Is a planning permission necessary?

This question does come up frequently. When only a minor alteration is made to the house many do not imagine they would need to apply for a planning permission. And times and times I have heard that the company in charge of carrying out the alteration assured the enquirer no planning permission would be necessary. This is not true and a few distinctions are to be taken into consideration as to the different obligations when undertaking any building work. For minor building alterations, i.e. new floor and wall tiling, you do not need to get permission from your neighbour (or existing community) but, by law, you do need a planning permission for minor works, called the obra menor. The application is a simple procedure at the “urbanismo” department of your local town hall and will be a small percentage on the total estimate for the works to be undertaken.

If you are part of a community / urbanisation, another minor alteration - let us say replacing old windows with new ones in green aluminium- would require the above planning permission for minor works and also the permission from your community if the rest of the windows in the urbanisation were in white. This would not have to be shown in writing when you are applying for the permission. The council would grant the permission always on the proviso that no objections are made by the community or neighbours. For anyone living in an urbanisation and wishing to undertake an alteration that has already passed the majority vote favourably at a meeting, a copy of the recorded minutes would always be a good back-up but not necessary unless requested. And as regards to a planning permission for major works, the obra mayor, i.e. alterations that affect the structure, these require a project drafted by an architect to be presented along with the application for the planning permission. If a neighbour had valid reasons for complaint and objected to the said alteration, the money spent on the above would be wasted.

letters Hello, A little late I got your January issue, where I read the article about your 2011 Award, given to Telefonica. How can you be so wrong ? (However, they managed to send me a bill for a connection at an address where no lines are installed ) No, The real awarded company should be Vodafone. I’ll tell you why. It’s a long story, but I’ll try to be as short as possible. After being a satisfied customer of Vodafone for many years back in Belgium, I decided to get connected with them here in Spain. They had a reasonable autonomo offer, where I could get two phone numbers on the same contract for a fixed price of 78 Euros a month. First stop at The Phone house, they didn’t do autonomo contracts. Second stop Vodafone shop in Torrevieja, where the very young girl behind the counter didn’t have a clue of the matter that they offer special autonomo contracts. Third stop at Carrefour Torrevieja, where the friendly girl behind the counter was able to help me out, finally. But, then again, after I put her the Vodafone magazine under the eyes, where they offered a Blackberry or HTC smartphone with the type of contract I wanted, she kept saying that was a mistake, I could only get a simple phone, and eventually she could (as I needed two numbers) offer me one touch screen model, and the other one was a cheap model. I tried to insist on the offer in the magazine, but finally, I accepted, because I had a business, and I urgently needed to get connected. So, the girl made the contract, had me sign it, and then, told me I had to come back “mañana a las tardes” (oh I start to hate that word) because the phones had to be activated first. So I went back the next day, but, no phones available, mañana again ….. Finally, after four mañanas, I got connected, ran to the print shop, having business cards printed, and was proud having, finally, a telephone number. This was, mid September 2009. And now, the real trouble begins. End of September I got my first invoice of 112 Euros, which seemed fair to me, (78 euros fixed price + a couple of calls to my home country), so I never watched the bill detail on the numbers I called. End of October 95 Euros, end of December 118 Euros, all invoices correctly payed by the bank. Beginning of January 2010, I had to travel back to Belgium for business, once I crossed the French border, and the phone should go in “roaming”,

I got the message on my screen “sim card not activated”. I thought I must have done something wrong with the settings, because my wife’s cellphone (which was on the same contract) worked fine. I tried to figure it out, but the message stayed on my screen. So, back in Spain after a week, I tried to figure out what was wrong. The answer I got was “You didn’t pay your bill”. So I contacted my bank manager, who assured me every bill had been paid correctly. So, I printed my bank history at home, and (after having made a tour over four Vodafone shops, where they all ignored me, and kept saying that I had to pay my bill), I landed in the “Vodafone tienda autonomo” in Almoradi, Where I was received by

The man consulted his computer, made couple of phone calls, and then told me that he would have me reconnected in 5 minutes…. After I payed a fine of 258 Euros. I protested, but, no solution, pay the bill or stay disconnected. So I payed the bill at the office by credit card, and before I was out of the shop, my cellphone was working again. This was January 15th of 2010. End of January, I received an invoice for 55 Euros. This seemed strange to me, (because my monthly fix was 78 Euros, remember ?). But I thought they might have charged me too much on the fine, and they probably credited The amount on this new invoice. Again, invoice correctly payed by the bank. Surprise, surprise, first week of February, I tried to phone somebody, but it didn’t work. I watched on my screen, where the message was back again “Sim card not activated”. So, I went back to the shop in Almoradi, where I got the message “You didn’t pay your bill” and, suptise, they could get me reactivated in 5 minutes, but first paying a fine of 325 Euros. I asked the man where those 325 Euros came from, and he told me “because of several open invoices” I showed him my bank balances, where all the
amounts were mentioned, including the last credit card payment in the shop, and surprise, the guy understood what I meant, and started making phone calls to Vodafone headquarters, trying to explain them there was something wrong. He got it sorted out, and after 2 hours, I left the shop, being reconnected without paying a fine. But it gets worse….. End of February, there’s no Vodafone invoice in the post box, and after asking at my bank, no invoice was presented for payment. I started to worry, and yes, first week of march, the message appeared again (“sim card not activated”). I didn’t even try anymore, and decided to change operator, no more on a contract, but on a simple prepaid card (I’m with the awarded Telefonica now, and guess what, no problems so far…) So end of march, I got a phone call from a girl named Concha, working for Vodafone call center, who friendly asked me why I didn’t pay my invoices. She told me I had 9 open invoices, for a total amount of 525 Euros, and threatened me, If I didn’t pay them within a week, they would put me on the black list, and I would never be able again to connect with any provider in Spain. Making a quick calculation, (I got connected September 2009, and we were now March 2010, that makes 7 months, how could I have 9 open invoices ??) I tried to explin that to her, but she wouldn’t (or couldn’t) understand. She said, she’d call me back. For the record, all the time I’ve been disconnected, people could reach me, but I couldn’t make any phone calls, and my wife’s cell phone (which was on the same contract, remember) always stayed working fine. Beginning of September 2010 Concha finally calls me back. She says they’ve had enough of it. I had to pay my invoices, or they would send the while case into court. So, I gently asked her if they could possibly send me any bills, because the last invoice I received was end of January. She puts me on music for 15 minutes, and than, comes back with the message, they sent me an invoice every month. I reply that is definitely not true, and ask her to what address they’ve send the bills. She puts me on music again for 10 minutes and then says. “Calle Amatisto nr 10 in Los Montesinos”. Now, first off all I never even lived on that address, and what’s more, that street doesn’t even exist in Los Montesinos. How could they have sent invoices. Now, that was a question she couldn’t answer. So I told her I had moved recently to Algorfa, and asked her to send the invoices to my new adress. I told her, if she was able to send me those invoices, I would pay (after checking them of course) I would pay them all within a week. So she asked me for my address details, her final question was “What Province is that ?, where I replied “Alicante””. She told me I could have saved a lot of trouble checking my invoices on their online portal at Vodafone.es. CONTINUED
So I tried to explain her that I couldn’t even register at that online portal, because my screen kept saying “this NIE does not correspond” but she said, that was not possible. However, we ended the 50 minutes phone call, with my promise that I would pay the invoices within a week from receiving them. (Today I’m still waiting for them ) So, after two weeks, Concha rings me back, and says I didn’t keep my promise, and insults me being a liar, because the street I mentioned, giving her my address details, didn’t exist in …..Madrid. I told her I never mentioned Madrid as being the town I live and even try to remember her she asked last time for the province I was living in, where I said it was Alicante. She couldn’t remember that. And then all of a sudden, she even calls my name ! “Señor Vasquez (or something), don’t fool around with me, you have to pay your bills, that’s how it works here !! Now, you could have guessed, my name is not at all Señor Vasquez, so I told her goodbye and told the story to my wife. She said ( I didn’t even think of that before) at Vodafone they probably mixed me up with somebody else. So, I dug up the invoices I received in the beginning, and started to check out the details of the phone calls I made. And, surprise, not a single phone number on those details was familiar with me. So, for myself I figured it out now. The first months of my contract, I’ve been paying somebody else’s bill (however the invoices mention me and my wife’s telephone number), and that mister or misses unknown received my bills, but never paid them. I drove back to the shop in Almoradi, to try to explain them, but the nice man who helped me out the last time doesn’t work there anymore, and is replaced by some 18 year old girl, who doesn’t even know how to take a Sim card out of a cell phone, so I gave up. 1st of January, I got completely disconnected, (and surprise, this time my wife’s number which has been normally functioning all the time, is disconnected too. Ever since beginning of October, I’ve never heard them again. And I guess I will never hear them again. My next door neighbor told me yesterday that he is disconnected from Vodafone. He doesn’t get any invoices anymore since two months. I told him not to bother, leaving him with question marks when I told him they couldn’t find the street we’re living in Madrid. I told him to change operator, because his story sounded very familiar to me. So, I warned you, it’s a long story, but for my opinion, Vodafone is the only company that should get your 2011 award . Hi, I’d just like to comment on your opening story “pulling the wrong strings” in your N 80 edition. I am gay and I would like to know why a stereotype was used? Just for those who go round with their eyes closed and head in the sand, not all gays are the same, we are as diverse as any other community. I do not like Eurovision, I only like one or two ABBA songs and may I point out that they were a very successful group an liked by millions around the world, neither do I like watching any of the reality shows including these dancing on ice and Xfactor type shows. I too laugh at some of the older TV shows like “Are you being served” or “Allo Allo” but I personally think that the style of comment at the end of your article misrepresents gays and reinforces the uninformed’s beliefs. Could I possibly ask you to use a little more tact next time please? I mean how would you feel if you were continually referred to in a derogatory way? Mr. D I am...you haven’t met my friends have you...? ED.

Welcome to this month’s computer article written by Richard from BlueMoon Solutions This month we look at Amazon’s book reader, the Kindle. Many of you received one from Santa - I know because I have been asked by loads of people how you do various things with it like connecting it to WIFI, changing the default country etc. So I thought I would dedicate the next couple of months to looking at this popular device. The Kindle, for those you that don’t know what I am going on about, is a sleek graphite looking tablet device that is dedicated to allowing you to carry around your library of books, enabling you to read pretty much whatever you like on the move. It’s certainly the easiest way to carry around 100’s of books if you like to read whilst you travel. It connects to the Internet either by WIFI or 3G, the WIFI version requires that you have an Internet connection with WIFI at the location that you want to download your books. The 3G option is a little more expensive but will allow you to download your books from pretty much anywhere.

Inside the factory at Elche (well worth a visit even if you don’t buy) the impressive shoe store carries a wide variety of makes and styles along with accessories, suitcases and more. We were taken down into the factory (which you can watch from above as the cobblers go about..er…cobbling?) they still use many traditional methods and it´s something different to see shoes being put together from a a few strips of some dead animal. Most of the workers have been with the family firm for a long time and are highly skilled in their trade. But nowadays any shoe shop worth its salt needs to carry a fair range (for the ladies mainly) and marques from around the world are now sold to cater for evolving tastes and needs. Even my son found some size 49 trainers at the store, and we didn’t need to sell the furniture to pay for them. From a small beginning – one man in his workshop to three factories and exports around the world – shoe making in this region really has become a load of cobblers…

There has only been one change with the process of importing vehicles this month. Many will be chuffed to bits to hear that it IS now possible to register a right hand drive pickup truck!! There is now a loophole so for those of you who have not given up on this, now is the time to re register before they change their minds. Buying a 2nd hand car in spain is not complicated as long as you have been given the correct advice beforehand. First you really should do a VIC (vehicle information check) to make sure the vehicle is free of finance and debt. This enquiry is made at your local trafico office. Then next step would be to make sure you have relevent paperwork- original passport, residencia or nie and padron or escritura for buyer, car documents, suma receipt for current year(although this is not obligatory) and a bill of sale signed by both parties. A spanish compraventa de vehiculos can be dowloaded from the computer. With all this in hand a trip is then made to the local concelleria de hacienda where you complete the necessary modelo 620 and then a visit to the bank to pay the 4 percent transfer tax. Then its back to the tax office for approval of the papers. Once you have these you then present all at trafico after paying their fee and you will usually be given a stamped document to return to trafico in one month to collect the final document unless you are lucky enough to receive it on the day. GUARDAMAR’S TOURIST TRAIN - CHUFFED TO BE BACK... Guardamar’s now famous ‘Path of History ‘ Tour continues to attract visitors from all over the district – and statistics last year show a marked increase in other nationalities on board – as well as a significant increase in groups and associations. The Tour – organised by Guardamar Town Council in conjunction with its Tourist Information Office – is a fascinating journey through ancient civilizations, covering its history from past to present, including the earthquake of 1829 and the reforestation work on the sand dunes. As the Tourist Office explained ‘The aim of the tour is to provide a compact history of our town – in an interesting and practical way. We show a short video beforehand – and then passengers board the local tourist train which stops at the various historical points, where our English speaking guide provides a fascinating insight into Guardamar’s history and cultural heritage. Tours begin again on Friday, 4th March with departures at 12 noon. (Passengers are asked to be at the Tourist Information Office 11.30 a.m. for the ‘in house’ video beforehand) Groups and Associations are being encouraged to book in advance through the Tourist Information Office’s Reservations system. ‘We have seen a marked increase in the number of group reservations – it is, after all, an interesting and unique way to experience local history. Groups are offered a discounted price – which includes a free guide book and the Tourist Office can often help with suggestions for ‘eating out’ before or after the guided visit. ART ON SHOW IN GUARDAMAR Guardamar’s Public Library opens its doors during the month of March to the ‘OpenArt Group’ (formerly known as los Balcones) – an international group of artists who have chosen to display their work, once more, in Guardamar. The group, who have been together for some time now, and are based at the Mar Azul centre in Torrevieja, chose the Guardamar venue after much soul searching and were delighted with the offer from Guardamar’s Town Council’s, Councillor for Culture, Sabrina Amorós to organise their opening evening in Guardamar’s Public Library.
