Speaking of paint, we continue an ongoing discussion of painting the garage floor or basement with a question from reader: “Would concrete stain be a better choice than paint? I used a concrete stain on my outside patio which is exposed to the elements and has held up quite well for 10 years now.” From what I am told, that would be an excellent choice, but I would recommend strongly that you do your research on surface preparation and determine how wet that floor can get, because any moisture might compromise performance over the long run. For advice on the kind of paint, I would recommend talking to the folks at your neighborhood paint retailer. They should know your area and all of its requirements, and should be able to guide your decision. The garage floor stain

should offer protection from oil and paint and other spills, however.

Before you crank up the grill

Now you’re cooking with gas. Some advice for outdoor grilling season, from the testing and certification group CSA International: Make a clean start. Before firing up the barbecue for the first time, carefully inspect burners and burner tubes for blockages due to dirt, grease, insects, or rust buildup. Clean or replace any blocked parts or have a certified technician make repairs. Blowing bubbles. Check for cracked, brittle or leaking hoses. To check for leaks, apply a 50/50 solution of soap and water to hoses and fittings and turn on the main gas or propane valve while leaving burners off. Any leaks will show up as bubbles. Replace any damaged hoses or fittings. Old gas? Take a pass. Propane cylinders must be inspected and requalified a minimum of every 12 years in the United States. A date stamp on the cylinder indicates when it was last qualified. Do not use a rusty or damaged cylinder. If in doubt, have your tank replaced. Breathing fire. Keep grills and barbecues away from combustible materials such as fences, trees, buildings, awnings, and carports. Never use a barbecue in a garage.

Report: Builder sentiment up By Steve Goldstein MarketWatch

WASHINGTON — Home builder sentiment improved in May to the highest reading since the recession on an upturn in sales and traffic, a trade group said this week. The National Association of Home Builders/ Wells Fargo housing market index rose to 29 from 24 in April. The April index was initially reported to be 25. Economists polled by MarketWatch had expected a reading of 27. The reading, though the best since May 2007, is still well short of the 50 level that indicates that more builders view conditions as good than poor. “Builders in many markets are reporting that buyer traffic and sales have picked back up after a pause this April,” said Barry Rutenberg, chairman of the NAHB and a home

builder from Gainesville. The component gauging current sales conditions rose 5 points to 30 and the component gauging traffic of prospective buyers rose 5 points to 23, which was the highest level since April 2007. The component gauging sales expectations in the next six months rose three points to 34. Housing activity remains depressed after the burst of the housing bubble, as house prices have tumbled by roughly a third. David Crowe, chief economist at NAHB, said tough access to credit for both builders and consumers, inaccurate appraisals and rising materials prices have limited gains. But activity in the new-build market has bounced off lows, helped by low mortgage rates and a declining unemployment rate. Ian Shepherdson, chief

economist at High-Frequency Economics, said the builders sentiment data are running ahead of the hard data. “The gap has to close sooner or later,” he said in a note to clients. “The key story here, we think, is improving access to mortgage finance, rather than the level of rates, which have been very low for a long time. After a credit event, availability of credit is the key to real recovery; housing is on the cusp.” The iShares home construction index has surged 30 percent this year. A separate measure of housing affordability released by the National Association of Realtors said its index hit a record high in the first quarter, based on the relationship between median home prices, median family income and average mortgage interest rates.

Rents soar as former homeowners, young workers seek housing By Alejandro Lazo Los Angeles Times

LOS ANGELES — A nation still struggling to clear up one housing debacle has run smack into another — soaring rents. The foreclosure mess has pushed millions of former homeowners with tarnished credit into a competitive apartment market across the U.S. Add fresh demand from young workers, few new units and tight standards for home loans, and the result is rental sticker shock not seen in years. Rents are surging from New York to Los Angeles. The average monthly U.S. rent for apartments hit

$1,008 in the first quarter, pushing past the all-time high set in the third quarter of 2008, according to the data firm RealFacts. In certain markets, it is now cheaper to own a home than rent. Menachem Krinsky recalls how in late 2008 every street seemed ornamented with “for rent” signs when he first moved to Los Angeles from the East Coast. Back then, his landlord was so desperate to keep him as a tenant that he slashed his rent of about $2,000 by $800 after Krinsky’s first roommate bailed on the lease. These days, however, Krinsky’s search for a

one-bedroom apartment costing around $1,500 is shaping up to be a major headache. “I am looking for something clean and new, and unless you want to spend a fortune, it’s hard,” said Krinsky, a 22-year-old art director and graphic designer. Rob Magnotta, a real estate agent, recently listed his two-bedroom Irvine, Calif., condominium for rent on Craigslist for $2,300. He had six applicants within 24 hours, including one who wrote a poignant letter about losing a home to foreclosure. “It was almost too easy,” said Magnotta, who chose

another renter. “I know the rental market was strong. But until you are actually renting the place, I think you are surprised it is that strong.” A big driver of rent increases has been demand from young workers who are striking out on their own after doubling up with family members during the worst of the economic downturn. Alaia Williams, 27, recently moved out of her mother’s Inglewood apartment to be nearer to her job at a Santa Monica, Calif., tech start-up. She and a roommate are splitting the $1,400 rent on a two-bedroom apartment in

Los Angeles’ Palms neighborhood. “We can’t afford to live” closer to work, she said. People who have lost their homes to foreclosure or short sales are also feeling the sting. Damaged credit means many must pay a premium or put down a bigger deposit to secure a place. Robert Corlette pays about $1,700 a month for a two-bedroom townhouse in Anaheim Hills, Calif., that he shares with his wife and five children. The family lost their home to foreclosure in 2009 after Corlette lost his $75,000-a-year job selling insurance. His current job, also in the insur-

LIVE-IN CAREGIVERS by Cathy L. Lucrezi, Attorney at Law It is easy to imagine many scenarios where a handicapped individual may require the assistance of another person. For individuals with severe mobility impairments, a caregiver may assist with moving the tenant in and out of a wheel chair. For individuals with dementia, a caregiver may be responsible for keeping the tenant safe. A caregiver may be responsible for housekeeping, paying bills, administering medication, and/or a thousand other tasks. A tenant’s request for a live-in caregiver should be handled just as any other request for a reasonable accommodation. The tenant must demonstrate she is handicapped and needs the caregiver. If it is reasonable to grant the request, the landlord is obligated to “bend the rules” and let the caregiver move in. Who is a caregiver? A caregiver is a person who performs some type of service to a handicapped tenant so that the tenant is better able to use and enjoy the rental premises. The caregiver does not have to be certified or licensed. She could be the tenant’s relative or she could be someone from a nursing agency. The caregiver is whoever the tenant says he is. When is a caregiver needed? As with any other request for an accommodation, the landlord can require the tenant to produce verification of the need for the caregiver. If the tenant’s health care provider (doesn’t have to be a physician) says the caregiver is needed by the handicapped tenant, then the caregiver is needed. Period. The landlord should not second guess the health professional’s opinion. What should the lease say? The live-in caregiver is not a tenant and should not be listed as a tenant on the lease. The caregiver is not responsible for rent or any other charges that may become due under the lease. Only the tenant is responsible for that.

Neither should the caregiver be listed as an occupant. The caregiver has no status as a tenant and no entitlement to protections of the landlord tenant statute. His presence in the household is based solely on the tenant’s need for his services. The live-in caregiver is in a category by himself. The lease should include a provision, or there should be an addendum, that indicates the name of the caregiver and acknowledges that the tenant remains responsible for performance of the lease and the conduct of the caregiver. The lease should make the tenant responsible for notifying the landlord of any changes in who serves as caregiver. Can the caregiver be “checked out”? Because the caregiver is not a tenant, the caregiver’s income is irrelevant. There is no need for the caregiver to complete an application or for a landlord to run a credit check. However, it is perfectly legitimate for a landlord to run a criminal background check. The landlord can request the minimum amount of data necessary to run the check. If that means the caregiver must sign an authorization, then it is the tenant’s responsibility to obtain it. If the criminal background check reveals a conviction that wouldn’t pass muster under a typical application, then it is reasonable for the landlord to refuse to allow that particular caregiver to move-in. Sample lease provision (name of caregiver) shall reside in the premises as Tenant’s caregiver. It is understood that the caregiver is not a tenant entitled to the protections or entitlements of the lease, nor of the statutes related to landlord tenant matters. If Tenant changes caregivers, Tenant shall notify Landlord of the name of the new caregiver prior to the new caregiver taking occupancy. Landlord may conduct a criminal background check of the caregiver and may condition consent to the caregiver upon the results of the criminal background check. Tenant is responsible for any lease violations that occur through the acts or omissions of the caregiver. Tenant shall provide a copy of this lease to the caregiver.

ance industry, pays about half that. “There is a lot of pressure,” said Corlette, 56. “It wears you down.” The crash has made owning a home more affordable than renting in some markets. An index by the research firm Green Street Advisors compares buying with renting in 79 metro markets; that index hit its most attractive point last year for buying since 1991, when the firm began tracking the data. Researchers calculate that the after-tax cost of a mortgage is only 10 percent higher than what it costs to rent nationally after taking into account mortgage rates, property taxes and other factors. Rising rents have converted some renters into buyers. Scott Matulis, 48, recently purchased a townhome in Oak Park, Calif., after enduring two consecutive years of rental increases. His mortgage, taxes and homeowner association fees now total $2,200, just $100 more than what he was paying his landlord. “I finally just pulled the trigger and figured I’d be throwing money away on rent,” Matulis said. Although rising rents may be motivating home purchases by people who are in good shape financially, those increases are walloping working class families and the poor — groups already hard hit by job losses, lost income and stagnant wages. Virginia Villa of Brea, Calif., a single mother of four who works as a manager at Disneyland, has doubled up with her adult daughter, who contributes $400 to the monthly household budget. Still, Villa said, about half her takehome pay goes toward rent and utilities. “I have a decent job and I would love to buy a house, but I don’t think that’s possible to do,” Villa said.

Lenders less leery of reducing homeowners’ principal By Hudson Sangree McClatchy Newspapers

SACRAMENTO, Calif. — Principal reduction, long a nonstarter with lenders, has suddenly become a potential reality for thousands of homeowners who owe far more than their houses are worth. Some economists and politicians have argued for years that the only way to revive the housing market and jumpstart the economy is to vastly reduce the amount Americans owe on their mortgages. But lenders have balked at writing down debts. Now, however, as part of the $25 billion mortgage settlement announced in February, some of the nation’s largest lenders have agreed to reduce loan balances for thousands of customers. Bank of America announced this week that it would offer more than 200,000 borrowers relief by reducing principal to as low as a home’s current value. And in a key development, Keep Your Home California, the state’s major housing-aid effort, said it was changing its rules to no longer require a lender contribution to its Principal Reduction Program, which provides up to $100,000 in loan forgiveness. That change will benefit as many as 9,000 borrowers in the state, program officials said. In addition, Fannie Mae and Freddie Mac, the government-backed mortgage giants that control the majority of mortgages in the state, will now allow loans to be paid down by the California program. Before, when a lender contribution was required, Fannie Mae and Freddie Mac would not participate. Diane Richardson, head of Keep Your Home California, said the changes will “level the playing

field” for underwater borrowers, who have been unable to refinance homes in which they have no equity. “It gets them back to the point where they won’t be so underwater that they just feel helpless,” she said. Even as it gains momentum, principal reduction remains deeply controversial, with some experts calling it a potential cure for the economy and others expressing concern about its effectiveness and fairness. Keep Your Home California’s Principal Reduction Program, for example, benefits home owners who have experienced economic hardship, such as job loss, and who are delinquent on their loan payments or facing foreclosure. A borrower in that situation could receive a principal write-down of up to $100,000, while their neighbor, who has made mortgage payments on time but who is also deeply underwater, receives no debt reduction. About 30 percent, or more than 2 million, of California’s 6.8 million mortgaged properties were underwater in the fourth quarter of 2011, Santa Ana-based CoreLogic reported. The question with principal reduction is “who do you give it to?” said Mike Himes, vice president of NeighborWorks in Sacramento, a nonprofit that helps struggling homeowners. Himes, who stressed he was expressing his own views and not those of his organization, said those who have their loan balance reduced — in some cases because of only temporary job loss — will be better positioned to build equity as the housing market recovers. Those who stayed employed and kept paying, on the other hand, may never catch up. “Selected

people will get back (lost equity) and some won’t,” he said. Himes said loan modifications, which reduce interest rates and extend payment terms, can make mortgage payments affordable without giving some homeowners a big advantage. Many critics of principal reduction say it creates an incentive for borrowers to default on their loans in order to take advantage of assistance programs. Some economists call such incentives for bad behavior, with others paying the costs, a “moral hazard,” and warn against them. “Principal reduction should be the absolute reduction of last resort,” said Anthony Sanders, a professor of real estate finance at George Mason University. Sanders made his comments during a panel discussion on principal reduction last month at the Brookings Institution, a public-policy think tank in Washington. The keynote speaker at the event was Edward DeMarco, acting head of the Federal Housing Finance Agency, the government conservator that oversees Fannie Mae and Freddie Mac. Democratic politicians have criticized DeMarco for refusing to let the government-sponsored enterprises reduce the principal of loans they own or back. To do so, he has argued, would undermine his responsibility to preserve their assets and minimize losses to taxpayers, who invested more than $187 billion in Fannie Mae and Freddie Mac following their near collapse in the housing crash. In his April speech, DeMarco said it might make sense in some circumstances to offer principal reductions. But he said a large-scale effort would come at net cost to

taxpayers of $2.1 billion and would affect less than one-tenth of the estimated 11 million underwater homeowners in the United States. “This is not about some huge difference-making program that will rescue the housing market,” DeMarco told the Brookings audience. Others disagree. California Attorney General Kamala Harris, a key player in negotiating the national mortgage settlement, has been one of DeMarco’s critics. In February, she wrote him saying the settlement would help borrowers of Bank of America, Chase and Wells Fargo, who promised to provide at least $12 billion for principal reduction and short sales, where lenders agree to accept less than what they’re owed. The settlement did not include Fannie Mae and Freddie Mac, Harris noted. She urged DeMarco to cease foreclosures in the state and to conduct a “straight-forward analysis” of whether a broad program of principal reductions would help homeowners and save taxpayer dollars. Harris expressed confidence that the agency’s potential findings would confirm her views. DeMarco wrote back denying her request. He said the agency had already analyzed the benefits of principal reduction, and had concluded it was no more effective than other tools that reduced monthly payments without such high costs. Those tools included cutting interest rates and extending loan terms. “There is no question that underwater borrowers in California would benefit from other taxpayers across the United States paying off the underwater portions of their mortgage debt,” he wrote to Harris. But

DeMarco said his obligation was to taxpayers and to ensuring maximum assistance at minimum cost. That’s the wrong way to look at it, said Jeffrey Michael, director of the Business Forecasting Center at the University of the Pacific in Stockton. The biggest benefit to all taxpayers, he said, would be to pull the economy and the housing market out of its slump by erasing debt that may never be repaid — and which will only lead to more foreclosures and economic turmoil. Principal reduction should be open to a broad range of borrowers, not just to those who are delinquent, to address the fairness issue and to avoid providing incentives for borrowers to stop paying, he said. He said borrow-

ers don’t need to see their negative equi ty erased, but suggested that loan balances should be no more than 120 percent of home values. “It gives them an incentive to stay in their home and gives them light at the end of the tunnel,” he said. Who would pay the billions of dollars such a program would cost? Taxpayers, he said. It makes sense, he said, because those same taxpayers will pay regardless, though depressed home prices, lagging job recovery, neighborhood blight and under-funded schools. The downward spiral will only continue as long as there’s a massive amount of negative equity on the books, he said. With a broad-ranging debt reduction, he said, “I think we’ll all be better off.”

Renovations transform two Parade of Homes winners By Dave Hodges HomeFinder.com Editor

Two builders in the 2012 Parade of Homes stand out not only for the unique homes they built, but the kind of projects they did. In the renovation and remodeling category this year were GBGH Construction and D Stich Construction Services LLC. They both won awards for their work and will have their entries open today from noon to 6 p.m. Builder Matt McHaffie, owner of GBGH, noticed the two-story brick house at the corner of Georgia and Meridian streets when he was looking for a place to live. It had been on the market for three years and needed a lot of work. “I noticed that and with my remodeling background, I though this was a great location and a great neighborhood,” McHaffie

said. He was also encouraged by the structural soundness of the house, which had been built in 1948 with poured concrete walls 8 inches thick. “I was really happy to know that the guy definitely cared about what he was doing,” McHaffie said of the original builder. The house, which won the Gold Award in the renovation category, was originally 3,000 square feet and consisted of a basement and a main floor. GBGH converted that to a three-level house by creating a master suite with bedroom, walk-in closet and master bath in what formerly was the attic. The top level also got a deck on the east side of the house, just like the two floors below. Now the house is three bedrooms and two baths, and totals 4,300 square feet. The basement is unfinished,

but McHaffie said it can become an in-home office, apartment or “man cave.” The project included $10,000 worth of high-efficiency windows custom made for the existing wall openings. “I didn’t want to mess with any of the existing window or door openings because I didn’t want to disturb the structural integrity of the house,” he added. In similar fashion, builder David Stich took a lakefront home built in 1950 on Echo Point Lane and turned it into a three-bedroom, two-bath layout with all new plumbing and airconditioning systems and a bonus room added upstairs. “We only added about 400 square feet of living space to the building, but we completely renovated the inside,” said Stich, who worked for many years with Turner Heritage Homes and is now running

The project also included sprayed-in foam insulation, ceramic tile floors, new countertops and stainless-steel appliances. The home won the Parade of Homes’ Silver Award in the renovation category. “We kept the style and charm of a vacation home,”

Stich said. “The ceilings throughout the house are the tongue-and-groove pine with the exposed beams.” He’s most proud of the view from the upstairs window. “You can see Lake Bradford,” Stich said. “That’s the draw — the million-dollar view.”
