On April 16, Baylor College of Dentistry held ADA National Signing Day, which will be featured in the May 2014 TDA Today.
Robert Truitt Maberry Sr, DDS, 89, of Abilene, and formerly of Fort Worth, died April 2, 2014. His funeral and interment were April 7, 2014. Dr Maberry was born November 25, 1924, in Pritchett. He graduated from Gilmer High School and East Texas State Teachers College (now Texas A&M at Commerce) where he earned a bachelor of science degree in chemistry. He was accepted to Maberry both medical and dental schools but graduated from the University of Texas Dental Branch at Houston in 1947 with a dental degree. Then 22, he set up his first dental practice in Teague. He married Joan Davis in 1948, and the couple had 4 sons. He served in the U.S. Navy and was stationed at San Diego. Following his discharge in 1952, he moved his family to Fort Worth, practicing there until he retired in 2006. He served as president of the Fort Worth District Dental Society and the TDA, as well as the editor of the TDA. He was elected as a Fellow of the American College of Dentists and the International Society of
Dentists and was a member of the Southwest Prosthetics Association. In his personal life, he was a respected musician, playing his way through dental school. He enjoyed photography and was a Mason and a Shriner. Dr Maberry was a member of First Presbyterian Church in Abilene. Survivors are his wife of 65 years, Joan Maberry; sons, Robert Maberry Jr, DDS, PhD, and wife, Anita, Phillip Davis Maberry, and Mark Maberry, MD, all of Abilene, and James Michael Maberry of Cleburne; brother, James Douglas Maberry, MD, of Fort Worth; 2 grandchildren; and 4 greatgrandchildren. The family asks that memorials be made to the Alzheimer’s Association, TDA Smiles Foundation, or First Central Presbyterian Church of Abilene. Texas Dental Program Medicaid/CHIP Message from the Health and Human Services Commission While the Texas Health and Human Services Commission (HHSC) is still moving forward with the goal of unbundling D0145 (First Dental Home), the implementation of this unbundling has been delayed and will not be effective April 1, 2014. Please note that due to this delay, the changes proposed at the February 17, 2014, rate hearing are on hold and the caries risk assessment codes will continue to pay at $0 until the unbundling changes occur. While HHSC does not yet have a new target date, we will provide timely updates on this implementation regularly to prepare providers for potential changes.
Affordable Care Act Medicaid Provider Credentialing Requirements As of January 1, 2013, all Texas Medicaid dentist providers must re-enroll in Texas Medicaid at least every 5 years. All providers who were enrolled in Texas Medicaid BEFORE January 1, 2013, must complete the re-enrollment process by March 24, 2016. HHSC recommends that providers begin the reenrollment process as early as possible. Reenrollment includes the submission of a new Texas Medicaid Provider Enrollment Application and all additional documentation so that the provider may continue to participate in Texas Medicaid.
Sales and Use Tax: Texas Comptroller of Public Accounts Whether sales and use taxes apply to your dental practice depends on the specific situation of your practice. If you sell tangible personal property such as toothpaste and toothbrushes and purchase tangible personal property such as dental equipment or gloves, then your practice is likely subject to sales and use taxes. Although most drugs and medical supplies and equipment sold or dispensed in the dental office are exempt from sales tax, the dentist owes taxes on non-exempt tangible personal property used to provide dental services. Sales and use taxes apply at different times. For example, generally speaking, sales taxes refer to taxes collected from the patient at the time non-exempt items are purchased in your dental office. Use taxes are remitted by you to the comptroller if you purchased a taxable item and did not pay sales tax on it. Tax Code §151.313 Health Care Supplies includes a sales and use tax exemption for over-the-counter drugs or medicines. Comptroller Rule 3.284 Drugs, Medicines, Medical Equipment, and Devices (34 Texas Administrative Code §3.284(a)(6)) defines an over-the-counter “drug or medicine” as a product that: • is intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease, illness, injury or pain; • is applied to the human body or is a product that a human ingests or inhales; is not an appliance or device; • is not food; or, • is labeled or required to be labeled with a “Drug Facts” panel in accordance with regulations of the federal Food and Drug Administration. Additionally, dental appliances including implants, dentures and splints, also are exempt from Texas sales tax. Comptroller Rule 3.284 (34 Texas Administrative Code §3.284 (a) (4)) defines “dental device” as an artificial replacement of one or more teeth or a dental appliance worn on the teeth to correct irregularities of growth or position. However, the term “dental device” does not include toothbrushes, toothpaste, dental floss, mouth mirrors or other devices used to prevent cavities or plaque build-up or removal. The rule also states that sales tax is not due on the sale, lease, or rental of medical equipment meeting the definition of a dental device. The Comptroller’s staff addressed the taxability of a variety of specific products listed below. They recommend that items designated as taxable should be purchased tax-paid (or accrued and reported as a taxable purchase) by the dental office.

DentaQuest will initiate contact with providers approximately six months prior to expiration of the credentialing to start the process. Providers should make sure that their email address and mailing address is current with DentaQuest. In addition, DentaQuest will need to make sure that your roster of dentists is current. Failure to do any of the aforementioned could delay or create other issues with re-credentialing. Dentists Who Care (DWC), recipient of The Governor’s Award for the Best Charity Organization in Texas in 1999, is a non-profit charity organization that was created in 1996 to help address the issue of poor oral health among indigent children of the Rio Grande Valley. DWC’s mission is to provide for the dental needs of children who have no money, no Medicaid, and no dental insurance. This mission is accomplished through the utilization of a Mobile Dental Unit and the award-winning Charity Dental Voucher Program.

It is important that we dentists serve as the pillars of our communities, and volunteering our time is one way to do that. This month is Child Abuse Prevention Awareness Month, and one of our members Dr Carmen Smith serves as a Court Appointed Special Advocate. She provides more eyes and ears for judges and members of Child Protective Services so they can determine a positive outcome for children who are removed from abusive homes. Read her story in the Member Spotlight of this issue (to the right of this message).

Her work as a dentist is important, but her work as a volunteer makes a lasting impact on many people. Consider volunteering with a civic organization like Dr Smith or with our own TDA Smiles Foundation. After all, “Volunteers are paid in six figures … S-M-I-L-E-S!” (Gayla LeMaire).

She and the rest of the Department of Annual Session work all year long to make the TEXAS Meeting the best dental meeting in the country. Where did you grow up? Born and raised in Austin, Texas. As a true native Austinite, it has been my privilege to be part of this beautiful city my entire life. Where breakfast tacos are a major food group, you don’t have to wait for Halloween to see the bats, you bleed orange, and the music … well — hello! — it’s Austin! Austin is as comfortable as a much-loved pair of jeans, and it looks just as good. I’m proud to call this “weird little big town” my home. What is one thing about you that might surprise people? I am a huge film fan, especially Oscar-nominated films. I have seen every Oscar-nominated film since 1942. Hollywood’s classical film noir period from the early 1940s to the late 1950s is my favorite. What is your favorite thing about the job? You’ve heard the phrase, “It’s all in the details.”If I had to pick my favorite thing, it would be the details. I enjoy being part of a team that develops such an amazing dental meeting each year from start to finish. Each day is a different detail or multiple details at one time. I find this balancing act in my profession both challenging and fulfilling. Also, I enjoy the interaction with members and staff. I rarely meet a stranger, and I can talk the ear off a brass donkey. So, customer service comes naturally, and I enjoy making others smile. What certifications do you have for this position? I am a certified meeting professional (CMP) and a member of Meeting Professionals International. Why did you decide to come to the Texas Dental Association? Truth be told, I came to TDA in March 1999 as a temporary. I had 2 small children, we were building a home, and I wanted to purchase new furniture. I was thrown into this whirlwind of preparing for the annual session. Instantly, I was hooked! I went from wanting a temporary job, to developing a real passion for the meeting industry. In June 1999, I became a permanent fixture at TDA. Fifteen years later, I look back over my time with the TDA and am truly grateful for the moment that brought me here and being introduced to the exciting meeting industry and dental profession.
Thousands Attend Star of the South Dental Meeting More than 5,900 dentists, dental professionals, exhibitors, and guests attended the Star of the South Dental Meeting on March 27-29, 2014, at the George R. Brown Convention Center in Houston. More than 50 speakers offered more than 90 lectures and participation courses at the event, sponsored by the Greater Houston Dental Society. Dr Smith graduated from Baylor College of Dentistry in 1996. She is a general dentist in Dallas. She became a CASA volunteer, completing its 40 hours of training, 1 year ago. She says she felt the need to volunteer in a non-dental organization and first learned of CASA when she was involved in the Junior League of Dallas. “I see so many stories (of child abuse) on the news. I thought I needed to do something, be a part of correcting the system.” According to the Dallas CASA website, on an average day in Dallas County, more than 2,000 abused and neglected children live in foster care because they cannot live safely at home. Part of the responsibility of a CASA volunteer is to help judges and Child Protective Services come to a decision about the future of where a child may safely live. They advocate for the best interest of the children.

Dr Smith says she felt she needed to serve as a voice for these children. “We serve as another eye and ear for the children,” Dr Smith explains. “We report to the judge to help him or her and Child Protective Services come to a decision.” She is required to complete 12 hours of CE each year to maintain her position as a CASA volunteer. Sometimes she must spend time with the child and the families to report her observations or attend a court hearing for custody, which Dr Smith has twice done. Dr Smith prefers to work with the younger children, those under 3 years old, but says the biggest reward is seeing all of the children receive the proper care. “When you see a child reunite with parents or get adopted and know they will be well taken care of, it feels good to know you’ve played a part.” For more information on becoming a CASA volunteer, visit casaforchildren.org. During its February 28, 2014, meeting, the Texas State Board of Dental Examiners (TSBDE) withdrew the second draft of a new rule governing the dental treatment of sleep disorders and voted to publish a third rule version in the Texas Register for 30-day public comment. The third version of the new rule was published in the March 28, 2014, issue of the Texas Register.

The TDA Council on Dental Education, Trade & Ancillaries is reviewing the third draft of the new rule and is preparing a comment letter for the TDA Board of Directors to approve and submit to the TSBDE during the rule comment period. The TDA submitted comment letters to the previous rule drafts in June 2013 and October 2013. Upon final adoption by the TSBDE, this new rule will define the scope of practice of a dentist in the treatment of sleep disorders. The information in this TSBDE Update came from 22 Texas Administrative Code §108.12— Dental Treatment of Sleep Disorders. HIPAA Update: Microsoft Discontinues Support for Windows XP

Microsoft discontinued its technical support for Windows XP as of April 8, which could put dental practices still using the operating system at increased risk of serious HIPAA security problems. Security updates that help protect personal computers against newly discovered vulnerabilities will no longer be provided for Windows XP as of that date. According to Microsoft, “Unsupported and unpatched environments are vulnerable to security risks. This may result in an officially recognized control failure by an internal or external audit body, leading to suspension of certifications, and/or public notification of the organization’s inability to maintain its systems and customer information.” Although the HIPAA Security Rule does not specifically require the use of operating systems that are manufacturersupported and continuing to use Windows XP after April 8 is not a HIPAA violation, it is advisable for dentist covered entities in this situation to review and revise their HIPAA Security risk assessment and reinforce security measures. The written risk assessment includes acknowledging the security vulnerability, documenting the plan being put into place to address the vulnerability, and detailing a migration path to a supported operating system within a suitable timetable. Ignoring the increased risks posed by an unsupported operating system and refusing to even try to do an analysis of the situation is inviting trouble.
