Exhibition Place splash pad art causes waves HILARY CATON hcaton@insidetoronto.com

An art installation on a splash pad at Exhibition Place is in hot water for alleged plagiarism.
American artist Jim Sanborn said the installation sitting in Centennial Park, just south of the Dufferin Gates in Parkdale, is a copy of his own artwork titled Kryptos.
“It’s stunning that someone would do something like this wantonly,” Sanborn told The Villager from his Washington, D.C home. “It is absolutely identical
to the many pieces I’ve done. It’s really a copy, both in idea and most importantly for me from an intellectual property standpoint, the expression of >>>AMERICAN, page 12
Parkdale Community Legal Service (PCLS) student workers have made history by being the first student union in the clinic’s 44-year history. “There has been organizing drives periodically throughout the history of the clinic to become a union, but with no success,” said Jenna Meguid, one of the lead organizers of the unionizing effort for the students. The past attempts haven’t been successful until now. Meguid said what helped with this group’s success was seeking advice from those who tried to unionize in the past. “They gave us well-timed advice to start early,” she said. Students who work for PCLS on a four-month summer contract position are currently enrolled in the Osgoode School of Law with the York University. Students do similar jobs to full-time staff at PCLS, such as advise and represent community members in their disputes with employers, landlords and government agencies, perform frontline intake, legal research and writing, administrative work, community organizing and public legal education. Parkdale dad is hoping to brush up graffiti wall park HILARY CATON hcaton@insidetoronto.com There’s good graffiti and there’s bad graffiti. One Parkdale dad is hoping to turn the latter into the former with a grassroots mural campaign for a 180foot wall south of Sorauren Park. “Don’t get me wrong, I love graffiti. I’m constantly taking pictures of nice graffiti. I like the art form a lot,” said Eli Klein, the parent behind the push to paint over the wall. “What’s up there facing the playground (right now), it’s not crass or tasteless or anything. I just know what graffiti artists are capable of and I just want to make it nicer.” Klein, who lives near Roncesvalles Avenue and Marion Street, visits the playground in Charles G. Williams Park, just south of Sorauren Park at least three times a week with his two kids Kieran, 6, and Arlo, 2. He said the wall is littered with “bad graffiti” and became tired of seeing the length of wall being vandalized, so he decided to do something about it. He teamed up with Torontobased artist and longtime

friend Kirsten McCrea, the creator of Papirmass Art that sends monthly subscriber’s art in the mail, to get the ball rolling. They are in talks with six other artists to help create a mural on the wall with the central theme: Young Hearts, Run Free. “I like the song by Candi Stanton and I like the mes-
sage and the chorus,” Klein said. He and McCrea have spoken to a few artists about the theme surrounding Young Hearts, Run Free and are looking forward to what they come up with. “We want imagery that’s kid friendly, that’s about freedom and expression and about
not necessarily fitting into little boxes people tend to categorize children into,” he said. “I’ve really encouraged collaboration on this, so the artists can work together and blend their styles.” He said he is hoping this mural project not only beautifies the heavily vandalized wall, but also brings

neighbours together. “I thought about just putting that (Young Hearts, Run Free) phrase up on the wall and then I thought this is huge wall and this is a cool opportunity to bring a community together and have some great community ownership of this project especially if we crowdfund it.” To help cover the cost of the mural, a page was launched on the website Fund What You Can Aug. 12 and has raised just more than $1,500 by press deadline Tuesday. It also has incentives to encourage people to donate cash by giving gift cards in return from a local coffee shop, arts and clothing stores. For example, a $35 donation gets the donor a $10 gift card to a local coffee shop. Klein said he was hoping the project would have gained more momentum by now as it has less than a month to reach its $10,000 goal. But he hasn’t given up. He plans to make flyers and gather some volunteers to head to local schools to inform parents. “There’s got to be 300 to 400 families that frequent that park once a week, so even if

we got $20 per family we’d hit our target. It’s just a matter of awareness,” Klein said. “I understand people aren’t sure where the money is going, but they need to know these aren’t scrappy kids coming to put something dirty up. These are established artists (who) will put up something beautiful.” Klein has also got the City of Toronto’s StreetARToronto program that helps promote and fund street art in Toronto neighbourhoods to cover the cost of materials and has enlisted a handful of 14 Division Police officers to prime the walls before the heavy painting begins. He said he’s hoping to start painting Friday, Sept. 25 in time for the 20th anniversary celebrations for Sorauren Park Sept. 26. He’s hopeful families will help out his cause to turn the wall into a work of art that the community can appreciate. “No amount is too small. It all adds up,” he said. abour Day is like the middle of the longest car trip you can remember: powering across the prairies, destination a little farther past the horizon than the trip’s beginning. Prime Minister Stephen Harper got us started early – way back in August, packing up the federal election campaign bus in the dark and hauling us from our Sunday morning beds without so much as a bathroom break before hitting the highway. And now here we are: in the midst of the longest federal election this century, that by the polls is anyone’s to win. So far, for those of us paying attention and not distracted by our view the attack ads on the in-car DVD player, what we’ve had to occupy Serious us are strategic and tactical questions. questions The trial of suspended senator to consider Mike Duffy has laid bare some of the inner workings of Harper’s prime minister’s office (PMO), and we’ve puzzled over how the revelations might be used by the New Democrats or Liberals, or somehow minimized by the Conservatives. We’ve watched Liberal leader Justin Trudeau dodge attack ads complimenting his hair, but questioning his readiness, then put in a good early debate performance, and wondered how that might affect the polls. And we’ve tried to figure out what it is Tom Mulcair’s New Democratic Party is doing to edge into the lead in all those polls that keep dropping. Well, it’s Labour Day coming up – not even halfway to the Oct. 19 election day – and it’s safe to say we’ve burned through all the simple driving games. It’s time to start paying attention – and by that we don’t mean watching U.S. Republican leader hopeful Donald Trump on YouTube. Voters in Toronto and across the country are facing some serious questions about the next five years. The three main parties are offering very different visions and plans to navigate this country down what could be some very rough roads. Conservatives, Liberals and New Democrats sharing the driving up front will have strategies for us to consider. Although it may not seem like it here in the back seat, we, the voters, only have choices.

Olympic flame a temptation too great to resist There are some temptations that are too much for a mayor to resist. Promising a tax freeze, or increases so low they may as well be? That’s a tough one. Devising a new transit plan that wasn’t on anybody else’s long-term infrastructure plan? Good luck saying no. But those are all easy when it comes to the tempting, flickering flame of the Olympics. A mayor who says no to that would have to be made of sterner stuff than pretty well all of them. So it is with Mayor John Tory, who appears to be following Oscar Wilde’s advice, which is to say, banishing temptation by yielding to it. After a summer of feigning a wait-and-see attitude, Tory appears to be ready to go all in with a bid to host the 2024 Summer Olympics. There is a lot to like, politically at least, in being
david nickle the city out-front in a bid for an Olympic Games. It is, first and foremost, a fundamentally boosterish enterprise: mayors and business leaders and often popular sports figures spend lunch-hours before cameras speaking highly of their city and basking in the glow of it. Infrastructure projects find themselves at least nominally on a fast-track for funding. The city and its leadership floats along on dreams. Of course, dreams are what they are, and things can go nightmarishly wrong. Former mayor Mel Lastman brought the city a pot-full of embarrassment when he made a cannibalism joke as he prepared to visit Africa to court International Olympic Committee (IOC)
votes on Toronto’s 2008 bid. The only thing that might have been worse would have been actually winning the bid over Beijing, and ending up with a suite of unusable facilities and terrible debt as Montreal did in 1976 – or just disappointing economic results as London did in 2012. Tory might be headed for a more ignominious defeat than that. There is serious question as to whether even his own council – even the portion of council that happily supports him – is at all supportive of going forward with the plan. On Tuesday, members of the city’s budget committee had little time for launching a bid for 2024. Budget Chief Gary Crawford made it clear he was “cautiously” withdrawing from the idea – the cost of simply launching a bid being a major barrier. Etobicoke Centre Councillor John Campbell opined that even if the pri-
vate sector or some other level of government were to front the $50 to $60 million it costs to launch a bid, the city would still be best to stay away. Others, like York Centre Councillor James Pasternak suspected with Los Angeles entering the race, winning the Olympics would simply be impossible for 2024. Perhaps, he thought, 2028 might work, but with a novel and so-far againstthe-rules strategy of teaming up with Buffalo, New York, for an international bid. Based on all of that, it looks as though no matter how mightily Tory is tempted, the better judgement of his friends on council will prevail – and our mayor will find himself hauled back from the bright Olympic flame, before his wings get any more than a little singed.

Project has people writing love letters all over the city Project pairs with David Suzuki Foundation for event at Trinity Bellwoods Park SAM JURIC sjuric@insidetoronto.com For the past 11 years, Lindsay ZierVogel has been wooing Torontonians through a series of love letters tucked away in airmail envelops and marked ‘Love’ for strangers and passersby to stumble upon. “I was with my friend at Trinity Bellwoods Park, writing love poems to the city. We happened to have envelopes and we decided to hide them,” said Zier-Vogel, an artist raised in Etobicoke who now lives in Bloor West Village. Phone booths, newspaper stands and bicycles are just some of the places the love letters to Toronto can be found.
Zier-Vogel’s love lettering has swelled into a community engagement project that has stretched across the city and beyond. Since 2004, thousands of letters have been written by residents confessing their affection for the city. The project hit the road in 2014 to celebrate its 10th anniversary in collaboration with DreamCatcher Mentoring for a three-city journey through Canada’s northern cities of Yellowknife, Whitehorse and Fort Smith. Most recently, the project connected with the Chester Subway Station Artist Stand to encourage people to appreciate the city. “I love when art intersects in your day and you can’t help but pause,”

she said. During a love lettering event, Zier-Vogel recalls a three-year-old boy who wrote a letter to marigolds. It took a moment for Zier-Vogel
to realize from the boy’s height and line of sight, marigolds had a larger presence in the life of a child than it would for an adult. “It shows different perspectives of the city. It makes me see it dif-
ferently,” Zier-Vogel said. The Love Lettering Project will be partnering with the David Suzuki Foundation this fall as an extension of the Homegrown National Park Crawl event Sept. 27 at Trinity Bellwoods Park. Lately, it is the Humber River and High Park that have been receiving heart-felt letters from Zier-Vogel, who has recently become a mother and has been spending much of her time walking with her six month old in the west end. The ultimate power of the Love Lettering Project is its ability to bring people together, she said. “Love lettering forms a connection with people you will never meet and that’s really special in a city as big as Toronto.”

>>>from page 1 five areas of law when working for PCLS: workers rights, social assistance, violence and health, landlord and tenant and immigration. Full-time staff members at PCLS have their own union, but students were never members. To rectify the situation, students sought out the help of the Ontario Public Service Employees Union (OPSEU) organizing representative Kiera Chion. Chion told The Villager the main reason for the students’ push to become a union was due to intense workloads. “Oftentimes students were being paid for 35 hours, but worked up to 60 to 70 hours,” the OPSEU rep said. “A lot of issues were also around the lack of input in workplace decisions regarding workload, equity and transparency around how decisions are made that impacted their work directly.” The workload was having
an impact on how student caseworkers split their time as well, Meguid said. “There’s a lot of case work coming through the door, so it can be hard to find the time to do community legal work,” Meguid said. “How can we carve out time to make sure that we have time for the important work that needs to be done and be in service of the community (in a way that) allows you to have in impact.” Eighty per cent of the student workers, 16 out of 20, agreed to move forward with the unionization. From there, students signed membership cards and an application was sent out to the Ontario Labour Relations Board by OPSEU on their behalf. PCLS then had a few days to respond to their request and the answer the students got was “hurtful and surprising,” Meguid said. The Villager contacted the board at PCLS to discuss its
response, but did not get a reply by press deadline Tuesday. “Their legal response was that they don’t see us as employees at all,” Meguid said. “It was one we didn’t expect at all and was one that for us threw in our face the values we’re trying to embed in the workplace.” PCLS said they believed they did not have a sufficient connection to the workplace to constitute an appropriate bargaining unit, Chion added. The response, she said, was ideologically driven and isn’t grounded in reality because the students receive a pay cheque and get T4 forms. However, the students sought the help of members of PCLS and alum to sign a letter to the board showing the overwhelming support the students had from workers both past and present and the community; there were 237 signatures to give to the board, which is now supportive of the union.

American artist alleges work is a ‘copy’ of his sculpture >>>from page 1 the piece. That means the look and so, it disturbs me.” The $500,000 splash pad, which was jointly funded by the City of Toronto and Exhibition Place, features a sculpture by Paul Marsala from Terra Plan Landscape Architects. The piece sitting in the middle of the splash pad is a cylindrical bronze sculpture that has all 51 sports played in this year’s Toronto 2015 Pan Am and Parapan Am Games etched into the sculpture like a stencil template. At night the sculpture lights up and the names of the sports cascade onto the surrounding landscape. The pieces are so similar, Sanborn said he will be taking legal actions against the design firm that created the piece. The firm’s managing director, Alan Shwartz acknowledged the similarity after seeing Sanbor n’s work Monday, Aug. 24, but denied claims it was a direct copy. Schwartz said he felt confident the firm could defend the work against allegations of copying. He added he does feel bad for the artist and that any similarity between the pieces was unintentional. Sanborn told The Villager he started working on the piece in ’89, and in ’91 had one installed outside the Central Intelligence Agency (CIA) headquarters in Langley, VA. It’s become one of his most famous works because of the secret code etched in the cylinder, which was created by Sanborn, has never

been cracked. Since 1992, 69-year-old Sanborn has installed 15 illuminated cylindrical pieces. His Kryptos pieces can be found throughout the United States from Texas to Florida to Washington, D.C. “It took a few years to come up with a method of making it work. There are some critical dimensions involved and the diameters of the cylinder and the type of bulbs used... it doesn’t make it an easy thing to pull off,” he said. “I’ve had requests from people all over the world asking me how I do this and I’ve refused all those requests because it’s proprietary.” Like most artists, Sanborn is protective of his work and is sensitive about others claiming it as their own. “Every artist worries a lot about what they do and there’s borrowing sometimes

of ideas and images and sometimes that’s OK, but if it’s a copy, which is what this largely is, it’s very difficult,” he explained. “In the past I’ve had to be very secretive about what I do, as so many artists have to be, until I put it out there. And since I have been putting it out there for so long, this kind of thing is stunning to me.” Sanborn wouldn’t say what kind of solution or compensation he’s looking for, but he knows he doesn’t want his name associated in any way with the piece that sits in Parkdale. “It’s just a copy of my work,” he alleged. “Would Gucci sign their name to a knock off intentionally? I don’t think so.” ~ with files from TorStar News Services
