WASHINGTON — Average rates on U.S. fixed mortgages ticked up this week but are still low by historical standards, a trend that has helped the housing market recover. Mortgage buyer Freddie Mac said Thursday that the average on the
30-year loan rose to 4.39 percent from 4.31 percent last week. Rates are a full percentage point higher than in early May. The average on the 15year fixed loan increased to 3.43 percent from 3.39 percent last week. Rates spiked in June after the Federal Reserve indicated it could slow its bond purchases later this
year, which have kept long-term interest rates low. But on Wednesday the Fed hinted it might hold off because the economy remains sluggish. And it noted for the first time that mortgage rates, which have fueled home sales, “have risen somewhat” from record lows. Mortgage rates tend to
follow the yield on the 10year Treasury note, which has also jumped on speculation that the Fed could slow its stimulus. Despite the increases, mortgages are still a bargain for those who can qualify. And low rates are helping boost home sales in most markets and driving home prices up. Home prices jumped
12.2 percent in May compared with a year earlier, according to the latest Standard & Poor’s/CaseShiller 20-city index released Tuesday. That’s the biggest annual gain since March 2006. To calculate average mortgage rates, Freddie Mac surveys lenders each week. The average doesn’t include extra
fees, known as points, which most borrowers must pay to get the lowest rates. One point equals 1 percent of the loan amount. The average fee for a 30-year mortgage was 0.7 point this week, down from 0.8 point last week. The fee for a 15-year loan also declined to 0.7 point from 0.8 point.

The Real Truth About the Mortgage Interest Deduction As the United States Senate examines existing tax policies as part of its “blank slate” approach to tax reform, and as the House Ways and Means Committee continues its review of the tax code, it is appropriate to keep in mind the importance of the mortgage interest deduction (MID) as a middle-class tax provision that makes it possible for many families to achieve homeownership. It is also useful to review some of the claims against the MID to determine if those claims are valid. Economists at the National Association of Home Builders (NAHB) have analyzed data from the IRS and the Census Bureau, as well as estimates from other sources, to assess the validity of these claims.
If home values fall, then more families will find themselves under water, in default and in foreclosure. Eliminating the mortgage interest deduction would reduce the financial resources families can draw on for education, entrepreneurship and retirement. And if home values fall, then state and local tax revenues fall, making it harder to fund schools, infrastructure, public safety and other important government functions. Repealing the MID would have serious economic consequences.
Claim #1: The wealthy get most of the benefit from the mortgage interest deduction. Fact: The majority of the tax benefits from the MID go to middle-class households. Data from the Congressional Joint Committee on Taxation shows that 86 percent of households who benefit from the mortgage interest deduction have incomes of less than $200,000. It is also useful to keep in mind that the majority of home owning households are married couples, so the household income measure will often include two incomes. Claim #2: Repealing the mortgage interest deduction would not damage the economy or individual households. Fact: Almost all studies examining the elimination of the mortgage interest deduction find that it would reduce demand for housing by raising taxes on prospective home buyers. This reduction in housing demand would also lower home values for existing home owners who would experience a significant loss in wealth. A 1 percent decline in home prices would result in a loss of $185 billion to American households. Just a 6 percent decline would eliminate $1 trillion in household net worth. If repealing the deduction lowered prices by 10 percent or more, Americans would lose trillions of dollars in household net worth.

Claim #3: Only a small percentage of home owners claim the mortgage interest deduction. Fact: The mortgage interest deduction is broadly claimed. The argument that only an estimated “quarter of taxpayers” claim the deduction is misleading because it ignores the lifecycle element of homeownership. Of the two-thirds of households who are home owners, one-third own free-and-clear with no mortgage. And of those with a mortgage who claim the standard deduction in lieu of the MID, many

are in the final years of a mortgage and are paying small amounts of interest and greater amounts of principal. In the early years of their mortgage when much greater amounts went to interest, those home owners very likely claimed the mortgage interest deduction. Claim #4: Repealing the mortgage interest deduction would make the tax code more progressive. Fact: A progressive tax system is one in which taxpayers with lower incomes pay a smaller share of their earnings in taxes than higher income households. Repealing the mortgage interest deduction would result in larger tax hikes – as a share of household income – for the middle class. For example, for households with less than $200,000 in adjusted gross income (AGI), the typical mortgage interest deduction is worth 1.76 percent of that family’s AGI. For taxpayers reporting more than $200,000 in income, the benefit falls to 1.5 percent of AGI. Thus, in the event of repeal, middle-class home owners face a larger tax hike as a share of their income, making the tax system less progressive. Claim #5: The mortgage interest deduction incentivizes buyers to purchase a larger home. Fact: While the mortgage interest deduction is sometimes connected with larger homes, evidence shows that it is more often the case that the tax benefit reflects family size and underlying housing demand. Larger families require a larger home, which in turn means a greater amount of mortgage interest paid and a larger tax benefit. And NAHB analysis of IRS data confirms this. Taxpayers with two personal exemptions (a measure of family size) who claimed the MID had an average tax benefit of $1,500. Taxpayers with four personal exemptions had an average benefit of approximately $1,950. In fact, the benefit increased correspondingly from one dependent to five-plus personal exemptions, which is consistent with the notion that larger families require larger homes.

WASHINGTON — Spending on U.S. construction projects fell in June by the largest amount in five months as government building activity declined to the lowest level since 2006. Even housing activity slowed but that setback was likely to be temporary. Construction spending dropped 0.6 percent in June compared with May when spending had surged 1.3 percent, the Commerce Department reported Thursday. It was the biggest decline since a 2.3 percent drop in January. Housing construction was flat during the month with a gain in remodeling offsetting declines of 0.8 percent in single-family construction and a fall of 3.3 percent in multi-family projects. Residential construction has been a bright spot in a sluggish economy this year and that strength was expected to continue even though mortgage rates have risen from their lows. Total construction stood at a seasonally adjusted annual rate of $883.9 billion in June, 3.3 percent above the level of a year ago. Even with the June slowdown in residential
construction, activity in this area is 18.1 percent above the level of a year ago. Nonresidential construction dropped 0.9 percent in June, reflecting weakness in the construction of offices, hotels and shopping centers. It marked the first decline in this category after four months of gains. Government spending declined 1.5 percent to an annual rate of $261.1 billion, the lowest level since November 2006. State and local building was down 1.1 percent and federal construction projects fell 1.5 percent. All levels of government construction have been under pressure because of budget problems.

R.I.P. Dining Room? Residential floor plan designers will never be able to make a onesize-fits-all plan that works for everyone. There are always those who want something different than the norm, like the guy who wants Robert “Greg” Lane to build a home inside St.Cert.Res. REA#2252 a cave or the architect V.P., Timberlane Appraisal whose dream it is to have a two-bedroom cottage made from a Boeing 747 fuselage. We see shifts in home designs every ten years or so, as our culture reacts to technology and lifestyle changes. Remember the home office in a dedicated room? Thanks to wireless Internet, the home office can be your leather couch. Or, how about the TV-niche trend of the 90s? Who would’ve thought TVs would be mounted flat on a wall? And if you live in a home built before 1990, chances are you have a dedicated dining room, maybe even a combo living/dining room off of the foyer. For large estate homes, a living room and a dining room will probably
always be expected, mostly for entertaining purposes and for resale. But in smaller homes, where space is at a premium, buyers are more interested in having no wasted space. The room that typically gets used the least is the dining room, based on my experience as a real estate appraiser. Two recent homes I inspected made great use of the dining room: one had a pool table, the other was used for piano lessons. The floor plan of the millennium is trending towards large bars and islands with room for the whole family, a box of Cheerios, and a few laptops. Our kids are on their phones each morning, eating breakfast and watching television at the same time. If we want to have a family dinner, it had better be where the wireless signal is best and the TV can be seen. As more families begin to right-size their lives, I think the dining room will become an afterthought in the small to mid-size singlefamily home. It is sad to say bon voyage to ye olde dining room, but I’ve only used mine twelve times in twelve years—and I always wanted to take up billiards.

Never been a heavy metal fan? The new look of brass, copper, bronze and nickel in this fall’s decor might change your mind. The finishes are warm, without the kitschy clash of some previous gorounds. You’ll see these softer, richer-looking metals — joining gold and silver on the decor stage — as accents on accessories, as furniture embellishment and as a brushed finish on textiles. It’s a classic look that can work in both traditional and contemporary spaces. A simple bronze, steel or iron table is one of the season’s hot accent pieces. Burnished silver, gold or copper bowls and vases are being offered by many retailers, some crafted in metal, some in stoneware or a sustainable wood, and washed with metallic paint. Crate & Barrel’s Loki and Ophelia silvery free-form bowls are light and luminous. The Eiffel Tower is rendered in brass-finished aluminum in a stylish table lamp at www.worldmarket.com. The site also has 1930sstyle Pharmacy lamps in bronze or rust finishes. At stores like West Elm and Target, you’ll see smart throw pillows with a light brush of metallic paint, some metallic thread or applied bits of metal. If you’re more attracted to the shinier side of metals, check out Tom Dixon’s reflective ball lighting. Crafted in mirrored silver, copper or bronze finishes, the fixtures have a spacey yet sophisticated look. Aerin Lauder, Estee’s granddaughter and founder of a high-end lifestyles brand, has designed a collection of luxe porcelain tabletop items including vases, bowls and nesting trays that are hand-dipped or painted with 18-karat gold. She’s got an elegant collection of cowry, nautilus and snail shells dipped in gold as well. New York studio Koket’s sexy furniture collection includes sensuous table bases formed out of gold-tinged metal swirls and nets. The brass-circled base with a cobra printed top that makes up the Burlesque console is a saucy mix of flash and dash.
Windsor Trace boasts small community
Offers buyers a ‘pocket neighborhood’ Tucked into a wooded setting on Thomasville Road near Hermitage Boulevard is the next new residential neighborhood. What Windsor Trace lacks in physical size it will make up for in convenience, charm and atmosphere, say the Tallahassee firms who are designing and marketing the project. “It’s neat. It’s a really neat little place. I am excited about. It’s taken me two years to get it to this point,” said developer Jason Naumann, broker and president of Naumann Group Real Estate Inc. The site, which totals 4 acres, is designed to have a total of 12 homes in what Naumann called a “pocket neighborhood,” a residential idea that is becoming popular in communities around the United States. Among the amenities is a common area defined by an outdoor fireplace and a brick-paved space where residents can spend time together and socialize. The homes will be built by Page Pittman, the Southern Living builder in Tallahassee. Though they will lookn akin to cottages, Naumann said the residences will be bigger than they appear. Construction is expected to start by October, with the first homes completed by next April. “In actual square footage, they will be close to 3,000 square feet, but that’s because they utilize some bonus rooms and studio space above the garage — a relatively small footprint, but a lot of amenities,” said Joe Wynn, residential designer and owner of local firm Wynn & Associates Residential Design. Three models are planned, with different options available for each. Wynn said the two-story
plans consist of master bedrooms downstairs and bedrooms upstairs, with a guest suite above the home’s garage. “We are noticing there are a lot of multi-generational living arrangements these days, and that’s a good thing,” Wynn said of households where children, parents and grandparents may all be under the same roof. “That’s a very strong trend that we are noticing.” The complete options list is still being prepared, but the homes will have large kitchens, granite countertops, luxury baths with walk-in showers, and

by Harry Anthony Heist, Attorney at Law In the “Public Records” section of your typical credit report, you will see things like evictions, foreclosures, suits for money and bankruptcy filings. Most application processing companies obtain and compile this data to allow the landlord to make a more informed decision on whether or not they will rent to the applicant. Often you will see that an eviction was filed on the applicant, and the disposition was “Voluntary Dismissal” or “Dismissed”. Does this mean that the tenant was not evicted or that everything was amicably resolved? Don’t be so sure. The “Dismissal” Not all tenants who have evictions filed against them are actually “evicted” by the Sheriff. A number of things can happen. The tenant may vacate the premises voluntarily shortly after the eviction is filed. The tenant may pay all the money owed, and the landlord requests that the eviction be stopped. The tenant may enter into a Stipulation with the landlord, under which payment arrangements are made, and the tenant successfully stays and pays pursuant to the settlement terms. In all these scenarios, the eviction filing will show up in the public record and will be in this public record for many years. Eventually, the eviction matter is “dismissed” and is recorded as such. There are two main ways an eviction is dismissed. It will either be by the landlord’s attorney filing a “Voluntary Dismissal”, or the court entering a “Dismissal for Failure to Prosecute”. In both cases, the public record will show the case as being dismissed, BUT it does not always mean that things were worked out or that the tenant paid the rent. Usually, it is quite the opposite and simply means the tenant vacated and the eviction was not processed further. The Voluntary Dismissal When a tenant vacates, the attorney may file a “Voluntary Dismissal”. This means that the case is no longer being prosecuted, as no further action is necessary on the file. The landlord got what they wanted, which is possession of the premises. In the situation where a Stipulation is entered into by the parties, the Stipulation may provide that the case will be voluntarily dismissed upon the tenant making the payments as planned. Unfortunately, the landlord, when looking at a “Voluntary Dismissal”, usually has no way of knowing why the case was dismissed. Without further information, the best assumption a landlord can make is that the eviction was filed and that the tenant vacated.
Many evictions are filed as Two-Count Complaints. Under the first count the landlord is asking for possession, and under the second count the landlord is suing for money damages. In order to get a judgment for money damages in Count Two, the tenant will have had to be served personally with the eviction action or will have filed an answer to the complaint. Often, neither of these two contingencies occur, and at the end of the eviction or some time after the eviction is over, the attorney will file the Voluntary Dismissal with the court to close the case out. There may even have been a Final Judgment for Eviction somewhere in the public records, but the final action showing up may be that “Voluntary Dismissal as to Count Two” The Dismissal for Failure to Prosecute If an eviction is filed, the tenant vacates and the attorney takes no further action, the Clerk of Court’s office will eventually send out a notice to the attorney and the tenant stating that the case will soon be dismissed by the court on its own, if the attorney for the landlord or the tenant does not pursue the case any further. This could be six months after the case has been filed, or even more than a year. The attorney will either then file a Voluntary Dismissal closing out the case or do nothing, and the Court will go ahead and dismiss the case. If a Two-Count complaint has been filed and no personal service has been effected on the tenant, the Court will know that the case is probably not going to proceed any further and will want the case dismissed. This dismissal by the court happens to tens of thousands of cases each year. The Court does not want to keep files unnecessarily open and will purge them from their active case system. When the landlord looks at the public record results, it will show as a “Dismissal”. What should the landlord do when the record shows “Dismissed”? There is a high probability that the applicant had an eviction filed against him or her by a prior landlord and just vacated. It is imperative that if any eviction filing shows up on the public record, the landlord looks into the matter deeply to find out exactly what happened during the eviction. Did the tenant pay and stay? Did the tenant vacate? Did the tenant get fully evicted? These are all questions that can be answered by looking at the Court file further and contacting the prior landlord. Most counties are now online on the internet, and a lot of information will be available to the landlord by simply going to the website of the Clerk of Court where the tenant had the eviction filing and examining the docket. claims that properties are selling within hours or days, this still is the exception rather than the rule. In Broward County, for instance, the typical home still sits on the market for 29 days before going under contract, down from 37 days a year ago, according to the Greater Fort Lauderdale Realtors.
That’s plenty of time for potential buyers, including you, to make an offer. It’s easy to get caught up in the hype and stay out of the market entirely or jump on a home that might not be a good fit. Neither of those is the right move, in my opinion. While you must be realistic about your buying power, you
still need to stick to your wish list and not settle for a house just to get one. You shouldn’t stay on the sidelines if you are ready to buy because interest rates and home prices will continue to climb. Remember that it is your personal economy that matters more than the general economy.
You may be out-bid on a few homes and the process may be more stressful than you’d like, but be persistent. If you’re ready to be a homeowner, it’s still a great time to buy.

Financial considerations for homebuyers over 40 By Alex Veiga Associated Press
LOS ANGELES — It’s often the most daunting and emotionally taxing item on one’s financial to-do list: Buying a home. Most people wade into homeownership for the first time in their 20s and early 30s, when they still have the bulk of their working years ahead of them and a long runway to build equity — a key asset for eventually moving up to a bigger home. But what if you’ve reached midlife and still envision buying a home one day? Tackling that first home purchase after 40 can be easier in some ways than when you’re just staring out in your career, but it also brings its own set of financial factors.
“It’s important to consider the financial work you have left,” says Eleanor Blayney, consumer advocate for the Certified Financial Planner Board of Standards based in Washington D.C. “The financial hurdles you still have over the rest of your life and how homeownership and debt in particular are going to impact that.” A National Association of Realtors survey of people who bought a home between July 2011 and June 2012 showed that nearly 80 percent of first-time homebuyers were 32 years-old or younger. In the next age bracket, those age 33-47, 36 percent were first-time buyers; between the ages of 48 to 57, only 19 percent were first-time buyers. The rates of first-time homeownership general-
ly declined as buyers got older, according to the survey, which featured 8,500 respondents. Even so, the last decade’s economic downturn and housing crash has forced many to put off that first home purchase. Here are some things to consider if you’re older than 40 and considering homeownership:
Rules don’t change for older buyers Good news: Being closer to retirement age than someone in their 20s and 30s can’t legally be held against you by a lender when they consider you for a home loan, regardless of the loan period. “So if somebody was to walk in today, and they’re 114 years old, and they ask for a 30-year mortgage and qualify for it, we have

She advises that homeowners start with the roof color, then work their way down the house to consider the siding, window frames, front entry door and trim. “Whether people are adding color to a new home or a cherished older home, there are so many wonderful color combinations that are striking on different styles of houses,” Smith says. “This online tool is available for both industry professionals and homeowners to gain confidence and ideas for adding color to a wide variety of home styles.”

The decision on whether one qualifies for a loan hinges on the borrower’s income, assets, credit history and other factors. Banks generally look back two years to establish a borrower’s income history and look to evaluate the likelihood that the borrower will continue to make the same level of income for at least another three years. If you’re in your late 50s or early 60s and disclose that you’re planning to retire within three years, a lender will evaluate your projected earnings from Social Security, retirement accounts, dividends on investments and other sources.
Consider benefits of paying off loan Most banks operate under the assumption that even a 30-year fixed mortgage will be swapped out for another loan within eight years, if not sooner. That’s because many homebuyers often end up refinancing, or moving for work or due to family considerations. But paying off a home and owning it free and clear by the time one retires is a smart play, particularly as the cost of housing is a significant expense for a person relying on a fixed income. That can be tougher for
someone who puts off that first home purchase two decades into their prime working years, assuming they haven’t saved up money to make a hefty down payment — think at least 30 percent. But it’s doable. Blayney recommends that even older borrowers who take on a 30-year mortgage take steps to pay off the loan or lower the monthly payment significantly by the time they retire. That could mean making extra payments during the early years of the loan, or putting up more than the minimum down payment so the borrower is financing a smaller amount. A 15-year mortgage, which typically translates into lower interest, but higher monthly payments, is another route to a quicker loan payoff.
Look into first-time buyer assistance One of the biggest obstacles to homeownership is coming up with a down payment to qualify for a loan. Federal and state housing agencies offer assistance for first-time homebuyers, including in many cases former homeowners who haven’t owned a home for at least three years. You can find a list of some programs by state at www.hud.gov. Remember though, while some loan pro-

Homeownership can bring stability to one’s monthly housing costs, versus rental housing, as well as tax benefits, but it also carries with it a trove of costs, including property taxes, insurance and maintenance. A good way to evaluate all the ways buying a home, whether in cash or through financing, will affect one’s retirement finances is to enlist a financial planner to go over one’s retirement goals. “You have to sharpen your pencil, sit down and do all the math,” Blayney says. “There’s no one answer.”
