Welcome to My Buyers Resource Guide for YOU

For 49 years, I have been“in training”here in Steamboat Springs to help you purchase real estate. We will cover many topics in the following pages, so feel free to browse this guide. I am licensed, insured, and will operate under a detailed written employment agreement we call an“Exclusive Right-To-Buy Listing Contract – Buyer Agency.” This agreement details the duties I owe you to promote your interests. A current, serious topic is the cost and availability of Insurance; we will be sure to investigate and question for you.

My value to you is the skill I have accumulated in the local real estate business here in Steamboat Springs. I have participated in over 660 real estate transactions with real estate as my full-time business. My compensation is a success fee paid only upon a proper closing of the transaction on your behalf (a commission.) You will want the Seller to pay my fee if possible and will instruct me to request that payment at Closing via our Buyer Agency agreement.

Steamboat Springs – A Rich History

Nestled in the wide, open spaces of the Yampa valley on the western slope of the Continental Divide, Steamboat Springs has long been known for it’s western hospitality.

Long before Steamboat Springs became the world-class resort it is today, the Ute Indians adopted the area as their summer home. The Yampa Valley was the summer hunting grounds of the Ute Indians for hundreds of years. The first white men passed through the area in the early 1800s. The name Steamboat Springs is said to have originated in the 1820s when three French trappers traveling along the Yampa River heard a “chug, chug” sound. Thinking they had reached a major river one yelled, “a Steamboat, by gar!” Upon further investigation, they discovered the sound came from a natural mineral spring, to be named the Steamboat Spring. The town that grew up around that spring became Steamboat Springs. The Steamboat Spring still sits at the far end of town; however, it ceased to “chug” when the railroad bed was laid above it in 1908.

I t wasn’t until 1875 that the first permanent settler, James Crawford brought his family to this area. Crawford lived peaceably among the Ute Indians, who annually visited the “medicine springs.” After the removal of the Indians from Colorado in 1880 following the battle at Milk Creek, other settlers gradually joined the Crawfords. By 1885 five other families had settled in the area.

T he earliest mail service (from Georgetown) was by skis or snowshoes in winter, horseback or afoot in summer. Extension of the Rio Grande Railroad from Leadville to Wolcott in 1888 saw the establishment of a regular stage line, with coaches in the summer and sleds in the winter. This provided both passenger and mail service. The stage line was much improved in 1890 when the state bridged the Grand River, now the Colorado River.

From the earliest times, one of the town’s greatest attractions was the Bath House, supplied with natural hot mineral spring water. On this same site on the east end of Lincoln Avenue, the Steamboat Springs Health and Recreation Association operates the spring fed pools currently in use.

M ajor improvements to the town occurred in the late 1880s, including the building of the Sheridan Hotel, a fine sawed log a structure built by Henry Schaff on the west end of town, and the first bridge across the Bear (now Yampa) River near the Bath House in 1889. Neither of these structures remains today.

Submitting An Offer

Once you have found the right property, the next step is to make a purchase offer to the seller.

DETERMINE THE PRICE YOU WANT TO OFFER

• The price the seller is asking may or may not reflect realistic market value

• The best way to determine market value is with a Comparative Market Analysis (CMA) showing similar properties that sold recently, those currently active on the market and those that failed to sell

• I will discuss with you an estimate of costs associated with purchasing this property

DECIDE ON FINANCING

• We will review together the status of your loan pre-approval

• You will work with your loan officer to understand financing options and help you determine the mortgage plan that best fits your requirements.

DECIDE ON OTHER ISSUES THAT ARE IMPORTANT TO YOU

• Items of personal property you want included with the house

• Warranty, inspections, repairs or other home enhancements by the seller

• Closing date and possession

Definitions of Relationships

SELLER’S AGENT A seller’s agent (or listing agent) works solely on behalf of the seller to promote the interests of the seller with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the seller. The seller’s agent must disclose to potential buyers all adverse material facts actually known by the seller’s agent about the property. A separate written listing agreement is required which sets forth the duties and obligations of the broker and the seller.

B UYER’S AGENT A buyer’s agent works solely on behalf of the buyer to promote the interests of the buyer with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the buyer. The buyer’s agent must disclose to potential sellers all adverse material facts actually known by the buyer’s agent including the buyer’s financial ability to perform the terms of the transaction and, if a residential property, whether the buyer intends to occupy the property. A separate written buyer agency agreement is required which sets forth the duties and obligations of the broker and the buyer.

TRANSACTION-BROKER A transaction-broker assists the buyer or seller or both throughout a real estate transaction by performing terms of any written or oral agreement, fully informing the parties, presenting all offers and assisting the parties with any contracts, including the closing of the transaction without being an agent or advocate for any of the parties. A transactionbroker must use reasonable skill and care in the performance of any oral or written agreement, and must make the same disclosures as agents about all adverse material facts actually known by the transaction-broker concerning a property or a buyer’s financial ability to perform the terms of a transaction and, if a residential property, whether the buyer intends to occupy the property. No written agreement is required.

CUSTOMER A customer is a party to a real estate transaction with whom the broker has no brokerage relationship because such party has not engaged or employed the broker, either as the party’s agent or as the party’s transaction-broker.

Glossary of Terms

ACCEPTANCE Consent to an offer or contract.

ADJUSTABLE RATE MORTGAGE (ARM): Interest rate and monthly payments are adjusted periodically during the life of the loan to correspond with changes in the money market. The initial interest rate is usually lower than that for a fixed-rate loan. A cap limits the amount by which the rate or the payment can change.

AGENT Someone who is authorized to represent another individual (the principal).

AMORTIZATION The process of paying off a debt by installments normally by equal installments over a fixed period of time as in a 30 year fixed-rate mortgage.

APPRAISAL A formal opinion or estimate of value by one who is qualified to evaluate factors of value. In real property appraisals the purpose of the opinion may affect the type of report issued, e.g. insurance, market value, tax assessment, etc.

ASSESSMENT A special charge placed against a particular property for some specific purpose such as installation of sidewalks.

ASSUMPTION OF MORTGAGE The process of assuming personal liability for the payment of existing loans for which property is the security.

BALLOON PAYMENT The amount due when a note or mortgage becomes due which is in excess of normal installment payments.

BILL OF SALE The legal document used to transfer title to personal property.

BROKER One who acts as an agent or negotiator for his principal when dealing with third parties on behalf of his client.

BUILDING CODE The code of restrictions established by a government body for regulating the construction of buildings.

CARRYING COSTS The various expenditures necessary to maintain a property from month to month such as taxes insurance repairs.

CLOSING COSTS Additional cost other than down payment needed to purchase a property. They include points application fee and year’s premium for hazard insurance tax and insurance escrow deposit city revenues stamps, recording fees and attorney’s fees,

CLOSING STATEMENT The settlement sheet that is a statement of debits and credits for the buyer and seller in summarizing the costs involved when selling property.

COMMITMENT An agreement to loan a specified amount to a purchaser in the event of title transfer or to a seller in a refinance arrangement.

Glossary of Terms

CONDOMINIUM An apartment house subdivided to give title to individual occupants by a description of the air and ground space involved for each unit. A form of real estate ownership.

CONTINGENCY Any requirement in a contract which must be completed before the contract can be considered ready for performance; most commonly refers to a mortgage contingency.

CONTRACT An agreement negotiated and entered into by two or more parties who exchange mutual promises to perfiwnt certain acts in accordance with the wishes of both parties.

CONVENTIONAL MORTGAGE Any mortgage that is not government insured is considered to be a “conventional” mortgage.

CO-SIGNER One who accepts equal obligation for the performance of a contract, note, or other act by affixing his or her name to the documents involved.

DEED A written instrument, which conveys title to real property.

DEFAULT Failure to perform the acts or promises made, such as the default on a mortgage when payment is not made on time.

DISCOUNT POINTS Refers to the points paid in connection with an FHA/VA loan. Will fluctuate with the money market (see points).

EARNEST MONEY A sum of money given to bind an agreement or an offer made to show good faith.

EQUITY The interest one has in real property as an owner above all existing indebtedness.

ESCROW A depository for papers funds and instructions with a third party who is then obligated to carry out all instructions providing they are in complete agreement.

“FANNIE MAE” The nickname given to the Federal National Mortgage Association operated by the government as a secondary market for mortgage loans.

FHA LOAN Federal Housing Administration loans are insured by the federal government. Interest rates can be lower than for conventional loans but the real advantage lays in the low down payment requirement, usually under 5%. These loans are assumable. Usually “discounts points” must be paid and can be paid by either buyer or seller as agreed.

FIXED-RATE MORTGAGE Interest rate monthly payments remain the same for the term of the loan.

GIFT LETTER A letter prepared for a mortgage, which verifies that the sums of money being used as a down payment were a gift from a relative made without obligation of repayment.

LEASE An agreement by which real estate is rented for a fixed period time.

Glossary of Terms

LEGAL DESCRIPTION A description of property, which can be recognized by law and by which the property in question can be definitely located by reference to recorded maps.

LISTING A contract with a real estate broker authorizing that broker to be the sales agent for the property.

LONG TERM CAPITAL GAIN An increase in the value of an asset occurring over a period of at least 6 months duration and on which the owner can claim special tax privileges when the property is ultimately sold.

MARKET PRICE The price a property should bring based on comparable sales of similar properties within recent months.

PERSONAL PROPERTY That which is essentially moveable or not affixed to real property.

“P.I.T.I.” A phrase used to denote the components of a mortgage payment: principal interest taxes insurance.

POINTS A term used to describe loan discounts collected by mortgage lenders as a means of increasing their yield on real estate loans. A point is I% of the amount of the mortgage.

PRINCIPAL One who employs an agent or becomes a participant in a real estate transaction as owner, buyer, etc.

PRIVATE MORTGAGE INSURANCE (PMI) An insurance premium charged by lender to buyers with less than 20% down payment. PMI insures lender in the event that buyer should default on the loan.

PROMISSORY NOTE A written promise to pay a certain sum of money at a definite date in the future.

PRORATION To divide proportionately among the parties involved based on a fixed date of computations their share of an obligation paid or due eg, taxes, water, sewer, rents.

SECONDARY MORTGAGE MARKET The outlet for primary mortgages to those who buy them for investment after the original lender has completed his purchase of the loan.

VA LOAN Only veterans of the United States Armed Forces who have received an honorable discharge are eligible to receive these loans.

How Do We Compete with a Cash Offer?

Dear Client………

Given the continuing low inventory of properties for sale and the active demand for real estate in Steamboat Springs, here are my tips to YOU to compete with a cash buyer if you wish to obtain a Loan. I urge you to contact a Lender of your choice and become “pre-approved.” Please study these ideas and ask me questions and perhaps consider a new opportunity included at the end of this presentation.

1. Offer more than List Price – motivates many Sellers. Selling prices of many closed sales in our market, especially condominiums in the lower price ranges, are continuing to show higher sales price than the initial listed price.

2. Increase (double?) the Earnest Money – you are a serious Buyer. Your Earnest Money has several protections in the purchase contract.

3. REALLY, REALLY Get PRE-APPROVED – Formally apply to and obtain a letter from your chosen Lender stating you are pre-approved for the loan you are proposing in your offer. All preapprovals are not the same; a pre-approval from a reputable lender, especially on a popular property can make a difference. You should assemble your financials before you begin so that your lender can act in a timely manner for you. The letter should be on the Lender’s letterhead, signed by your Lender and show contact information for your chosen Lender. The letter needs to be submitted with your offer to purchase. * Pre-approval means you have completed a Loan Application, have had your credit run by your chosen Lender, and your chosen Lender has looked at some of your financials before writing the pre-approval letter. A proper pre-approval will have qualifiers from the Lender. (* Note: You may qualify for more than the loan amount you are seeking. Be sure your Lender loan approval letter lists only the amount of loan you are requiring in your purchase Contract.)

4. Offer “proof of funds” for the section of our contract where you certify that you have the funds available for your proposed purchase (§ 4.4.3) This action can be as simple as providing the name of your Banker. The Listing Broker can call your Banker on behalf of the Seller to verify. You certainly do not want to give out account # information, although a redacted bank statement will say volumes to the Seller.

5. Pay the “appraisal gap.” Insert a clause in your offer stating that you will pay the difference between the Contract Price and the Appraised Value in cash at closing – this may increase your

down payment / out-of-pocket cash, but the Seller will know that you are not going to ask for a lower price if the appraisal is received and does not meet the Contract Price. Placing a cap on the “appraisal gap” amount you will pay will give you some control (i.e., less than $50K, etc.)

6. Seek a lower loan-to-value (LTV) – i.e., a 70% loan or less. Leveraging your money with a high purchase LTV will create a higher interest rate for you. More down payment is the norm to compete with cash. More down payment may also help you obtain a lower interest rate in these times of higher interest rates.

7. Inspection. OK to have this provision but qualify to state the inspection will be to determine the condition of the major mechanical, health, and safety systems only. There are additional strategies we can employ regarding inspection. See #9., below.

8. Appraisals. This part of the loan process created lengthy delays in loan processing in the past and caused more than one Buyer to lose a purchase when a “back up Buyer” was ready to proceed quickly when a Seller would not extend the appraisal deadline. The problem has lessened somewhat now, and we are seeing shorter appraisal times. One “work around” that has helped Buyers obtain a timelier appraisal is to state that you, the Buyer, will instruct your Lender to order an EXPEDITED APPRAISAL and pay the additional cost charged by the Appraiser who agrees to perform the appraisal. You will wish to discuss this idea with your Lender prior to proceeding.

One trend due to the above is that we are now seeing out-of-area Appraisers working in the Steamboat Springs market and joining our Board of Realtors MLS system to access accurate comparable data. These appraisers have helped ease the backlog. However, demand for housing continues strong; local competent licensed Appraisers are always in demand.

9. Inspection Section of Contract (§ 10.3). Our real estate contract allows you to inspect all parts of the property. Most often, a Buyer engages a home inspector for this purpose and then, if needed, can have a professional inspect in more detail (electrician, plumber, engineer, etc.). One tip you might consider is eliminating the box called “Inspection Objection Deadline” but retaining the box called “Inspection Termination Deadline.” This tactic still allows you to terminate the contract if you find major issues but tells the Seller that you will not “nickel and dime” items you find that need correcting. This is a refinement of my Tip #7, above.

10. Offer to pay costs historically paid by the Seller: Survey; Title Insurance; Seller Closing Costs.

11. You may be forced to participate in a “bidding war.” If so, you might consider your “highest and best” offer from the beginning. You may have heard of what is called an Escalation Clause in real estate contracts. You state that you will pay “x” $ above the highest offer (but not to exceed a certain price amount). I am not a fan of this tactic as it “shows your cards” right up front in the negotiations. Also, use of these clauses has fallen upon disfavor with the regulators and Attorneys.

12. Consider “Delayed Refinancing.” This tactic may have great appeal to you if you can pay cash but wish to ultimately leverage your funds when interest rates are more favorable. The advice of a good Lender is very important to You.

I do not want you to overspend and be uncomfortable based on what YOU can afford, however, the market is active. I suggest you want to sit down BEFORE you “jump in” to the buying process to determine exactly what you will be comfortable investing and how you might apply these tips. You may

move to considering a property you have not previously envisioned. You will likely be paying more than you anticipated.

FYI: new construction not “in the pipeline” in our area continues to be two / three years into the future. Construction costs continue rising. Given past lumber tariff issues with Canada, and now wildfires, the December 2021 Marshall Fire in Boulder County, and the virtual “year-round building season,” lumber prices / futures continue to rise. I completed a personal project in 2022. The project required metal siding. I paid prices for “metal” (think metal roofing/siding) that “went through the roof” – no pun intended.

Given this less-than-rosy but accurate presentation, I have three suggestions for you.

MAKING SENSE OF HOMEOWNERS INSURANCE

If there’s one thing that goes up and doesn’t come down, it’s homeowners’ insurance. It’s not uncommon for policy holders to see their premium rates double or even triple with a renewal notice at the end of the year. So what gives?

“Basically, Colorado is now considered a high-risk state when it comes to wildfire,” says Savanah Harding, Personal Lines Lead, Mamich Insurance Agency. “The big event that triggered this was the Marshall Fire. It was the straw that broke the camel’s back.”

The wildfire started in Boulder County Colorado on December 20, 2021, and quickly spread from a grass fire to become the most destructive fire in Colorado history

in terms of the number of buildings destroyed. “The fire caused rebuild rates to double because of the increased demand,” Harding says. “The demand surge caused a shockwave through the industry.”

Harding says to understand the insurance industry, you have to look at the bigger picture, not just what’s going on in your own backyard. Insurance carriers are national corporations with policy holders across

the U.S., so a major disaster affects everyone, not just homeowners in the area where the incident occurred.

“Hurricane Ian was an eight-billion-dollar loss to the insurance industry. Each carrier is supposed to keep a percentage of premiums for its reserves, but when you have a major incident like that, it drains the company’s reserves, and that’s why they have to increase premiums, even here in Colorado.”

Harding says a common refrain regarding dramatic premium increases is “I’ve been with this company for 40 years and never filed a claim.” Unfortunately, the reality is an individual track record has little to do with premium rates.

The question is: what can a homeowner do to save money when it comes to the rising cost of homeowners insurance?

Now that Colorado is considered a high-risk state because of wildfire, that’s going to be one of the biggest variables an insurance company is going to

look at when determining the cost of protecting your home. The good news is there are things you can do.

“Insurance companies want to see that you’ve created a defensible space around your home. Clearing brush. And cluster of trees should be at least 75–100 feet away from any structure and landscaping around your home should be neatly kept,” Harding says. Consider installing irrigation surrounding your home to protect it from wildfires and having a specialist come out to do an inspection or give recommendations on how to create a defensible space.

Another important thing to consider when purchasing a home is that its within five miles from a fire department. “Once you’re farther out in more rural areas coverage gets trickier,” Harding says. “Some companies simply won’t insure a property farther out, period.”

In addition to fuel sources close to your home, insurers will also look at the degree of slope your lot is on, as well as access—both characteristics that are typical for a lot of mountain homes.

With the increased risk and more complicated variables here in Colorado, Harding warns homeowners not to try to cut premium costs without consulting your agent because it may very well ending up costing you more in the long run, should something happen. “Just because you can get on app or website and buy a policy doesn’t mean you’re insured for what you think you are.”

“When the Marshall fire occurred, we heard so many stories about people who believed they were getting screwed by their insurance company, but most likely they got online, built their own policy and were just trying to make it cheap and didn’t realize that cheap coverage also meant less coverage,” Harding says. “It’s important to work with an insurance agent who can walk you through how much a policy costs and what you carry so if you do experience a loss, you have someone you trust who can walk you through it.”

An insurance agent has a program to estimate your home’s replacement cost which is especially important in a luxury resort market like Steamboat where the cost of construction is constantly going up. “With our replacement cost estimator, we can get as specific as the replacement cost of each window or types of countertops and hardwood floors.” Harding says any high value item such as jewelry or artwork should be appraised and documented. There are even specialty insurance companies that will provide coverage for jewelry specifically—again, this is something an agent can look into for you to make sure you’re adequately covered.

There are still ways to cut costs, it just has to be done strategically. “One way to save is to do a split deductible, which means you have a separate deductible for wind and hail. Those types of claims are unlikely to happen here in Steamboat, so it can be separated from what is known from an ‘all perils’ deductible you’d use in the case of theft or fire. This can help keep the overall deductible cost lower,” Harding says.

If you are a buyer, keep an eye out for items that might make a home harder to insure. If the home has a retaining wall, make sure it’s vented for water so it won’t move or shift over time. Newer rooves are important too. “Most companies will not provide replacement coverage for a roof that is more than 20 years old. A roof that is 21 years or older may only be covered for its value before it was damaged.” It’s especially important to consider this if you’re looking to purchase a condominium. “Older condominium complexes might be cheaper, but keep in mind that insuring an older property is going to be a lot more expensive to insure,” Harding says. This is also often the reason HOA dues rise dramatically, is because of the cost of insurance.

If your rates go up, you definitely want to shop around. Just make sure you don’t sacrifice your coverage for a lower premium. “That’s when you want to have an agent who understands the industry and can tell you ways to save,” Harding says. “It’s a tricky balance.” //mamichagency.com

2023 YEAR IN REVIEW

The real estate market has stabilized in resort towns throughout the Western United States since the frenzied pace seen in 2021-2022. In 2023, there was a dip in several key metrics, including the number of properties sold and sales volume. However, the average sold price increased in 14 of 17 resort communities across the Mountain West profiled in this report. This average increase was 12.42%, demonstrating buyers’ ongoing desire for areas that offer yearround recreation like skiing, hiking, fly-fishing, and golf. Destinations with the largest jump in sold prices were Park City, Utah; Big Sky, Montana; and Sun Valley, Idaho. The average price per square foot also rose in 12 resort areas, ticking up by 4.5% in 2023.

These scenic locales, with access to national forest and a variety of outdoor activities, had limited

inventory throughout 2023, resulting in a decline in sales volume, which dipped by an average of 10.7% overall. Rising home prices and a decrease in new construction within several resort areas contributed to less buyer demand this past year. Homeowners were also less inclined to sell as they were happy with their current property and location, adding to the lack of inventory available for buyers.

The annual Steamboat Sotheby’s International Realty Resort Report provides analysis for the markets of Aspen, Beaver Creek, Breckenridge, Crested Butte, Snowmass Village, Steamboat Springs, Telluride, Vail, and Winter Park in Colorado; Park City, Utah; Sandpoint and Sun Valley, Idaho; Jackson Hole, Wyoming; Big Sky and Whitefish, Montana; and North and South Lake Tahoe, California/Nevada.

The rivers, lakes, and towering peaks of the Mountain West offer adventure opportunities throughout the year, along with expanded options for dining, entertainment, and shopping.

Property sales are likely to be affected by inventory constraints as buyers seek out primary residences, vacation homes, and investment opportunities in resort communities with limited building space.
