Wooden floors will darken with age By Al Heavens The Philadelphia Inquirer

Question: We have had natural hardwood floors for five years. During that time we had a rug under a coffee table. This week we removed the rug and the wood floor was a much lighter color. What can we do to have

the floor return to its original matching finish? Answer: It probably would involve less work if you just let the area darken to match the floor that was exposed to the sun’s UV rays. I’ve seen homeowners use bleach to lighten wood floors with some success, but I wouldn’t do it myself.

There are, I am sure, products available on the Internet that might progressively lighten the floor, but most of the solutions I’ve seen involve refinishing all the floor. Q: I plan to sell my house in the next year or two. Right now I am trying to make some small improvements to make

the house more appealing. One area that needs improvement is the patio. The previous owners poured the 200-squarefoot patio in one large chunk, probably about 15 years ago. There is a large crack that runs horizontally across the patio, which was filled with some kind of caulk that

I have few significant skills in life. I can’t tell a joke, juggle, or do a backflip. But I can walk into most homes and tell you the age of the home within minutes. I call this “carbon dating” the home, taken from my Intro to Geology class at FSU back in the day. Unfortunately for most sellers, buyers have this same “sixth sense” for real estate. Three decades ago, we embraced a mid-’80s color palette of dark countertops, carpet, and wall colors. As tastes changed in the mid-’90s, many of us realized that “white, bright, and airy” was the new wave, and it was time to break from the ’80s. I still don’t know what “airy” is, but it sounded really good on HGTV when everyone said it, over and over again. Remember the movie Poltergeist, with its famous catchphrase, “They’re back”? Well, welcome to the new millennium, because the rich, darker colors we so longed to get away from are back with a vengeance. Anyone who toured the very successful Parade of Homes this year noticed the darker color choices in most, but not all, of the homes. Buyers really want new, but in some cases they cannot afford it, it is not available, or it is not in the location they are looking for. For some of those buyers, they really should just build. For those who don’t want to or can’t, the next best thing is a relatively new home which has been updated. If the buyer walks into your home and you have the pickled oak cabinets, green Formica countertops, white tile flooring, white appliances, white walls, and huge vaulted (airy?) ceilings, you might as well have an electronic billboard that reads, “This home was built in 1995.” So look around. It might be time to warm up your home, add some stone countertops, brush on some mocha paint, and go stainless. No matter how appealing the exterior is, a buyer is going to carbon date the interior of your home, which may just be the difference in whether it sells or not. only serves to make it more noticeable. Is there any way to make this patio better, short of digging it all up and repouring it? A: The fact that the crack runs across the patio is a sign to me that the job was badly done and no amount of patching will fix it. The answer, then, is no, in my opinion, but I’d get a second one from a contractor or two before you took my thoughts to the bank. Advice on rust from reader Jerry Grover: I have seen several questions about rust in your recent articles. There is a product by Loctite called Extend that is a rust neutralizer. It converts light rust to a black paintable surface. I’ve used it for years and never had a problem with the rust returning. The last can that I bought came from Home Depot. This one is a spray can, but I have found it in a bottle as a white milky liquid that you could apply with a brush. I have usually painted over it with Rust-Oleum, but the directions say to use three coats if you are not top-coating it. Q: In the early ’80s we refinished our basement. We used a foam-backed carpet that was glued to the floor. The carpet has gotten wet and we want to remove it. Any ideas on how to remove the carpet and foam from the cement floor? Is there some type of solution we can use? A: A solvent and a scraping tool, but wear plenty of protection and make sure the work area is well-ventilated. I’ve seen a recommendation for that citrus paint remover but I’d head off to the hardware store for suggestions. Q: Our dishwasher is around 10 years old, and we have a lot of calcium in

our water (according to our plumbers), which leaves a brown residue anywhere the water sits for any length of time. The dishwasher worked fine until about six months ago, when the residue started collecting everywhere (the sides, the bottom, the racks, the blades). I’ve tried things that are supposed to clean dishwashers: wiping off everything we can reach, adding no-spot stuff, which I never needed before. In addition, over the last month or two the smell has gotten unpleasant. I’ve tried spraying everything with an ammonia-water solution, sprinkling baking soda inside, wiping the rubber ring in the center and applying the no-spot stuff liberally around it. Nothing helps. I’m concerned that if we just replace the dishwasher, the problem will continue, since I don’t know what is causing it. A: Hard water will do these things. You’ll need to look into a filtration system before you buy the new dishwasher.

Sorting through furniture options By Tim Butt McClatchy Newspapers

KANSAS CITY, Mo. — Today, we are experiencing a demand for the designs of midcentury American furniture, when America was in a period of design excellence and innovation, but the question of what to buy has become more confusing to the consumer. Can I buy an original? Should I buy vintage or new? What is the difference between an authentic piece and a reproduction? As a designer, and someone who supports authentic design, I will try

to clarify some of the confusion around these questions. (Full disclosure: I am an authorized retailer for Herman Miller and Knoll, both licensed to produce iconic midcentury furniture pieces.)

Original What really defines a piece of furniture as an “original”? This is an interesting question since many of the mid-century pieces we are familiar with were designed to be mass-produced and have been in production since being introduced. In the purest sense of the word, an “original” is a

one-of-kind piece or a piece that was made during a limited production run (also called a limited edition). Very few of us can afford an original, as this is the stuff that is highly prized by collectors and rarely comes up for auction. So the term “original” is not really applicable when you are talking about mid-century furniture that was designed to be mass-produced.

Vintage or new? This really gets down to your taste. Are you a person who wants to see some patina on your piece

or someone who wants something brand-new? If you are like me, the answer is both. I shop vintage stores when I’m looking for something that I want to have a bit of history or when I am looking for something that is not made today. Other times, I buy new because it either looks best in the space or the new piece has been improved upon from previous production runs. Before buying a vintage piece with a price tag higher than a new piece, do your homework and find out when the piece was made and how it is different from those be-

Code Enforcement and the Property Manager

by Harry Anthony Heist, Attorney at Law There will come a time when the property manager and/or owner of the property receives a notice of a code violation from the municipality where the property is located for something the tenant is either doing or not doing. This may be for something as simple as parking on the lawn, failing to cut the lawn, or not taking in the garbage receptacles from the street in a timely manner. The violations could be more serious, such as failing to maintain the exterior of the property, engaging in a business activity, or allowing mountains of personal property or debris to accumulate on the front lawn. How the property manager deals with the issue can make the difference in the property owner receiving a fine or notice of hearing, or instead getting a serious break cut for them by the code enforcement official. The key is the property manager must deal with the problem, deal with it swiftly, and keep code enforcement fully aware of the actions which are being taken to rectify the situation. The Catch-22 is that the time period for compliance given by code enforcement is seriously at odds with the actual time it can take to get compliance or eventual removal of the problem tenant. The Property Owner Receives Notice Usually, the property owner will receive notice by mail at the address that code enforcement has for the owner. This is usually the address where the tax bills are sent. The owner may live in a distant state or be absent on vacation when this letter arrives, and there is thus a major delay in word of the problem getting to the property manager. This is the first in a series of problems that can occur. The Property Manager is Notified Once the property manager is notified, action needs to be taken immediately. There will most likely be a time deadline which may be close to passing, or in some instances has already passed. This is when the property manager must immediately notify the code enforcement officer by phone and in writing, acknowledging receipt of the citation and expressing a strong willingness to deal with the problem fast.

Can the problem be solved immediately? If the situation can be solved immediately, for instance by having a lawn person go out and immediately cut the lawn, this should be done, and the tenant should be billed for the expense incurred. If getting compliance requires the property manager do any self-help removal of the tenant’s personal property, the property manager should NOT attempt this at all. Self-help removal of items or the towing of vehicles can lead to serious litigation. If the property manager cannot easily rectify the problem, a dialogue must be opened with code enforcement. Communication with Code Enforcement The property manager should call code enforcement immediately to see exactly what the problem is. Often the citation is vague in describing the offending activity or condition, and this will allow the property manager to get a better idea of what exactly is wrong and what needs to be done. By calling immediately, the property manager

can explain to the code enforcement officer that she is on top of the problem and will be taking every legal step possible to rectify the problem. Most code enforcement officers will appreciate the call and indicate to the property manager that the main purpose of the citation is to get compliance, rather than impose fines or other penalties. The property manager will then be led to believe that the code enforcement officer is a nice person and that there is an actual extension given. It may be a correct assumption that the code enforcement officer is indeed going to work with the property manager and give an extension of time to deal with the problem, but can the property manager be sure? Did the Property Manager Get an Extension of Time? The property manager immediately will serve the tenant a Seven Day Notice of Noncompliance with Opportunity to Cure, which probably is the proper notice to be given in most code violation situations. Your attorney can assist you here. Will the code enforcement officer sit back and wait? We are not sure. Next week, there may be another code enforcement officer assigned to the case, as the original one is on vacation. Was the extension properly communicated? Did the property manager get something in writing, or will he or she simply depend upon the phone conversation with code enforcement, one of many phone conversations the code enforcement officer had that day among many other people? We recommend that you immediately follow up any phone conversation with a letter to the code enforcement officer by regular mail and certified mail such as this: Dear Officer Smith: Today I received the notice of violation on 125 Main Street and will be taking immediate action. As per our phone conversation, you have agreed to hold off on taking further action against the property owner during this process. We have contacted our attorney and have served the tenant with a Seven Day Notice of Noncompliance with Opportunity to Cure which is attached to this letter as “Attachment #1”. This is required by Florida law before we can terminate the tenancy, if he or she fails to cure the problem. If the problem is not cured within seven days, we are required by law to serve a Seven Day Notice of Noncompliance Notice to Terminate. Once this notice expires, we can then begin an eviction action, which takes between 20 and 45 days on average. Please use me as your contact person, as I am the person directly responsible for managing the property. My phone number is 555-1212. I will be doing everything legally possible to either get compliance or have the tenant removed. Please feel free to call me or my attorney at 555-1313 if you have any questions about the progress or the procedures which the Landlord/Tenant Act requires.” The result of such communication will usually buy extra time for the owner of the property. Code enforcement often has no idea how the compliance and eviction process occurs, and they need to not only be informed of the procedure to understand your dilemma, but keeping them informed of the progress will help insure a cooperative experience with code enforcement and help in future occasions when another one of your tenants may be in noncompliance. Developing a keen and cordial working relationship with code enforcement is one of the traits of a successful and effective property manager.

authenticity. Sometimes the design of the manufacturer’s tag has changed over time, which can help establish a date of the piece. Consider photographing the tag and contacting the manufacturer to see if it can help you narrow down the time frame.

Authentic or reproduction? Experience has taught me that clients get easily confused by this question because of the way pieces are marketed. “Authentic” pieces are being produced by the manufacturer that is authorized by the designer, holds the license on the design and is making it consistent with the original design specifications. A “reproduction” is a piece that is produced to look like the authentic piece, but the manufacturer does not hold the license from the designer or the original manufacturer to produce it. Other words and phrases are used to describe a reproduction such as “replica” or “inspired by.”

Despite a steadying housing market, sellers and real estate agents still complain that low appraisals delay or kill up to 15 percent of all deals. In recent years, agents and others blamed a 2009 law that they said inadvertently led to less-experienced appraisers working in unfamiliar neighborhoods. Now a common refrain is that appraisers purposely keep valuations down. St. Petersburg appraiser Frank Gregoire, who testified before Congress, says banks and underwriters are pressuring appraisers “to be less optimistic and more cautious” to prevent another housing bubble. But that’s “patently false,” said Ken Chitester, spokesman for the Chicago-based Appraisal Institute. He concedes there may be a lag in valuations in a recovering market, but says appraisers can only work with the data available to them at the time. Appraisers make the final call, of course, but here are steps that sellers and their agents can take to ensure that valuations are fair and accurate:

» Don’t get greedy. Strong demand for homes is resulting in multiple offers, and some properties are being bid up so high that they won’t appraise, real estate agents say. Cash buyers typically don’t request appraisals, but banks require them so they don’t lend more money than homes are worth. In accepting a bid from a buyer needing financing, a seller would be wise to consider whether the offer can match the appraised value. “Highest is not always best when you’re dealing with an appraisal,” said Jim Heidisch, a broker with Campbell & Rosemurgy in Pompano Beach. » Be accommodating without being intrusive. The change in rules governing appraisals discourages contact between agent and appraiser, but there’s nothing improper about the agent’s being at the home to give the appraiser access and answer any questions, said Michael Citron, of RE/ MAX ParkCreek in Coconut Creek. Sellers should not be present because they tend to get in the way, agents say. “If they’re there, the sellers will ask, ‘Is it going to appraise?’ and you

don’t want to bother the appraiser,” Citron said. “Just have the lights on and the air conditioner blowing real cool to make it as comfortable as possible.” Fort Lauderdale appraiser Scott Dooley said he doesn’t mind if sellers stay. If they aren’t there, he prefers for an agent to

Federal Over-Regulation Hurts Builders and Consumers Let’s make something clear right from the start. No true professional in the home building industry would do anything to jeopardize the health, safety, and welfare of our citizens when it comes to their new home or remodeled project. You should also know that the Tallahassee Builders Association (TBA) enjoys a strong working relationship with local officials, both elected and appointed, who impose and enforce regulations on our industry. In most cases, those regulations are reasonable, and when believe otherwise, we make our case as best we can. That said, the fact remains that overregulation at the federal level of government can and does impede our ability to provide affordable housing in our community and to keep down the costs of remodeling.

Overly restrictive rules for the forthcoming QM standard will prevent creditworthy borrowers from entering the housing market. Meanwhile, changes to the Environmental Protection Agency’s Lead: Renovation, Repair and Painting (RRP) rule have constrained small businesses in the home building and remodeling industry. The final rule, which went into effect on April 22, 2010, requires renovation work that disturbs more than six square feet in a home built before 1978 to follow new lead-safe work practices supervised by an EPA-certified renovator and performed by an EPA-certified renovation firm.

Last week, the National Association of Home Builders (NAHB) told Congress that an unwieldy federal regulatory process is hampering the housing and economic recovery. “Housing serves as a great example of an industry that would benefit from smarter and more sensible regulation,” said NAHB Chairman Barry Rutenberg, a Gainesville to the House Committee on Oversight and Government Reform. For example, the Dodd-Frank Act required significant changes to mortgage lending practices, including an “ability to pay” provision that requires lenders to establish that home buyers have a reasonable chance of paying back the loan at the time that a mortgage is written. The law states that certain high-quality, low-cost loans known as qualified mortgages (QM) are presumed to meet this standard.

By removing the opt-out provision, the EPA more than doubled the number of homes subject to the RRP, and the agency has estimated this will add more than $500 million in compliance costs to the remodeling community in the first year alone, without making young children any safer. Moreover, the EPA has not approved reliable lead testing kits, and in many cases consumers are needlessly paying additional costs for work practices that are unnecessary. NAHB, our Florida Home Builders Association (FHBA), and TBA will continue to fight regulations that are “nice but not necessary.” When we prevail in those battles, our consumers and clients are the ultimate winners.

ATLANTA — When you’re paying for the view, a vacation home doesn’t need to have fussy decor or over-the-top interiors that distract from the lake or coastal setting. “That’s the reason why they’re buying the house,” said Alicia Mooney-Macchia, owner of Alicia Mooney Interiors, an interior designer at Lake Oconee, Ga., and throughout metro Atlanta. “What you want to do is walk in the house and look straight back at the view.” Heavy fabrics and details such as fringe on furniture are out, replaced with clean lines, linen fabrics and neutral colors, she said. Still, vacation homes don’t have to be shabby or suffer from the bare-

If you want to give a nod to the water setting and participate in the nautical trend in homes and fashion, Mooney-Macchia advises against creating a “lake room.” Instead, keep it simple. She accessorizes with nautical items, such as old oars or glass fishing floats and buoys covered with netting. Or a throw pillow could have a nautical or water motif. Requests for bunk-bed rooms are rising, especially as grandparents seek to accommodate multiple grandchildren during weekends and summers. “One of the neat things

Lowe’s executives are hesitant to say that we’ve arrived at the home of the Jetsons, with everything in your house automated and controlled by computers and wireless devices, but they say we’re not far off. “There’s been so much hype, we don’t usually say ‘the Jetsons house,’ ” said Kevin Meagher, vice president of smart homes for Mooresville, N.C.based Lowe’s Inc. “The reality is, we’re getting there.” The home improvement company has started rolling out its Iris system, which it says will help consumers use less electricity, increase security, and help monitor and alert homeowners to everything from freezer doors left open to elderly parents in trouble. Iris gives users the ability to remotely control and monitor systems such as thermostats, door locks, power consumption, cameras and motion sensors, on a computer or mobile device. Lowe’s is expanding Iris to nearly 500 stores this month, up from a pilot run in 10 stores. The products are also available online nationwide. Lowe’s hopes to expand the system to work wire-

lessly with more household appliances and possibly even electricity meters in future “smart grids.” Iris is the latest in a string of smart home systems that have come out recently. Time Warner Cable has been rolling out its IntelligentHome service. Verizon unveiled a similar system in 2011, and Comcast is pushing its Xfinity smart home system to customers. AT&T is piloting a similar system called Digital Life. And home security company ADT has offered a smart home sys-

tem called Pulse since 2010. But there are still questions over whether smart homes will truly catch on, or even whether consumers really want them. The Pew Internet & American Life Project released a survey of experts on where they see the future of smart home systems in

June. Just over half agreed with the prediction that fully connected smart homes would be much more widespread and efficient in 2020, while just under half predicted most smart home efforts will fail due to consumer trust issues and the systems’ complexity.

Smart home systems will certainly have to overcome hurdles before consumers adopt them. Chief among those, Pew found, is the problem of getting diverse manufacturers to all use compatible standards in consumer electronics, so they can all talk to each other. The systems are also more complicated than old-fashioned “dumb” homes, even though Lowe’s and others have taken steps to simplify them. And consumers could react negatively to the “Big Brother” aspect of having their energy usage and comings and goings constantly monitored, even if by a service they signed up for. Many of the systems on the market now offer similar capabilities. Lowe’s Iris, Time Warner Cable’s Intelligent Home, and Verizon all give users the capabilities to remotely set thermostats, set door alarms, and connect to wireless cameras in the home, for example. Here’s how Iris works: Once Iris is installed, a small hub wirelessly talks to various home appliances and a user’s mobile device. Users can set rules, such as turning thermostats down when they leave, or wirelessly turn them back up before they get home. A key fob sensor tells the system

whether the user is at home or not. The system also comes with motion sensors and cameras, which can be accessed from a mobile device, sensors to tell whether a door is open or closed, a smoke detector and flood sensors. Lowe’s is rolling out more devices integrated with Iris soon, such as door locks and pet doors, which can be configured to open or close at certain times. The retailer also is leveraging its connections with manufacturers to come up with more connected devices in the future, such as valves that automatically turn off water if a flood is detected, or a water heater that learns your personal routine and heats the water only when you generally need it. The base cost is $179 for a security kit with an Iris hub, door sensors, motion sensors, and a security keypad. Or you can pay $179 for an energy kit with an Iris hub, one wireless, energy consumption-monitoring wall outlet, and a thermostat. A combined kit with everything from both starter kits costs $299. Adding more sensors and accessories costs more. A wireless video camera costs $129, while each additional key fob and door sensor costs $19.99, for example.

Question: I am trying to complete a short sale of my home and received an approval letter from my lender. I can’t tell if I’m being released from the remainder of the debt. My real estate agent will not explain the seven-page

letter to me. The letter does say that I will be receiving a 1099 form for the deficiency. How do I know if I am off the hook? Answer: The only way to tell if you are truly released from the obligation is if your lender says so in writing, such as, “You are released from any further

liability under this loan.” Your real estate agent is correct in not trying to explain the approval letter. Consult with an attorney instead. Approval letters often are vague on this issue. Simply getting a 1099 form regarding the “forgiven debt” is not enough, and your lender can still

come after you for the deficiency if your approval letter does not specifically release you. I have had many cases in which I have had to get the lender to clarify in the approval letter that the borrower was released from the remaining debt, which can be a difficult and time-consuming task.

I also have had instances in which we have not been able to obtain the full release in writing. Still, most people are better off with a short sale, even without a full release. They may be able to negotiate the debt for pennies on the dollar, and they will save themselves a lot

of time.
