Ontario Court of Appeal will hear case in the spring challenging the city bylaw which passed in 2015 MIKE ADLER madler@insidetoronto.com Dozens of Toronto business owners who make a living from herbal shisha are holding their breath, waiting for a court ruling they believe will either clear them or force them to shut down. For now, people still visit places like the Nile Palace Cafe in Scarborough’s Wexford Heights, or the Fairouz Sheesha Cafe on the Eastern Danforth, to play backgammon, watch sports or surf the internet, often in the middle of the night. And of course, customers come to smoke shisha mixtures owners owner say provide 80 or 90 per cent of their revenue - through waterpipes called hookahs. "It’s a community for us, not just a cafe," says Magdy Mehany, owner of the Nile Palace for about the past nine years. People also come hookah bars to get away from the regular bar scene, and for companionship, adds Fairouz’s owner Karim Raja Fallah, whose place is one of several on the block to offer shisha. "They have problems; when they talk, we try to help," he said. "There’s no fight, and they’re going home safe. They’re not touching the lives of others." A Toronto bylaw passed in 2015 banned shishasmoking in licensed establishments, but the ban isn’t enforced because of a challenge the Ontario Court of Appeal will hear this May or June. Anti-tobacco campaigners and the Ontario Lung Association supported the

But because of its narrow scope, said Ryan Zigler, a lawyer for shisha bar owners, including Mehany, who are appealing the Toronto ban, "what they really did was to pass a bylaw to shut down an existing business." Shisha joints usually serve some food and juices. But though 46 per cent of customers in a city focus group said they’d still come if shisha wasn’t served, owners say their establishments would have no future.

"They’re going to lose their life savings. It’s a financial catastrophe for them," Zigler said last week. Certain commercial areas where shisha joints opened up in the last decade, and where they make up a large part of the street life, risk being decimated, owners say. The Wexford strip along Lawrence Avenue East is famous for being an Arabic or Middle Eastern community, and people mainly go there for Mediterrean food and shisha, Mehany said. A Superior Court judge last October upheld the by-

law. If the appeal court’s three judges don’t rule against it, Mehany predicted, "there won’t be a lot of Arabic people gathering in this community anymore." The Wexford Heights Business Improvement Area did not respond to a request for comment on the ban’s possible effects. Last week, Maher Hamarneh, owner of Dream Cafe on Lawrence, wondered whether it was the growing popularity of shisha-smoking among non-Middle Eastern Canadians that moved the city to act. "Shisha, it used to be for

Ali, Mohammed and all the Arabs. Now, it’s becoming Tony, Sammy and Mike," he said, standing in his second Wexford-area business, a wholesaler he opened in March called Shisha Mart. Stacked on shelves around him were hookahs from Egypt, Turkey, Dubai and other countries, ranging in price, he said, from $10 up to $800 home showpieces. In the late 1970s, Hamarneh said, he opened Ontario’s first shisha cafe, Jando, in Mississauga. "I opened it to see friends - I didn’t have time to see them

- and have fun." Toronto’s municipal government says it believes in multiculturalism, but it’s practicing "favouritism" by banning a practice important to Middle Eastern culture, Harmarneh said. City officials have said there was little awareness about the health risks of hookah use, and ban supporters argued smoking shisha "normalizes" tobacco smoking for young people. Owners, however, say they don’t include tobacco in their shisha mixtures, and don’t let anyone under 19 in. "We take pride in seeing the place is well-ventilated," Mehany added. While admitting it isn’t healthy, the sellers argue shisha doesn’t cause much harm in a city where alcohol, marijuana, fast foods and other unhealthy pursuits are freely available. In Egypt, Fallah said, "people that are 90 years old are still smoking it. If a person is an adult, they can do what they want." The city could license and limit shisha bars rather than banning them outright, he and Harmarneh suggested. But Zigler said the appeal should be successful because the city doesn’t have the power to close a business based on health concerns. "Businesses haven’t been banned in Canada since Prohibition," said Zigler, who is also representing hookah lounges in Peel region, where hookah-smoking is banned in all public places. That case will be heard in late February.

Toronto police reform ushered in with hope, skepticism The City of Toronto is preparing for some substantial changes on a number of fronts. Budget consultations are underway and residents are signing up by the dozen to appeal to decision-makers to maintain funding for programming. Toronto Council is considering some new revenue tools to provide some of that funding, with road tolls, a hotel tax and very possibly more in place. And then there’s policing. Change has been very slow to manifest itself within the ranks of the Toronto Police Service (TPS). There is indication that some is on the way. In an interview with crime reporter Andrew Palamarchuk this week, Toronto police Chief Mark Saunders outlines what some of those changes will look like: removing crossing guard responsibilities from TPS and amalgamating various police divisions among them. A report on modernizing the force is finally bringing about the change we’ve wanted to see for a long time from police who have a reputation for heel dragging when it comes to reform and economy. The chief describes this change as "exponential" on the one hand. On the other, he makes it clear that it won’t happen overnight. Forgive us for wishing that it would. It would have been nice, for instance, to see the controversial carding policy change more quickly. Changes have finally come into effect, on Jan. 1. Information from past carding interactions – targeting a group consisting disproportionately of young black men – will now be more difficult to access. Critics arguing that the information should simply be deleted are persuasive. It’s been slow going on this issue – under both Saunders and his predecessor Bill Blair. The Toronto Police Services Board, headed by Mayor John Tory, hasn’t done much to accelerate matters. Will Toronto’s police service be any quicker to implement the "exponential change" that Saunders insists is coming? It’s tough not to be skeptical, but it would be unduly cynical not to be hopeful. We are in a time of change in the governance of our city. Money is tight. Our leaders have made expensive choices to spend what we’ve got in areas other than policing. Toronto’s police service will have to adapt to that change, and it’s got a blueprint as to how to do so. It remains to be seen whether its leadership is also seized by the urgency. We hope that it is.

Are hookah bars really a health threat? Is there a limit to what the City of Toronto can do to keep you safe? Karim Raja Fallah and Maher Hamarneh think so. Both own hookah lounges where customers - mostly young men, but people of all ages - smoke herbal mixtures called shisha through water pipes. The city says that’s unhealthy. It banned hookah use in all licensed places, and only a case to be heard at Ontario’s Appeal Court stands between such businesses and what their owners believe is financial ruin. Owners, including Hamarneh, believe benefits of such businesses as social spots outweigh whatever harm is done by smoke. Hookah bars have clustered in commercial areas such as East Danforth and Wexford Heights in Scarborough - with a Middle Eastern flavour. The ban is set to deliver them an economic wallop. "This is our culture. And you believe in multiculture? It’s not multiculture, it’s favouritism," Harmarneh says. Years ago, the city banned sales and possession of shark fins - a status food at Chinese weddings -

in part because shark fins had an "adverse impact" on Torontonians’ health. While the worldwide loss of sharks is catastrophic, a judge in decided in 2012 that it wasn’t a municipal issue and threw the ban out. He noted people appealing the fin ban argued it was "a gratuitous insult to the dignity of the Chinese community," since the city hadn’t banned "any other food or clothing products enjoyed by any other ethnic groups." Residents from Glen Andrew, south of the proposed Scarborough Town Centre station, asked TTC staff last year to study an alternative alignment they call the Big Bend, or Big Curve. Two Scarborough Subway supporters, Glenn De Baeremaeker and Scarborough Centre MPP Brad Duguid, told Glen Andrew ratepayers in October they’d fight to get the plan fully assessed. But the Big Bend, which would lengthen the six-kilometre tunnel by 280 metres and excavate a station beside an existing one for the Scarborough Centre Rapid Transit line, turned out to be unworkable, says De Baeremaeker, a local councillor and TTC board

member. As TTC staff prepare to present the $3.2-billion extension’s preferred alignment to the board on Jan. 18 and the city’s executive committee on Jan. 19 -along with a third-party review of costs - De Baeremaeker said staff are convinced the bend will add expense and affect more properties than the preferred plan. Both De Baeremaeker and ratepayer representatives, however, believe they won important victories last year when the TTC was forced to rule out placing a construction staging area in the prized Frank Faubert Woodlot, and later when plans to expropriate homes or businesses south of Ellesmere Road and the mall were dropped, as a staging area was chosen on the mall property. People in the neighbourhood are pleased, said Lorne Ross, a retired City of Scarborough planner who drew up the Big Curve and

with its ridership numbers too low for Toronto Council to support. During a provincial Scarborough-Rouge River byelection, the riding’s new MPP, Raymond Cho, supported a future stage where the Scarborough subway would indeed reach Sheppard at least. The Big Curve pointed the end of its tunnel alignment towards a future Sheppard Subway extension that would reach Scarborough Town Centre -- despite the fact plans for an Sheppard East light-rail line are still in place. De Baeremaeker, who opposed such an extension when Rob Ford was mayor, now supports it. "I’m a convert. I believe the Sheppard Subway should be extended to the Scarborough Civic Centre." After tunnelling under the Don Valley, difference in cost between light rail and a subway on Sheppard is "minuscule at best," he said.

Ferduse Bari, one of 29 people running in the Ward 42 byelection, features on his website many photos of people in the northeastern Scarborough district wearing red Bari campaign hats and other gear. But one section (now removed), labelled "Support from leaders," displayed the candidate posing with Toronto Mayor John Tory, Scarborough-Agincourt MP Arnold Chan, Humber RiverBlack Creek MP Judy Sgro, and Scarborough Southwest MP Bill Blair. After an online story reported this, one of Chan’s assistants contacted Bari’s campaign on Thursday, Jan. 5, saying Chan didn’t endorse Bari and didn’t approve having his picture on the website. The other politicians, it turned out, aren’t backing Bari in the Feb. 13 vote either. "The mayor has not endorsed any candidate in the Ward 42 byelection. He has also not offered his support to any candidate," Keerthana Kamalavasan, a Tory spokesperson, said Sunday. This week, Bari said the politician selfies were posted on his site as a result of an "an error made by the web designer," and added they were taken down Thursday within minutes of this being pointed out.

Volunteers count 4,553 birds in frozen Rouge Park Close to 200 volunteers stood in frigid conditions on Sunday, Jan. 8, counting and identifying avian life in Scarborough’s Rouge Valley. In all, they recorded 4,553 birds of 57 species during the annual Rouge Bird Count. That included a Northern Shrike, three different species of owl and three species of woodpecker, plus a bald eagle. "Everyone was really excited by these observations," said Jeffrey Sinibaldi, a Parks Canada spokesperson. Done Sunday for the 14th straight year, and now organized by Parks Canada and the Toronto Zoo, the count provides Rouge Park managers and scientists with valuable clues about local ecology. Sinibaldi said birders had a great time despite temperatures low enough to trigger an extreme cold weather alert. Last year, rain ended the count early, he said.

’Exponential change’ coming to Toronto Police Service Chief Mark Saunders says ’community-centric’ policing is his mandate moving forward ANDREW PALAMARCHUK apalamarchuk@insidetoronto.com Toronto’s top cop wants to offload non-core police services like the city’s 600 school crossing guards in a year that is expected to see "exponential change" on the force. Toronto police Chief Mark Saunders said crossing guards shouldn’t be a police issue. "Why are we one of the only police agencies in North America looking after this?" he said in an interview with Metroland Media Toronto. "We have a tremendous amount of schools across the city and getting these boys and girls across the road is important. We’re aware of that, but there are other entities that should be, and could be doing this." Not only are police in charge of crossing guards, officers often fill in for them when the guards are away. "It’s 35 times a day, give or take," Saunders said. Police are also analyzing the types of calls they respond to. "We, on average, go to about two-million calls a year," Saunders said. In 2016, police responded to more calls than the previous year though fewer calls were for an emergency. "We had more of these calls that, to be quite honest, the police might not have been the best resource to go to, so we want to prioritize to see what calls the police should be going to and what shouldn’t we be going to," Saunders said. "Through analytics, we’re going to figure out what those calls are going to look like that we’re not going to. We will be

"The taxpayers look at that and say is that the most effective and efficient way of using highly trained police officers?" But Scarborough-Rouge River Councillor Chin Lee, who is vicechair of the police services board, said city studies have indicated that it’ll be more expensive if the city looks after crossing guards as well as beach life guards, who

begin implementing the recommendations of the final report by the Transformation Task Force on modernizing the force. The final report goes to the police services board Jan. 26. An interim report was released in June followed by public consultations across the city. "Over the next year, you will see us starting to roll out more officers on foot," Saunders said. "The final report will also speak to timelines with some of the initiatives...Every three months, I have to report to my board to say that this report isn’t just a report that is sitting on my shelf; it’s a report that is actually being executed. The public had asked for that, and I will deliver."

The implementation of the recommendations will be made over three years and is expected to save $100 million. "The savings will be coming from the reduction in the number of officers," Lee said. "The final target after these three years would be 4,700 uniform officers. Now, it’s about 5,200." Merging police stations are also in the plans. Saunders said officers typically record their encounters in their memo books and then input the information into a computer at the station. "But our business process is going to be more virtual," he said, adding a component of that could involve e-memo books so officers wouldn’t have to go to stations to input their encounters but do it "right where they are." In that way, stations would become less important. "Crimes do not happen in police stations. Officers will spend more time out on the road," Saunders said. "One of the things we heard at all of the community consultations was they wanted more of a community-centric approach to policing, so we’re going to be policing the neighbourhoods by having more officers on the beat." Lee suggested more stations don’t necessarily mean better policing. He stressed many of the new initiatives will be implemented over three years "so don’t expect things to change overnight." According to Toronto police statistics, shooting occurrences in 2016 were up 41 per cent over the previous year while the number of shooting victims increased by 34 per cent. Saunders said the problem isn’t unique to Toronto. "The answer is not just about enforcement," he added. "It’s about government working with the police to invest in those neighbourhoods that are in need of resources and that are in need of guidance, and I think that is the starting point to success."

Many people feel frustrated because others speak too quickly. This results in missed words and it can be hard to understand what’s being said. This is why we often have to ask people to repeat what they just said. Even mild cases of hearing loss can lead to difficulties with processing speech. Hearing loss can develop so gradually people do not even realize they have it. Fortunately, modern hearing aids can help by stimulating the auditory centers of the brain responsible for speech understanding. Hearing better will seem like the sounds “slow down” when a person is speaking so we hear all the words. You may be relying on visual cues (e.g. reading lips) or are applying more effort to listen. Research shows that the longer an ear goes without hearing, the greater the effect of auditory deprivation can be. Hearing aids may prevent auditory deprivation as they provide stimulation to the auditory nerves and auditory cortex. Further, the speech understanding abilities of some people improve with hearing aids (recovery from auditory deprivation). However, if hearing aids are put off for too long, it can cause longlasting speech understanding difficulties. Auditory deprivation may be prevented for some clients through

Hope you all enjoyed the holidays. Christmas. Hanukkah, Kwanzaa. New Year as well. Happy belated. Because now things are a little grim. After the trees and lights come down, we are staring down the barrel of a long winter in a very cold climate. I often think our forefathers and mothers chose a fantastic country to settle. Except for that climate thing - they kinda blew that one. Back to work and school. Credit card bills due. New Year’s resolutions already broken. And the extra expense of that gym membership you will never use. Name one good thing that happens in January. There, you couldn’t now could you. My dog’s birthday doesn’t count. John A, Macdonald’s birthday? No holiday for that, although with this being Canada’s 150th birthday, we will all

others can go days at this time of year hardly seeing the sun. "I have a day job as well, and I get up at 6 a.m., and get out of work at 5 p.m., then come here, so I don’t see the sun for days. It’s nice when spring comes", said Jesse Fraser, 22, who works at the historic Stone Cottage on Kingston Road. Now February I can deal with. It has 28 days. Valentine’s Day is kind of fun for a lucky guy like me with a wife and two daughters. I always have at least one date. Tell me the Family Day holiday doesn’t make a huge difference to break up the month, even the winter. See, we’re already nearer to spring. That wasn’t so bad was it?

Residents speak out at city budget consultations ANDREW PALAMARCHUK apalamarchuk@insidetoronto.com Poverty reduction, student nutrition programs and public transit were among the issues heard at the Scarborough Civic Centre during a public deputation meeting on the city’s 2017 capital and operating budgets. On Thursday, Jan. 5, dozens voiced their views to members of the budget committee, which needs to find $91 million to balance the budget. John Stapleton, who coauthored a poverty report in November, urged councillors to invest in reducing poverty. "The city also has a role in creating a living wage that would take people out of poverty and turn them into taxpayers," he told the meeting. "Rather than trying to save 2.6 per cent off the city’s budget through cuts, the city’s government could more usefully apply itself to reducing the city’s own share of the cost of poverty, and in time, eventually save the same amount and perhaps a bit more." Stapleton noted the "fiscal drag of the cost of poverty" stands at about $5 billion out of the $184 billion economy Toronto represents. "That is an unneces-

sary fiscal drag of just over 2.7 per cent caused by the cost of poverty alone." Though it’s not up to city government to create full employment, Stapleton said, the city does have an important role "to create the policies that foster full employment." Sherry Pearson, co-ordinator of the student nutrition program at St. Agatha Catholic School, spoke of the merits of the morning meal program. "Benefits such as satisfying hunger - which allows a child to focus more on his or her school work educating them simply through example on healthier food choices and providing food in the morning to those who, for one reason or another, don’t get enough, or in some cases, any food at all." Pearson said her greatest challenge is "acquiring more funding in order to maintain this invaluable program." Councillor Gary Crawford, chair of the budget committee, said in an interview that an increase in funding to student nutrition programs across the city isn’t in the budget at this point. "If we can’t balance the budget through other means, some of those important programs could be in jeop-

ardy," he said - adding, though, the mayor won’t be supporting cuts to programs that impacts the city’s poverty reduction strategy. Gillian Sumi received applause after describing the challenges of using public transit while in a wheelchair. She said that ramps are too small and she can’t navigate easily on narrow TTC buses. When the buses are very crowded, Sumi said, she can’t even get on, forcing her to travel during nonpeak hours. She said she uses transit buses because Wheel-Trans requires riders to book trips at least one day in advance. Sumi said the TTC is experiencing a $77 million budget shortfall and urged councillors not to support cuts to bus routes. "Council has not applied the revenue tools needed to build the transit our city desperately needs. Road tolls alone will not do," she said. What is the harm in a quiet meeting between politicians, to hash out strategy and direction, maybe sort out differences? That is the reasonablesounding question that Mayor John Tory has asked in a private meeting with Ontario Premier Kathleen Wynne. As documents obtained by The Toronto Sun in a Freedom of Information request show, and Tory has confirmed, Tory asked for changes to the City of Toronto Act that would lift the rules preventing more than 50 per cent of a committee or council from meeting privately. Tory is specifically interested in having full, private meetings with his executive committee, the most powerful assembly in the city with the exception of council itself. The executive’s members are generally considered especially loyal to the mayor and his agenda - in-

Which is something that one would expect to be done with a cabinet filled with loyalists. It is much easier to do in a big group than in the two-bytwo meetings that Tory says he needs to do to even order lunch with his 12member committee. So no harm, right? Perhaps no harm, but doing so would be a lot of trouble - so much so that when the

matter became public, Tory indicated, maybe a little sullenly, that he wouldn’t in fact be pursuing the change."It’s not worth the trouble," he told reporters.It is trouble, and should be trouble, to do something like this. It’s not because of fear that Mayor Tory’s behaviour will become particularly more nefarious indulging in quiet lunch-ordering meetings with his caucus. It’s a matter of transparency, and checks and balances - and appearances. And any time that a politician makes a move to close a door, it gives the appearance that transparency and checks and balances are being sacrificed for something rather more serious than efficiencies.
