‘Expect to Win’ By Mac Deaver, MBA President
MBA Convention time is here again! The annual 127th annual “family reunion” of Mississippi banking will take place May 13-17 at Sandestin Golf and Beach Resort in Destin, Deaver Florida. Once again, bankers, industry associates and professionals from across the state and region will gather for a great time of educations fellowship, recreation, and relaxation. This year, “Expect to Win” is our convention theme – honoring MBA Chairman Freddie Bagley and the leadership he has provided throughout the year. Before beginning his banking career almost 39 years ago, Freddie was young teacher and coach. “Expect to Win” reflects the philosophy that has guided his career – and his mentoring and coaching of others for almost four decades. The MBA has been fortunate to have Freddie as our “head coach” this year. And he and Mary Lynn have served as wonderful ambassadors for Mississippi banking during his term. We want the convention be serve as a big “thank you” to them for what they have done this past year. As we all know, the past 12 months have seen a continuation of new regulations emanating from Washington, and economic conditions have presented challenges for banks and bankers. All the while, the MBA and other industry groups, with the support of our members, have stayed in the fight to gain relief for traditional banks. Last year’s Congressional elections brought significant changes to Washington, most notably a new majority party in the U.S. Senate. (Among other things, this resulted in Mississippi Senator Thad Cochran becoming chairman of the Senate Appropriations Committee.) 2
For banking, the new Senate leadership has spurred hope for legislation to relief traditional banks from some of the burdensome regulations created by the Dodd Frank Act. While Dodd Frank was deemed untouchable by the previous Senate leadership, we are encouraged that some meaningful changes will be considered in the Senate this year. This year’s looming state elections impacted much of the debate by the State Legislature in the recently concluded 2015 regular session. Legislators sparred over the state budget, particularly education funding, and battled over proposed tax cuts. In the end, the Legislature funded public education at record levels and no tax cut was passed. Also, the Legislature proposed an alternative to “Initiative 42” – a proposition that will appear on the Mississippi ballot this fall. That initiative, if passed, would have a huge impact on the entire state budget -- not just education. Many will be working over the summer to help voters understand this initiative and its potential implications. On bank-related matters, we were pleased to see the Legislature confirm the appointment of Commissioner Charlotte Corley and approve a budget for the Department of Banking and Consumer Finance that will help the department maintain and expand its professional staff. Several other bankrelated bills passed, including legislation to deter “patent trolls” and to

increase the allowable duration of trusts in Mississippi. Besides state and federal legislative activity, the MBA had another successful year in 2014-15. We began our year by celebrating the MBA’s 125th anniversary with the publication of a special edition of The Mississippi Banker magazine. This publication, first revealed at the 2014 MBA Convention, chronicles the history of banking in Mississippi and our association. We are grateful for the support of hundreds of bankers, Affiliates, advertisers and others who helped make this special issue a reality. Copies of the anniversary issue are available for purchase from the MBA office. Last fall, our association opened new avenues for communication with our members – and the world – with our entry into social media. Also in the fall, we had a great response to the MBA’s fourth annual “A Banker in Every Classroom” program, reaching a record number of students in grades K through 12 across the state. First Security Bank nominates new members to Board of directors The Annual Stockholders’ Meeting of Security Capital Corporation was held on March 19. New nominees for directors were Dr. Stephen Sullivan and Mrs. Connie Hawkins, both long-time residents of Batesville. After completing his degrees at the University of Mississippi and the University of Tennessee Dental School, Dr. Sullivan returned to Batesville and has practiced dentistry for over twenty years. He is a second generation stockholder in Security Capital Corporation. Connie Hawkins has been an employee of First Security Bank for 37 years, beginning under the leadership of John Meacham, Jr. She served many of those
years as Internal Auditor and has served since 2002 as Executive VicePresident, CFO and Cashier. In 2013, Hawkins received the designation of President of Security Capital Corporation. Sullivan She is a Certified Public Accountant. Larry Pratt, Will Hays, Frank West, Ken Murphree, Laney Funderburk, George C. Carlson, Tony Jones, John L. King and Norris Faust were appointed Hawkins by the Board of Security

Trustmark Bank honored with ‘Innovation in Financial Education’ Award
Trustmark was recently honored with the Innovation in Financial Education Award presented by NASDAQ and EverFi. The award recognizes significant efforts to improve the financial capability of young Americans. Twenty-five financial institutions from across the nation were recognized with this distinction at a ceremony hosted at NASDAQ’s Marketsite headquarters in New York City. Honorees were selected based on a set of criteria that included the scale and reach of their financial education initiatives, the duration of their commitment and unique employee volunteering activities that supplement their programs. “Trustmark believes it is our responsibility to promote sound, responsible financial management through financial literacy education programs in our
schools. With our commitment to 125 high schools across Mississippi, we are able to achieve our vision of helping young people establish a strong foundation in financial education,” Trustmark CEO Jerry Host stated. “We are honored to receive this recognition and are proud to be among the first recipients of this award.” As young adults are faced with increasingly complex financial decisions, Trustmark is committed to providing students with the skills and knowledge needed in order to succeed. MissBankPAC 2015 fundraising underway On April 13, MissBankPAC sent out its annual contribution solicitation packet, officially kicking-off its fundraising drive for 2015 – a significant statewide election year. In 2015, Mississippians will elect all 174 members of the State Legislature as well as all of our state-wide elected officials including Governor, Lt. Governor, Attorney General, Secretary of State, Treasurer and others; all banks are encouraged to consider making a contribution to MissBankPAC in this important year. In the fundraising letter he sent to bank CEOs across the state, MissBankPAC Chairman Leslie Usher, Great Southern Bank in Meridian, reminded bank executives that, “…this year, it is vitally important that your bank participate in
MissBankPAC. Having a healthy PAC will help us ensure we continue to have a business-friendly legislature that works to move Mississippi forward.” Legislative elections will begin this summer, as party primaries are scheduled to occur on August 4. Any party runoffs will occur on August 25. The state’s general election is slated to occur on November 3. In his letter, Usher went on to say that, “with statewide elections scheduled
for 2015, our State Fund needs to meet this year’s [fundraising] goal to assure we can support pro-banking candidates in all of the races around the state.” MissBankPAC operates two separate segregated funds – a State Fund and a Federal Fund. The State Fund operates under Mississippi campaign finance laws and is active in Mississippi’s legislative and appellate court elections. The Federal Fund, which is subject to federal elections law, participates in Congressional elections through its affiliation with the ABABankPac. Likewise, the enrollment from Mississippi for the upcoming GSB at LSU has been strong. MBA’s third annual Women in Banking Conference ‘ignites brilliance’ for 140 bankers in attendance
Some 140 bankers from across Mississippi participated in the Mississippi Bankers Association’s third annual Women in Banking Conference held March 24 at the Marriott Hotel in Jackson. Gee Gee Patridge of BankPlus, chairman of the conference, expressed gratitude to everyone who contributed to the event’s success. “Many thanks to the MBA staff and to the conference steering committee,” she said. “They hit a home run with the agenda!” Patridge noted that the conference has grown each year, presenting increased networking opportunities for attendees. Patridge opened the conference with remarks at a breakfast held for attendees. Commissioner Charlotte Corley of the Mississippi Department of Banking and Consumer Finance addressed the conference’s morning session, discussing the regulatory burdens facing Mississippi banks and bankers, the importance of dealing with interest rate risk, Bank Secrecy Act/Anti-Money Laundering issues, and cybersecurity. Commissioner Corley also addressed the budget for the state banking department, noting the need for expanded funding to support the DBCF’s professional staff. Sylvia Plunkett, a Mississippi native who serves as Senior Deputy Director of the FDIC in Washington, provided a regulatory report to bankers in attendance. Plunkett provided attendees with some
insight into the successful course of her career with the federal banking regulator. The conference’s featured speaker was Amy K. Elliot Eisenberg, Ph.D. is a nationally acclaimed economist and public speaker specializing in making the arcana and minutia of economics fun, relevant and educational. Eisenberg was formerly a Senior Economist with the National Association of Home Builders in Washington, D.C. He is the creator of the multifamily stock index (the first nationally recognized index to track the total return of public firms principally involved in the ownership and management of apartments), the author of more than 70 articles, and a member of the Editorial Board of the Encyclopedia of Housing.
Dan Reeves spent 23 years coaching for the Denver Broncos, New York Giants and Atlanta Falcons. He played or coached in a record nine Super Bowls – five with the Dallas Cowboys, three with Denver and one with Atlanta. Prior to becoming a head coach, he spent 16 years in the Cowboys organization – five as a player, three as a player/ coach and eight as an assistant coach.
Jeff Plagge is president and CEO of Northwest Financial Corp. of Arnolds Park, Iowa, and the immediate past chairman of the American Bankers Association. He currently serves on the ABA Board of Directors and the ABA Communication Council. Mississippi Legislature adjourns 2015 Session On April 2, the Mississippi Legislature adjourned the 2015 Regular Session, wrapping up the scheduled legislative activity of the four-year term. The upcoming state-wide elections loomed over the Legislature all session, and many of the decisions that were made this year were influenced by the upcoming races. The MBA worked throughout the session to advocate and advance industry positions on a number of important issues. Of note, the MBA was successful in working to see HB 589 (Rep. Andy Gipson) enacted into law. This legislation should help protect banks from potentially expensive patent trolling litigation in Mississippi. The MBA was also successful in working to enact trust reform legislation,
HB 153 (Speaker Philip Gunn), which would allow trust clients to establish long-term trusts by amending the state’s common law “Rule Against Perpetuities.” The MBA also worked with a number of interested parties and other business groups to support tax reform measures that would have, among other things, phased out the corporate franchise tax. This measure passed the State Senate, but unfortunately failed in House of Representatives by only 5 votes. The Legislature passed a $6.3 billion budget that does not use any one-time money for recurring expenses. The state budget is also highlighted by record spending in K-12 education as well as significant increases for the state’s univer-
sities and community colleges. Through the legislative appropriations process, the Department of Banking and Consumer Finance was also given authority to expand its examination staff and give department employees a 3% pay raise. Our state’s elected officials will now fully turn their attention to this year’s election cycle. Party primaries are scheduled August 4 with runoffs scheduled August 25. The state’s general election is slated to occur on November 3. The campaign process is beginning to kick-off now across the state. Telling Stories

A stay-at-home mom in Massachusetts goes through the pain of a divorce resolved to provide as much stability for her kids as possible. She sets out to re-enter the work force and applies for Keating a loan to purchase the family home so her kids can remain in the same schools. The bank wants to help, but because the woman cannot meet the ability to repay/ qualified mortgage rule requirements, the loan is declined. An experienced doctor in Oklahoma with a substantial income wants to move his family to a neighborhood with better schools. Though he has been practicing for several years, he just purchased his own practice. Now, without a two-year history of self-employment income, he can’t qualify for long term mortgage financing. Another homeownership dream dashed by inflexible regulation. There are plenty more stories where those came from. In fact, when ABA recently asked bankers to share examples of the most troublesome regulations, with an emphasis on how the rules’ affected their customers, bankers did not disappoint. A bank in New Mexico has stopped offering mobile home secured loans because its customers would not observe the home ownership counseling requirement. An Idaho banker reported the frustration of ag customers who are being told they must purchase flood insurance on low-value sheds and barns located on their property. A Colorado banker noted how his bank worked with a recently retired engineer with substantial liquidity and a generous, albeit time-limited pension. A good credit risk yet, thanks to overly prescriptive rules, the man had to ask his 75-year-old father 36
to cosign the loan. These are powerful stories. In fact, most stories are powerful. That’s because, despite the tremendous advancements in communications technologies, storytelling remains the most effective way to make a point. Members of Congress believe it, too. In fact, three VIPs speaking at ABA’s Government Relations Summit in March -- Rep. Jeb Hensarling (R-Texas), who chairs the House Financial Services Committee, Sen. Sherrod Brown (D-Ohio), ranking member of the Senate Banking Committee, and Rep. Kevin McCarthy (R-Calif.), who holds the second most powerful post in the House -- all advised bankers seeking regulatory relief to “tell their stories” to their lawmakers. Hensarling and McCarthy also stressed the importance of talking with members of both parties. The legislative solutions we seek require bipartisan support to be enacted. Rather than telling your story to an official who already knows you and appreciates what you do, tell it to the freshman representative or the Democrat who fears one or two practical legislative fixes could lead to the unraveling of the Dodd-Frank Act. Our first instinct when asked to talk about our industry’s regulatory burden might be to talk about how much time and money compliance is costing banks. That’s a legitimate grievance that reveals an essential economic truth: Money spent on paperwork is money that can’t be spent in loans that bring growth and prosperity. But dry economic arguments don’t pack nearly as much punch as stories about how a customer couldn’t buy a home or expand her business. Analogies help, too. I have tried to explain banks’ regulatory burden to reporters by telling them if restaurants had to expend as much human and financial resources on

compliance as banks do, the food you eat wouldn’t taste very good. Colorful analogies and anecdotes resonate more than just plain facts. Narratives are more memorable than PowerPoint slides. If you’ve heard me speak, you know that I believe this. I practice what this column is preaching. If you want to see meaningful regulatory relief -- or a level playing field with credit unions and the Farm Credit System, or more accountability for retailers involved in data breaches – share your stories with your lawmakers when you write or meet with them.
