Many people choose an attorney purely on the advertising they see on television or on billboards. This can be a dire mistake as not all attorneys are created equal and the quality of your attorney can greatly impact your potential recovery. What you want is a lawyer who knows how to settle your case when appropriate but who is also a great litigator who knows when and how to take a case to trial. You should keep in mind that if you are injured by no fault of your own, chance are you will only get “one bite at the apple” for a recovery, meaning you cannot go back and ask for more money if your injuries worsen or you require more treatment. Hiring the wrong attorney can cost you for the rest of your life. When interviewing for an attorney, don’t be timid in asking about their trial experience. Ask what types of cases they have tried, is-
sues they have encountered, and what their background in handling comparable cases is. It is also important to determine whether your lawyer can truly afford to handle your case. Many firms take cases but shortchange their clients because they don’t advance the money necessary to properly prepare the case for trial or to best advance the client’s position in negotiations. Some lawyers don’t do this because they don’t have the requisite funds to do so.This area is so important and so frequently overlooked by the client, as most simply assume the attorney will advance whatever costs are needed, when often that’s not the case.

Your lawyer may be doing a good job but what the facts, injuries and law allow may be quite different than your desires. Rather, look strongly at what work the lawyer has done for you and evaluate the lawyer on their actions. See how they line up with their words. If they don’t, a change may be in order. Remember, information is power. If you are hurt by another, immediately gathering the information you need and researching information on the attorney you will choose can be essential to your recovery. <

The black-tie affair, hosted at the Full Sail Live Venue, exuded elegance with a formal dinner provided by Emeril’s Tchoup Chop, entertainment by the Dave Capp Project and silent and live auctions. Money raised went toward SPCA programs providing shelter to pets of families in crisis, food and veterinary care for pets of needy senior citizens and summer camps for children. For the young or young at heart, this Diamond Anniversary Gala exemplified agelessness as raising funds for a good cause, never goes out of style. For uber-foodies who balk at the notion of a “food coma” and are on a constant quest to quench their gluttonous cravings, the Second Annual Orlando Food & Wine Weekends September 28th-October 5th was the ultimate destination for pursuit of all things tasty. The event featured, Sea World/Busch Gardens and Discovery Cove Animal Ambassador, Julie Scardina who brought an array of her exotic animal friends with her to educate and wow the crowd.Volunteer puppy raiser, Andrea Batchelor was honored with the Golden Leash Award for her dedication for the past 10 years for her many roles to help enhance the lives of others. As there is less energy content per given volume in these biofuels compared to normal petrol, the fuel-system has to manage a flow that is similar to a 2000hp petrol engine, which means that the Agera R’s return-less fuel system has the highest capacity of any car presently in production.

The first tip is to simply make sure you eat a normal breakfast and lunch during the day. You might think skipping meals and saving your calories for the big dinner is a good idea, but more often than not it leads to you overeating and adding even more calories to your intake. While we’re on the subject of calories, let’s talk about your Thanksgiving day cooking. One great tip for a healthy Thanksgiving day is to try easing up on the

It’s also about family, friends and quality time. Take a healthy, bonding walk with your loved ones after dinner and let this New Year’s be the one where you don’t have to make that resolution to you-know-what.<

> More and more lately I’ve been approached by people seeking my advice who are concerned with how to invest in such a low interest rate market. I hear statements like, “CDs aren’t paying anything!” and “What happens when interest rates finally rise?” Well, in my opinion, people do have reason to be concerned. Interest rates have been exceptionally low for three years now and treasuries are flirting with all-time lows. Not only that, but the market has continued to be quite volatile which only punishes risk-averse investors even more.
rates are at historical lows, and the rate is locked in for a long time, when rates go up and better options are available for investors, this bond fund isn’t as attractive. Unfortunately, this isn’t like when you are out at a bar and someone doesn’t find you attractive. When that happens you smile, walk away, and find someone else to talk to. When bonds lose value it means real money losses - money losses that are ironically coming from the investments that people are flocking to in the masses to reduce risk and preserve their capital.
If you are retired or approaching retirement, capital preservation is important, but you also want your portfolio to outpace inflation in order for it to last throughout retirement. Even for investors with a longer time frame who want to be properly diversified, where do you find historically lower volatility investments, like bonds, that are offering palatable dividends? So how do you factor the prospect of continued low interest rates into your investment strategy?
No, I don’t have a crystal ball. Moreover, I don’t know when interest rates may rise. But, if it is logical to believe that bonds lose value when interest rates rise, and they are currently at historically lows, then what are you to do? There are other options, whether you focus on shorter-term bonds, preferred stocks, UITs, ETFs, or non-traded investments that are prepared for a rising interest rate market, it is important that you review your portfolio. Look through your investment holdings and meet with your advisor to discuss where you currently stand and what changes you may need to make. If you do not have someone to talk to or would like to seek out a second opinion, please do not hesitate to call or email me. Bonds, and bond mutual funds, have seen more inflows of cash from investors in recent years than stocks even though interest rates and yields have not been offering much in return. There are a few glaring issues here. First, the yield available in a welldiversified, long-term bond fund on average isn’t even keeping up with today’s inflation rate. Secondly, if interest rates begin to rise, these bond funds may lose value. Consider what these bond funds own… BONDS! Bonds that are long-term, sometimes 30+ year agreements to pay a certain interest rate for borrowed money. Well, if interest

IRS TARGETS OFFSHORE CREDIT CARDS - BY MARK L. HORWITZ > The IRS and Department of Justice have expanded efforts to uncover offshore accounts by tracking credit card use. The IRS has named this new effort Offshore Credit Card Program (OCCP).
The IRS efforts include issuing John Doe summonses to obtain information from VISA, Master Card and American Express. In addition, the IRS has summoned information from Credomatic, a Florida credit card processor that services banks located in Caribbean tax-haven countries.

By issuing a John Doe summons to credit card companies and processors the IRS can discover the identity of individuals with offshore credit cards. After obtaining offshore credit card holders’ identities, the IRS will begin a civil examination and may commence a criminal investigation.
The “stick” is the threat of civil penalties and criminal prosecution upon discovery of unreported income and offshore accounts. The “carrot” is the Offshore Voluntary Disclosure Program (OVDP) which results in significantly reduced civil penalties and eliminates criminal prosecution. Under OCCP the government will identify many offshore accounts. This program will result in many criminal prosecutions. Even though a John Doe summons has been issued, a person can enter the OVDP as long as the government has not yet received the information from the offshore banks, credit card companies or credit card processors.<

A MASTER OF HIS OWN DISGUISE Tony came by music naturally. His father was a musician who played the guitar and there was always music around the house. But he also learned about pain and distrust at an early age. Tony was sexually abused by his grandfather and the priest at his church – dark secrets he never shared with his now-deceased parents. As a result, Tony became a “master of his own disguise,” as he says in the title song of A Liar’s Broken Heart, hiding his anger and suspicion behind biting sarcasm that pushed most people away. He spent hours a day holed up in his room, mastering the guitar; and, when he was ready, he took on the Miami music scene with a vengeance, showcasing his talents with local bands, blowing audiences and other musicians away. But he never really fit in. The same was true when his family moved to Central Florida: He could play and sing better than most, but his musical alliances were all short-lived. Connections soon led him back to Miami, where he worked with the Eagle’s producer, Bill Szymcyk, in Coconut Grove’s famed Bayshore Studios. He played with Joe Walsh and on Jay Ferguson’s Top Ten hit, Thunder Island. For a time, there was even talk of a solo album; but things went sideways and
Tony found yet another reason to distrust authority.
A DIFFERENT DIRECTION Undeterred, he decided it was time to take control – to take his talents elsewhere and use everything he’d learned about the industry to make music his way. So he packed up his equipment and moved to New York, New York, where he opened a small recording studio,The King of Queens (decades before the TV show). And he hustled. Before long, he was working with major artists like Keith Richards and Run-D.M.C. He made connections with major labels, television networks and movie producers. He moved to Manhattan and opened Studio 900 – still in operation. He produced a series of jazz recordings with Bill Cosby. He was successful, but he wasn’t satisfied. In the late nineties, he grew tired of long cold winters and returned to Florida. Work found him, and he continued to produce, engineer, and lend his vocal and instrumental talents to the constant barrage of projects that followed. Tony also found himself in uncharted waters – in love and expecting his first child. He “settled down,” bought a house and began raising a family, working out of a small home studio. Of course, when opportunity knocked, he traveled the country writing, playing, recording and producing. But his three children – Olivia, Ruby and Jake, now 18, 13 and 10 – became an unexpected priority in his life. He was determined to protect them – to keep them safe from the abuses he had suffered.
THE MUSIC NEVER STOPS While recording in a Central Florida studio in 2000, Tony was introduced to a gangly teenager from Bishop Moore High School named Mandy Moore. He and friend, Shaun Fisher, began working with her, crafting songs to fit the girl’s big voice. Tony tapped his contacts to help Mandy get a contract with Sony, and the result was So Real, a platinum-selling CD featuring the top-ten single, Candy.

In 2001, he became the only person to ever sing for Bart Simpson in the New Kids on the Blecch episode. Tony wrote all the songs – including Drop Da Bomb – and performed the singing voices for every boy in Bart’s band. Orlando’s *NSYNC also appears in the episode. In the years that followed, Tony produced albums for a number of hard rock/alternative bands. Martorano excels in his role as executive chef. One might think Martorano spends most of his time in the kitchens, but as executive chef, his job description is way heftier. The beautiful and elegant Hilton Orlando houses 1,450 guestrooms and seven dining outlets including Spencer’s for Steaks and Chops and David’s Club, a classic American Gastro pub. Martorano manages his 68 cooks and six sous chefs, while also managing the finances and adhering to budget, the hiring of the entire culinary and stewarding teams both salary and hourly, establishing succession plans for all managers, and creating all menus, recipes and implementation. “It’s a tremendous operation,” said Martorano. But Martorano has certainly been groomed for this position and has worked his way up the pipeline at hotels across the country to land in his role at the Hilton Orlando. Brooklyn born Martorano grew up playing baseball, and had one goal…to become a professional ball player. While attending St. John’s University in Queens, N.Y., he was offered a walk-on invite from the Cleveland Indians. But when baseball ended just a year later, he went to work for his family’s Italian restaurant in Little Italy.
Although working with his family in the restaurant was a great platform, he didn’t see much of a future there, and so he went to work as a banquet server in a wedding hall in Brooklyn. It would be this little parttime serving job that would change his life forever. While serving one night, New York’s Waldorf Astoria’s Food and Beverage Director, Tim Minetti was a guest and was so impressed with Martorano as his waiter that he invited him to come work for him at the WA. “When he asked me to come work for the WA, I told him I actually only served part time and that I was actually a cook,” said Martorano. “Minetti said ‘Really? You’re a hell of a server’ and I said ‘I think I’m a better cook!” So off he went to the WA with very little training and cooking experience and began work in the vegetable kitchen and every rotation there after. “It was my own $60,000 education and I got paid to do it,” referring to the fact that he never attended culinary school. “But it was like a crash course. I only had one time to do it right.” While working at the WA, Martorano headed to New York City Technical College to earn a hotel restaurant degree to learn the ins and outs of the management side, which would prove very beneficial in his future positions. Soon after, he moved on from the WA to work in the Marriott Marquis in New York and the Weston Hotels & Resorts in California, South Carolina, and Florida for six years. In 1995, Martorano headed to Nashville, Tennessee to open the “Delta” for the Gaylord Opryland. In August 1997, Martorano headed down to the sunshine state to work at the Boca Raton Resort & Club for almost 11 years, where he worked in multiple chef positions.

In 2008, he was asked to return to the Gaylord family and help open the Gaylord National in Washington, D.C.

And this experience is what led him to getting his dream job as Executive Chef and help open the Hilton Orlando in Florida in 2009. “I was a glutton for opening hotels for two straight years, but it was an unbelievable experience.” The job description was perfect, and the location of the hotel couldn’t be better, sitting on International Drive and just a half-mile away from the Orange Country Convention Center. The two are connected by a covered, open-air walkway making it convenient for business workers, vacationers, and locals coming to enjoy the tastes of the Hilton. Martorano’s passion for cooking and service is evident and his team philosophy is what sets him apart from the rest. As a self-proclaimed sports freak, Martorano wants his team to live, breath, cook, and serve as one. “I love to develop my team. I use their input because when it’s their ideas, it’s their heart and soul and if you don’t have that, you can tell in the food.” You won’t find Martorano micromanaging though. He’s not a fan of this style. Instead, he encourages involvement and feels that “if you don’t feel like you did something, you’re not going to give 100 percent.” And it’s clear this style is working. In its first three years of opening, the Hilton Orlando was the recipient of the Hilton Worldwide “Connie Award” in 2010 and 2011, which awards for top service amongst all Hiltons across the world. They were also ranked number one on Trip Advisor’s rankings of Orlando hotels and the hotel has received a AAA Four Diamond rating for its luxurious amenities and top-notch service. This die-hard Yankees fan believes that “if you don’t win, it’s a loss. You have to be better than you were yesterday, and if you weren’t good yesterday, how can you be better today.” Martorano has found a comfortable spot here at the Hilton Orlando and believes he still has a lot of goals with this young hotel. It’s safe to say he will be here for a while, which only means that the already incredible food and service will continue to raise the bar. “Guiding this hotel has been the best job of my life. FOR THE GOLDEN RAISINS
Raisins – 6 oz Sugar – 2 oz Sherry vinegar – 2 oz FOR THE SAUCE
Cubed sweet unsalted butter – room TEMP soft to touch – 1 lb Dry white wine – 8 oz Shallots minced – 3 tbsp Garlic minced – 1 tbsp Bay leaf – 1 each Fresh thyme sprig – 2 each after emulsifying, strain through fine mesh strainer then add the remainder, Fresh cut chives – 1/4 cup Raisins add all Capers drain from brine - 1/4 cup Season with salt and pepper – to taste. BASTED BRISTOL SEA SCALLOP, ROASTED SPAGHETTI SQUASH, LIME SAGE GASTRIQUE.
Butter & olive oil for cooking/ sautéing. Fresh dry u-10 Bristol Sea scallop remove adductor muscle, hold cold, 2 each per dish. Spaghetti squash- cut in half and rub with olive oil. Roast in oven for 30 min (until tender) skin side up. Oven TEMP 375 degrees.When out of oven and still warm take a dinner fork and scrape out meat of squash (should appear to look like spaghetti). Hold or refrigerate until
Method - spaghetti squash- in hot sauté pan heat whole butter (do not burn) squeeze juice of one lime and add two leaves of fresh sage. As pan bubbles when acid is added place squash in pan and incorporate with butter and lime. Season with salt and pepper. Hold hot. Scallops - in sauté pan heat half olive oil and butter.When pan is good and hot (not burning) place scallops in pan and sear golden brown on both sides. Recommend you cook scallop to a medium TEMP while cooking scallop with a spoon, baste the scallop with the butter oil mixture we used to sear it.When desired cooking texture is accomplished pull off fire. Hold. Sauce- in small saucepot heat olive oil with minced shallots and garlic, sauté until translucent. Add white wine and reduce to almost dry.Whip in room TEMP butter until smooth. Season with salt and pepper and strain through fine mesh strainer. Add sultanas (golden raisins), capers and fresh chopped chives. Plate - arrange on plate by placing squash down first, the scallops centered on squash. Spoon sauce over generously. Garnish with tiny greens tossed in olive oil and seasoned with salt and pepper. > So when you get up in the morning and feel that crisp chill in the air, see how the leaves on the trees are changing their color or the heater in the house is finally being cranked up, you know one thing is certain. Fall is here and you don’t live in Central Florida!! But it does mean, for me anyway, the best season is finally here. Tis the season for pairing wine and food and that always brings a smile to my face. Those certain fall flavors we only taste this time of year are screaming to be paired with a great bottle of wine and I am here to help you pick and choose the right one for this time of year. For me the holidays during the fall point to red wine as a showcase for those big family meals around the table. Just ask your Thanksgiving turkey and he will tell you he prefers to be hooked up with a silky Pinot Noir or a spicy, sexy Syrah. There is a place for white wines as well but I think this is the time for those “other” red wines to shine. Wines such as Pinot Noir and Syrah, as well as a couple of others like Grenache and Beaujolais, really like and need the spotlight this time of year. Now you can find certain varietals of these wines in more than one corner of the world. I am not here to tell you where your bottle should be from or how much it should cost. The important thing is you enjoy it with whatever meal you have in front of you. Pinot Noir has quickly become and stayed as one of my favorite wines to drink this time of year. New World Pinot Noir is a versatile red wine that can cozy up to all types of dishes from turkey and duck to your smoked meats or fish. New World Pinot’s typically have a nice explosion of

fruit up front and finish with an elegance found rarely in most other varietals. The Old World Pinot’s, such as Burgundy, usually take on a more earthy characteristic. Roasted meats are a must to pair with Old World Pinot Noir. Pumpkin or butternut squash that has been kissed with nutmeg and cinnamon are happy to sit next to Pinot’s from the old world. Thanksgiving is an obvious time to have one or four bottles of Pinot Noir sitting on that table throughout the feast. Mix it up and try different Pinot’s from different parts of the world and you will soon be hooked like me. Syrah, or Shiraz if you prefer, is also a showstopper for any fall feast or holiday shindig. While Syrah is usually found on labels from Europe and the United States, Shiraz comes to us from “down under,” as well as South Africa. I find Shiraz from Australia can really pack a peppery punch but still have an abundance of soft fruit. Both will have that nice kick of spicy fruit and even hints of chocolate showing up on your palate. These wines pair up nicely with smoked meats or wild game if that’s your pleasure over the holidays. Look for names such as Cote du Rhone or Cote du Rotie if you really want that old world style to pair rustic meats or vegetables with. One of my favorite pairings is a nice bottle of Cote du Rotie with bacon inspired dishes or bacon dipped in dark chocolate. Syrah to me is one of those mysterious mistresses that should always be at the party but you are not sure how much trouble she is going to cause. A couple of other fun wines to have during this season are not as well received for some reason. Grenache is a little more accepted as being a great wine while Beau-
jolais is like the kid who is picked last for the baseball game. I hope we can change that perception, as Beaujolais should be the big surprise for anybody who opens a bottle for Thanksgiving dinner. Grenache is usually found as a varietal in several types of blends, most notably Chateauneuf du Pape or G.S.M’s (look it up.) The Australians have done a great job with this varietal as a standalone wine. Grenache is a good option for those vegetarians out there who still put out the big spread over the holidays. Beaujolais Nouveau is one of those wines people usually have seen as cheap and around at every giant grocery store chain for years. I am telling you grab a bottle for Thanksgiving and you will not be disappointed. The annual release of this varietal is a big event in France, happening on the third Thursday of November, every year. It is a wine that is very young and therefore is a very fruit forward wine. My favorite pairing is that turkey sandwich you make the day after Thanksgiving with some leftover cranberry sauce. It is always at the right price and can dance playfully around all those other big, serious wines it sits next to on the table. Regardless if you like the big huge holiday banquet with roasted meats and wild game or you choose the light vegetarian path, you can always find a wine to pair with your choice. It is just this time of year with all the changes outside, mostly, and the foods we usually only get to see and taste once or twice a year, these wines shine brighter than most. So this fall season reach for one of these “other” red wines and be pleasantly surprised. Beaujolais will be grateful to you and so will I.<

SNIFFING OUT HORSE SENSE IN BUSINESS LAWYERS - BY STEVEN D. KRAMER > Many people hire the wrong attorney to represent their small business. As an attorney, representing small business requires an understanding of a range of legal issues including contract law, intellectual property, corporate law, employment law and a range of legal disciplines that merge together at small business.
Because of the tendency towards over specialization in law, few attorneys have an understanding of these multiple disciplines and how they overlap. Instead business owners wind up seeing multiple attorneys, but lack a cohesive strategy, lose time and money in the back and forth, and lose competitive advantage in lost communication between multiple attorneys or worse, multiple law firms.

For example, some firms have attorneys that focus specifically in business transactions, which center on contracts and closings, and have separate attorneys or departments that deal with litigation of contracts or transactions. If an attorney does not litigate contracts or transactions and see the effects of unintended consequences or poor contract draft-
ing, how can that attorney properly represent a business in transactions or in drafting contracts? Representing small business properly requires more than understanding multiple areas of law, it also requires understanding how business works. Many attorneys have never worked in business outside of being a lawyer. They have never run a business; they do not have common business sense- or horse sense. Be sure that your attorney has worked in businesses outside of law. Ask them about their experience as an entrepreneur. Ask them about their depth of understanding in business law, contract law, employment law, corporate law, and intellectual property.
