TCDLA’s purpose is to protect and ensure by rule of law and protect those individual rights guaranteed by the Texas and federal Constitutions in criminal cases; to resist the constant e orts which are now being made to curtail such rights; to encourage cooperation between lawyers engaged in the furtherance of such objectives through educational programs and other assistance; and through such cooperation, education, and assistance, to promote justice and the common good.

Jim welcomed everyone to the new year Introduced new board members in attendance, Greg and Shawn.

Chair Report, Jim Darnell

• Randy Wilson – Board members talked about Randy and their memories of him. Asked for a moment of silence. Instead of flowers he has asked for TCDLEI donations ($700)

• 2024 Rusty Booth & Silent Auction – final numbers $28,770, Silent Auction $13,280

• 2025 Raffle & Price Differentiate – We will have a drink basket for a $25 ticket, a wine pull for $20, and any big item donation you can think of. If we can get someone to donate another raffle that would be great, it was successful this year.

• Dashboard & Report Card – you will receive an email with your accomplishments, let staff know if you have questions

• Board Member Donations/Recruitment ($1500) – in the report card email, you will also have ways to recruit donations if you do not want to contribute personally $1500 Call Melissa if you need help with different ways to donate and/or recruit.

• TCDLA Board Responsibilities Voice – in your packet is a list of board members who have not fulfilled their Voice Article commitment, they are an excellent group to target.

• Merchandise Report – We are almost out of our kid's merchandise, reordering all kids Melissa showed an image for a prosecutor cup and would like to hear feedback about it. Merchandise for animals was suggested. Philip committed to buying the first bandana for his cat!

• Inaugural Distinguished Lifetime Fellow – these are names of those who are close or met the requirements – we will reach out to those who are close or someone on the board can if they know them. We will advertise in Voice, social media, commercial slide, and flyer for seminar packets. Any other ideas let Melissa know.

• FY24 Scholarship Awards – recipient list is in your pack. In FY24 - 119 criminal defense attorneys were awarded scholarships from TCDLEI totaling $44,550 in addition one, 3L for $5000, 1 - Christine S. Cheng Memorial Asian-American, and 2 Scrappy Holmes Indigent Defense

• BJA Grants, none at this time, will continue to look

• Fundraising Brochure & Letter - in your packets – if you want a printed copy, let us know

• SBOT Life Insurance, Melissa Schank – looking into whether we continue pursuing this.

• Golf, Laurie Key, Monroe Solomon, and Sam Bassett – want to work with all the affiliates and have a statewide golf tournament. Looking at late spring of next year.

• Donation Holiday Challenge December 2024, Melissa Schank – this is ready to go and will start sometime in November. You will be getting a text regarding the challenge.

• Giving Tuesday, we will do in November

• Major Outside Donor Initiative, Kyle Therrian, Cynthia Orr, Angela Moore, and Pat McCann – no update

• Grant Writer, Cynthia Orr – will discuss with Melissa

• Sheet of Ideas, Kyle Therrian and Melissa Schank – need to work on these ideas and put them together.

• Auto Monthly Added, Melissa Schank – a form will be sent out to sign up for auto monthly payments if needed for donations.

Old and New Business

• Diamond and Sapphire Pins, Cufflinks, Cory Clements – images were passed out. Ideas for pins were presented by Cory’s jeweler, and pricing for the two options was discussed. We will be getting more quotes. Melissa will reach out to a jeweler in Austin. A deadline of January 1st to donate through the end of the year for the first class of $25k donors

• Long Range Planning Committee, Philip Wischkaemper – Cynthia would like to join the committee. We will set up a zoom to share the strategic plan that TCDLA is using.

• Meme for social media, Jim Darnell – staff will work on this

• Auto Monthly Added, Kyle Therrian – this has been added to the form for donations; we will try to recruit

• Nominating committee – contacting upcoming renewals if they will be interested in renewing. We will let you know at the January meeting how many vacancies there will be depending on how many board members renew.

In person: December board meeting moved to January. The decision was made to move the board meeting to Lubbock.

TCDLA Committee Expression of Interest

TCDLA is seeking enthusiastic and motivated individuals for upcoming openings to its 2024–2025 committees. Committee descriptions and mission statements are listed on the website. Complete the form below and check one or more of the committees that you would be interested in serving on.

Responsibilities ofaTCDLA Committee Member:

1. Member of TCDLA.

2. Committees will provide advice, guidance and recommendations to the TCDLA President and/or Board of Directors on relevant matters related to their particular committee.

3. Committees will have assigned responsibilities associated with TCDLA’s strategic plan and objectives.

4. Meet throughout the year via zoom call and/or at quarterly board meetings.

5. Members are expected to review and respond to email requests in a timely fashion.

6. Committee Chairs are expected to prepare written reports for inclusion in the board packets for each board meeting. Any items requiring a decision of the Board should be included on agenda. Committee members will assist chairs in the preparation of reports.

Innocence for Students

In Person (travel stipend included) | FREE Overview: Melvin Quinney was convicted of indecency with a child, his son, John, Parker. He was sentenced to 20 years confinement in 1991. He was released from prison in 1999 and exonerated due to the creative efforts of the Innocence Project of Texas in 2023. His story and others have been reported by podcasters

Sharon Shattuck and Julia Marchesi on “American Panic” a Spotify production. This year’s innocence for students program will feature personal appearances by Melvin, John, Julia and Sharon. TCDLA is proud to offer this program funded by a grant from the Court of Criminal Appeals.

Forensics

October 17-18, 2024

In Person (travel stipend included) | FREE Overview: Many lawyers would have been doctors if they had been interested in or talented with science. Forensics is where science runs headlong into the legal process. This seminar will introduce lawyers to the sciences that we often encounter in our more complex cases. We will learn what is available on the internet to assist us and what our clients may leave as evidence. Computers, cell towers, arson, false confessions, crime scene and collision reconstruction, brain scans and more will be introduced during this two-day seminar. And yes, we will cover DNA! The changes in this field are rapid and significant!

The Anxiety Issue

• ABA Commission survey on Lawyers Assistance Programs and Hazelden Betty Ford Foundation found that 19% of 15,000 lawyers reported severe anxiety symptoms.

• 2020 ALM Mental Health and Substance Abuse survey of 3,800, more than 64% indicated experiencing anxiety.

Lawyers and Alcohol

• ABA study, approximately 20% of lawyers in the United States have alcohol use disorders, compared to 6-8% of the general population

• Hazelden Betty Ford Foundation found that 36% of lawyers reported problematic drinking, compared to 15% of other professionals, with more specific inquiries, the percentage jumped higher than 36%

Lawyers and Substances/Mental Illness/Depression

• Attorneys have the highest suicide rate of any profession.

• ABA estimates 15-20 % of attorneys suffer from addiction or mental illness, compared to 9% of the general population.

• Consistent with these findings, the National Institute on Alcohol Abuse and Alcoholism estimates that while 10% of the U.S. population is alcoholic or chemically dependent, the abuse may be as high as 20% among lawyers.

• Research data from SAMHSA (Substance Abuse and Mental Health Service Administration) supports findings that addiction rates among lawyers can approach twice that of the general population.

• These risks don’t appear to dissipate with age. While 18 % of attorneys with two to 20 years of experience reported drinking problems, this statistic increased to 25 % for attorneys who had practiced more than 20 years.

• Alcoholism is a contributing factor in approximately 30 % of all suicides.

• The prevalence of depression among lawyers is notably higher compared to the general population. Studies suggest that up to 28% of lawyers experience depression at some point in their careers.

Scholarship Request

Scholarships for seminar tuition are available to deserving attorneys actively engaged in the defense of criminal cases who can demonstrate financial need. Scholarship requests must be in writing and state that the applicant is a TCDLA member and has not received a scholarship within the last two years (Trial College does not count as a scholarship). Scholarships are available to public defenders who do not have access to CLE funds.

Scholarship applicants must send in the following to be considered: 1) Letter of request; 2) Letter of recommendation from a TCDLA member. Scholarships recipients will receive materials on CD. Course books may be purchased for a $60 fee. Scholarships are awarded to qualified applicants in order received.
