pints of water removed during a 24-hour period. Units with 25-, 40-, 50- and 60-pint capacities are available. The Lowe’s site uses the Association of Home Appliance Manufacturers’ dehumidification selection guide, based on square footage and moisture levels. For example, a dehumidifier in a 500-squarefoot wet area needs to have a capacity of 14 pints per day. One 50-pint-capacity dehumidifier I saw advertised claimed it was designed for a medium-size space, but then added that it could handle an area of up to 3,000 square feet. I keep my relatively dry basement at 40 percent relative humidity, using a 60-pint-capacity dehumidifier. Instead of having to dump out the reservoir that holds the collected moisture, I have it draining into a plastic splash guard that empties into the sump. Humidity, the amount of moisture or water vapor in the air, is most often talked about in terms of relative humidity, according to EnergyStar.gov. Relative humidity is the amount of water vapor actually present in the air compared with the greatest amount of water vapor the air can hold at that temperature. The optimum RH level for a building is generally considered to be between 30 and 50 percent. Anything above this range may promote bacteria growth. In colder climates, humidity levels during the heating season should be in the range of 30 to 40 percent to prevent window condensation. Many dehumidifiers include a built-in humidistat, a device that allows you to set the desired relative humidity level that you would like for the room.

Once the room reaches the desired relative humidity level, the dehumidifier will cycle on and off automatically to maintain the level. Most dehumidifiers have top-mounted air discharge and can be placed against walls, but if you do not have top-mounted discharge, make sure the dehumidifier is located away from walls and furniture, so that air can circulate freely around the unit. If the space being dehumidified has temperatures that typically fall below 65 degrees, you may want to consider buying a product specified for use at lower temperatures. Qualified Energy Star models are available that are rated for use at temperatures as low as 42 degrees. The energy efficiency of a dehumidifier is measured by its energy factor, in liters of water removed per kilowatt-hour. In general, a higher energy factor means a more efficient dehumidifier and, therefore, one less costly to operate.

If your neighborhood or homeowners’ association has a story to tell, the judges in the 2013 Florida Communities of Excellence Awards want to hear it. A program of the the Florida Community Association Journal, the law firm of Becker & Poliakoff and Pen Group Communications, the awards honor neighborhoods and associations in a variety of categories, ranging from financial management and program design to sustainable landscaping, disaster preparedness and civic involvement and volunteerism. The deadline for applications is Jan.15 and there is no fee to enter. Now in their fifth year, the awards have involved more than 300,000 residents in hundreds of residential communities across the state. “There is no question that there is a lot more awareness out there. The program has grown,” said Alan Penchansky, executive director of the awards program. “Each year we’ve had more communities, judges, sponsors and attendees, and each year we’ve revised and updated the program in response to the feedback from these individuals and the changes in communities throughout Florida,” he addeds. For 2013, the awards include a new “Communications & Community” submission category. The judges will be looking for entries that promote positive community relations

and build knowledge and compliance with rules and regulations through use of any media, including email, newsletters, social media, closed-circuit television and Web sites. In 2012, the Sandy Key Owners Association in Pensacola won in the “Comeback Kid” category that recognizes communities which overcome big setbacks or problems and are able to resume normal functions. Sandy Key was affected first by Hurricane Ivan in September 2004 and then had to deal with the effects of the April 2010 oil spill from the Deepwater Horizon rig that failed in the Gulf of Mexico. Bill Smith, the Sandy Key association’s general manager, said the 183-unit condominium resort on Perdido Key suffered catastrophic hurricane damages to its three 8-story buildings, pools, spa, dune crossovers and parking area. A 26-foot storm surge wiped out the firstfloor units and Sandy Key’s electrical supply room, which was its main connection to Gulf Power. With electricity disconnected after Ivan passed, the condos on the

upper floors began to deteriorate and a major problem developed with mold in the units. Residents had to vacate the property, removing their personal belongings, and then figure out how to proceed with insurance claims, reconstruction and recovery. Smith credited his association’s board with having the right approach. “The board took action immediately,” he said. “They contacted the original builder, with whom they had a really good relationship.” The general contractor also brought in engineers and subcontractors to prepare for the rebuild of the structure, which had been gutted to the bare walls and floors. Even with an offer from an investor group wanting to buy the buildings as is, the condo own-

ers stuck to their plan. “They had a vote, and the majority of the owners wanted to rebuild,” Smith said. “To me that’s the amazing part of the story.” The reconstruction took from September 2004 to January 2007 to complete and essentially resulted in a brand-new building. Also added in the process were sprinkler and alarm systems. The BP oil spill eventually resulted in oil reaching the beaches in Pensacola, causing a devastating loss of revenue when visitors stopped coming to the area. Sandy Key owners filed a claim with BP and were compensated for the lost revenue for the roughly 60 rental condos available on the property. Smith said that business is largely back to normal. “We have had a really good year in terms of occupancy and it seems to be carrying over now.” Communities and associations desiring to apply for the awards may do so online at http://communitiesofexcellence.net/entering-the-competition/. Hoarding Woes Grow By: Lynn Dover*

Hoarding is a growing problem for the rental housing industry. If a hoarding issue is handled incorrectly, it can lead to a costly fair housing complaint. Hoarding as a Disability The Fair Housing Amendments Act of 1988 defines disability as a physical or mental impairment that substantially limits one or more of life’s major activities. Hoarding is loosely defined as: • The acquisition of, and failure to discard, a large number of possessions • Persistent difficulty discarding or parting with possessions, regardless of their actual value • Living spaces that are sufficiently cluttered so as to substantially compromise activities for which those spaces were designed. Hoarding has a devastating impact on a person’s ability to function and deal with the activities of daily living. Hoarding is a disability. Disability Accommodations

Fair housing laws require landlords to make reasonable accommodations for the disabled when such accommodations are necessary to afford the person full and equal use and enjoyment of the property. An accommodation is a change or exception to the rules, policies, practices or services. Increasingly, fair housing advocates take the position that if a landlord knew or should have known that a disability was underlying the problem, the landlord must try to accommodate before terminating the tenancy. With hoarding, this generally means trying to get the resident into lease compliance before serving any formal legal notices.

It is important to understand that hoarding is difficult to overcome and a hoarded home usually cannot be brought into proper condition in a short period of time. A balanced approach that recognizes the disability and gives time and support for the resident to comply, while still addressing the health and safety issues caused by the hoarding, is best. If the resident is willing, try to come to a mutual agreement, in writing, that spells out what needs to be done, the deadlines for complying with each item, and the consequences for failure to comply. Start with the most serious health and safety issues and work your way down to the least serious. Recognize that the unit will probably never look the way you would choose if you lived there. Also recognize that it isn’t your job to tell the resident how to live – your job is to make sure the unit is brought into a healthy, safe and sanitary condition. Lastly, hoarding behavior doesn’t just “go away.” Include in your agreement periodic inspections – for instance, quarterly – to ensure that the unit remains in compliance. State what is expected if the unit is found to be out of compliance again – for example, the resident must remedy the problems within 30 days. Document all your interactions with the resident. Ultimately, if the resident won’t cooperate, you will likely have to terminate the tenancy. percent and 30 percent for many projects, according to estimates, making green roofs viable for industrial and commercial uses, as well as in public buildings — especially those placed urban areas — but Pride’s Corner is starting to see some interest among homeowners as well. The average LiveRoof project is about 2,000 square feet and contains five to 10 different cultivars, so that if any one particular plant variety fails in a given environment other plantings will take over. Cuttings from the various cultivars are placed in trays of between 4 and 6 inches in depth containing a largely inorganic shale mixture that discourages weeds from sprouting up. Planting is relatively easy, involving spreading cuttings on top of the special shale mixture, adding fertilizer, watering and waiting for the plants to take root inside the trays. Trays have to be regularly weeded, but the shale mixture reduced the problem somewhat. Farm workers also occasionally have to move the rooted cuttings around to ensure an even spread throughout the trays. “Once you install the trays on the roof, it looks like it’s been there forever,” Costello says. The success of the LiveRoof business has encouraged Pride’s Corner to go one step further and try out a new LiveWall “vertical garden” system that uses the same concept as LiveRoof for heavily walled urban areas in search of a little greenery. The concept, which will be unveiled in June, could allow people to grow a variety of flowers and herbs even in confined spaces. “It would be great for a restaurant with an outdoor cafe,” Costello says.


FHA homeowners recover from foreclosure Program creates new finance ability

R.C. and Stacy Davis lost their condominium to foreclosure in 2009, a bad break that seemed destined to keep them from buying another home for many years. Yet last week — only three years after their foreclosure — the couple signed the papers to buy a four-bedroom house in Livermore. Their avenue to homeownership? A loan backed by the Federal Housing Administration. “We’re as happy as can be,” Stacy Davis said. The ability to get an FHA loan so quickly after a foreclosure could be welcome news to thousands of people who lost their homes during the housing bust. While mortgage giants Fannie Mae and Freddie Mac make people wait seven years after a foreclosure, the FHA will approve loans after three years, providing the buyer has established good credit and the ability to pay the mortgage. “There’s definitely a movement of folks who have had a foreclosure to re-emerge and re-engage in the market,” said Dustin Hobbs of the California Mortgage Bankers Association. He said brokers have picked up on the trend. “It helps the housing market,” said Guy Schwartz of CMG Financial in San Ramon, Calif., which handled the Davises’ mortgage. The FHA, which is selfsupporting, provides mortgage insurance for loans with low down payments and more flexible

household income requirements. The Davis loan came with a 3.5-percent down payment plus required monthly mortgage insurance and a 3.75percent interest rate on a 30-year loan. “An FHA loan is a good option for those who can qualify,” said Paul Leonard, California director of the Center for Responsible Lending. And there couldn’t be a better time to try, he said. “We are at near substantial price corrections,” he noted. That and low interest rates present “kind of a historic opportunity if people can qualify,” he said. But it’s not clear whether there’s a flood or a trickle of new borrowers with foreclosures in their recent past. The FHA said it doesn’t have data on how many of the loans it insures involve people who are buying homes after a foreclosure or short sale. Wells Fargo, the country’s largest FHA loan originator and servicer, said it doesn’t break out those loans. In the first six months of this year, Wells Fargo has made more than $73 billion in FHA-backed loans compared with $47 billion last year, spokesman Jim Hines said. Mason McDuffie Mortgage in San Ramon is working with foreclosure victims. “We are making loans and have made loans to people who have corrected their credit,” said Bill Godfrey of Mason McDuffie. “It’s nice to see.” The borrowers are “people who waited three years, have a job and qualify,” Godfrey said. “They have their credit, have a job and things are looking better. They may not be perfect ... but that’s part of the way to move forward. Clearly there is some thawing in that area.” Some listing agents

complain FHA loans take a lot more time and work. “It’s a hard transaction to complete,” said Bob Barrie of Keller Williams in San Jose. Barrie said he is listing a home next week in Santa Clara, Calif., and if there are multiple offers, a buyer with an FHA loan will be at a disadvantage. The Davises’ journey from foreclosure to new home began in 2005, when they bought a condo in Concord, Calif., for $262,000 at the peak of the market. The couple’s interestonly, 100 percent-financed loan was a classic bubble product that became a formula for foreclosure during the housing crash. To make things worse, the condo was in a rough neighborhood, said Stacy Davis, who is a high school special-education teacher in Fremont, Calif. Her husband is a senior producer for the Golden State Warriors basketball team. They tried to sell the condo after their daughter was born, but no one wanted to buy it, Stacy Davis said. “We decided we’re going to try to stick this out. We owned it, and we would make it work.” So they remodeled, put in a new kitchen and molding. Meanwhile, the neighborhood deteriorated. Shopping carts piled up on the sidewalk, she said. Graffiti blossomed on walls. After their son was born, they tried a short sale and found a buyer. “Within a week, an upstairs bathroom pipe busted open and flooded the whole place — the new kitchen, the molding, all destroyed. So the buyer backed out,” she said. Their condo in ruins, they moved to a rented house in Dublin, Calif., and the bank foreclosed. Their credit rating dropped to about 500, but they were

able to build it back to about 700. “Within a year we were getting credit card appli-

cations. We didn’t feel like it affected our lives at all,” she said. The purchase of the

house in Livermore completed, the Davis family will move in early November.

Dripping with style: new chandeliers Associated Press

Some interior designers tout paint as the best way to change the look of a room. For Lisa Roberts, “It’s lighting. ... It’s more bang for the buck.” With the holidays approaching, a new chandelier could be a fun and affordable way to make over the dining room, said Roberts, a Minneapolis designer who organized a chandelier fashion show at the home and garden show in that city earlier this year. Michelle Jennings Wiebe, president of Studio M Interior Design in Tampa, Fla., agreed, saying a dining room should be about more than the table and chairs. “You really need that piece that caps it off and makes it special,” she said. “It’s almost like a piece of artwork.” Chandelier shoppers have plenty of choices these days. Chandeliers come in a variety of styles, and can range in price from a few hundred dollars to tens of thousands. “We have a lot of fun picking them out,” Wiebe said. “It’s a way to make a special impression.” New manufacturing techniques have led to the creation of designs and shapes that previously were not possible, said Joseph Rey-Barreau, an architect and lighting designer and a professor at the University of Kentucky in Lexington. Trends include jewel tones, geometric-inspired pieces, retro fixtures and the use of lamp shades, these lighting experts said. Roberts included several colorful chandeliers at her show. She favors deep jewel tones, and showed one piece made out of black cut crystal. A chandelier can add sophistication or whimsy to

a home, she said. The decor featured on the television show “Mad Men” has created more interest in Mid-century Modern, said Wiebe, and many of her clients are choosing slim, sleek pieces reminiscent of the 1950s and ‘60s. In Florida, shell, coral or other nature-inspired lighting also is a common choice, she said. Shannon Cantor so appreciates the seashell-inspired chandelier in her condo in Redington Beach, Fla., that she put a variation of it in her second home, in Tampa. She said she and her husband wanted something they would enjoy looking at every day. “We walk by it a lot,” said. “You want something that grabs your attention. It’s going to be there for a long while.” Rey-Barreau called lamp shades on chandeliers “a very, very fashionable trend,” from lights surrounded by a single, round drum shade (a little like a hanging table lamp) to a group of mini drum shades covering each bulb. Some chandeliers have removable shades, so you can use them or not. When helping clients choose a chandelier, Wiebe considers the size of the room and the style of the home. But she also reminds them that the fixtures have a job to do. “First and foremost it’s for lighting,” she said. For instance, will a table with lighting overhead be used mostly for eating or will children be doing homework there? “You really need to think about what you are going to do with the fixture,” said Rey-Barreau. He offered these chandelier tips: — Always put chandeliers on a dimmer switch. This makes them more functional and can help set a mood in the dining room.

— To determine what size chandelier is needed, add the width of the room to the length of the room in feet, and then convert that number to inches for a chandelier’s diameter. A 10-by-20-foot room, for instance, would require a chandelier with a diameter of about 30 inches. — In a room with 8-foot ceilings, chandeliers are normally hung about 30

inches above the table. For every additional foot of ceiling height, raise the fixture 3 inches. — When shopping for a chandelier ask whether it is part of a “lighting family.” Some manufacturers have developed series of fixtures designed to complement each other. Strickland, Koelemij Earn Statewide Recognition

Larry Wayne Strickland, CIP, of Capital City Builders won FHBA’s 2012 Remodeler of the Year Award and Karen Koelemij of Orange State Construction was selected by her peers to represent Florida on the

Executive Board of the National Association of Home Builders (NAHB) Strickland becomes the second TBA member to win the coveted remodelers’ honor, following in the footsteps of Ed Dion of Dion Builders, who won the award in 2010. Koelemij is a Past President of TBA, continuing the legacy of her father John, who is a past TBA, FHBA and NAHB President and a member of the TBA, Florida, and National Housing Halls of Fame.

One of TBA’s most active members, Strickland won the associations’ 2011 Builder of the Year Award and was a four-time winner in this year’s Remodelers Show Awards for remodeling excellence. In addition, Strickland chairs TBA’s Member Consumer and Education Committee (MCEC), which presents seminars and home show exhibits that teaches the public how to make good home buying and remodeling decisions. Strickland also serves on the Tallahassee Community College Construction Advisory Committee, the state Residential Construction Mitigation Program (RCMP) Advisory Board, and is one of 13 TBA members to earn the professional

designation “Construction Industry Professional” or CIP for his education, experience, and proven track record of professionalism. Most recently, Strickland has been named to the Board of the Literacy Volunteers of Leon County. In addition to representing Florida on the NAHB Executive Board, Koelemij is a Senior Life Director of the national association, which is fighting for housing consumers, including preservation of key tax benefits of housing such as the mortgage interest deduction.

QUESTION: I am getting ready to buy a home, and the attorney just informed me that there are “open permits” on the house, but that I could close anyway. What does this mean? – Sandy ANSWER: Insist that the seller resolve this prior to closing – or it will become your headache after you move in. A homeowner who gets certain work done is required to get a permit and pay a fee to the city or county. Usually, the contractor takes care of this. After the work is completed, the permit must be closed, often after an inspection by the building department. This final step often is overlooked as the contractor rushes off to the next job, leaving the open permit in place, sometimes for years. The problem comes in when the new owner goes to pull another permit and now has to deal with getting the prior permit closed before the building department will issue the new permit. To close the old permit, typically a new contractor will have to inspect and possibly fix the old work, and the building department will have to come out and inspect. This can cause quite an expense for the new owner. Also, be aware that not all closing agents will search for open permits or other code issues because they generally do not affect the ownership of the property. It is important to insist that an “unrecorded lien search” (known in the business as “lien letters”) is performed on every closing and that any issues that are found are fixed before closing.

Sandy reminds us all of coastal hazards Rob Young and Andrew Coburn

Superstorm Sandy will almost certainly join the pantheon of “the costliest storms in history.” The storm’s impact has been felt from South Carolina to southern Massachusetts. There has been massive damage to significant segments of the New Jersey and New York coastline. As hard as it might be to think about while people are still being plucked from rooftops, storms such as Sandy represent an opportunity to reassess and improve future exposure of coastline communities to storms and ocean surges. For example, let’s take the hardest hit coastal area from Sandy — New Jersey and New York. A study released in March 2012 by Ben Strauss and Climate Central, which does research on climate change, listed New York and New Jersey among those states most vulnerable to sea level rise. These shorelines will only become more vulnerable with time, and more costly to maintain. Even New Jersey Gov. Chris Christie agrees. When NBC’s Brian Williams on Tuesday night asked Christie about the power of Mother Nature and rebuilding the Jersey Shore, he said: “There is a way to do it, but we’re going to have to sit down and be smart about it. ... One of the things I’m going to be talking with the president about ... is bringing the Army Corps in immediately to talk to us about how’s the best way to rebuild the Jersey Shore.” Of course, predicting the likelihood of wind damage 50 miles from the coast is impossible, but we have a far better grasp 10 » SUNDAY, NOVEMBER 4, 2012 » TALLAHASSEE DEMOCRAT

today of the impact of coastal flooding and erosion. Every coastal community has its hazard hotspots, and yet we still have failed miserably in keeping development out of these highly vulnerable areas. How can we keep repeating the same mistake? The federal and state governments provide multiple incentives for homeowners and businesses to rebuild, rather than relocate. The continuing saga of Dauphin Island, Ala., is a notable example. The west end of the island is arguably the most vulnerable shoreline in the USA. It has been impacted by tropical storms 10 times since Hurricane Frederic in 1979. Though it was spared Sandy’s wrath, it is still recovering from damage from Hurricane Isaac in late August. The cost from the previous 10 storms to the federal taxpayer was approximately $80 million for an area of about 1 square mile with only 400 homes. The funds for this rebuilding come largely through the public assistance sections of the 1988 Stafford Act. This law created the federal system of emergency response that we are all so familiar with. When the president makes a federal

The largest insurer of coastal property in Florida is the state of Florida through its Citizens Property Insurance Corp. Private losses not covered by insurance are often written off at tax time, an indirect federal subsidy of risky development. Finally, federal and state taxpayers have spent billions of dollars over the past four decades pumping up beaches in front of coastal properties (beach nourishment) and constructing coastal protection projects. In New Jersey, alone, approximately $1 billion in public funds have been spent just to keep beaches in front of homes and oceanfront buildings.
