A
s November begins, we can’t help but reflect on how fast this year has gone. It seems like just yesterday we were making our summer plans, and now here we are preparing for South Florida’s version of winter, and the upcoming holiday season. November means Thanksgiving (one of our favorite holidays!) is soon upon us and we’re looking forward to spending time with our loved ones, reflecting on all that we are grateful for, indulging in turkey and stuffing, and watching some football. Many will start their Christmas shopping, and Hanukkah, the festival of lights, also begins. On a personal note, this month is especially meaningful to me as my wife and I are expecting the arrival of our baby boy. We are so excited for the new addition to The Florida Villager family and will have lots to be thankful for this holiday! We’re so pleased by the positive response you’ve shown to The Florida Villager thus far, and encourage everyone to like our page on Facebook. his is responding to the article by the Mayor of Pinecrest in the October issue of The Florida Villager, “It’s Time for Pinecrest Pups To Have Their Own Park”. In 2010, the residents of Pinecrest clearly, explicitly and unequivocally voted NO to the issue of changing the Veterans Wayside Park to a ‘Pinecrest Dog Park’. So why would the Mayor of Pinecrest publicly voice her own individual opinion in the magazine, The Florida Villager, instead of implementing the vote of her constituents? My understanding of representative democracy is that “elected officials” are to represent the views and concerns of the voters even at the sacrifice of their own personal views and opinions. In addition to blatantly dismissing the vote of NO, sometime between 2010 and 2013 a resolution was passed by the Council, under the leadership and influence of the Mayor, allotting $100,000 in the budget for a dog park that was already clearly voted NO on by the residents of Pinecrest! How was this resolution able to get by the residents of Pinecrest and how legal was such a resolution without the vote of the people? And if it isn’t enough to disregard the vote of the residents, how dare the Council of Pinecrest, disrespect and dishonor our Veterans! How do you replace the value of lives lost at war who fought for the very freedoms we have with placing a higher value on the life of a dog to run free at a park? What an exchange…the freedom of a dog to come run, play and poop at their own park and the Veterans whose very lives were lost for that freedom are dishonored and disrespected by dismantling their park where they and their families received some kind of recognition for the sacrifices they made, many with their very lives! This issue never ever should have been on the table! Below are additional reasons that the Veterans Wayside Park should remain as is: ▸▸ The Park is a vibrant balanced habitat and even a home during the winter for migratory birds. ▸▸ It is where residents learn to observe and care for wildlife. It is the site for recreational outings and even for school band practice. ▸▸ Finances for maintenance of a dog park would be laid on the residents. Among these costs are the prevention of tick and flea infestation. Ticks and fleas are vectors of many parasites that cause human diseases. This would be a public health problem for the Village of Pinecrest! ▸▸ Another public health problem: Responsible disposal of Dog poop. Who foots this bill? The Village of Pinecrest? ▸▸ Legal costs when Pinecrest is sued for ‘accidents’ of dog bites and attacks. Again, the financial burden on the residents of Pinecrest. ▸▸ Increased traffic flow becomes a traffic endangerment. Let’s respect the decision of Pinecrest as expressed in the dedication in 2007 and the vote in 2010 and pass a resolution that it is The Veterans Wayside Park, in perpetuity!

ENVIRONMENTAL AWARENESS Sea Turtle Conservancy Funds Sea Turtle Nesting Habitat Restoration Project BY ALEXIS PRIETO
T
he Coastal Cleanup Corporation (CCC), a grass-roots non-profit organization dedicated to removing marine debris from the south Florida coastal environment, was awarded a grant for $2,152 from the Florida Sea Turtle Grants Program, which is funded by the sales of the sea turtle specialty license plate. Their project, The Restoration of Sea Turtle Nesting Habitat on Elliott Key, FL (Phase II), was one of 17 approved proposals selected from 44 applications to receive funding. Launched in 1996, the “Helping Sea Turtles Survive” specialty license plate raises money for two important programs that benefit Florida sea turtles—the Florida Wildlife Conservation Commission’s Marine Turtle Protection Program and the Sea Turtle Grants Program, which distributes money back to the local level for sea turtle conservation projects. The local non-profit will use the funds to facilitate the removal of marine debris and invasive, exotic vegetation from coastal dune habitat on Elliott Key within Biscayne National Park (BNP). Earlier this year, as part of a previous Sea Turtle Conservancy-funded project, volunteers from the CCC collaborated with BNP resource managers to remove large amounts of accumulated marine debris from the ocean-side beaches of Elliott Key where female loggerhead sea turtles (Caretta caretta) dig their summer nests. Over 200 trained volunteer participants donated more than 1,800 volunteer-hours to remove massive amounts of accumulated marine debris from the coastal dune habitat, beaches, and mangrove shorelines of the islands within the park. More than five tons of plastic, glass, Styrofoam, rubber, synthetic ropes, lines, and fishing traps were removed by volunteers in just 20 cleanup days of the project. “Unfortunately, with every tide, locally and globally-derived marine debris washes up and litters the island, posing significant obstacles to nesting sea turtles,” said George Pappas, Director of CCC. So far this year, CCC volunteers have been able to maintain the cleanliness of many of the beaches during the nesting season by accompanying BNP sea turtle monitors on their daily patrol and removing accrued marine debris. Data for the 2013 season thus far suggest that the collective restoration efforts are having meaningful impacts on sea turtle nesting activity within Biscayne National Park, as resource managers have surveyed roughly three times the number of loggerhead nests that are typically observed, and for the first time, have recorded an endangered green sea turtle (Chelonia mydas) nest. With sea turtles encountering fewer obstacles as they come ashore to nest, the number of observed false crawls (failed attempts by sea turtles to nest) has also declined this year as compared with observations from previous years. The Sea Turtle Conservancy-funded Elliott Key project will likely have similar future positive effects on loggerhead and green sea turtle nesting activity. The 13,500 square foot store is located at 9205 South Dixie Highway and the trading hours are 8A.M.-9P.M., daily. n Feb 15, 2013, the Village of Pinecrest and town of Cognac, France signed a formal agreement to become Sister Cities. The agreement contemplates a friendship and exchange of culture, information and education, business and tourism. Our cities have some similarities, the population size is similar: they have 19,534 residents, we have 18,300, both have a love of culture as well as host jazz series. Then there are some real distinctions: we are a new city, just 17 years old as a municipality; while Cognac is truly a medieval city, with a beginning in the 11th century. Cognac is the birthplace of Francois the First in 1494. It sits along the Charente River, which was one of the main supply routes for the salt trade, where it flourished. The Cognac region is of course best known for their eau de vie, and is surrounded by 80,000 hectares (192,000 acres) of vineyards. My initial introduction to Cognac Mayor Michel Gourinchas was by happenstance. The Cognac delegation was visiting Miami in February of 2012 and the Mayor and I were both invited to a luncheon at Pinecrest Gardens, where we were seated next to each other, striking up a conversation. A few days later, he and Pinecrest Mayor Cindy Lerner and Cognac Mayor Michel Gourinchas his delegation visited our signing the twinning agreement establishing a sister city relationship. Village Hall for an “official state visit,” at which I issued a Proclamation to signify the day by declaring it “Cognac Day” in Pinecrest. The Mayor was very impressed and promised they would return the following year during Cognac Day. The host organization of that luncheon where we met, Les Dames d’Escoffier, Miami Chapter provided an opportunity to visit France, with a tour of the Cognac region, which I had the great fortune to participate in last fall. The mayor of Cognac held a lovely reception for us at Cognac Town hall, which was when we agreed to pursue the creation of a sister city relationship. And on February 15, 2013, on our second Cognac Day, Mayor Gourinchas, his wife, and two of his Council members came to Pinecrest, to sign the formal sister city agreement. This past month, I was invited to attend the World Mayors Summit on climate change in Nantes, France (all expenses paid by the French conference) and took a quick side trip to Cognac to work on developing an educational exchange program. We visited the Lycee Jean Monnet, their high school, where we discussed how our teachers and theirs could develop educational exchanges through the power of the Internet, followed by visits to each others’ country. They will focus on culture, history, environmental issues and, of course, food. There will also be student trips and exchange programs between the two cities. And finally the opportunity for adults to travel to Cognac will be a real option next summer, as we plan for a Sister city visit there. For more information on Cognac visit www.tourism-cognac.com. hanksgiving is approaching quickly and it traditionally conjures thoughts of family gathered around a table laden with lovingly-prepared foods -roast turkey with the trimmings, savory side dishes, flavorful gravy, buttery rolls and mouthwatering pies. But, according to the Calorie Control Council, the average American may consume as much as 4,500 calories on Thanksgiving Day. If you find that statistic staggering, you are not alone. Dealing with an overabundance of rich, tasty foods can really test your willpower and, without a plan in place, you can end up consuming excessive calories with your Thanksgiving meal. However, there’s still time to develop your holiday eating strategy. Here are some basic tips to help you fight the desire to overeat this Thanksgiving:
Watch your alcohol
Liquid calories also count towards your total caloric intake. Be sure to drink plenty of water and avoid drinking too much wine, beer and hard liquor, which not only adds unnecessary calories, but also lessens your resolve to eat more than you planned.
Leave some food on your plate
There’s no requirement that you must leave a clean plate on Thanksgiving. Try to leave at least one bite of each item on your plate. If you still have food on your plate, it is much easier to decline second portions and stop eating when you are full.
Portion your holiday leftovers
Don’t fast all day
Resist the urge to consume your Thanksgiving leftovers in another big meal. Rather, portion them out in several different size containers and label them with the specific days you plan to eat them. Or, better yet, place the containers in the freezer to enjoy at a later date.
Eat normally before your “big meal”. Skipping breakfast or starving yourself in an attempt to save up your calories for your holiday meal not only slows down your metabolism but it also leads to eating more calories later in the day.
Don’t rush through your meal
Experts claim that it takes the brain 20 minutes to realize you are full so eat slowly and chew thoughtfully. Use your time to enjoy the family and friends around you.

h My Goodness!! It’s November! How did THAT happen?? While we have been merrily going along...going to work... going to Publix…going to kid’s soccer games, football games, tennis matches, dance lessons, school functions, going to dinner parties, movies, shopping…watching the Nightly News, NCIS, The Voice, American Idol, Two and a Half Men…time has been flying by! Yep! Here we are…THE HOLIDAYS! … B-R-E-A-T-H-E… Last month we talked about “Tolerations” - things we all ‘put up’ with. And, now that we are in November, you would expect that we will chat about “Being Grateful”… Uh, NO! My guess is that we will all see so much about gratitude in the next few weeks that we will completely tune it out anyway (and besides, we ARE grateful people, aren’t we?). Instead, I’m going to share a concept that will actually make a large and lovely impact in your life, IF you will adopt its simple process: ELIMINATING DELAY! Eliminate the high cost of delay in all that you do. Delay is one of many challenges (and bad habits) that can be greatly reduced--in your business and in your daily life. I said “simple process” because this one is not rocket science. Just handle things as they come floating by in your life. You receive a gift in the mail from Aunt Martha. You open it (a sweater with puppies on it!), you smile, toss the sweater on your bed, put the card into the pile that is already on the counter and plan to send a thank you note soon. Now, you have a new “To-Do”! If you go to the drawer, get a blank note, write a sweet thank you message, address the envelope and stamp it RIGHT NOW (4 minutes!)... VOILA! Done! Never makes it to your plate! Delay has been averted! A Few Tips on Eliminating Delay: ▸▸ Become the type of person who responds to others’ requests immediately Putting off a response is actually more painful to you than to them. ▸▸ Request immediate response. Begin to expect others to respectfully respond to you in a timely fashion without your having to chase them down…requesting that from the beginning will save you time and energy. It is amazing how powerful your polite request and expectation of others can be. ▸▸ Get rid of your inventory of “To-Do”s. Not easy, but if you begin to tackle the current list, and eliminate delay of new tasks you will get there! Git ‘Er Done! ▸▸ When you find yourself delaying, find out why. There is always a reason and it’s worth knowing why, even if you choose to do nothing about it. Be aware of the red flag of fear. If you find that the reason you are delaying action is often about fear...you might want to seek a therapist to move you through that...or a Coach to lovingly kick your butt! 1/2 cup (1 stick) unsalted butter, melted 1/2 cup sugar 1/2 cup dark corn syrup 2 large eggs 2 tablespoons aged bourbon 1/4 teaspoon coarse salt 1-1/2 cups pecan halves; 1 cup chopped pecans 1 cup (about 6 ounces) coarsely chopped semi-sweet chocolate 1 tablespoon heavy cream 1 large egg yolk 1. Preheat oven to 375 degrees. On a lightly floured surface, roll out pie dough to an 11-inch circle, about 1/8-inch thick. Fit dough into a 9-inch pie plate and trim edge to 1-inch thick. Fold edge under and crimp decoratively. Prick bottom of crust several times with tines of a fork. Freeze for 15 minutes. 2. Remove crust from freezer; line with parchment paper and fill with pie weights (dried beans work well). Bake for 20 minutes. Remove parchment and weights and bake crust for about 5 minutes more, until dry, though not brown. Let crust cool on a wire rack until completely cool. Reduce oven temperature to 350 degrees. 3. Stir together butter, sugar, flour, corn syrup, eggs, bourbon and salt in a medium bowl. Stir in chopped pecans and chocolate. Pour into crust. Arrange pecan halves on top of filling. 4. Whisk cream and egg yolk in a small bowl, and brush over edges of the pie. Bake until the pie is just set in the center and the crust is golden, about 40 minutes. If crust begins to brown too quickly, cover the pie loosely with tin foil. Let pie cool completely before serving. Serve with a dollop of whipped cream if desired.

LEGALLY SPEAKING Using Chapter 13 To Keep Your Home and Other Properties For Much Less Than You Owe BY OMAR J. ARCIA, ESQ., FORECLOSURE DEFENSE AND BANKRUPTCY PROTECTION ATTORNEY
M
ost consumers are familiar with a Chapter 7 bankruptcy in which all of the debtor’s assets are liquidated and credit cards and all other unsecured debt is wiped out. However, within a Chapter 7 bankruptcy you will not be able to modify your home loan or any other amounts owed on any investment properties. Your lender even has the right to continue a foreclosure on your home during a Chapter 7 with permission from the court, which is always granted when the homeowner owes more than the home is worth. Many consumers, however, are unaware or unwilling to consider the immediate benefits of a Chapter 13 bankruptcy. Unlike a Chapter 7 bankruptcy, under a Chapter 13 a debtor restructures his/her debts. A Chapter 13 debtor has the ability to repay over a period of 3-5 years, all mortgage arrearages, late fees and escrow shortages. All credit card and other unsecured debt can usually be negotiated down to about one percent (1%) of the amount owed, and you may even be eligible to reduce student loan payments, wipe out IRS debt, and even reduce your car payments. However, the most beneficial part of a Chapter 13 plan is the ability to remove all second mortgages, lines of credit and other liens (including homeowners’ association liens) from your principal residence. You may also be able to significantly reduce principal balances on investment properties, and pay off those properties in as little as just three years. In order to wipe out a second mortgage from your home, the amount owed for the first mortgage must exceed the market value of that home. As it relates to a debtor’s

investment properties, under a Chapter 13 plan you are able to wipe out any second mortgages or credit lines, and even reduce the principal balance of the first mortgage on each property down to the property’s market value, payable at a low fixed interest rate, and under one affordable monthly payment. Once a debtor submits a Chapter 13 plan and stays current on plan payments, the lender cannot proceed with a foreclosure of any properties listed in the plan. If you owe more on your first mortgage than the home is worth, have a second mortgage, line of credit or other liens on that property, you are a perfect candidate to file a Chapter 13 bankruptcy. If you also have any investment properties which are upside down in value, and would like to keep them because they are generating rental income, a Chapter 13 bankruptcy is the ideal solution to resolve your mortgage crisis instead of wasting countless hours attempting to modify your loans directly with lenders.
