Memories of columns past came to mind as I read the Consumer Reports latest CFL-versusLED lightbulb study, available in complete form in its October issue. Longtime readers may recall that I asked for
feedback a couple of years ago on CFLs and received more than 1,000 emails from around the country. Consumer Reports says the biggest beef people have with CFLs and LEDs is the price, with 23 percent of those surveyed stating that they cost too much.
CFLs can take minutes to achieve full brightness compared with LEDs that brighten instantly, but in tests, one LED was dim and emitted a ghastly, bluish light color, and others couldn’t cast light in all directions. Consumer Reports has identified four lightbulb letdowns and ways to pre-
vent them. Dim bulbs – Opt for more lumens. Check the lighting facts label on the packages of CFLs and LEDs for the number of lumens. The higher the lumens, the brighter the bulb. Weird light color – Choose the right Kelvin (K) number. Light color is

expressed by its Kelvin temperature. The higher the Kelvin number, the cooler the light. Those wanting to trim electric bills who prefer the warm light of an incandescent should choose a CFL or LED marked 2700K or so on the lighting facts label. Unflattering light – Choose bulbs with a higher CRI. When the colors of things look off, find out the color rendering index of the lightbulbs. CRI indicates how accurately a lightbulb displays colors, and the higher the better. Incandescent bulbs are at or near 100; most CFLs and LEDs Consumer Reports tested are in the lowto-mid 80s. Early burnout – Return the bulb to the retailer or contact the manufacturer. You may need the model number or UPC and a receipt. And when buying replacements, be sure the bulbs can be used in existing fixtures. Putting a CFL or LED in an inappropriate fixture can shorten its life. Q: Every year wasps and hornets come into our house. We tried putting a screen on the chimney and sealing the recessed lighting, but they still come. An exterminator sprayed the perimeter of the house and bombed the attic with pesticide, but how do we find the source? A: Do more of this kind of chemical warfare inside and outside of your house, and wasps and hornets will be the least of your worries, I guarantee. A more direct approach is to locate the nests of these creatures – paperlike and made from chewed wood products mixed with wasp saliva – found under eaves and alcoves, in trees and bushes and on sides of the building. I find one or two every year, usually underneath the eaves on the sunny
side of the house. I deal with my own, but I recommend hiring a professional who will spend some time locating the nests and taking care of them with precision rather than area bombing. Yellow stains – I get email periodically from readers who have lifted throw rugs from flooring only to find yellow stains where the carpeting has been sitting. In some cases, there is no cure. Bernadette Chupein seems to have found a solution, although the reason behind it eludes her. “I also had a yellow stain caused by a mat in front of a double slider door in the kitchen. I removed the mat, but did not replace the flooring, which is a grey-and-white swirl design vinyl. “Within several weeks, the stain disappeared. I can only assume it was the sun coming through the glass that caused this. One thing you learn in this job is sometimes there just is no answer.

from Connecticut to enjoy their golden years. But when Joseph got sick and died, Marie, 75, realized she could not afford the two-bedroom manufactured home the couple had bought in Deerfield Beach in 2005. Now, instead of enjoying shuffleboard and card games in her senior com-
munity, she’s fighting off foreclosure. “I cry every night when I go to bed,” Ginise said. “You work for something your whole life and then it doesn’t turn out like that at all. I don’t know if I’m here or there.” Marie Ginese is among the older Americans who

»About 3.5 million loans held by people over age 50 (or 16 percent of all loans for that group) were underwater as of December 2011. »The percentage of seriously delinquent mortgage loans increased from 1.1 percent in 2007 to 6 percent in 2011 for people 50 and older. »The foreclosure rate for people 50 and older also increased, from 0.3 percent in 2007 to 2.9 percent in 2011. “It’s like the end of the American Dream for them,” said Gladys Gerson, a supervising attorney for Coast to Coast Legal Aid of South Florida. “They’re very embarrassed that they can't maintain their own home.” Max Rothman, president of the Alliance for Aging in Miami, said he is seeing “more older folks calling in about various issues relating to financial insecurities. It’s a symptom of the times.” Older Americans are struggling to make ends meet on nest eggs earning paltry returns, but the underlying factors of the mortgage crisis began long before The Great Recession. As housing prices soared, older homeowners took home equity loans and second mortgages on their houses, just as their younger counterparts did – but with less time to weather the financial storm if the monthly payment became unaffordable. “If you’re 65-plus, it’s not like you can take a second job to make the payments,” said Debra Whitman, AARP’s executive vice president for policy. “Your income just doesn’t change much. You have a lot fewer options.” The AARP report noted that older Americans are carrying more mortgage debt than ever be-
fore. This spells trouble because home equity has often been used to help pay for medical bills or supplement fixed incomes later in life. Gerson, of Coast to Coast Legal Aid, which represents low- and moderate-income Broward County residents, is defending Marie Ginise in foreclosure proceedings. Gerson said there are hundreds of seniors like Ginise who are behind on their mortgage payments – with no hope of catching up. “They get further and further behind.” The hardest hit: lowand middle-income seniors. According to AARP, older middle-class borrowers with incomes ranging from $50,000 to $124,999 accounted for 53 percent of foreclosures in 2011. Borrowers with incomes below $50,000 made up 32 percent of all foreclosures in that age group. “There are limited things they can do” in the case of a foreclosure, Gerson said. “If they’re lucky, maybe they move in with a relative or rent a room somewhere. But most fear that they’re going to be stuck in some institution at the end of their years.” Though she’s hopeful that the lender will reconsider the foreclosure, Ginise worries about where she will live if the lender refuses to modify her loan. She had already asked the company for a break when her husband got sick in 2007. At the time, the lender agreed to lower monthly payments, but did not reduce the loan. When her husband died in May 2009, the lender demanded she pay what was owed over the two years of reduced payments. She couldn’t afford the sum then, and she can’t afford it now.

QUESTION: I want to know if the “transaction fee” being charged by my real estate agent is a legitimate cost. I have spoken with three different agents, and they all insist on charging me this fee in addition to a 6-percent commission. Do I have to pay it? – Richard ANSWER: Real estate agents can charge any reasonable fee for their services, whether it is 4, 6 or 9 percent or a flat fee. While 6 percent is normal for most residential transactions, there is nothing stopping an agent from charging a different amount if you agree to pay it. The same logic also applies to the transaction fee, which is also called a “compliance,” “administrative” or “processing” fee. Most of the time, the extra charge (about $500 or so) is just more commission, rather than a fee for additional work. If you agree to pay it, fine. But you can object and have the agent remove the fee from the closing documents if it wasn’t previously agreed to. Most experts insist that the additional fee can be charged as long as it is fully disclosed in a way that is not misleading and is reasonably priced for the actual services performed.

Tampa-based DeBartolo Development LLC has acquired the 122room Hampton Inn & Suites at 3388 Lonnbladh Road in Tallahassee, the company has announced. Built in 2004, the Class A limited-service hotel is near Capital Circle Northeast and I-10. The Windsor/Aughtry Co. Inc. of Greenville, S.C., developed the hotel for AHG Hotels LLC. When a lease is signed by two or more tenants, what happens at the end of the lease when one tenant gives notice to the landlord that he or she will be vacating, and in fact does subsequently vacate? What if no notice is provided by one of the original tenants, but it appears that a particular tenant has clearly abandoned the premises some time during the original lease period? In either case, is the departing tenant still responsible for lease obligations beyond the original lease term? Is the landlord able to enter into a new lease with the remaining tenant(s) and/or replacement tenant(s)? What happens to the security deposit? The Landlord/Tenant Act neither contains any specific provisions governing a change in parties after the original lease period, nor does the statute specifically indicate that the security deposit “stays with the property”. If a month-to-month tenancy is created after the lease expiration date, a good argument can be made that all the original tenants are still financially responsible for the ongoing tenancy. However, some judges may not hold this view, particularly if the departing tenant gave written notice of vacating, and in fact vacated, prior to the original lease
change of parties from the original lease has occurred, and this is not a true “renewal” lease. If one of the original tenants has apparently vacated for good but never provided any notice, we advise landlords to be very careful before adding new parties to a subsequent lease. The landlord should be very clear that the original tenant is gone for good, and that none of that tenant’s personal property is still on the premises. At the point where the landlord contemplates a new lease involving a change of parties from the original lease, we recommend that a new security deposit be collected from the tenant(s) on the new lease, and that an accounting take place on the original security deposit consistent with Florida Statute 83.49, with any refund check made payable to all original tenants. If no new lease has been signed, but one or more of the departing tenant(s) from the original lease demand a return of the security deposit, we recommend trying to collect a new deposit from the remaining tenant(s) and making the accounting as described above. If the remaining tenant(s) are unwilling or unable to put up a new deposit, then we recommend non-renewing the existing month-to-month tenancy, and to then make an accounting for the deposit by following the provisions of Florida Statute 83.49 with regard to all tenants on the original lease.

It’s called a natural swimming pool or swimming pond, and it’s an idea that some in the industry believe will be the next big thing in health and environmental consciousness. Chlorine has long been the industry standard to keep pool water clean and clear, but consumer demand for alternatives has prompted the emergence of new technologies, including the saltwater systems that came into vogue a few years ago and the copper-and-silver ionization and ozone-gas systems that are increasingly popular. “I don't like the stuff that goes into swimming pools,” said Philip Daughtry, a Topanga Canyon poet who often swims in the koi pond he refers to as his “backcountry swimming hole.” Daughtry’s swimming pond was constructed by Environmental Sculpturing in Topanga Canyon, the outfit that also helped to design and install the Santa Monica pond being built in a Zen-influenced, minimalist style. Natural swimming ponds take many shapes. Some look like traditional pools with poured concrete foundations, hard edges and straight lines. Others take forms that more closely mimic nature, with gently sloping and planted edges. Natural swimming ponds are relatively new to the U.S., but more than 20,000 have been built globally, according to a spokesman for BioNova Natural Pools, a German company with North American headquarters

in New Jersey and three natural swimming pools built or under construction on the East Coast. “A lot of people are interested in leading a chemical-free lifestyle. We're not using any devices, sterilizers or chemicals of any kind,” said Alan Weene, spokesman for BioNova, which has partnerships to build natural swimming ponds in more than 30 countries. The BioNova system uses shallow- and deepwater plants in conjunction with filters to keep
the water clear. The system only works to a temperature of 86 degrees. BioNova pools, as well as those designed locally by Environmental Sculpturing, are biologically active. That means unlike chemically treated pools, which are sterile, natural swimming pools contain plants and beneficial microorganisms that outcompete algae and harmful bacteria for nutrients, leaving water safe for swimming. In these natural pools, water is circulated with pumps to pre-
vent mosquitoes from laying eggs. Although installation costs are slightly higher for a natural swimming pond compared with a traditional pool, the level of maintenance is roughly the same. Both types of pools require vacuuming and hand skimmers to pick off surface debris. Natural swimming ponds do not need biweekly visits from a pool professional to add chemicals, but they do require occasional weeding and replanting.

HACKENSACK, N.J. — After they moved to an Englewood, N.J., Tudor in the 1980s, Lorraine and Lewis Baer occasionally passed a large stucco house with a red tile roof on North Woodland Avenue. Lorraine would look at it and say, “That's the house I really wanted.” In 1991, she got her wish when the couple purchased the home from New York Cosmos soccer star Giorgio Chinaglia. The eight-bedroom house is an example of the Spanish revival style, which enjoyed a renaissance in the 1920s, especially in hot climates with a history of Spanish colonial settlement, such as Florida and California. The buildings are marked by stucco walls, low-pitched tile roofs, arched windows or doorways, and sometimes curved parapets or gables decorating the roofline. Often, their front doors are dramatically carved wood, according to “A Field Guide to American Houses,” by Virginia and Lee McAlester. Architectural historians say the style was popularized in part by the Panama-California Exposition in San Diego in 1915. “Rather than copy the East’s revival of its own colonial past, California turned to its Hispanic heritage for inspiration,” the McAlesters wrote. Spanish revival is among a number of styles that enjoyed a rebirth in the 1920s, including colonials and Tudors. It was a time when architects and builders freely borrowed from historic styles, and home buyers could choose house styles out of architectural pattern books. The Spanish revival homes would appeal to people “who wanted their house to be more unusual,” says T. Robins Brown, a historic preservation consultant and co-author of the book “The Architecture of Bergen County, N.J.” Their facades generally “aren’t too fussy,” she notes. esque, smacking of Florida vacations and Hollywood glamor. These buildings are uncommon in northern New Jersey, and owners of these homes love their unusual character. “It’s a different place. It’s not a McMansion – 10,000 square feet of nothing,” says Lewis Baer, an art and antiques dealer in New York. “I think it really shows an old-world style of living, more of a European style of living. I think that’s really what attracted my wife. It’s that old-world charm.” “It’s got a lot of character to it,” says Gerry Santos, a graphic artist who, with his wife, owns a three-bedroom Spanish revival in Hasbrouck Heights, N.J., which boasts a cluster of the homes. Bob Lindsay, a real estate agent with Re/Max Legend, has a Spanish revival home listed in Wayne, N.J., for $525,000. The owners, he says, were from South America and loved the architecture because it re-
minded them of their native land. With their thick walls, the homes are also very solid. Tile roofs can easily last a century, and many of the North Jersey homes have their originals, Brown says. “It’s a nice, sturdy-looking style,” Brown says. Carol Berlin of Teaneck, N.J., who has a Spanish revival house, agrees: “I feel like if there were some sort of natural disaster, this house would remain standing. It’s solid.” Similarly, an architect Baer hired for renovations at his home once told him, “If we have a nuclear war, I’m coming to your house.” The Baer house is one of a cluster of roughly half a dozen Mediterranean-influenced mansions on North Woodland, on Englewood’s East Hill. Several have colorful histories. Baer, for example, bought his home from Chinaglia, the 1970s Cosmos soccer star who wasn’t
shy about complaining when he felt his famous teammate Pele hogged the ball. Nearby is Gloria Crest, an Italianate mansion that channels a different part of the Mediterranean. It was once owned by Hollywood star Gloria Swanson. And across the street is a Spanish revival that was built on the site of Helicon Hall, a short-lived commune established by the early 20th-century muckraking writer Upton Sinclair. Another cluster of more modest Spanish revival homes is on Pasadena and Baldwin avenues in Hasbrouck Heights, not far from Routes 17 and 46. James and Marianne DiDonato bought one of the homes in 1971. “It was different from all the Colonials we looked at,” says Marianne DiDonato. Homes appear small but are surprisingly spacious inside, perhaps because their living
rooms have high, vaulted ceilings. Penny Santos says that after touring tiny Cape Cods in their house hunt, she and her husband loved the more open feeling of their house. Though the tile roofs last for a century or more, these homes are still at an age — more than 80 years old — when they sometimes need extensive work. The Baers’ house needed a massive renovation, including replacement of the windows, the kitchen, and the electrical, plumbing and heating systems. The couple reconfigured the second floor to add bathrooms and transform 11 small bedrooms into eight larger ones. They transformed a telephone room on into a powder room. “It was a labor of love,” Lewis Baer says. Along the way, they talked to an interior designer who suggested a modern decor. “The designer wanted to make it into a new house,” Baer recalls. “That was just the wrong way to go. We wanted to be very sympathetic to what was there.” To that end, they have furnished the home largely with European antiques. Carol and Dan Berlin bought their Teaneck, N.J., home when they moved from St. Paul in 1994. Her initial house-hunting left Carol discouraged, she says. “Why would I want to pay twice as much as back home, and get half as much space?” she said. But she felt otherwise when she saw the “unique, unusual” Spanish revival. Sunlight poured in through large windows, and a sunroom with a fountain hinted at the enclosed courtyards of Spain. Former residents still feel a tie to the house. Last year, her daughter was hosting a bridal shower for a friend when a former resident, in town for a high school reunion, rang the doorbell and asked to see the house. It was, says Carol Berlin, at least the third time that has happened.
