UNDERSTANDING YOUR RIGHTS AND RESPONSIBILITIES AS A TENANT or A LANDLORD The Tenant – Landlord relationship has long been a source of conflict. It really needn’t be the case, a beneficial and stress free relationship can be maintained if either party is informed and understands their rights and responsibilities. The Housing and Building Act [Chapter22.07] and the Rent Regulations Statutory Instruments 676 of 1983 and 32 of 2007 Form the basis of tenant – landlord relationship in Zimbabwe, most leases are based on the provisions of these regulations. What follows is an outline of what we, in our experience , feel are the fundamental aspects of this relationship that all parties should always be aware of-:

Tenant’s responsibilities These include but are limited to: • • •

The Lease Agreement The most important aspect of the Tenant – Landlord relationship is the Lease Agreement which both parties should take care to familiarise themselves with. This document sets out the expectations of both parties. Furthermore each party has certain rights and responsibilities and it’s important that they know and understand what these are. The lease agreement helps to clarify your rights and responsibilities and provides possible remedies to ensure that everyone is protected and knows what they should and shouldn’t do.

Any special conditions like taking care of special equipment

Select a tenant without engaging in any form of housing discrimination Access to inspect, repair, maintain Get paid rent on time in exchange for the tenant’s use of your property Collect a security deposit Restrict tenant from subletting Have tenant legally evicted if he damages property or violates lease terms like paying rent late.

Landlord’s responsibilities Tenant’s rights As a tenant you have the right to: • be protected from unfair eviction and unfair rental increases • have your deposit protected • get your deposit back at the end of your tenancy within 15 days of vacating the leased property, as long as you meet your responsibilities as a tenant • live in a property that’s in a good state of repair and is safe

Insure the property Maintain the property in accordance with health and building by-laws. It should be clean, safe and habitable. Provide information to tenants about any conditions affecting the property Provide proper receipts and records of transactions pertaining to the tenant Ensuring the property is pest free when the tenant moves in. Thompson Properties ABOUT US Jonathan Thompson is the founder and director of Thompson Properties (Pvt) Ltd. He grew up in the United States of America, working at his own businesses from the age of 11 years old. He loves business and has always excelled at sales. Jonathan worked in construction industry from the age of 16, and throughout his time at university. Shereen Thompson, a director of Thompson Properties, was born in Zimbabwe, before living in the United States for 13 years. She attended university in Rhode Island, where she met Jonathan. After university the two were married in Mwenzi, Zimbabwe in 1990. From 1990-1999, Jonathan and Shereen Thompson managed an apartment complex in Tulsa, Oklahoma. In that time, the complex hit record occupancy rates and rental collection rates. While working at Utica Manor, Jonathan started Thompson Imports, an import/export company. Jonathan and Shereen Thompson moved to Zimbabwe full time in 1999. They worked together in Chipinge as the pastors of Chipinge Community Church. They spent time with local orphanages and ran feeding programs for the needy. In 2006, they moved to Bulawayo where they opened businesses and assisted churches and orphanages. In 2011, Jonathan began working for R.E.D. Property. While there, Jonathan was the leading sales person each year. Jonathan re-built R.E.D. Property’s property management portfolio. He then opened R.E.D’s second Real Estate

branch in Ascot, Bulawayo, and then later their third branch in Bradfield. He passed the EAC (Estate Agents Council) Real Estate exams in 2014. He became a Registered Agent with EAC in February 2015, with the Registered Agent’s number of #916. or the last few years the trend in interior décor has been almost exclusively for many different shades of grey – whether for interior paints, upholstery and curtaining fabrics, carpets or accessories. While grey is eminently versatile and adaptable it can become just a little tedious and boring. The owners of this home are certainly not afraid of celebrating colour and they’ve done so in a really stylish way. The old farmhouse was one of the original homes in the area, built in 1914, so it’s seen a lot of history. The current owners bought the house back in 1994 and it’s been the family home since then – although the children have grown up and moved away, hopefully to return sometime soon. It was originally a four bedroom house with two bathrooms but has been renovated and redesigned to become a three bedroom house with three en suite bathrooms. There are also additional bedrooms and bathrooms in the newer outbuildings – two bedrooms in the thatched cottage, as well as a self-contained studio apartment, bringing the accommodation up to six bedrooms and six bathrooms. The main approach to the house gives a hint of what lies inside. Dramatic black and white chequerboard tiles clad the front porch and wrap around the side of the house and on to the west facing verandah. The tiled outdoor spaces are broken up with water features, bass reliefs, and - of course – the obligatory potted plants in terracotta containers, vines, and vibrant red geraniums and pelargoniums. The tiles recall the grand Italian palazzos of Venice and Milan but there’s a little added detail. African sculptures live happily on either side of the door under classical coach lamps. 34

The front door has a stained glass, Art Deco inset created by local artist Annalie Maartens. The entrance leads into a rather grand foyer with a formal lounge to the left and a dining room to the right. Originally the entrance would have been to a rather dark passageway with rooms leading off to either side through smaller doors but now a series of large arches create integrated and coordinated spaces.

residential profile To the left is the formal lounge painted in a glorious, rich, golden yellow colour, highlighted by dusty blue drapes and sofas upholstered in a similar colour. The blue sofas are accompanied by salmon pink sofas with a retro floral chintz. But the space is really held together by an antique Chinese credenza topped with an Ethiopian carved wooden cross and African themed paintings. Behind the formal lounge is a smaller more cosy sitting room which repeats the golden yellow colour below the dado rail. The room has large bookcases and glorious deep red curtains. The colour of the curtains is picked up in a pair of midcentury upholstered armchairs.

To the right of the entrance foyer is the dining room painted in Venice Green – a vibrant, almost lime colour, surprisingly popular in 19th Century homes. An oak table with chairs covered in a bright pinkish-red raspberry colour sit on a Persian carpet while a carefully curated selection of paintings and objet dress the room. Floral printed curtains complete the look.

residential profile Beyond the dining room is the kitchen which is the only part of the house that has exposed roof trusses. Wood look ceramic floor tiles have been chosen to echo the wooden floors in the lounge and dining room. The kitchen also incorporates a small wood burning stove for heating, a work station, and an informal dining area with blue chairs. Red bar stools and red lampshades add pops of colour. The kitchen opens up to a small outdoor ‘breakfast’ space overlooking the vegetable and herb garden. As its east facing it’s flooded with sun in the mornings.

Beyond the dining room and the two lounges are three bedrooms all with luxurious en suite bathrooms. Of the original four bedrooms one bedroom was used to create space for the new bathrooms.

The lounges overlook the generous verandah which leads onto the pool and garden. The verandah has a group of old leather sofas for relaxing and a teak dining table accompanied by modern, transparent acrylic chairs. The mix of old and new is carefully thought out and works together well with the different elements and styles enhancing each other. An abstract painting by Mozambican artist Christo adds colour and freshness, while voluminous white drapes – with a small blue stripe – shelter the verandah from the westerly sun and add a Mediterranean feel.

A major part of the renovations to the main house included removing the old leaking roof, which was a patchwork of different materials, and replacing it with a new Chromadek roof that integrated the roof structure. In order to have somewhere to live while the roof was removed the owners built a small thatched cottage in the garden. The cottage has two bedrooms and two bathrooms on either side of a central kitchen, lounge and dining room. The architectural design and the finishes of the cottage

are fairly minimalist with raw cement floors and cast concrete counter tops, however the exposed thatched roof, chandeliers, timber furniture and the romantic mosquito nets over the beds add warmth and texture, and colour has again been employed to add personality to what could have been a fairly cold design. The owners have also created a self-contained guest cottage from what was originally a garage space. The guest cottage has an integrated bedroom and lounge area with a small kitchenette and a separate bathroom, so guests can be completely selfcontained. The whole property also has serious green credentials with solar power and inverters allowing them to operate completely off grid if needed. They have a borehole to augment Council’s erratic water supply and a sophisticated water harvesting system. There’s a 400k litre reservoir concealed in the plot to harvest rainwater and recycle grey water for the garden and the vegetables. Altogether the home is a testament to blending colours, styles and cultures into a cohesive and coherent design including African, European and Asian influences. And most importantly and impressively it showcases how colour can be used to create unique and individual designs.

RENOVATIONS AND EXTENSION OVER TIME CREATE A UNIQUE FAMILY HOME text by Michael Nott photos by Structure and Design

he owners bought the property over 20 years ago as the family home for themselves and their three children. The house was in a good area, close to amenities and with a decent sized garden with some established trees. It’s a well-built house, of brick under tile, originally constructed in the early ‘70s. As with most houses of the time the windows were of the older Crittall Hope style with small cottage panes which made parts of the house a little dark. The house was fairly modest with three bedrooms and a family bathroom. The original design of the house is roughly L-shaped, with the kitchen, dining room and lounge on the shorter leg of the L and the bedroom wing running along the longer leg. One of the owners’ first extensions was to add a master bathroom, a dressing room and an en suite bathroom to the bedroom wing. The L-shape encloses the pool, part of the garden and a recently added outside deck and entertainment area. From the front door a passageway divided the lounge on one side and the dining room and kitchen on the other side. The owners have done a series of renovations and extensions over the years to bring the home up to date and make it uniquely suited to their lifestyle and their taste while keeping the exterior footprint of the house largely unchanged. The kitchen, dining room and lounge spaces have been opened up so that the spaces work together and flow better. The kitchen was fitted out by Easy Life Kitchens about seven years ago and an extension added for a scullery and utility space. The design of the kitchen, like the rest of the house, is simple, elegant and functional with top end finishes. This type of design doesn’t go out of style in just a few years and will continue to be attractive, functional and appealing for many years to come. They also made the lounge slightly larger by closing in and incorporating a small verandah. Two or three years ago the owners engaged Liz Howes from Howes and Homes to extend and update their verandahs. There was a fairly narrow verandah between the lounge and the garden and a longer verandah running along the passageway of the bedroom wing. The narrow verandah outside the lounge meant that the sun shone into the lounge making it quite hot in summer and also damaging some of the furniture. It was also an awkward space, being too narrow to comfortably accommodate an outdoor dining table for entertaining family and friends. Along the bedroom wing small steel windows made the passageway inside quite dark. Liz Howes replaced the windows with larger wooden frames (stained to match the other existing teak frames from the lounge) and built up architraves around the openings. The narrow part of the verandah was made considerably wider and the small verandah was extended to wrap around the corner creating a much larger, more cohesive outside space. It’s now like an additional dining room and lounge (and built in bar) which augments the interior living areas. 60

interior design Liz Howes extended and raised the verandah roofs and created a single more integrated structure with chain downpipes from the gutters. New tongue and groove ceilings were installed, some of the existing pillars were moved around, or added to, in order to accommodate the new design, and the quarry tile floors were patched and extended where needed to seamlessly match the existing tiles. The home owners now have a generous dining area and a large and comfortable outdoor lounge – perfect for evening cocktails overlooking the pool and garden. The owners have carefully selected comfortable, country chic furniture for the seating area with soft, overstuffed sofas, Malawi cane chairs and a rustic wooden coffee table. You get the feeling that every piece of furniture has a unique family history and a special place in their hearts. A few years ago Liz Howes renovated the shared bathroom, installing a new modern tub, a new shower screen, Metro-style wall tiles and a custom made vanity – altogether bringing the bathroom right up to date. In one of the bedrooms Liz Howes installed French doors, so the bedroom now opens up to a private, delightful French Provencal style garden courtyard, complete with a small tiled deck, rosemary bushes, a lemon tree and a small, tinkling water feature. It’s now a tranquil and charming outdoor space.

However, the most impressive renovation by far has to be the new en suite master bathroom. The owners have created an elegant and supremely stylish bathroom with the feeling of a Balinese holiday spa, complete with a luxurious outdoor shower within a private courtyard. The whole bathroom was gutted and all the wall and floor tiles removed or replaced. The existing Crittall Hope window behind the toilet was moved and replaced with a new aluminium framed window and the window at the bottom of the bath was replaced with an aluminium sliding door. There’s now a free standing tub set in front of a dramatic black painted wall, a glass enclosed shower and a custom double vanity – all completed with matt black faucets and fittings. The double vanity was made to order by Pharaoh Tsaga from Pharaoh’s Trading. Pharaoh also supplied the matching timber towel rail and stool. The owners have selected slatted roll down bamboo blinds over the doors and windows which add to the tropical Balinese flavour. They are delighted that the blinds look particularly romantic in the evening with shards of moonlight shining through. A woven reed lampshade completes the exotic, tropical look. 62

Big aluminium and glass doors now open to a small courtyard with a deluxe outdoor shower. Howes and Homes built an outdoor courtyard of approximately 2m x 1.6m which encloses the shower area and an outdoor, matt black, hand basin. Following through with the beachy, Bali theme the pipe work for the shower is concealed behind a slatted CCA treated timber screen and there’s a matching slatted floor in the shower area which is a comfortable, non-slip surface to stand on and conceals the drainage. The renovations are a testament to the owners’ good taste and design aesthetic – skilfully realised by Howes and Homes’ dedicated and experienced team of artisans. From a fairly modest house they have created a delightful – slightly quirky – family home that perfectly expresses their lifestyle and unique personalities.

SilverStar Mercedes – a new shining light in the Mercedes Benz and Jeep firmament

Structure and Design spoke to Donald Matuku, the founder and CEO of SilverStar Mercedes, situated along Coventry Road, Workington, Harare.

When and why was SilverStar Mercedes started?

The idea started in my backyard in Houghton Park in 2009. With my training and expertise I realised I could offer customers improved service and make better use of my qualifications as a Certified Diagnostic Technician, offering superior solutions at an affordable price to the growing Mercedes Benz and Jeep market in Zimbabwe. So in October 2010 we opened our first workshop at Alex Motors along Julius Nyerere Way. We have always aimed to offer our customers a real alternative to main dealer repairs and servicing options. As the business at Alex Motors expanded we moved to 3 Hanover Road, Workington in 2011. SilverStar Mercedes was founded in 2014 at 76 Douglas Road with 6 employees before moving to 93 Coventry Road last year.

As the CEO of SilverStar Mercedes, could you tell us about your experience and training as a Mercedes Benz and Jeep expert..

A

I have trained as qualified Mercedes Benz Technician, acquired through a dealership, dating back to 2000. I have acquired training locally, regionally and internationally through the Daimler Chrysler Global Mercedes Benz Training programme. I have received training in South Africa, Kenya, Malawi and Zimbabwe resulting in me becoming a Mercedes Benz Certified Diagnostic Technician. The qualification boosts the abilities of Mercedes Benz technicians, also enhancing the entire service experience. I have a natural interest in auto-electrics and so in my training as a Mercedes expert I also trained as a Jeep expert.

Q 3.Let us talk about your staff the technicians and their training. Our model is based on continuous in-house training for our team and, with the help of our partner in Dubai, we have invested in the correct manufacturer-specific diagnostic equipment and up-to-date product training for our technicians. We constantly strive for excellence and we continue to receive the latest technological software and training material from our partner.

Q 4.Do you still work on vehicles yourself or are you in a more administrative role these days? My passion in life is for fixing cars and I enjoy both my technical role and my quality control role, so I am still on the workshop floor. Q 5.In the last few years the science of vehicle maintenance and repairs has changed quite dramatically as new vehicles are more advanced and complex. Could you outline some of the technological advances and changes? Automotive technology has advanced considerably over the last few years and at SilverStar we have made it a point to acquire high level diagnostic equipment to identify faults as well as advanced calibration systems. Q10.How do you see the future of vehicle repairs and maintenance as hybrid or electric vehicles are becoming more popular? Will you be in a position to service and repair fully electric vehicles?

The automobile’s future is electric, and weas SilverStar we are part of that future. It is important to understand that the fully electric or hybrid vehicle is not just the future, but also offers the ultimate in luxury driving. We are therefore excited about this future.

I believe Zimbabwe has now entered a new era of motoring and we have been waiting for these hybrid vehicles since 2015. Through our partner we have had a few training sessions in preparation for the electric and hybrid vehicles and we are well prepared.

omona Steel and Fencing opened their new business in September 2020, so they’re just one year old, yet in a short time they’ve already established themselves as leaders in the field of supplying fencing solutions for a wide variety of applications. They supply, manufacture and install a selection of fencing and gate options for the construction industry, as well as for mining, industrial and agricultural concerns, for the hospitality industry, and for residential applications. Just a few of their recent clients include Pannar Seed warehouse in Ruwa, Management Training Bureau in Msasa, Union Hardware’s Burnley Road branch and OK Zimbabwe branch in Mbare , as well as a number of residential projects. Pomona Steel and Fencing will visit your site to measure up and make recommendations, or alternatively they can work from drawings or information supplied by the client. They can then provide you with a free quotation as well as an estimated time to manufacture and install your products. Once the quotation has been accepted they will proceed to manufacture your fence to your specification including your gates and within a few days their installation team will be at work fitting your superior quality product.

They currently have a team of 7 employees at their factory involved in the manufacturing side - cutting, welding, drilling and spray painting – in addition to three teams of 4 workers on the installation and fitting side. All work is carefully and personally supervised to ensure customers receive the best quality service and are totally satisfied. Pomona Steel and Fencing supply a selection of fencing options which includes the diamond mesh, field fencing, barbed wire and razor wire. They also supply and fit Clear View fencing – sometimes referred to as High Vis or Anti-climb fencing. Another very popular option is their palisade fencing which is completely manufactured and finished at their factory. Both of these products are becoming increasingly popular these days as they provide an extra level of security for customers while still allowing a clear view of what’s happening inside the property. Solid perimeter walls tend to provide a barrier but once unwanted or undesirable people are over the wall they are protected from watchful eyes and can go about their business unchecked. Clear View or palisade fencing is ideal for retail businesses, providing excellent security while still allowing customers

to view the products or services on offer, and these options are considerably more aesthetically appealing and attractive than the conventional pre-cast cement panels. Both Clear View and palisade fencing also create an opportunity for businesses to put up signage or branding and allow interior signage to be seen. Clear View is also ideal for demarcating and securing smaller spaces within a factory or warehouse, for instance for stock control.

Clear View is generally available in black, grey, green and galvanised, while black and green are the preferred colours for the fence. However, as the fence post are spray painted at the factory customers can request their individual or unique colour choices. Fencing posts could be red, yellow or blue to match the exterior architecture or the colours of your brand’s logo. The choices are almost unlimited! There’s a 25 year warrantee on their galvanised finish and a 10 year warrantee on the powder coated finish. As your product is likely to last a lot longer than 10 years fences, posts and gates can easily be repainted as or when needed. In addition to their standard fencing products Pomona Steel and Fencing also supply and fit electric fences. They manufacture a range of gates to suit your needs including single hinged access gates, steel security gates, butterfly gates and sliding gates. Gates can be operated manually or by an automated electric motor system and are custom made to your design whether you need plain, no nonsense industrial gates, or a more decorative design for your home. Pomona Steel and Fencing was founded by Mr Chengetai Mawoyo who has previous experience in supplying agricultural equipment. Their factory, storage and offices are accommodated in a huge warehouse custom designed to suit their requirements by Craftworx Architecture. The warehouse is over 1000 sqm with an attractive aluminium and glass façade, a pretty landscaped garden in front (created by Savannah Gardens) and plenty of parking. At the rear of the warehouse 6m roller shutter doors allow easy access for loading and deliveries.
