Short sale may be worth the extra tax liability By Gary M. Singer

QUESTION: I have decided to sell my home through a short sale. I have heard that the deadline for the tax waiver is the end of the year. After that, you have to pay taxes on any debt that the lender forgives. I don’t

want to owe money to the government. Now I’m unsure whether to go through with the short sale. – Sarah ANSWER: The Mortgage Forgiveness Debt Relief Act of 2007 does expire at the end of this year, and industry groups and observers are concerned about the effect

on homeowners and the real estate market in general. Most pundits, including me, think the law will be extended at some point. Still, this isn’t something you can count on. As it is now, the amount the lender forgives on most primary residences is not taxable.

No extension would make short sales less attractive next year and beyond because sellers would have to pay taxes due to the forgiven debt. This could result in tax hits of a few thousand dollars or considerably more. Despite the potential tax liability, a short sale still may be the best

The Lights Are On

The lights are on…but nobody is home! Sometimes we have to leave a home unoccupied. It doesn’t always work out that your buyers move in the day you move out, or maybe you have to relocate before your home sells. Before you look at your house in the rear-view mirror, here are a few tips that might increase your peace of mind, and improve your home’s security and selling potential. Install a few motion detector outdoor lights. They now have surprisingly attractive fixtures that look like regular fixtures—not like spotlights. On the inside of the home you can put up temporary, light-filtering pleated shades over the windows. These are easily attached with self-stick adhesive to the woodwork and can be cut to size with scissors. Your buyers will love them, too, because they are good enough to leave up until they get their own window treatments. If you don’t have an alarm, at least put up alarm signs; just a sign is a reasonably good deterrent. We suggest putting one by each door. If it would give you peace of mind, get an alarm system. There are portable systems that you can take with you when your home sells or you can leave it for the new owner. The neighbor next door can also be your watch dog. Make sure that they have your REALTOR®’s information and vice-versa, just in case he or she needs to be informed of anything while you are away. Leave some of your furniture behind in the house. Use inflatable beds on a frame and make them up nicely. If you need to you can also either rent furniture or buy it at thrift stores. You can also talk to your REALTOR® about home staging. And your REALTOR® has a great piece of security equipment called a “lockbox.” He or she can explain to you its many features and why it is so valuable as a means of security and for allowing your home to be shown to the right people at the right time.

openings include Lacoste, Fossil and Desigual. Coming soon are fashion retailers Armani Jeans, Custo Barcelona and John Varvatos, along with specialty shops Dylan’s Candy Bar, Tesla Motors and Lush cosmetics. That doesn’t include such national chains as Nike, Urban Outfitters and Microsoft, all of whom are reportedly scouting for expansion opportunities. “There are more tenants that want to be there than there is space available,” said Stephen Bittel, whose firm Terranova and an affiliate of Acadia Realty Trust paid nearly $52 million last year to buy property on Lincoln Road. “The challenge is selecting the right tenants that lift the street higher. It takes the right owner with the right balance sheet that has the vision for the future.” While Lincoln Road’s transformation has been in the works for more than 20 years, it’s now reaching a new level of critical mass. One key step was developer Robert Wennett’s creation of the 11 11 Lincoln building, designed by famed Swiss architect Herzog & de Meuron and opened in spring 2010. The $65 million mixeduse project added a new level of upscale tenants to Lincoln Road that include Nespresso, the restaurant Juvia, Taschen Books and fashion boutiques Coltorti, Alchemist and Y-3. “I saw the potential of Lincoln Road and thought it could get a lot better than what it was, but it needed a catalyst,” Wennett said. “Our project has helped reinvigorate locals coming to Lincoln Road. We brought the kind of tenants they wanted to have.” Another catalyst was the New World Symphony’s move in 2011 into its new campus designed by

architect Frank Gehry, complete with a city park featuring a video projection wall for live outdoor concerts. Add to that a booming tourism market, with an influx of luxury hotels in and around Lincoln Road. Together, the changes have reinforced Lincoln Road’s position as a muststop destination for tourists visiting both Miami Beach and Miami. “Lincoln Road represents an amazing opportunity because of the consumer base,” said Steve Birkhold, president and chief executive of Lacoste North America, who also in a previous job brought Diesel jeans to Lincoln Road. “It’s one of the premier shopping streets. All over the country, they’re building lifestyle centers to do the same thing as Lincoln Road. It’s hard to replicate this because it’s so authentic.” The problem: most local tenants are getting priced out of Lincoln Road. Long gone are the 1980s when you could get retail space on a rundown Lincoln Road for less than $5 per square foot. By the late 1990s, it seemed like a boom when rents hit $40$60 per foot and the first national tenants like The Gap and Pottery Barn arrived. Little did anyone know that was just the beginning. Even through the recession rents held strong. In 2009 retail spaces were leasing at $150 per square foot. In the last year, rents broke the $200 mark and continue to climb as high as $300. “When pricing gets really high you don’t get crappy tenants, you get better tenants,” said Lyle Stern, a local broker and property owner on Miami Beach. “You need people that can generate the sales to pay the rent.”

Plant flowering kale, colorful cabbage By Norman Winter

Flowering kale and cabbage are favorite cool-season plants, but I recently saw them from a new perspective – backlit by the late afternoon sun. I was amazed at the brilliant purples and mauves in some leaves and iridescent stripes in others. We think of kale and cabbage as pansy partners or to be used in stunning combinations with snapdragons, but after watching them closely throughout the day I believe they can offer all the cool-season

sizzle you may want. These plants, which survive in zones just about anywhere in as cold as 0 degrees Fahrenheit, are among the easiest to grow. They do prefer fertile, well-drained soil. At the Columbus Botanical Garden we added a 4-inch layer of organic matter prior to rototilling. We also incorporated a slow-release, 12-6-6-fertilizer at a rate of 2 pounds per 100 square feet of bed space. Flowering kale and cabbage should be set in the soil to a depth just slightly below the bottom set of leaves. The plants will reach 6 to 12 inches

HOW A COMPLAINT IS INVESTIGATED

By: Cathy L. Lucrezi, Attorney at Law Who handles the Complaint? Administrative complaints of fair housing violations are handled by government agencies and, in some rare situations, nonproﬁt organizations. An administrative complaint is not the same as a lawsuit, even though it can have the same consequences as a lawsuit. Whether it’s HUD or the Commission on Human Relations or a local agency, the process is pretty much the same. What will the investigator want? 1. Documentation: As part of its investigation, the agency will ask for copies of various documents, including the tenant’s (or applicant’s) ﬁle, copies of notices, the property’s ads and brochures, policies related to reasonable accommodation, applicant criteria, and just about anything else that might shed some light on the complainant’s situation. 2. Position Statement: The agency will request a position statement from you. It wants to know your side of the story. The statement should be reviewed carefully by your attorney to make sure every word is accurate. NEVER send a position statement to an investigator unless it is reviewed by your attorney. 3. An Interview: Often, the agency will want to interview you

and other staff members at the property site. This is done informally, but is nonetheless important. The investigator may ask to see files, including those of other tenants. The investigator also notes the environment – whether the fair housing logo is posted, whether staff is pleasant to all who enter, etc. The Complainant’s side of the story At the same time the agency is obtaining all this data from you, it is getting data from the complainant. When all the information is in, the agency issues a determination. The Agency’s Determination The determination can be any one of the following: “probable cause”, “no probable cause”, or “no determination can be made”. If the agency concludes there is “probable cause” to believe a violation of fair housing law occurred, the government has the opportunity to file a lawsuit against you. The Determination is “No Probable Cause”: Are you safe now? Keep in mind that all of the above is about administrative complaints. The complainant always has the option of filing a lawsuit in court, even if the administrative complaint was unsuccessful and a determination came back as No Probable Cause”. Is it necessary to hire an attorney? Although there is no legal requirement that you be represented by a lawyer, it is nonetheless imperative to have one. The lawyer can help formulate responses in a way that most effectively communicate your position.

This organic pest control is safe and poses no threat to gardeners. These plants can be showy by themselves, or for a riveting display, try bold drifts of pink or purple kale next to another drift of a white variety. Consider planting a large bed of narcissus behind the kale or cabbage for special spring crescendo. Kale and cabbage also are exceptional in large containers where you might place three in a triangular design. Plant tulips or daffodils in the center of the triangle and then place pansies around the edges. There are many more varieties than gardeners realize. The Chidori series with its fringed ruffled leaves and intense colors have become the most popular. The Peacock and Sparrow series also have to be considered among the prettiest.
