Hot days of summer will test your skill in conserving energy By Alan J. Heavens The Philadelphia Inquirer

Nature doesn’t appear willing to cut consumers a break. Neither does the economy. Longer, colder winters turn quickly into prolonged, hotter summers. To add insult to injury, it seems to be happening while the cost of energy is skyrocketing. This week’s 90+ degree days tested the endurance of even those who thrive on sultry weather. As household electric meters spin at warp speed, how can you rein in energy costs and remain as comfortable as possible? “My first response would be to add insulation

to ensure a well-sealed house, but if homeowners cannot manage it in the middle of a heat wave, I understand,” said Ronnie Kweller, a spokeswoman for the nonprofit Alliance to Save Energy in Washington. A no-heavy-lifting alternative: buying an Energy Star-rated programmable thermostat for “as little as $25.” “When the house is empty, the thermostat could be turned up and set to have the temperature drop to more comfortable levels by the time you arrive home,” Kweller said. Just doing that can cut energy expenses 10 percent, she said, adding that the cost of cooling a house

in summer averages about 12 percent of your annual energy bill. Most utility companies and energy-efficiency advocates recommend raising the thermostat to 78 degrees when you’re home, 85 degrees when you’re away. In a 2,400square-foot house, the savings per degree would equal $4, according to Georgia Power in Atlanta. Other fairly easy ways to chill a bit include replacing furnace/air-conditioning filters regularly, as recommended by the manufacturer; closing blinds, curtains, and shades on the sunny side of the house; and using energy-efficient lights that don’t produce a lot of

heat. A variety of sources offer ways to cut costs while staying, if not cool, less hot: Massachusetts utility company NStar, among others, suggests using a ceiling fan to create a breeze and keep air circulating. To get rid of hot air while cooking, turn on an exhaust fan. The savings on cooling costs will far outweigh the electricity used. Take lukewarm showers and baths to avoid humid air, which holds heat. Not all energy-saving measures have to do with keeping comfortable. And some require an explanation.

The California Energy Commission’s Consumer Energy Center, for example, says: “Having lots of food in your fridge keeps it from warming up too fast when the door is open.” “It seems that there are two reasons why it’s better to keep the refrigerator full when possible,” Kweller said. “The solid food itself retains the cold, and the tightly packed items serve as a physical barrier to the cold air rushing out when the door is opened.” A corollary to this: Let hot items cool down before placing them in the refrigerator so it doesn’t have to work as hard. CREDIT REPORTS AND “DISMISSALS”

by Harry Anthony Heist, Attorney at Law In the “Public Records” section of your typical credit report, you will see things like evictions, foreclosures, suits for money and bankruptcy filings. Most application processing companies obtain and compile this data to allow the landlord to make a more informed decision on whether or not they will rent to the applicant. Often you will see that an eviction was filed on the applicant, and the disposition was “Voluntary Dismissal” or “Dismissed”. Does this mean that the tenant was not evicted or that everything was amicably resolved? Don’t be so sure. The “Dismissal” Not all tenants who have evictions filed against them are actually “evicted” by the Sheriff. A number of things can happen. The tenant may vacate the premises voluntarily shortly after the eviction is filed. The tenant may pay all the money owed, and the landlord requests that the eviction be stopped. The tenant may enter into a Stipulation with the landlord, under which payment arrangements are made, and the tenant successfully stays and pays pursuant to the settlement terms. In all these scenarios, the eviction filing will show up in the public record and will be in this public record for many years. Eventually, the eviction matter is “dismissed” and is recorded as such. There are two main ways an eviction is dismissed. It will either be by the landlord’s attorney filing a “Voluntary Dismissal”, or the court entering a “Dismissal for Failure to Prosecute”. In both cases, the public record will show the case as being dismissed, BUT it does not always mean that things were worked out or that the tenant paid the rent. Usually, it is quite the opposite and simply means the tenant vacated and the eviction was not processed further. The Voluntary Dismissal When a tenant vacates, the attorney may file a “Voluntary Dismissal”. This means that the case is no longer being prosecuted, as no further action is necessary on the file. The landlord got what they wanted, which is possession of the premises. In the situation where a Stipulation is entered into by the parties, the Stipulation may provide that the case will be voluntarily dismissed upon the tenant making the payments as planned. Unfortunately, the landlord, when looking at a “Voluntary Dismissal”, usually has no way of knowing why the case was dismissed. Without further information, the best assumption a landlord can make is that the eviction was filed and that the tenant vacated.

Many evictions are filed as Two-Count Complaints. Under the first count the landlord is asking for possession, and under the second count the landlord is suing for money damages. In order to get a judgment for money damages in Count Two, the tenant will have had to be served personally with the eviction action or will have filed an answer to the complaint. Often, neither of these two contingencies occur, and at the end of the eviction or some time after the eviction is over, the attorney will file the Voluntary Dismissal with the court to close the case out. There may even have been a Final Judgment for Eviction somewhere in the public records, but the final action showing up may be that “Voluntary Dismissal as to Count Two” The Dismissal for Failure to Prosecute If an eviction is filed, the tenant vacates and the attorney takes no further action, the Clerk of Court’s office will eventually send out a notice to the attorney and the tenant stating that the case will soon be dismissed by the court on its own, if the attorney for the landlord or the tenant does not pursue the case any further. This could be six months after the case has been filed, or even more than a year. The attorney will either then file a Voluntary Dismissal closing out the case or do nothing, and the Court will go ahead and dismiss the case. If a Two-Count complaint has been filed and no personal service has been effected on the tenant, the Court will know that the case is probably not going to proceed any further and will want the case dismissed. This dismissal by the court happens to tens of thousands of cases each year. The Court does not want to keep files unnecessarily open and will purge them from their active case system. When the landlord looks at the public record results, it will show as a “Dismissal”. What should the landlord do when the record shows “Dismissed”? There is a high probability that the applicant had an eviction filed against him or her by a prior landlord and just vacated. It is imperative that if any eviction filing shows up on the public record, the landlord looks into the matter deeply to find out exactly what happened during the eviction. Did the tenant pay and stay? Did the tenant vacate? Did the tenant get fully evicted? These are all questions that can be answered by looking at the Court file further and contacting the prior landlord. Most counties are now online on the internet, and a lot of information will be available to the landlord by simply going to the website of the Clerk of Court where the tenant had the eviction filing and examining the docket.

Speaking of washing: Do laundry in a more energy-conscious way by using the warm- or coldwater setting. Use cold water to rinse clothes (savings: 4 percent). Line-dry clothes whenever you can (savings: 5 percent). When you run the dryer, do full loads, use the moisture-sensing setting, and clean the lint trap after each use (savings: 0.5 percent). Most new electronics use electricity even when off. Unplug phones and chargers; turn computers and printers off at the power strip (savings: 1 percent to 2 percent). Unplug or recycle that spare refrigerator if you don’t really need it. It can save you up to $150 per year. Turn your water heater down to 120 degrees to save even more money on your electricity bill. When baking, Georgia Power says avoid opening the oven door, which lets out 20 percent of the heat. Use a timer. When cooking on top of the stove, use pots and pans that match the size of your burners, which brings more heat to the pan and less to the surrounding area.

‘Gatsby’ place joins doomed mansions

MELVILLE, N.Y. — The once-grand white house watches over Long Island Sound from the tip of Sands Point, its days numbered. Lands End, the 25room colonial revival mansion that local lore says was F. Scott Fitzgerald’s inspiration for Daisy Buchanan’s home in “The Great Gatsby” faces demolition this month. In the 1920s and ’30s, Winston Churchill, the Marx Brothers and Ethel Barrymore attended parties there. Fitzgerald was perched on the back deck, drinking in the view. Rooms featured marble, parquet and wide woodplanked floors, Palladian windows and hand-painted wallpaper. Now, the front door is off its hinges, wood floors have been torn up for salvage, windows are missing and the two-story Doric columns are unsteady. Sands Point Village in January approved plans to raze the house and divide the site into lots for five custom homes starting at $10 million each. Lands End is the latest Gold Coast estate to fall. With each demolition, the North Shore loses more of its gilded past, when sea breezes and social events attracted the rich and famous. Historians say hundreds of the mansions have been lost in the past 50 years as owners faced increasing taxes and high maintenance costs. “The cost to renovate these things is just so overwhelming that people aren’t interested in it,” said Clifford Fetner, president of Jaco Builders in Hauppauge, N.Y., and Lands End project construction manager. “The value of the property is the land.” Among the estates already lost are the former homes of financier J.P. Morgan on East Island

and glassmaker Louis C. Tiffany in Laurel Hollow. From about 1890 to 1950, business titans, politicians and old-money families built as many as 1,400 opulent homes on the North Shore. The Gold Coast stretched from Great Neck to Eatons Neck and down to Old Westbury, said Paul Mateyunas, a historian and real estate agent at Daniel Gale Sotheby’s International Realty. The homes often were designed by noted architects like Stanford White and echoed European grandeur. They belonged to Vanderbilts, Woolworths, Morgans and Astors. “The No. 1 priority is drawing attention to these mansions, saving what we can,” said Oyster Bay author and historian Monica Randall. Sands Point Village Trustee Katharine Ullman, who lives near Lands End, at first opposed the subdivision, saying it would increase traffic, disturb a creek and tear down a navigation landmark for sailors. But now, “I understand the problem,” she said. “It was costly to make the repairs to make it livable.” Taxes, insurance and maintenance of the 24,000-square-foot house and 13-acre grounds total as much as $4,500 a day, said David Brodsky of 4B’s Realty, which is redeveloping the site. His father, health-care entrepreneur Bert Brodsky, bought Lands End for $17.5 million in 2004 from Virginia Kraft Payson, the late wife of former New York Mets owner Charles Shipman Payson. “In its heyday, it had 20 in help,” David Brodsky said. “It was a true Gold Coast estate.” The state Offices of Parks and Historic Preservation acknowledged that the costs of rehabilitation were prohibitive, but required the family to

provide historical documentation and photos about the property. “You can’t save everything,” Ullman said, adding that some historic homes “are being restored. Maybe that’s the best we can do.” But about 500 historic North Shore homes were knocked down in the1950s and ’60s, Randall said. More have fallen in the

past 30 years. “It’s becoming more and more of an epidemic,” said Alexandra Wolfe, director of preservation services at the Society for the Preservation of Long Island Antiquities. The senior Brodsky has said he bought Lands End with plans to live there, but his family objected. He put it up for sale in 2006 for $30 million.

Do Your Homework When Selecting a Remodeler The Tallahassee Builders Association’s recent Parade of Homes™ was a huge hit in the community, as evidenced by the record number of visitors to the 29 news homes on display. ORLANDO — Jim Benson is kicking in more than the appliances to help sell his historic home in downtown Orlando. He is also giving away his vintage Rolls-Royce Silver Shadow. Frustrated with trying to sell the $699,000 house for the past year and a half, he put up yard signs recently advertising the car giveaway. The gleaming black Rolls hasn’t sold the house so far, but Benson is hopeful. “Someone who might want a classic home might appreciate a classic auto to go with it,” said Benson, whose interests of late have turned to restoring pipe organs. Selling a house in today’s foreclosure-underpinned market is difficult for anyone: On average, Orlando-area homes took more than three months to sell in April, compared with less than a month at the height of the buying frenzy in July 2005, according to figures kept by local Realtors. Owners of custom homes have to work even harder to lure qualified buyers. Realtor Margaret Barnes said the number of showings at the Benson house has increased in recent weeks, though she was unsure whether the car had anything to do with it. Home sellers have given away cars before. Cambridge Homes, for instance, has tossed in a Mini Cooper with a purchase. But the keys to a chauffeur-worthy Rolls? Benson knows he’s competing against houses with furnishings staged by interior designers. His son has told him that buyers want granite counter-

tops and luxury master suites. Benson’s yellowbrick, columned house has none of those things. Both the house and the car, however, share a more understated appeal. The four-story home rests on dense, fortresslike wooden beams that weigh more than cast concrete. Its long-hewn floor planks dwarf today’s laminates. Similarly, the 40year-old car has no halogen headlights or LCD screens, but the back seat smells like hand-tooled leather from prized cowhide. The doors shut with a vacuum-seal sound rather than a metallic clang. The engine of the 2-ton behemoth, Benson said, runs so well that it “has never had a wrench touch it.” Benson said he first fell in love with the car of British royalty in the mid-1960s, when he was stationed with the U.S. Navy in Scotland and on temporary assignment in London. Four years after returning to the States, he still longed for the classic auto and went back for one. In England, he found a used 1967 Shadow in good condition for $12,000. After paying $1,000 for shipping, it was his. Silver Shadows, produced in greater numbers than other Rolls models, retail today from less than $20,000 to $50,000 each. “I didn’t tell many people I owned it because people get the wrong idea – that you’re rich,” he said. “Better to play it low key.” Benson said he still prizes the quality of both the car and the house, but he no longer drives the one, and his knees complain about the flights of stairs in the other.

The title agent will review the public land records for the property including deeds, outstanding mortgages and judgments, property liens, easements, pending legal actions, and notary acknowledgments. When issues are uncovered, the title company will work with the parties to correct them so the transaction can move forward. After the deed is executed and filed and the real estate transaction is complete, the policy will continue without any additional premium. When there is a hidden or overlooked issue covered by the title policy, such as a forged signature or incorrect public record, a title policy will protect the owner and lender. Question: My husband and I co-signed a loan for our son and his now ex-wife. Our son stayed in the home, but fell behind on the payments and the home was in foreclosure. His ex-wife discharged her mortgage debt through bankruptcy, but her name is still on the deed. Our son has deeded the house to us, and we made payments to the bank to bring the property out of foreclosure. We’re trying to complete a short sale, but she won’t cooperate. What can we do? – Carole Answer: Co-signing a mortgage is always a risky move because it means that borrowers are responsible for the loan payments without rights in the house that is securing the loan. You at least have rights because your son deeded the home to you, but your patience will be tested by your former daughter in law. Check your son’s divorce papers to see if the court ordered the ex to deed the property to your son. If that’s the case, and she hasn’t complied, your son can point that out to the judge. If the divorce papers are no help, explain to her that she has the responsibilities of ownership, even though she no longer owes the bank. She could be personally liable to the homeowner’s association and tax collector. And if someone is hurt on the property, she’ll be sued right along with you. If that doesn't do the trick, you may be able to sue to have the court determine everyone’s interest in the property. The judge may even order her to cooperate in a short sale.
