he pounding of rain or hail, the fury of wind and the weight of snow and ice test the strength of a tree’s limbs, trunk and root system. The care you give your trees before and after a storm can be the key to their survival and keeping them from falling on your home, car or other valuable property. Planting and Pruning Carefully choose your trees and consider their location when you landscape. Know how large a young tree can be expected to grow to at maturity, and avoid planting it near wires, too close to a building, or in spots where it will be in danger of blowing over. Planting trees in groups, or planting species with naturally deep root systems can also help prevent trees from being blown down. To prevent weakness, trees should be pruned when they are young. As they grow, pruning dead or weakened limbs annually and thinning excess branches from the crown will help keep them strong. The goal is to produce a well-shaped tree with the center of gravity squarely over its trunk. Water, fertilize and protect the soil from compaction to keep trees and roots healthy and vigorous. After a Storm The confusion following a major storm can result in removal of trees that could be saved or the improper weakening of a tree that can reduce its healthy life. Homeowners can lose money as well as the beauty and practical benefits of their shade trees with poor advice and the services of fly-bynight tree “experts.” Tree work can be extremely dangerous. A professional tree care company should be used when: • a tree is large and requires high climbing or the use of a chain saw; • a tree is leaning on a structure or entangled with another tree; • wires are involved or structures are endangered; • major repair of the tree is necessary; • a large limb is split or broken but still attached to the tree; • when you do not have the proper tools, knowledge or health to do tree work. It is wise to get more than one estimate. When removals are necessary, have a clear understanding about who removes the limbs and debris from the property, and whether or not the price includes stump removal and clean-up. Your tree will have value as firewood or chips that should be considered in the estimate. The Screening Process ◆ Have a written, dated applicant criteria and attach to every application. (As of June 7, 2012, this is required by law as explained in detail in the previous Keys to Renting article.) ◆ Chose a reputable screening company that offers screening choices for the small landlord or property manager and become a client. You do not have to have your home or office inspected before you can get the necessary screening information. The complete Commercial Credit Report does require an inspection, but there are a variety of other types of reports that are helpful and provide rental history, employment history, court records, and creditworthiness recommendations that do not entail an inspection. Your screening company can tell you about the varieties of screening reports you can choose from. ◆ Know your application form inside out and require that every question be answered!! Your criteria can state that incomplete or illegible applications will not be processed ◆ Do not discriminate. Follow the Fair Housing Rules completely. Know the protected classes and do not exclude applications due to race, ethnicity, familial or martial status, disability, age or sexual orientation. ◆ It’s often a problem if you tell an applicant that they are “the one,” or the “first one.” Should the screening process turn up something negative, that applicant will still expect to move in and could assume discrimination, file a complaint, or make your life stressed for a while. If asked or pressed by an applicant, respond that your application process is open for x number of days or until the unit is ready, etc. and the first application returned from the screening company that meets the criteria will be signed up. ◆ Make certain that each applicant has signed a statement saying they have received and read the rental criteria. The LLA has revised our Application to Rent to include a line toward the bottom of the page that reads, “I have read and received a copy of the Rental Criteria for the above vacancy.” There is a line for their initials. This indicates you have complied with the law and protects you from complaint. Since this is a change in the law, there may be testers pretending to apply for your vacancy to determine if property managers and landlords are giving each applicant a criteria, so make
this a part of your application process without fail. ◆ Collect an application fee. In Washington State, an applicant is responsible for paying their own screening fee, unless a landlord or property management company wants to waive it or split it. Have the applicant make out a check and write it to the screening company directly, if possible. The reason for this is that an applicant may be hoping that the landlord is going to pocket the money and not screen, thereby missing some important information that the applicant may not want known. When a check is written to a screening company directly, this causes some applicants to “self-screen,” that is, they decide not to continue the process. This saves them application fee money and the landlord the hours it takes to check references and perform the screening process. Read the applications thoroughly to see if the applicant meets your official rental criteria. ◆ There are legitimate reasons to reject an applicant and Landlord Association members can ask the office to email, fax or mail them a list of seventeen legal reasons. As long as you have a written criteria, are completely consistent in abiding by it, and the criteria items are based on nondiscriminating factors, a landlord or property management company may reject an applicant based on those items. If you reject due to information from the screening report, the screening company needs to prepare an Adverse Action Report for either your or them to give to the applicant. ◆ When you receive a screening report that is favorable, contact that applicant and let them know. Contact the other applicants and express appreciation for their interest and regret that you had only “x” number of vacancies and they are now full. Wish them luck in their search and if you did not process their application yet through the screening company and pay the fee to the screening company, return the full application fee. You are not permitted by law to profit from application fees. ◆ Proceed to the lease-up of your new tenant. That process will be covered in the next Keys to Renting article. QUESTION: I have a first and second mortgage on my home. Last year, my lender agreed to a loan modification on the first. The problem is that the lender will not help with a re-fi or loan modification on the second lien. Any suggestions? ANSWER: Let’s imagine you bought a home six years ago for $300,000. You got 80 percent ($240,000) from the first loan, 15 percent ($45,000) from the second and paid $15,000 in cash plus closing costs. Today the property is worth $200,000. That means there is no equity. If the property is foreclosed, any money from the sale will go to pay off the first lender. If there is anything left after the first lienholder is paid – and in this example, there isn’t – then the second lienholder may get some money. Your question raises several points. First, the lender will not refinance or modify the second lien because the property has little or no equity to secure the mortgage. Second, it may appear that both loans are owned by one lender, but that may not be the case. It’s entirely possible that you’re speaking with the loan “servicer,” a company that collects monthly payments. The two loans may be owned by different investors. Even though your property has little or no equity, it may be possible to change the terms of the second mortgage under the government’s Second Lien Modification Program (2MP). However, for this to happen the first lien must be modified through the federal Home Affordable Modification Program (HAMP), and the second lien owner must be among those who participate in 2MP. Just getting the first mortgage modified through HAMP could greatly ease financial issues – the typical monthly savings with a successful HAMP refinance is $536. In other words, even if the second lien cannot be modified, a HAMP modification could still help. Debt dip spells housing gain As household debt declines, prospective homeowners have a better shot at obtaining the mortgage they want. Marilyn Kennedy Melia CTW Features
o wonder the housing market hasn’t made a really robust recovery: There’s a $11.38-trillion weight in the way. Collectively, American households owed $11.38 trillion in student loan debt, credit card balances, auto loans, mortgages and equity loans in the second quarter of this year, according to the Federal Reserve Bank of New York’s Quarterly Report on Household Debt and Credit. To be sure, that’s a big number, but it’s down $1.3 trillion since the peak of indebtedness in the third quarter of 2008. “The fact that overall debt is trending downward is a good omen for the future,” says Scott Hoyt, senior director of consumer economics at Moody’s Analytics. “If we don’t borrow today, we have more to spend tomorrow,” he explains. Many, however, don’t borrow today because they simply can’t. Case in point: A Federal Reserve study released at the beginning of this year finds that 9 percent of 29to 34-year-olds got a firsttime mortgage from 2009 through 2011, compared with 17 percent ten years earlier. Students are graduating now with about a $25,000 average loan debt, notes Fred Amrein, a Wynnewood, Pa., fee-only financial planner who specializes in education funding. Although federal loans offer repayment plans that can ease the monthly payment, “it can be complicated for graduates, because many have several different loan types,” Amrein says. Still, the fact that people haven’t taken on significant new debt, and the recession has prompted some to more diligently pay down existing debt has boosted the FICO credit score – the number mortgage lenders use to evaluate borrowers – of a sizable portion of consumers. “The average FICO score has stayed constant at 690,” notes Anthony Sprauve, FICO spokesperson. Some consumers’ scores have been badly damaged from foreclosure or other woes, but others have improved their scores, explaining why the average has remained constant. Lenders offer better rates on mortgages to those with good scores, says Keith Gumbinger of the mortgage data firm, hsh.com. The lower the mortgage rate, the lower the monthly payment, he adds, and that’s a combination that makes home buying easier.
