CSC and Nebraska State College System officials knew about possible NCAA violations in its football fundraising activities at least two weeks before publicly announcing they had reported the incidents to the NCAA, The Eagle has learned.

On Oct. 13, the NSCS office in Lincoln, through Chadron State officials, issued a press release stating that they had reported possible NCAA violations and were “fully cooperating with the NCAA in a joint investigation regarding football fundraising activities and various financial transactions not part of the college foundation.”

Since then, Head Football Coach Bill O’Boyle has been temporarily removed from his position to focus on the investigation, college officials said. He has been replaced by Director of Athletics Brad Smith, who served as the Eagles’ head coach from 1987-2004.

Meanwhile, The Eagle learned last week from Nebraska Auditor of Public Accounts Mike Foley, that NSCS officials notified his office on Sept. 29 – two weeks before publicly acknowledging the possible violations – that the college had retained the services of a private auditing company, BKD of Lincoln, to assist the college during the NCAA investigation. see NCAA, Page 4

President takes some blame for lack of participation

Bahensky disappointed with conference turnout Reporter James Bahensky, Student Senate vice president, reviewed highlights of the State Colleges Conference last weekend, and brought back two primary goals to the rest of the senate – technology and revising the organization’s constitution.

He said that the conference was very informative, and that he benefited from the ideas of the student governments from Wayne and Peru State Colleges.

Along with his enthusiasm for change and hope for the future, Bahensky also expressed his disappointment with the lack of participation and attendance from the Chadron State student senators.

Senate president, echoed this sentiment. She said that while she took some of the blame for the lack of attendance, she wished that more students had participated.

Nelson ended on a positive note, and said, “I think the conference went really well.

We learned a lot from the other colleges.”

T.J. Thomson, senate treasurer, said that there is $12,805 in un-allocated funds in the senate’s combined accounts.

Bahensky said that the next Senate meeting would be at the King Library, where members will be given a tour highlighting renovations.

There will be no formal meeting until the following week. Bahensky said that attendance to the tour would be mandatory.

Senate members and students are both welcome to participate by helping plant trees around campus.

Deer Camp, the next Galaxy Series event, is approaching, and a “red-neck” day would precede the event, Laure Sinn, coordinator of Student Activities, said.

Bahensky also brought up the idea of renting a mechanical bull for a campus activity, but noted that the liability insurance might be cost-prohibitive.

However, he also said that if it was something that students really wanted to do, than he felt like we could afford to pay for the insurance.

Reporter At its weekly meeting, the Campus Activities Board promoted Halloween activities and cancelled next week’s meeting.

Jamie Keller, vice president, said that the haunted house is 7 p.m. – 11 p.m., Sunday in the Student Center.

There will be a Halloween dance 9 p.m., Monday at the Student Center Pit. Club representatives who help clean up after the haunted house Tuesday will receive one free absence from a CAB meeting, Luke Wright, president, said. Wright encouraged students to wear their costumes all day on Halloween.

The CAB account contains $6,450.

Wright said there will not be a CAB meeting next week because the executive board members have other obligations.

Wright did not give specific reasons for the cancellation other than this.

Wright said that Student Senate will be taking a tour of the college library at 5 p.m., Monday to see what is planned for the library renovations.

Wright invited club representatives to attend the tour.

Wright said that students who sign up for spring classes can register to win a TV or an iPad. T.J. Thomson, secretary, said that CEC and the Criminal Justice club still need to submit their contact information.

Sara Labor, student events coordinator, said there is a home football game Saturday versus Fort Louis. A “Minute to Win It” half-time spirit event will give students a chance to win prizes.

Laurie Sinn, adviser, said the galaxy series event “Deer Camp” is 7 p.m., Nov. 8 at Memorial Hall.

The event is free to students who reserve their tickets in advance.

As a number of hunting seasons approach, Chadron’s branch of the Nebraska Forest Services reminds hunters to enjoy themselves, but respect the privileges they enjoy at the same time.

Two primary issues surfaced from an afternoon travelling around the area surrounding Chadron with representatives from local law enforcement and the Department of Agriculture’s Forest Service – respecting the land, and employing safe practices during firearm use.

“Shooting on public lands is an allowable exercise, but at the same time, it is a big issue in terms of safety,” Cyd Janssen, public affairs

for the Forest Service, said.

“If they want to go out and shoot, that’s fine, but they have to pick up their trash,” Janssen said.

In addition to BKD, the college has hired the law firm of Stinson Morrison Hecker, which has eight offices in four states and Washington, D.C. Nebraska APA Audit Manager, Sandra Steinbrecher, said the state’s staff arrived on campus Sept. 26 to perform a routine annual audit of CSC, and that the team, still on campus, is scheduled to leave Friday.

Foley said that on Sept. 29, three days after his auditing team arrived at CSC, the NSCS office notified him that it had hired BKD. “We initiated the current audit a couple of months ago and were making good progress till we learned that the State College system negotiated and signed a contract with a private CPA firm to investigate this matter. This all occurred without any communication to my office until after the arrangement was finalized despite the fact that my audit manager was on the Chadron campus at the time. I regard this act as both extraordinary and very troubling and certainly not in keeping with anything we have ever seen in government,” Foley stated last week in an email interview.

In addition, on Oct. 10, three days before announcing the possible NCAA violations and 11 days after notifying Foley’s office about BKD, NSCS Chancellor Stan Carpenter issued a campus-wide email to all CSC employees dictating procedures employees should follow if contacted by the state auditor’s office to “provide records or respond to written questions.”

The two primary uses of the land are tourists visiting for the scenic value and hunters, said Dave Simons, law enforcement officer with the Chadron branch of the Forest Service.

Mike Watts, recreation specialist with the Forest Service, said that people use all sorts of messy and potentially hazardous objects as subjects for target practice. According to Watts, a majority of the items used are not biodegradable.

Watts continued by saying “We have had a lot of close calls, but fortunately, not one has gotten shot yet,” about the often-unsafe backdrops that people use when target practicing. Contrary to popular belief, trees are not good backstops, Watts said.

“Before the fires, the trees got shot up so much than when a windstorm came, it blew them over.

We try to discourage people from using green trees as backstops,” Watts said.

Even though no one has been accidently shot as a result of stray bullets shot during target prac-

tice, Price asserts that the danger posed by careless target practice is real.

“Something will be done as soon as someone is shot,” Price said. He recounted that bullets have flown over his house on multiple occasions, and

The final cost of hiring BKD is unknown, but a BKD representative said Monday that the company’s hourly rate ranges from $100-400 per hour, depending on the complexity of a job.

Meanwhile, system office and college officials remain mum about the details surrounding the NCAA investigation.

On Monday, The Eagle called the system office and emailed Carpenter requesting comment about the investigation and Foley’s comments.

Wednesday morning, Kristin Petersen, NSCS general counsel and vice chancellor for employee relations, called The Eagle and said that Carpenter would not be available for comment prior to The Eagle’s Wednesday night’s deadline.

“I’m not sure there is going to be much I can say,” she said. “As far as the NCAA investigation is concerned, we aren’t making any comments other than what was already released in the press release.”

She also said the system office was satisfied about the time frame of its notifications.

“The chancellor notified the state auditor in a timely and appropriate manner,” Petersen said.

“We’re comfortable that we’ve provided timely notice to our employees and the community; we’ve released as much information as we can as quickly as we could.”

About the cost of hiring BKD, Petersen said that she would have to look into it. She added that she doesn’t have a bill for accounting or for legal services.

Petersen also explained the system office’s rationale for hiring BKD. “It’s not unprecedented that the colleges would contract with another professional service – in this case, we wanted an outside, independent, accounting service to come in who had expertise and resources available to investigate into the matter for us. The Board of Trustees has the ability to do that, so that’s what we’ve done.” that at one point, a bullet became lodged in the metal of a windmill adjacent to his barn.

Price reminded firearm-users that bullets can skip off the ground in winter when the ground is frozen, posing a definite safety risk.

One of the law enforcement officers, who preferred to remain anonymous, encouraged individuals to keep abreast of current regulations and continue educating themselves on proper safety.

“Regulations have changed. Things you used to do might now get you a citation,” the officer said.

Even though issuing citations is a part of Simons’ routine job, he asserted that he would rather influence a positive change in someone’s behavior rather than have to ticket them.

“If I can affect behavior change; that’s more important than trying to cite or fine people. The money [from tickets] is not doing us much good as it goes into the general fund of the Forest Service [and therefore may not affect local programs in Nebraska],” Simons said.

Further, he continued, “We [enforcement officers] have to live here, and we would rather effect change from the ground-up.”

Lifestyles Editor Recently the hot-button political topic of discussion has been Occupy Wall Street and Occupy Together. The occupy rallies that started in New York on Sept. 17 have now spread not only across the country, but across the world.

The rallies are showing that people, the “99 Percenters” are tired of not having jobs, being in debt, getting kicked out of homes, having to pay too much for medical care, and paying too much money for an education that might not necessarily return what they give. The one percent of America is made up of the extremely wealthy, mainly those with banks and big businesses who are making too much money for not really doing anything.

These are the very same banks who got bailed out for their poorly done work, as well as the typical big businesses that, despite having the continued Bush-era tax cuts and comparatively

A glimpse into the past . . .

Four international students register at CSC – Oct.

24, 1960 – Gabriel Ukporo from Nigeria, West Africa; Athanas Okoitie from Kenya, East Africa; and Rafael Fonoti and Semi Lemalu from Pago Pago, American Samona, were accepted to CSC. Before coming to the U.S., Ukporo taught school in Nigeria. He wanted to go back to Nigeria to teach English, Biology, and History. Lemalu and Fonoti planned to return to Pago Pago to teach after getting their degrees in Elementary Education. Okoiti wanted to achieve a degree in Economics and Political Science in order to make the government for his native land better.

Article VI of the U.S. Constitution states that anyone can hold office in government and, “[N]o religious test shall ever be required as a qualification to any office.” Socially, however, it seems you can’t get anywhere politically without faith. That’s why we often see people at meetings like the Value Voters Summit, a virtual cesspool of sincere and phony candidates playing the Christian card to win votes. Yet at the same time any criticism of one’s faith is paradoxically labeled as “bigotry” and having “nothing to do” with holding office. This happened to Mitt Romney recently.

Last week Pastor Robert Jeffress of the First Baptist Church in Dallas, at a Perry campaign even in Dallas, called Mitt Romney’s Mormon faith a “cult,” urging “true Christians” not to vote for him. Now, one shouldn’t take such criticism of the Mormon religion (or any faith) as a disqualification, but people do have the right to take another’s faith into consideration even if they think it is bad (this would apply to Jeffress’ own weird religion too).

As a former Mormon for 18 years of my life, I think there are issues with the faith that do deserve scrutiny and criticism. Jeffress,

Not only is Christ the focal point of Mormons but the religion is fundamentally “American” (Mormons believe the Garden of Eden was in presentday Missouri). SHAMEFUL: Sparse student turnout at governor’s keynote Last Friday, Gov. Dave Heineman visited Chadron State to promote his view of how college students today can make an impact on the future of the state and country.

With college costs going up, employment uncertainty after graduation, student loan debts, and other personal issues, students came out to speak with the governor about those problems and possible solutions. The governor addressed these concerns in-depth.

He also answered questions on tough issues like “ObamaCare,” taxes, the Heartland Expressway, and the Keystone XL pipeline.

This important event was organized by the CSC Student Senate. Most senators showed up for the dinner Thursday night in the Sandoz Center, but only six showed up to hear the governor Friday afternoon. It seems a good buffet ranks higher than a visit from our state’s top leader.

When asked for comment on the CSC student senators’ attendance, Student Senate Vice President James Bahensky wrote in a statement, “While every senator strives to represent the student body to the best of their ability, it must be understood that they themselves are students as well. Several of our senators have classes during this time, and others have jobs that did not allow them to devote to the conference.”

It’s easier to be excused from a class to attend an event than it is to enroll in one.

Representatives from Peru and Wayne state colleges drove seven hours to be here, but it seems CSC’s senators couldn’t ask their professors if they could miss class. Work is understandable, but even students with parttime and even full-time jobs attended.

How can these individuals, with their apparent apathy and laziness, expect to be taken seriously as the leaders of tomorrow? They won’t be, and they won’t be excused for such behavior either.

Leadership requires the sacrifice of selfinterest, but most of our student leaders are unwilling to make the committment to lead.

As for the rest of the student body, it’s a shame that so few students attended. Out of a campus of about 3,000 less than 20 showed up.

This apathy needs to stop. Participating in government may not be as fun as a basketball game or as tasty as a fancy buffet, but it’s our right and duty as students, citizens, and leaders of tomorrow.

CHADRON STATE HOSTS THE State Colleges Conference

Representatives of the three NSCS institutions’ student governments sit at a reception Thursday evening in the Sandoz Center.

Evening reception at the Sandoz Center - Thursday Members of the student governments from Chadron State College, Wayne State College, and Peru State College met last Thursday for a reception in the Chicoine Atrium of the Mari Sandoz High Plains Heritage Center.

The formal dinner was the first of three days of events for the NSCS leadership conference, which included the governor’s visit to the CSC campus.

Morgan Nelson, Student Senate president, welcomed the student representatives from Wayne and Peru. She said that she was excited to get the conference started. James Bahensky, Student Senate vice president planned the conference events, according to Nelson.

Approximately 38 students attended the dinner, which was catered by CSC’s Creative Dining Services and consisted of Italian cuisine.

The Eagle was on the scene at Chadron Municipal Airport as the governor’s plane touched down at approximately 1:15 p.m. Friday.

The governor was short on time, but answered a few questions from The Eagle’s Web Editor, Kevin Oleksy.

The governor declined to comment on the letters that Nebraska Speaker of the Legislature Mike Flood sent out Oct. 19. regarding the prospect of a calling a special session of the Legislature.

Gov. Dave Heineman spoke to a crowd of around 30 people at the keynote speech of a three-day student leadership conference, hosted at Chadron State College. The audience consisted of about 14 student leaders from Wayne, Peru, and Chadron State Colleges, and 16 other students and people from the Chadron community.

The governor gave a short address based on two questions the conference organizers had previously provided him. The questions asked how Nebraska youth might affect the future of the state, and how students can get their voices out and heard and make an impact.

The governor emphasized participation as the biggest way that youth can affect the future of Nebraska. He said education and jobs are his top two priorities. By providing the youth in Nebraska colleges and universities the opportunity to get the best education that they can, the state strives to have the jobs to keep graduates here when they are settling into a career.

As far as having their voices heard, the governor said students should have conversations with elected officials and business leaders locally, volunteering, and getting a good education.

Heineman said “With a good education, if you work hard as an adult you can go do and be whatever you want. And you’d be surprised what an impact you can have on the community and state, and can affect the nation too.”

The governor also gave an overview of the state’s status regarding the economy and jobs.

“I am very proud of our state and our citizens because we’re in better financial shape than almost any other state in America right now.

What’s different about Nebraska? We’ve got a lot more common sense than they do in New York City or Los Angeles,” Heineman said.

He continued, “The most important reason that we’re in better financial shape than the rest of the country is a very fundamental financial principle that they’ve forgotten sometimes. In Nebraska, we don’t spend money we don’t have.

We are able to balance our budget by controlling spending, not by raising taxes.”

Stretching the Limit Eagles basketball team takes advantage of yoga instruction

Chris Clark Sports Editor Nikes and Converse All-Stars line one wall of the NPAC’s dance studio. Their lean, athletic owners are scattered about the hardwood floor, seated on grey foam mats. Class hasn’t started yet, so they talk and joke lightheartedly.

It’s a not a typical basketball practice for the Chadron State College Eagles. They’re not practicing their jump shot, or working on their ball-handling, or even touching a basketball for that matter. They’re taking a yoga class.

Every Thursday for the past two seasons, the team has been guided through a onehour yoga routine by Dr. Maggie SmithBruehlman. It might seem strange that competitors in a fast-paced sport like basketball should be spending valuable practices stretching and meditating, but the millennia-old Indian tradition can have a variety of physical and mental benefits for athletes.

“An athlete can benefit from yoga by improving their game, developing balance, stretching muscles or simply relaxing

and unwinding,” Smith-Bruehlman said.

“Another benefit of yoga for athletes is improved focus through training the mind and body to concentrate.”

Today, the players are performing “vinyasa-flow,” a somewhat relaxed routine that focuses on flexibility and balance. Smith-Bruehlman pops a CD into a boom-box and the studio fills with soft, tinkly piano and xylophone. They start slowly, twisting and laughing at each other’s occasional clumsiness. As SmithBruehlman moves on to more difficult poses, though, the laughter dies and the atmosphere shifts to a pure, strenuous athletic focus. A few of them are sweating.

Their coach, Brent Bargen, flawlessly performing the routine near the front of the room, isn’t.

Bargen has a few reasons for the unorthodox training.

“Physically, it will get them in better shape, especially as far as flexibility is concerned, which is very important for young athletes,” he said.

Bargen added, “Secondly, the mental aspect of it will help them focus and have better concentration. I like to get them out of their comfort zone as

much as possible.”

The players are certainly becoming more flexible.

“I’m hearing that they’re seeing greater flexibility,” Smith-Bruehlman said, “They’re able to get into some of the poses more easily.”

The penultimate phase of the routine is called “savasana” or “final relaxation.”

With the lights dim, they lie flat on their mats and breathe deeply. Bruehlman asks them to focus on their breathing and willfully release both physical and psychological tension.

“Anything that you’ve been keeping,” she says, “Just let it go.”

Finally, she invites the team to sit crosslegged, straight-backed in the classic yoga pose for meditation. One player, senior guard Kevin McClelland of Long Beach, Calif. doesn’t oblige. He appears to have fallen asleep.

“I feel so awesome,” he said afterwards, “It’s really relaxing.”

The Eagles will get the opportunity to test their newfound focus and flexibility against their first season opponent Tuesday, when they play the University of Northern Colorado in Greeley, Colo.

It wasn’t long before a defensive stop gave the Eagles good field position and another chance to score.

An eight-yard touchdown pass from Gorsuch to junior receiver Cody Roes of Chadron capped off a six-play drive that gave the Eagles a 14-0 lead before half.

Late in the third quarter, CSC would get on the board again. This time it would be senior tight end, Jeff Alcorn of Chadron on the receiving end of a 52-yard touchdown pass from Brandon Gorsuch.

This touchdown gave the Eagles a 21-point lead heading into the final quarter.

The Mustangs found them selves back in the game after a short touchdown pass from senior quarterback David Ingram, of Irvine, Calif., made the score 21-7.

After a stop, Western New Mexico got the ball back on their own 11-yard line. They then drove 89 yards in 14

After missing the extra point, the Mustangs were within eight points late in the game.

With just over two minutes left in the game, a four-yard run by Glen Clinton for a first down on third and three sealed the game for the Eagles. From that point they were able to take three knees and end the game.

This victory puts the Eagles at 4-4 on the season and in a tie for third place in the RMAC. Next weekend the Fort Lewis Sky Hawks will travel to Elliot Field to take on the Eagles.

CSC will have a chance to make it three in a row against the Sky Hawks, who have a record of 2-6 for the season.

Kickoff is scheduled for noon Saturday.

Chadron’s Eagles volleyball team remains winless in the RMAC after Friday night’s 25-10, 25-23, 25-19 loss to Colorado Christian University in the Armstrong Gymnasium.

Chadron struggled to fend off CCU’s Aurora, Colo. freshman Ali Weber, who amassed 14 kills on the night.

Junior Tija Rudzitis, junior of Nowthen, Minn., also contributed 10 kills. Erika Roybal, freshman of Denver, Colo. led Chadron with nine kills and ten digs.

The Eagles began the match sluggishly, dropping the first game without holding the lead once and tallying a team hitting average of -.042.

The second game was more

competitive, but the Cougars managed to pull away from a 23-point tie for the win.

Chadron kept pace early in the third game but CCU ultimately rallied to seal their victory.

“I just don’t think we were ready to play” head coach Natasha Marquis said after the game, “We didn’t come to the floor as sharp as we should have.”

Chadron is slated to take on Metropolitan State College of Denver, (19-4, 11-3 RMAC,) and Regis University, Denver (19-6, 10-4 RMAC) on Friday and Saturday, respectively.

Both teams are nationally ranked by the American Volleyball Coaches Association.

Metro State is ranked 10th and Regis sits at 25th.

‘Ornery Times’ – stories from Chadron resident Don Holst Kevin Oleksy Web Editor (This is the first in a four-part series on the life and “Ornery Times” of Chadron resident Don Holst.)

Don Holst, 81, of Chadron, is something of a living legend around town. Though his isn’t a household name among the current student body, Holst has made indelible marks on Chadron State College, the city of Chadron, and many of its citizens.

Holst is a former athlete and coach with a passion for reading, singing, painting, and educating—several people in the community call him a rural renaissance man.

Originally from Marysville, Kan., he was a child during the Great Depression and World War II. Of his birth and upbringing, Holst said, “I was conceived the day the stock market fell.

So I was off to a good start. When I got a little older, we had a world war. It was ornery times.”

Ornery times begat an ornery person—Holst has a quick wit, and a wealth of jokes, stories, and experiences to tell.

When I asked about staying active and productive as a retiree, Holst said, “I guess I’m retired.” His ambitious projects and vivacity

speak otherwise.

He is the author of two books and many poems. His paintings adorn many of the walls in CSC’s Math and Science building. Holst is also a passionate cultivator of the descendants of the Olympic Oak Trees, which were given to gold medal winners at the 1936 games.

He coached track and field, was an assistant football coach, and taught at CSC from 1965 to 1974. When Holst arrived in Chadron on September 10, 1965 there were 10 inches of snow on the ground, and the football team hadn’t yet played a game. He decided to stay anyway.

Holst was good friends with such wellknown Nebraskans as Poet Laureate, historian and ethnographer, John Neihardt; State Poet, William Kloefkorn; and Chadron State’s Ron Weedon, late professor of physical and life sciences.

Like many Chadron residents who move away, Holst returned to the area after living elsewhere for many years.

“I came back to Chadron because I didn’t like being around the city. I loved this area for its beauty, and I’ve always loved fishing,” Holst said.

I sat down to talk with Holst at his home, a small cabin south of town, which he helped build about 10 years ago.

Sigma Tau Delta and the English and Humanities Department are hosting their annual Scream Slam event tonight in the Bordeaux Room of the Student Center.

A meet and greet with faculty will begin at 7 p.m., and the Scream Slam, which is similar to an open mic event, is scheduled for 7:30 p.m. Faculty, as well as students, are welcome. Participants can read Halloween-themed short stories and poetry or original written works.

Participants will be judged in several different categories including poetry, prose, original reading, best costume, and best overall reading. Prizes include gift cards and an Amazon Kindle as the grand prize.
