Foreclosure on home jeopardizes rental properties By Gary M. Singer Fort Lauderdale Sun Sentinel
QUESTION: I own a couple of rental properties out of state in addition to my primary home, which is worth less than I owe. I may have to let it fall into foreclosure, but can the lender get at the equity in my rentals? – Jenifer
ANSWER: Yes. If your lender forecloses on your “underwater” home, the bank may be able to get a judgment against you for the difference between what you owe and the value of the home. Your lender can record the judgment in the public records and create a lien against your other properties in Florida. The
bank can even “domesticate” the judgment in other states and use the domesticated judgment to get at your properties there. Once the lender has a lien against your property, it may be able to foreclose that lien and have the property sold in order to pay off the judgment, with any remain-
ing money from the sale going to you. Further, the bank also can use the judgment to try to collect the money owed by garnishing your wages, taking the money from your bank accounts or even taking personal property, such as a motorcycle or stock certificates. Of course, there may be protections to the
homeowner that vary by state. For example, it’s very difficult to garnish the wages of the primary wage earner for a household with children or to foreclose on your homestead property. It would be much better to avoid all of this hassle by negotiating a smaller settlement with the bank or seeking a short sale or
deed in lieu of foreclosure.

RICHMOND, Va. – Aging deck structures, harsh storms, high temperatures and a lack of routine maintenance can put homeowners with decks at serious risk of injury for themselves, their families and guests. More than 40 million decks in the U.S. are more than 20 years old, according to the North American Deck & Railing Association, and hundreds of deck accidents are reported annually. The experts at Archadeck, the nation’s largest outdoor living company, recommend checking decks each spring and fall to ensure safety: Boards: Check deck boards for rot, softness or major cracking. Connections: Inspect every hardware connection on the deck. Look for screws or nails backing out, red rust and other signs of corrosion on metal connectors . Structure: Look at the posts, beams and joists that provide the structural framework of the deck. Is there noticeable sagging between supports? Attachments: Most deck failures occur at the attachment site to the home. Ensure that the deck is properly attached to the house with bolts and
proper flashing for water protection. Never use nails. Foundation and footings: The foundation and footings support the weight, or load, on a deck and the columns that bear on them. Look for sinking or noticeable sag. Exits: Check the deck’s exit areas, usually stairs. Are the stair stringers, treads and risers OK? Do the stairs require a handrail? Is there adequate lighting to use the exits at night? Rails: Look at posts and railing sections to make sure that they aren’t loose or wobbly. All pickets/balusters should be fastened securely and spaced no more than 4 inches apart.

largest design shops in the nation. “Most homebuilding companies don’t have an internal design voice like we do. It’s usually very construction driven,” Jones said. “We talk with homebuyers and learn what they want and where they want it to happen. We talk with our homeowners about what they love and what they would change in their current homes – and we use those ideas when designing new homes.” Meanwhile, Jones said the kitchen as “an aesthetic impression” has evolved with clean lines, ample storage, and easy to clean and uncluttered spaces. “The kitchen is now a driving force in defining the decor of the home overall,” she said. PulteGroup’s 700-plus new home communities across the country feature fully furnished model homes because the majority of homebuyers prefer to see the design ideas “in action.” Pulte also allows homebuyers to design their dream kitchen with a click of a mouse with its new interactive Kitchen Studio. Images on www.pulte.com allow users to visualize a custom kitchen space by selecting from a variety of colors and finishes – from flooring to wall color. “Only 20 percent of homebuyers have the confidence to visualize and colorize the space. Kitchen trends New kitchen layouts and designs are open and island-centric, using mul-
tifunctional spaces that allow everything from homework, to craft and work projects to dinner and entertaining. To keep the clutter off the island, but near the kitchen, Pulte has also introduced new home designs that feature Pulte Planning Centers for the family. This multifunctional space is close to the kitchen – the main living area of the home – and gives families the room they need to manage their busy lives and stay organized. The designs are the result of consumer research and feedback. Two-tone colors and contrasting colors on cabinets, counters and appliances are an emerging trend in kitchen design. PulteGroup is rolling out new Black Ice and White Ice appliances offered by national partner Whirlpool. The new appliance designs are the outcome of consumer research showing kitchens are trending toward more timeless, contemporary styling. “This is the biggest visible news in the appliance world in years,” Jones said, adding that the new look was inspired by popular, cutting-edge high tech gadgets like smartphones. As for storage, the trend in homes is smarter use of space where families spend the most time. For smaller spaces, innovative storage solutions are important, such as: larger deeper drawers in lieu of cabinets on the lower surfaces; pop-up cabinets for heavier kitchen appliances like mixers; vertical pull-out drawers for large trays; shallow storage compartments in previously wasted areas under the sink or stovetop. “Right now it’s all about style and selections meeting convenience and multifunctionality in the kitchen,” Jones said.
Real estate enticing investors anew By Kathleen Lynn The Record - Hackensack, N.J.
HACKENSACK, N.J. — The stone house has small rooms, an overgrown yard and a roof that begs to be replaced. But investor Frank Oliveri and his business partner, Al Best, see the potential in its Wyckoff, N.J., address and the $125,000 in renovations they’ve got planned. The house fell into foreclosure after selling for $522,000 in 2006, when the housing market was at its frothiest. Oliveri, of Rochelle Park, N.J., and his brother, Mel, bought it recently for $315,000, even less than its 1999 sale price of $339,000. After extensive renovations — including the addition of a master suite — the investors hope to sell the property for more than $600,000. If this deal works out as planned, it will illustrate the more favorable numbers that are slowly drawing investors back into the real estate market. After the housing crash left many with losses, some investors are now seeing the attraction of lower home values and interest rates, as well as higher rents. Home sales are running ahead of last year’s very slow pace, and about one in five buyers is an investor, according to the National Association of Realtors. “The flipping market is back,” said Antoinette Gangi, a Re/Max agent in Woodcliff Lake, N.J. Real estate investors, she said, “want to put their money in the dirt, not in the bank.” That’s certainly the case with Best and the Oliveris. They look mostly for short sales or bankowned properties, because they have to buy the properties cheaply enough that they can still turn a profit after spending on improvements. That’s easier to do in the current market. “Prices have come down, and investors have a lot more room to wiggle with,” said Frank Oliveri. Builder Lou Chiellini of Park Ridge, N.J., who buys and renovates or replaces homes, also said that he’s been able to pay less for properties these days. At the same time, he’s accepting

lower profit margins than in the past, he said. “If you’re not greedy, you can still make money,” Chiellini said. Some investors would rather hold properties, to take advantage of both lower purchase prices and higher rents. “In some areas of the country, housing prices are down to the point where you can get a positive cash flow out of turning property into a rental unit,” said Jed Smith, an economist with
the National Association of Realtors. “In the past, they couldn’t get a positive cash flow on rentals; they got a return based on appreciation. Lower prices make properties more appealing to investors.” “In any market, if the numbers make sense, you do the transaction,” said Dan Schwartz of Fair Lawn, N.J., president of the non-profit Metropolitan Real Estate & Investors Association. At current prices and interest rates, he
said, “the numbers are more likely to make sense” — though there are pitfalls. “Yes, prices have come down and interest rates are at historic lows; however, banks are highly reluctant to lend money,” said Schwartz. Certainly, there’s plenty of risk in real estate investing. Upgrading a property can be expensive, and holding costs such as taxes, mortgages, utilities and insurance can eat into profit — especially if the sale takes longer than expected. Surprises like asbestos, bad wiring and underground oil tanks can pop up in older homes, requiring expensive remediation. And with mortgage money still tough to come by, it’s not always easy for investors to find buyers. “It’s not easy money,” Best said. “You’re going to find your opportunities, but nothing comes for free. — It takes a lot of money and a lot of people to bring a deal together.” He and his partners borrow from private investors at high interest rates. “There are more ways to lose money than there are to make
money, when you’re not seasoned,” said Billy Procida, president of Procida Advisors in Englewood Cliffs, N.J., who invests in real estate directly and lends money to other investors. “Real estate is the single most complicated type of investing you could do. I’ve seen people buy land without knowing there’s a stream running through it and they can’t build on it.” “Most investors are one-anddone. They realize they’re not going to make the money they’re supposed to make,” said Gene Lowe of Better Homes and Gardens Real Estate Rand Realty in Wayne, N.J. Lowe is an active investor who has recently stepped up his buying pace. His usual method is to pay cash for a small, neglected house — often an estate sale and often the least expensive home in a town. He’ll spend a short time and limited amount of money to renovate it, then quickly resell. After a long period of watching home values slide, he said, some sellers are willing to take low prices. “They’re worn down after trying to sell their house for the wrong price. I offer them much less than market value, and they take it,” he said. For example, he said, he recently bought a bi-level in Butler, N.J., for $250,000, put in $15,000 worth of improvements, and sold it for $318,000. One key to his success: He avoids major renovations that require getting permits from the town, because that dramatically slows the process. Schwartz, a real estate investor since 1982, agrees that many investors spend too much time and money on renovations, which makes flipping a tricky proposition. He prefers to hold properties and rent them out for enough to cover his monthly costs. Even with the risks, Schwartz thinks investors will look back in 15 years and wish they had taken advantage of this year’s low prices. “Real estate has always gone in cycles,” Schwartz said, “and I bet my money on the fact that it will go up again.”

Others may be waiting for true appreciation in the market . The median time a home was listed for sale was 69 days in July, a 29.6 percent plunge from the same month just a year ago, according to data from the National Association of Realtors. “The serious buyers are all looking at the same thing,” said Mark Reitman, regional manager at Redfin. “A couple of years ago, there was more in-
ventory so there was more choice.” Agents say it takes a few lost opportunities for consumers to understand the local real estate market isn't in the same poor condition it was two to three years ago. “The myth is that it’s a buyer's market right now,” said Bridget Rose of Chicago, who just extended an apartment lease after losing out on what she fears may have been the dream house for herself, her husband, Sean, and their son. “If it's finished, if it’s updated, it’s gone in an instant,” said Pete Mangione of Prudential Rubloff, the Roses’ agent.

CODE ENFORCEMENT AND THE PROPERTY MANAGER by Harry Anthony Heist, Attorney at Law
There will come a time when the property manager and/or owner of the property receives a notice of a code violation from the municipality where the property is located for something the tenant is either doing or not doing. This may be for something as simple as parking on the lawn, failing to cut the lawn, or not taking in the garbage receptacles from the street in a timely manner. The violations could be more serious, such as failing to maintain the exterior of the property, engaging in a business activity, or allowing mountains of personal property or debris to accumulate on the front lawn. How the property manager deals with the issue can make the difference in the property owner receiving a fine or notice of hearing, or instead getting a serious break cut for them by the code enforcement official. The key is the property manager must deal with the problem, deal with it swiftly, and keep code enforcement fully aware of the actions which are being taken to rectify the situation. The Catch-22 is that the time period for compliance given by code enforcement is seriously at odds with the actual time it can take to get compliance or eventual removal of the problem tenant. The Property Owner Receives Notice Usually, the property owner will receive notice by mail at the address that code enforcement has for the owner. This is usually the address where the tax bills are sent. The owner may live in a distant state or be absent on vacation when this letter arrives, and there is thus a major delay in word of the problem getting to the property manager. This is the first in a series of problems that can occur. The Property Manager is Notified Once the property manager is notified, action needs to be taken immediately. There will most likely be a time deadline which may be close to passing, or in some instances has already passed. This is when the property manager must immediately notify the code enforcement officer by phone and in writing, acknowledging receipt of the citation and expressing a strong willingness to deal with the problem fast. Can the problem be solved immediately?

CHICAGO – If it wasn’t the two failed offers or the missed opportunities, it was a tape measure that finally convinced potential homebuyers Brian McCord and Jamie Blondin that they just weren’t moving fast enough. When they went to see a two-flat in Chicago’s Bucktown neighborhood earlier this summer, they liked everything they saw, except for the other potential buyers also looking at the house. “Not only were they looking, they had a measuring tape,” McCord said. “And that made us much more nervous,” Blondin added. The couple promptly offered $626,000 for the $649,000 house, 96 percent of the asking price. This time, they were successful. The transaction closed earlier this month. The circumstances that McCord and Blondin encountered – shorter marketing times, multiple offers and bidding wars – can create anxious home shoppers forced out of their comfort zones. A confluence of factors is accelerating the pace of transactions in both choice and more stressed neighborhoods. Mortgage interest rates, while they have ticked up the past four weeks, remain well under 4 percent for a 30year, fixed-rate mortgage. More sellers are setting realistic list prices. Six years into the housing crisis, consumers who have sat on the sidelines are trying to take advantage of it all, as are investors who are scouring the market for properties to turn into rentals. The market trends are forcing a re-education of clients and real estate agents alike. It used to be that when agents told each other there were
thought were just bluffs. Now Davis has taken to role-playing with clients, pretending that they find a property and training them to make a decision quickly. “No one likes to rush,” Davis said. “I tell them when you find a good opportunity, you have to pounce. You can’t hesitate. When you go back and see it under contract, you go through an emotional loss.” Some of the quickened sales pace is seasonal, but it’s also due to a lack of inventory. Housing inventory in July was nearly 24 percent lower than the same month last year, according to the National
If the situation can be solved immediately, for instance by having a lawn person go out and immediately cut the lawn, this should be done, and the tenant should be billed for the expense incurred. If getting compliance requires the property manager do any self-help removal of the tenant’s personal property, the property manager should NOT attempt this at all. Self-help removal of items or the towing of vehicles can lead to serious litigation. If the property manager cannot easily rectify the problem, a dialogue must be opened with code enforcement. Communication with Code Enforcement The property manager should call code enforcement immediately to see exactly what the problem is. Often the citation is vague in describing the offending activity or condition, and this will allow the property manager to get a better idea of what exactly is wrong and what needs to be done. By calling immediately, the property manager can explain to the code enforcement
officer that she is on top of the problem and will be taking every legal step possible to rectify the problem. Most code enforcement officers will appreciate the call and indicate to the property manager that the main purpose of the citation is to get compliance, rather than impose fines or other penalties. The property manager will then be led to believe that the code enforcement officer is a nice person and that there is an actual extension given. It may be a correct assumption that the code enforcement officer is indeed going to work with the property manager and give an extension of time to deal with the problem, but can the property manager be sure? Did the Property Manager Get an Extension of Time? The property manager immediately will serve the tenant a Seven Day Notice of Noncompliance with Opportunity to Cure, which probably is the proper notice to be given in most code violation situations. Your attorney can assist you here. Will the code enforcement officer sit back and wait? We are not sure. Next week, there may be another code enforcement officer assigned to the case, as the original one is on vacation. Was the extension properly communicated? Did the property manager get something in writing, or will he or she simply depend upon the phone conversation with code enforcement, one of many phone conversations the code enforcement officer had that day among many other people? We recommend that you immediately follow up any phone conversation with a letter to the code enforcement officer by regular mail and certified mail such as this: Dear Officer Smith: Today I received the notice of violation on 125 Main Street and will be taking immediate action. As per our phone conversation, you have agreed to hold off on taking further action against the property owner during this process. We have contacted our attorney and have served the tenant with a Seven Day Notice of Noncompliance with Opportunity to Cure which is attached to this letter as “Attachment #1”. This is required by Florida law before we can terminate the tenancy, if he or she fails to cure the problem. If the problem is not cured within seven days, we are required by law to serve a Seven Day Notice of Noncompliance Notice to Terminate. Once this notice expires, we can then begin an eviction action, which takes between 20 and 45 days on average. Please use me as your contact person, as I am the person directly responsible for managing the property. My phone number is 555-1212. I will be doing everything legally possible to either get compliance or have the tenant removed. Please feel free to call me or my attorney at 555-1313 if you have any questions about the progress or the procedures which the Landlord/Tenant Act requires.” The result of such communication will usually buy extra time for the owner of the property. Code enforcement often has no idea how the compliance and eviction process occurs, and they need to not only be informed of the procedure to understand your dilemma, but keeping them informed of the progress will help insure a cooperative experience with code enforcement and help in future occasions when another one of your tenants may be in noncompliance. Developing a keen and cordial working relationship with code enforcement is one of the traits of a successful and effective property manager.
