DIVORCE – ‘NO TWO ARE ALIKE’

Sadly, January is a busy time for family lawyers. As people put away their Christmas decorations, they often reflect on the past year and the year ahead. Many decide to make fundamental changes in their personal lives. Last year, we found more and more people were trying to do their own divorces on line and then came to see us when they ran into problems, or the court rejected an application due to fundamental legal errors.

We were also instructed by people years after their divorce, having received a claim out of the blue from their ex-spouse for financial provision. Not instructing a specialist family solicitor at the outset can be a false economy, often costing the parties more than it would had they instructed a solicitor from the start.

Here are some of the reasons why people choose to instruct a specialist family solicitor when they are thinking about going through a divorce:

Divorce is a stressful time for everyone. It can be mentally and physically taxing on the strongest person. Instructing a specialist family law solicitor to complete a divorce is one way to reduce the amount of stress and pressure of the divorce. Let the solicitor deal with the complex legal issues and the direct contact with your soon to be ex-partner or their solicitor.

A specialist family law solicitor will employ their knowledge, expertise and experience into finding more creative solutions for a fair division of the assets that a lay person may never have thought possible. You can avoid mistakes and therefore additional expense and delay that mistakes can cause. The legal system is complex, as can be the legal issues. Each divorce is case specific and no two divorces are alike…so you cannot obtain the right advice for your situation from the internet sites as these are geared and intended to provide general non-specific advice only. No one divorce fits all; Your partner says ‘we can agree the terms ourselves and save money on solicitors’, an oral financial agreement is unlikely to hold up in court, a solicitor will help you achieve your desired outcome. Some partners try to pressurise the other into agreeing a settlement that is one sided. A specialist family solicitor will avoid this happening; and

If you require financial certainty and security, a clear and legally binding financial agreement is a must in a divorce. Unless you are familiar with legal jargon it is unlikely that you will create a financially binding document that is certain, concise and unambiguous.
As a rule of thumb, you should seek early legal advice from a specialist family solicitor when:1.
You have a lot of assets;

Many assets are held in your spouses’ sole name or you do not know what assets your spouse has or there are trusts involved;
3.
You feel you are vulnerable either financially or as a negotiator compared to your spouse;
4.
There are domestic violence or abuse issues;
5.
You are not confident with paperwork;
6.
You are unsure what is fair financially;
7.
You have a disagreement regarding children;
8.
You spouse is threatening to exclude you from the home or cut you off financially.

MENTAL HEALTH AND THE BENEFITS OF EXERCISE Here at Suburban magazine we spoke to Hayley Jarvis who is the Community Sport Programmes Manager at mental health charity Mind, about the benefits of exercise and mental health.
Hayley Jarvis Community Programmes Manager (Sport) at Mind said: “Being active is really important for both your physical and mental health. Research shows that being outdoors and exercise can have huge benefits for people’s health and wellbeing. “This is thought to be due to a combination of doing more physical activity, which is known to have many physical and mental health benefits; getting more regular social contact with people, which can reduce loneliness and boost self-esteem; and being surrounded by nature, which can boost your overall mood and sense of wellbeing. “One in four people will experience a mental health problem. One study has found that by increasing your activity levels from doing nothing to exercising at least three times a week, you can reduce your risk of depression by almost 20%. “Structured physical activity can play a key role in someone’s recovery from a mental health problem and in turn staying well in for years to come. However certain factors contributing to someone’s ill health are often reasons for someone to avoid exercise in the first place for example feelings of self-esteem, low confidence, anxiety of crowded spaces and the feeling that people are judging you can cause depression and anxiety. “At Mind we want people with mental health problems to enjoy

exercise and see the benefits for their own recovery. Our sports programme, Get Set to Go, can help people overcome the barriers to exercising, by choosing an activity which is suitable for them and enabling them to take the first step and get active to improve their physical and mental wellbeing. “Exercise isn’t only good for those of us with a mental health problem. When you exercise, your brain chemistry changes through the release of ‘feel good’ hormones called endorphins – which some people call a ‘runners high’. Sport helps us to switch off from everyday pressures, relieves stress and gives us time to clear our heads. It also reduces levels of cortisol, ‘the stress hormone’, which has been linked to a range of mental health problems including depression and anxiety. People have different levels of fitness, ability and availability, so if you have not exercised for a while doing too much too soon may put you off. NHS guidelines for 19-65 year olds suggest 150 minutes of activity per week. To get the most from exercise it’s important to find a type of exercise you love and can stick at. Don't feel that you have to stick at something that's not working for you. Here are some tips to get started. 1. Have realistic expectations. If you used to be active in the past remember that age and inactivity can take its toll on fitness levels, so have some realistic expectations about what you can do when you first start. 2. Try to build more activity naturally into your daily routine. For example: • Try taking the stairs instead of the lift • Walk or cycle to work instead of driving or getting the bus (if it’s too far, see if you can walk or cycle for at least part of the journey).
There are lots of free training schemes for new cyclists around the country. • leave the car at home • Walk to your nearest supermarket to do your weekly shop. 3. Be patient, and gradually increase the intensity of your exercise as your body adjusts. 4. Getting fit with others can have even greater impact as it provides an opportunity to strengthen social networks, talk through problems with others or simply laugh and enjoy a break from family and work. This is the month when we start to slowly think of the world outside the house, after all the Christmas and New Year festivities are over. One of the best things to start with, are the fences, furniture and sheds. Do they need some running repairs, which we were too busy to do in the summer? It is useful to repaint them every few years, especially before the shrubs and climbers start to cover them with new foliage.
