(Hereafter known as TC – En adelante TC)

Terminos y Condiciones

1. TC the service

1. El Servicio TC

1.1 The service provides you with fixed wireless high-speed access to the Internet and a range of Internet services and applications, including the option to purchase a TC VoIP telephone service.

1.1 Este servicio le proporciona conexión inalámbrica a Internet de alta velocidad, con diversos servicios asociados y aplicaciones, incluida la opción de contratar el servicio de teléfono TC vía VoIP.

2. When the Contract Begins

2. Cuando Comienza el Contrato

2.1 The contract comes into effect from the date of installation. No payments will be taken by TC until the system has been installed and is operating satisfactorily The initial payment shall include all installation costs (including peripherals) plus the first months usage pro-rata. Monthly payments shall be taken directly from the bank account or credit card of which the details have been given. Please note these payments shall be taken between the 23rd–5th of each month.

2.1 El contrato comienza a ser efectivo a partir de la fecha de instalación. No se producirá cobro alguno por parte de TC hasta que dicho servicio haya sido instalado y funcione satisfactoriamente. El pago inicial incluye el coste de la instalación (más periféricos) más la primera cuota prorrateada. La cuota mensual se paga por domiciliación bancaria o tarjeta de crédito facilitada por el cliente entre el día 25 y el día 05 de cada mes.

2.2 This contract is to run for the period stated on the final separate sheet signed by the client.

3. Prior to Service Connection

3. Previo a la Conexión del Servicio

3.1 If equipment needs to be installed at your premises, you will need to provide a suitable location for any equipment installed by TC.

3.1 Si el equipo requiere instalación en el domicilio del cliente, éste necesitará proporcionar a TC una dirección válida.

3.2 When the service is being activated at your premises it may be necessary for our engineers to alter the network settings of your PC.

3.2 Cuando el servicio sea activado en dicho domicilio, puede que sean necesarios ciertos ajustes en la configuración del ordenador del cliente.

3.3 We will use all reasonable efforts to activate the service by the date agreed with you by our office however it should be noted that all dates are estimates and TC cannot guarantee that they will be met.

3.3 TC utilizará todos los medios que sean oportunos para proceder a la activación del servicio en la fecha acordada con usted y nuestra oficina; sin embargo deberá tenerse en cuenta que todas las fechas serán estimativas y que TC no podrá garantizar el cumplimiento exacto de las mismas.

3.4 If client/clients representative or alternative arrangement is not met/present at the appointment for installation a charge of 50€ will be applied.

3.4 Si el cliente/representante de los clientes o arreglo alternativo no se cumple/presente en la cita para la instalación hay un suplemento aplicado de 50€.

4. Equipment

4. Equipo/s

4.1 To ensure that the service remains safe and secure, any equipment connected to, or used with, the service must bear the European Consumer Equipment Standards "CE" mark and be used in compliance with all relevant instructions and safety and security procedures.

4.1 Para que el servicio sea y permanezca seguro, cualquier equipo conectado (o en uso) dicho servicio debe llevar el distintivo “CE” (“Consumer Equipment Standards”) deberá ser utilizado bajo procedimientos e instrucciones de seguridad.

4.2 Legal title of the antenna equipment installed by TC (other than the 299€ P.A.Y.G. offer) shall remain the property of TC as part of this offer, unless otherwise stated in writing. Legal title of additional internal networking equipment sold to the customer as detailed on the final page of this contract will be transferred to the customer, together with the appropriate manufacturer’s warranties.

4.2 El equipo de antena instalado por TC (menos el contrato de prepago a 299€) será propiedad exclusiva de TC como parte de esta oferta, a menos que se especifique lo contrario. El equipo interno de red adicional que se venda al cliente, como se detalla al final de la página del presente contrato, será transferido al cliente, junto con las correspondientes garantías del fabricante.

4.3 All TC installations will be carried out to the highest standard and all equipment will be aligned, tightened and fixed to the best endeavours of the TC engineer. We will ensure that the best reception of the available signal is received. Signal can be lost due to any of the following reasons; equipment moving during adverse weather conditions or equipment being physically moved or damaged. Realignment of the equipment is NOT covered by the TC warranty and any necessary realignment of the equipment will be payable by the client.

4.3 Todas las instalaciones de TC se llevará a cabo al nivel más alto y todo el equipo estará alineado, apretado y fijado a los mejores esfuerzos de los ingenieros de TC. Nos aseguramos de que la mejor recepción de la señal disponible estará recibida. La señal puede ser perdido debido a una de las siguientes razones; movimiento causado durante adversas condiciones climáticas o movimientos físicos o dañosos. Alineación del equipo NO está cubierto por la garantía TC y cualquier reajuste necesario del equipo se carga al cliente.

4.4 Manufacturer’s Warranty DOES NOT include damage caused from electrical power surge, prolonged low voltage or acts of nature, such as lightening etc. (These can severely limit and damage your connection and equipment). TC require customers purchase and use surge protection for the equipment installed or ideally install a UPS (Uninterrupted Power Supply).

4.4 Las garantías del fabricante NO INCLUYEN daños causados por fallos provenientes de adaptadores eléctricos, prolongadores de bajo voltaje o causas de fuerza mayor (rayos, tormentas, etc.; éstos pueden dañar severamente conexiones y equipos) Por ello, TC requerirá por parte de los clientes la compra y el uso de una regleta protectora contra picos para los equipos contratados o idealmente un S.A.I. (Sistema de Alimentación Interrumpida).

4.5 In the event of an antenna needing replacing either after 24 month warranty period (Or within the 24 month warranty period but due to reasons described in 4.3). A subsidiary fee of 99€ will be charged to the client. (In such circumstances TC advise clients to claim against their household insurance policies).

4.5 En caso de que una antena deba ser reemplazada tras el período de garantía de 24 meses o bien dentro de dicho período de garantía, por las razones descritas en el punto 4.3, se cobraría al cliente un importe secundario de 99€ (en tales circunstancias TC notificará al cliente la reclamación contra las políticas del seguro del propietario del edificio/domicilio).

4.6 Where the customer cancels this contract after the minimum agreed term TC will arrange to de- install and collect its connection equipment. The customer cannot cancel the contract until the contract period has expired. If the contract period has not been fulfilled then an early cancellation fee option of 100€ +IVA will be applied. This fee must be paid by credit card or cash and will be taken automatically if there is no response from the customer.

4.6 Tras la cancelación del contrato por parte del cliente después del periodo establecido, TC organizará la desinstalación y recolección del/los equipo/s de conexión. El cliente no podrá cancelar el contrato hasta que el periodo de permanencia haya terminado. En el caso de no haber cumplido dicho periodo, TC aplicará un cargo adicional de 100€ +IVA. Dicho cargo deberá ser abonado en efectivo o por tarjeta de crédito y se cobrará automáticamente si no hubiera respuesta del cliente.

4.7 Telitec will contact the client to arrange collection of the antenna within a period of 36 months from cancellation date. Client is responsible for ensuring Telitec has access to recover the antenna during this time period. 4.8 Collection of equipment, if a piece of equipment is missing there will be a deduction of: Missing pole - 20€, Missing cable - 30€, Missing bracket - 20€.

4.7 Telitec se pondrá en contacto con el cliente para organizar la colección de la antena dentro de un período de 36 meses a partir de la fecha de cancelación. El cliente es responsable de garantizar que Telitec tenga acceso para recuperar la antena durante este período de tiempo.

4.9 Equipment is subject to wear and tear which may decrease or deplete any holding deposit. Where the equipment cannot be refurbished the deposit may not be reimbursed.

4.8 Recoger equipo/s, si falta una parte del equipo/s inicial habrá una deducción de: Falta palo - 20€, Falta cable - 30€, Falta soporte - 20€.

4.10 Required work or removal of antenna equipment must be carried out by an authorised TC engineer. TC does not allow permission for unauthorised personnel to access the antenna equipment.

4.9 El equipo está sujeto a desgaste que puede disminuir o agotar en cualquier depósito. Cuando el equipo no puede ser reformado el depósito no puede ser reembolsado. 4.10 Para cualquier trabajo o recoger equipo de la antena debe ser hecho por un técnico autorizado por TC. TC no deja permiso o acceso a la antena para personas que no son autorizados de TC.

5. Access to Your Premises

5. Acceso al Domicilio del cliente

5.1 From time to time TC (or our agents) may require access to your premises (e.g. repairs, maintenance or upgrades). If access is required, when possible TC will provide advance notice. In a situation of emergency, to collect and remove equipment, or if the customer cannot be contacted TC will proceed to access the property. It is expected reasonable requirements concerning the safety of people on your premises is met by both parties.

5.1 De vez en cuando, TC (y sus agentes autorizados) requerirán acceder al domicilio del cliente (por ejemplo: reparaciones, mantenimiento o ampliaciones). Si se requiere dicho acceso, cuando es posible TC deberá notificarlo con anterioridad. Para situaciones de emergencia, para recoger equipo, o si no es posible contactar con el cliente TC se procederá tener acceso a su domicilio. El cliente autorizará la entrada al domicilio y salvaguardará la seguridad de ambas partes en dicho domicilio.

6. Ensuring that the Service Is Secure

6. Seguridad del Servicio

6.1 TC may provide you with a set of usernames and passwords. These are for your secure use of the service. You must make sure that they are kept confidential, secure, and are used in accordance with all relevant instructions.

6.1 TC proveerá al cliente usuarios y contraseñas para un uso seguro del servicio. El cliente deberá mantenerlos de manera confidencial, a salvo y para un uso en concordancia con las instrucciones que resulten relevantes.

6.2 To ensure that the service remains secure, you must not change or attempt to change a username or password.

6.2 Para asegurar que el servicio permanece seguro, el cliente no cambiará o intentará cambiar ni el usuario ni la contraseña.

6.3 If we consider that there is likely to be a breach of security, or misuse of the service, we may:

6.3 Si TC considerara que existe un incumplimiento de seguridad o mal uso del servicio: (a) Se procederá al cambio de contraseña y se notificará dicha acción al cliente; y/o

(a) Change your password and then notify you that we have done this; and /or (b) Se procederá a la suspensión del usuario y contraseña del cliente de acceso al servicio (véase el párrafo 14)

(b) Suspend your username and password access to the service (please also refer to paragraph 13)

6.4 Si el cliente sospechara que su usuario o contraseña estuvieran bajo conocimiento de terceros sin autorización, o si cualquier contraseña fuera a ser o haya sido utilizada, pondrá inmediatamente en conocimiento a TC.

6.4 If you suspect that any username or password has become known to someone not authorised to use it, or if any password is being used, or is likely to be used, in an unauthorised manner, you are advised to contact TC immediately.

6.5 Se notificará inmediatamente a TC cualquier cambio en los datos proporcionados (postales, bancarios, etc.), durante o tras la firma del contrato.

6.5 If any of information that you provide when signing up for the service, including any changes to your payment details email address, is changed at a later date, you must inform TC immediately. 7. Other Factors within This Agreement

7. Demás Factores en el Presente Acuerdo

7.1 TC may need to temporarily suspend the service for operational reasons (e.g. for planned maintenance, repairs or upgrades) TC will endeavour to give reasonable notice and restore the service as soon as possible after any such suspension.

7.1 TC necesitará en determinadas ocasiones proceder a la suspensión temporal del servicio por motivos de mantenimiento, reparación o ampliaciones. TC procurará restablecer el servicio en el menor plazo de tiempo posible tras cualquier suspensión.

7.2 TC may need to alter code or access details or technical specifications associated with the service for operational reasons.

7.2 TC necesitará en alguna ocasión alterar los datos de acceso, código o ciertas especificaciones asociadas al servicio por cuestiones técnicas.

7.2.1 TC will not be responsible or liable for loss of service caused by interference from a third party or another provider, even if the equipment is produced or manufactured by the same provider.

7.2.1 TC no será responsable de ninguna pérdida de servicio, ocasionada por interferencias por parte de terceros o de algún otro proveedor, bien sea el fabricante del/los equipo/s o bien el mismo proveedor.

7.3 TC may provide you with instructions when using the service or about your use of the service, to ensure the quality of the service we provide to you and other customers; and you agree to observe them.

7.3 TC proporcionará al cliente instrucciones a cerca del uso del servicio, con objeto de asegurar un correcto funcionamiento y calidad del mismo; el cliente deberá atender a dichas instrucciones.

7.4 Fair Use Policy - TC wants customers to get the most out of their broadband service. That is why TC does not restrict the speed available to individual users any more than the restrictions applied by the connection type contracted and why we only apply traffic management controls to peak time P2P traffic or any services that require continued high usage of bandwidth, which is not time critical and can run at full speed during the off peak period.

7.4 Normas de Uso Justo - Es intención de TC que los clientes obtengan al mayor provecho de su conexión a Internet. Por este motivo, TC no aplicará más restricciones de velocidad disponible al usuario final que las dictadas por el tipo de conexión contratada. Así mismo, solo se aplicarán controles de tráfico P2P en horas punta o en aquellos servicios que requiera un uso elevado y continuado de banda ancha; servicios que no sean extremos y que puedan llevarse a cabo en velocidades elevadas en fueras de horas punta.

7.5 TC may be required to carry out work, either on site (i.e. customer premises) or the offices of TC, as such TC cannot be held responsible for any data loss.

7.5 TC requerirá el cumplimiento de ciertos trabajos, bien en un lugar en concreto (por ejemplo en el domicilio del cliente), bien desde sus propias instalaciones, y no se hará responsable pérdida de datos alguna.

7.6 TC may provide advice on replacement / upgrading of any components and or computers systems etc. in the event of it becoming necessary for the adequate functioning of the network provided by TC.

7.6 TC notificará el reemplazo o ampliación de cualquier componente o sistemas informáticos en caso de que sea necesario para un correcto funcionamiento de la red.

7.7 The indicated speed of the package chosen is the maximum speed available, not a guaranteed connection speed. TC guarantees only 10% of the maximum Download and only 10% of the maximum Upload, at any time, of any of the packages indicated at paragraph 18.

7.7 La velocidad indicada del plan escogido es la máxima disponible, no una velocidad de conexión garantizada. TC le da una garantía de solo 10% de la velocidad de bajada máxima, y solo 10% de la velocidad de subida máxima, en cualquier tiempo por cualquier de los paquetes indicados en parágrafo 18.

8. Repairing Service Faults

8. Reparaciones en el Servicio

8.1 Although TC shall attempt to provide you with the best possible service, we cannot guarantee that the service will be operational at all times. However, TC shall attempt to correct all reported faults as soon as reasonably possible.

8.1 Aunque TC intentará proveer del mejor servicio posible al cliente, no se garantizará que dicho servicio se encuentre siempre operativo. Sin embargo, TC tratará de corregir cualquier fallo tan pronto como sea posible (Véase el acuerdo sobre el Nivel del Servicio de TC).

9. Charges

9. Costes

9.1 It is agreed that all charges for any equipment you purchase from TC and the services provided are payable in full by you.

9.2 All payments remain due in the event of a subsequent fault being reported.

9.3 Administration charges apply for declined payments.

9.4 Moving equipment from one home to another is chargeable at 90€ +IVA. 9.4 El traslado de un equipo a otro domicilio tendrá un coste de 90€ +IVA. 9.5 Any direct debits returned by your bank will incur a 10€ charge. 9.5 Se cobrará 10€ para cualquier recibo devuelto por su entidad bancaria. 9.6 If a monthly payment is rejected from your bank account, it may be taken from a credit card given to us if we are unable to contact you to make other arrangements.

9.6 Si el recibo de la cuota mensual fuera devuelto por su banco y no conseguimos hablar con usted para solucionar el problema, reservamos el derecho de cargar la cuota en la tarjeta proporcionada.

9.7 Only card or cash will be accepted as method of payment for installation and/or equipment.

9.7 Solo se aceptará tarjeta o efectivo como método de pago para instalación y/o equipos.

10. Service Use

10. Uso del Servicio

10.1 You must take all reasonable precautions to ensure that nobody (including you) makes use of the service:

10.1 El cliente tomará las debidas precauciones para asegurar el uso incorrecto del servicio o bien por parte de un tercero:

(a) Fraudulently or in connection with a criminal offence;

(a) Uso fraudulento o en relación a cualquier delito criminal;

(b) To send, knowingly receive, upload, download, or use any material which is offensive, abusive, Indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights;

(b) Para el envío, recepción, subida, descarga o utilización de cualquier material que resulte ofensivo, abusivo, indecente, difamatorio, obsceno o amenazador, o rompa cualquier término del copyright, confidencialidad, privacidad o cualquier otro derecho;

(d) To spam or to send or provide unsolicited advertising or promotional material or, knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party;

(d) Promover o enviar correo no deseado (spam) o proveer de material publicitario o promocional o recibir así mismo spam, publicidad o material no solicitado, remitido o por parte de un tercero;

(e) In any way which, in our opinion, is or is likely to be detrimental to the provision of the service to you or any of our customers;

(e) Cualquier otra actuación que se considere perjudicial para la provisión del servicio al/los cliente/s;

(f) In an unlawful manner, in contravention of any legislation, laws, license or third party rights, or in contravention of our Acceptable Use Policies. Amended from time to time; or

(f) Cualquier actuación ilícita, en contraposición con la legislación, leyes, licencias o derechos de terceros, o bien en contraposición con nuestras Políticas de Aceptación de Uso.

(g) In a way that does not comply with any instructions provided to you;

(g) Cualquier actuación que no cumpla con las instrucciones que se proporciona al/los cliente/s;

(h) You may not redistribute the TC services to a third party. (h) El/los cliente/s no re-distribuirá los servicios de TC a ningún tercero. Any breach of paragraphs 10.1 (a)-(h) may result in action or actions explained in paragraph 12 and 13.

El incumplimiento de cualquiera de los párrafos anteriormente expuestos en el punto 10.1 incurrirá a acciones expresadas en los puntos 12 y 13.

10.2 TC may make software available to you that will enable you to use the service. This software must not be copied or modified by you or anyone else unless allowed by law. It is important that you access the service only via use of this software, or in an alternative way permitted by TC, and you must not attempt to circumvent any security measures inherent in the service.

10.2 TC proporcionará al cliente el software necesario para el uso del servicio. Dicho software no podrá ser copiado o modificado por el cliente o por ningún tercero, a menos que esté permitido por ley. Es importante el cliente acceda al servicio mediante el uso exclusivo de este software o, como excepción, mediante otro procedimiento admitido y aceptado por TC, sin intento de sortear las medidas de seguridad establecidas por parte de TC.

10.3 The service TC supplies to you, and any associated software, is intended for your use only. Therefore, the service (or any part of it) or the associated software, must not be re-sold, transferred, assigned or sub-licensed to anyone else unless permission has been given in writing.

10.3 El servicio proporcionado por TC es para uso exclusivo del cliente que lo contrata. Por ello, no se permitirá la re-venta, transferencia, asignación o sub-licencia de dicho servicio (y/o cualquier parte del mismo) o el software asociado, a menos que sea conceda permiso por escrito.

11. Your Internet Use

11. Uso de Internet

11.1 The service enables you to access the Internet. The Internet is separate from the service and use of the Internet is at your own risk and subject to any applicable laws. We have no responsibility for any goods, services, information, software, or other materials which you may obtain when using the Internet.

11.1 El servicio permite al cliente el acceso a Internet. Dicho acceso no está vinculado al servicio y uso de Internet, bajo el propio riesgo del cliente y sujeto a las leyes establecidas. TC no tendrá responsabilidad sobre bienes, servicios, información, software u otro material que puedan ser obtenidos por medio de Internet.

12. Breach of Contract

12. Incumplimiento de Contrato

12.1 TC may suspend the service or end this contract (or both) at any time:

12.1 TC suspenderá el servicio o finalizará el presente contrato (o ambos):

(a) With immediate effect if you materially breach this contract;

(a) Con efecto inmediato cuando se rompa materialmente el presente contrato;

(b) with immediate effect if TC believes that the service is being used in a way as described in paragraph 10.1, even if you do not know that the service is being used in such a way;

(b) Con efecto inmediato cuando TC crea que el servicio ha sido utilizado bajo los términos descritos en el punto 10.1, incluso en el caso en que el cliente desconociera que el servicio ha sido utilizado a tales efectos;

(c) Upon reasonable notice if you breach this contract in any other way and fail to remedy the breach within a reasonable period of being asked to do so.

(c) Bajo notificación pertinente si el cliente incumpliera el presente contrato por cualquier otra vía y no se remediara dicho incumplimiento dentro de un plazo de tiempo razonable.

12.2 If TC suspends or terminates this contract under paragraphs 13.1, we will inform you of such suspension or termination as soon as reasonably possible and explain why this action has been taken.

12.2 En el caso en que TC suspendiera o finalizara el presente contrato bajo los términos descritos en el punto 13.1, se notificará al cliente de tal suspensión o finalización tan pronto como sea posible y se le pondrá en conocimiento acerca de los motivos que han dado lugar a tal actuación.

13. Suspension of the Service

13. Suspensión del Servicio

13.1 In the event that TC chooses to suspend the service or a password or username for any reason, TC will restore the service only if adequate guarantees have been given by you that the service will be used as per agreement.

13.1 En caso de que, por cualquier motivo, TC decida suspender el servicio, contraseña o usuario, TC restablecerá dicho servicio únicamente si el cliente proporciona las garantías necesarias de que se hará uso del servicio de acuerdo a lo acordado.

13.2 If we choose to suspend the service under paragraph 13, this contract will continue during the period of suspension and you will be required to pay all relevant charges.

13.2 Si se decidiera suspender el servicio de acuerdo a lo expuesto en el punto 13, el contrato seguiría vigente durante el tiempo de suspensión, solicitando al cliente el pago de cualquier importe que resultara relevante.

14. Matters Beyond our Reasonable Control

14. Motivos Ajenos al Control de TC

14.1 If TC cannot do what has been agreed in this contract due to matters beyond its reasonable control (including, interference from third party, faulty equipment or due to our service provider), TC shall not be held liable. TC do not compensate for such claims.

14.1 Si TC no pudiera cumplir con lo que había sido acordado en el presente contrato por motivos ajenos al control de TC (incluyendo interferencias por parte de terceros, equipos defectuosos o por parte de nuestro proveedor), TC no se hará responsable. TC no compensan tales reclamaciones.

15. Our Liability to You

15. Responsabilidad ante el Cliente

15.1 We have no liability (whether in negligence or otherwise) for any loss not reasonably foreseeable by us when this contract begins, nor for any loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure, or data being lost or corrupted.

15.1 TC no tendrá responsabilidad alguna ante cualquier pérdida no previsible al comienzo del presente contrato, ni por cualquier pérdida de oportunidad, voluntad, reputación, negocio, margen, beneficio o ahorro que el cliente esperara obtener, cualquier desembolso o información que haya sido perdida o corrompida.

15.2 TC does not have liability of any sort for the acts or omissions of other providers of telecommunication services and telecommunications and network equipment, or for faults in (or failures of) their networks and equipment.

15.2 TC no tendrá responsabilidad alguna ante los actos u omisiones de otros proveedores de servicios de telecomunicaciones y equipos de red, o fallos en sus redes y equipos. 15.3 TC no tendrá responsabilidad alguna (incluido para negligencia) para cambios realizados por usted o nuestro proveedor de comunicaciones que resulta en la cesión de su conexión internet y entonces este servicio.

15.3 TC does not have any liability of any sort (including liability for negligence) for changes made by you or our telecommunications provider which result in the cessation of your internet connection and therefore this service.

15.4 Cada provisión de párrafo 15 se entiende por separada y aparte de las demás. 15.4 Each provision of paragraph 15 operates separately in itself and survives independently of the others.

16. Terminating this Contract

16. Finalización del Contrato

16.1 This contract may be cancelled via email to administration@telitec.net or in writing via post or handed in directly to our Moraira office at the address detailed on the T&C´s giving the minimum required cancellation period as outlaid in the T&C´s.

16.1 El presente contrato podrá ser cancelado por email a administration@telitec.net, por escrito mandado por correo o entregado directamente a nuestra oficina en Moraira a la dirección indicada, respetando el período de cancelación.

16.2 This contract will automatically continue until notice of cancellation.

16.5 We reserve the right to apply a cancellation fee if the client cancels the contract before the expired date.

17. Amendment of Contract

17.1 This contract may be amended by TC, including charges, at any time. This contract may be transferred by TC to any such party deemed necessary.

17.1 El presente contrato podrá ser enmendado por TC, incluyendo costes, en cualquier momento. Este contrato podrá ser entregado a terceras partes cuando se considere necesario.

18. Indicated Package Speed

18.1 The indicated speed of the package chosen is defined by the upload and download capacity combined.

19. Email

19.1 You are responsible for checking the mail sent to the e-mail address you provided us with. TC can provide customers with one yourname@telitec.com email address per person upon request.

20. Waiver

20.1 Neither party shall be considered to have waived its rights under this contract because of failure or delay to exercise any such right.

20.1 Ninguna de las partes debería considerar la renuncia a sus derechos en el presente contrato por motivos de fallo o retraso en el ejercicio de cualquier derecho.

21. Third Party Rights

21. Derechos a Terceros

21.1 A person who is not a party to this contract has no right under the contract.

21.1 La persona que no forme parte del presente contrato, no tendrá derecho alguno a los términos descritos en éste.

22. The Law That Relates To This Contract

22. Ley a la que está Sujeta este Contrato

22.1 This contract is governed by Spanish Law and we both agree to the exclusive jurisdiction of the Spanish courts.

22.1 Este contrato está sujeto a las Leyes Españolas y ambas partes acuerdan someterse a la jurisdicción de los juzgados españoles.

23 Invoices

23. Facturación

23.1 In order to keep the cost of service down, invoices will be e-mailed to customers on request. The customer agrees to accept emailed invoices. All payment for internet services will be in advance. Late payment notices will be emailed to customer. If payment is not received within 1 week of late payment notice, service will be disconnected. A re-connect fee of 50€ +IVA will be charged for resumption of service. Customers who persist with late payments may have service terminated permanently at the discretion of TC.

23.1 Con intención de mantener un menor coste, las facturas serán remitidas a los clientes por petición mediante correo electrónico (email). El cliente acepta dicho envío. El pago por los servicios será por adelantado. Cualquier impago será notificado por medio de correo electrónico. Si no se produjera el pago durante la semana posterior a la notificación pertinente, se procederá a la desconexión del servicio. Se abonará el importe de 50€ +IVA como cuota por re-conexión de dicho servicio. Tras repetidos impagos, TC podrá proceder a la desconexión permanente del servicio si así lo considerara oportuno.

23.2 In the event of continued non-payment TC will pass client details to an international debt recovery unit for further action.

23.2 En caso de falta de pago continuo, TC pasará los datos del cliente a una entidad de recuperación de deudas internacional para que se hagan cargo.

24. Advance Internet Subscription Payment

24. Pagos por Adelantado en Suscripción de Internet

24.1 Under this offer the agreed contracted monthly internet payments of the subscription rate outlined on the final page of this agreement are due as a one off advanced payment.

24.1 En virtud de esta oferta, las cuotas pactadas (detalladas en la última página) en el presente contrato se abonarán en un solo pago, por adelantado.

25. VoIP Telephone Service

25. Servicio de Telefonía VoIP

25.1 Free minute packages can be applied according to the monthly package selection. The free minutes are to western European landlines only. Calls to mobiles and non-geographical numbers are NOT included.

25.1 Paquetes de llamadas gratuitas se pueden aplicar según la selección de mensualidad. Las llamadas gratuitas se aplican solo a fijos de Europa Occidental. Llamadas a móviles y nogeográficas NO SON incluidas.

25.2 The standard free minute allowance applied to packages with a 96 number selected is 300 minutes. The package including unlimited calls to western European landlines is subject to a fair use policy of up to 1000 minutes per month.

25.2 El paquete que incluye llamadas ilimitadas a fijos de Europa Occidental está sujeto a unas normas de uso justo en la forma de un máximo de 1000 minutos al mes.

25.3 All free minutes are to selected European landlines and we reserve the right to change these at any time. Please note that if the VoIP telephone option is taken this cannot be suspended. (However it can be taken and used in another worldwide location with a broadband service). TC do NOT recommend cancelling a standard landline for a VoIP line OR to be dependant for VoIP as a business line. TC cannot be held responsible for any loss of business or revenue caused by any lost communication and do not offer any form of compensation for such instances. Due to the nature of the way the system works, it is not possible to dial emergency services from a VoIP telephone.

25.3 Todos los minutos gratuitos son para selectos países de Europa y reservamos el derecho de cambiarlos en cualquier momento. Destacar que una vez se ha escogido la opción de telefonía VoIP, ésta no puede ser suspendida. (Sin embargo, podría ser utilizada desde distinta ubicación mediante servicio de banda ancha). TC no recomienda la cancelación de una línea fija existente al favor de una línea VoIP o depender de una línea VoIP para un negocio. TC no se responsabiliza para pérdidas de llamadas o ganancias causadas por fallos en comunicación y no ofrece compensación bajo dichas circunstancias. Debido a la manera en que funciona el sistema, no es posible marcar números de servicios de emergencia desde un teléfono VoIP.

26. Suspension Contract

26. Contrato de Suspensión

26.1 The 6 month contract -service can be suspended for up to 6 months per contracted year after the first six months of full service.

26.1 Con el contrato de 6 meses- se puede suspender el servicio para hasta seis meses por año de contrato después de los primeros seis meses de servicio.

26.2 The contract can be suspended per calendar month after the contract period has exceeded the minimum required period. Notice to suspend must be given via email (administration@telitec.net) 1 calendar month before the required suspension period.

26.2 Se puede suspender el servicio por mes calendario solo cuando se excede el periodo mínimo del contrato. Solicitud de suspender el servicio se debe enviar por email (administration@telitec.net) 1 mes calendario antes del periodo de suspensión solicitado.

27. PAYG Contract

27. Contrato de Prepago

27.1 No minimum usage, paid in advance via credit or debit card. Payment details can either be given at the time of signing the contract (a password will be supplied) or by another credit or debit card prior to being switched on.

27.1 Sin consumo mínimo, prepago con tarjeta de crédito o débito. Se puede facilitar los datos de la forma de pago al firmar el contrato (se proporcionaría una contraseña de seguridad) o bien por otra tarjeta de crédito o débito antes de solicitar la conexión del servicio.

28. Rental Property Contract

28. Contrato tipo Alquiler

28.1 Contract period of minimum 11 months, to correspond with rental agreement if available.

28.1 Contrato con periodo mínimo de 11 meses, correspondiente al contrato de alquiler.

28.2 This is a running contract and will not be terminated after the 11 month period unless the required notice is given to cancel (1 calendar month). Customer has the option to renew the contract for a further 11 months with TC and receive 1 free month. Please refer to paragraph 9.4 for details on relocation of equipment.

28.2 El contrato continúa y no cancelamos hasta recibir solicitud del cliente, a menos que la notificación requerida se da a cancelar (1 mes calendario). Tiene la opción para renovar el contrato con regalo de 2 mensualidades gratuitas. Refiere al parágrafo 9.4 para información sobre reubicación del equipo.

29. Landline Calls Contract

29. Contrato con Llamadas de Línea Fija

29.1 The reduced monthly payments of 24.99€ will remain in force as long as the landline calls are routed through TC.

29.1 La cuota reducida de 24.99€ permanecerá en vigor siempre y cuando las llamadas de línea fija sean a través de TC.

29.2 If the minimum call spend of 5€ applied to this reduction is not reached for 3 consecutive months or if the landline call routing is cancelled for any reason, the monthly payments will be increased to 29.99€.

29.2 Si la llamada es una inversión mínima de 5€ se aplica a esta oferta no se alcanza durante 3 meses consecutivos o si la llamada de teléfono fijo de enrutamiento se cancela por cualquier razón, los pagos mensuales se incrementarán a 29.99€.

30. Extras

30. Cargos Adicionales

While every endeavour will be made not to add any ´extra´ charges to the installations, any installations deemed ´beyond standard´ are chargeable at 30€ per hour labour plus 1.50€ per meter of cable. A standard installation is to place the antenna as advised by the TC engineer at installation and then to cable externally and terminate in one desired room.

Intentaremos no añadir cargos adicionales al coste de la instalación. Sin embargo, si la instalación no fuera considerada como estándar, se cobrará 30€ por hora mano de obra más 1.50€ por metro de cable. Una instalación estándar consiste en colocar la antena en el sitio recomendado por el técnico y correr el cable por la pared exterior con conexión en una sola habitación, elegida por el cliente.
