Proposed tougher rules give hope to Toronto tenants

LiveSafe rating system in highrises could improve quality of life MIKE ADLER madler@insidetoronto.com Toronto may be one of the most livable cities in the world, as Mayor John Tory says, but Orville Brown must still keep his rice and flour in heavy plastic bins with airtight seals. If not, he says, cockroaches infesting the kitchen of his Southwest Scarborough apartment near Markham Road find their way in. “These are my tenants, here,” Brown said on a night last week, gesturing to the cupboards, where insect traps were full. Brown and renters across the city are hopeful a proposed tougher apartment building inspection regime will help them with problems, including infestations and a lack of heat and hot water, weighing down their daily lives. They include Robert Perry, who said the current system just “shakes a finger” at landlords cutting corners in buildings to save money. “There needs to be a lot more oversight than the city permits currently,” said Perry, who’s spent most of his live in a highrise near Etobicoke Civic Centre. Four years ago, the building changed hands. Perry said it took the new management seven months to fix a bedroom window which broke in a December storm, eight months to replace a bathroom sink tilting forward and moving away from the wall. On Jane Street in North York, Savitri Ashmead said her bathroom tiles are falling apart, and

her bathtub is old and rusted. Mildew has blackened her bathroom ceiling, and is coming down the walls. Twice management - she only knows her building is owned through a numbered company painted over the ceiling, but the dark stuff reappears. Ashmead said she’s ashamed of how her bathroom looks. She sent a work order to management two weeks earlier, she said, but no one even replied. “We’re trying our very best to keep it livable, but it’s not.” For a decade, tenant advocates including Toronto ACORN have pushed for highrise apartment landlords to be licensed. What’s now proposed instead – and which passed the city’s Licensing and Standards Committee last week – is an expansion of the city’s apartment building inspection program. Among other things, the new bylaw would require buildings to register with the city, have a process for tracking and responding to tenant repair requests, and have a “comprehensive” pest management plan that includes the use of licensed professionals. The city won’t commit to it, but would explore using a rating system similar to its restaurant “DineSafe” program, one requiring landlords to post colourcoded signs displaying the city’s rating in a “prominent” location. ACORN calls this the LiveSafe program. The new bylaw wouldn’t win every battle for tenants. The proposed program budget adds six more full-time positions to the

Inspections are mainly limited to common areas of buildings, and so “don’t capture the scope of in-suite issues that tenants also face,” the Federation of Metro Tenants’ Associations and other housing advocates told the city last week in a letter. Landlords may be able to pass the $8 per unit per year registration fee to tenants unless the province forbids that. Perry said he wants to see “more visual homework” for tenants before they move in, and annual mandatory inspections by an unbiased body. Brown, meanwhile, said he’s learned to walk away from arguments in his building office

He wants more inspectors, and approves of the grading idea. “If people know there was roaches here, they’d probably think twice” before renting, said Brown. Landlord representatives dropped flyers in his building, calling the registration proposal “an apartment tax,” but Brown had gone to an ACORN meeting, so “mine went to the recycling bin,” he said. In another building on McCowan Road in South Scarborough, Angela Aminian Fershteh has stopped using her kitchen cabinets in October, because roaches are behind the cabinets. Fershteh keeps kitchen sup-

plies in bags and piles them on her dining table, and in her son’s room. She never leaves dirty dishes in the sink, she said last week. “I always clean; always, every day.” She took her management to Ontario’s landlord and tenant tribunal this fall, saying roaches and mould had affected her health, and her son’s. Her complaint was dismissed after the landlord’s pest control company testified they didn’t see live cockroaches in her apartment. Fershteh is determined to try again, and she attended a recent meeting at city hall out of hope the city’s system can change. “I’m not animal, I’m human,” she said. “I want rights, please, because I’m paying.”

Toronto Council mustn’t be timid when it comes to highway tolls

ext week, Toronto Council will gather to talk about the prospect of tolling two highways: the Don Valley Parkway and the Gardiner Expressway. It wasn’t so very long ago that politically at least, such conversation would have been unthinkable. Ontario’s only experiment with a toll road, the privatized Highway 407, has not been the best proof-ofconcept for commuters and taxpayers - and that was a road that was purpose-built in parallel to the existing toll-free Highway 401. The idea of putting tolls on roads already built, without easy free alternatives, has been political poison for more than a decade in this town. Now, road tolls on the DVP and the Gardiner are more pill than poison, and even John Tory, who once ran for mayor opposing them, seems to understand that. He’s thrown the weight of his office behind the idea, along with a couple of other revenue sources - a hotel tax, and the closing of a tax exemption for vacant businesses - and it’s unlikely that Toronto Council will turn him down next week. Of course, voting in favour of tolls will be easier for some councillors than others. Those who represent wards along the two highways will get pushback from their residents. Indeed, Tory’s own deputy mayor Denzil Minnan-Wong’s ward 34 (Don Valley East) straddles the Don Valley Parkway and at the Executive Committee he was concerned that his constituents would wind up being disproportionately gouged with tolls. His solution was to look into providing a cap on tolls for Toronto residents. There will likely be other solutions designed to mitigate the impact of the new fee on constituents by the time this gets to Council and we would urge councillors to look at any such measures with caution. That’s because by any estimation, as ambitious as it might seem to raise money for transit and transportation through road tolls, road tolls alone are not enough. Mayor Tory selected his three revenue measures from a list of nine put forward by city staff. Those include alcohol and sales tax, an income tax, changes in residential property tax rates, a parking tax and the reintroduction of the vehicle registration tax, at double the rate that it had when briefly in place. At some point, council will have to revisit some or all of these measures, after having taken this first step of tolling roads. Knowing that, it would behoove councillors not to stumble out the gate.

Homeowners in Scarborough, North York and north Etobicoke can’t abide them. A generation after amalgamation they are illegal, a threat to property values, blamed for nearly everything dragging a neighbourhood down. Yet, those parts of the city - in five selected areas across the north end - are where city staff want to introduce some form of legal, licensed rooming houses before the next city election in 2018. Here’s a prediction on the number of rooming houses licensed north of Highway 401 by then: none. It’s easy for suburban

It’s said many rooming house tenants don’t know their housing is illegal, but let’s assume many do. They are usually newcomers to Canada, or young adults, or both. They learn they need to break the rules, to dump their garbage somewhere else, to furtively move their cars around, and to expect no protection from the city they live in. Some rooming houses need to be shut down, but

shutting them all before licensing begins is impossible. In old Toronto, licensing at least provides rules and inspections that can keep people safe. Mel Lastman - once mayor of a North York where three persons unrelated by blood or marriage couldn’t legally live together - used to say legal basement apartments would lead to disaster in his former suburban city. The province made second suites legal in Toronto - all of amalgamated Toronto - in 1995, and the disaster has yet to arrive. Murdered doctor remembered as ‘talented’ physician ANDREW PALAMARCHUK apalamarchuk@insidetoronto.com

The medical community is raising funds to help the children of Dr. Elana Fric Shamji, the Scarborough family physician who was murdered last week. A You Caring crowdfunding page was set up Monday to “ensure that the immediate needs” of Fric Shamji’s three children are met. As of early Wednesday evening, more than $84,000 was raised of a $100,000 goal. The Ontario Medical Association (OMA) said a trust fund is also being put in place to assist with the long-term financial needs of Fric Shamji’s children. The OMA had said it’s also working to “permanently honour” Fric Shamji. Her colleagues called an urgent meeting Sunday to discuss ways to commemorate her.

Her husband, Mohammed Shamji, a prominent Toronto neurosurgeon, was charged on Friday with first-degree murder. The couple lived with their children in North York. “The Ontario Medical Association is also actively working on a way to permanently honour Dr. Elana Fric Shamji’s memory,” Dr. Virginia Walley, OMA president, said in a news release. “We continue to keep her family and friends in our thoughts and prayers.” Walley said doctors in the province are a “close knit community, and we are all stunned by the tragic news.” She described Fric Shamji as a “talented family physician who was active in many efforts to improve the health-care system.” Fric Shamji was a member of The Scarborough Hospital family medicine teaching unit, which provides patients with access

condolences to her family and friends. We will be working with our team in the Department of Family and Community Medicine to have physicians ready to care for her patients.” Fric Shamji’s clinical interests were women’s health, preventative health and family and community medicine. Memorial donations can also be made to The Shelter Movers of Toronto and/or The Canadian Centre for Refugee and Immigrant Health, the OMA said. Fric Shamji attended medical school at the University of Ottawa and completed her family medicine residency in Ottawa. She also holds a Master of Public Policy degree from Duke University. Originally from Southwestern Ontario, she reportedly filed for a divorce from her husband of 12 years just prior to her murder. She was reported

Shamji was a neurosurgeon at Toronto Western Hospital, which is part of the University Health Network. He also served as an assistant professor of surgery at the University of Toronto. He completed medical school at Queen’s University in 2003 and then entered the neurosurgery residency program at the University of Ottawa. Battle ahead in Toronto suburbs over rooming house licensing Councillors expected to back homeowners in talks next year MIKE ADLER madler@insidetoronto.com Neighbours watched workers tear up and pave part of the front lawn. In 2008, they photographed the result: two cars in the garage, and three parked abreast in the driveway. People in Chartland, a North Scarborough subdivision of four and fivebedroom homes, then saw more suspected rooming houses take root. Police raids shut two down, and in 2014 there was an angry meeting between the local councillor, Chin Lee, and Chartland homeowners. One later recorded video of rats running from behind the original rooming house to her garden next door, where she killed five or six of the rodents in one summer. The house, listed as having eight bedrooms, had been sold by then. But Chartland people don’t forget. To them, bad rooming houses, even when they turn quiet, are a blemish on the neighbourhood. Now the city wants to try licensing some rooming houses in five suburban areas of Toronto, and Chartland’s in one. “People downtown don’t understand how a bad rooming house affects the community,” said Murray McLeod, who spoke to Mayor John Tory’s Executive Committee this fall on his neighbourhood’s behalf. McLeod said people want bad operations “cleaned up” before any licensing begins. The committee approved consultations next year within five areas – in North York, south of York University’s Downsview Campus and Newnham Campus of Seneca College; near Humber College’s North Campus in Etobicoke; in Scarborough,

A fight is brewing in Toronto’s suburbs over proposed licensing for rooming houses in parts of Scarborough, North York and North Etobicoke. Rooming houses are illegal there, but are legal if licensed in other parts of Toronto. Most local councillors are expected to fight any move towards licensing, reflecting the views of homeowners. near University of Toronto Scarborough, and across three wards north of Highway 401 and east of Victoria Park Avenue – where “a more permissive zoning environment” could soon be tried. It adds up to a fight for suburban councillors, several of whom, if experience is a guide, will do what they can to drag out the process, hoping the 2018 municipal election wipes the slate clean. This worked before. It kept the city, a generation after amalgamation, from harmonizing rules for rooming houses, which are illegal in Scarborough, North York, East York and North Etobicoke, but legal, if licensed, nearly everywhere else. Vincent Crisanti, an Etobicoke North councillor who’s heard complaints for years about Humber students in rooming houses urinating outdoors and hosting noisy parties believes homeowners in his ward want stiffer enforcement of the rooming house ban, and that licensing some will just encourage others. “I’m going to support my community, advocate for them,” he said. A report to the committee warned against “unreasonable expectations” for enforcing the ban: prosecuting rooming house operators takes six months to over a year; fines range from $150 to $2,500, it said. Crisanti acknowledged the process is too slow, the powers of the city too weak. The province, he said, has to give municipal bylaw officers power to immediately enter a

suspected rooming house, “not just knock on the door and walk away.” While the city suggested North Scarborough is an exception “because of worker or ‘newcomer’ need” for cheaper housing, it says post-secondary students create rooming house demand in the other four areas. Scarborough East Councillor Ron Moeser, responding to years of complaints from the Highland Creek community, arranged for dedicated enforcement staff to shut suspected rooming houses near UTSC, which like other the suburban Toronto campuses has seen enrollment grow far beyond on-campus residence capacity. Charges were laid, but new rooming houses kept appearing. At Tory’s own request, the city will engage universities and colleges, as well as developers, in a separate but related dialogue during 2017 “on solutions to student housing.” UTSC CAO Andrew Arifuzzaman said the campus worked with its neighbours for years on the rooming house problem. “We will support all initiatives that protect our students and our neighbours from housing conditions that fail to meet an acceptable standard,” he added. Shelley Carroll, a Don Valley East councillor whose ward contains Newnham Campus, said the students aren’t going away, and neither are rooming houses. Colleges and universities have to recover costs as they build residences. Students, if they find a cheap-

Three mayors since 2006 have stayed away from legalizing rooming houses, and suburban councillors respond with misinformation and “fear tactics,” Carroll said, suggesting only “real leadership from the mayor’s office” will get licensing through.

Licensed multi-tenant houses, she argued, belong on roads with bus routes, not deep in subdivisions, but creating a legal alternative will help the city successfully prosecute rooming operations which remain illegal. The Advocacy Centre for Tenants Ontario, meanwhile, has already warned Tory’s Executive the city is

taking too long. “Some members of the Committee may take pride in their ability to defer consideration of this matter time and time again,” the group said in a recent letter. “If (City) Council is unable or unwilling to move forward on this file, you may find someone else moving it forward for you.”

‘Tis the season for gift giving, decorations and spreading joy. It’s also a season that shines a light on the haves and have nots. That’s why being considerate during this time of year extends beyond a basic respect for the fact that not everyone celebrates Christmas – the religious way, or the commercialized way. Let’s start with the children. A 2014 report by Colour of Poverty, Children’s Aid Society of Toronto, Social Planning Toronto and Family Service Toronto indicates that out of the 20 largest Canadian cities, Toronto has the highest rates of poverty and child poverty. The “stark inequality” that the report shows exists between children in the city points to the reality that ‘Santa’ won’t be leaving an equal amount of – or even any, in some cases – gifts for everyone. And it has nothing to do with how naughty or nice they’ve been.

Beyond that, many suffer from depression during the holidays. For some, it’s because they don’t have anyone to spend them with. For others, it could be that they have recently lost a job or a loved one. Being conscious of all this is about more than just donating items to a food or toy drive. Although, if you’re able to do so - by all means. It’s about understanding, as you’re making small talk

with colleagues and peers, that not everyone has huge family reunions, dozens of presents or winter getaways to Florida to look forward to. And not everyone will feel like sharing about what they don’t have amid overwhelming conversations and social media highlight reels flaunting what others do have. If you are one of the folks feeling joy this season, be grateful for that. Keep in mind that not everyone, maybe even people closer to you than you think, is that lucky. It may help put things in perspective the next time you’re out shopping and someone cuts in front of you in line, or grabs the last “it” toy off the shelves just as you reached out for it. Taibu’s Ubuntu program for seniors grows in Scarborough Original group at Taibu Community Health Centre changed lives MIKE ADLER madler@insidetoronto.com Agnes Browne was a retiree, “sitting at home and making phone calls to people who didn’t have time to talk,” she says. That was before Browne joined an exercise class at Taibu

Community Health Centre. Now the Malvern woman is chairperson of the Ubuntu Elder Council, and her co-operative “village” for seniors is expanding to cover all of North Scarborough. That’s because Ontario Trillium Foundation, which funded Ubuntu, gave it $618,700 more to start three new “village” groups north of Highway 401. “This is a powerful program,” Scarborough-Guildwood MPP Mitzie Hunter said last Friday at Taibu, which is beside the Malvern Town Centre mall.

Hunter said Ubuntu has changed 2,700 lives for the better, so far. Seniors stopping by the health centre get involved in eight free groups. One teaches very basic computer literacy. There’s also a writing group, a civic engagement group that has travelled to Queen’s Park and Malvern Eats, which serves a sit-down restaurant-style lunch to anyone who wants some. But the group dearest to Browne’s heart, she said, is the Nzuko Circle, which brings

seniors out of their homes for socializing at least once a month. “There are a lot of older seniors that do not come out,” she said. Taibu’s executive director Liben Gebremikael said the program is unique because it’s led entirely by seniors. “They put our staff meeting to shame, they’re so organized,” he said. A second Ubuntu group started at St. Paul’s L’Amoreaux Centre in Agincourt, and the latest grant will see it branch out to Chester Le, near Victoria Park and Finch Avenues, and Alton Towers, near McCowan Road and

Steeles Avenue. Kenny Dayal joined the Taibu group early on, hoping for better health through some exercise. “Plus, it’s a way to socialize with people your own age,” said Dayal, who now chairs a men’s group which discusses worldly affairs. Scarborough-Rouge River MPP Raymond Cho said his area’s seniors deserve Ubuntu. “You built up this community and this country, and it’s time for you to get some respect,” he said. More than 100 people came to a meeting at Sir Wilfrid Laurier Collegiate on Tuesday, Nov. 29, to talk about how that would work, and what programs they’d like to see at the Guild. Consensus so far is programs in the building and park must be accessible to all, and reflect Scarborough’s diversity, while also generating some revenue. Nadira Pattison, Toronto Arts and Culture’s manager of arts services, said people at the meeting want the future art centre “to reflect and honour the legacy” of the Clarks but know it’s 2016: art at the Guild won’t happen the same way. The city closed the Guild Inn, a hotel and restaurant in the park’s main building, in 2001. A year ago, Dynamic Hospitality and Entertainment Group started restoring the old

mansion and expanding it into a $20-million event centre, making a rebirth of art activities at the Guild finally possible. A “cultural precinct” plan for the park in 2007 proposed expanding Building 191 to add a visitor’s centre, café, exhibit room and craft shop, but Jo Ann Pynn, a senior Toronto arts official, said the plan wasn’t reviewed against Guild Park’s many constraints. Decorated in front with bas relief panels from the Globe and Mail’s original building on King Street, the storage building has few windows and can’t expand because it’s in an environmentally sensitive area, but the city wants to add a third floor, she said. Getting approvals for the work could take 18 months, but the art centre could open in 2020, said Pynn. The project will also restore two cabins in the park so they can be used

for arts and other programs. Pynn said the city will install water pipes in the Sculptor’s Cabin, but can’t do the same for the Osterhout Cabin, which is closer to the lakeshore and reputed to be one of Toronto’s oldest buildings. Current plans also don’t call for the city to build new facilities, including washrooms, at the park’s outdoor Greek Theatre, but Pynn said the theatre area’s power supply will be improved. Parking at the Guild, which includes 88 acres of forest and gardens displaying sculptures and fragments of vanished Toronto buildings, is being expanded to 297 spaces. Another meeting about the arts centre is being scheduled for early spring. Interested residents can ask for information or send comments on desired programs to Susan Kohler at skohler@toronto.ca

Bill was born in Montreal and later moved to Toronto with his wife and children where he enjoyed his sales career in the printing and packaging industry. He was a dynamic speaker and helped raise money for the Heart & Stroke Foundation through his inspirational talks. Bill was an avid runner; ran several marathons and enjoyed working out at the Fitness Institute. His favourite pastime was attending his grandchildren’s milestones and activities.
