Understanding Agency Relationships
It’s important to understand what legal responsibilities your real estate salesperson has to you and to other parties in the transaction. Ask what type of agency relationship your agent has with you: Seller’s representative (also known as a listing agent or seller’s agent) A seller’s agent is hired by and represents the seller. All fiduciary duties are owed to the seller. The agency relationship usually is created by a listing contract. Buyer’s representative (also known as a buyer’s agent) A buyer’s agent is hired by prospective buyers to represent them in a real estate transaction. The buyer’s rep works in the buyer’s best interest throughout the transaction and owes fiduciary duties to the buyer. The buyer can pay the licensee directly through a negotiated fee, or the buyer’s rep may be paid by the seller or though a commission split with the seller’s agent Subagent A subagency owes the same fiduciary duties to the agent’s customer as the agent does. Subagent usually arises when a cooperating sales associate from another brokerage, who is not the buyer’s agent, shows property to a buyer. In such a case, the subagent works with the buyer as a customer but owes fiduciary duties to the listing broker and the seller. Although a subagent cannot assist the buyer in any way that would be detrimental to the seller, a buyer customer can expect to be treated honestly by the subagent. It is important that subagents fully explain their duties to buyers. Disclosed dual agent Dual agency is a relationship in which the brokerage firm represents both the buyer and the seller in

the same real estate transaction. Dual agency relationships do not carry with them all of the traditional fiduciary duties to clients. Instead, dual agents owe limited fiduciary duties. Because of the potential for conflicts of interest in a dual-agency relationship, it’s vital that all parties give their informed consent. In many states, this consent must be in writing. Disclosed dual agency, in which both the buyer and the seller are told that the agent is representing both of them, is legal in most states. Designated agent (also called appointed agent) This is a brokerage practice that allows the managing broker to designate which licensees in the brokerage will act as an agent of the seller and which will act as an agent of the buyer. Designated agency avoids the problem of creating a dual-agency relationship for licensees at the brokerage. The designated agents give their clients full representation, with all of the attendant fiduciary duties. The broker still has the responsibility of supervising both groups of licensees. Nonagency relationship (called, among other things, a transaction broker or facilitator) Some states permit a real estate licensee to have a type of nonagency relationship with a consumer. These relationships vary considerably from state to state, both as to the duties owed to the consumer and the name used to describe them. Very generally, the duties owed to the consumer in a nonagency relationship are less than the complete, traditional fiduciary duties of an agency relationship. Are You Prepared for an Emergency?
The past few years have shown that natural or man-made disasters can hit any family at any time. Ensuring the personal safety of you and your loved ones is your number one priority. But being prepared for the aftermath by organizing your critical documents and communicating their location to designated individuals can save you many problems
later should the unexpected occur. Could you locate all your family’s important documents quickly in the event of an accident, evacuation or disaster? Or could they find them should you be incapacitated or become separated from each other? If not, here are some important steps to take. It’s a good idea to keep document originals in one location,
with backup copies stored in at least one additional, equally secure place. A fireand waterproof box that can be locked and is small enough to carry is a good way to keep documents nearby, but safe from damage or theft. A safe deposit box at a bank is another secure location. Copies can also be stored with a family member or friend. Critical documents that you should be able to quickly access include: Passports, birth certificates and social security cards List of insurance policies, policy numbers and contact information Copies of wills, living wills, power of attorneys and
healthcare proxies List of bank, retirement and investment accounts, account numbers and contact information Titles to your car or home and sales receipts or proof of ownership of other high-value items List of loan or debt obligations such as mortgages or credit cards, account numbers, balances and contact information Other documents to think about collecting, making copies of and storing in a central location include medical histories, physicians’ contact information, dental records, past years’
tax filings, and Internet account user IDs and passwords. While paper copies may take up a lot of space, scanning originals and saving them on a portable storage device such as a memory stick or CD-ROM is a convenient alternative. A video — also stored in multiple locations — is a good way to record your material possessions, and will help you remember everything and prove ownership for insurance claims if your property is destroyed. Be sure to get close-ups of serial numbers,
and talk about the purchase date and price of each item as you record. Finally, it is especially important to let a trusted family member or friend know where your important documents are so that they can access them and take action should you be unable to temporarily, or in the worst case, permanently. While no one likes to think about the implications of a personal or community disaster, taking these steps will help you minimize the impact. Some energy-saving actions such as switching off lights when leaving a room and turning off the water while brushing your teeth or washing your hands are simple and cost effective. This summer, try a few of the following energy saving tips to save your family some money while keeping the environment in mind: * Only run dishwashers, washing machines and clothing dryers when they are full. If a household switched to coldwater washing for a year, enough energy would be saved to watch TV for 1,363 hours or charge an iPhone 4S 30,861 times. So by switching to cold water washing, you can cut down on household energy use and save money while doing something good for the environment. On
a larger scale, if everyone in the United States switched to coldwater washing, the energy saved could power the streetlights of New York City for 71 years. Tide Coldwater detergent is specially formulated to provide a deep clean in cold water conditions while helping families save up to 50 percent of energy per wash cycle. * Keep cool this summer by closing curtains to block out the hot sun during the day. Angela Thompson, of the Keller Williams Realty Pinehurst office, has recently reached “Cap” status. According to the Keller Williams structure, sales associates who reach certain sales goals earn “cap” status which entitles them to 100 percent of their earned commission on sales for the remainder of the year. “Angela is a relatively new agent who has lived in this area all her life and is excited about her business in her hometown,” commented Donna Campbell, Team Leader. Thompson has been with Keller Williams a year has grown her business into one of the top 15 producing agents in the area. “She enjoys what she does and it shows,” said Campbell. Thompson grew up on a tobacco and chicken farm in the Vass/Woodlake area of Moore County. She is a member of the Woodlake

Thompson’s husband, Kenny, is a builder with Longhorn Builders LLC and her mother, Portia Cummings, recently retired from BB&T. “With the building background and connections and the banking knowledge in my family, it is a natural fit that I am the realtor of the family,” states Thompson. Thompson also finds time to enjoy Crossfit and calls herself a Crossfit fanatic. She earned a Bachelor of Arts degree from Meredith College in Studio Art and has pursued graduate studies at Purdue University. When asked about her move to Keller Williams, Thompson stated,”I appreciate the commission split and training. Those were the main things
that brought me to KW.” The business models helped Thompson work more effectively by teaching her to make a business plan and set goals. “I am on track to meet my 2012 goals and am very excited about that,” said Thompson. Even though real estate market is still rough, Thompson believes you have to shift with it. Thompson is still building her team and would love to talk with anyone interested in a career in real estate. While aesthetics often take precedence when settling into a "new-to-you" home, it's important for homeowners and renters alike to complete a safety check of their abode to reduce the risk of unintentional injuries. One of the greatest hazards in a home that usually is the furthest from the mind is fire. But, it's one of the easiest to address. "As we approach Home Safety Month in June, there is an urgent need to educate families about fire safety," says Kate Carr, president and CEO of Safe Kids Worldwide. smoke alarms or with non-working alarms according to the National Fire Protection Association. One in four families with homes built prior to 2002 is at risk due to aging (10 or more years old) smoke alarms, according to a recent survey from Kidde. Fire experts recommend replacing alarms every 10 years as older smoke alarms may not operate efficiently and often cause nuisance alarms. By the time a smoke alarm is 10 years old, it has a 30 percent chance of not alarming due to age-related factors such as accumulated dust, insects and airborne contaminants, according to a Kentucky Injury Prevention and Research Center study. If you don't know how old your smoke alarms
