a cut above! ELEANOR Riley, from Tarvin, loved her long hair but she agreed to have her long locks chopped so that the hair could be given to a charity which supplies wigs to children. It’s hair today and gone tomorrow for Eleanor! Nine-year-old Eleanor Riley, from Tarvin County Primary School, recently had her hair cut and donated it to The Little Princess Trust, a charity that makes real hair wigs for children in the UK and Ireland. Eleanor loved her long hair so much but was very keen to help the charity. Alongside having her hair cut Eleanor also wanted to raise the money to pay for the wig to be made which is a massive £350. She smashed her target and the running total at the moment is £545 of which she would like to send a little to St Luke’s Hospice, Winsford. Eleanor and her family thanked Grace Lancaster, from Raymond Francis in Tarporley, who did a great job cutting Eleanor’s hair free of charge.

TARPORLEY PARISH COUNCIL NEWSLETTER Brook Road Field The Outdoor Sports and Recreation Committee met recently with Groundworks to discuss the need for a drainage survey and a topographical survey. A DRAFT plan has been prepared following the last public consultation to include a football pitch, an all-weather multi sport games area, a pavilion, a car park, a length of running track and a footpath around the edge. A wider consultation is scheduled for early 2016. Section 106 monies received from developers have been looked into BUT significant additional funding WILL be required. If anyone has specific experience with sourcing money for a project like this please contact the Clerk to the Council or Andrew Wallace on andrewwallace@ wrightmarshall.co.uk.

Garden Plots The Parish Council is looking for individuals to take on the maintenance of various small areas of amenity garden in the village such as by The High School entrance, Bowmere Road, Burton Square and Cobblers Cross. If you are unhappy with your current working regime, we invite all local carers to come and meet for a presentation about our care services. You will meet some of our carers who will give testimony to the valuable service we have provided to our clients over the past 47 years.

Our Philosophy We passionately believe the elderly and vulnerable people should have the choice of how they are looked after. Our experience tells us that almost everyone, with the right care and support, can remain living in their own homes. We do not believe in ‘pop in - pop out’ home visits. Our clients want and deserve respect, privacy and should be treated with dignity. Therefore each visit is a minimum of one hour giving the carer time to interact with their client, not rushing them and having time for a chat over a cup of tea.

Choose your hours and your clients Your hours can be flexible to suit your other engagements such as school runs, medical appointments and holidays. Once we know that you and our clients are happy, you will become one of their regular carers, sometimes exclusively and sometimes as a team. All our carers are self employed BUT, they all say that they have a better experience with Bunbury. As from October our hourly rate will be increased to £12 per hour weekdays and £15 per hour at weekends, plus 45 pence per mile travel allowance. Overnights and weekend start at £100 per night, waking nights are more.

Impressive turnout for allot

Presentation of the cheque by representatives of the bowls and allotments clubs to Tarporley War Memorial Hospital: Graham Rathbone, Bert Bolt, Tony Gorman (General Manager), Claire Teasdale (Matron), Ken Warburton, Bobbie Nancarrow. Tarporley’s Allotments & Bowls clubs played joint hosts to the village at their Grand Open Day which had been organised to raise awareness about the threat to the site from developers and also to raise funds for a local charity. Despite some very windy and wet weather which played havoc with the gazebos, visitors flocked to take part in organised events. For children, there were scavenger and bug hunts while for adults there were taster sessions of Crown Green Bowling, a tombola and plant sales. Allotmenteers were on-hand to advise on how to get the best results from the vegetable seeds and seedlings. Visiting exhibitors such as The Cheshire Wildlife Trust and MidCheshire Beekeepers were also available with

expert advice on such issues as insect-friendly gardening. The Cheshire Wildlife Trust was also kept busy with games for smaller children. Various fund-raising activities on the day raised an impressive £517 which has been donated to Tarporley’s War Memorial Hospital. A further £40 was donated by Eaton Garden Club to the Hospital. Residents plus some parish councillors were also very keen to show their solidarity with the allotmenteers and bowlers whose amenities are threatened by the proposed developments to the site. Those opposed to the developments were pleased to sign one of the many petitions which have been in circulation. In total, over 1,000 signatures have now been gathered! Clearly, residents of Tarporley are very unhappy at the thought of any changes to their village’s precious green open spaces.

TEN students from year 10 at Tarporley High School set up their stall and helped raise money for Macmillan Cancer Support. The students, who organised the coffee morning as part of their ASDAN vocational course, raised £72 which will be added to by another coffee morning and more fundraising by staff later in the month.

The Harmonettes are coming to the Barbour Institute on Sunday 1st November to perform Dorothy’s War, the story of a woman’s journey to World War One’s frontline. Teacher is a voiceover star Tarporley’s very own English and Media teacher, Mrs McMillan, was asked to record the voiceover for a new trailer for BBC School Report – a BBC project which gives students in the UK the chance to make their own news reports for a real audience. The trailer is still in production but will be played nationally on television, on radio and online later this year. Having been heavily involved in the BBC School Report project for many years, the BBC approached the school to receive feedback from teachers who had worked with students in the past. Mrs McMillan spoke to the marketing team, and as a result of that discussion, was invited to Media City, Manchester, to record the voiceover in a studio this summer. Two English and Media students, Rhiannon Price and Dan Farrell, accompanied the teacher to Salford, gaining invaluable insights into the Media Industry as well as acquiring a unique experience to refer to on their UCAS applications for University. The main BBC School report news day is on 10th March 2016, when Tarporley students will be involved in once again. Look (and listen) out for the forthcoming trailer on the run up to the main event!

Vic’s show off new kit Tarporley Vic’s are delighted to announce that Wichtig International is the Club’s new main Sponsor for the 2015/2016 season. The Club are grateful to Wichtig International for their generosity in providing a new home strip for the First & Reserve Teams, plus training tops and t-shirts as part of this sponsorship. Wichtig International is an STM (scientific, technical and medical) publisher which was established in Milan, Italy. Pete George, a Tarporley resident, acquired Wichtig International eighteen months ago and the Company is growing with the objective of becoming a global player in the Medical Publishing market. Jean Jones is a Senior Manager at the Company and a key member of Pete’s Team in Tarporley. Wichtig International also has an office in Milan and one of the points of interest for Pete, Jean & Giulio Zuanetti, who is a Senior Manager in

the Milan office, was that Tarporley Vic’s strip is in the same colours as FC Internationale Milano (who English football fans know as Inter Milan). Who knows, we may be able to make use of this link in the future! Pete George also made reference to the fact that Tarporley Vics FC gives excellent development opportunities for young players from Tarporley and the surrounding area; Pete & Wichtig are also keen to utilise local talent, as Pete did previously when he was involved with Wolters Kluwer Ltd, based in Tattenhall. On the field of play Tarporley Vics 1st Team have played four League games and one Cup game in recent weeks. On the League front Tarporley Vics suffered defeats against Altrincham FC Reserves, Billinge FC & Pilkington FC. These teams were all expected to do well this season, with Billinge & Pilkington both having played in the Premier Division for a number of years and their experience certainly came to fore in these fixtures.

To balance out these defeats, the win over Middlewich Town, by a 3 – 0 score line (watched by Pete George and Jean Jones after the presentation of the kit!), helped boost the squad’s confidence as did a Cup-tie win against AFC Macclesfield. With the return to Football action of the players who represent local cricket teams during the summer, Andy Williams and Sean Taylor hope to continue to build on this confidence for

‘Legion must be sold t T

here has been a considerable amount of rumour and misunderstanding with regard to the disposal of the land in Tarporley currently in Trust to the Royal British Legion, writes Ernest Boynes.

The original donation of the land occurred in 1966 when the benefactor offered that parcel of land which now comprises the redundant Tarporley Royal British Legion Club building and the car park to the Tarporley Branch of the Royal British Legion (the Trustees), to be held in Trust “ for the Pursuance of the Aims and Objective of The Legion which are expressed in the Royal Charter of Incorporation”. There were four Trustees, Members of the Branch, appointed by the Branch, who signed the document.

In 1987 that parcel of land now known as the allotments and bowling green was sold to the Tarporley Branch. The document states “The Transferees shall hold the property upon trust and for the benefit of members ( both present and future) of the Royal British Legion, Tarporley Branch, to deal therewith whether by way of sale, lease, mortgage, charge or otherwise as its committee shall from time to time direct. In 1999 and following a resolution passed at an Extraordinary General Meeting of the Tarporley Royal British Legion, the two parcels of land were passed in trust to the Royal British Legion, a registered charity ( Charity number 219279). The document transferring the property was signed by four members ( the Trustees) of the Tarporley Branch. The management and control of the Property was vested in the National Council of the Trustees of the Royal British Legion.


to the highest bidder’ These documents have been viewed by the Parish Council. In December 2014, for reasons that have been widely publicised the RBL Club closed. The property, including the Club together with the allotments and bowling green, provided a limited amount of income for the Charity and now the Club lies derelict. Charities have a duty in law to obtain the best reasonable return from their assets when sold in order to provide support for its beneficiaries. As this property in its present condition and usage will not produce a return commensurate with its value, the RBL has no option but to sell for the highest amount it can reasonably obtain for its beneficiaries. It should be noted that to be a member of the RBL does not necessarily qualify a person to be a beneficiary. A beneficiary is defined as a person, a member of the armed forces community, which includes dependants, who currently serves, or has served in the armed forces and is in need as a result of wounds, ill health, bereavement or adverse circumstances for the remainder of their lives. In order to comply with the terms of its Royal Charter the RBL now has no option but to sell or lease the property to obtain a satisfactory return on the asset. If the local authorities had wished to take an interest in the land they could have approached the RBL with a proposition. The Charity must consider whether they have sold the property on the most favourable terms. A charity can achieve this by ensuring the property is favourably marketed, taking advice from professionals and accepting the best financial offer available. However an

offer that is not necessarily on the best terms can be accepted by a charity in the following circumstances: if the disposal is to a charity with similar purposes; if the charity reasonably believes that a buyer would not be able to complete; or if the buyer’s intended use of the property conflicts with the principles of the charity. The Royal British Legion is now in discussions with a developer for the disposal of the land and details of the initial proposals have been posted on the notice board at the entrance of the RBL car park. It is anticipated that there will be objections by local interest groups to any development which will result in a change of use of the land, so the Parish and Borough Councils will need to decide whether or not to object to any planning application. In the case of this particular planning application there is an additional matter which the Parish and Borough Council might believe they are obliged to take into consideration, namely the government’s Armed Forces Covenant, “An Enduring Covenant Between The People of The United Kingdom, Her Majesty’s Government and All Those who serve or have served in the Armed Forces of The Crown And Their Dependants”. The principle forming the basis of this Covenant is that no decision made by any part of government or the public services should disadvantage the armed forces community. The funds raised by the sale of this land, if completed, will be used to support those who serve, or who have served in the Armed Forces, together with their dependants, who are in need.


Bunbury Neighbourhood Plan submitted The Neighbourhood Plan was formally submitted to Cheshire East Council on Friday 28th August. The submission was made in accordance with Regulation 15 of The Neighbourhood Planning (General) Regulations 2012, for consideration and wider publicity. The plan will shortly enter a new and final round of consultation, for a period of six weeks, and Cheshire East will issue a press release to coincide with the early stages of the consultation launch. Cheshire East will publicise the plan so that it is brought to the attention of people who live, work or carry out business in the neighbourhood plan area. The latest version of the plan is now available on our website (www.bunburynpg.

org) and the consultation will provide an opportunity to comment on this submission version. Details of how to comment will appear on the Cheshire East website. Following the consultation period the plan will be independently examined. When considering the content of the Neighbourhood Plan the independent examiner’s role is limited to testing whether or not the draft Neighbourhood Plan meets the basic conditions, and other matters set out in the legislation (paragraph 8 of Schedule 4B to the Town and Country Planning Act 1990). The last stage of the Neighbourhood Plan process will be a referendum, organised by Cheshire East Council, to enable the residents of Bunbury to vote on the Plan.

What’s on in your village OCTOber Kelsall Flower Club The club are having a visit on Wednesday 18th November, from Paul Burrell, former Butler to Princess Diana, who will demonstrate Christmas wreaths/table decorations and give some insight on how the Royal Family managed their Christmas festivities. Bunbury WI The group meets at 7.30pm on the 2nd Thursday of every month in the Pavilion, with a talk or demonstration, some brief WI business and refreshments. Several Members travelled to Harrogate at the beginning of September to attend the WI Centennial Fair – a lovely day of indulgence in all things craft, cookery and travel. On 8th October Dr Karen Castle will share her experiences as a Prison Nurse and following the AGM on 12th November Prof Peter Styles will share his thoughts on Fracking and Shale Gas. The WI is a great way to meet like-minded women, make new friends, listen to a variety of interesting speakers, enjoy some of the many organised activities or join other smaller groups for reading, keep-fit, quizzing, luncheons, etc. Visitors and potential new members are more than welcome to join us. Tattenhall Gardening Society The society opens its autumn programme of illustrated talks and workshops on Wednesday 14th October with Jen Benefield and Janni Hollins from Tattenhall Hall, who will be giving a talk on ‘Succession Planting’ in which they’ll give tips on how to grow something of interest for every day of the year. TGS meetings are held in the Barbour Institute, Tattenhall on the second Wednesday of the month at 7.45pm. New members are always welcome. Tarporley and District U3A Tarporley and District U3A monthly meeting – 10am on Thursday 22nd October in The Community Centre. Peckforton and Beeston WI ‘Do not give up but learn by your mistakes’ was Kate Cawley’s message to the ladies in relation to entering craft competitions. After becoming an expert in all types of handicrafts Kate is now a judge and gave many tips to improve chances of success. She was very amusing and brought some marvellous examples of soft toys, knitting, embroidery etc. to illustrate her talk. On 7th October Vivienne Derricutt will give a talk entitled ‘No rest for the Wicked: A woman’s lot in the 17th Century’ . We arrange monthly evening walks of about three miles in summer, & often arrange trips & social functions.Walks always finish at a convenient hostelry. Membership is £6 a year, & is open to anyone.
