Use Checklist to Select Your Builder or Remodeler The question consumers most frequently ask the Tallahassee Builders Association (TBA) is how do I select a qualified builder or remodeler. (Of course, the next question is how much is my new home or remodeling project going to cost… but we’ll leave that one for another day). To help you select a professional who can meet your building or remodeling needs, the National Association of Home Builders (NAHB) has developed the following checklist: ❑ Contact your local home builders association (in Tallahassee, go to www.tallyba.com or call 385-1414) for the names of member builders and remodelers. TBA also has a list of builders who have earned the Construction Industry Professional (CIP) designation (see box at right), which means

❑ Check out the company’s rating and if there have been any complaints filed with our local Better Business Bureau: www.bbb.org. ❑ Make sure the builder/remodeler has appropriate workers compensation and general liability insurance. If not, you may be liable for any construction-related accidents on your premises. ❑ Ask the builder/remodeler to provide you with names of previous customers. If they won’t, beware. If they do, ask the customers if they would hire the builder/remodeler again. ❑ Ask if you can see the builder/remodelers work, both completed and in progress. Check for quality of workmanship and materials. ❑ Do you feel you can easily communicate with the builder/remodeler? Remember you will be in close contact with them throughout the construction process and afterward as you live in your new home.

❑ Find out how long they have been in the building business. It usually takes three to five years to establish a financially sound business. You want to make sure they will be around after the construction is complete to service any warranties.

❑ Make sure the builder/remodeler provides you with a complete and clearly written contract. The contract will benefit both of you. If you are having a new home built, get and review a copy of the home warranty and homeowner manual as well. ❑ Be cautious of unusually low-priced bids. If the builder/remodeler is unable to pay for the materials and labor as the project proceeds, this may indicate a potential problem. vember with employers shedding 57,081 workers from their payrolls, according to a report from outplacement consulting firm Challenger, Gray & Christmas Inc. The cuts were a 20-percent increase from October, the report said. National companies like Hostess Brands significantly contributed to the cuts. Hostess ended its manufacture of snack cakes and dismissed all of its 18,500 employees. “The approach of Christmas is not likely to provide any relief from large-scale layoffs. In fact, the end of the year tends to see heavier downsizing activity as companies make last-minute attempts to meet earnings goals or adjust payrolls based on the budget for the coming year,” said Rick Cobb, executive vice president of Challenger, Gray & Christmas, Inc., pointing to Citigroup's 11,000 job cuts earlier this month. Statewide the 8.2-percent unemployment rate is improving, albeit slowly. In October, this region added 2,000 jobs from October 2011 to October 2012 and only one sector – construction – has registered continuing losses with an elimination of 300 jobs in the same time period.

Manatee’s 8.3-percent unemployment rate is significantly, down from the 10.5 percent it saw a year ago. “We expect modest gains to continue and don’t foresee any large layoffs,” said Sally Hill with the Suncoast Workforce, the area’s jobs agency. Yet University of Central Florida economist Sean Snaith says the national and state recovery continues to be “lackluster.” He points to a projected 1.2 percent GDP growth in the fourth quarter compared to the 4.1 percent a year ago. “There’s been a sharp slowdown,” Snaith said. “There is still uncertainty about the fiscal cliff and whether there will be a permanent or temporary resolution. There’s also the question of the impact of health care reform.” It all adds up to lots of reasons for companies to “pull back the reins on hiring,” he said. But Robinson doesn’t believe the doom-andgloom predictions. “You've got to be brave and face up to your market and have the courage of your own convictions,” said the entrepreneur, who co-owns the company with his wife, Deborah Robinson, who is chief operating officer. The company has facilities in the United Kingdom, Australia and a new one opening in Brazil. All the recent talk about a fiscal cliff makes him angry. “We know that the fiscal cliff is not going to happen. It would be lunacy,” he said. “It just gives the economists something to talk about.” U.S. policymakers didn’t let the financial crisis erode into a worldwide depression and they are not going to create a recession with a fiscal cliff, Robinson said.


How to get a Comfortable country living deposit back if sale fails For the Associated Press

QUESTION: I am trying to buy a home and was pre-approved from my bank. Unfortunately, the lender turned me down for the loan. The seller is not agreeing to give me my deposit back. What can I do? – Sara ANSWER: The answer to this question depends on the contract you signed with the seller. All contracts for the sale of real estate must be in writing, and the written contract controls the details of the transaction. Most contracts contain clauses that will allow the buyer and/or seller to cancel the contract if certain events happen or don’t happen. Some of the more common contingencies are for inspections of the property, the seller’s ability to convey clear title, the property appraisal and the buyer’s ability to get financing. These contingencies contain deadlines that must be strictly followed. For example, a contract may say that if the buyer can’t get loan approval within 30 days, he or she may cancel the contract without penalty. In this case, if you are denied on the 28th day and you notify the seller, you are entitled to your money back. But if you wait until the 31st day,

you would lose your deposit. It is important that you get the denial letter from the bank and properly notify the seller in writing before the deadline. If there’s a dispute about the contingency and the seller balks at returning your money, the terms of the contract also will dictate what action you must take to get the money back. Sometimes you can sue the seller, but in other cases you will need to go to arbitration or have a state board decide what happens. In your situation, you need to read the contract and see if there is a financing contingency. Make sure you followed all of the conditions and deadlines. If you did, you should have no problem getting your deposit back. If you didn’t, contact a local attorney to see if any other options are available to you. When you enter future contracts, write down all of the deadline dates on your calendar. Doing this will ensure that your next deal is much smoother.

Build for your future with Better Living Design Life expectancy in the U.S. is nearing 80 years old, and the number of Americans over 65 now exceeds 40 million. These facts alone push forward a growing trend in home construction that accommodates people of various sizes and ability levels. Design professionals, builders and homeowners

looking for ideas to maximize accessibility in homes can look at three Better Living Design approaches: 1) accessible design, 2) universal design and 3) aging-in-place design. There’s a lot of overlap among them, and while some people speak about them interchangeably, each has its own thoughtful foundation

that has led to a unique approach to designing, building, and remodeling. Let’s explore what is best for you and your family. Accessible design — This refers to ensuring access for persons with disabilities. Since its passage in 1990, the Americans with Disabilities Act (ADA) has been mandatory for public buildings

and for private buildings that are open to the public – but not for privately owned, single-family houses. Nevertheless, “ADA compliant” is sometimes used to describe houses built with the sort of accessibility features common to buildings required to follow ADA requirements. The ADA is focused on

Appraisal Anxiety

Robert “Greg” Lane St.Cert.Res. REA#2252 • V.P., Timberlane Appraisal “Appraisal anxiety” is a common theme among buyers and sellers in today’s market. It used to be the home inspection that people lost sleep over, but lately it seems that the real estate appraisal is front and center. Whether you are buying a completed new home or building a home from the ground up, your lender will require an appraisal. It is in your best interest to demand that a competent appraiser be assigned to your purchase or refinance. Due to recent laws which have adversely impacted the profession, you can no longer choose the most qualified appraiser; an appraiser is chosen for you from a list or lottery. That appraiser may be qualified, but it does not hurt to ask the lender, “Who is on your approved roster—how were they selected, and why?” You are writing the check for the appraisal, it is your house (or future house), and you have a right to demand a professional. So when you meet the appraiser ask questions, like where the appraiser may choose his comparable sales from, or whether he will include distressed sales in the analysis. Inquire about local market statistics, specifically those that may affect your neighborhood. I recommend “qualifying” the appraiser, just like you would an attorney, a doctor, or a building contractor. Ask the appraiser if he knows the history of your neighborhood—does he know your home’s style and quality of work, does he understand the value of energy efficient items, etc.? If you are building a home, why not ask for the appraiser’s advice on the floor plan and features? We see mistakes every day that cause a good home to sell for a discount; functional design flaws are just one example. Knowing these pitfalls in advance might give you a competitive edge on the resale side later. If you find that the appraiser is not competent, whether geographically or materially, let your lender know. If you have any misgivings, it is important that you communicate the concern with your lender immediately. Once the appraisal is complete, the lender may have limited options on how to deal with a flawed appraisal. And whether your feedback is good or bad, the lender will never know how they were represented by the appraiser unless you tell them. THE BOTTOM LINE LEON COUNTY, FL As of 12/7/2012

It has been crucial in ensuring access to such places as schools, museums, office buildings, and swimming pools. Because the ADA is built around enforceable requirements, compliance can be measured. This can lead, however, to designs that meet the requirements, but detract from a building’s aesthetics. Universal design — Here, access meets aesthetics. Universal design starts from a position of inclusion by not just focusing on people with the most common physical disabilities, but by focusing on everyone. In doing so, universal design accommodates people who don’t fall into the category of being disabled, but who nevertheless often face challenges in navigating buildings and spaces, such as children, short people, tall people, pregnant women, and the elderly. Universal design attempts to incorporate accessibility features into a house in an aesthetically pleasing way. Whereas a ramp alongside a set of entry stairs might make a house accessible to persons with disabilities, a house built according to universal-design principles would have a stepfree entrance designed from the beginning to be accessible to everyone – not just a person in a wheelchair, but also someone pushing a stroll-

er or pulling a suitcase on wheels. No design can foresee every disability or complication, but if a resident of a universal-design home becomes disabled, the home will not suddenly become impossible to navigate. If that person needs grab bars or a stair lift, the blocking is already in place for installation. If an elevator is needed, stacked closets provide the perfect location. Aging-in-place design — While aging-in-place design is easily incorporated into new construction, it is most often employed when homeowners want to ensure that they can stay in their present home as long as possible. This is usually preferable to moving into an independent living facility, and it is much more cost effective. Many of the most common features of an aging-in-place remodel will include wider doorways, lever handles on doors and faucets, curbless showers – which can also be found in homes built in accordance with universal-design principles. Aging-in-place design, though, most often is focused more narrowly on preparing a specific home to be accessible to its current residents as they age. Every day, 10,000 baby boomers reach the age of 65 and it’s going to continue at that rate until 2030. With this much of the population seeking living environments that work in their favor, we can expect to see the Better Living Design movement gaining momentum every year.

At first glance, Shane Lambert would not have considered himself as president of the Tallahassee Builders Association. At one point early in his life, he didn’t even plan to be in the construction business. Things have a habit of changing, though. A pre-med student, Lambert was going to break tradition. “I was around construction all my life and never got into it,” he recalled, noting his father, Dallas Lambert Jr., and grandfather, Dal-

las Lambert Sr., were builders and both served as TBA president. Shane, 37, eventually switched from a career in medicine to becoming a state-certified general contractor and starting Shane Y. Lambert Construction Inc. 13 Shane Lambert years ago. He has belonged to the TBA since 2002 and was installed this past week as its president for 2013. Destiny aside, Lambert hopes to carry on the

revival of the association that has gradually occurred as the construction business itself has begun to recover from its worst economic slump anyone can remember. “Our industry was hit harder than any other industry in our nation’s history,” Lambert said of contractors. “They have been through the ups and been through the downs, but this is the worst they have ever seen.” Not only are there fewer people employed in construction nowadays, the business itself has changed — from project financing and technology advances to the expecta-

tions of consumers. “Today, people are smarter with their money and smarter in the way they spend,” he said. A good example is the prevalence of renovation and remodeling work for existing homes — an activity that is Lambert’s principal activity. Many homeowners are content to stay put, investing in upgrades and additions, hoping those projects build value into their properties. “Basically, the dynamics have changed,” Lambert noted. “Clients are feeling it, too. They are pinching their pennies even tighter.”

Terminating A Tenant For A Lease NonCompliance – It Is Harder Than You Think By Harry A. Heist, Attorney at Law It would be difficult to find a property manager who has not served Three Day Notices for non-payment of rent and Seven Day Notices to Cure for tenant noncompliances. The tenants usually pay the rent, or in the case of noncompliances, they cure the noncompliance or move right out. Most property managers are well versed in notice serving and have filed evictions on their tenants when the notices just did not do the trick. Many property managers have even experienced going to court on contested non-payment of rent cases. The result? Usually the tenant is evicted, or the case gets settled. Now ask yourself: How many times have I actually gone to court on a contested eviction on a Seven Day lease noncompliance case and had to prove the noncompliance in court? Very few property managers have experienced going to court on contested noncompliance cases and do not realize how hard these cases can be to win. Proper preparation, hard core proof and good convincing witnesses are necessary to win these cases. Are you ready to prove your case to a judge who will really put YOU to the test? Winning and Losing the Seven Day Noncompliance case Since most property managers have never experienced going to court on a contested noncompliance case, you will just have to trust us here. We have handled many of these cases, and we have LOST many of these cases. You don’t want to lose a case in court. Besides the pain of losing with the tenant now getting to stay and smirk at you for the next six months, if that tenant retained an attorney, you may be on the hook for attorney’s fees. Recently two cases we lost resulted in around $2000.00 each having to be paid to the tenant’s attorney, for which the property manager thought she had a great case, really wanted to get the tenant out and insisted that the eviction be filed against our advice. Is your attorney a wimp? Once of the most frustrating things for the landlord’s attorney is to try to convince a property manager who thinks he has a great case that there is a high chance of losing in court. The property manager needs to understand that the landlord’s attorney may make his or her living filing your evictions and has every incentive in the world to file your eviction, BUT also wants to protect you from losing the case and having to suffer the consequences. The landlord’s attorney has probably filed hundreds, thousands or in our case, tens of thousands of evictions, winning the vast majority of the evictions, as most are for non-payment of rent. Trust the experience of your attorney. Your attorney is on your side, feels your frustration, but is also under the legal and ethical duty to warn you of the dangers of losing and guide you in the right approach. Your attorney is not a wimp or lazy. Your attorney has the experience to know what is best for you. There have been situations where an unsuccessful Seven Day Noncompliance case has not only been lost in court, but took on a new life when a Fair Housing Discrimination case was filed against the property later! The judicial attitude in the Seven Day Noncompliance case When you go to court on a typical residential tenant eviction, the tenant usually did not

pay the rent, did not properly withhold rent or did not post all the money into the court registry. Judges handle thousands of these cases each year, and some of them have no tolerance for listening to the tenant’s sad story of losing a job, car breaking down or the myriad other excuses. Most cases for non-payment of rent result in an eviction. Now we come to the Seven Day Noncompliance eviction. This is far different than the non-payment case. Here the property manager has accused the tenant of doing or not doing something that is spelled out in the lease or Florida Law. Notices have been given, these notices must be correct, and now the property manager is put to the test and has to prove the case. Judges do not take these cases lightly and really make the property manager prove the case. Often it seems that the judge is far more sympathetic to the tenant, but really it is a proof issue. It is much easier to prove someone has not paid the rent. They either paid it or they did not, and the burden of proof of prior payment is on the tenant. Proving a noncompliance is the landlord’s burden and can be a real challenge. How do we prove the case in court? Before we even get to court, the property manager must have prepared and served a PROPER Seven Day Notice, be it a Seven Day Notice of Termination or a Seven Day Notice to Cure followed by the Seven Day Notice of Termination. We strongly recommend that you have your attorney prepare these notices for you. We prepare all our clients’ Seven Day Notices for no charge, as we really want them done the way we feel they would be most effective and successful in court. Now, proving the noncompliances can be a real challenge. We need witnesses, documentation, solid proof, logs, file notes, notices, photos, videotapes, police reports, incident reports, and anything else to help the judge believe that the noncompliance is occurring or has occurred. Does the Noncompliance have to be severe? Remember that you are asking a judge to kick someone out of their home. Often there are children involved. The noncompliance needs to be substantial, and you need to trust your attorney to help you decide if it is indeed substantial enough to sway a judge your way. It is ironic how when the market is strong and the property has a waiting list, there seems to be so many more tenants in noncompliance. Hmm, a coincidence? I have petitions and statements signed by 5 residents! Nice try, but no cigar. The complainers or witnesses MUST appear in court. This even includes the police officer who responded and wrote up the police report. How do we get them into court? We need to subpoena them, but often they just do not show up for court, and the case falls apart. We have had situations where many tenants have complained about one tenant. Every day they wrote letters and called the office complaining about the noise that the tenant was creating. We end up in court, one complaining tenant shows up and tells the judge that the problem has stopped. Bang. We lose the case. Never be certain that the complaining tenants will actually come to court. Often they are afraid, were threatened or get cold feet at the last minute and do not want to be involved. What does your attorney need to win these cases? The proof that you need is wholly dependent on the type of noncompliance involved and is extremely case specific. Let’s go through some of the most common

noncompliances and list some of the evidence we may need to potentially prove our case in court. Unauthorized Occupants – Seems easy, you see the person there all the time. When you go to court, the tenant says they are just visiting. You need to now prove that they are no visiting. Proof you may need includes and is not limited to: 1. Multiple photos of the unauthorized occupant’s car morning and night with date and time records; 2. An admission by the tenant to you that the unauthorized person is living there; 3. Proof that the unauthorized person is receiving mail; 4. Unannounced visits to the unit with a witness; 5. Police report that the unauthorized person gives the address as his or her address; 6. FDLE sexual predator or offender registration with your address listed; 7 .A lease clause that is clear as to how long someone can stay. Unauthorized Pets – First you need to make sure the prior manager did not authorize the pet or the pet has not been there for a long time, which can cause a waiver. 1. Pictures of the pet, date and time stamped; 2. Witnesses who have seen the pet; 3. Pictures of the tenant walking the pet; 4. Maintenance who will testify to pet food or pet bowls in the unit; 5. Recording of barking when you go to the door, if a dog that is; 6. Picture of the pet damage; 7. Picture of the pet coming to the window; 8. Hard proof after the Seven Day Notice of Noncompliance with Opportunity to Cure has expired. Noise Disturbances – These case are tough, as usually there is no police involvement, and the complaints come from other tenants who may just be angry at each other, or a group of tenants have it out for one tenant. Are we really dealing with a tenant versus tenant war? 1. Records of multiple tenant complaints; 2. Police reports; 3. Tenant witnesses who will appear in court; 4. Witnesses who are employees of the landlord; 5. Multiple provable disturbances; 6. Courtesy officer who will appear in court. Unsanitary Unit – Is the unit really unsanitary or just an extremely cluttered mess? Many times we deal with accumulators who throw nothing out and have piles of newspapers, clothes and books throughout a rental unit, with only a small path in which to walk. Is this unsanitary or just strange? 1. Pictures of unit; 2. Pictures of kitchen, bath and anything “unsanitary”; 3. Pictures of exposed and rotting food; 4. Pest control personnel who will come to court; 5. Infestation of vermin; 6. Strong odor; 7. Maintenance staff that must come to court; 8. Other staff who will come to court. Emotions and the Seven Day Noncompliance case We see situations where property managers get angry at a tenant and “just want them out”. This is the worst possible situation because the anger and frustration of the property manager is now running the show. That unauthorized occupant who was not a problem for three months all of a sudden becomes a big problem, because he came into your office and was belligerent. That person with the unauthorized pet was left alone until it defecated in front of the office or got loose and scared another tenant. Never let your emotions dictate your actions when deciding to terminate a tenant. Follow the law, get your attorney involved early, and be cautious.

He’s got a lot of energy. He’s a bright man and he’s very committed to the TBA and to the industry,” McFarland said. The TBA intends to continue expanding its membership, promoting professionalism in the building business, and raising public awareness of its mission. On the calendar is the TBA’s signature event, the annual Parade of Homes in May, the Remodelers Showcase Awards, golf outings and even a fishing tournament.
