Pellet stoves (left) are extremely efficient, fully automated heating systems. They use wood pellets, manufactured from compressed sawdust and wood waste, as fuel. Pellets are clean burning and have a low carbon footprint. They are made in South Africa and are now available at Calore retail stores. I need an extra long break… after the past 8 weeks. It was a very interesting time for our household, to say the least. Have you ever wished for a 48 hour day? We had to be satisfied with only 24 hours! We were busy, busy, and busy and then we moved house. I am still camping in my own new house. No kitchen yet. This is quite an extraordinary experience! We hope our sparkling new kitchen is installed as you read this issue. Never a dull moment. This month we celebrate 6 years as owners of the Housefinder Magazine! It has been a huge learning curve in our life. How the magazine has changed over the 6 years is remarkable! Our clients and our readers are especially wonderful and we are grateful for the relationships we have built with all of you. As with any learning process, you sometimes make mistakes but in general we have had wonderful experience and always try to be accommodating and handle situations to the best of our ability. Home needs and preferences checklist Namibian would-be home buyers are urged to draw up a checklist of needs and preferences when viewing properties to buy, says a property expert. When visiting the homes lined up for inspection, you should, tick off these features against the checklist and make notes of anything that has pleased or disappointed you, such as the wrong colour tiles, the size of the bath, the lack or small size of a shower, inappropriate or unattractive lighting, the 'wrong' flooring or possibly dĂŠcor or layouts which might be unsuitable for their furniture, a lack of natural light, insufficient security or unsafe play conditions for children (this last item specially needs checking in sectional title schemes). Potential home buyers will often find that after looking at anything from eight to 12 properties they have become confused and unable to remember clearly what it was that appealed to them or was seen as a disadvantage in the homes they have visited.

Understanding Contracts in Namibia Namibian contract law is "essentially a modernised version of the RomanDutch law of contract," which is itself rooted in Roman law. In the broadest definition, a contract is an agreement entered into by two or more parties with the serious intention of creating a legal obligation. The function of contract law is to provide a legal framework within which persons can transact business and exchange resources, secure in the knowledge that the law will uphold their agreements and, if necessary, enforce them. The law of contract underpins private enterprise in Namibia and regulates it in the interest of fair dealing. A contract in Namibia is classified as an obligationary agreement—it c r e a t e s e n f o r c e a b l e obligations—and ought therefore to be distinguished from absolving agreements (whereby obligations are discharged or extinguished) as well as from real or transfer agreements (whereby rights are transferred). For a contract to be considered valid and binding in Namibia, the following requirements must be met: 1.There must be consensus between the contracting parties. 2. The parties must have the capacity to contract. 3.The necessary formalities must be observed. 4. The agreement must be legal. 5.The contractual obligations must be possible of performance. 6. The content of the agreement must be certain. A contract has certain characteristic features:

1. It is a juristic act. The law attaches the consequences intended by the parties. 2. It is necessarily bilateral or even multilateral; a contract cannot be unilateral. 3. It entails promises or undertakings, on one or both sides, to make certain performances: that is, to give something, to do something or to refrain from doing something. Alternatively, it may be a warranty that a certain state of affairs exists. 4. It usually entails reciprocity, in that one party's performance is promised in exchange for the performance of the other party. The modern concept of contract is generalised, such that an agreement does not have to be of a specific type before it may be enforced, but contractual parties are required to conduct their relationship in a manner consistent with good faith. The law of contract forms part of the law of obligations. An obligation is a legal bond between two or more persons or parties, obliging the one party (the debtor) to give, do or refrain from doing something to or for the other party (the creditor). The primary sources of obligations are contract and delict, the latter being wrongful and blameworthy conduct which causes harm to a person. There is a very close similarity between a breach of contract and a delict, in that both are civil wrongs and may give rise to a duty to pay damages as compensation. Therefore certain conduct may constitute both a breach of contract and a delict (as when a surgeon

negligently leaves a cotton swab inside a patient's body), in which case there will be concurrent liability, permitting the patient to sue on either basis. Another source of obligations is unjustified enrichment, which occurs when there is a shift of wealth from one person's estate to another without good legal grounds or cause. Where a party transfers an asset to another in performance of a contract that is for some reason invalid, the shift of wealth is without good cause, and an enrichment action for the restitution of the asset will lie. Many commercial transactions involve both the law of obligations and the law of property, and so have both proprietary and obligationary or contractual elements.

The pedestrian entrance is placed on the quiet side of the site on the corner of Tienert and Nachtigal streets. An integrated approach to architecture and landscaping was followed. The tricky orientation of the site allowed for sun controlling devices to block out sun on the east and west and opening up on the South. The building is thus designed appropriate to the Namibian climate, sun angles, wind and rainfall.

The architectural language will allow for the use of natural locally availably materials, grounding the building and integrating it within the larger urban context. Care was taken to incorporate the existing trees and plants on the site as far as possible, and all new landscaping will be done with lowmaintenance indigenous plants such as Aloes and Acacia trees. Vegetation is used a natural sound buffer toward the busy street.

The architecture of Mandume Park is striking and iconic. The intension is that, with all its signage lit up at night, it will become a landmark on Mandume Ndemufayo Street and Windhoek. There is no doubt that the impact of this landmark investment into the infrastructure of Windhoek will be significant.

1 Roll ready-made puff pastry 1 Punnet strawberries 1 tub mascarpone Vodka Castor sugar 1 Teaspoon vanilla extract Fresh mint Balsamic glaze 1 Egg whisked Hull & halve the strawberries. Place in a glass bowl and splash generously with vodka, sprinkle with castor sugar

and mix chopped mint carefully through. Leave to marinade in the fridge for at least 2hrs. Unroll puff pastry onto a flat surface and cut into a rectangle of 30cm/15cm (do not roll out at all!) Uninvited, unwelcome - so sorry you can’t stay! Spring is in the air – time for the birds and the bees, but alas, also goggatjies in the trees, creatures and critters that are most unwelcome! As the soil temperature starts picking up, it’s time to nurse our lawns back to lushness to enjoy delightful summer picnics and sing in the rain with the first breaking of the dry winter spell. Unfortunately two problems usually surface shortly afterwards: LAWN CATERPILLAR

Most common are the Cape and Natal lawn caterpillar, which both can cause considerable damage to lawns – although the larvae are a good food source for birds and other garden wildlife. There’s a moth in background – although they vary in shape and size, both can cover long distances, flying low over natural veld and pastures. Most evergreen grass mixed are ideal host plants, contrary to common belief that it is only Kikuyu and LM lawns. When conditions are favorable, moths hatch from pupae in the soil beneath organic debris and leafs and the cycle begins. Watch for dead patches on the lawn – where infestation is severe the patches turn brown with possible complete die back. A badly infested lawn will have a typically ‘ripped’ appearance, completely as if someone has raked over it and with close inspection of the

grass showing chunks eaten away from the sides of the leaves. During the day lawn caterpillars hide below grass debris and within the root area of the grass, partly as defense against natural predators. Therefore it is important to apply the recommended insecticide as late as possible in the afternoon. Early rainfall can already lead to infestation at the onset of spring, peaking during January to March. Moths seen in flight in December and January are an indication of their activity, so start getting ready for battle! One way of detecting activity is to place a wet towel on a suspect area overnight. Lift the towel early the next morning and, if the lawn is infested, larvae will be attached to the towel. Or use any soapy solution on patches late afternoon when they are close to the surface – the irritation will flush them out. EFEKTO’S SOLUTIONS: 4:1:1 Fertilizer + Karba, alternate with Garden Ripcord. MOLE CRICKETS are tan-coloured , cricket-like insects about 4cm long with short, stout forelegs, spade-like feet and large eyes. Young ones look like adults but without wings and smaller and darker. They feed at night by tunneling through plant roots, and stay underground during the day. Use the same method to flush them out and apply Efekto’s ZERO MOLE CRICKET. Once again, as late as possible in the afternoon. ANTS are getting very active, looking for host plants to deposit aphid eggs. Killing surface ants will not solve the problem, target the colony by

eliminating the soldiers and queen. Scatter Efekto’s Ant Bait Granules or use their ANTRAP bait stations wherever you see activity. Ants are extremely communicative and soon all will know of the readily available food source.
