The lineup for a special 20th anniversary Riverdale Share holiday charity concert Sunday, Dec. 9 at 3 p.m., is complete.

And with showtime just more than a week away, there are still plenty of tickets available.

The show is not only back after a one-year hiatus, but back at the Danforth Music Hall.

Known for raising both holiday cheer and funds for local grassroots charities that do their good work in the east end, the annual holiday charity concert always receives huge volunteer support from area musicians, including its share of prominent performers.

Confirming another return for the 20th anniversary show is Steven Page who will be doing a tribute to the late Jack Layton with the Centre of Gravity Circus.

Communty Centre 55’s Share-A-Christmas campaign expands High volume of those in need expected as WoodGreen program not running this year JOANNA LAVOIE jlavoie@insidetoronto.com The 31st annual Share-A-Christmas campaign is set to be the biggest one yet as Community Centre 55 (CC55) aims to collect food and gift hampers for an estimated 800 less fortunate local families and individuals this holiday season.

“This year we are expecting a higher volume of recipients,” said Debbie Visconti, CC55’s executive director, explaining numbers are up this year as WoodGreen Community Services isn’t running its annual Christmas hamper program.

“We’ll need more donations of food and toys to accommodate the extra families we will be serving.”

She said the need is especially great as the City of Toronto’s wellused Christmas Bureau has fallen victim to budgetary cutbacks.

For several years, CC55 has provided toys and gifts to an additional 400 to 500 families across the city through its emergency distribution clinic after Dec. 22. Visconti said she expects a significant increase in demand because of the cutbacks.

“We’ll do whatever we can for people. We won’t turn anyone away,”

she said. “People in our community have been very supportive and we expect they will help us again this year.”

Community Centre 55’s ShareA-Christmas program, the biggest yearly initiative at the Upper Beacharea agency, officially kicked off for the season last Sunday with Hamper’s Christmas Parade on Kingston Road followed by a postparade celebration at the local community centre.

A number of events are planned for the coming weeks to raise muchneeded funds for the annual program.

This Saturday, people are invited to join Santa Claus for a pancake breakfast at Community Centre 55, 97 Main St., at Swanwick Avenue. The event, which runs from 8 to 10 a.m., costs $3 per person. Reservations are not required.

Later that evening, those 19 years of age and older are invited to take part in the 10th annual 12 Cheers of Christmas Pub Night, which will run from 6 p.m. to midnight.

Admission is $20 per person and includes appetizers, trivia and karaoke at the final pub. A shuttle service, departing from CC55 and transport-

ing revelers from pub to pub and back, will also be provided.

Community members are also asked to bring non-perishable food for the Share-A-Christmas program to the Toronto Beaches Lions Club’s Old Fashioned Christmas Tree Lighting at Kew Gardens Saturday from 5 to 7 p.m.

Tanenbaum race The newly rebranded Centre 55 Tanenbaum 10k race is also expected to benefit the Share-A-Christmas program in a big way as nearly twice as many people have already signed up to take part in the Sunday, Dec. 2 event. For more details, visit www. tanenbaum10k.com.

Further, community members are invited to attend the All About The Benjamin’s Memorial Christmas Fundraiser for Community Centre 55 Saturday, Dec. 8.

This event, which will include door prizes, a 50/50 draw, games, a DJ, cash bar and more, will take place at the Royal Canadian Legion, Branch 73, at 2 Robinson Ave., near Danforth Road and Danforth Avenue.

Aside from supporting various

fundraising events, area residents can support the annual campaign by making a monetary donation.

Charitable tax receipts are available.

People can donate Canadian Tire money to the program, which serves those living in an area bounded by Lake Ontario and Danforth, Coxwell and Victoria Park avenues.

Non-perishable human/pet food as well as toys for children from babies to teens are also greatly needed. Items can be dropped off at CC55, the Beaches Recreation Centre at 6 Williamson Rd., FreshCo at Gerrard Street East and Victoria Park Avenue, Price Chopper on Eastern Avenue and at local CIBC branches until Thursday, Dec. 20.

Some of the fun ways to support the Share-A-Chrsitms program include organizing a draw, planning a food drive or money collection at your family or corporate Christmas party, adopting a family or taking part in the CANpaign program by placing a money collection can at your business or holiday event.

The centre’s mascot, Hamper the Reindeer, is more than happy to attend any Share-A-Christmas fundraiser. Anyone who would like

Community Centre 55 is also selling Hamper the Reindeer Christmas cards.

As always, a veritable army of volunteers will be needed to help sort, pack, and deliver the food and toy hampers. Registration is not required.

Packing and sorting of nonperishables takes place Tuesday, Dec. 18, Wednesday, Dec. 19 and Thursday, Dec. 20 from 6 to 8 p.m.

Toys will be sorted and packed Friday, Dec. 21 from 6 to 8 p.m. No children please.

Perishable food items will be packed and sorted Saturday, Dec. 22 from 11 a.m. to 1 p.m. with delivery set to begin that same day beginning at 2 p.m.

Those interested in helping out should dress in layers as the building can get hot/cold, bring their muscles as the food boxes can get heavy and pack their patience as lots of elves come out to help and things can get a bit hectic at times.

Keep treated woods out of fireplace

Council needs to re-set priorities at halfway point

To the editor: Nothing is more pleasant than the smell of a wood-burning fire, providing the dry wood is free of chemicals.

Unfortunately, in this day of pressure- and surface-treated woods, many are unaware of the hazards contained in this wood.

oronto City Council reached the halfway point of its mandate in spectacular fashion this week.

Monday’s decision by Superior Court Justice Charles Hackland ordering Mayor Rob Ford be removed from office due to his violation of the Municipal Conflict of Interest Act will take effect on Dec. 10. The judge gave council 14 days from Monday to deal with his ruling. That possible date of removal comes just three days after council reaches the twoyear anniversary of its four-year our view term.

The situation on Ford is constantly changing. Council was Councillors examining its legal options at this week’s meeting. At the moment, must still focus it appears council has the choice on community of either appointing a caretaker mayor for the remaining two years of this term, or calling for a mayoral byelection. City solicitor Anna Kinastowski said it’s going to be a long process, much of it dependent on other court rulings which could stay Ford’s removal or keep him in office if he wins his appeal.

If or when the time comes for council to make a decision on replacing Ford, we strongly favour the appointment route. Calling a byelection will cost an estimated $7 million.

It will also likely cause a mess of a domino effect as councillors abandon their wards to run for mayor. And that’s the last thing Toronto needs, distracted councillors furthering their own political careers during a byelection while ignoring the needs of the wards they were elected to represent in 2010.

As our stories in today’s paper on Council at The Halfway Point show, councillors must fully focus on the important work of representing their communities.

This has to remain their priority.

We also ask that the appointee be from Ford’s side of the political spectrum. He was elected on a mandate of fiscal responsiblity and concern for taxpayers, and that should be respected.

The halfway point of a council’s mandate is an artificial line for council members to reflect on what’s gone right and what’s gone wrong during the first two years of office.

Unfortunately, this time it’s a harder line in the sand.

It’s a re-set point for every civic politician and every civic official. There are no longer any rookie councillors – everyone has two years of experience.

Understand that the pure pleasure and advantage of local politics is in moving forward carrying the interests of your constituency beyond an agenda of a perceived political left or right vision.

Burning can release harmful chemicals, such as pesticides, that protect wood from insects but are toxic to human health.

Smelling and inhaling are not mutually exclusive.

When these toxic chemicals are released on burning, they do enter our systems, causing illness.

If in doubt about the wood, do not burn it in your fireplace but dispose of it according to your municipality’s waste regulations.

Price to pay for living with our eyes wide shut

ast year a book was written by Margaret Heffernan which provides some important insights into the judge’s ruling on Mayor Rob Ford’s conflict of interest case.

Willful Blindness: Why we ignore the obvious at our peril is the book’s title and in it the author shows how human beings have a surprising ability to deliberately not recognize what’s taking place in front of them.

It is not surprising that in Justice Charles Hackland’s ruling released on Monday that one of the key terms that emerged was willful blindness which has an important legal meaning.

As Heffernan points out in the introduction to her book, she quotes from the case of Jeffrey Skilling and Kenneth Lay, CEO and chairman of Enron, who was involved in a historic case of fraud. Judge Simeon, when instructing

the jury about the case, pointed out that the act of deliberately closing one eyes to what’s in front of them can only be done if one has knowledge of what one is ignoring.

In common law practice, if it is your responsibility to know something and you choose not to do so you cannot claim ignorance because you did not see or know something. This concept of willful blindness goes back to the 19th Century, when in the 1861 trial of Regina vs Sleep, the judge ruled that a person can be convicted if they had either direct or indirect knowledge of a crime. In this particular case, which

was about the theft of government property, deliberately looking the other way while the goods were being stolen implied knowledge of the theft.

Where the concept applies to Mayor Ford lies in the fact that during the 10 years he spent as a city councillor he self admittedly never read the city’s policies on conflict of interest. This was compounded by the fact that when he became mayor he yet again did not review city policy, even though he knew it existed. Furthermore, when he was provided with opportunities to have the policies explained to him, he turned those down.

This became further exasperated when he did not act on several letters from the city’s integrity officer explaining to him that he had transgressed the city’s integrity policies.

He made matters even worse for himself when

despite being warned by the speaker during the debate by city council around his use of city letterhead not to speak or vote on the matter, he did so anyway.

That willful blindness towards city policy over a period greater than a decade and deliberately ignoring direct warnings that he was in conflict of interest is the reason behind Justice Hackland’s ruling.

I say that not to excuse Rob Ford for what he did, but to point out how endemic this mindset is in our society.

No truer words were spoken about our third (amalgamated city) mayor, than the sound-bite-ready quip from lawyer Clayton Ruby, who led the legal challenge to Mayor Rob Ford’s legitimacy to hold the office to which he was elected two years ago.

Ford is facing what can only be counted as a disgrace: ordered removed from office not by disgruntled voters or his own life-choices — but a court of law, for violating the Municipal Conflict of Interest Act. There will be an appeal of the decision by Justice Charles Hackland. Perhaps the mayor will prevail on appeal, and be able to remain in office. But in the course of getting there, he will hear the verdict in the libel lawsuit from the owner of the Boardwalk Cafe in the Beach. And before the end of the year, the result of a compliance audit on his election expenses will be released.

Depending on how badly that goes, he could well be faced with removal from office a second time, as well as a second restriction on when next he can run for election. Ford has already surrendered the moral authority to lead the city. The courts are now in the process of taking legal authority from him.

Some have suggested that the punishment meted out by Justice Hackland — and prescribed in the Municipal Conflict of Interest Act — outstrips the nature of the crime.

Hackland admitted as much in his decision: that Ford’s decision to speak on his own behalf, when faced with a report demanding he repay $3,150 in donations to his football charity, wasn’t a matter of corruption, and the violation of

the act was technical.

Council is a fragile body at the best of times. The huge uncertainty Ford’s potential departure could throw it entirely off the rails.

Toronto Council will need to pass a budget — which, one would hope, would reflect the complex will of the electorate. It will have to deal with the continued implementation of a transportation plan. It will have to decide what to do about revenue sources like the land transfer tax.

One might argue Ford’s presence has been of diminishing relevance to all of this, as council has chosen its own route. But the instability over the next few months will all but guarantee a level of legislative paralysis Toronto hasn’t seen since the early days of amalgamation. Ford will appeal the decision and has asked for a stay of the ruling he be removed from office on Dec. 10.

As city council reaches the halfway point of its two-year mandate next week, Fragedakis was concerned the ruling would overshadow important upcoming discussions on the budget and new transit.

“We just have a lot of work to do,” said Fragedakis.

“That hasn’t changed. We have to stay focused.”

Over the first two years of her first council term, Fragedakis, said she was proud to have played a role in successfully reversing cuts to the 2011 fiscal budget and preserving city services considered essential to the local community.

“I would argue there are people in our ward who feel we should be getting more services,” she said.

“Torontonians expect a certain level of service for the tax dollars they pay.”

To prevent the shuttering of the Todmorden Room library, recommended for closure in a report prepared by accounting firm KPMG which was hired by the city to find cost savings in the 2011 budget process, Fragedakis organized a community meeting in opposition. “It’s the size of some people’s living rooms,” she said of the Todmorden space, located in the East York Civic Centre. “It’s just a small library but it serves some 20,000 people near Pape and Cosburn.”

The library was ultimately spared the chopping block when city council voted in 2012 to keep it and an estimated 98 branches open.

Despite the “distraction” surrounding mayor Ford’s removal from elected office Fragedakis said city council should remain focused on serving residents.

Reflecting on his first two years on council, Don Valley West Councillor John Parker said he was proudest of the decision to reinstate much of the Transit City light rail transit (LRT) plan unilaterally cancelled by Ford.

The project was restored following a majority vote by council in spring of 2012.. “We came perilously close to mishandling that opportunity,” said Parker, who also serves on the TTC board.

“After decades of talk and inaction we have now settled on a commitment for transit and we’re expanding in the right way.”

Parker said he found himself in an unfamiliar position on the transit issue: opposing the mayor, whom he often supports. “I didn’t want to undercut the mayor, but this was too big an issue to let slide by,” said Parker.

Even though Parker was ultimately unsuccessful in convincing the Ford to reverse his stance on the LRTs, he said closed door conversations on the matter remained civil and friendly.

“That had far more of a persuasive effect than any other approach would have had,” said Parker. “This wasn’t a matter of the opposite side of the fence

finding another bone to pick with the mayor.”

Locally, Parker said he was proud to have played a role in transforming Laird Drive, which he believes is suffering from neglect despite being Leaside’s main street. “It’s been treated as a back alley for decades, a piece of pavement meant to move cars but not to take pride in,” said Parker.

He said he has worked with developers to beautify the area and make commercial lots more compatible with the surrounding architecture. Working with developers rather than opposing projects is the only way to ensure community interests are protected, said Parker. “It’s a recognition of the rights the builder has, whether I’m happy or not, and then picking battles where we can make some progress,” he said.

One major victory in the last two years was convincing a developer not to demolish the historical Pease Foundry building at 211 Laird Dr., he said. “The result is an outstanding preservation of a unique building.”

Beaches-East York Councillor, Janet Davis said she was reassured by the response of residents in speaking out against the anticipated cuts to the the 2011 budget.

She said the level of attention paid to municipal issues was heartening and the most striking aspect of the last two years of council. “There were more people engaged with city politics than I’d ever seen before,” said Davis. “We

managed to protect city services, and I’m very proud of this.”

She said she would continue to help to facilitate dialogue between local community groups and the city in making Danforth Avenue “vital” to the health of the city. “We have to keep encouraging people to shop locally and for the local storefronts to remain filled so that the Danforth remains a vibrant business area.”

She said she was extremely happy the TTC will complete work on making all subway stations in the ward accessible. Work at Main and Victoria Park Station has been completed, she said, while both Coxwell and Woodbine stations are expected to be fully accessible by 2014.

Davis also said she was pleased with the ongoing restoration of Taylor Creek Park but said more work needed to be done to make the park a destination of choice for all Torontonians.

“Taylor Creek park is our green gem and thousands of people use it every year,” she said.

For the future, Davis said she wanted to see new transit approved for the area and a “sustainable” budget that takes into account the need to be able to pay for city services.

Mayor Rob Ford has had a colourful first two years in office: starting from the moment he announced that Transit City was “dead,” then handed off the limelight in his swearingin ceremony to a red-baiting Don Cherry.

As he reaches the second anniversary of his mayoralty on Dec. 7, Ford’s political career in municipal politics could well be over. Superior Court Judge Charles Hackland ordered Ford removed from office on Monday over a conflict of interest he failed to declare, when he asked council to forgive him having to pay $3,150 of money donated to a football charity.

That matter was one of many black eyes Ford has inflicted on his own mayoralty.

But what about policy? After two years in the mayor’s chair, what has Rob Ford done to change the face of Toronto?

Initially, it seemed like he had accomplished quite a bit. He convinced Ontario Premier Dalton McGuinty and Metrolinx to stop work on the Sheppard LRT and let the city attempt to build a subway there instead. He convinced Toronto Council to scrap the $60 vehicle registration fee, and using surpluses left by the previous administration, froze property taxes in 2011. Toronto councillors’ office budgets were slashed in half. He convinced council to contract out garbage collection in the area west of Yonge Street. He and Deputy Mayor Doug Holyday were able to win major concessions from the city’s remaining unionized workers, with only a short public library strike.

In the service of his promise to cut the “gravy” at city hall, he implemented a core services review, which enabled council and the public to decide what services the city should or should not be providing.

These exercises found little to cut.

The fallout from the process arguably led Toronto Council to take a firmer hand with the mayor in 2012, which saw many of his promises undone.

Council resurrected Transit City and turned around the 2012 budget to restore some key services.

What’s to come? Well, if Ford is successful in appealing Hackland’s ruling, there are a couple of outstanding promises. Ford has promised to start cutting the land transfer tax on real estate transactions. And he is aiming at a 1.75 per cent property tax increase for 2013. And he has made it clear since the spring, when council shut down his subway dream: Rob Ford is already campaigning for re-election in 2014.

The decision has left councillors unclear as to how the city will be governed, and already led to splinters in the mayor’s inner circle.

Ford, meanwhile, has made it clear he will be appealing the decision, which could prevent him from running for office until the 2014 election, and blamed the decision on a left-wing conspiracy to remove him from office.

“This has come down to left wing politics,” Ford told reporters Monday morning, just over an hour after the decision was released.

“They’re going to do anything to get me out and I’m going to fight tooth and nail to hold onto my job. And if they do for some reason get me out, I’ll be running back at them in a byelection.”

That may not be possible, however. According to city lawyer Anna Kinastowski, the decision prohibits the mayor from seeking office again until 2014, the next general election.

And the move already has some of Ford’s former allies suggesting that until the appeal is heard he should step aside and allow Deputy Mayor Doug Holyday to take over.

Ford will launch an appeal.

At issue was a decision by Ford to speak on his own behalf as council was considering a report from the city’s integrity commissioner.

The report recommended council compel Ford to repay $3,150 he had accepted from lobbyists for his football charity. Ford had as a councillor solicited those funds using his councillor’s letterhead, which was a violation of council’s code of conduct.

Ford had repeatedly refused to repay the money, and when it came to council, he begged councillors not to compel him to do so.

That, according to the Hackland decision, was a violation of the Municipal Conflict of Interest Act, which requires that politicians refrain from speaking or voting on matters in which they have a financial interest.

Hackland rejected arguments made by Ford’s defence, suggesting he had made an error in judgement on the matter – one of the few acceptable mitigating factors in COI violations.

“In the view of the respondent’s leadership role in ensuring integrity in municipal government, it is difficult to accept an error in judgement defence based essentially on a stubborn sense of entitlement (concerning his football foundation) and a dismissive and confrontational attitude to the Integrity Commissioner and the Code of Conduct,” wrote Hackland.

“In my opinion, the respondent’s actions were characterized by an ignorance of the law and a lack of diligence in securing professional advice, amounting to willful blindness.”

Clayton Ruby, the lawyer who prosecuted the case for citizen Paul Magder, said he and his client were pleased with the victory, but saddened by the situation.

Ford apologizes, announces date for appeal to be heard Mayor Rob Ford has apologized to “everyone who believes I should have done this differently,” for the behaviour that led to a Superior Court judge to throw him out of office two weeks from now.

“Looking back, maybe I could have expressed myself in a different way,” said Ford at a Tuesday afternoon news conference.

“Everyone who believes I should have done this differently, I sincerely apologize.”

The contrite Ford made the statements just a day after the decision from Superior Court Justice Charles Hackland was released, in the conflict of interest case that Toronto citizen Paul Magder and lawyer Clayton Ruby brought to court in September.

Ford has been ordered to be removed from office within two weeks of the ruling, and not to run again until the end of the term.

On Tuesday, Ford’s press secretary revealed that Ford’s lawyers would be seeking a stay of the order to vacate the seat at a hearing

Dec. 5; the Divisional Court hearing will take place Jan. 7.

Ford re-iterated his defence on the stand, saying that he believed he had done nothing wrong and had no conflict.

“I respect the courts and the decision that was released yesterday,” he said.

“My decision to appeal is not a criticism of the court. But I feel that it is important to go through the appeal system so I can continue to do the work I was elected to do for the taxpayers of this city. This entire matter began because I love to help kids play football. When this came to council for a vote I felt it was important to answer the accusations that had been made against me. I was focussed on raising money to help under-privileged youth. I never believed there was a conflict of interest because I had nothing to gain and the city had nothing to lose.”

Ford did not take any questions, because, he said, the matter is before the courts.

Participate in the City’s 2013 Budget Process How City Council establishes the City’s budget and priorities directly affects the quality of life for every resident. The Operating Budget determines what programs and services the City will offer and how much the City will raise and spend within a year and in the immediate future. The Capital Budget and Plan provides funding for the facilities and infrastructure required to deliver those services.

A Staff Recommended 2013 Tax Supported Operating Budget and 2013-2022 Capital Budget and Plan are now being considered by the Budget Committee for recommendation to the Mayor and his Executive Committee and then to City Council.

The City of Toronto is hosting a free flu shot clinic this Saturday at Gerrard Square, 1000 Gerrard St. E. at Pape Avenue.

aybe the memo about the slowing pace of highrise development in Toronto’s core hasn’t yet reached the development community.

Last month, one of the largest proposals ever in North America was unveiled, showing an expanded convention centre, hotel, plus additional retail, offices and residential towers along

Front Street.

Just steps away, another vision promises to transform part of King Street with three residential towers, each of which could be more than 80 storeys.

During the summer there were almost 200 condo projects already underway in Toronto, which would bring another 50,000 units to market.

All of this activity must be profitable for developers or they would not be risking their capital.

he holiday season is also the season of giving, and East Side Players, along with the City of Toronto, is getting into the spirit by hosting a charity reading of A Christmas Carol, the beloved Christmas classic

by Charles Dickens.

A Christmas Carol is the story about the Cratchit family, who are poor but rich with love, and a wealthy, but heartless, penny-pincher named Ebenezer Scrooge, who has an emotional transformation after he is visited by three ghosts that show him the err of his ways.

These visits cause Scrooge to realize how his miserly ways have caused him a life of loneliness and teaches him the importance of giving back and sharing his wealth with others.

Director Jan Francies said this show is ideal to stage at this time of year because of its important messages of

hope, compassion, love and charity, and it’s the perfect show to get everyone in the holiday spirit.

“It’s the redemption of Scrooge, someone who doesn’t see the good in anything, and he’s turned around by seeing that he can change people’s lives, and instead of letting his money rule him he becomes a philanthropist,” she said.

Francies said 15 members of East Side Players happily volunteered to stage this special reading, which is an abridged version that runs about one hour and 15 minutes. Since this is a reading and not a full production, you may be wondering how this story will be brought to life. Francies said they will be using costume props, imaginative lighting, stage movements and choreography.

She has also cast two narrators, who will be stationed at either side of the stage, and everyone besides them and Scrooge, will be playing multiple roles. Besides enjoying a festive performance, Francies

said this show is also a way to showcase Todmorden Mills, one of Toronto’s beautiful heritage sites. She said each year the city hosts a holiday event, and since East Side Players are the theatre-in-residence at Todmorden, Francies said it only seemed fitting.

And, since the theme of the show and this time of year is all about generosity and giving, Francies said East Side Players is donating a portion of the box office to the Toronto Star Santa Claus Fund.

As an added treat for the audience, The Toronto Beach Chorale, under the direction of Mervin Fick, will also be there donating their time, and greeting guests with Christmas carols as they arrive. Also, at the end of the performance, Francies said the choir and cast will join the audience to sing We Wish You a Merry Christmas.’

A Christmas Carol will be performed on Dec. 9 at 2 p.m. The Papermill Theatre, 67 Pottery Rd. Tickets are $12 and $5 for children. Call 416396-2819.
