uying local food promotes environmental sustainability. Did you know the average distance food travels is 1,500 miles, increasing dependence on petroleum and increasing greenhouse emissions that contribute to global warming? There is little to no packaging and eating local produce is more nutritious because it is sold soon after it’s picked. The Pinecrest Farmers Market is open from 9 a.m. to 2 p.m. Sundays in Pinecrest Gardens. The market is nestled under a canopy of verdant trees that provide the perfect shade and backdrop for a relaxed weekend morning. Even Pinecrest Mayor Cindy Lerner spends many Sunday mornings at the market with her family and dogs. “A Sunday morning visit to the Pinecrest farmers market provides a great opportunity to browse and buy fresh produce, bakery and ethnic delicacies,

while sharing a leisurely stroll with our dogs, and meeting with friends and neighbors in one of the prettiest settings in Miami-Dade County, “ said Lerner. Buying produce from the Pinecrest Farmers Market supports local farmers who grow organic and local fruits and vegetables in Homestead, the Redlands, Fort Pierce and Clewiston. To add to Pinecrest’s Farmers Market’s environment-friendly setting, South Florida’s first public electric car fast-charging station will be installed in the Pinecrest Gardens parking lot in about a month. Pinecrest Gardens Director Alana Perez is proud to host a market that has grown to become South Florida’s preferred venue for local and organic farmers in a setting like no other. “Not only are you getting the very best of homegrown produce, organic foods and the very best artisan bakers, but our market has grown to become a community gathering spot on Sundays,” said Perez. Spending money on locally grown food increases the value of the land to the farmer, makes development less likely and conserves open green spaces. 8

Over 70 vendors have signed up with the Green Market Co-op, which runs the market. Some of the vendors in Pinecrest’s Farmers Market include: certified Organic Bee Heaven Farm produce, Teena’s Pride CSA, and V&B Farms. The Farmers Market has something for everyone: From Zak the Baker’s artisan breads to Babe Froman Fine Sausages procured with gluten-free, hormone and antibiotic free meats. Forno Italiano Pizza uses only Australian Pine in its wood-burning oven (Australian Pine is an invasive species that displaces native beach plant communities that provide critical wildlife habitats for threatened or endangered plant and animal species). And Living Colors Nursery is the first in the State of Florida to enroll in the Best Management Program, which is a voluntary program that growers can join to affirm they are using practices to reduce exposure to the environment of fertilizers and chemicals. Aside from holding one of the most environmentally responsible farmers markets in South Florida, the Village of Pinecrest champions green initiatives that include: a Strategic Green Action Plan, Sustainable Building Regulations, a Carbon Off-set Program, Florida Green City Certification, LEED Trained Staff and is a Tree City USA for sixth consecutive year. COMMUNITY NEWS “Castaways Against Cancer” Relay For Life Team Ranks 9th in U.S. With the Support of TotalBank

E

by alexis prieto

ach year, more than four million people in over 20 countries raise much-needed funds and awareness to save lives from cancer through the Relay For Life movement. At Relay For Life events, communities across the globe come together to honor cancer survivors, remember loved ones lost, and fight back against cancer. TotalBank was a proud participant with Castaways Against Cancer in support of the American Cancer Society (ACS). As a Lower Keys Relay For Life team, sixteen intrepid kayakers shoved off from Virginia Key this past summer for the “Trip Around the Sun Tour” and paddled from Miami to Key West. Raising $114,593 with the aid of TEAM TotalBank, Castaways Against Cancer ranks ninth in the nation for Relay For Life teams, and as the Lower Keys Relay For Life team earned third-place for highest fundraising team in the state of Florida. This year approximately 5,600 communities participated across the U.S., and 360 Relays took place in Florida alone, with an estimated 10 to 90 teams per Relay. TotalBank teamed up this year with the Castaways for their 14th annual fundraising ACS Relay For Life event. Because of the overwhelming support received from TotalBank employees, customers and friends, they quickly surpassed and more than doubled their initial fundraising goal of $50,000.

“We are thrilled with this year’s Relay For Life results and are appreciative of all the help and support we received from TotalBank. The bar has been set high for next year, but we are excited to see what we’ll be able to accomplish,” stated Steve O’Brien, founder of Castaways Against Cancer. “This was a physically grueling event, but surpassing our initial goal was incredible and worth all the effort and hard work,” said Patrick Linfors, captain of the Castaways team. “For the past 14 years, Castaways Against Cancer has been committed to the fight against cancer and has defined a standard of community giving and sacrifice that is a model for imitation. TotalBank was honored to be their partner in raising funds for life-saving cancer research,” stated Luis de la Aguilera, President and Chief Executive Officer for TotalBank. Averaging more than 22 miles a day, the Castaways paddled a total of 160 miles during their seven-day-long journey. The mission of Castaways Against Cancer is to help find a cure for cancer and to honor those who have fought the fight. The money the team raises supports the American Cancer Society’s Relay For Life of the Lower Keys. ocal artist Patsy Rodriguez never knew that when she was diagnosed with Multiple Sclerosis (MS) she would be led to her passion in life. “Becoming an artist was never in my master plan, but then again neither was Multiple Sclerosis. Painting became an outlet as my world diminished. In fact every step in the evolution of my art was an adaptation of some sort,” explained Rodriguez. Multiple sclerosis is a chronic, often disabling disease that attacks the central nervous system, which is made up of the brain, spinal cord, and optic nerves. Symptoms may be mild, such as numbness in the limbs, or severe, such as paralysis or loss of vision. The progress, severity, and specific symptoms of MS are unpredictable and vary from one person to another. Today, new treatments and advances in research are giving new hope to people affected by the disease.

“Multiple Sclerosis is a journey no one wants to go on, but the arts have made the trip a lot better.” Patsy wanted to find a way to stay busy, but due to her MS, she wasn’t able to follow through with a lot of the movements of physical activities, so she decided to turn to art. Her daughter was taking Karate at the time, so Patsy wandered into the Ceramic League of Miami next door to the dojo. “I fell in love with the place. Unfortunately there was no air conditioning and with kilns firing it was just too hot for someone with MS.” Rodriguez thought her days in ceramics were over. She was then told about an artist who taught tile painting in her home. Working with hand painted tiles allowed her to work on her art at her own pace and in her own space. Early on Rodriguez began putting her hand painted tiles into concrete benches. This seemed a natural for someone who was always looking for someplace to sit when she went out. She worked on private and public commissions in Europe, South America and the US. Her benches were first shown at Fairchild Garden’s “Rambel” in 1998, where they quickly sold out. Many of her benches are now on permanent display in Palmetto Bay’s Ludivici Park, the Dave and Mary Alper JCC, the Allapattah YMCA, Pinecrest Gardens, Carrolton School, Eagle Point Elementary and the Quaker Meeting House. Other tile works, murals and pathways were done at Pine Villa Elementary, Pinecrest Elementary, Coral Reef Montessori and the Children’s Cancer Center. A collaborative bench piece, named “A Day Away” was made with work from the kids with cancer and was shown at the Frost Art Museum. The tile work that Patsy Rodriguez is most proud of is located in Freedom Playground, a universally accessible playground in the city of Tampa. The piece was installed in 2008. “As my artwork and disability have gone hand in hand so too has my involvement as an advocate for the arts and its role in the lives of those with disabilities.” Rodriguez has been a guest speaker and panelist at the International Mosaic Conference in San Francisco, Cummer Museum in Jacksonville, Florida and a part of the Florida Dance Festival. In 2006, she became a founding member of All Kids Included, which is presenting it’s eighth annual Family Festival featuring activities and cultural experiences for children with and without disabilities at the South Miami Dade Cultural Arts Center on May 3rd. Patsy Rodriguez is currently working with students at Feinberg-Fisher K-8 Center and Biscayne Gardens Elementary as part of the teaching artist residency program ‘Hand in Hand.’ She has also recently finished painting both a large fiberglass dog and cat to be auctioned off at the Fashion in the Gardens event in Pinecrest Gardens this month to raise money for local Pinecrest public schools. school news THINK: A New Health and Wellness Program at Pinecrest Elementary School

W

by alexis prieto

hile many kids are spending their after school hours in front of the television or computer screen, a group of Pinecrest Elementary students are using dumbbells, hurdles and hula hoops to improve their fitness. These same kids then head into the kitchen to practice juicing oranges, lemons and limes, peeling fruits and vegetables, measuring ingredients and cracking eggs. When back in the classroom, they’re learning about the importance of physical activity and nutrition, as well as essentials like how to prevent food poisoning. This hands-on learning is all part of a daily 10-week complimentary program being offered to Pinecrest Elementary students who are enrolled in the YMCA after school program. Called the THINK Program (Translational Health in Nutrition and Kinesiology), in partnership with the University of Miami, this new initiative is a preview to the yearlong program that will launch in the fall of the 2014-15 school year. The information gathered from confidential assessments of the children during this trial run of the program will then be used to help develop new programs that improve children’s health, wellbeing and academic performance. “We’re always excited about research-based programs, and this one links wellness with the cognitive function of students so that’s very exciting,” says Principal Marisol

Diaz. “We know students need enriching options after school, and this program reinforces what we do in our regular program. Students can internalize this as a way of life and not just a lesson.” THINK is part of the overall wellness offerings at Pinecrest Elementary. Later this year, the school will partner with the University of Miami once again for a research-based wellness program that will bring experts to the school’s physical education classes. “It will help our students make the connection between going out there and playing and doing sports, and how important it is to be healthy,” Diaz says. “It’s great to be able to take full advantage of a top quality university and bring their expertise to our students.” Pinecrest Elementary also is creating its own wellness policy to complement the district’s policy, which has five cornerstones: nutrition, physical education, physical activity, health and nutrition literacy, and preventive healthcare. The school policy provides teachers with guidelines to incorporate wellness into everyday school activities. “Our staff sees themselves as role models for the children,” Diaz says. In keeping with a healthier lifestyle for the students, the staff at Pinecrest Elementary has revamped the offerings in its vending machine and has also launched a morning walking club for teachers and staff members.

cover story The Recycled Closet – A Local Gem

W

by alexis prieto

e’ve all heard the slogan, “Reduce, Reuse, Recycle.” In today’s society, we are more aware of the effects that our constant consumption of materials has on the earth. The Recycled Closet, a Falls area boutique consignment store, takes this mantra to the very heart of their business. Americans dispose of over four billion tons of worn clothing and textiles annually. EPA studies show 5% of our dumping grounds are composed of textiles. Recycling and reusing clothing keeps them out of our landfills. When The Recycled Closet opened it’s doors five years ago, Jennifer Vosters Kaloti and her daughter Jenna Kaloti-Ramirez, envisioned a place where teens and young adults could not only find the designer brands that they wanted at a price they could afford, but also have a place to “recycle” them when they no longer wanted or needed them. At The Recycled Closet patrons can recycle their “gently used” brand name clothing and get up to 40% of the sale price. This is where the store’s stock of almost-new trendy label treasures such as H&M, Banana Republic, J Crew, BCBG, Theory, Free People, Jimmy Choo, and Marc Jacobs come from. Jennifer says, “It’s a treasure trove everyday. We appreciate our consignors bringing in their items, making our boutique very eclectic. We started with

two consignors and now have over 1,200 consignors in our database.” In the last five years, the popularity and demand for shopping and selling of “previously loved” clothing, shoes, and accessories has increased so much that The Recycled Closet moved from its 800 square foot space to its new 3,000 square foot home in the Warehouses by the Falls. The new space allows for a larger capacity for merchandise as well as customers. They now have room for women’s plus sizes, and trendy urban men’s clothes. The store prides itself on being locally owned and operated. Jennifer is a Pinecrest native and chose to raise her family in the area as well. Both she and her kids graduated from Palmetto Sr. High. Her family has had local businesses in the Pinecrest area since 1953, carrying on the tradition of entrepreneurship. At The Recycled Closet, Jennifer makes it all about the customer. The store started off as a side project, and has become a local success! They have been recognized by AOL’s City’s Best, CBS 4 Best Of, Miami New Times Best Thrift 2013, and well reviewed on Yelp.

There are the regulars that stop by frequently so they can check to see what new items have come in. Since the inventory changes from day to day as the result of traffic in the store, it is recommended to visit frequently to see what is new on the racks. Often times when a consigner comes in to “recycle” their old clothing and accessories, they wander around the store and find a few items to purchase for themselves. Then there is The Recycled Closet’s famous “Dolla Holla” bins. When items go unsold after a period of time, they will end up in the “Dolla Holla” bins. Everything in the bins is marked down to either two or five dollars. If you’re unfamiliar with consignment stores, here’s how it works. The Recycled Closet is a traditional consign-

ment store, which means the consignor’s product must sell in order for them to receive the 40% earnings on the item. In addition to making money from cleaning out your closet, you also could be helping out a great cause. Unsold clothes are donated to Chapman Partnership, a shelter for the needy in South Dade, empowering the homeless. Jennifer also makes monetary contributions to the National Alliance of Mental Illness. Both charities are a passion for Jennifer. With prom and social event season rapidly approaching, The Recycled Closet is in need of gently used formal evening gowns. Finding the perfect formal dress for an occasion at The Recycled Closet is a great way to get a fashion forward find for a small price. They are also accepting winter and ski items, as this is the time of year when Floridians venture away from the hot sun to the colder temperatures. The Recycled Closet is located at 8867 SW 132nd St. and is open Monday-Saturday from 11am-6pm. If you’re interested in consigning and would like to know more, visit www.therecycledcloset.com.

he Village began the New Year by continuing its commitment to economic development and improvement of our US1 corridor with presentations by the Down Town Redevelopment Task Force to residents and the Council. Over the years since our incorporation the Down Town area has been the focus of zoning initiatives aimed at bringing improvements. This recent effort has already stimulated the sale of properties to new interests in the area. Serious corporate attention to the outcome of the Task Force’s work has amplified as the plans become solidified. Coming in the near future are plans for the landscaping of US1, which will improve the look of our community to its residents as well as to those investing in the village’s future. The Task Force, which is a combination of professionals from the financial world, planning, architecture, marketing, and business that are personally invested as residents of Palmetto Bay has done a credible job. Their planning for the future of their community and the positive impact it will have on the quality of life of their fellow residents is a testament to their hard work during this ongoing process. The Task Force is seeking opportunities to meet with groups to explain the plan and receive input. Contact Ed Silva at Village Hall to find out more about this important initiative. The Education Committee has begun working towards the implementation of the Education Compact. The Council approved the final 2 members of the 5-member committee in January. This board will work in concert with community and school system members to ensure the quality of our children’s public education. Our local School Board Member, Dr. Larry Feldman has been an integral part of the creation of the impact. Coming up on the first Saturday of March will be the Village’s Annual Celebration Picnic. This event is talked about all year long as the seminal indicator of what Village life should be about. The 4000 people who attend this picnic each year certainly hint at how important quality of life is to those who live in Palmetto Bay. I hope you will join your friends and neighbors at the Celebration Picnic in March for a great day at Coral Reef Park. I hope to see you there. ebruary, the month when love is in the air and roses and chocolates are the bill of fare. But what if you are in the group of the “uncoupled?” Whether you are newly divorced or have been for a while, the fact remains you are single and dreading the fourteenth. So, what’s a girl to do? Change your perspective starting with a reality check. Stop romanticizing this day of wine and roses. Yes, there are couples in love that grace the restaurants and have flowers delivered. But, there is also the obligatory crowd that does Valentine’s Day because they have to. I am sure if you choose to remember, you will conjure up a Valentine’s Day or two at the end of your marriage that was like that. How lonely did you feel sitting at that dinner table, or how hurt were you when your now ex made the comment about how Valentine’s Day was thought up by Hallmark to make money? My point is this…It’s great to have a “Valentine” but with the right person. Don’t assume everyone you see that day dressed in red is over the moon. There are some pretty sad people that make dinner reservations only to sit across from someone they can’t have a conversation with. Keep this whole day in perspective. Instead of viewing this as a time you don’t have someone special in your life, see the flower vase half full as opposed to half empty. You are now in a position to have the kind of relationship you want. So, look to your future with anticipation and excitement.

So, back to my original question, “What’s a girl to do?” Simply put, it’s a day of love, so love yourself and someone else. Don’t settle by going out with a guy just to say you have a date on Valentine’s Day; it could leave you feeling pretty “blue.” Instead, plan a spa day even if it is in your own bathroom. Or, get with a bunch of girlfriends and dress in red and go out, but with this caveat…there is to be no talk about how you are single, that there are no good guys, etc., as that defeats the purpose. Visit an elderly person and bring cookies or give roses to the homeless people you drive by on the way to carpool. The objective is to be proactive and plan something way before the day of hearts arrives. Give to yourself in a loving way, have fun with it and then give to someone else who might be feeling alone. That being said, I know “they” say Valentine’s Day is for lovers, but I say it is for loving. If you can change your perspective, plan ahead and have fun, I promise you will never look at roses the same way again. usic, talking and laughter filled the air. Although the holidays are behind you, the memories that were shared during this time with family and friends may still be in the back of your mind. You may have even played an old-time holiday song on your record player. You probably selected the right song on the vinyl album for the right moment. And the sound … it doesn’t compare to digital, does it? Do you remember the first record album you ever owned? Hmmm … was it the Beatles, Beach Boys, Bob Seger, Elvis Presley? Are you still listening to your vinyl records? Or are they gathering dust, filling milk crates in the garage, or on a bookshelf in the living room? Do you wonder if they even make these collectibles anymore in a world that is mainly digital in nature? In the mid-60s to the late 70s, vinyl records turned music into America’s most favorite entertainment industry. Today, a record album is a click on a computer mouse. Music downloads become a taste test for the listeners as they browse music online and then purchase a few sample songs. Then, if they like what they hear, they may buy the

According to numbers released by the British Phonographic Industry (BPI) and the Official Charts Company, sales of vinyl albums increased by 101 percent in 2013; however, that still only accounts for less than one percent of the overall music sales. With digital music, the value is really in its convenience and the immediacy of its delivery, and the fact you can play it while doing something else. There’s a quiet ceremony to playing a record. It requires more dedicated listening and planning. It’s the audio quality, the visual quality, and the physical touch of the artistic, one-of-a-kind cover and vinyl album. For those of us that grew up when the vinyl record album was at its peak, it also brings back many fond memories and oftentimes a smile. bouquet can transform your mood in a moment. In fact, studies from Rutgers University have shown that flowers can “trigger happy emotions, heighten feelings of life satisfaction and, in short, make us feel positively glowing.” Flowers are a classic gift used to share and express the emotions we feel for each other at any given moment. Launching March 1st, Kalla, a new luxury online floral brand, will feature bold and innovative floral couture for a relationshipfocused approach to giving. Kalla has found that there are a number of gift givers who can’t find the appropriate bouquet to accurately express what they’re feeling for a friend, family member or significant other. With sights set on providing luxury moments delivered, Kalla will offer uniquely curated bouquets delivered in bloom, paired with high impact packaging and innovative technology to give consumers a personal, new way to say exactly what’s on their mind. How do you know when to give the perfect flower? Be sure your intentions match the bloom with these gift gifting etiquette tips. »» Know your flower colors and what’s culturally appropriate. In Asian culture, red flowers symbolize life and happiness while white flowers symbolize a mourning period. In Mexican folklore, it’s just the opposite. Red flowers cast spells and white flowers lift spells.

»» If you’re attending a dinner party, send flowers ahead of time. There’s no better way to thank a host or hostess than in advance. You don’t have to worry about remembering to bring a gift to the dinner party and they can use the flowers as a lovely centerpiece for the soirée. »» Be an equal opportunity gift giver. There’s no rule that says you can’t send a man flowers. In fact, many men enjoy receiving flowers. Maybe it’s your anniversary or you want to show him you appreciate him. »» And the most important flower etiquette rule of all...You don’t need an occasion to send flowers. Everyone loves receiving flowers. Who doesn’t want to be surprised with a captivating curated bouquet in a chic vase delivered to their door? Four out of five women say they prefer getting flowers unexpectedly. If it has been too long since you’ve gotten your room to bloom, send a bouquet to yourself.

heart health Florida Heart Research Institute Goes to the Dogs with Bark for Your Heart

T

he American Heart Association (AHA) recently issued a statement that owning a pet may help lower blood pressure, obesity, and cholesterol, as well as reduce the risk of heart disease and increase survival among patients. Chair of the AHA committee that issued the statement, Glenn N. Levine, M.D., professor at Baylor College of Medicine in Houston, Texas, says that “there are plausible psychological, sociological and physiological reasons to believe that pet ownership might actually have a causal role in decreasing cardiovascular risk.” What is clear is that dogs help their owners adopt healthier lifestyles. A study of over 5,200 adults showed that “dog owners engaged in more walking and physical activity than non-dog owners, and were 54% more likely to get the recommended level of physical activity.

State of the Art Management of Arthritis in Pets

S

by Dr. Marta Sanchez Emden

o, the family pet’s age is starting to show: walks are shorter and more difficult, going up and down stairs is harder, sitting down is slow and difficult, and climbing on furniture is a rarity. You’re dreading the next visit to the vet because you’re expecting them to prescribe a dozen drugs or worse. Too bad there aren’t more options, right? WRONG! Thanks to technological advances in veterinary medicine over the last two decades, our pets are living longer than ever. Thirteen-year old cats and dogs represent the average age nowadays. Conditions related to old age such as arthritis, limited vision, dry eye, decreased hearing, and senility are managed routinely. In the past, arthritis (osteoarthritis or OA) was seen as an end stage condition with treatment limited to managing pain with medications that could potentially cause harmful side effects. Today, the goal of treatment has changed. We no longer just treat the symptoms. We can now slow the rate of development of OA and more effectively minimize its severity when it eventually develops. This newer medical philosophy is known as the multi-modal approach for OA management. It involves combining pain treatments with different mechanisms of attacking the pain in order to achieve, as a group, better pain control with lower doses and minimal or no adverse effects. The greatest benefit of the multimodal OA management is that it is not limited to the use of drugs as other methods are. The multi-modal approach includes the integration of FDA veterinary approved pain control methods such as stem cell therapy, laser therapy, acupuncture, thermotherapy, massage, therapeutic exercises, therapeutic analgesic/antiinflammatory diets, supplements and weight management. Seek a veterinarian certified and experienced in animal rehabilitation to plan an OA management strategy for your pet. The rehab clinician will be able to identify concurrent impairments that contribute to the pet’s disability such as trigger points, atrophied or spastic muscles groups, compensatory postures, and areas of referred pain. They will then prescribe a customized rehab plan for your dog or cat’s specific motion impairments. The rehab clinician will objectively monitor your pet’s progression and will modify the program as your pet improves, facilitating a successful outcome. car care Cars, They Have so Changed for the Better

I

by michael stoklosa, PRESIDENT, M&R AUTO REPAIR

have been driving cars since the mid-70’s and repairing them since the early 80’s, and boy have they changed. In the cold weather you prayed they would start and then had to wait for them to warm up before you could drive them safely. Today you turn the key and they start and off you go. Cars are running the best they have ever run. They are getting fantastic fuel economy and have impressive power from much smaller engines. We now have creature comforts we never thought of before; adaptive cruise control, heated & air conditioned seats, seats that massage you while you drive, back up sensors and cameras, zone air conditioning, hybrid technology and of course connectivity with GPS navigation. We have come a long way from the first horseless carriage to today’s automobile. So has the repair and maintenance. You may not believe it but your car requires far less repairs then even before. The combination of better technology and automated production has given the consumer an extremely reliable product. Unfortunately, you still need to maintain your vehicle. Maintenance service is more critical than ever. Make sure you follow your manufacturer’s recommended service intervals and that your service person uses the proper lubricants in your vehicle. Neglecting your maintenance will definitely cost you, and cost you big. Cheap service is not an option. Question the person servicing your vehicle. Will they use the proper weight oil? It used to be there were only a couple of different oil blends for engines; straight weight and 10w30 or 10w40. Today’s engines vary widely. There are 0w20, 5w20, 5w30, 10w30, 20w60 and then all the same in synthetics. Your vehicle may or may not require synthetic oil. It matters!

The same gauntlet occurs with transmission fluids, power steering fluids and differential fluids. All fluids need to be changed on a regular basis; they are the lifeblood of your car. Check your owner’s manual and speak with your service professional. It’s critical you know when to have your vehicle serviced. Following these service recommendations will help ensure your vehicle runs well and problem free for several hundred thousand miles. That’s right, several HUNDRED THOUSAND miles. Use to be at 100,000 miles your car was pretty much worn out and in need of a major overhaul from bumper to bumper. Not anymore. I regularly see vehicles with 200,000 miles on them and running strong. Mind you, all of these drivers have been religious with their maintenance. Maintenance, maintenance, maintenance! It’s the recipe for happy car ownership. Find yourself a mechanic you like and trust. That might be a challenge. Do your research. Google them, ask friends whom they use for maintenance, visit the shop before you need major repairs and ask lots of questions. If you don’t like the way they answer or talk down to you, find a different shop. There are good ones out there. Once you find a good one, be loyal and recommend them. A good mechanic will save you money in the long run and give you peace of mind. Buckle up, no texting and smile. M&R Auto Repair is owned and operated by Michael Stoklosa and has been serving South Florida since April of 1985. legally speaking New Loan Modification Program is 85% Successful

A

By Omar J. Arcia, Esq., Foreclosure Defense and Bankruptcy Protection Attorney

fter much anticipation, on April 1, 2013, the new Loss Mitigation Mediation Program (“LMM”) was launched in all South Florida Bankruptcy Courts. This new program is in direct response to the frustration experienced by many homeowners who have tried to modify their home loans time and time again without success. The success rate for traditional loan modifications outside of bankruptcy is less than 20%. So far, however, about 85% of the eligible homeowners that have completed the LMM program have obtained permanent loan modifications with significantly better loan terms. Here are some of the other benefits of the LMM Program that you need to consider. »» Under the LMM program, the foreclosure process stops immediately and any foreclosure sale date is automatically cancelled. »» The entire program is court supervised, a mediator will be appointed to your case, and all negotiations must be concluded and a decision rendered within 150 days of the date a mediation Order is signed by the Court. »» The other frustrating feature for homeowners about conventional loan modification applications is the fact that lenders continuously misplace documents or require updated documents. Under the LMM program there are no more “lost documents” by the bank since all documents are uploaded to a single website to which all parties have immediate access. »» If the lender refuses to provide a timely response to a completed loan modification application, or even refuses to participate in the program, the homeowner now has the right to seek assistance from a federal judge to ensure that the lender complies with its obligations. This enforcement component is simply not available to homeowners trying to do a loan modification on their own. »» The program applies to both Chapter 7 and 13 if you are surrendering a property, but loan modifications under the LMM are only available under a Chapter 13 bankruptcy. »» There is an increased likelihood that your Chapter 13 Bankruptcy Plan will be confirmed by the Trustee given that once the mortgage loan is modified under LMM, the homeowner’s future financial picture is more clearly defined. While these are exciting new benefits for any homeowner struggling with a loan modification of their mortgage, a Chapter 13 bankruptcy petition is NOT a do it yourself proposition. In fact, many consumers attempt to file their own, and their cases are dismissed with prejudice for 180 days for failure to comply with the Bankruptcy Code. This means that you cannot refile for bankruptcy during that time. Any homeowner even considering this alternative must seek sound legal advice from attorneys with Chapter 13 bankruptcy experience, like the knowledgeable staff at the Arcia Law Firm. More detailed explanations of different options available to homeowners considering bankruptcy are discussed in a new consumer-friendly DVD developed by the Arcia Law Firm entitled “Fight For Your Home.” If you mention that you heard about the DVD through this magazine you will receive a FREE copy during the appointment to discuss your case in detail with a member of our qualified legal team. If you are struggling to make your monthly mortgage payments, or if you just received a foreclosure summons, contact the Arcia Law Firm today at 954-437-9066 to schedule a free consultation, or visit www.arcialawfirm.com for more information.
