Cleanup tips for patio bricks that turn black over time By Alan J. Heavens The Philadelphia Inquirer
Question: I have a dry-laid brick patio bordered on three sides by flower beds. Over the years I have noticed that the bricks are turning black on top. This is not from garden soil or mud, and it is not uniform in its coverage. I have thought about scrubbing the bricks with a waterbleach mix, but I am afraid that it will bleach the bricks. What is the black stuff, and how do I get it off without changing brick color? Answer: You can try Oxy-Clean, the oxygenat-
ed bleach that we use to clean mildew off 18thcentury headstones in our churchyard. It could be oil, according to some sources, leaching from mulch in the flower gardens, or black algae, others say. Regular cleaning may be necessary, whatever the cause. Q: The water in my house in Avalon, N.J., has developed a rotten-eggs odor. I first noticed it after Sandy hit, when a friend took me to the Shore to check the house. I thought at the time the odor might have been caused by the storm affecting the water quality, but when I was there this
weekend, the smell was still apparent in all the water faucets. It is stronger in the hot water, but that is probably because hot water releases gas more easily than cold. I have read that this gas is not necessarily a health threat, and the only step I have taken so far is to buy lots of bottled water for drinking and cooking. I really have no idea where to begin to find the solution to the problem. I asked my neighbors, and none of them has noticed any odor. A: The best explanation for the rotten-egg smell — hydrogen sulfide
gas, which occurs naturally in groundwater — comes from a D.C.-area company called Magnolia Plumbing, Heating & Cooling, www.magnoliaplumbing.com: The odor also can be produced by sulfur bacteria or chemical reactions inside water heaters, or by pollution, which is probably the case, at least initially, with Sandy. The rotten-egg smell does not mean your water is unsanitary, except in the rare case that the gas is caused by sewage pollution. Hydrogen sulfide gas in the air can be harmful in high concentrations, Magnolia’s plumbers say.
When removing the gas from the water, which is possible, it’s important to vent the gas outside so it doesn’t collect in low-lying places like well pits, basements, or in enclosed areas like well houses. How can you find the problem, and correct it? This is where calling your plumber becomes an important step. If the rotten-egg smell only comes out of hotwater faucets, there’s probably a problem with the water heater. If the smell is coming from both faucets, but only comes from water that has been treated by a water softener, the prob-

CREDIT REPORTS AND “DISMISSALS”
by Harry Anthony Heist, Attorney at Law In the “Public Records” section of your typical credit report, you will see things like evictions, foreclosures, suits for money and bankruptcy filings. Most application processing companies obtain and compile this data to allow the landlord to make a more informed decision on whether or not they will rent to the applicant. Often you will see that an eviction was filed on the applicant, and the disposition was “Voluntary Dismissal” or “Dismissed”. Does this mean that the tenant was not evicted or that everything was amicably resolved? Don’t be so sure. The “Dismissal” Not all tenants who have evictions filed against them are actually “evicted” by the Sheriff. A number of things can happen. The tenant may vacate the premises voluntarily shortly after the eviction is filed. The tenant may pay all the money owed, and the landlord requests that the eviction be stopped. The tenant may enter into a Stipulation with the landlord, under which payment arrangements are made, and the tenant successfully stays and pays pursuant to the settlement terms. In all these scenarios, the eviction filing will show up in the public record and will be in this public record for many years. Eventually, the eviction matter is “dismissed” and is recorded as such. There are two main ways an eviction is dismissed. It will either be by the landlord’s attorney filing a “Voluntary Dismissal”, or the court entering a “Dismissal for Failure to Prosecute”. In both cases, the public record will show the case as being dismissed, BUT it does not always mean that things were worked out or that the tenant paid the rent. Usually, it is quite the opposite and simply means the tenant vacated and the eviction was not processed further. The Voluntary Dismissal When a tenant vacates, the attorney may file a “Voluntary Dismissal”. This means that the case is no longer being prosecuted, as no further action is necessary on the file. The landlord got what they wanted, which is possession of the premises. In the situation where a Stipulation is entered into by the parties, the Stipulation may provide that the case will be voluntarily dismissed upon the tenant making the payments as planned. Unfortunately, the landlord, when looking at a “Voluntary Dismissal”, usually has no way of knowing why the case was dismissed. Without further information, the best assumption a landlord can make is that the eviction was filed and that the tenant vacated.

Many evictions are filed as Two-Count Complaints. Under the first count the landlord is asking for possession, and under the second count the landlord is suing for money damages. In order to get a judgment for money damages in Count Two, the tenant will have had to be served personally with the eviction action or will have filed an answer to the complaint. Often, neither of these two contingencies occur, and at the end of the eviction or some time after the eviction is over, the attorney will file the Voluntary Dismissal with the court to close the case out. There may even have been a Final Judgment for Eviction somewhere in the public records, but the final action showing up may be that “Voluntary Dismissal as to Count Two” The Dismissal for Failure to Prosecute If an eviction is filed, the tenant vacates and the attorney takes no further action, the Clerk of Court’s office will eventually send out a notice to the attorney and the tenant stating that the case will soon be dismissed by the court on its own, if the attorney for the landlord or the tenant does not pursue the case any further. This could be six months after the case has been filed, or even more than a year. The attorney will either then file a Voluntary Dismissal closing out the case or do nothing, and the Court will go ahead and dismiss the case. If a Two-Count complaint has been filed and no personal service has been effected on the tenant, the Court will know that the case is probably not going to proceed any further and will want the case dismissed. This dismissal by the court happens to tens of thousands of cases each year. The Court does not want to keep files unnecessarily open and will purge them from their active case system. When the landlord looks at the public record results, it will show as a “Dismissal”. What should the landlord do when the record shows “Dismissed”? There is a high probability that the applicant had an eviction filed against him or her by a prior landlord and just vacated. It is imperative that if any eviction filing shows up on the public record, the landlord looks into the matter deeply to find out exactly what happened during the eviction. Did the tenant pay and stay? Did the tenant vacate? Did the tenant get fully evicted? These are all questions that can be answered by looking at the Court file further and contacting the prior landlord. Most counties are now online on the internet, and a lot of information will be available to the landlord by simply going to the website of the Clerk of Court where the tenant had the eviction filing and examining the docket.

If the smell comes on strong when either the hot or cold faucets are first turned on, but diminishes after a little while, you probably have sulfur bacteria in the well or distribution system. If the smell is strong when you first turn the faucets on and doesn’t go away, there’s probably hydrogen sulfide gas in the groundwater. While I’m a fan of do-it-yourself, I limit what I do to things that are relatively routine or provide a great deal of satisfaction, such as building a coffee table or a bookcase or painting the dining room or the exterior of the house. I leave the important stuff to professionals, and you should, too. It’s worth the money to get it done properly and quickly, rather than try to do it yourself and end up having to spend even more to extricate yourself from a situation you have made much worse. The rotten-eggs smell has an obvious source. Your plumber, experienced with Shore houses, will find it.

rates are at an all-time low and home values are stabilizing and in many areas increasing, which gives consumers the confidence boost they need to make a decision to purchase a new home or remodel an existing home,” said Lambert, president of Shane Y.

Kitchen Up-Tune Meets Need for Affordable Remodels In our continuing series on “Home Remodeling Month” in June, the Tallahassee Builders Association is pleased to highlight one of its members, Frank Skubel of Kitchen Tune-Up, who has a long track record of helping consumers make affordable upgrades to one of the most important rooms in the home. Kitchen Tune-Up is a locally-owned, national franchise that offers minor kitchen remodels. “We’re not selling our clients more than it takes to accomplish their goals according to their budget,” says Skubel. “We once talked a client out of a new kitchen because what she wanted could be accomplished through refacing and a couple of new cabinets. Needless to say, she saved lot of money.” The company specializes in three services to update kitchens without clients having to empty their bank account. Lambert added that he felt the improving market would encourage lenders to feel more confident in making loans to credit-worthy home buyers. Masoud Karimipour, owner of Persica Homes and first vice president of the TBA, agrees with the assessment, also citing historically Karimipour low mortgage interest rates plus shrinking home and lot inventories, and consumer excitement over such new-home features as modern kitchens and alluring master suites. “Consumer interest in the Parade of Homes this year was Weekley the best I’ve seen in years and I think people understand that now is a great time to buy a new home,” said Karimpour, whose Parade entry sold during the mid-May event. “Even though mortgage rates are very low, they are rising, which should create a sense of urgency for those looking to buy.” For some builders, like Alan Weekley of Alan Weekley Homes Inc., the change in consumer attitude came after last fall’s presidential election, when people decided it was time to move on with life and major purchase decisions. “I’ve had a lot of prospects (for remod-
eling and new homes) who were on the fence for a long time,” Weekley said. “Now, they are moving forward. During the downturn, my business was mostly remodeling. Now I’m very excited to have a number of new custom homes on the drawing boards as well as some large remodeling projects.” Appraiser Greg Lane of Timberlane Appraisal Associates Inc. is one of the area’s leading real estate experts. He echoes the positive sentiment expressed by the builders. “Most segments of the Leon County market have recovered or are seeing increasing demand and activity,” Lane said. “New construction is booming, relative to even a year ago, and builders are much more in tune with their target markets. Builders are now scrambling to find affordable, constructionready lots at affordable prices, to meet the demand of end users.” Lane adds that the resale market is just as good, with most of the competitively priced homes, in good condition and in the right location, selling quickly. “A sixmonth supply of Lane homes is considered a balanced market by most experts,” Lane noted. “Our overall supply in Leon County is now just below eight months of inventory. So as long as the activity and demand increase, while inventory stabilizes or decreases, we should continue on this path of real estate recovery.” Suzanne Cook, executive director of the Tallahassee-based Florida Green Building Coalition, has watched the rebound in the Tallahassee market from a different perspective. “Since 2009, we’re seen slow, steady growth in new homes being FGBC-certified but just recently, we’re seeing more entire communities commit to FGBC standards, which means developers and builders are experiencing and anticipating consumer demand for green homes.” Cook said she expects homes that are environmentally friendly and energyefficient to be the norm rather than the exception in the future. Including Tallahassee, 29 new markets were added to the improving market list, while 24 others were dropped from it this month. “This is the fifth consecutive month in which the IMI has designated more than 70 percent of U.S. metros as improving,” said NAHB chairman Rick Judson, a home builder from Charlotte, NC. “While that’s a good sign that the housing recovery is on solid footing, we know that various challenges are slowing its progress — including continuing issues with credit availability for builders and buyers, as well as appraisals that aren’t keeping up with the rising cost of construction,” Judson said. As market conditions improve across most of the country, some metro areas have moved onto the IMI list while mar-

ginal seasonal fluctuations have nudged others off of it, noted David Crowe, the NAHB’s chief economist. “This is to be expected as the recovery expands. Meanwhile, it’s worth noting that the number of improving markets is now more than three times what it was in June 2012.” The IMI is designed to track housing markets throughout the country that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top Metropolitan Statistical Areas. The three indicators that are analyzed are employment growth from the Bureau of Labor Statistics, house price appreciation from Freddie Mac and singlefamily housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metro area must see improvement in all three measures for at least six consecutive months following those measures’ respective troughs before being included on the improving markets list.

parking, noise and crime. What looks to be a great community at 11 a.m. on a Wednesday may have lots of noise and no parking on Saturday afternoons. Or the next-door neighbor has barking dogs that you didn’t notice on the first visit. Then you need to look into the condition of the property, checking to see that it is well-maintained
and cared for. Find out if the landlord provides regular pest control and how broken appliances and other problems are handled. The apartment will be in its best condition when the landlord is trying to rent it, and if things are not right then, they likely will be even worse later. Finally, check into the landlord. With so much
information on the Internet, it’s easy to find out from property records whether the person you are dealing with is actually the owner. Check court records to make sure the house is not in foreclosure or behind on its homeowner’s association payments. Also, see if your landlord has evicted people in the past and ask
why it happened to get a sense of his or her attitude.
