Sellers, Set Your Sights on Spring

Robert “Greg” Lane St.Cert.Res. REA#2252 V.P., Timberlane Appraisal For those homes with the “right stuff” in the Tallahassee market, this is an excellent time to be looking at selling. The pollen came out early this spring, and so did the buyers.

Our spring collection of new inventory typically hits MLS (Multiple Listing Service) in March. This year, buyers are more anxious, mostly over the perception of interest rates rising as we move into 2014. That said, buyers seem to feel, and the statistics support, a stabilizing trend in many of our market segments within the larger Tallahassee real estate market. The best way to get a hook into one of these buyers is to set yourself up to be in viewing range. In other words, stage appropriately, list with a REALTOR®, and above all, price competitively. There is still an oversupply in many of our market segments, but many of these homes have become “stale” on the market and do not compete with fresh listings. Buyers are savvier and more educated on the market today than ever before. They can sniff out an overpriced listing like a trained hunting dog. If your home is not even within viewing distance, buyers are not going to waste their time. Even in what is still considered, for the most part, a buyer’s market, I continue to hear the following response from at least one buyer every week: “Well, we don’t want to make an offer because we don’t want to offend the seller.” So if this is the case, then you won’t even get an offer if you are out of range. This spring, keep the buyers in your sights from day one, and zero in on your target. If you cannot do that, it is not worth the hunt for a sale. THE BOTTOM LINE LEON COUNTY, FL As of 2/6/2013

hesive used. For example, it has been my experience that tiles on plaster walls that were installed after the plaster cured are much easier to salvage than those stuck to drywall. The worst luck I’ve had is with wet-bed installations — tiles embedded in wet concrete. It is virtually impossible and incredibly laborintensive to do so. Q: Would you possibly have any suggestions for removing cat-urine smell from a painted concrete basement? We have disinfected, scrubbed, hosed down and dried, all with three small windows open and fans blowing. This basement has painted, pargeted stone walls, a painted concrete floor, and an unpainted and exposed floor-joist ceiling. It appears clean as a whistle, but is rank. A: Concrete is porous, so cleaning the surface isn’t likely to solve the problem for very long with the methods you have described. Some people suggest using white vinegar because they sat it is capable of chemically neutralizing urine. You might also try a commercial cleaner designed for such removal. You’ll need to seal the floor once this is done, or maybe even go as far as coating the floor with a thin layer of concrete when you are finished. Septic system tips It has been eons since I lived in a house with a septic tank, but I know some of you still do. The Environmental Protection Agency has some tips on how to keep waste in its place and not let septic-system prob-

lems get out of hand: Spread laundry and dishwasher loads throughout the day. Consider fixing plumbing leaks and installing faucet aerators and waterefficient products. Too much water use at once can overload your system, particularly if it hasn’t been pumped in the last couple of years. Avoid pouring fats, grease and solids down the drain. Homeowners should have their septic system inspected every three years by a licensed contractor and have their tank pumped when necessary, generally every three to five years. On average, it costs homeowners $250 to pump their septic system, while the price of replacing a conventional septic system is $5,000 to $10,000. Remind guests not to park or drive on your system's drain field, because the vehicle's weight could damage buried pipes or disrupt underground flow.

Living above the antique store and loving it By Mary Meehan Lexington Herald-Leader

LEXINGTON, Ky. —

Janice Langston admits that once in a great while she will set a fancy meal on the dining room table that’s part of the dining room suite for sale just down the hall from the family kitchen. It’s one of the benefits of having a house full of fabulous American and English antique and reproduction furniture, lighting and accessories just steps from her private home. But generally Langston is more than content to share a cozy portion of the second floor of her

store, Janice’s at the Saltbox, with her husband, Don. “It is our little nest. We couldn’t be happier,” said Janice Langston. Her favorite place is her “throne” — a comfy, skirted, wingback chair in a floral print in the small living room. Don’s preferred perch is the plaid couch. For 23 years, the couple has lived and worked at 859 E. High St. in Lexington. The first floor and part of the second are stuffed with merchandise. Tucked in an upstairs corner is the twobedroom, two-bath home the couple shares. The

only differences between the warm, lived-in feel of the retail space and the family home are the price tags in the store

and the lack of family photos on the tables that are for sale. Langston designed her home with such tradition-

al touches as Victorianthemed art in gilded frames, wood boxes with tasseled keys and even a cherubic girl in a large frame over the bathtub. The hardwood floors, installed when they moved in, have an antique feel accented by the oriental rugs that echo the traditional theme. The rooms are a mix of dark, rich colors, floral wallpaper and gleaming wood furniture, reproduction and antique. by Cathy L. Lucrezi, Attorney at Law Whether it is reserved or “first-come, first-serve”, parking is a territorial issue which tenants loathe to let anyone change. Because of this, a property manager may have a dilemma when a tenant with a disability requests a reserved accessible parking space. Fair housing law obligates you to provide reasonable accommodations for tenants with disabilities. That means you are obligated to provide the reserved space even if your property does not assign parking spaces to specific tenants or units. You must provide a reserved parking space to a tenant with a disability if he requests it. The reserved parking space for the disabled tenant must be posted with a sign at the head of the parking space, saying the spot is reserved and enforced. It should be marked as reserved so that other people with disabilities don’t park there.

You must enforce the tenant’s right to the reserved accessible parking space. That may mean issuing a notice of noncompliance to a tenant who parks there. A challenge arises when there are several tenants with disabilities, each one requesting a reserved parking spot. Unfortunately, there is very little guidance from HUD about how to juggle numerous, competing requests. Instead, each

request must be handled with individual consideration. It helps to have in place a written policy and procedure regarding requests for reasonable accommodations. Note that not all accessible parking spaces have to be equal. Many tenants who need an accessible parking space don’t need an extra-wide space with an access aisle. They may only need a regular-size parking space nearest to their front door (or on the most accessible route to the front door). Discuss with the tenant his or her needs for parking. Guest parking is subject to ADA Title III rules, which require that at least 2% of all guest spaces in any lot meet access requirements and be designated with appropriate signage. These spaces must be at least 96” wide and must have an adjacent access aisle at least 60” wide, which allows room for a wheelchair, electric scooter or other mobility device. An access aisle can be shared between two accessible parking spaces. At least one of these spaces must be van accessible with a 96” access aisle. Remember that the parking spot you provide to a tenant in response to an accommodation request is separate from and in addition to any general accessible spots provided for the public or tenants and their guests. If the rental office is on-site, be sure to locate at least one accessible guest parking space next to the office.

ny were bought on a trip to London. To transition from home to work, Janice Langston said, they just shut the door. But living above the shop is very different from how the couple started out. They met at the University of North Carolina, where she was studying nursing and he was on the football team, and spent the first half of their 58 years together in suburbia. But, Langston said, as her children got older, she became more involved with interior design and selling furniture. She started doing interior design work for friends and then ran a business out of the family home in Lexington’s Lansdowne neighborhood, where she would feature furniture from her home state of North Carolina. When Don Langston retired from IBM, the couple looked for a place where they could expand the business and downsize their home. They bought The Salt Box, which was a lighting store at the time. It had only one floor, so the Langstons added a second and an extension out the back with a three-car garage to create a 6,800square-foot shop-home combo. Friends wondered whether people might take advantage, calling at all hours with decorating emergencies or asking the Langstons to open the store during off hours. But Janice says that hasn’t happened. She said the shop’s location was ideal because of the thousands of cars that drive by each day. While that might not be ideal for a home, the sound of traffic has never been a problem, Langston said.

The hallmark of Midtown is that you can walk everywhere. Restaurants, cafes, shops, parks, art galleries, grocery stores and medical services are so dense in this strip of land north of downtown Tallahassee that people can easily stroll from one place to the next. The nightlife is continuous here, with several restaurants offering live local music with your meal, a choice of bars featuring specialty wines and beers and larger venues for dancing. Midtown runs roughly from the intersection of Monroe Street and Thomasville Road north to Betton Road and includes the neighborhoods of Los Robles, Lafayette and Levy that border the commercial district. Green spaces abound and include Lake Ella and Winthrop and Lafayette parks. Right in the middle of Midtown is the gateway to Los Robles near the intersection of Thomasville and Meridian roads. The arches mark the entrance to the 1920s neighborhood once considered the outskirts of Tallahassee. Midtown is also home to DayStar, Tallahassee’s only co-housing community. It consists of eight homes located behind the site of the new Whole Foods Market off Thomasville Road. Residents own their own homes, but share common space including a community garden, parking lot and sidewalks. Two homes in DayStar recently went under contract shortly after being listed. One of those homes, 1523 Payne St., will have an open house today from 2 to 4 p.m. The

immaculate, 1,100square-foot house overlooking the community garden is listed at $150,000. Backup offers are welcome. Midtown offers probably the widest range of home prices in the city. In 2012, for example, about 35 residences were sold, ranging in price from $21,500 to $405,000, with the median being $158,750, according to the Capital Area Technology and Realtors Service Inc. The median days on the market was 80. More than 15 homes are now on the market, with at least five under contract. Prices range from $35,000 (on Gibbs Street) to $784,900 (on Cristobal Drive), with a median price of $216,000. City planners, neighborhood groups and the Midtown Merchants Association — which boasts more than 70 members — are committed to improving the vitality of the area. In November, they held a ribbon cutting for the 5th Avenue Plaza, a formerly nondescript street between Whataburger and the Tallahassee Board of Realtors. The street is now lined with bricks and has benches, gaslight lamps, wide sidewalks, a water fountain, pedestrian walkways and electric outlets for food trucks and other vendors to use for special events. Additional improvements include making the area even more accessible by bike and foot, said Cherie Byrant, manager of the comprehensive planning and urban design division of the Tallahassee-Leon County Planning Department. A trolley connecting Midtown to Downtown and the Gaines Street area is also expected by the end of the year. “Once you have more people on the street,

more people walking by, it makes businesses stay open longer and brings new businesses to the area,” Bryant said. “A small investment can yield some big results.” For people living in the surrounding neighborhoods, those investments are bound to increase their quality of life, and likely, the value

Mortgage insurer can sue seller after short sale By Gary M. Singer Fort Lauderdale Sun Sentinel

QUESTION: I completed a short sale on my home, and the agreement didn’t address whether I still was on the hook for the forgiven debt. I was just served with a lawsuit from a mortgage insurance company that wants me to pay the defi-

ciency. What’s going on? ANSWER: I’m seeing more of these lawsuits. A common misconception about private mortgage insurance is that it protects the borrower. In reality, while the borrower pays for this insurance, it actually is designed to protect your lender if you default on the mortgage.

Not all loans have PMI. But if yours does, and you complete a short sale or lose the home in foreclosure, your lender can make an insurance claim with the PMI company. The company then can stand in your lender’s shoes to try and collect the money back from you, a legal concept known as “subrogation.”

The theory is that because your actions resulted in the insurer having to pay the claim, the company can seek repayment from you. You can respond to this lawsuit by making the company prove it has the right to collect the deficiency, just as you would make the lender prove it has the right to fore-

close. You may be able to settle with the insurer for less than the full amount you owe. Of course, if the deficiency had been previously waived by your lender in the short sale or foreclosure, you wouldn’t have to worry about any of this. That’s why it’s so important to make sure

the lender forgives the debt.

Tricks to help kids keep organized Neat bedrooms can be a reality

The conversation often starts with, “Where are your shoes?” For many parents trying to get out the door on time in the morning, a child with a disorganized bedroom can be a huge roadblock. The clock is ticking. The bus is coming. And your offspring is searching for his favorite hoodie. The day often ends with similar challenges: “Is your backpack ready for school tomorrow?” “Where are your library books?” Getting a child’s room organized can be the first step toward smoother mornings and more peaceful evenings. “It was nice to be organized 20 years ago,” says organizing consultant Kathryn Bechen, author of “Small Space Organizing: A Room-by-Room Guide to Maximizing Your Space” (Revell, 2012). But given how busy we are today, she says, “it’s become a necessity.” Here are some experts’ tips on decorating and arranging your child’s bedroom in ways that will simplify daily life.

Get them excited No need for full-scale redecorating. An offer to rearrange items and perhaps add a few new ones will probably get your child excited enough to help shape up her space. “Try to make it fun,” Bechen says. “Take one whole Saturday or Sunday for the whole family to work on it.”

Pare down Eliminating clutter isn’t simple, especially when kids would prefer not to part with anything. Donna Smallin, author and creator of unclutter.com, suggests having kids help haul everything they own into the hallway outside their room. When the room is empty, have them bring back in only their favorite or most necessary things. You can supervise: When all the necessities are back in, start discussing what might be good to give away, sell or box up for storing in an attic or basement. Reassure the child that items in storage can always come out again later. If the room includes a desk, keep it as uncluttered as possible, suggests Dr. Martin L. Kutscher, pediatric neurologist and co-author of “Organizing the Disorganized Child” (William Morrow Paperbacks, 2009). Get a bin that holds hanging file folders to store finished papers that come home from school or pending homework. Another small bin can hold pens, pencils and a few other supplies needed for schoolwork. Otherwise, keep the desk clear.

Rethink the closet To get children excited about actually putting things away in the closet, let them “paint it a neat color inside,” says Bechen. It can be as outrageous as they’d like; it’s hidden behind a door. If they love it and it feels personal, she says, they’re more likely to use it. (For kids who share a room, let each choose the color for one side of the closet.) Then, work with their habits: If your child isn’t

anything else that needs to be easily located. A large wall calendar that children can reach is also a great way to help them get organized. Last item: a dry-erase board (WallPops makes one that’s a repositionable vinyl decal) where kids can keep a checklist of tasks for bedtime and morning. Write out the checklist with them, then praise them for using it.

You might prefer Tshirts to be neatly folded, says Smallin, but having them wrangled in large baskets is better than finding them on the floor. If shoes get misplaced, add a large crate to the closet where the child can drop them. If you will be using the closet rod, Smallin suggests adding a small double rod that hangs below one portion of the main rod. Put items the child wears most often on the lower rod, so they’re

within easy reach. Or use this extra rod for the clothing the child will wear to school this week. If those items are chosen in advance and all located in one place, you won’t spend time searching for them.

Get playful Make straightening up fun. Consider buying one large trashcan for sports equipment and another to use as a hamper. Let the child label and personalize the outside. Also, have the child decorate a special bin or basket where tomorrow’s clothes and shoes will go. Then choose a permanent spot for it. Each night, toss in everything your

child will wear tomorrow (including the packed, zipped school bag). Better to find missing socks and debate which clothes are appropriate in the evening than do it when the school bus is on its way.

Use the walls Kids are more likely to use hooks than hangers. So add lots of colorful hooks at your child’s level — not just one or two, but a whole row — to store hoodies, jackets and even pants. Also consider hanging a shoe bag on back of the door, but don’t feel obligated to use it for shoes. Smallin says it can be filled with socks and underwear, small toys or

So simplify bedding — perhaps just use a fitted sheet and a duvet with a cover you can drop in the wash once a week. Limit the decorative pillows and piles of toys, so school supplies can’t get lost in the chaos. Smallin suggests lifting the child’s bed with risers to create extra storage space, which can be filled with labeled plastic bins. Use a bed skirt to hide the bins from view.

Once you’ve done it For the first few weeks, Bechen says, “Run through the drill. Tell them, ‘You come home, you put your things here... .’” Repeat the steps each day, as patiently as possible. And trust that in time, your kids will keep their bedrooms organized out of habit. “It’s an executive function. It requires the ability to stop, plan, organize and actually execute a goal,” Kutscher says. As that ability is growing, parents need to gently guide the process. “We take the safety net approach,” he says, “gradually letting the child master the skills, as we stand by as needed.”
