and a hardship letter. Review these documents with an agent prior to listing your home. Additionally, “talk to an accountant about any tax liability for debt forgiveness,â€? Carver says. • Understand the repercussions. Develop a plan B strategy in case the short sale falls through. Also, make sure to comply with any laws in your state to safeguard against your lender filing a deficiency judgment against you. Some states allow for personal liability when a borrower defaults on a promissory note, which means you could legally owe the lender a deficiency – the difference between the principal balance due and the amount received. Conduct an initial title search to be sure any fines, liens or code violations are removed before completing the short sale. “Discuss your situation with a reputable attorney who is familiar with short sales, market conditions, tax implications and other legal outcomes,â€? says Robert Shiller, senior vice president of enhanced servicing, at Wingspan Portfolio Advisors in Dallas. • Settle on the right price. “Determine an asking price that reflects the home’s value, accompanied by detailed evidence of its disrepair, and then prepare a pricing strategy for reductions should the home not sell,â€? says Linda Perillo, associate broker and senior vice president at Heddings Property Group, Southampton, N.Y. “Price determination is what can make or break a short sale. The initial price must be at least the lowest comparable property in the area.â€? However, make sure the introductory price isn’t too low, Shiller warns. “Once you list a property, it’s hard to keep adjusting up if it is listed too low initially.â€? • Select the ideal buyer. “The strongest buyer is not always the highest price,â€? says Jim Lowenstern, CEO of Castles Unlimited, Newton, Mass. “There needs to be a good deal of patience on the buyer’s side. The buyer needs to understand the process to realize a short sale can sometimes take six months to a year to go through the channels of the lender.â€?

C

an’t afford to pay your home mortgage any longer? Tried loan modification efforts but struck out? Want to avoid the hassles and shame of a foreclosure? A short sale could alleviate your mortgage woes – provided you understand what’s needed to complete one successfully. The short sale is a process through which a property is sold for less than the amount owed on a mortgage, and the lender agrees to reduce the loan balance. They are becoming increasingly popular; data from RealtyTrac, a real estate website that specializes in foreclosures and bankowned properties, indicated that there were 35,000 short sales in January 2012, an increase of 33 percent compared to January 2011. Why are short sales appealing? They are less traumatic and damaging than a foreclosure, which will stay on your credit report for at least 10 years. On the other hand, there are some disadvantages. In a short sale, you’ll still be forced to move, your credit rating will be negatively affected and you may still be obligated to pay back some or all of the loan balance. The process is not simple, either; a short sale can take anywhere from six to 12 months. For those who wish to pursue a short sale, follow these steps. • Enlist the right agent or broker. “Make sure you are listing with an agent who specializes in short sales and is highly experienced in successfully obtaining approvals [from lenders],â€? says Leslie Carver, broker and sales associate, Prudential Americana Group Realtors, Henderson, Nev. It’s possible for a borrower to obtain short sale approval without help, but a listing agent can expedite this process. “Many [real estate professionals] have no clue what they’re doing and do not have the bank contacts needed to get it done,â€? says Anthony Lamacchia, broker and owner of McGeough Lamacchia Realty, Inc., Boston. • Get your financial house in order. Prepare all financial documentation to prove you cannot afford the home, including bank

Peter G. Miller refinance about a year ago. The deal worked like this: My lender offered to refinance my loan to a lower rate with no cash closing costs. By “nocost,� the lender meant that it would pay all settlement expenses except escrow account deposits. It may seem unlikely, but lenders can find it beneficial to offer this “no-cost� refinancing option for some specific borrowers, depending on the economic climate and the borrower’s financial standing. Since lenders – like everyone else – are in business to generate a profit, how could they possibly make money on a loan with a lower interest rate and no cost to the consumer at closing? Two ways. First, the lender could charge a higher interest rate than you might get elsewhere. Even though the new rate may not be the absolute lowest rate available, if it means smaller monthly CTW Features

costs than what you’re paying today, it could be attractive to the borrower, especially if there really are no closing costs. Second, the lender can sell the loan to mortgage investors and get cash from the transaction that way. But why would the lender want to refinance an existing loan with a higher rate from a steady borrower? Most probably, the lender no longer owns the loan. The mortgage has been sold and the lender now provides servicing such as collecting the monthly payments from the original borrower. The lender knows from credit records that the borrower is making payments and that the loan is likely to be refinanced because rates have fallen. Rather than lose a good borrower, the current lender steps in and offers a new loan, a better rate and lower costs. The sweetener is that the borrower pays nothing for closing costs. If you’re considering a “no-cost� refinance, make sure the lender provides a good faith estimate of closing costs before you accept any offer. Check the sheet with care and shop around. Also, see if you need cash at closing for any items not covered by the lender’s offer.

ne of the greatest challenges renters and landlords have is the disparity in opinions about what should be deducted from a security deposit. The tenant usually believes they have left the unit cleaner than they found it, that they were thorough and left nothing undone. The landlord is amazed to find food in the dishwasher drain, garbage still in the disposal, an oven that has caked-on stains, and a tub and bathroom bowls that still have crud on them. Perception is reality in the eye of the beholder and, if you don’t have proof, there is a problem. So clarity about vacating becomes another of the many things that renters and landlords or property managers must think of when the lease is signed. Understanding expectations and requirements about cleaning upon vacating is a must, and they should be clearly stated before move-in or at the time of move-in. Here are some of the ingredients that cause the problem: • The landlord or property manager fails to let the potential resident or the new tenant know the criteria for getting the security deposit back, and fails to do this at the very beginning. Tenants should ask for a list of what is expected. • There is no mention of non-refundable fees prior to signing the lease. This usually revolves around the non-refundable carpet cleaning costs. ...
