March will be going out like a lion on the 29th at Fiddlers Crossing with finger style blues guitarist Claude Bourbon on the stage. To be more specific, Bourbon plays Medieval and Spanish blues, and delivers songs in a perfect gravelly blues voice. He was a favorite performer on the former Mama Hillybeans stage, and this is his second visit to Tehachapi. Bourbon was born in France and grew up in Switzerland playing classical guitar. He has since performed and studied all over the world. He now makes his home in the UK. Although his music is rooted in blues, it is infused with classical and jazz influences, Eastern ethereal music, Spanish and Latin elements, and even Western folk songs. While

most fingerpicking guitar players use only the thumb and two or maybe three fingers, Bourbonâ&#x20AC;&#x2122;s unique style uses all five digits, â&#x20AC;&#x153;each dancing independently on the strings, sometimes moving at breakneck speedâ&#x20AC;?, as a review on his website put it. The sound is pure â&#x20AC;&#x153;Claude Bourbon.â&#x20AC;? The concert will begin at 7 p.m., with doors opening at 6:30 p.m. Tickets are $15, and are available at Mountain Music, next to the venue, and at the Apple Shed. A $1 fee is added to each ticket paid by credit card, which can be used at Mountain Music or over the phone by calling 661-822-1753. Fiddlers Crossing is at 206 East F Street, in Downtown Tehachapi at Robinson Street. As always, coffee and goodies are included in the ticket price.

Treat yourself to the ‘clean comedy’ show Tehachapi residents are in for a rare treat. Tehachapi's own Lainee J will be introducing (and outrageously encouraging) Jason Love to be as funny as he can possibly be to raise funds for Marley's Mutts on Sunday, April 7, 7 p.m. at the Beekay Theatre. Their show is entitled, Clean Comedy Night. Jason Love has done standup at venues the world over, including the Improv, Laugh Factory, Comedy Store, and Disney Cruise Line. Jason has performed for Google, Coca-Cola, True Religion, Farmers Insurance, Pandora, MTV, General Motors, L.A. Dodgers, Relay for Life, Boys and Girls, Rotary, Kiwanis and Alcoholics Anonymous. His media credits include Last Comic Standing, Comedy Central, The Bob and Tom Show, HBO’s “Luck” starring Dustin Hoffman, lead male in “Love Aplenty,” Santa Barbara Film Festival and hundreds of TV news and radio programs. Art show in BVS opens Saturday Tehachapi Dermatology The Bear Valley Springs Cultural Art Association’s Spring Art Show will be held on Saturday, March 23, through Sunday, March 31, at the Oak Tree Country Club, 29541 Rolling Oak Dr. in Bear Valley Springs. A reception for the artists will be from 4 to 6 p.m. on the opening day, March 23, providing an opportunity to meet and talk with the artists and enjoy refreshments. Attendees will also be able to purchase raffle tickets with work contributed by participating artists as prizes. The raffle will take place in Bear Valley Springs during the opening night’s reception on March 23. All exhibited works will remain on view through March 31. Presented annually, the exhibit features artists and their works in the mediums of painting, photography, sculpture and pottery. Featured contributing artists this year include Sonja Bronson, Debi Hartman, known as Sparks, Mary Anne Moore and Kathleen Levenson. Featured Artists This week's featured artists are the late Arnold A. Given and Debi Hartman, also known as Sparks. Sparks Sparks is an art lover turned artist, influenced by the many talented artist friends she surrounds herself with in Tehachapi. She paints from the images she creates in her mind or from dreams in which images come to her. These visions can be purely abstract or have shape and often come to life in human form. They are rarely detailed or precise and often filled with intense emotion. Some of her favorite paintings are created

using techniques that cede some of the control to the medium — using alcohol, canned air, or simply tilting the canvas and and letting the paint go where it will. Sometimes she uses very deliberate techniques that create interesting textures with fingers, palette knife or body parts and sand from her backyard, as examples. "From the first moment I brushed paint to canvas in 2009, I was captivated by both the process and the results of converting my feelings into something tangible and visually compelling," she said. Sparks has embarked on an intense and prolific period of selfeducation and experimentation, producing more than 500 canvases in both oil and acrylic. Arnold Given Master sculptor Given donated his work to the show prior to his death on Jan. 19. Given honed his artistic ability for well over 30 years and began by developing his artistic skills with small wooden sculptures. They are known as “Santies” and of his own design with a unique and fanciful quality. Many of his clients are adamant that they have a signed and dated “Santie” each year. Given’s creations included detailed carvings of waterfowl involving proficient feathering detail. According to his wife, Shirley, Given found carving to be a means of not only expressing himself artistically and importing his spirit to future generations, but also an avenue to grant a legacy to his grandchildren. To paraphrase a Native American Legend, she said, “A creation by one's own hand takes with it an element of the creator's spirit.” With his sculpture, Given accepted the legend with certitude.

It's going on three months for me. I also had vasculitis (HenochSchonlein purpura). I haven't experienced any symptoms for a couple of years. I have been feeling nauseated and have had loose BMs and the odd stomachache. A red spot appeared on my leg a few days ago. Do you think the vasculitis is playing a role in my delay in recovery? -- J.B. ANSWER: I'll describe the typical pain of sciatica, and you see if the description fits your pain. The sciatic nerve is the body's largest and longest nerve. It travels from the lower back, down the leg to the ankle or foot. Pressure on the nerve from a protruding back disk, a bone spur or anything that compresses the nerve brings on sharp or burning pain

running down the side and back of the leg to the foot. Pulling the knees to the chest and holding that position for 20 seconds produces sciatica pain. The pain of sciatica often lessens and disappears in one or two months. The X-ray report you included doesn't rule in or rule out sciatica. If the pain persists, an MRI or CT scan provides additional information. You are improving, so I think eventually you should be pain-free. Vasculitis is an inflammation of blood vessels, and Henoch-Schonlein (HE-knock SURN-line) purpura is one kind of vasculitis. Children get this illness more than adults do. Red blotches that turn into bruises (purpura) pop up on the buttocks and legs. Joint pain, abdominal pain, nausea, vomiting and diarrhea (or constipation) also arise. In the first year after recovery, relapses are

common. If your current stomach troubles worsen or you see more red blotches, get back to the doctor who took care of you before. I don't believe that HS, if it is returning, is interfering with your recovery from sciatica. The booklet on back problems describes their common causes and their treatment. Weight loss tips for real life (Family Features) Chances are you've been down the weight loss road before. And chances are just as good that you've gained it all back. But don't despair; there are ways to avoid the dreaded yo-yo. The Santa Clara River Valley Railroad Historical Society (SCRVRHS), will celebrate its 20th anniversary with “Railfest 2013” on March 23 and 24 in Fillmore’s Central Park, about a two-hour drive from Tehachapi. This event has become one of the regions’ largest annual railroad related events. Hours are 9 a.m. to 5 p.m. each day. Admission and parking are free. Railfest 2013 will feature Fillmore & Western Railways’ fully operating and restored Baldwin 1913 “Consolidation” type steam locomotive #14. This locomotive, a 2-8-0, will be powering the “Railfest Special Event” train including a caboose with three train departures each day of the event. A daytime diesel train will be pulling a Scenic Excursion train to Santa Paula. Saturday evening a diesel powered Family Murder Mystery Dinner train

will travel west from Fillmore and back, departing at 6:30 p.m. Another dinner train on Saturday night will be pulled by the Baldwin steam engine and features a boxed BBQ dinner provided by SCRVRHS. It will depart Fillmore at 5:30 p.m. and head east to Piru before returning to Fillmore at 8:30 p.m. These vintage trains will consist mostly of traditional pre1940 heavyweight and also streamliner passenger and dining cars. In addition to train rides, Railfest 2013 offers many railroadrelated venues such as ‘Speeder’ rides and informational displays from various railroadrelated organizations. Society’s vintage 1906 RR Turntable throughout the event and provide information and details about the equipment. The turntable, used to turn around locomotives and railcars, is one of the first to be installed in California in over 50 years. Also, the SCRVRHS Railroad Visitor Center, located across from Fillmore’s Central Park at 455 Main Street, will be open. It contains many historical railroad artifacts, a Lionel “0” gauge model-train layout, a gift shop, and a 20-seat digital theater with surround sound. Question: I have a question about feeding raccoons. My goodintentioned neighbor puts large pans of dog food out every night for the raccoons. We live in a very close community and the raccoons keep me awake at night with sounds of their fighting over food. They also venture onto my patio to cause more commotion and damage. I've tried everything to discourage their visits - ammoniasoaked rags, cayenne pepper, lights, etc. Nothing works. I've tried to talk to my neighbor, telling her it's not good for wildlife to be fed by an unnatural food source, but she turns a deaf ear. Are there laws against feeding wildlife? Is there any other advice you can

give me? (Anonymous) Answer: While feeding wildlife makes those people doing so feel good, in the long run it is often to the detriment of the animal recipients. Although many animals will eat offered food, temporarily satisfying their hunger, in reality, many human foods lack the protein and nutritional components animals need for good health. So, although your neighbor may be wellintentioned, she’s actually hurting the wildlife and her neighbors by encouraging wild animals to get too comfortable around humans. When animals concentrate around food, they are more likely to spread diseases to each other and to domestic pets. When wild animals lose their natural fear of humans, they can become very aggressive. Coyotes, in particular, are wellknown for eating small

pets because they do not differentiate between the food you leave for them and other prey items, like dogs and cats. People often think they are just feeding cute, furry critters. But if they were to put a surveillance camera out, they would likely be surprised to find out what’s actually eating the food at night. They would probably be appalled to discover animals fighting over the food, and that they’re actually keeping the neighborhood rats fat and happy. By feeding wildlife, your neighbor may be disrupting the animals’ normal behavior patterns in violation of California Code of Regulations (CCR) Title 14, section 251.1. There may also be a local ordinance that bans feeding of some wild animals. Los Angeles County, for example, has an ordinance that prohibits feeding of “non-domesticated mammalian predators, including but not limited to, coyotes, raccoons,

foxes and opossums.” Feeding raccoons also presents a real human health risk. Raccoons are frequent carriers of a potentially fatal human pathogen, raccoon roundworm, Baylisascaris procyonis. This roundworm is transmitted through contact with the feces of raccoons and has caused fatalities in humans, including toddlers who will put raccoon feces in their mouths. How often to check hoop nets? Question: When fishing my hoop nets in the river or ocean, how often do I need to check them? Answer: Hoop nets

are required to be checked at intervals not to exceed two hours (CCR Title 14, section 29.80). The owner of the hoop net or the person who placed the hoop net into the water must raise the hoop net to the surface and inspect the contents of the hoop net at intervals not to exceed two hours (CCR Title14, section 29.80(b)). Any hoop net abandoned or left unchecked for more than two hours may be considered abandoned and may be seized by any person authorized to enforce these regulations.

Using trout for bait? Question: Can you please clarify whether trout can be used in California waters as bait? (Andrew G.) Answer: Trout may not be used for bait. Statewide bait-fish regulations for all inland fishing districts begin with, "Except as provided below, live or dead fin fish shall not be used or possessed for use as bait . . ." (CCR Title 14, sec-

tions 4.00-4.30.) Therefore, if the species is not specifically authorized in that section, it may not be used for bait. Even though trout are not specifically prohibited from being use as bait in the law, neither are they specifically authorized, and are therefore included in the general prohibition against using (any) live or dead finfish. In addition, there are only two districts (Valley and South Central) where any species of finfish that is lawfully taken may be used for bait. However, trout and salmon are specifically excluded (CCR Title 14, section 4.20(d)). This is the provision that authorizes the use of bluegill for taking striped bass in the Delta. Spicy Candied Bacon Yield: 6 slices Prep Time: 5 minutes Cook Time: 25 minutes • 1/2 pound extra-thick cut bacon, about 6 slices • 1/4 cup Hungry Jack Original Syrup • 1/4 teaspoon cayenne pepper • 1/4 teaspoon ground cinnamon • 1/8 teaspoon cracked black pepper 1. HEAT oven to 375F. Line 15 x 10-inch baking pan with foil. Lay bacon slices on foil. 2. BAKE 18 to 20 minutes or until bacon edges begin to curl. Remove from oven. Tilt pan to drain. Pat bacon with paper towel. Combine syrup, cayenne pepper, cinnamon and pepper in small bowl. Drizzle evenly over bacon slices. 3. BAKE 5 minutes or until evenly browned. Remove to wire rack. Cool 5 minutes. Serving suggestion: Candied Bacon Breakfast Sandwich: Layer fried egg on English muffin. Top with shredded cheese, Spicy Candied Bacon and a dash of hot sauce or ketchup. Top with other half of English muffin.

2. WHISK pancake mix, water and syrup in medium bowl. Stir in cheese, potatoes and 1/4 teaspoon salt. Cook sausage patties as directed on package. 3. POUR 2 tablespoons batter on griddle, spreading batter to make a 3-inch circle or by using 3-inch pancake molds, coated with no-stick cooking spray. Repeat to make 7 more pancakes. Cook 2 minutes or until golden brown. Turn. Cook second side 2 minutes. For eggs: 1. MELT butter in large skillet. Add red pepper. Cook and stir about 1 minute. Whisk eggs and salt in small bowl. Pour into skillet with peppers. Cook slightly, then shape into four 3-inch circles about the same size as the pancakes and sausage. 2. PLACE one pancake on plate. Top with cooked sausage patty, egg and another pancake to make breakfast sandwich. Repeat with remaining ingredients to make 3 more sandwiches. *TIP: If using pre-made sausage patties, flatten slightly into 3-inch rounds, if necessary.

Eggs: • 1 tablespoon butter • 1/3 cup diced red pepper • 4 large eggs • 1/8 teaspoon salt For pancakes: 1. COAT griddle or skillet with no-stick cooking spray. Heat griddle or skillet on medium heat (350F).

• 3 large eggs • 1 cup sour cream • 1 tablespoon Dijon mustard •1 1/2 teaspoons fresh dill weed or 1/2 teaspoon dried dill weed • 1/4 teaspoon salt • 1 cup shredded Swiss or cheddar cheese • 1/3 cup thinly sliced green onion • 4 ounces thinly sliced deli-styled baked ham, coarsely chopped fresh dill sprig (optional) For crust: 1. HEAT oven to 425F. Coat 12-inch pizza pan with no-stick cooking spray. Combine pancake mix, Parmesan cheese, dry mustard and onion powder in medium bowl, stirring until blended. Stir in water and olive oil until dough forms. 2. PRESS dough onto bottom of prepared pan to form a crust, building up outside edge to form a rim. Bake 7 minutes. For filling: 1. WHISK eggs, sour cream, Dijon mustard, dill and salt in medium bowl. Stir in cheese and green onions. Pour over hot crust, spreading evenly. Toss ham to separate pieces. Sprinkle evenly over egg mixture. Reduce oven temperature to 350 degrees F. Bake 20 to 25 minutes or until egg mixture is set in center. Cool 5 minutes before cutting. Garnish with fresh dill, if desired.

Grilling Tips from the National Pork Board • Grill over indirect heat. This allows the ham to heat evenly, without burning. • Score the ham. Scoring (diagonal cuts about 1 inch apart on the surface of the ham) not only looks more appealing, but it allows both the natural juices and the glaze to penetrate and flavor the meat. • Use an instant-read thermometer. Heat pre-cooked (or cured) ham until the internal temperature reaches 140F. Cook fresh uncooked ham until the internal temperature reaches 145F, followed by a 3-minute rest. When inserted into the thickest part of the meat (without touching any bone), the temperature should register within a few seconds.

Have you ever turned on the light in a dark basement and shuddered as cockroaches scurried away? I get that same sense of revulsion whenever I hear about unscrupulous swindlers taking advantage of the victims of natural and manmade disasters. The Better Business Bureau has dubbed these human cockroaches "Storm Chasers" because they creep out of the woodwork after every major storm or disaster. In fact, because fraud was so widespread after Hurricane Katrina, the Department of Justice created the National Center for Disaster Fraud, a central information clearinghouse for more than 20 federal agencies where people can report suspected fraudulent activities tied to disasters of all types. One common scam is where supposed repair workers blitz impacted neighborhoods, hoping to ensnare frazzled homeowners. Their typical line is, "We're really slammed but with a cash deposit you can ensure a spot on our busy schedule." Or, they'll scare people into thinking their home is dangerously unsafe, sometimes actually creating damage during their "inspection." Often, these Storm Chasers just take the money and run. Or, if they do show up and make repairs, their work or materials are shoddy. This could leave you on the hook financially since your homeowners insurance probably won't cover unauthorized or fraudulent repairs. Here are a few tips from the Better Business Bureau to avoid becoming a Storm Chaser victim: Ask your insurance company about what's covered under your policy and specific filing requirements. Also ask

them to survey the damage and see whether they have approved contractors. Never hire a laborer or contractor on the spot. Get at least three estimates based on the same specifications and materials. Check their references, licensing and registration information with the National Association of State Contractors Licensing Agencies (www.nascla.org/licensing_information); also read reviews posted by the Better Business Bureau. Require written contracts that specify work to be done, materials to be used, start and end dates, responsibility for hauling away debris, and costs broken down by labor and materials. Verify that the contractor's name, address, phone number and license number are included, as well as any verbal promises and warranties. Read the fine print. Some shady contracts include clauses allowing substantial cancellation fees if you choose not to use the contractor after your insurance company has approved the claim. Others require you to pay the full price if you cancel after the cancellation period has expired. Ask your contractor to provide proof of current

insurance that covers workers compensation benefits, property damage and personal liability. You'll probably be asked to pay an upfront deposit to cover initial materials – one-quarter to one-third is reasonable upon delivery of materials to your home and once work begins. Never pay in full in advance, and don't pay cash. Have the contract specify a schedule for releasing payments, and before making the final payment, ask the contractor to provide proof that all subcontractors have been paid – if not, you could be liable for their fees. And finally, remember the adage, "If it sounds too good to be true, it probably is." If someone uses high-pressure sales tactics, requires full payment upfront, asks you to get necessary permits or offers to shave costs by using leftover materials from another job – run. Spiced Grilled Ham with Citrus Glaze Prep Time: 15 minutes Cook Time: 1 1/2 to 2 hours Yield: 12 to 14 (4-ounce) servings 6 to 7-pound fully-cooked bone-in ham, trimmed 1tablespoon ground coriander 1 tablespoon ground paprika 1 teaspoon ground cumin 1/2 teaspoon ground cinnamon 1/4 teaspoon ground cloves 1/4 cup lemon marmalade (or other citrus marmalade) 2 tablespoons orange juice 2 tablespoons packed brown sugar Preheat gas or charcoal grill to medium-hot (375F to 425F). Prepare grill for indirect cooking: For gas grill, turn off center burner; for charcoal grill, bank coals on either side; place a drip pan under grate between heat sources. Score a diamond pattern into ham, about 1/8 inch deep into any fat. In small bowl, combine coriander, paprika, cumin, cinnamon and cloves. Rub spice mixture over all sides of ham. Place ham, flat side down, in center of grill over drip pan. Cover and cook, adding briquettes as necessary to maintain heat, until internal temperature of ham reaches 140â&#x2C6;&#x17E;F, 1 1/2 to 2 hours or 15 to 18 minutes per pound. Meanwhile, in small bowl, combine marmalade, orange juice and sugar. Brush marmalade mixture over ham. Cover and grill 5 minutes, until glaze is lightly caramelized. Remove ham from grill, transfer to cutting board, and let rest 15 to 30 minutes. (Oven-roasting instructions can be found at www.porkbeinspired.com.)

Caramel Frozen Yogurt Pie with Grilled Peaches Prep Time: 20 minutes Cook Time: 15 minutes Yield: 8 to 10 servings 2 pints premium vanilla frozen yogurt 1 9-inch prepared graham cracker pie crust, or 8 individual graham cracker pie crusts 1 1/4 cups caramel sauce, storebought

2 tablespoons butter, melted 2 tablespoons dark brown sugar 6 ripe medium sized peaches, halved and pitted Transfer 1 pint of frozen yogurt from freezer to refrigerator to soften for 30 to 40 minutes. Preheat oven to 375F. Bake pie crust until lightly browned and crisp, about 10 minutes. Set aside to cool. To assemble pie, spread softened yogurt evenly over pie crust. Place in freezer and chill about 1 hour. When firm, spread about 3/4 cup caramel evenly over frozen yogurt. Return pie to the freezer, and transfer second pint of frozen yogurt to refrigerator. Allow pint to soften for 30 to 40 minutes. Spread second pint of yogurt evenly over caramel, making decorative swirls, if possible. Freeze until firm. Remove from freezer 10 minutes before serving. To grill peaches, prepare medium fire in a charcoal grill or preheat gas grill on medium. Melt butter and stir in brown sugar until dissolved. Toss peaches with butter mixture until well coated. Grill peaches directly over medium fire, cut-side up, until grill marks are visible, about 5 minutes. Turn peaches over and grill until grill marks show and peaches are tender, about 4 minutes longer. Set aside to cool. When cool, cut peaches into thick wedges. When ready to serve, cut pie into wedges and serve with peaches on the side. Drizzle a little of remaining caramel sauce over top.

Roasted Potatoes with Bacon and Goat Cheese Prep Time: 10 minutes Cook Time: 40 minutes Yield: 6 servings 1/2 pound bacon, sliced 12 small red potatoes, halved Olive oil 1/2 cup sour cream 1/4 cup goat cheese, plain 4 tablespoons green onions, sliced 1/4 cup Parmesan cheese, grated 3 tablespoons dill, snipped, plus dill for garnish 1/4 teaspoon seasoned salt

1/4 teaspoon pepper Heat oven to 450F. In large skillet, cook bacon over medium heat, turning to brown evenly, until crisp. Blot bacon on paper towels, mince and set aside. Brush cut surfaces of potatoes lightly with olive oil. Place potato halves cut side up on a shallow rimmed baking pan; bake until potatoes are tender and faces of potatoes are lightly browned, about 20 to 30 minutes. Meanwhile, in small bowl mash together sour cream and goat cheese, stir in minced bacon, onion, Parmesan, dill, salt and pepper. Top each potato with a spoonful, about 2 teaspoons, of sour cream mixture. Serve warm. Make-Ahead Tip: Roast potatoes before guests arrive; keep warm in the oven. Top with cheese mixture before serving.

Ham and Peas with Mint and Tarragon Prep Time: 10 minutes Cook Time: 10 minutes Yield: 4 to 6 servings 4 ounces cooked ham, cut into 1/4-inch dice 3 cups peas, fresh or frozen 3 tablespoons unsalted butter (1/2 stick) cut into 4 to 6 pieces 1/4 cup fresh mint, coarsely chopped, plus sprigs for garnish 2 tablespoons fresh tarragon, coarsely chopped, plus sprigs for garnish Salt and pepper to taste Bring medium saucepan of wellsalted water to a boil over high heat. Add peas and cook until tender, 3 to 8 minutes depending on size of peas. Drain peas, reserving 2 tablespoons cooking water. Return peas and cooking water to saucepan. Noteworthy Grand Jury has no recomendations for Rosamond Community Services District The Kern County Grand Jury recently released a report of its Law and Justice Committee. The committe visited the Rosamond Community Services District on Oct. 9, 2012, meeting with the district’s general manager. The committee reviewed agendas and minutes for April, June, July, and August of 2012, an independent auditor’s report for 2011 and 2012, California From 700 documents and information from the online website. The last report on the Rosamond

Community Services District was completed in 2002-2003. The mission of the RCSD is to provide safe drinking water that meets or exceeds all of the state and federal government standards; maintain a sewage treatment facility that disposes of waste in an effective and efficient manner and provide sufficient street lighting to the community. In 1966 the citizens of Rosamond voted to create the Rosamond Community Services District (RCSD) for the purpose of providing

water for domestic, irrigation and fire flow use, collection and treatment of waste and storm waters and for the maintenance of street lights. In 1998 the voters added two additional powers, graffiti abatement and parks and recreation to those originally approved in 1966. At the time the original district was approved a bond issue was authorized by the voters. A portion of the funds from the bond issue were used to build a waste collection and treatment system and two evaporation ponds.

Additional monies from the bond were used to purchase a local private water company and to make needed improvements to the water system. Repayment of the bonds was completed in 2003. Prior to 1982 the District had approximately 600 accounts and activities were handled by four full-time and one part-time employee. Today the district employs 17 full time employees and two parttime employees and manages over 5,000 accounts. The budget

According to James, “they have submitted their plans within the past week and their request for permit is in the works.” What about Walmart? James said currently the Walmart response is very preliminary. “We do have a schedule worked out. The amended EIR document is scheduled to be circulated for public review in late March to mid April,” he added. “We then have a 45-day waiting period for responses.” From there it will follow normal protocol call and go back to the Planning Commission, and then to the Tehachapi City Council if appealed. Walmart was originally approved by the City Planning Commission on Jan. 31, 2011. On Feb. 10, 2011, an appeal was filed, sending the matter to the City Council . On May 19, 2012, the City Council rejected the

appeal and approved Walmart. On June 17, 2011, Tehachapi First, an organization that grew out of opposition to the proposed Walmart store, filed a lawsuit challenging the approval of the approval At a hearing held on April 27, 2012 in Kern County Superior Court,Judge Kenneth Twisselman found the EIR to be deficient on two of 24 issues and that one of the findings concerning cumulative traffic impacts was also deficient. The court issued a judgement and Writ of Mandate, which instructed the city to step back and set aside its approval of the Walmart EIR and the related findings as well as the site plan review. At its regular meeting on Aug. 20, 2012, the Tehachapi City Council adopted a resolution setting aside the certification of the Walmart Environmental Impact Report and related actions taken on May 19, 2011. Since then the city has been working on amending the EIR.

The RCSD currently maintains nine wells, a tertiary waste water treatment facility, two parks, graffiti removal, 16 evaporation ponds, water banking and over 550 street lights. The district also handles Parks and Recreation and receives a small amount of funding (through the tax base) to maintain the pool at Williford Park. The district had been working in deficit when the GM was hired 18 months ago. The RCSD is an Enterprise District and does not have a general fund to pay debts. Instead, expenditures that exceed monies on hand are taken from reserves to pay. The Rosamond Community Services District is looking at solar power for the wastewater treatment plant and hopes to gain a $7 million savings to the district over a 25 year period. The graffiti removal is provided at no cost to the customer. The district has a public works truck equipped with a high pressure compressed air system able to remove the graffiti without damage to property. RCSD had not performed an inventory count on capital assets since 2007. In the June 2012 fiscal audit a formal procedure of inventory count was lacking. The district, however established a formal schedule for a year-end inventory count and has acquired software to implement the inventory counts. The June 2012 fiscal audit shows the district is managed responsibly and is not in deficit. The Grand Jury committee at this time had no recomendations for the Rosamond Community Services District.
