Be wary of keeping would-be buyer’s deposit By Gary M. Singer Fort Lauderdale Sun Sentinel

QUESTION: I am selling my vacant house “as is,” and the buyer never had an inspection done. At the walk-through yesterday, he could not get the air conditioner to work. Now he insists that I give him a credit to get

the A/C replaced, or he will cancel the contract. Can he do this? — Art ANSWER: Not unless you let him. Typically, in an as-is deal, the buyer will get a short period of time to get inspections done and to do his due diligence on the property. During this inspection period, if the buyer is not

happy with the house, he can cancel the contract and receive his deposit back. After this period ends, the contract “goes hard,” meaning that the buyer will lose his earnest money deposit if he does not close. In your case, it sounds as if the buyer has missed his chance to

cancel the contract and still get his deposit back. If he does not close, you can keep his deposit. But before you do this, think about the potential consequences. You should consider how much the deposit is, how much the A/C repair will cost and how long it will take to find another

Q: I am curious about purchasing property at foreclosure sale. It seems too good to be true that you can get a house for just a few thousand dollars this way. Is it? — Kathy A: Yes, it is often too good to be true. When you purchase a home from a foreclosure auction you get the title to the home, subject to any problems that may be attached to the house, and you also get the house in the physical condition that it is in. This means that you will have to clean up the house and deal with any code enforcement matters with the city. lien is foreclosed, it can only foreclose out other liens that are subordinate to it. For example, if the lender is foreclosing its second mortgage, the first mortgage will still be a valid lien against the property. Further, if the lender misses or otherwise does not sue another lien holder, that lien will also still be against the property. All of this means that when you purchase a property at a foreclosure auction for a very low price, it is probably that way for a reason. It is very important that you thoroughly research any property so that you don’t end up buying a problem.

Author John Lescroart, another longtime friend, calls the garden “simply stunning” and adds, “It is perhaps the most impressive private garden planted anywhere in California in the past decade – or more.” The son of an Indian father and British mother, John Poswall moved from England to Marysville when he was 10 years old. Growing up, he picked fruit along with his parents. A graduate of California State UniversitySacramento, and Cal’s Boalt Hall law school, Poswall found success beyond his dreams. He bought the property about 20 years ago after he was diagnosed with leukemia. His cancer remains in remission. His gardens are a return to nature. The latest addition to their wonderland is a spectacular cross-cultural Asian blend named “Yu Shan Hua Yuan,” the Garden of Mountain Happiness. More than 300 friends and fellow garden lovers recently celebrated its dedication. “It was two years in the making,” Poswall said. “But of course, it’s not done.” China is just one stop on the Poswalls’ world tour. An Italian garden – complete with bocce court – traces its roots to a vacation in Tuscany. Grapevines cover a large arbor over a 17-foot-long dining table made from a single plank of roughhewn redwood. “Tequila Hill” is covered with 800 agaves, grown from a single plant. Nearby, Mexican fan palms shade succulents and cactus in a homage to the Southwest. On the pond, a rowboat lazily floats among the water lilies in a scene straight out of a French impressionist painting. Below the tower, more

Most travelers bring home souvenirs. In their globe-trotting, John and Peg Poswall collect ideas, then transplant them to their home and gardens. “We see something we like and we think, ‘We could do that,’ ” said John Poswall, as he surveyed the view from his turret. “And we do.” That’s why their home – nicknamed “Toad Hall” – looks like a castle, complete with a 40-foot circular stone tower. Inside the tower is a circular library packed with thousands of books. With a nod to Poswall’s native England, the house has its own Stonehenge, overlooking a wellstocked 5-acre pond. Nearby are massive Chinese gates, the entrance to his newest creation. “When I bought this property, I wanted a view and a pond,” he said. “I got both.” Their view now includes bits of Europe, Mexico and Asia, woven together with whimsy on

50 oak-studded acres in the hills outside Lincoln, Calif. Poswall calls his creations the “Gardens of Springhill.” So far, he has 18 gardens, all pulled from farflung inspirations. “They’re not meant to be faithful reproductions or replicas, but were inspired by these other places,” he said. Most of the work Poswall did himself, often starting without a plan on paper, but just an idea. The gardens fit together in a colorful and surprising patchwork. “In the evening, Peg and I sit out here on the deck and say, ‘Can you believe we have this?’” Poswall said. Among Sacramento’s best-known attorneys as well as a novelist, Poswall created his own retreat full of fun and memories. Peg Tomlinson Poswall is a renowned food expert, writer and former restaurateur. Together, they love to entertain. “We like putting people around a table, talking and having a good time,” said Peg, while stirring a large pan of tomatillo sauce for a taco party.

Experts: Homebuyers want more for less By Al Heavens The Philadelphia Inquirer

What does today’s homebuyer want? That insight is more critical than ever, given six years of a real estate downturn that has flooded the market with foreclosures and cost homeowners billions of dollars in lost equity. The simple answer, according to the real estate search engine Home.com is this: a four-bedroom, three-bathroom “family oasis.” Of Home.com’s database of 2,000 home seekers, 455 responded to the question. More than half opted for a detached, sin-

gle-family house in the country, with three bathrooms and an ideal size of 2,001 to 3,000 square feet of living space. Sought-after rooms? Screened-in porches, basements, sunrooms. Desired amenities? Walk-in closets, en suite bathrooms, fireplaces. Outdoor must-haves? Decks, swimming pools, patios. As Gopal Ahluwalia, former director of research for the National Association of Home Builders, observed about the trends he witnessed in more than 30 years on the job, buyers “want to have everything but can’t afford it.” Before the housing

bubble burst, buyers believed that home prices and personal incomes both would continue to increase, meaning that they could buy more than they could afford and everything would be OK. Instead, prices began a free fall in 2006 that has slowed but not stopped. According to the S&P/ Case-Shiller indexes, home prices today are about where they were in 2003. And income? In September, the Census Bureau reported that median household income had fallen 2.3 percent, to $49,445, in 2010, and that it had dropped 7 percent since 2000 after adjusting

for inflation. Income was the lowest it had been since 1996. The result? Record foreclosures – 4.3 million since 2007 – as buyers who stretched to the limit, taking on excessive debt in the belief that increasing home values would cover it, lost the bet. With all this in mind, one might think the houses being built today would be smaller, that those 2,001- to 3,000square-foot homes sought by respondents to the Home.com survey were the stuff of, well, dreams. Yet Bloomberg News recently reported that slightly more than one in four houses built in 2011 ex-

ceeded 3,000 square feet – the highest percentage since 2007. Better Homes & Gardens magazine, the nation’s home builders, and ImprovementCenter.com, a remodeling website, have contrary opinions, though. Jill Waage, Better Homes & Gardens’ content director, took responses from 4,000 of the magazine’s subscribers who identified themselves as prospective home buyers or those planning major home improvements. Space and how it is used remains important, she found. But with cost in mind, readers who responded reduced

Code Enforcement and the Property Manager by Harry Anthony Heist, Attorney at Law

There will come a time when the property manager and/or owner of the property receives a notice of a code violation from the municipality where the property is located for something the tenant is either doing or not doing. This may be for something as simple as parking on the lawn, failing to cut the lawn, or not taking in the garbage receptacles from the street in a timely manner. The violations could be more serious, such as failing to maintain the exterior of the property, engaging in a business activity, or allowing mountains of personal property or debris to accumulate on the front lawn. How the property manager deals with the issue can make the difference in the property owner receiving a fine or notice of hearing, or instead getting a serious break cut for them by the code enforcement official. The key is the property manager must deal with the problem, deal with it swiftly, and keep code enforcement fully aware of the actions which are being taken to rectify the situation. The Catch-22 is that the time period for compliance given by code enforcement is seriously at odds with the actual time it can take to get compliance or eventual removal of the problem tenant. The Property Owner Receives Notice Usually, the property owner will receive notice by mail at the address that code enforcement has for the owner. This is usually the address where the tax bills are sent. The owner may live in a distant state or be absent on vacation when this letter arrives, and there is thus a major delay in word of the problem getting to the property manager. This is the first in a series of problems that can occur. The Property Manager is Notified Once the property manager is notified, action needs to be taken immediately. There will most likely be a time deadline which may be close to passing, or in some instances has already passed. This is when the property manager must immediately notify the code enforcement officer by phone and in writing, acknowledging receipt of the citation and expressing a strong willingness to deal with the problem fast. Can the problem be solved immediately? If the situation can be solved immediately, for instance by having a lawn person go out and immediately cut the lawn, this should be done, and the tenant should be billed for the expense incurred. If getting compliance requires the property manager do any self-help removal of the tenant’s personal property, the property manager should NOT attempt this at all. Self-help removal of items or the towing of vehicles can lead to serious litigation. If the property manager cannot easily rectify the problem, a dialogue must be opened with code enforcement. Communication with Code Enforcement The property manager should call code enforcement immediately to see exactly what the problem is. Often the citation is vague in describing the offending activity or condition, and this will allow the property manager to get a better idea of what exactly is wrong and what needs to be done. immediately, the property manager can explain to the code enforcement officer that she is on top of the problem and will be taking every legal step possible to rectify the problem. Most code enforcement officers will appreciate the call and indicate to the property manager that the main purpose of the citation is to get compliance, rather than impose fines or other penalties. The property manager will then be led to believe that the code enforcement officer is a nice person and that there is an actual extension given. It may be a correct assumption that the code enforcement officer is indeed going to work with the property manager and give an extension of time to deal with the problem, but can the property manager be sure? Did the Property Manager Get an Extension of Time? The property manager immediately will serve the tenant a Seven Day Notice of Noncompliance with Opportunity to Cure, which probably is the proper notice to be given in most code violation situations. Your attorney can assist you here. Will the code enforcement officer sit back and wait? We are not sure. Next week, there may be another code enforcement officer assigned to the case, as the original one is on vacation. Was the extension properly communicated? Did the property manager get something in writing, or will he or she simply depend upon the phone conversation with code enforcement, one of many phone conversations the code enforcement officer had that day among many other people? We recommend that you immediately follow up any phone conversation with a letter to the code enforcement officer by regular mail and certified mail such as this: Dear Officer Smith: Today I received the notice of violation on 125 Main Street and will be taking immediate action. As per our phone conversation, you have agreed to hold off on taking further action against the property owner during this process. We have contacted our attorney and have served the tenant with a Seven Day Notice of Noncompliance with Opportunity to Cure which is attached to this letter as “Attachment #1”. This is required by Florida law before we can terminate the tenancy, if he or she fails to cure the problem. If the problem is not cured within seven days, we are required by law to serve a Seven Day Notice of Noncompliance Notice to Terminate. Once this notice expires, we can then begin an eviction action, which takes between 20 and 45 days on average. Please use me as your contact person, as I am the person directly responsible for managing the property. My phone number is 555-1212. I will be doing everything legally possible to either get compliance or have the tenant removed. Please feel free to call me or my attorney at 555-1313 if you have any questions about the progress or the procedures which the Landlord/Tenant Act requires.” The result of such communication will usually buy extra time for the owner of the property. Code enforcement often has no idea how the compliance and eviction process occurs, and they need to not only be informed of the procedure to understand your dilemma, but keeping them informed of the progress will help insure a cooperative experience with code enforcement and help in future occasions when another one of your tenants may be in noncompliance. Developing a keen and cordial working relationship with code enforcement is one of the traits of a successful and effective property manager.

During the boom, the average home size climbed to 2,500 square feet. The builders’ group projects that by 2015, the average new house will be about 2,100 square feet, and says its members point to these items high on today’s buyers’ lists: a walk-in closet in the master bedroom, as well as a separate shower and tub; energy-efficient appliances, lighting and windows; a linen closet; programmable thermostats; a great room; nine-foot ceilings on the first floor; a laundry room; and insulated front doors. Diane Williams, a veteran agent with Weichert Realtors in Blue Bell, Pa., said small houses are in vogue because of “heating costs and other things.” “They also don’t want (houses) too far, because of gas costs and long commutes,” Williams said, and “McMansions are not as popular.”

Four members of the Tallahassee Builders Association (TBA) will serve as mentors to hopefully the next generation of builders and trade professionals on Saturday, August 25 with an underconstruction home as the “classroom.” The program is known as Situational Environmental Circumstances (SEC) mentoring and is sanctioned by the National Association of Home Builders (NAHB) Home Builders Institute (HBI) training program tailored to young people considering careers in construction. Tallahassee builder Doug Barton of Barton Construction – the Best of Show winner in the TBA 2012 Parade of Homes™ – will host the event at a home in Southwood and will join a “faculty” that includes TBA Senior Officer Alan Weekley of Alan Weekley Homes, TBA builder Bill Kimberl of Kimberl Construction, and Dawn Davis of ABC Supply. Weekley and Kimberl were winners of TBA 2012 Remodelers Showcase Awards.

Ferns: Low-maintenance landscape The sturdy fern dates back to Mesazoic era By Cindy McNatt The Orange County Register

SANTA ANA, Calif. — So many of us have the wrong impression of ferns, including me, who thought that giant staghorns weren’t really ferns but some sort of epiphyte more closely related to bromeliads or tillandsia. Wrong, says Jim Boehme of The Fern Factory in Anaheim Hills, Calif. “Any plant that starts from spores is classified as a fern.” That includes the unfern-like staghorns, skinny horsetail and many other seemingly alien plants. Ferns are some of the oldest plants on the planet, dating to the Mesozoic era when dinosaurs roamed Earth. They were here millions of years before flowering plants. That is a testimony to how sturdy ferns really are. And unlike the rest of us, Boehme believes that ferns are some of the easiest plants to grow. Boehme got hooked on ferns 20 years ago when he tried to master the difficult task of spore propagation to reproduce his favorite, hard-to-find staghorns. That led to getting his hands on unusual ferns. Ultimately, Boehme got the hang of the technique that sometimes can take years before actual plants appear. And the demand for his ferns and staghorns just kept going. He quit his day job as a printer and began to supply plants full time to the landscape trade and on the Internet. “People don’t think of using ferns in their landscape, but they’re very easy to grow,” he said. Mostly it’s like this: “You plant a fern,” Boehme said. “What most people try to do is take care of them.” And that is where it all goes wrong. Boehme grows hundreds of ferns in his Anaheim Hills land-

scape. He amends the soil before planting with peat moss and compost. He plants. He waters lightly every day. And he alternates his yearly mulch with fine bark one year and peat moss the next. That’s it. And that’s really easy. Boehme recommends most exotic ferns over natives that he said are a bit fussier. Silver lady is his most popular. Woodwardia is a native that is easy. Boehme recommends growing leatherleaf fern for anyone

who makes floral arrangements. “It’s the same fern that florists use,” he said and it grows like a weed in his landscape. The greenhouse is where Boehme propagates his most difficult plants, which can take four to five years to develop and need a constant watch. “There is no surefire way to propagate spores,” he said. Sometime Boehme gets plants and sometimes he doesn’t in exactly the same growing conditions.
