HARLINGEN, TX – The Port of Harlingen began preliminary work for five projects for upgrades and construction as part of the Rider 38 Grant Program. In May 2020, the Port was awarded $5.262 million by the Texas Department of Transportation (TxDOT) Rider 38 Grant for transportation improvement and service expansion. Grant money, along with $1.75 million in matching funds (project total cost $6.8 million), will create more truck queuing areas along Port and Cemetery Rd., which a portion will also function as a breakbulk cargo laydown yard, and road expansion and refortification on Port Rd and Robles Rd. “These projects not only bring us to some milestones on our Master Plan, but also opens the door

to more opportunities in diversifying cargo and the Ports ability to handle the inevitable increase in truck traffic,” said Port Board Chair Alan Johnson. Rider 38, the most recent round of funding provided by the Texas Legislature, was approved by the Texas Transportation Commission May 28th totaling $40 million for select port projects statewide. The last three sessions have included budget riders in the General Appropriations Act that authorizes the use of $100 million for projects to improve access to maritime ports. These funds come from the Texas Mobility Fund, or other eligible sources. All projects that receive funding are selected by the Port Authority Advisory Committee (PAAC) and approved by the Texas Transportation

Commission. The Port of Harlingen previously received $7.8 million through the Rider 45 Grant in 2017 that led to the rebuild and resurfacing of Port and Cemetery Roads, as well as the expansion of the intersection of Port Rd. And FM 106 creating a safer roadway for Port and regular traffic. “Since 2017, the Port has seen a 43% increase in tonnage due in large part to the increase in petroleum coming in and out of the Port,” Port Director Walker Smith said. “This not only means an increase in barge traffic but also trucks used for export. We would not have been able to handle the rate of growth we have without essential maintenance and upgrades to our roads.” Projects associated with Rider 38 are set to be completed by the first quarter of 2022.

Santa Maria district employees and locals receive vaccination By Nelda Briones LFN A vaccination clinic was held recently in Santa Maria. Vouchers became available Thursday morning March 26 at Tony Gonzalez Elementary School. Lines moved quickly and people were all set to come back the next day for their vaccines. This is all a part of the plan to get everyone eligible vaccinated in the county as well as school district employees. County Judge Eddie Trevino Jr. Stated “For the past two months, now we have vaccinated individuals at our County clinics following the guidance and priority groups

as identified by the State of Texas and the CDC. Teachers not being identified as a priority group has been a concern of ours and we’re glad to have received updated guidance from the State of Texas. They administered 563 doses to the community and District staff.

Texas landowners deserve fair & transparent eminent domain process

(WACO, Texas)—The president of the state’s largest general farm organization urged Texas House lawmakers today to give landowners an eminent domain process where they can legitimately negotiate a fair deal. Texas Farm Bureau (TFB) President Russell Boening of Wilson County testified in Austin in support of the committee substitute for HB 901 (CSHB 901) at a public hearing of the House Committee on Land and Resource Management. The legislation by State Rep. DeWayne Burns of Cleburne includes language agreed to by TFB in 2019 to ensure landowners get a fair bona fide offer and required easement terms with the initial offer. “Over the past four years of working for meaningful eminent domain reform, Texas Farm Bureau’s goal has been simple— give the landowner a process where they can legitimately negotiate

a fair deal. A fair deal that gives them the compensation they have a right to under the Takings clause of the Constitution. A fair deal that results in an easement agreement that protects their property and other rights,” Boening said to the committee. “And, hopefully, make this possible without having to hire a lawyer, appraiser or other professionals whose costs the landowner cannot recover. The landowner has no right under the Takings clause to be reimbursed for those costs.” Boening noted the goal of meaningful eminent domain reform and the legislation is not to stop or create unreasonable delays for infrastructure projects. When a private company armed with lawyers and other professionals has the authority to take private property, there has to be a process that protects the landowner’s interest, he said. Under CSHB 901,

a private entity with eminent domain authority has made a bona fide offer only if the initial offer includes the complete written report of the property’s value and the private entity’s basis for initial offer, including any damages to the remaining property. The value or estimate price must be determined by one of the following prepared by an appraiser or real estate broker—property appraisal, comparative market analysis, broker price opinion or market study. The bona fide offer under CSHB 901 must also include the Landowner Bill of Rights and a conveyance document with the required minimum easement terms. Features of minimum easement terms include required terms for pipeline and transmission line easements; the required terms are negotiable after the initial offer; and the easement document must be filed

with condemnation petition. “Current law does not give the landowner a legitimate opportunity to get a fair deal without hiring a lawyer or other professionals. If you look at Section 21.0113 of the Property Code, you can see it. Under the bona fide offer, it requires a landowner to receive an initial offer in writing. That’s it,” Boening told

to the committee. “So, a landowner gets an initial offer in writing and then has to try and negotiate a fair deal without any information on what the offer was based upon. And the landowner is given an easement document where the landowner has to negotiate technical legal terms to protect themselves, not knowing if what they are given is what most

landowners receive.” Following the conclusion of testimony, the committee withdrew CSHB 901 from consideration and left HB 901 pending.

For the 2021-2022 school year, the La Feria ISD Board of Trustees has approved offering a limited Tuition-supported Pre-kindergarten Program for La Feria ISD employees and community members. Children who are four years old on or before September 1st and who do not qualify for the current Pre-kindergarten program provided for qualtvvifying students are eligible to apply for the Tuition-supported Pre-kindergarten Program at La Feria ISD. Local Student Places 1st at STPGA Junior Tournament By Nelda Briones

Local Jr. golfer Alliana Briones placed 1st at the local Spring STPGA Junior Tournament on Sunday March 28. The tournament was held at the Shary Municipal Golf course in Mission, Tx. The STPGA Junior Golf program is one of the four pillars of PGA Reach Southern Texas. Dating back to 1994 when the Foundation was created, the leaders of the Southern Texas PGA saw the need to go all in with junior golf and the next generation. Their program started as a clinic-based approach that saw PGA Members running STPGA ap-

proved clinics. Today, the STPGA administers six different junior golf programs and is part owner of a seventh. In total, they run over 400 junior golf tournaments with nearly 4,500 unique juniors ages 6-18. Additionally, the program has numerous partnerships with national and regional organizations to help south Texas based juniors experience golf at the highest level in Texas as well as across the country. This includes programs like Drive, Chip and Putt, PGA Junior League, the Texas Golf Alliance, the Legends Junior Tour, and the Junior PGA Championship.

Alliana attends W. B. Green Jr. High in La Feria. She has been playing golf since the young age of 6 years old. Her father, grandfather and uncle are all avid golfers. Her uncle David Briones, who is the head golf coach in La Feria has been coaching her since a young age and practice has paid off with many medals and trophies. Over the years she has accumulated quite a few, including seven firstplace finishes, 10 second place finishes, Seven third place finishes, two fourth place and one fifth place finish. She has also participated in more than 30 tournaments since she began playing.

HHSC Updates Visitation Rules for Long-Term Care Facilities

Expands In-Person Visits at Nursing Facilities

AUSTIN – The Texas Health and Human Services Commission is expanding visitation statewide in nursing facilities and other long-term care settings, effective today. Per federal guidance issued March 10 by the Centers for Medicare and Medicaid Services, fully vaccinated nursing facility residents are now allowed close, in-person visits with family members and friends who are not designated essential caregivers, as long as proper safeguards are in place. “Safely visiting with family and friends is vital to the mental health and well-being of long-

term care residents,” said Victoria Ford, HHS chief policy and regulatory officer. “We are so pleased these new rules will allow residents to enjoy in-person visits with a wider circle of loved ones.” For nursing facilities, these updated visitation rules give providers additional flexibilities in accordance with the new federal guidelines.
