Police seek witnesses to fatal hit and run Toronto Police are hoping autopsy results, witnesses and a piece of wreckage from the scene can tell them the make and model of the vehicle someone drove away from a fatal accident on Midland Avenue. A 42-year-old man crossing the road Tuesday at 5:20 p.m. was struck by a northbound Ford Freestar van turning into Kilcullen Castle Gate, a small street connected to Silver Star Boulevard north of Finch Avenue. The collision threw the man into Midland’s southbound passing lane, where he was hit again by another vehicle. That vehicle failed to remain at the scene, and the pedestrian was pronounced dead. Police asked the public to help find the missing vehicle, which they say is likely to have some front-end

damage. “We do have witnesses. We are looking for more,” Cons. Clinton Stibbe of traffic services said Wednesday. Stibbe said police are investigating whether the level of street lighting on this stretch of Midland may have played a role in the accident, and said pedestrians crossing such roads should be aware at all times. The pedestrian, a Toronto resident, attempted to cross Midland from west to east just a few metres south of Kilcullen Castle. There is a set of traffic lights at the intersection of Silver Star and South Shields Avenue, about 300 metres to the south. Malvern Rouge Valley youth group works to continue its mission MIKE ADLER madler@insidetoronto.com A year after its charitable status was revoked, Malvern Rouge Valley Youth Services is partway through a transformation into a new charity that could carry on its mission. Before MRVYS shut down last fall, executive director, Phillip Fearon, said its board discussed relaunching the best of the organization under a different name. They decided instead to launch two organizations, said Fearon in an interview. The first, YPlanet Digital Learning Services, was registered last December. A non-profit company offering software and technology training, YPlanet rents space at Sheppard and Morningside avenues around

the corner from the former MRVYS office. “We’re largely volunteering, trying to keep this growing,” said Fearon, YPlanet’s executive director, adding MRVYS’s staff had to be downsized. “I’m volunteering. I’m one of the staff laid off.” STARTED IN 1980 Fearon said supporters of MRVYS applied to the Canada Revenue Agency in January to establish a charity called Youth Planet, which would run youth programs and a recording studio, as MRVYS once did. The CRA responded, and Fearon said the applicants (Youth Planet has no directors yet) are trying to answer the federal agency’s questions. The former Malvern charity was started in the 1980s by neighbour-

Pedestrians should not live in fear

Council needs to re-set priorities at halfway point

oronto City Council reached the halfway point of its mandate in spectacular fashion this week. Monday’s decision by Superior Court Justice Charles Hackland ordering Mayor Rob Ford be removed from office due to his violation of the Municipal Conflict of Interest Act will take effect on Dec. 10. The judge gave council 14 days from Monday to deal with his ruling. That possible date of removal comes just three days after council reaches the twoyear anniversary of its four-year our view term. The situation on Ford is constantly changing. Council was Councillors examining its legal options at this week’s meeting. At the moment, must still focus it appears council has the choice on community of either appointing a caretaker mayor for the remaining two years of this term, or calling for a mayoral byelection. City solicitor Anna Kinastowski said it’s going to be a long process, much of it dependent on other court rulings which could stay Ford’s removal or keep him in office if he wins his appeal. If or when the time comes for council to make a decision on replacing Ford, we strongly favour the appointment route. Calling a byelection will cost an estimated $7 million. It will also likely cause a mess of a domino effect as councillors abandon their wards to run for mayor. And that’s the last thing Toronto needs, distracted councillors furthering their own political careers during a byelection while ignoring the needs of the wards they were elected to represent in 2010. As our stories in today’s paper on Council at The Halfway Point show, councillors must fully focus on the important work of representing their communities. This has to remain their priority. We also ask that the appointee be from Ford’s side of the political spectrum. He was elected on a mandate of fiscal responsiblity and concern for taxpayers, and that should be respected. The halfway point of a council’s mandate is an artificial line for council members to reflect on what’s gone right and what’s gone wrong during the first two years of office. Unfortunately, this time it’s a harder line in the sand. It’s a re-set point for every civic politician and every civic official. There are no longer any rookie councillors – everyone has two years of experience. Understand that the pure pleasure and advantage of local politics is in moving forward carrying the interests of your constituency beyond an agenda of a perceived political left or right vision. To the editor: Re: ‘Pedestrians urged to pay attention while crossing streets’, News, Nov. 8. It’s so easy to blame the victim. I am not suggesting pedestrians should be inattentive, but they should not have to live in fear of their lives when crossing our streets. This elemental fact seems to elude the Toronto Police Service. Sgt. Jack West epitomized that in his statement: “I think if pedestrians have a better understanding of driver behaviour that will keep them safe. Drivers at intersections quite often are anxious; they want to make a left turn, they’re watching for the oncoming traffic, they want to beat that vehicle. They make their turn and for the very first time they see the pedestrian crossing and it’s too late.” It is motorists who have the greater responsibility in ensuring they do not harm others. Rink B deserves a solid A-plus in my book

s I write this, I’m staring at something I’d long since given up hope of ever seeing again in the neighbourhood – a brand spanking new outdoor hockey rink. I had to pinch myself to make sure I wasn’t dreaming. But it is an outdoor rink here in Cedarvale, alright. And it’s almost ready for action. The only thing missing is the ice and and that little detail will be taken care of in short order. The grand opening date, weather permitting, is Sunday, which, like the rink, is just around the corner. Since the weather these days often has a way of not permitting, the historic debut could be pushed back a bit. If so, I’m OK with that. I’ve waited decades for such a rink. A few extra days won’t matter a bit. And when it does open, I’ll be there with bells on. Some players wear the jersey of their favourite

player, others wear a jersey from a team of their youth. I prefer bells. It’s not just an on-ice fashion statement. It’s very practical, too. The jingling drowns out the huffing and puffing around me. Anyhow, when the puck drops to christen the rink I’ll be thinking about two rinks I used to frequent in days of yore. The first is the now defunct ice surface at the not defunct West Prep, my old public school, about a mile-and-half away. That rink is where my hockey career, such as it is, began. I wasn’t involved in serious hockey at the start. My parents didn’t chauffeur me all over the GTA to rinks six days a week. I played house

league at Memorial Arena in Forest Hill. One game a week, no practices. That’s it. Ah, but at West Prep, I could be on the ice every day. It didn’t get any better than that. I didn’t dream of being in the NHL. I dreamed only of playing at West Prep. The second rink I’ll be reminiscing about is an indoor facility that still exists. It’s located just five feet from this one – the venerable Phil White Arena, aka venerable Cedarvale Arena. I played there during my formative 20-something, 30-something and etc.something hockey years. This new outdoor arena, going only by the name of Rink B, sits in the formerly unused parking lot right behind it. Those Cedarvale games were some of my all-time faves. There was no shinny or pleasure skating schedule available at press time, so that possibility still exists. As I await the grand open-

ing, I can’t get a hit song by Canadian singer-songwriter Joni Mitchell out of my head. It’s titled Big Yellow Taxi. It was about not realizing how good you have things until it’s too late. “Don’t it always seem to go, that you don’t know what you’ve got till it’s gone,” she sings. Another memorable line in it, “They paved paradise and put up a parking lot.” Well, as for the former, I never took outdoor shinny for granted. I cherished every moment. I still do. As for the latter? Lo and behold, they paved the parking lot and put up a hockey rink. ob Ford did this to Rob Ford.” No truer words were spoken about our third (amalgamated city) mayor, than the soundbite-ready quip from lawyer Clayton Ruby, who led the legal challenge to Mayor Rob Ford’s legitimacy to hold the office to which he was elected two years ago. Ford is facing what can only be counted as a disgrace: ordered removed from office not by disgruntled voters or his own life-choices — but a court of law, for violating the Municipal Conflict of Interest Act. There will be an appeal of the decision by Justice Charles Hackland. Perhaps the mayor will prevail on appeal, and be able to remain in office. But in the course of getting there, he will hear the verdict in the libel lawsuit from the owner of the Boardwalk Cafe in the Beach. And before the end of the year, the result of a compliance audit on his election expenses will be released.

Depending on how badly that goes, he could well be faced with removal from office a second time, as well as a second restriction on when next he can run for election. Ford has already surrendered the moral authority to lead the city. The courts are now in the process of taking legal authority from him. Some have suggested that the punishment meted out by Justice Hackland — and prescribed in the Municipal Conflict of Interest Act — outstrips the nature of the crime. Hackland admitted as much in his decision: that Ford’s decision to speak on his own behalf, when faced with a report demanding he repay $3,150 in donations to his football charity, wasn’t a matter of corruption, and the violation of

the act was technical. Council is a fragile body at the best of times. The huge uncertainty Ford’s potential departure could throw it entirely off the rails. Toronto Council will need to pass a budget — which, one would hope, would reflect the complex will of the electorate. It will have to deal with the continued implementation of a transportation plan. It will have to decide what to do about revenue sources like the land transfer tax. One might argue Ford’s presence has been of diminishing relevance to all of this, as council has chosen its own route. But the instability over the next few months will all but guarantee a level of legislative paralysis Toronto hasn’t seen since the early days of amalgamation. Toronto council at the midway point As Toronto council approaches the midway point of its four-year term, Scarborough councillors reflect on their accomplishments, the future

n the early months of this year, Rob Ford walked a succession of Scarborough malls on weekends. The visits were said to be part of the Toronto mayor’s own weight-loss regimen, but they a felt like a political closer look campaign. The mayor was Inside elected insisting Toronto Scarborough residents wanted subways instead of “streetcars,” and he had immediately cancelled the Sheppard East light-rail line, but in 2012 his efforts to build a subway through Scarborough ended in failure. At a parkette near Victoria Park Avenue in March, Ford stood near Agincourt residents – some of whom asked him during his campaign to cancel the LRT line – saying he’d win the next crucial transit vote at Toronto Council. Money to build a Sheppard subway extension to Scarborough Town Centre would appear as it was built, he said, and it could be built one station at a time. Weeks before, the mayor held another open-air press event on Eglinton Avenue, declaring he’d spend $1.5 billion or so to bury the Eglinton-Scarborough Crosstown LRT through Scarborough, making it a “subway” to Kennedy Station. He had a letter, signed by seven of the 10 Scarborough councillors, backing his stand. But on this, too, he lost. Fellow suburbanite Scarborough voters, after years grumbling about post-amalgamation Toronto, had helped put a fellow suburbanite from Etobicoke in the mayor’s seat, but their newfound power on council – including five of 13 seats on Ford’s powerful executive committee – didn’t get Scarborough what it apparently wanted most. At the term’s half-way point, days before Ford found himself fighting a judicial removal from office, local councillors known as council moderates said the mayor should work hard in the future to compromise with opponents. Michelle Berardinetti, stepping down next month as a member of Ford’s executive, said some responsibility for the overturning of his subway plan lies with Ford, who “should have done a better job at working with some Scarborough councillors” opposed to it before a council vote in February.

Ford kept saying subways could be built without new taxes or tolls after Berardinetti and other subway supporters saw the numbers didn’t add up. “He wasn’t even willing to talk about other revenue sources,” said the Scarborough Southwest councillor. Council under Ford, Berardinetti said, has “become more political, and that doesn’t bode well for the issues,” adding the city’s urgent needs – a practical way to expand its transit system, repairing damage done by the emerald ash borer, upgrades to sewer infrastructure – cannot wait for a new term. Chin Lee said he didn’t support the mayor during his election campaign because he feared a lack of leadership at council. “I saw what could happen, and it’s happened in the last two years,” said Lee, who represents Scarborough-Rouge River. “People are emailing me and saying Toronto is the laughing stock of Canada because council is divided.” After seeing more American-style politics “where there’s conflict campaigning and not getting the work done,” Lee was hoping this would change. Lee said he voted against Ford’s subway plans – including burying the Eglinton LRT – because they would be taking money from an LRT project benefiting his constituents. “People say Scarborough’s a poor cousin. The north end of

Scarborough’s even poorer,” he explained. Before the 2010 election in which they chose Ford, Lee and Berardinetti said, Scarborough residents told them they wanted “value for money” from city hall. They wanted more jobs to come to Scarborough, they wanted the city to keep its programs, but they wanted their tax money spent wisely. Ford campaigned as a man who would stop frivolous spending. Judging from emails he gets, Lee said, a good number of people are still convinced city hall’s wasting money. “They still feel there should be further cuts.” But others in his ward are against cuts, particularly when it comes to public library hours or police. And despite the wholehearted efforts of Ford’s budget chief, ScarboroughAgincourt Councillor Mike Del Grande, Scarborough councillors joined downtown colleagues in rejecting proposed cost savings. People in Birch Cliff helped save the Birchmount Residence, home to older homeless men, when it was threatened in their community. Berardinetti managed to stop the privatization of programs at the Warden Hilltop Community Centre. Along with some successes – Ford opened a bus stop at Variety Village he had personally promised during the campaign, shook up the executive of Toronto Community Housing

and then scored a “huge win,” according to Berardinetti, when municipal unions signed tough contracts she thought were fair for all sides - there are still feelings Scarborough doesn’t have enough clout in city government. At Scarborough Community Council recently, some members were clearly disappointed to learn funds from a city land sale nearby had been spent on streetcars and couldn’t be used, as they had thought, to create a park over part of McCowan Road or for improvements to the civic centre area. Berardinetti, taking over as community council chairperson for the rest of the term, said she had completed her original to-do list (upgrading community parks, for example, and removing bicycle lanes which were a “real sore point” with residents) for her ward, and was making a new one. Lee said he’d like to improve Scarborough’s image, getting the media to stop implying the area isn’t safe. Both councillors said it may be better for the province to make the TTC part of a regional transit system that can be paid for through shared revenue tools, such as a sales tax.

Mayor Rob Ford has had a colourful first two years in office: starting from the moment he announced that Transit City was “dead,” then handed off the limelight in his swearingin ceremony to a red-baiting Don Cherry. As he reaches the second anniversary of his mayoralty on Dec. 7, Ford’s political career in municipal politics could well be over. Superior Court Judge Charles Hackland ordered Ford removed from office on Monday over a conflict of interest he failed to declare, when he asked council to forgive him having to pay $3,150 of money donated to a football charity. That matter was one of many black eyes Ford has inflicted on his own mayoralty. But what about policy? After two years in the mayor’s chair, what has Rob Ford done to change the face of Toronto? Initially, it seemed like he had accomplished quite a bit. He convinced Ontario Premier Dalton McGuinty and Metrolinx to stop work on the Sheppard LRT and let the city attempt to build a subway there instead. He convinced Toronto Council to scrap the $60 vehicle registration fee, and using surpluses left by the previous administration, froze property taxes in 2011. Toronto councillors’ office budgets were slashed in half. He convinced council to contract out garbage collection in the area west of Yonge Street. He and Deputy Mayor Doug Holyday were able to win major concessions from the city’s remaining unionized workers, with only a short public library strike. In the service of his promise to cut the “gravy” at city hall, he implemented a core services review, which enabled council and the public to decide what services the city should or should not be providing. These exercises found little to cut. The fallout from the process arguably led Toronto Council to take a firmer hand with the mayor in 2012, which saw many of his promises undone. Council resurrected Transit City and turned around the 2012 budget to restore some key services. What’s to come? Well, if Ford is successful in appealing Hackland’s ruling, there are a couple of outstanding promises. Ford has promised to start cutting the land transfer tax on real estate transactions. And he is aiming at a 1.75 per cent property tax increase for 2013. And he has made it clear since the spring, when council shut down his subway dream: Rob Ford is already campaigning for re-election in 2014.

The mayor had refused advice from the city’s integrity commissioner to return the money before a complaint led to this week’s decision. “I don’t think anyone on council really knows what to do next,” said De Baeremaeker, who often clashed with Ford and his councillor loyalists over the last two years.

Ford was elected in 2010 with a strong mandate but the ruling is “a black eye for the city” because other council members are working hard, and Ford “made us all look like a bunch of idiots,” De Baeremaeker said. “The whole world is either laughing or groaning at the City of Toronto today.” De Baeremaeker said he gives the mayor benefit of the doubt that the breach of rules was an error in judgement, but said Ford was a veteran councillor before he was mayor and should know better. Hackland suspended his ruling for 14 days and Ford said he will appeal.

The mayor may be able to hang onto the job until appeals are decided, but he is still facing the results of a libel trial and an investigation into his campaign finances, De Baeremaeker said. “My guess is he won’t be able to focus on running this city, like the rest of us are.” The councillor said he was so far undecided on whether there should be a byelection to fill a vacant mayor’s chair or if Doug Holyday, the city’s deputy mayor, should be appointed. “If there is a byelection, the mayor’s inappropriate behaviour will have cost the taxpayers $7 million.”

Ford apologizes, announces date for appeal to be heard Mayor Rob Ford has apologized to “everyone who believes I should have done this differently,” for the behaviour that led to a Superior Court judge to throw him out of office two weeks from now. “Looking back, maybe I could have expressed myself in a different way,” said Ford at a Tuesday afternoon news conference. “Everyone who believes I should have done this differently, I sincerely apologize.” The contrite Ford made the statements just a day after the decision from Superior Court Justice Charles Hackland was released, in the conflict of interest case that Toronto citizen Paul Magder and lawyer Clayton Ruby brought to court in September. Ford has been ordered to be removed from office within two weeks of the ruling, and not to run again until the end of the term. Ford re-iterated his defence on the stand, saying that he believed he had done nothing wrong and had no conflict. “I respect the courts and the decision that was released yesterday,” he said. “My decision to appeal is not a criticism of the court. But I feel that it is important to go through the appeal system so I can continue to do the work I was elected to do for the taxpayers of this city. This entire matter began because I love to help kids play football. When this came to council for a vote I felt it was important to answer the accusations that had been made against me. I was focussed on raising money to help under-privileged youth. I never believed there was a conflict of interest because I had nothing to gain and the city had nothing to lose.” Ford did not take any questions, because, he said, the matter is before the courts.

The committee, which formed after the incident and organized two peace walks and a back-to-school barbecue there, has told the city residents wanted a safe space with resources for children, a place to foster academic excellence and help adult residents employment and careers. Under their three-year proposal, administered through the East Scarborough Boys and Girls Club, a single townhouse residents named “Our Space” will be renovated and equipped with furniture, computers, tutors and instructors who can offer specialized training and, by next July, summer programming. A scholarship fund will also be formed to grant $5,000 to one boy and one girl from Danzig each year, said Thompson, adding residents attending the presentation yesterday were excited and pleased about the community’s new prospects. “They realize they’re part of the solution in order to ensure their own success,” Thompson said.

n Elder abuse awareness

A company of 50-plus actors were at a Toronto Community Housing building in Parkdale to stage a series of short plays aimed at raising awareness about elder abuse. Act2Studio Works, a theatre program out of the Chang School for Continuing Education’s Programs for 50 Plus at Ryerson University, staged their latest production of plays before an audience of seniors at the May Robinson Apartments Nov. 21. The series of seven short

plays look at the different forms of elder abuse, including emotional, physical, sexual and financial abuse as well as isolation and neglect. “Toronto Community Housing had been interested in developing a show on elder abuse and they contacted us because Act2Studio has a history of doing shows about social issues,” said Elaine Vayda, a member of Act2Studio Works. The plays were written by Vrenia Ivanoffski, artistic director and founder of Act2Studio Works,

in collaboration with the actors based on discussions they had with Toronto Community Housing and concerns they had. “The plays were designed to generate awareness of the problems and help to stimulate discussion afterwards on different ways to react to it, how to get help and where to look for help,” said actor Neil Naft. Act2Studio Works has performed the plays for Toronto Community Housing residents across the city nearly a dozen times in the past.

Tax credit aimed at helping seniors live at home JUSTIN SKINNER jskinner@insidetoronto.com The provincial government has upped its commitment to seniors with the introduction of a tax break geared toward making homes more accessible and allowing people to live independently in their homes for longer. Seniors Minister Linda Jeffrey announced the Healthy Homes Renovation

Tax Credit, which puts in place a permanent, refundable tax credit that could put as much as $1,500 back into the pockets of seniors or those living with seniors, at the North York Seniors Centre on Thursday, Nov. 22. “We know that the home is where seniors connect to their community,” Jeffrey told a group of seniors at the centre. “It’s where we as a government can support

you in your independence.” The plan calls for a 15 per cent tax credit on such home upgrades as ramps, grab bars, walk-in or wheel-in bathtubs or showers, lowered counters, non-slip flooring or anything else that will allow seniors to live independently in their homes longer. “Often, making small, practical changes to our homes can make a world of difference in our lives,”

Artists can be torn between the desire to quit their day job and everyday pressure to withdraw from art completely. “A lot of us in the arts wear two hats,” Ben Lopes, program director for Scarborough Arts said this week. “There’s always that pressure to pay the bills and support a family.” The Scarborough group, along with the Neighbourhood Arts Network, is launching a new speaker series, Making a Living, Making Art, this Friday afternoon. Sounds of Season set for UTSC The Sounds of the Season will be on tap this Saturday, 3 to 5 p.m., at the University of Toronto Scarborough Campus (UTSC), at the Meeting Place, featuring both classical and contemporary selections. Each ensemble will perform a variety of songs, including Amazing Grace, The Ukrainian Bell Carol and Dmitri Shostakovich’s Waltz No. 2 from Suite for Variety Orchestra. There will also be a special collaboration between the concert choir and concert band as they perform Ave Maria and Irving Berlin’s White Christmas. Admission is free. Donald Day Peacefully, the morning of November 24, 2012 at the Scarborough General Hospital, in his 79th year, after a long battle with cancer. Predeceased by his wife of 49 years, Kitty. Lovingly known as “The Dude”. Very good friend of Joyce Scott of Scarborough. He leaves behind four children, Dawna, Michael, Robert and Richard - all of Toronto. He will be sorely missed by his six grandchildren, one greatgranddaughter and siblings Jim, Jacquie, Lorne, Gary and Jeanette all of Western Canada. Born and raised in Alberta, Don moved to Toronto in 1955 after playing one season with the Edmonton Eskimos in the CFL. Don’s passions included his family first - always - and playing with and coaching his kids on baseball, hockey and football teams. An avid golfer and bridge player, Don always found time to volunteer as convenor, president, commissioner, labourer - you name it - for anyone who asked. You can’t believe how much this guy will be missed! All may gather at McDougall & Brown Funeral Home (Scarborough Chapel), 2900 Kingston Rd. 416-267-4656 on Thursday, November 29th from 2-4 & 6-8 p.m. Funeral mass will be held at St. Joseph’s Highland Creek Catholic Church, 200 Morrish Rd. on Friday, November 30th at 11 a.m. Burial at Christ The King Cemetery. IVY RANDALL Died peacefully at the home of her daughter Deborah and daughter-in-law Patricia on Monday November 26, 2012 in her 87th year. Special thanks to Dr. Dennis Stern, Dr. Kim Warwick, Linda Woodard, Joyce Brown, Larry Freeman, and the Fabiano family for their care and support. Thanks also to Deborah’s colleagues and staff at Lakeland Long Term Care for their patience, understanding and help during Deborah’s many recent absences. Ivy is fondly missed by her friends and neighbours in West Hill, ON, and also by her family (including many generations of nieces and nephews) in England and Canada. Mum was very specific about her wishes, and so there will be no visitation or service. In keeping with one of her great loves, she would appreciate being remembered through a donation to your local animal rescue organization or humane society. Cherished grandmother of Taylor, Stephanie, Michael, Nicole, Katie, Bryan, Melani, Jessica, Ashley, Christina, Amanda, John, Jordan, Nathan, Jenna and Selena. Daughter of the late Jadwiga and Romuald Sulatycki. Predeceased by brother Roman and survived by siblings Sophia, Halina, John and Luke. Anna will be lovingly remembered and sorely missed by her many friends and family.
