Let’s start this column with advice from reader Sharon Garcia of St. Davids, Pa.: “I just read the question posed by the person with the brown stain buildup everywhere in the dishwasher. I had this problem for many years,

and discovered that the only thing that would make the brown go away was putting Tang drink mix in the soap dispenser. It will have to probably run a few times if it has a lot of buildup. I always ran it on hot without dishes when the buildup got bad. I also would open it during the rinse cycle and add some more.

As I talk to REALTORS®, buyers, and sellers in other parts of Florida, I am amazed at how some markets have done an about-face. Two buyers for south Florida homes recently told me that every home they made an offer on had another offer in place already. One buyer told me he wrote five offers and was outbid on each home. Even with continued uncertainty in the world economy, people are still buying homes, and many are still buying them in Florida. One buyer recently told me that he had to buy, because the rental market was so competitive that it was just too expensive and there were few choices. Some have said that it is the rental market that will help bring back our sales market. In other words, as rents go up and rates remain at all-time lows, buying will be the cheaper alternative. Buying a home allows you more leverage, since there is still an ample supply of inventory, to choose where you really want to live at the monthly cost you can afford. Furthermore, buying a home allows you to make it “your own,” to paint walls, make repairs, etc., without having to ask permission from someone else. Believe it or not, I have already seen a few cases of increasing sale price trends, specifically in the new construction market. However, our local market would still best be described as “stabilizing.” There is still an oversupply in the market in general and there remain some market segments that have not stabilized. For the most part, though, I think we are at the cusp of a new beginning in our market. The rules have changed, buyers are more cautious, and lenders have new guidelines they must follow. That said, today’s informed buyer who works with local professionals—REALTOR®, appraiser, home inspector, closing agent, etc.—should feel confident with their purchase. I don’t see the investors coming here in droves from Europe and Brazil, like they are in South Florida, but I do think we are heading back to that typical Tallahassee stability we were used to. don’t’s when paying in cash. It is in the neighborhood of $10,000, so it is a lot of cash to carry around. I really just want to be aware of any pitfalls or ‘gotchas,’ and make sure I am protected in case of any dispute. Answer: There are a couple of things working in your favor. The first is that you like the contractor; the second is that he comes recommended. You need a contract in any case, whether you pay him in cash or not, and you should not give him all of it up front. The best way is to agree contractually to release an agreed-upon amount periodically for work completed to your satisfaction, with the largest payment to come at the successful completion of all the work. Make sure you get a receipt signed by him for the amount you provide. If he uses subcontractors and he wasn’t on the upand-up, he might tell them you didn’t pay him and they could put a mechanic’s lien on your house for the amount he owes them, or not finish the work. I am wondering why he wants the money in cash, as I imagine you are. The cynical in the audience will suggest that he is trying to put something over on the government — federal, state or local — either in taxes or permits. I doubt that you would be considered a party to this deception, especially if you have a contract stating that the payments were to be made in cash in return for $400 off, but I’m not a lawyer so I’m not providing legal advice — just my thoughts.

R-22 is ozone depleting and has been phased out in favor of replaced by environmentally friendlier R-410A. » Is your outside compressor unit free of debris? Many times leaves and grass clippings can get stuck on the coils and restrict airflow. This causes the unit to work harder and ends up costing you more money. » Invest in a programmable thermostat. Why pay to cool the house when you aren’t home? Programming the thermostat around your schedule can save hundreds of dollars a year. » Know the right questions to ask a contractor. ANSWER: This is a nightmare that more people are starting to face. When you lost your home two years ago, your line of credit, which is really a second mortgage, was not paid off because there was not enough value in your property to cover it

in the foreclosure sale. That loan has sat out there, and now your lender has decided to sue you to recover the money that you borrowed. A mortgage loan is made up of two components: the promissory note and the mortgage. The note, or credit agreement in your case, is the

bank lending you money. The mortgage is the document in which you pledged your home as collateral to the lender to secure repayment of the money. Now the collateral, or your home, is gone, so the mortgage is useless — there is nothing for the bank to take back — but the loan still exists and

Don’t Get Caught in Trap of Unlicensed Contracting The Consumer Federation of America (CFA) and North American Consumer Protection Investigators (NACPI) partnered to conduct a survey to study consumer complaints for 2011. No. 3 on the list of most frequently-cited complaints was “home Improvement and construction” which was further defined as “shoddy work or failure to start or complete the job.” Unfortunately, that same complaint is the second fastest-growing of the “worst complaints” of consumers, earning that dubious distinction because of the dollar amounts involved and the impact on particularly vulnerable consumers. I am not here to defend any subpar work on the part of any contractor but I strongly suggest that the results of this survey underline a problem that haunts builders, remodelers, and consumers… and that is the statewide, perhaps nationwide, epidemic of unlicensed contracting. The Tallahassee Builders Association and the Florida Home Builders Association are working hard to reduce or eliminate unlicensed activity and I’m confident you’ll see our industry support a bill in the 2013 session of the Florida Legislature to increase policing and penalties for unlicensed contractors. In the meantime, consumers need to do their part in two ways. One, make sure you deal with licensed, reputable contractors… and you’ll find plenty of them within the Tallahassee Builders Association, and easily accessible at www.tallyba.com or by calling 385-1414. Two, understand the preventive action you can take to avoid the serious problems related to unlicensed contracting. For example, before you hire any contractor, ask to see a copy of their state-issued license. Contractors must have a state license and the proper workers

compensation and liability insurance to perform any roofing repairs/replacements, additions, HVAC repair/replacements, plumbing work, electrical work or swimming pool repairs; these jobs typically require a permit. Be sure to sign a contract before any work is performed and be certain your contract contains the contractor’s name, street address, telephone number and state license number. Be aware that unlicensed individuals often: • Target the uninformed, inexperienced as well as the elderly. • Solicit door-to-door, frequently traveling in unmarked trucks and vans. • Can provide work more cheaply than licensed contractors. • Provide a post office box instead of a physical address. • Convince you to obtain the building permit. If you contract with a person who does not have a license, warranties for items installed are not usually honored by an unlicensed individual. In addition, City and State agencies/boards may be unable to assist you with any financial loss that you sustain as a result of your complaint; your only remedy against an unlicensed contractor may be in civil court. Educate yourself, become an informed consumer and protect yourself from dishonest persons who will use your misfortune to their advantage. your lender has the right to sue you to get a judgment against you. Think of it as your friend lending you $10 to buy a hamburger and fries. Now it’s next Tuesday, and your friend wants her $10 back even though all that remains of your lunch is the lingering memory of it. I encourage you to try to negotiate with your lender to take less than what is owed. Lenders often will take pennies on the dollar to settle this sort of debt. Q: I am confused as to what defines the deficiency amount in a short sale. If $116,000 is the balance left on a mortgage and a short sale of $120,000 is accepted by the bank, is there still a deficiency? If so, how is it figured? — Henrietta

A: In a short sale, the deficiency refers to the amount remaining owed to your lender after the closing. In your example

of a $120,000 sale price, the bank may have received only $106,000 after paying for real estate agents and closing costs, in which case the remaining deficiency would be $10,000. In a foreclosure, the “deficiency” is the amount that is awarded to the lender on the final judgment, which includes not only the remaining principal due to your lender, but also attorneys’ fees, court costs, interest and the like, minus the actual market value. Regulator rejects lower rates WASHINGTON — After a lengthy review, a key federal regulator said this week he would not allow Fannie Mae and Freddie Mac to lower the amount some underwater homeowners owe on their mortgages despite new financial incentives from the Obama administration. Detailed analysis has determined that principal reductions would cost taxpayers money and would not clearly improve the ability of homeowners to avoid foreclosure, said Edward DeMarco, acting director of the Federal Housing Finance Agency. The agency oversees Fannie Mae and Freddie Mac, the housing finance giants that were seized by

the government in 2008 as they teetered on the brink of failure. The Obama administration, Democratic officials and housing advocates have been pressuring DeMarco to allow Fannie and Freddie to lower the principal for underwater homeowners as a way of reducing foreclosures. Fannie and Freddie own or back about 60 percent of all mortgages. Some have called for Obama to fire DeMarco because of his refusal to allow Fannie and Freddie to reduce principal. But DeMarco has steadfastly refused out of concern that it would increase the cost of the taxpayer bailouts of Fannie and Freddie.

The sight of a tankful of tilapia gobbling the food he’d given them made Scott Geistweite smile. Every day, the Akron, Ohio, resident checks and feeds the fish in an aquaponics system at Bridges, a vocational center for adults with developmental disabilities. In the seven months he’s been helping to maintain the foodgrowing system, Geistweite’s verbal skills have skyrocketed, said Laura Gerlich, Bridges’ director. It’s just one of the unintended benefits that have been reaped along with the beans and salad greens since Bridges started getting its clients involved in gardening. Bridges is operated by Ardmore Inc., an agency that serves developmentally disabled people in Summit County, Ohio. The center provides recreation, continuing education and vocational training, and recently it’s added gardens, an aquaponics system and chickens to the mix. Ardmore bought the property last year with the intention of using its 10 acres for gardening. When it hired construction company F.G. Ayers Inc. to renovate the building’s interior, the project got an extra boost. As it turns out, Ayers’ president and office manager, Lance and Cheryl Schmidt, are sustainability advocates. The Schmidts suggested the aquaponics system, a setup that combines hydroponic gardening and raising fish in a mutually beneficial arrangement. grow under lights in a soilless medium. Fish waste in the water supplies nutrients that fertilize the plants, and in turn, the plants and the pebbles they grow in clean the water before it’s returned to the tank. The system was installed in late December and has been “very engaging” for the clients, who are often eager to show visitors what they’ve grown, Cheryl Schmidt said. One of those whose attention it captured was

Geistweite, who has autism. The sound of water trickling into the tank calms him, Gerlich explained, and the job of monitoring and feeding the fish has developed his sense of responsibility. The aquaponics system is growing crops chosen by the Bridges participants — jalapeno peppers, chives, carrots, spinach and several types of lettuce. A salad they made from the first lettuce harvest was gone in minutes, Gerlich said. The center also put in a corn patch, three small raised beds for tomatoes and herbs, and a bigger vegetable garden that’s producing an assortment of edibles, including beans, radishes, lettuce, tomatoes, zucchini, squash and Swiss chard. And in March, Bridges welcomed10 Golden Comet chicks, which have since grown into hens. Many of the clients love holding the gentle birds, and some have even taught them to jump for treats of lettuce. The Bridges participants think of the chickens more as pets than as farm

animals, which makes Becky Lemasters, the agency’s executive director, glad they’re being raised just for eggs instead of meat. When the first egg was laid about a month ago, all the clients wanted to watch. “I felt sorry for the poor chicken,” Lemasters said with a smile. In addition to the Schmidts, Bridges got help from employees of Keller Williams Realty, which spent a day in May doing such chores as helping to plant and fixing up a shed that’s being converted to a chicken coop. The Henry Bierce Co. donated seeds. Now participants who choose to work in the gardens are learning to care for the plants, skills they might be able to turn into jobs someday. Client Romalle DeShawn Green of Akron walked carefully between the rows of bean plants as he searched for weeds to pull. “I learned it’s a lot of responsibility,” he said. It’s important not to trample the plants, he explained, “and you gotta water them real good.”

His fellow gardener, Chris Benedum of Barberton, said he’d done a little gardening at home with his mother, but nothing so extensive. Benedum wasn’t as eager to taste the fruits of his labor as some of his fellow Bridges participants, but he said he’d probably try some of the crops. “I’m not a big vegetable fan,” he admitted, “but maybe I’ll get used to it.” The project has proved therapeutic for the participants, many of whom have autism. The deep pressure involved in the pushing and pulling motions of gardening is calming, Gerlich explained, and the outdoor work and repetitive motions are also beneficial. Those with attention deficit disorder can often focus better in the garden than they can indoors, she

said. The work helps relax them, enhancing their capacity for learning and giving leaders an opportunity to model appropriate behavior and interaction in a nonthreatening environment, Gerlich said. Many of the participants find it easier to converse with others when part of the brain is engaged with gardening tasks, she explained. Besides, gardening is just fun. “Our folks are so eager and interested in it,” Lemasters said. For now, the program is an experiment, “our ‘let’s get our feet wet and see if we could do it’ year,” Gerlich said. Bridges hopes eventually to develop the program into a bigger vocational venture, perhaps growing crops to sell at farmers markets or supplying food to Ardmore’s group homes.

Has anyone told you about the vet bills, shoeing costs, trailer and gas costs, feed costs, hay costs, bedding costs and the thousands of hours it will take you to properly maintain this animal? Well, we will leave that part up to your friends who love every second of having horses, and we will stick with the relevant topic of land for horses. Here is a list of common questions asked by potential horse owners regarding the appropriate amount and type of land for maintaining a horse. There can be many variables relating to these situations, but we will keep the answers as simple as possible. 1. How many acres per horse does one need to have? The rule of thumb is one acre per horse if you want grass to be a part of the horse’s diet. They will still need supplemental grain and hay, depending on how you intend to use the animal. It is a good idea to have a small area — a shed or barn — where a horse can go for shade and to keep dry. Sometimes having a big group of trees will work for shelter, but when they are not available, we need to provide something to protect the

horse from the elements. 3. What kind of land is good for a horse? Land for horses’ use must be free of any kind of debris, such as trash, tractors or wire. Horses are not the smartest of animals and when potentially dangerous things are lying around, they will get tangled in wire or cut by loose metal and can get seriously hurt. The land must be mostly dry. If horses stand in water for any period of time, their hoofs will be vulnerable to disease. As relates to lay of the land for horses, it is best if it is flat or rolling terrain. 4. Can a horse be alone on a property? Horses can be alone, although they prefer the company of another animal such as a pony, goat

or another horse. They do not need a person to be there emotionally, unlike our best friend, Rover. However, they do need to be checked on regularly.

5. How do I need to fence my property for a horse to be safe? A 3- or 4-board or the new composite fencing that looks like wood is the

best thing to use. The smaller the enclosure, the sturdier the fence should be. 6. How do I know it is OK to have a horse? Above everything else, before you think of bringing a horse on your property or purchasing a property for an equestrian purpose, check the neighborhood, development, or land convenants and restrictions, as well as the zoning to make sure horses are allowed and welcome. Also, if you are planning to ride regularly, check to see if there are places to ride near you, such as the Miccosukee Greenway. We are very fortunate in Tallahassee to have several greenways and other places in the area that welcome

horses on their trails. I hope this helps all those potential horse owners out there. My last word of advice is not to take owning and providing for a horse lightly. However, if you get bitten by the horse bug and decide to go forward, that interest never goes away and you will never be sorry. I have ridden since I could walk; my parents said I would outgrow it and, without revealing my age, I love horses and the surrounding activities as passionately as ever. Good luck and happy trails.

Try these tips for cleaning household items By John Shultz McClatchy Newspapers

You keep a pretty clean home. Sure, sometimes your rigid cleaning schedule has to bend here and there to accommodate life, but your house/apartment/condo stays pretty darn tidy. You clean all the usual suspects: kitchen sinks, counters and floors. Bathroom countertop, toilets, showers. You vacuum the carpets, dust the furniture, and maybe even hit the blinds and curtains now and then. Good to go? Maybe, maybe not. There’s a whole host of everyday objects and high-use home appliances that may get overlooked during cleaning jags. And failure to be a completist can cost you in terms of appliance and electronic performance, allergy attacks and general hygiene.

Toilet brushes Difficulty: Minimal. Some grossness factor, though. You religiously clean your toilet, because, y’know, ewww. But do you make sure to clean the mechanism that cleans the toilet? “Your toilet brush should be cleaned every time you use it,” cautions Shana Cowart, area district customer service trainer with Bed Bath & Beyond. “Rinse it after every use and replace the head when needed.” Not doing so could mean growing a little Petri dish of germs in the corner of your bathroom.

Ceiling fans Difficulty: Varies, from rather simple to a little bit complex. Fans pose a little bit more of a challenge than toilet brushes because they’re less accessible.

That being said, “if you stay on top of keeping ceiling and attic fans clean, it’s a pretty easy process,” says Bryan Dunning, assistant store manager of the Lowe’s in Gladstone, Mo. Ceiling fans are rather simple, though you may need a long duster or stepladder to really get the job done (“with a vaulted ceiling, it may not be as feasible,” Dunning said). The key is dedication. Hit the ceiling fan blades with disposable dusting pads every couple of weeks, and you should be fine. Naturally, if you wait significant stretches between cleanings, expect a lot of dust falloff when

you finally do get around to it. For $3 a pack, you could also invest in a filter that sits on top of the blade, but cleaning is still recommended, Dunning said.

Keyboard and mouse Difficulty: More timeconsuming than you might think, especially if you eat near your computer. A quick rule of thumb from Jennifer BraniffHarmon, local covert operations agent with Best Buy’s Geek Squad, when it comes to cleaning tech equipment: “You don’t have to overspend on

cleaning products, as most devices can be cleaned with common household ingredients. Eyeglass cleaning wipes are cheap and contain rubbing alcohol for sanitizing, making them my favorite for cellphone, keyboard, headphone and monitor cleaning.” And the computer keyboard (and sometimes mouse) “are some of the dirtiest gadgets in your tech lineup.” Braniff-Harmon recommends sanitizing after any illness or at least every three months. If you eat near your keyboard and it’s growing fairly crumby, take care of it sooner. Crumbs in the

keyboard can cause damage. With the computer itself, it’s important to keep it relatively free of dust. But so not vacuum inside your computer, Braniff-Harmon said. “Static electricity caused by vacuuming .. can cause serious damage.” Go with compressed air instead.

Earbuds Difficulty: Varies based on use and your fine motor skills. Just because your headphones aren’t typically subject to public scrutiny doesn’t mean they don’t need the occa-

sional once-over. “Earwax can interfere with the sound quality of your earbuds, so I recommend cleaning them whenever you see the buildup,” said Jennifer Braniff-Harmon, local covert operations agent with Best Buy’s Geek Squad. “If you are able to remove the plastic bud, you can get a more complete clean inside the ‘canal’ with a cotton swab where the buildup can really affect quality.” If the gunk is particularly resistant to cleaning efforts, the detached buds — not the actual speakers — can be given a soak in a light mix of water and dish soap, she added.

Code Enforcement and the Property Manager by Harry Anthony Heist, Attorney at Law

There will come a time when the property manager and/or owner of the property receives a notice of a code violation from the municipality where the property is located for something the tenant is either doing or not doing. This may be for something as simple as parking on the lawn, failing to cut the lawn, or not taking in the garbage receptacles from the street in a timely manner. The violations could be more serious, such as failing to maintain the exterior of the property, engaging in a business activity, or allowing mountains of personal property or debris to accumulate on the front lawn. How the property manager deals with the issue can make the difference in the property owner receiving a fine or notice of hearing, or instead getting a serious break cut for them by the code enforcement official. The key is the property manager must deal with the problem, deal with it swiftly, and keep code enforcement fully aware of the actions which are being taken to rectify the situation. The Catch-22 is that the time period for compliance given by code enforcement is seriously at odds with the actual time it can take to get compliance or eventual removal of the problem tenant. The Property Owner Receives Notice Usually, the property owner will receive notice by mail at the address that code enforcement has for the owner. This is usually the address where the tax bills are sent. The owner may live in a distant state or be absent on vacation when this letter arrives, and there is thus a major delay in word of the problem getting to the property manager. This is the first in a series of problems that can occur. The Property Manager is Notified Once the property manager is notified, action needs to be taken immediately. There will most likely be a time deadline which may be close to passing, or in some instances has already passed. This is when the property manager must immediately notify the code enforcement officer by phone and in writing, acknowledging receipt of the citation and expressing a strong willingness to deal with the problem fast. Can the problem be solved immediately? If the situation can be solved immediately, for instance by having a lawn person go out and immediately cut the lawn, this should be done, and the tenant should be billed for the expense incurred. If getting compliance requires the property manager do any self-help removal of the tenant’s personal property, the property manager should NOT attempt this at all. Self-help removal of items or the towing of vehicles can lead to serious litigation. If the property manager cannot easily rectify the problem, a dialogue must be opened with code enforcement. Communication with Code Enforcement The property manager should call code enforcement immediately to see exactly what the problem is. Often the citation is vague in describing the offending activity or condition, and this will allow the property manager to get a better idea of what exactly is wrong and what needs to be done. By calling

immediately, the property manager can explain to the code enforcement officer that she is on top of the problem and will be taking every legal step possible to rectify the problem. Most code enforcement officers will appreciate the call and indicate to the property manager that the main purpose of the citation is to get compliance, rather than impose fines or other penalties. The property manager will then be led to believe that the code enforcement officer is a nice person and that there is an actual extension given. It may be a correct assumption that the code enforcement officer is indeed going to work with the property manager and give an extension of time to deal with the problem, but can the property manager be sure? Did the Property Manager Get an Extension of Time? The property manager immediately will serve the tenant a Seven Day Notice of Noncompliance with Opportunity to Cure, which probably is the proper notice to be given in most code violation situations. Your attorney can assist you here. Will the code enforcement officer sit back and wait? We are not sure. Next week, there may be another code enforcement officer assigned to the case, as the original one is on vacation. Was the extension properly communicated? Did the property manager get something in writing, or will he or she simply depend upon the phone conversation with code enforcement, one of many phone conversations the code enforcement officer had that day among many other people? We recommend that you immediately follow up any phone conversation with a letter to the code enforcement officer by regular mail and certified mail such as this: Dear Officer Smith: Today I received the notice of violation on 125 Main Street and will be taking immediate action. As per our phone conversation, you have agreed to hold off on taking further action against the property owner during this process. We have contacted our attorney and have served the tenant with a Seven Day Notice of Noncompliance with Opportunity to Cure which is attached to this letter as “Attachment #1”. This is required by Florida law before we can terminate the tenancy, if he or she fails to cure the problem. If the problem is not cured within seven days, we are required by law to serve a Seven Day Notice of Noncompliance Notice to Terminate. Once this notice expires, we can then begin an eviction action, which takes between 20 and 45 days on average. Please use me as your contact person, as I am the person directly responsible for managing the property. My phone number is 555-1212. I will be doing everything legally possible to either get compliance or have the tenant removed. Please feel free to call me or my attorney at 555-1313 if you have any questions about the progress or the procedures which the Landlord/Tenant Act requires.” The result of such communication will usually buy extra time for the owner of the property. Code enforcement often has no idea how the compliance and eviction process occurs, and they need to not only be informed of the procedure to understand your dilemma, but keeping them informed of the progress will help insure a cooperative experience with code enforcement and help in future occasions when another one of your tenants may be in noncompliance. Developing a keen and cordial working relationship with code enforcement is one of the traits of a successful and effective property manager.
