Rental agreements and lease-up By Joy Peck, Executive Director Landlord Association of the Inland NW

◆ Month-to-month or year’s lease? Both have advantages and disadvantages. Many landlords psychologically feel better believing they have a year’s rent that can be counted on, but tenants can and do move out in the middle of the night or give notice when their life circumstances change. To end a lease (a rental document with a specific beginning and end date), there must be “cause,” and except for non-payment of rent, cause is extremely difficult to prove and usually unsuccessful. A month-to-month rental agreement can be ended by either party with only a 20-Day Terminating Notice, but good landlords don’t lose tenants and good tenants very seldom are asked to leave by landlords. ◆ Use the required forms. To be in compliance with Washington State and federal laws, a landlord or property management company MUST have the following forms completed: 1. A written Rental Criteria, provided to the applicant. (Required as of June 7, 2012) 2. Lease or Rental Agreement signed by all parties over 18 3. Property Condition Report (sometimes called Inspection Checklist). 4. Smoke Detector Form/Carbon Monoxide Form (Mold and Mildew Addendum) 5. If your rental is older than 1978, a Lead-Based Paint Disclosure Form is required and along with the form, the Lead-Based Paint Booklet must be given to the tenant. ◆ Conduct the walk-through and get signatures of all parties over 18 on the Property Condition Report, note any damages or repairs to be made, take photos if possible of the move-in condition of the unit. Discuss any cleaning or carpet shampooing fees that are non-refundable. The security deposit rests on this document so without a completed Property Condition Report of some type, the tenant will be able to collect the entire deposit with NO deductions for unpaid rent, unpaid utilities, damages, pet damages, cleaning or repairs. ◆ At this time, collect the security deposit, first month’s rent (and last, if you require that), and any other deposits. You may require a pet deposit or a smoking deposit, any extra fees or rents for parking, storage areas, or garage spaces. ◆ Take the time to go over the lease and answer any questions completely. This may be the most important step in lease-up. Explain when the rent is due, any grace period you have, but emphasize that a grace period does not translate into letting a tenant pay late each month. Explain that late rents will result in a pay-of-vacate notice of some type and that you adhere strictly to this policy without exception. (You can later decide to make exceptions or not for good tenants in a

jam, but don’t begin the tenancy by putting this in the tenant’s mind.) Review noise, pet, parking, snow removal obligations (if any), and other items of importance. All these are listed on the back of the LLA lease/rental agreements, so it is easy to read and is on all copies of the form so the tenant always has the terms of the lease and knows his/her obligations. If you have additional snow removal or yard care requirements, LLA members can ask the office to prepare an addendum specific to their needs. ◆ If you are renting to roommates or students, have a roommate agreement or House Rules signed by all parties. This will be a lifesaver later on when complications, disagreements, and chaos ensues among the roomies. There is a sample of the LLA House Rules form or you can make your own. ◆ Make certain the tenant(s) understand the smoke detector/carbon monoxide, lead-based paint, mold and mildew and pet addendums. These forms are extremely important and concern tenant health and safety as well as the property owner’s legal obligations. It can also impact insurance coverage for the landlord and the tenant’s renter’s insurance policies. ◆ If you require tenant or renter’s insurance, get that documentation now. Or if you allow 30 days for the tenant to acquire that, be certain they know that not getting you the documentation within the first month will constitute a breach of lease. When you get the insurance documentation, contact the insurance agent and asked to be notified should the policy be cancelled during your tenant’s residency with you. ◆ Trade contact information and get emergency contact names and two ways to contact them. Should a tenant be hospitalized, jailed, a leak spring during a vacation absence, car accident, etc. you must be able to find out who is allowed inside the unit to get medicines, clothes or other items. In case of death, know who is permitted to enter and inventory possessions and/or take possessions. These emergencies happen more frequently than expected. The Tenant Emergency Contact Form is available at the LLA office and covers all the bases. ◆ Give the tenant(s) the keys and explain your lost key policy. The LLA has an example of a lost key policy as a starting point. “Keys to Renting” content is for informational purposes only and not meant as a substitute for legal advice.
