CONTRACT
CONTRATOS
The contract is to run for the period stated on the “Fibre Contract” signed by the client. By signing the contract the client accepts the following terms and conditions of the service.
El contrato pasa por el período expresado en el contrato “Contrato Fibra” firmado por el cliente. Firmando el contrato, el cliente acepta los términos y condiciones siguientes del servicio.
The contract comes in to effect from the date of the Fibre installation and will continue as a rolling contract until the client requests cancellation, giving the required notice of 1 calendar month via email to administration@telitec.net. Cancellation prior to the end of the contract will result in a cancellation fee, to be agreed by TC and accepted in full by the client.
El contrato empezará en la fecha de la instalación Fibra y la continuará como un contrato de renovación automática hasta que el cliente requiere la cancelación del mismo, dando la noticia con un mes de antelación a través de correo electrónico a administration@telitec.net. Si la cancelación se produce antes del final de contrato resultará en una multa o penalización, de acuerdo en los TC y aceptado todo por el cliente.
This contract may be amended by TC, including charges, at any given time. This contract may be transferred by TC to any such party deemed necessary. TC will endeavour to notify clients in advance of any changes.
Este contrato puede ser cambiado por TC, incluyendo las tarifas, en cualquier momento. Este contrato puede ser transferido por TC a alguno partido necesario. TC intentará notificar por adelantado a los clientes antes de cambiar las tarifas.
INSTALLLATION
INSTALACIÓN
Fibre will be deployed to the client’s property within a period of 8 weeks. The installation of the Fibre line will be carried out by a TC engineer or a third party engineer. Clients will be notified during the deployment stage and the provisioned installation date will be confirmed with the client. We will use all reasonable efforts to install and activate the service by the date agreed with the client and within the indicated time frame, however it should be noted that all dates are estimates and TC cannot guarantee that they will be met.
Fibra será puesta en la propiedad del cliente en un período de 8 semanas. La instalación estará hecha por un ingeniero de TC o un ingeniero de terceros. Los clientes serán notificados durante la etapa del despliegue y la fecha provisional de instalación será confirmada con el cliente. Intentaremos por todos los medios tratar de instalar y activar el servicio en la fecha acordada con el cliente y dentro del tiempo indicado, de todos modos debería tenerse en cuenta que todas las fechas son estimaciones y TC no puede garantizar que serán cumplidas.
The application and deployment may be delayed or rejected for the following causes;
La aplicación y el despliegue pueden ser retrasados o rechazado por las causas siguientes:
Force Majeure. External cabling not available. Internal cabling not available. Incompatibility with elements on the line. Coverage not available in the zone requested. Other causes identified by TC or a third party.
The client will need to provide a suitable location for equipment to be installed. If client / client’s representative or alternative arrangement is not met/present at the appointment for installation, TC reserves the right to charge a supplement of 50€.
Fuerza Mayor. Cableado externo no disponible. Cableado interno no disponible. Incompatibilidad con elementos en la línea. La cobertura no disponible en la zona requerida. Otras causas identificadas por TC o terceros.
El cliente tendrá que aportar un lugar adecuado para poder instalar el equipo. Si el representante del cliente o persona alternativa no se presenta en la cita para la instalación, TC reserva el derecho para retener depósito pagado del 50%.

SERVICIO
This service provides the client with Fibre high-speed access to the internet (FTTH, Fibre to the home).
Este servicio provee al cliente con Fibra de acceso muy rápido por el Internet (FTTH, Fibra para el hogar).
To ensure that the service remains safe and secure, any equipment connected to, or used with, the service must bear the European Consumer Equipment Standards “CE” mark and be used in compliance with all relevant instructions and security procedures. The client must take all reasonable precautions to ensure that nobody (including the client) makes use of the service for the following;
Fraudulently or in connection with a criminal offence. To send, knowingly receive, upload, download, or use any material which is offensive, abusive, indecent, defamatory, obscene, or in breach of copyright. To spam or to send or provide unsolicited advertising or promotional material, or knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party. In an unlawful manner, in contravention of any legislation, laws, license or third party rights. You may not redistribute or resell the TC Fibre services to a third party.
The Fibre service enables you to access the Internet. The internet is considered separate from the service and use of the Internet is at your own risk and subject to any applicable laws. TC has no responsibility for any goods, services, information, software or other materials which you may obtain when using the Internet. If TC cannot provide the service agreed in the contract due to matters beyond our reasonable control (including interference from a third party, faulty equipment or due to our service provider), TC shall not be held liable. TC do not compensate for loss of service. TC has no liability (whether in negligence or otherwise) for any loss not reasonably foreseeable by us when the contract begins, nor for any loss of opportunity, goodwill, reputation, business, revenue, profit or savings you expected to make, or data being lost or corrupted. Under no circumstances will TC guarantee or be held responsible in the event that the maximum speeds for the package contracted are not reached, either for technical reasons, line incompatibilities or other factors which are out of TC’s control. The Fibre service is provided by a third party company. The client will be provided with a VoIP telephone line (Voice Over Internet Protocol). This is not a landline and will run in conjunction with the Fibre service. Free minutes can be applied according to the monthly package selection. The free minutes are to Western European landlines only. Calls to mobiles and non-geographical numbers are not included. TC reserves the right to change the selection of countries included in the package at any time. The indicated speed of the chosen package is the maximum speed available, it is not guaranteed that the client will receive this speed. TC guarantees 10% of the maximum download speed and 10% of the maximum upload speed.
Para asegurar que el servicio permanece seguro, cualquier equipo conectado o usado con él, el servicio debe tener los estándares del equipo del consumidor europeo marca “CE” y debe ser usado de acuerdo con todas las instrucciones relevantes y los procedimientos de seguridad. El cliente debe tomar todas las precauciones para asegurar que nadie (incluyendo el cliente) hace uso del servicio para lo siguiente:
Fraudulentamente o en relación con un crimen Para enviar, subir, descargar, o usar algún material que es ofensivo, abusivo, inapropiado, difamatorio, obsceno, o infringe los derechos de autor Para enviar correo basura o enviar o proveer la publicidad o material promocional no solicitada, o recibir noticias por el spam, la publicidad o material promocional no solicitada enviada o proveída por un tercero. De un manera ilegal, en la infracción de algunas legislaciones, leyes o derechos del tercero. No debes redistribuir o revender los servicios de TC Fibra a un tercero.
El servicio Fibra te permite acceder a internet. El internet es considerado separado del servicio y el uso del internet será por tu propio riesgo y está sujeto a algunas leyes relevantes. TC no tiene responsabilidad ninguna para algunos productos, servicios, información, software u otro material que podrías obtener cuando usando el internet. Si TC no puede proveer el servicio acordado en el contrato debido a problemas que escapan a nuestro control (incluyendo intromisión de un tercero, equipo defectuoso o debido a nuestro proveedor de servicios), TC no se hace responsable. TC no compensa por ninguna pérdida de servicio. TC no tiene responsabilidad (ya sea por negligencia u otra causa) por pérdida alguna razonablemente previsible para nosotros cuando el contrato empiece, ni por ninguna pérdida de oportunidad, la buena voluntad, reputación, negocio, ingreso, ganancia o los ahorros que has esperado hacer o datos perdidos o corruptos. Bajo ninguna circunstancia, TC garantizará o se hará responsable en el intento de que la máxima velocidad del paquete contratado no se puede alcanzar, debido a razones técnicas, incompatibilidades de la línea u otros factores que están fuera del control de TC. El servicio Fibra es proveído por tercero. Al cliente se le proveerá con una línea VoIP de teléfono. Ésta no es una línea normal y hará conjunto con el servicio de Fibra. Minutos gratis podrán ser sumados en acuerdo con el paquete mensual seleccionado. Los minutos gratis serán sólo para las líneas del Oeste de Europa. Llamadas a móviles y números no geográficos no estarán incluidos. TC reserva el derecho para cambiar la selección de los países en el paquete en cualquier momento. La velocidad indicada del paquete elegido es la velocidad máxima disponible, no se garantiza que el cliente recibirá esta velocidad. TC garantiza el 10% de la velocidad máxima de bajada y el 10% de la velocidad máxima de subida.
