For the last year, Springdale has been used for city-sponsored events and private rentals for weddings, parties and birthday celebrations. It’s been the site of Three Notch Market, an annual Easter egg hunt, culinary classes for Lurleen B. Wallace Community College, receptions for legislators and potential industrial development partners, and a Christmas open house with rooms decorated by local civic groups. When the Spanishstyle home was to be sold at auction two years ago, city leaders feared the property would either be developed for commercial use or be left vacant and fall into disrepair. So the city bought it. As far as Andalusia Mayor Earl Johnson is concerned, it was worth every penny. “Beyond providing us a venue for different things, it has saved an historic landmark in our city,” Johnson said. “If that had been taken from the city or altered in anyway, it would have changed the essence of downtown Andalusia.” When not in use, the stately grounds are open for picnics. “I call it our little Biltmore,” Johnson said. “You get that feel.” Built by John G. Scherf, the house known as Springdale has been one of the most recognizable in this Covington County city for nearly 80 years. Thanks to a natural spring on the property, the home to this day is heated using a geothermal system. There are cedar closets throughout the

house and a bathroom for every bedroom. Electrical outlets wired into the base molding of the home blend with their surroundings unlike their modern-day, three-prong counterparts. A 425square-foot basement once served as a wine cellar. And that’s just the house. The grounds feature ponds fed by the same spring that heats the home. There’s a concrete arbor covered in muscadine vines along with original camellia bushes and brick walkways. “It’s such a focal point,” said Vanessa Nelson, the City of Andalusia’s horticulturalist and the home’s curator. “This magnificent house has been here for all these years.” The estate was originally named Springdale by Scherf as a nod to the property’s natural spring, although the home has been referred to as Scherf mansion and even the Tomberlin mansion (the estate’s second and previous owner). “Springdale was actually lost,” Nelson said of the name. “It got lost in the history.”

You can do that with decor, food, beverages and music, but it’s also nice to offer a party favor that guests can take home as a token of a special evening. Tallahassee: Buyer’s or Seller’s Market?

Wanda Carter Keller Williams Town & Country Realty Data from the National Association of REALTORS® (NAR) indicate that, nationally, real estate activity has transitioned the country’s market to a “seller’s market,” while the Tallahassee area is continuing in a “buyer’s market.” What makes a “seller’s market,” a “buyer’s market,” and a “balanced market?” Supply and demand. A “balanced market,” relating to residential properties, is a 6-month inventory, meaning it would take six months to sell the available supply of houses listed. In a seller’s market the supply would take less than six months to sell, which is considered a shortage of inventory, and prices increase because demand exceeds supply. Sellers often receive multiple offers in this market environment. In a buyer’s market the supply would take more than six months to sell, which is considered an over-supply of inventory, and prices decrease because supply exceeds demand. Often houses take longer to sell, listings expire, and sellers may wait to put their property on the market for sale, when possible, in hopes of selling it for the price they want. The national inventory of residential properties, according to NAR, is currently 5.4 months—a seller’s market. The Tallahassee Board of REALTORS® data (below) show 8.2 months of supply—a buyer’s market. Tallahassee was more fortunate than South Florida during the real estate “trauma” that began around 2006. Though we have experienced, and are continuing to experience, market pain, it did not penetrate our market to the same degree as the South Florida markets. Though the Tallahassee market is still a buyer’s market, the inventory has been shrinking in recent months. But there are persistent, ever-present rumors that a large number of foreclosures will soon “flood” our market. Let’s see what happens—if we shrink into a seller’s market or expand into a longer buyer’s market. Markets are segmented in various ways—by price, geography, age of neighborhoods, age of structure, for example. REALTORS® analyze market data to help their selling customers determine what price to list their property or to help their buying customers determine what price to offer for the purchase of a property using market data—whatever the market. Terminating A Tenant For A Lease NonCompliance – It Is Harder Than You Think By Harry A. Heist, Attorney at Law It would be difficult to find a property manager who has not served Three Day Notices for non-payment of rent and Seven Day Notices to Cure for tenant noncompliances. The tenants usually pay the rent, or in the case of noncompliances, they cure the noncompliance or move right out. Most property managers are well versed in notice serving and have filed evictions on their tenants when the notices just did not do the trick. Many property managers have even experienced going to court on contested non-payment of rent cases. The result? Usually the tenant is evicted, or the case gets settled. Now ask yourself: How many times have I actually gone to court on a contested eviction on a Seven Day lease noncompliance case and had to prove the noncompliance in court? Very few property managers have experienced going to court on contested noncompliance cases and do not realize how hard these cases can be to win. Proper preparation, hard core proof and good convincing witnesses are necessary to win these cases. Are you ready to prove your case to a judge who will really put YOU to the test? Winning and Losing the Seven Day Noncompliance case Since most property managers have never experienced going to court on a contested noncompliance case, you will just have to trust us here. We have handled many of these cases, and we have LOST many of these cases. You don’t want to lose a case in court. Besides the pain of losing with the tenant now getting to stay and smirk at you for the next six months, if that tenant retained an attorney, you may be on the hook for attorney’s fees. Recently two cases we lost resulted in around $2000.00 each having to be paid to the tenant’s attorney, for which the property manager thought she had a great case, really wanted to get the tenant out and insisted that the eviction be filed against our advice. Is your attorney a wimp? Once of the most frustrating things for the landlord’s attorney is to try to convince a property manager who thinks he has a great case that there is a high chance of losing in court. The property manager needs to understand that the landlord’s attorney may make his or her living filing your evictions and has every incentive in the world to file your eviction, BUT also wants to protect you from losing the case and having to suffer the consequences. The landlord’s attorney has probably filed hundreds, thousands or in our case, tens of thousands of evictions, winning the vast majority of the evictions, as most are for non-payment of rent. Trust the experience of your attorney. Your attorney is on your side, feels your frustration, but is also under the legal and ethical duty to warn you of the dangers of losing and guide you in the right approach. Your attorney is not a wimp or lazy. Your attorney has the experience to know what is best for you. There have been situations where an unsuccessful Seven Day Noncompliance case has not only been lost in court, but took on a new life when a Fair Housing Discrimination case was filed against the property later! The judicial attitude in the Seven Day Noncompliance case When you go to court on a typical residential tenant eviction, the tenant usually did not

pay the rent, did not properly withhold rent or did not post all the money into the court registry. Judges handle thousands of these cases each year, and some of them have no tolerance for listening to the tenant’s sad story of losing a job, car breaking down or the myriad other excuses. Most cases for non-payment of rent result in an eviction. Now we come to the Seven Day Noncompliance eviction. This is far different than the non-payment case. Here the property manager has accused the tenant of doing or not doing something that is spelled out in the lease or Florida Law. Notices have been given, these notices must be correct, and now the property manager is put to the test and has to prove the case. Judges do not take these cases lightly and really make the property manager prove the case. Often it seems that the judge is far more sympathetic to the tenant, but really it is a proof issue. It is much easier to prove someone has not paid the rent. They either paid it or they did not, and the burden of proof of prior payment is on the tenant. Proving a noncompliance is the landlord’s burden and can be a real challenge. How do we prove the case in court? Before we even get to court, the property manager must have prepared and served a PROPER Seven Day Notice, be it a Seven Day Notice of Termination or a Seven Day Notice to Cure followed by the Seven Day Notice of Termination. We strongly recommend that you have your attorney prepare these notices for you. We prepare all our clients’ Seven Day Notices for no charge, as we really want them done the way we feel they would be most effective and successful in court. Now, proving the noncompliances can be a real challenge. We need witnesses, documentation, solid proof, logs, file notes, notices, photos, videotapes, police reports, incident reports, and anything else to help the judge believe that the noncompliance is occurring or has occurred. Does the Noncompliance have to be severe? Remember that you are asking a judge to kick someone out of their home. Often there are children involved. The noncompliance needs to be substantial, and you need to trust your attorney to help you decide if it is indeed substantial enough to sway a judge your way. It is ironic how when the market is strong and the property has a waiting list, there seems to be so many more tenants in noncompliance. Hmm, a coincidence? I have petitions and statements signed by 5 residents! Nice try, but no cigar. The complainers or witnesses MUST appear in court. This even includes the police officer who responded and wrote up the police report. How do we get them into court? We need to subpoena them, but often they just do not show up for court, and the case falls apart. We have had situations where many tenants have complained about one tenant. Every day they wrote letters and called the office complaining about the noise that the tenant was creating. We end up in court, one complaining tenant shows up and tells the judge that the problem has stopped. Bang. We lose the case. Never be certain that the complaining tenants will actually come to court. Often they are afraid, were threatened or get cold feet at the last minute and do not want to be involved. What does your attorney need to win these cases? The proof that you need is wholly dependent on the type of noncompliance involved and is extremely case specific. Let’s go through some of the most common

noncompliances and list some of the evidence we may need to potentially prove our case in court. Unauthorized Occupants – Seems easy, you see the person there all the time. When you go to court, the tenant says they are just visiting. You need to now prove that they are no visiting. Proof you may need includes and is not limited to: 1. Multiple photos of the unauthorized occupant’s car morning and night with date and time records; 2. An admission by the tenant to you that the unauthorized person is living there; 3. Proof that the unauthorized person is receiving mail; 4. Unannounced visits to the unit with a witness; 5. Police report that the unauthorized person gives the address as his or her address; 6. FDLE sexual predator or offender registration with your address listed; 7 .A lease clause that is clear as to how long someone can stay. Unauthorized Pets – First you need to make sure the prior manager did not authorize the pet or the pet has not been there for a long time, which can cause a waiver. 1. Pictures of the pet, date and time stamped; 2. Witnesses who have seen the pet; 3. Pictures of the tenant walking the pet; 4. Maintenance who will testify to pet food or pet bowls in the unit; 5. Recording of barking when you go to the door, if a dog that is; 6. Picture of the pet damage; 7. Picture of the pet coming to the window; 8. Hard proof after the Seven Day Notice of Noncompliance with Opportunity to Cure has expired. Noise Disturbances – These case are tough, as usually there is no police involvement, and the complaints come from other tenants who may just be angry at each other, or a group of tenants have it out for one tenant. Are we really dealing with a tenant versus tenant war? 1. Records of multiple tenant complaints; 2. Police reports; 3. Tenant witnesses who will appear in court; 4. Witnesses who are employees of the landlord; 5. Multiple provable disturbances; 6. Courtesy officer who will appear in court. Unsanitary Unit – Is the unit really unsanitary or just an extremely cluttered mess? Many times we deal with accumulators who throw nothing out and have piles of newspapers, clothes and books throughout a rental unit, with only a small path in which to walk. Is this unsanitary or just strange? 1. Pictures of unit; 2. Pictures of kitchen, bath and anything “unsanitary”; 3. Pictures of exposed and rotting food; 4. Pest control personnel who will come to court; 5. Infestation of vermin; 6. Strong odor; 7. Maintenance staff that must come to court; 8. Other staff who will come to court. Emotions and the Seven Day Noncompliance case We see situations where property managers get angry at a tenant and “just want them out”. This is the worst possible situation because the anger and frustration of the property manager is now running the show. That unauthorized occupant who was not a problem for three months all of a sudden becomes a big problem, because he came into your office and was belligerent. That person with the unauthorized pet was left alone until it defecated in front of the office or got loose and scared another tenant. Never let your emotions dictate your actions when deciding to terminate a tenant. Follow the law, get your attorney involved early, and be cautious.

This season has seen a variety of creative, decorative felt items for table and tree. You’ll find it sewn, lasercut, appliqued or otherwise manipulated to create eye-catching fashion accessories, charming toys and sculptures, and chic items for the home. Or you can try your hand at felt-making and crafting yourself. (More on that later.) In Portland, Ore., designer Alison Comfort offers a woodsy wonderland of little felt pumpkins, acorns, mushrooms, nests and forest animals — small sculptures that might add charm to a holiday table — at her Etsy.com shop, www.etsy.com/ shop/houseofmoss. “There’s something so dear and precious about starting with a natural material in its raw state, using a simple tool and my own hands, and transforming it,” she says. There are guides online for making felt candy canes, but if you aren’t crafty and still love the look, consider Land of Nod’s delicious-looking versions; here too, round ornaments in felt stripes or gathered layers. It’s an extremely easy material to work with because, unlike most fabrics, it’s nonwoven, so it won’t unravel and doesn’t require hemming,” says Jodi Levine, designer-at-large for Martha Stewart Living. April Tatom of Louisville, Ky., sells felting supplies on her website, www.feltorama.com.

When she decided to try her hand at appliqued clothing for children and experimented with various fabrics, “I found that nothing matched the lush texture of felt. It just beckons to be touched and adds a cozy dimension to any project. There’s no ‘right’ or ‘wrong’ side to it. Felt toys are wonderfully tactile for little fingers and visually stimulating for kids of all ages.” For her own kids, Tatom recently completed a felt “picnic” set complete with a lunchmeat-, cheese- and lettuce-filled

She also recreated one of her son’s favorite book characters, Lowly Worm, from Richard Scarry’s “Busytown.” Food is a popular subject for felt crafters, often as soft children’s toys but sometimes so realistically rendered that it’s elevated to something more artful. Roving, a washed and carded wool with a texture similar to cotton candy, is the basis for many sculpted felt creatures and items. The fiber is pulled into strands that can be formed and poked

with fingers or needles into shapes. Many of the animals on Etsy and in stores are crafted this way; it’s easy to manipulate roving and no sewing is required. Alternatively, a method called wet felting uses hot, soapy water and agitation to enmesh wool or other fibers so tightly that they cannot be pulled apart. Or you may not have to buy anything at all if a common laundry mishap occurs. “If you’ve ever shrunk a wool sweater, scarf or hat, you’ve created felt,” Levine laughs. In the felting community, that method, which uses yarn rather than roving, is called “fulling.” Martha Stewart’s site also has instructions for making little felt mitten clips, mini stockings and mice ornaments, tree skirts and gifts, as well as some easy kids’ projects. Each has benefits: recycled eco-felt (created from recycled bottles), 100 percent wool felt (rich texture), wool-blend felt (affordable, versatile), bamboo felt (ultra-soft). » Don’t create a machine-washable project without first testing a swatch of the felt in the washer.

Grafted veggies are next season’s celebrity seeds By Dean Fosdick Associated Press

In many of the seed catalogs arriving soon in mailboxes, the headliners will be grafted vegetables, in which one or more different varieties grow from a single rootstock. Tomatoes seem to be the grafted transplants most frequently offered, providing greater disease tolerance, bigger harvests, increased vigor and better taste. Side-by-side tests done by Ball Horticultural Co. in Chicago have shown at least 50 percent higher yields from grafted tomatoes than from non-grafted varieties. That total varies from garden to garden and gardener to gardener, but it means more fruit or larger fruit. Grafted plants are also pricier, in part because grafting is labor intensive. “You’re also paying for disease insurance and a greatly improved yield,” said Scott Mozingo, product manager for Burpee Home Gardens, a Ball Horticultural subsidiary. “You’re paying more but what you’re getting is so much more.” Grafting is an ancient horticultural practice that fuses tissues from one genetically different plant to those from another, combining, for example, disease management with heirloom flavors. Think apple trees, grapevines and roses. Vegetables have been late entries in large-scale grafting programs intended for home gardeners, particularly in the United States. said. “Grafted vegetables have been big in Asia for 70 years. In Europe, for about a decade. It’s been largely a supply problem, but I think they’re going to be a very big thing in seed catalogs next season. A very big thing in retail, too.” Grafted plants aren’t any more difficult to work with than non-grafted ones, but do require slightly different management. That includes: » Planting them deeper. “They’re tall tomato plants so they need a deeper base,” Mozingo said. “But don’t bury the grafts. Those should be above the soil line or you cancel out the benefits.” » Pruning. “The plants are so vigorous that they produce a lot of vegetative material,” said Josh Kirschenbaum, product development coordinator and spokesman for Territorial Seed Co. in Cottage Grove, Ore. “There won’t be as much fruit production if they don’t get pruned.” » Adding trellises. “Towers or cages are pretty close to being mandatory,” Kirschenbaum said. “These plants are so energetic and grow so tall

that it’s important you give them some kind of support.” » Easing off on the chemicals. Grafted vegetables have better natural defenses against groundborne diseases and insects. Fewer pesticides and herbicides are needed. The potted plants will be offered with single or double grafts. Grafted peppers and eggplant will be offered along with tomatoes in many catalogs. Grafted cucumbers and watermelons may be added to the inventory once nurseries solve the logistics. “Both vine out pretty quickly,” Kirschenbaum said. “We aren’t ruling them out, but we will have to come up with a clever way to get those plants shipped to our customers.” At least one additional benefit can be derived from gardening with grafted plants: their entertainment value. “It’s fun to say you can grow red cherry tomatoes and orange cherry tomatoes on one plant,” Kirschenbaum said. “Or Beefsteaks with a Roma.”
