A New Cure For A Common Problem

A

FFECTING ANYWHERE BETWEEN 20 TO 45 PERCENT of middle-aged and elderly women (according to the North American Menopause Society), vaginal atrophy may be the least talked about, yet most common, problem for women of a certain age. Now there is a solution! The Mona Lisa Touch is an FDA-approved medical laser available for use in the U.S., replacing past treatment options such as hormone therapies, which are often laden with side effects or contraindications. So what is the Mona Lisa Touch and how does it work? Here’s what you need to know. WHAT IS VAGINAL ATROPHY AND WHAT CAUSES IT? Vaginal atrophy is a condition often coinciding with menopause in which the vaginal walls thin and dry out, creating issues with urinary functions, dryness and tightening as well as pain during sexual intercourse. Though often painful and frustrating for sufferers, few women ask for help –or know it exists. HOW DOES THE MONA LISA TOUCH WORK? The medical laser works similar to other laser treatments, counteracting the atrophy by stimulating collagen

production inside the vagina rather than altering hormone levels; essentially rehydrating, reviving dead skin and improving the condition of the vaginal walls. WHAT DOES THE PROCEDURE ENTAIL? Patients will receive three treatments spaced about six weeks apart. Each procedure takes only a few minutes to perform. The procedure is done in-office (patients feel only a small vibration) and requires no anesthesia or painkiller, with patients able to resume sexual intercourse after about 48 hours. After the three treatments, some patients may return for annual maintenance. HOW FAST WILL PATIENTS FEEL THE RESULTS? Many patients experience symptom relief after just one treatment and almost all feel a difference after the second. IS IT SAFE? A multisite study was conducted by two leading Urogynecologists who are experts in the field of post-

menopausal gynecologic health; and recent results from a trial on postmenopausal women and breast cancer survivors showed positive results and high patient satisfaction. HOW CAN I GET MORE INFORMATION? For more information and to see if you are a candidate for the Mona Lisa Touch, contact Ana Bueno, R.N. at South Miami Women’s Health / Drs. Happy Father’s Day!

S

UMMER IS OFFICIALLY HERE AND WITH IT COMES THE end of school, the beginning of vacation time and the beauty of less traffic. Longer days and less activities make summer a perfect time to explore some of the fantastic activities and opportunities that make South Florida great… many of which are the direct result of our own community members hard work and dedication. This month we spoke with two of those innovators: Grove native Stephanie Ansin, whose Miami Theater Company just received an NEA grant for an upcoming show (page 14) and Palmetto alum David Brownstein, who recently returned from Los Angeles to bring his years of experience in family entertainment to South Florida families and businesses (page 15). Also in the issue we celebrate our 2nd annual Father’s Day special feature (page 20). This year we’re proud to share a diverse group of fathers, sons, daughters (and even in-laws) who share more than just a name. Their take on family dynamics in the workplace and thoughts on what and how they’ve learned from each other is inspiring, funny, educational and, in the end, heartwarming. And don’t forget to connect with us via social media. You can find us on Twitter (@FloridaVillager), Facebook (The Florida Villager), Instagram (@thefloridavillager), and Google + (The Florida Villager). You can also find an online version of our publication at www.TheFloridaVillager.com. Sincerely,

Coral Gables Bar Association Celebrates 50th Anniversary of Miranda v. Arizona Secision on Law Day BY ANDREA CARNEIRO

O

Originally conceived in 1957, the annual Law Day was envisioned a special national day to mark our commitment to the rule of law. The following year, President Dwight D. Eisenhower established the first Law Day. Law Day was made official in 1961 when Congress issued a joint resolution designating May 1 as the official date for celebrating Law Day. “We cannot thank the members of the Coral Gables Bar Association enough for volunteering their time to make Law Day a success for the bright and talented students of Coral Gables Senior High,” said Lana Naghshineh, Esq., a director of the Coral Gables Bar Association. “The enthusiasm of the students and their apparent interest in the law is promising – our future is in good hands. “ Following the presentations, Judge Millan and Nyberg held a question-and-answer session with the students. These students all submitted essays on the Miranda v. Arizona case to the Coral Gables Bar Association as part of an annual Law Day essay contest. Correa personally presented the students with the top two essays with their prizes. Jordan Morina was awarded $1,500 for his first place essay and Francesca Mocci received $500 for her second place essay.

N MAY 6, 2016, THE CORAL GABLES BAR Association sponsored Law Day at the Coral Gables Branch Court with a celebration of the fiftieth anniversary of the U.S. Supreme Court case Miranda v. Arizona, which guarantees that any individual who is accused of a crime is advised of his or her rights. Forty students from Coral Gables High School participated in the event. Guest speaker, Judge Stephen Millan explained the history and significance of the Miranda decision to the students. Ramesh Nyberg of Nyberg Investigations, and 21-year veteran of the Miami-Dade County Police Department’s homicide division, was also a guest speaker and explained how this court decision has affected taking suspects into custody and questioning. “Our goal was to demonstrate that Miranda is more than words – that this law and its underlying principles are essential to our justice system and our culture,” said Andres Correa, Esq., president of the Coral Gables Bar Association. “We are thankful that Judge Millan and Mr. Nyberg were so generous in volunteering their time for this important cause. It is essential that we educated our future leaders so that we can work together to uphold and protect the procedures that ensure justice.”

Vizcaya Celebrates A Study of Robert Winthrop Chanler With New Book BY ANDREA CARNEIRO

T

HOUGH THE MAJORITY OF HIS WORKS REMAIN tucked away in private collections, American artist Robert Winthrop Chanler is well known for straddling the divide between fine and decorative art and defined notions of originality and authorship during the birth of American modernism. Two of his only public works (the pool grotto ceiling and “Vizcayan Bay” screen) happen to reside within South Florida at Vizcaya Museum & Gardens. An interest in those works prompted a 2014 symposium on Chanler, which paved the way for “Robert Winthrop Chanler: Discovering the Fantastic,” out this month from Monacelli Press. We spoke with Vizcaya Curator (and symposium organizer) Gina Wouters and Vizcaya Conservator Lauren Hall about Chanler’s legacy, the creation of the book and the efforts to preserve what remains of his work.

TELL ME A BIT ABOUT THE IDEA BEHIND THE BOOK.

Wouters: We always intended on having some form

of a proceedings publication [from the symposium], but ultimately decided to partner with a press that would produce a full-scale book with a broad distribution reach. Monacelli Press was a great partner because they have a high standard for producing books of great quality that are visually striking and present content. It is hard to find a press that is committed to scholarship and doesn’t just want to produce an attractive picture book.

WHAT WAS THE PROCESS OF PUTTING THE BOOK TOGETHER?

Wouters: The

content of each essay was already developed for the October 2014 symposium but the majority of the authors had their research underway for over five years. Authors refined their materials and submitted finalized text at the end of 2014. In early 2015 Vizcaya worked on editing the essays and since we all had the same protagonist, Robert Winthrop Chanler, there was significant review to ensure consistency and omit overlap.

Gina Wouters

conservation challenges. Vizcaya is approaching the preservation of Chanler’s mural in three phases including (1) Investigation and Documentation, (2) Materials Analysis, and finally (3) Treatment and Presentation. We’re currently completing phase 1 and beginning phase 2. Our overall project objectives are to stabilize the mural, better protect it from the ravages of the environment, establish a more cohesive aesthetic, increase accessibility to the space, and communicate about Chanler and his artistic intent. We are collaborating with a number of conservation professionals to conduct the comprehensive research required for such a complex project.

THE BOOK INCLUDES NEW PHOTOGRAPHS OF CHANLER’S WORK, MOST OF WHICH

WHY HAS THERE BEEN SUCH AN INTEREST IN HIS WORK?

Wouters: It’s important to mention the preservation

urgencies that plague Chanler’s immersive spaces and also drove the momentum to an extent. Finding a solution for how to preserve Chanler’s work is a time-sensitive question as paint flakes off on a consistent basis. The confluence of scholarship and conservation treatments has led to a dialogue between professionals challenged with the same objective.

Hall: Given that the mural is situated outside, over a

RESIDES IN PRIVATE COLLECTIONS. WHAT WAS MOST INTRIGUING ABOUT VISITING THE WORKS DURING THE BOOK PROCESS?

Wouters: It was a fascinating process to view extant

works that I and most other scholars had only been familiar with from a publication from the 1920s. Just being able to be in the physical presence of Chanler’s work is rare as the majority of his pieces are in private hands. A few days ago the Whitney Studio in Greenwich Village announced that they would begin offering tours of the phenomenal Chanler interior at the site. These are the only opportunities the public has to see Chanler’s work. Naturally, being surrounded by it for days was an extraordinary moment and honor, likely not to be duplicated. Hall: Accompanying Gina to New York to assist with photography for the book was an extraordinary opportunity to experience a diverse volume of his work. Observing these works of art in person enabled me to begin to recognize the artist’s hand, invaluable to understanding the creative process of an artist as distinctive as Chanler.

David Brownstein of Sounds Sweet Entertainment BY ANDREA CARNEIRO

C

REATING QUALITY EVENTS AND ACTIVITIES FOR CHILDREN IS NO EASY feat, but for Sounds Sweet Entertainment owner David Brownstein it’s turned into an award-winning career. The Pinecrest native turned Los Angeles resident turned Miami resident again channeled a love of performing into a career that has seen him go from in-demand kids DJ (he’s done more than 800 parties as “Groovy David”) to full-service entertainment company. Today, Brownstein not only works with families but also hospitality companies (think hotels and cruise lines) and event spaces to create what he calls “incredible family experiences.” We caught up with Brownstein to talk summer fun, kid’s demands and why sometimes the simplest idea is the best.

SUMMER IS PRIME PARTY AND WEDDING SEASON, WHAT’S THE ONE THING PEOPLE SHOULD REMEMBER WHEN INCLUDING KIDS IN AN EVENT? The first thing I would say is that you should always think about the type of party that you would like, rather than what others think you should have. You know your friends and family best. Then I would think about breaking down what you want for the day. An activity that you think will take an hour may only take 20 minutes, so think about how to schedule activities that will keep everyone occupied. We offer everything from interactive dance troupes to jugglers to stilt walkers as exciting entertainment options. Ask yourself “What am I trying to get to?” “What do I want the event to be about?”

WHAT ARE SOME NEWER TRENDS IN FAMILY EVENTS? A lot of people are trying to be more environmentally conscious, they want to use materials that are green and create less waste. Less plastic tchotchkes. So it’s about trying to find inventive ways to do that. People want a cherished memory, but they go home with buckets of stuff. For example, we just started our “Throw a Party, Donate a Party” initiative… if you throw a party with us we will donate our services to a charity or nonprofit. People have really responded well to that!

Discipline. Integrity. Loyalty. Miami Dance Project offers first class, trend setting instruction and services to the South Florida community, with a unbridled passion for the art of dance and performance.

REGISTER NOW FOR SUMMER C AMPS!

WHAT ABOUT THE CLASSICS? Oldies are goodies for a reason… you don’t have to overthink it. Take bubbles. You can’t go wrong there. My job is to work with event planners, corporate clients and families and take something classic and make it out of this world.

SHOULD YOU INCLUDE KIDS WHEN PLANNING AN EVENT? I always like to get the feedback of the kids and hear their feelings about the party if possible. That’s where I can be helpful, to let an outsider say “your friends are going to be there too… let’s think about what they want to do.” I turn down karaoke suggestions all the time because you may have three girls who love to sing and the rest are just sitting and watching.

SWITCHING GEARS- WHEN YOU WORK WITH LARGER COMPANIES OR HOTELS HOW DO YOU ADDRESS SAFETY AND PARENT CONCERNS? Safety is underneath everything we create, that’s the bottom line. From developing the hotel activities, training the staff, to the running of the event itself. Right now we’re looking at partnering with an app that will update parents during the day of how an activity or event is going. Maybe it’s a picture or a text about what their child is doing. We’re always striving to find inventive ways to keep parents updated so they can enjoy what they’re doing without worrying about the kids.

“Combining the concept of art and service has always been a major focus since the inception of Riviera Preparatory,” said KleinYoung. An inspiration and role model for her students, Klein-Young (in addition to her role at Riviera) operated ArtSouth, a non-profit arts organization that provides art enrichment programs for children living in Chapman Partnership for the Homeless and communities whose children lack the economic resources to benefit from exposure to the arts. That connection led to a special fundraising opportunity for Riviera art students when they set up face painting stations at the annual Palmetto Bay Picnic (they also face paint for Chamber South and the South Miami Art Show). “We have over 20 students participate/volunteer at each event,” says Klein-Young. “Many yearly opportunities are open to all 100+ art students, who generally find a way to use their artistic talents to benefit the communities in need.” In the end, face painting efforts at the Palmetto Bay picnic resulted in $500 in earnings, all of which were donated to ArtSouth. Another project originating in Klein-Young’s class focused on ceramics students. The students created realistic replicas of their favorite foods out of clay and held a silent auction, earning $500 in cash donations for Camillus House’s art program. “The Camillus House project fused the idea of creating ceramic pop-food projects with awareness of hunger and homelessness in Miami-Dade County,” said Klein-Young.

T HE PHIL ANT HR O PIST A person who seeks to promote the welfare of others, especially by the generous donation of money to good causes.

Faith in Family BY ANDREA CARNEIRO

NAME:

Elyssa Lewis Jewish Adoption and Family Care Options (JAFCO), jafco.org BACKGROUND: A South Florida native, Elyssa Lewis is no stranger to giving of her time to the local community. The Gables resident and mom of two not only acts as current PTA President at Pinecrest Elementary School but also as Sisterhood President at Temple Judea. Add to that her work with JAFCO and many might wonder how she manages to fit it all in. “It sounds cliche but it really doesn’t seem like that much when you’re in the middle of it,” she says. “I love helping and I love being around people so it’s sort of a no-brainer.” In fact, it was her work with Judea that brought her back to JAFCO after first hearing about the organization when she was a JCC camp counselor in college. “Some afternoons we would take the kids to Jewish Family Services and it always stuck in my head that there was an organization trying to help these kids,” she says. “When we did a Chanukah drive for them at Judea a few years ago I connected the dots that they were still here and still doing great things.” ABOUT JAFCO: Established in 1992, JAFCO is a non-profit organization dedicated to providing services to abused and neglected children in South Florida. They provide programs and services for at-risk children and children with developmental disabilities and their families at both their Children’s Village and Ability Center sites including: emergency shelter, group homes, foster care and adoption, family preservation, in-home therapy, special needs programs and more. “I am incredibly proud that even though Jafco takes in children from all religions, they work to keep Jewish children connected to their heritage and allow them to live as a family,” says Lewis. The Miami chapter, to which Lewis belongs, is one of more than a dozen in Miami-Dade and Broward counties as well as in New York, New Jersey and Philadelphia. “Because the Miami chapter was so small when I joined it was easy to become involved and to really feel like you were doing something,” she says. A DIFFERENT KIND OF FAMILY: Far from just providing a basic range of services, Lewis says it’s the not-so-little things that JAFCO provides that make her most proud of the organization. Children residing in their group home (located at JAFCO Children’s Village, a gated private residential community with six single family homes, a basketball court, a swimming pool, and a playground) are kept at their home school whenever possible and given access to tutors, therapists, music lessons, cultural outings and more under the supervision of a house parent. “They can go to college and have the opportunity to have a bar or bat mitzvah,” says Lewis. “They can stay in JAFCO’s care and in group homes until they are 24, which is really amazing.”

18

06.2016

FUTURE PLANS: Chapters will kick into high gear come September when fundraising events begin again along with planning for their annual March luncheon. “We’re always looking for people to host something at their home,” she says. “A camp shower, a baby shower... It’s an easy way to help without making a big financial and time commitment.” Lewis is also happy to spread the news about a newer fundraising initiative, the Birthday Club. Created by Lewis, along with friends Heather Sosler, Laura Kaplan and Julie Paresky, the Birthday Club allows donations to be routed directly to children within JAFCO’s Village to help them celebrate their birthdays. Donations (accessible via the JAFCO website) range from $36 for a birthday cake, to $108 for a dinner out with friends, to $504 for an entire birthday celebration. “We wanted our own kids to get involved in some way and to create something that would be relevant to them,” says Lewis of the birthday idea. “It’s one thing to give a holiday present, but it’s another to help someone have a great birthday... that’s a big deal.”

2ND ANNUAL FATHER’S DAY FE ATURE

FAMILY TIES

FORGET SUNDAY DINNERS AND HOLIDAYS, THESE FATHERS AND CHILDREN TAKE TOGETHERNESS TO A NEW LEVEL AS THEY MERGE BUSINESS AND FAMILY. HERE’S HOW THEY DO IT, WHAT THEY’VE LEARNED AND WHY IT’S BROUGHT THEM CLOSER THAN EVER… BY ANDREA CARNEIRO

HOWARD S. REEDER, INC.

Steele Reeder, Trey Reeder and Alicyn Reeder-Drujak Larry and Ross Reeder

ON CONNECTIONS: Alicyn: “I think working with my father [Steele] has brought us closer. Now we not only connect on a personal level but on a professional level as well. It’s these different perspectives that have allowed me to fully realize what an incredible man he is.” Larry: “One of the best parts of working [with my son Ross] is having the opportunity to lunch together and share experiences.”

ON FAMILY BUSINESS: David: “The best thing about working together is working with someone who has the company’s, and your, best interest at heart.”

ON TRUST: Steele: “There is no better feeling for me than to introduce clients to my children [Alicyn and Trey] who have such an active role in the advancement of the company. The most surprising thing for me is that I find myself going to them for ideas and opinions more then maybe they come to me.” Alicyn: “I’ve learned from my father how to have complete faith in your children’s ability. Very early on he bestowed responsibilities upon me that at times I was not sure if I would be able to handle. His unwavering faith in my abilities gave me the confidence to always be successful.”

SOUTHERN PACKAGING MACHINERY CORPORATION

David Raska and Audrey Raska Phillips

ON LESSONS LEARNED:

ON EACH OTHER:

Audrey: “I’ve learned a multitude of valuable lessons from my father, but the most prominent lesson is to survey the entire situation thoroughly before making a major decision.” David: “Audrey has taught me how to pay more attention to detail and to not procrastinate.”

Audrey: “Not only am I afforded the opportunity to see my father every day, but I’m able to better understand this industry and learn from both him and his peers. My father is very highly regarded in the packaging equipment industry and it’s inspiring to catch him in a moment of brilliance.” David: “Audrey doesn’t stop at success, she strives for perfection.”

MURAI WALD BIONDO & MORENO PLLC

Gerald and Brandon Biondo

ON LIFE BALANCE: ON CREATING A LEGACY: Brandon: “Getting to interface with his clients and their families, and in some cases, starting to work with his clients’ children has created a genuine feeling of family progression within the firm. I look forward to continuing the business once my father eventually retires. Also, the added treat of a free lunch every now and then is not something I’m going to complain about.” Gerald: “Practicing law with Brandon has given me a fresh perspective. The law is constantly evolving and Brandon always has creative solutions to resolving issues our clients face when trying to get deals closed. I have learned to keep an open mind and have grown as a lawyer watching my son in action. He has rejuvenated my career as I would have likely retired a while back, but now look forward to practicing law for several more years.”

ON SURPRISES: Rick: “After 15 years [of working together], we are surprised as to how well we continue to keep our daily lives fresh with new ideas and added value to our clients and the community. We have attained a harmony of passion and brains and have fun sharing in the life experience.”

20

The Florida Villager

Brandon: “Growing up, my dad was always active in all aspects of my life, from schoolwork to coaching my sports teams. I never realized the balance this must have taken until I entered the workforce myself. This has taught me the importance of being present and involved in my two sons’ lives. I now coach my oldest son’s basketball team, which is the very same league that my dad coached years ago. The importance of having a balanced life at home while working hard every day in the office has been such an important example for me in my life.”

TONKINSON FINANCIAL, INC.

Rick and Steven Tonkinson

ON LEARNING FROM EACH OTHER: Rick: “Steven is a true renaissance man who is talented and knowledgeable in many diverse topics. I learn new facets of Steven when we are talking to clients that I enjoy very much.” Steven: “My dad is open-minded and willing to adjust to the numerous business and community projects we are involved in. He is my role model on giving back to the community. His focus is to be efficient and effective.”

2ND ANNUAL FATHER’S DAY FE ATURE

ON COMMUNICATION: Kim: “We have worked together for 5 years but [my father-in-law] has been in my life since I was 19 years old. He has really helped me transform from a more corporate mindset into to the mind a small business owner.” Ted: “We must always be aware that whatever we say or do carries over to the rest of our lives. Kim is very kind and always puts up with my requests… however, she does have a mind of her own and shares with me what she thinks. The best thing about that is that we care for each other enough to be able to express ourselves openly, knowing that whatever we say to each other is for the betterment of our family business.”

ON TRADITION: Ted: “The thing that surprises me the most is how much Kim is similar to [my wife] Janice. She is a hard worker and is kind to all the customers. She tries to please everyone and is very tolerant, but she still has the ability to put her foot down and resolve issues.” Kim: “My in-laws have really shown me that the people who walk through our doors aren’t just customers, but friends and family within a business that has been around for more than 50 years. Each person has a story and an individual need and I try to remember that every day.”

HIRNI’S WAYSIDE GARDEN FLORIST

Ted and Kim Tate

ON BALANCE: Kim: “Being part of a family business he has helped instill in me that even though business is very important family comes first. Running back and forth to the kids school for special events or just to take them to an afterschool activity is important, and if I am unavailable to make it he is always happy to do it. It is most surprising and inspiring to me what a well balanced life he leads.”

CLARIN EYE CARE

Drs. Bruce and Adam Clarin ON SHARED VALUES: Adam: “I’ve learned that people and relationships are the keys to success. There are always ways to make more money but nothing will propel your success like treating people well. My dad has built his entire practice on integrity and respect- two things that are the backbone of Clarin Eye Care to this day.” Bruce: “From being a past president of the Pinecrest Business Association to dealing with patients at our office and even our staff, Adam has such a charismatic personality and it has not only helped him bring in patients, but also become such a respected member of this community.”

ON LEARNING NEW THINGS: Adam: “I never knew my dad was so funny. I hear patients laughing all day long throughout the office and I know that his humor is part of why they enjoy coming to our office.” Bruce: “Adam brought a new energy into the office. It has truly been a pleasure to see him grow into the optometrist he is today, and it gives me such a feeling of pride to hear patients tell me how great of an eye doctor he is and how much they respect him.”

THE YOUNG GROUP

Rocky and Dustin Young

ON GROWING AND CHANGING: Bruce: “Since Adam has joined, he has completely transformed our office. From the technological improvements to the recent expansion of our office, Adam has had the drive and the vision to transform Clarin Eye Care into Palmetto Bay’s premier eye care center.”

ON SHARING IDEAS: Rocky: I’ve been surprised by how much we think alike and how well we get along [at work]. It’s wonderful to be able to pass along years of experience to Dustin and work with a highly intelligent and motivated partner. Dustin: One of the best parts of working together is our deep conversations about investment ideas and how to best implement into our practice. We have a lot of fun bouncing ideas off each other.

ON LESSONS LEARNED: Dustin: I’ve really learned how to be patient and not let my emotions dictate my decision. Rocky: I’ve learned what a great job I’ve done as a father! Just kidding-I have learned a lot about being organized from Dustin.

MIAMI AWNING COMPANY

Michael, Joe and Dan Reilly

ON FAMILY BUSINESS: Michael: “I worked with my Dad for 20 years before he retired and have worked with my sons about five years. I get to see my sons every day and working with them has been a life lesson, as I have learned their strengths and also their weaknesses. It’s a good thing, though, because it helps us all to understand one another better and in a new light.

ON PAST AND FUTURE: Michael: “I’ve learned that my father was right about many things. Especially to not worry about what others are doing but only about what you are doing. It’s the only thing you can change. I learn about myself more every day by working with my sons. My sister, who has worked with me for more than 30 years, says it’s my comeuppance. But it’s important to have a younger fresh view in the mix. I love it!”

They generate federal income tax, state taxes and property taxes for the local municipality. The homes where these families live contribute with property taxes as well. Families care about each other and are willing to go the extra mile with their business to help one another. It’s refreshing to speak with a vendor that listens and responds without the use of scripts to address the issue. Family businesses can adapt to the individual circumstance and do what is right with autonomy in decisions — that right there is one reason why family run businesses will always have a market, their ability to make decisions at market speed. Another benefit is that those businesses can depend on family members to deliver complete service; it’s inherent. There is built-in accountability to ensure that. The marketing that promotes the business creates accountability with the community to deliver on the promise of excellent customer service. Right? Generational long-term service provides real-life opportunities to demonstrate shared values, work ethic and the consequences of every day decisions and actions. It shows the next generation how to work and make an honest living and allows them to set realistic goals for their future. A family that works together wins together and shares challenges when they come. This creates different perspectives with the same end goal, but with no hidden agenda or politics. It breeds transparency and trust in each other to do whatever has to be done, rain or shine. The juice that propels the business comes from the very basic need to provide for each other, now and in the future. A veritable raison d’être (purpose of being). In fact, we recently had the pleasure to work with a family that has been in the same business for nineteen generations. They have just moved here and are setting up their business. Welcome! Families that own businesses also care about the community by giving their time and talents. They show community care by contributing as committee leaders or within social groups in town, including coaching sports teams, organizing fund raising, participating in local council meetings, donating to charities and actively engaging with others for the improvement of quality of life. It takes a village to raise a child and we’re blessed to live in an area where people help each other. Sometimes random opportunity gives strangers a chance to teach a simple lesson. There are more people doing good than the opposite. Look and see for yourself. We do need family time and to keep separate the conversations about the business. That is a challenge in and of itself. Our own standard is to not discuss business after 7 p.m..We recognize that when we are blessed with business, it is part of our job to have down time that allows us rest and gives us the energy and clarity of mind to deliver on our promise of excellent service. 90 years after its inception, The Keyes Company continues to deliver services to you in South Florida. We are truly dedicated to and dependent of the local market. A Miami family owns and operates the company that then contributes right back to the local community. The DeValdivielso Team is part of this company and we are now into our second generation and counting… Thank you for your support!

LEG ALLY SPE AK IN G

Keeping It In the Family BY ANGELA BOUSALIS, ESQ.

T

HINKING ABOUT STARTING UP A FAMILY BUSINESS OR LETTING YOUR children take over the family business when you retire or pass away? The smartest move for either case is legally planning ahead and your best bet to keep it in the family is to seek a general legal practitioner. Many times when a family member ends up in our office, it is due to a problem that could have been avoided through good legal planning. Without prior legal planning, a situation may tear the family business apart and cause it to be wound down, or worse, litigation may ensue for years. A family owned business may be defined as any business in which two or more family members are involved and the majority of control lies within a family. There are many successful family-run businesses out there, such as Comcast, Walmart, Ford, Carnival, Nike, Phillips, Samsung, Volkswagen, Anheuser-Busch InBev, and now Facebook, to name a few. Running a family business has its advantages. Mainly, you keep the wealth, if successful, in the family. You can keep the family employed. Family members are uniquely suited to understand each other because they have a closer relationship than outsiders. You can give family members a solid informal training. Family members are committed to the success of the business. However, the disadvantages can quickly and suddenly put an end to the business. The three most common disadvantages are discord or rivalry between family members at home affecting their work; lack of business continuity or successful succession, and divorce. For example, the family hierarchy at home may or may not be the hierarchy at work: at home Dad makes the rules, but at work Mom makes the decisions, or maybe Son or Daughter wants to lead and it is difficult for the Dad to take orders from the child. Another example could be the head of the family passing away and leaving the children fighting over the business assets. Even when the head of the family leaves a will, there may still be hostility and rivalry if a child who has not been as invested as another in the business is left a piece of the business. Many disadvantages, as well as the most common three outlined above, can be avoided with legal planning. A shareholder’s agreement could have an employment agreement for each family member, that way when Dad calls in sick too many times, he can be terminated, or Daughter lands a new client she knows what her commission will be; thus, reducing or avoiding rivalry or discord. An operating plan can detail that Daughter can manage the opening of new offices and Son can make decisions on décor or the technology they’ll use, thereby decreasing the possibility that Dad thinks he always has the final word. In a recent survey, 75 percent of family business owners said they do not have a succession plan in place. Some family members struggle with the idea of letting go of the reins. Family business managers should consider who will run the business if the head manager no longer can. What happens if the manager is incapacitated temporarily or permanently? Having a succession plan in place helps keep the business running without interruption. A buy-sell agreement, prenuptial agreement, or postnuptial agreement can spell out what happens in a divorce. Seeking a general practitioner when looking for legal representation is your best bet, as issues in a family run business can cut across many legal practice areas. For example, discord in the family run business may arise from issues such as: rivalry, succession, or divorce. So having an attorney that is knowledgeable in family law, wills, trusts, probate, business law, contracts, pre-nuptial agreements, and succession planning is extremely important to be able to keep it in the family. After all, isn’t keeping it in the family the reason you create a family run business. Omaida Delgado, Esq. is the Managing Partner and Founder of Law Office of Omaida Delgado, P.A. What is Hospice?

H

OSPICE IS A COMPREHENSIVE PROGRAM OF MEDICAL CARE AND SUPPORT for people nearing the end of life. The Hospice philosophy is based on several ideas: »» No one should die alone or in pain. »» Life-limiting illnesses can cause emotional and spiritual distress as well as physical pain, all of which deserve quality professional attention and compassionate care. »» A serious illness affects the entire family, not just the person who is ill. Those affected need and deserve ongoing support before and after a loved one’s death. Hospice provides pain management and appropriate palliative care, care that focuses on the patient’s comfort, when curative medical treatments no longer enhance quality of life. Hospice strives to meet the patient’s physical, emotional and spiritual needs and provides support for the entire family during the illness and for at least one year after a patient’s death. Most Hospice Care is provided at home, where people most want to be when they are ill. Hospice Care can also be provided in a nursing or residential facility and in certain circumstances, in a hospital or hospice management residence. Hospice Dr Ismael Roque-Velasco President and Chief Executive Officer also provides medications, medical Hospice Care of South Florida equipment and supplies necessary to promote comfort at home or in other Hospice settings. Hospice does not mean giving up hope. The focus shifts toward helping the patient achieve the maximum quality of life by focusing on their physical, emotional and spiritual needs.

Hospice Care vs. Standard Medical Care Some differences between Hospice Care and Medical care are: »» Hospice looks at all of the patient’s and their family’s needs. A coordinated team of hospice professionals, assisted by volunteers, work to meet the patient’s and family’s emotional and spiritual needs, as well as the patient’s physical needs. »» An emphasis is put on controlling pain and symptoms through the most advanced techniques available as well as on emotional and spiritual support tailored to the needs of the patient and their family. »» Hospice recognizes that a serious illness affects not only affects the person who is ill, but the entire family as well. The family and patient is the “unit of care” for hospice professionals. At times, other family members may actually need more attention than the patient.

Who pays for Hospice care? Hospice palliative care is covered 100% by most insurance plans, including Medicare and Medicaid, with no out-of-pocket costs to the patient or family. Costs covered related to the terminal illness, including the services of the Hospice team, medications, medical equipment and supplies. Contact Hospice Care of South florida to learn more on how they can you and your loved ones in your time of need.

Planning for Special Needs: 5 Things You Need to Know BY LESLIE V. MARENCO, ESQ.

T

HE DAY TO DAY CONCERNS OF CARING FOR A CHILD WITH special needs are profound. Add on the responsibilities of parenting other children and maintaining a happy home, and you end up with little to no time to plan for the future care of your child with special needs. And in today’s information saturated world, researching tools and sources for support can feel ironically overwhelming. So here’s an easy to digest list of some of the most important things you should know about future planning for your child with special needs:

1

2 3

28

4

SECURE ELIGIBILITY FOR GOVERNMENT-FINANCED PROGRAMS When reviewing the child’s need for governmental benefits, take care to distinguish between those that are means-tested and those that are not based on the individual’s income or assets. Means-tested benefits are reduced or denied when income or assets are above certain limits. Although there are others, the two primary means-tested benefits that will be important in most instances are Supplemental Security Income (SSI) and Medicaid. Both have strict asset and income requirements in order to qualify. If eligible, Medicaid will cover long-term health care which can be extremely important for a child with disabilities. SSI is a Federal program which provides a monthly income supplement to meet basic needs such as food, clothing and shelter. The various programs have different rules regarding the treatment of unearned income and in-kind support from third parties. These differences often dictate the provisions that should be included in the client’s estate planning documents. The goal is to assure that the child is not disqualified from these programs by assets placed in his name.

5

TURNING 18. The legal significance of the 18th birthday is often overlooked when it comes to children with special needs. Once your child turns 18, he or she is officially an “adult” in the eyes of the law and able to enter into contracts, vote, and exercise all rights available to adults. As your child grows, it is imperative to evaluate his or her mental ability to function in society; and if you feel they are incapable of handling their own affairs, you should speak to an attorney about becoming your child’s legal guardian. Florida has adopted special procedures that make it easy to appoint guardians for individuals with developmental disabilities such as autism or cerebral palsy. By becoming your child’s legal guardian you will have the legal ability to act on your child’s behalf and make the best decisions for their well-being.

OBTAIN HELP FROM PROFESSIONALS. Although there are many support groups and community services available to assist parents who have children with special needs, at some point it becomes necessary to obtain help from competent professionals. In our experience, the best estate plans developed for families who have children with special needs arise from a team approach. In addition to the special needs planning attorney, it is critical that the family’s accountant, insurance and financial advisors be involved in the process. Of course, the family is an integral part of this process as well. If appropriate, the individual with special needs should be included in these discussions to the extent possible. In these types of situations, it is critical for advisors to listen to the needs and concerns of the family. Only after hearing their needs and concerns, can an appropriate estate plan be designed.

SET A GOAL FOR YOUR PLANNING. Planning must assure appropriate management of finances and personal decisions in the event of disability or death of both parents, with a goal towards avoiding future problems. Parents might also need to continue making decisions for a child with special needs during adulthood, provide for future residential needs, and find someone to care for the child when they are no longer able.

MAKE SURE YOU HAVE THE ESSENTIAL DOCUMENTS. A common misconception about estate planning is that it is only for the “wealthy.” But estate planning is a fundamental tool that enables you to provide for the care of your child with special needs when you are gone or incapacitated. Important decisions such as who will be the guardians of your children and the specifics how they will be taken care of financially should be made and documented to ensure your children are cared for when you can no longer be there for them. There are also important estate planning tools available such as Special Needs Trusts which allow you to financially provide for your child while preserving their qualification for government assistance. These trusts can provide funds to pay for certain expenses that can enhance your child’s quality of life, from psychological treatment to movie tickets or music lessons. And if you don’t have assets to leave behind, a life insurance policy is an affordable way to financially secure your children’s futures, especially in terms of funding a Special Needs Trust. When planning for the future it is essential that you have all your document in order. As a general rule, we should keep our estate planning documents in a safe place, which is readily accessible in the event they are needed. For a detailed description of what documents you will need check out our free report: 10 Must-have documents for parents of children with special needs. You can email my friendly assistant Mary and she will be happy to email it to you. She can be reached at Mary@mwprmlaw.com.

N MY PRIVATE PRACTICE, MANY OF THE PATIENTS I SEE COME in with an attitude problem about nutrition: “I can’t.” “It’s too expensive.” “I don’t have time.” “I want to try a diet/pill/book/ shot/supplement.” “My personal trainer told me that…” No carbs. Low carbs. Cookie diets. Grapefruit diets. Vegan diets. Juice cleanses. There are even diets based on the rummagings of “cavemen.” But here’s the thing. (And I’m probably not the first to break it to you.) Diets don’t work. Restriction and deprivation are a ruse. Counting calories is a gilded cage. And if it’s thigh gaps you seek, you can easily find them in the lush flamingo gardens of the Gables. So how does one truly, finally – ONCE AND FOR ALL – figure out this food crisis? It has been the objective of my career to determine this, and I’m happy to say I can offer the answer with absolute certainty: Feed Your Essence. “Feed Your Essence” is my motto and the guiding principle of my practice. But it’s also something that’s taken me a long time to understand, let alone master. In a nutshell, a person who feeds his or her essence is someone who is very in tune with their nutritional needs from a scientific perspective - but also uses intuitive self-guidance. The ability to even eat is a true gift.. We have to feed folks in the hospital through tubes in their noses, their stomach, and sometimes even their veins. Trust me, the fact that you can chew, taste, swallow, and digest, is incredibly precious My clients do not see any food as “bad” or “off-limits.” They are not running scared from every food group. They don’t demonize or glorify any particular category of foods, or feel restricted or hungry in any way. In fact, they love food. Their purse is a veritable fruit farm. I go nowhere without my arsenal of snacks. They enjoy their kale and have their Nutella, too. In other words, they have an extremely healthy relationship with food because they have the knowledge, the confidence, and the skill to make great choices for themselves throughout the day and on weekends. You will find them at happy hour, out with friends, dining in their favorite restaurants, and cooking dinner parties at home, while maintaining optimal weight and optimal health, because no matter where they are, they have strategies and tools to design their meals in a way that satisfies and delights them. Your gender, age, body fat content, medical conditions, medications, body type, and genetics are highly variable and deserve a unique and customized plan for your version of optimal health. Remember that nutrition at its core is a science, not a dogma. I took biochemistry, organic chemistry, a whole class on vitamins and studied metabolism. I have published peer-reviewed research. There is so much we don’t know yet, but we can empirically hypothesize. It’s important to eat for happiness, yes, but it’s equally as important to eat and ensure you are meeting your nutrition goals, which are highly individualized. It may seem like a shameless plug for dietitians, but I became a dietitian because I wanted every person to achieve their own personal best health, and I believe that your biological makeup is a very important part of that. Only a medical doctor or dietitian can legally prescribe diet recommendations. Come see me. I promise; no kale involved (unless you want it to be). Monica Auslander, MS, RD, LD/N is the owner of Essence Nutrition, LLC and is the nutrition princess of South Florida’s food culture. A practicing registered dietitian, Monica completed her Master’s in Dietetics and Nutrition at Florida International University with published and presented research at the 2013 Academy of Nutrition and Dietetics Food and Nutrition Conference and Exposition. Monica has previously worked as a pediatric dietitian at Jackson Memorial Hospital in the pediatric intensive care unit and completed internships at OliverPyatt Center, the University of Miami Crohn’s and Colitis Center, Sylvester Comprehensive Cancer Center, and University of Miami hospital. She also consults for corporations, groups, organizations, restaurants, and athletic groups.

The Importance of Hiring the Right Realtor BY BRYAN I. LEVY, ESQ.

H

OW DO I HIRE THE RIGHT REALTOR? WHERE DO I BEGIN looking for a realtor that can represent my interests- no matter what happens? How do I know if the realtor I have selected has the experience in assisting me with all aspects of my real estate transaction, not just activating the property on the MLS? The consequences of choosing the wrong realtor are long and far reaching. The concerns from clients are significant: Was the buyer screened prior to signing the contract? Why is there a lien/ open permit on the home? How come I was not aware of the contract requirements? Who reviewed / prepared the contract documents I signed? Should I have listened to the advice given by my realtor? At what point should I have hired an attorney? How come I wasn’t told my deposit can be lost? Should I use the closing agent recommended by my realtor? Who was my representative at closing? How can a property owner expect more from their realtor to avoid some of the unforeseen issues that plague many property purchasers and sellers? 1. Ask the realtor how many real estate closings they have been a part of in recent years. 2. Ask the realtor for references- not from individuals, but for property addresses they have assisted on the purchase or sale. 3. Ask if the realtor has had experience with different levels of property condition, open title matters, lien matters, etc. 4. Ask the realtor if any research should be done on the subject property prior to proceeding forward with the transaction. 5. Ask the realtor how you can feel secure with the entity holding the deposits for the transaction? 6. Ask the realtor how they can help ensure compliance with the contract, and your involvement in all aspects of the transaction, whether through the realtor directly, or through an attorney or the closing agent.

Place one hand on each side of the chest at the level of the animal’s heart (this is the point where the elbow comes in contact with the chest when you flex the pets elbow and shoulder all the way towards the back). For cats and little dogs, perform the compressions with just one hand, fingers on one side of the chest and the palm of the hand on the other side, as if squeezing a squeaky toy. Compress the chest 30 times at a rhythm of 2 compressions per second. To make this task easier, follow the rhythm of the Bee Gees 1983 hit song “Staying Alive” in your mind. Compress the chest for 30 compressions before going to the next step.

· · · ·

Initiate Artificial Respiration Pull the tongue out of the mouth and let it hang on the side. Gently close the muzzle with your hand. Make an airtight seal by surrounding the pet’s nose (or the whole muzzle if it’s a small dog or cat) with your lips, then blow in the nostrils for 2 seconds, pause, and repeat once more, so you provide two artificial respirations.

medical care to every patient by combining Conventional Medical approach with safe and effective Alternative Medicine methods.

If the pet is unconscious he/she will not be responsive, the pupils will be dilated, there will be no respiration, the gums will be blueish, and there will be a very weak or nonexistent heartbeat. If the pet seems unconscious but you are not sure if it is breathing or if there is a heartbeat, initiate CPR anyway. Quickly place the pet on a firm surface such as a sidewalk or a table, and make sure the head is aligned with the spine. Open the mouth and look for any object that might be blocking the air passages such as a piece of a bone, a hard treat, a ball, etc., and remove it if present.

NOWING HOW TO PERFORM CPR ON AN ANIMAL IS A MUST FOR EVERY PET OWNER. THERE ARE certain emergency situations where action is required immediately, even before considering driving the pet to the nearest emergency clinic. It only takes three minutes for an animal that is not breathing to develop permanent brain damage. Knowing how to perform CPR correctly is a must, since we can make the condition worse by utilizing an incorrect technique. Not all information found on the internet on how to perform pet CPR is accurate. Add that to the fact that pet CPR techniques are modified every few years for efficiency, and it’s easy to understand why there is so much confusion on how to perform CPR on pets. Animal CPR refers to a series of chest compressions and artificial respirations performed on an unconscious animal. Remember, the animal must be unconscious; a weak pet that has collapsed but is conscious does not need CPR, and has the potential to bite due to fear or pain or both. CPR will not be effective on animals that show cardiac-respiratory arrest due to chronic diseases, such as cancer or cardiac conditions. With all of this in mind, let’s move on to the latest pet CPR techniques:

Maintain the respiration-cardiac compression cycles

Perform two artificial respirations followed by 30 cardiac compression cycles for 10 minutes. Check every two minutes to see if the pet is breathing on its own and/or has a heartbeat. Remember to be patient: in a best case scenario, it will take at least a minute for your compressions to successfully bring blood into the heart and for you to start noticing signs of improvement such as pink gums. Your chest compressions are not as efficient as a natural cardiac compression. They only produce 30 percent of the cardiac output produced by a natural heartbeat, so be persistent while performing the respiration-compression cycles. You must take your pet to the nearest emergency clinic after 10 minutes, even if you were successful performing the CPR technique. Animals that have gone into cardiac or respiratory arrest need further medical care to ensure their survival. When performed at the right time with the right technique, CPR can save a pet’s life. The most important thing to remember is to stay calm, quickly analyze the situation and then take immediate action. You might save your best friend’s life one day. ASK T HE PL AST I C SU R G EO N

The Predictability of Lightning and Cosmetic Surgery Safety BY JOSE M. SOLER-BAILLO M.D., M.S, BOARD CERTIFIED PLASTIC SURGEON, SOUTH MIAMI, FL

O

NE OF THE INTERESTING FACTS ABOUT MIAMI IS THAT it has one of the most electrically active atmospheres in the world… and I’m not talking about the nightlife. Lightning strikes this fun town thousands of times every year, unfortunately causing several deaths. Having great experience with lightning, most Floridians have learned how to decrease their chances of being struck. During a thunderstorm common sense takes over, we get indoors, we don’t stand under a tree, some even skip the 18th hole. Why? Because we have, in some crude way, noticed the statistics of lightning strikes. Then I wonder, why do people risk their lives every day undergoing cosmetic surgery procedures in mass production surgery centers? I’m not pointing fingers here, I’m just pointing out that while cosmetic surgery can be a rewarding experience, all surgery carries risk. Cosmetic surgery complications are rare, and those resulting in death is even rarer. Thousands of people are flocking to Miami from around the world to experience the boon of cosmetic surgery. Most of these beauty pilgrims are attracted by the amazingly low prices here. The product of warring cosmetic surgery centers that continue to stab at each other’s hearts with yet a more affordable price. Some board certified plastic surgeons are violating the code of ethics using questionable marketing strategies in order to attract patients. Mass production, performed by detached physicians, guided by unscrupulous businessmen is a veritable lightning rod. In the constant effort to control costs, many centers start cutting back on a very important part of the equation, safety. Just think of it this way, when you have gotten the best price anywhere for your procedure, just imagine where the center has cut costs in order to provide you with

that amazing price. Here is a little advice: Do your homework. Just because a friend had a procedure at a high volume center, and did OK, doesn’t mean you will be as lucky. Visit the ASPS website (ASPS.org,) and become educated on who should perform your procedure and what certifications the facility should have. Do a bit of research on their track record, and read reviews (the good, the bad, and the ugly). An infection can set you back thousands of dollars in lost work time, and further medical expenses. A botched job can cost you triple to fix. So now that really cheap surgery has become very expensive. Unfortunately, some have paid with their lives. So by all means come to Miami to enjoy more affordable plastic surgery, just be very, very, careful where you stand. An International, multilingual Plastic Surgeon, Dr. Jose Soler-Baillo brings to South Florida a refreshing, modern approach to Cosmetic Surgery. Dr. Soler-Baillo earned his Medical Degree at the prestigious Mount Sinai School of Medicine in New York City, trained in General Surgery at the Saint Barnabas Medical Center in Livingston, New Jersey, and received extensive training in Plastic Surgery in Miami, New York, and Texas. Dr. Soler-Baillo is Board Certified by the American Board of Plastic Surgery. For more information please visit, resultsmd.com or email info@soler-baillo.com.
