A Superior Court judge has declared Toronto’s “highly intrusive” ban on shark fins outside the city’s jurisdiction, saying in a decision that the bylaw “lacks a proper municipal purpose” and added no “identifiable benefit” to Toronto’s “environmental well-being.”

Shark advocates and a Scarborough councillor supporting the ban, challenged before it could go into effect Sept. 1, immediately urged an appeal of the decision which came down on Friday, Nov. 30.

The city had argued it has a right to protect its residents from the adverse health effects of consuming sharks, which as top predators can accumulate mercury and other toxins from prey. It also maintained it can pass laws against animal cruelty and that Toronto does not >>>GROUP, page 3

Basement flood claims denied MIKE ADLER madler@insidetoronto.com The City of Toronto has rejected 217 damage claims from homeowners in Scarborough’s Ward 36 whose basements were flooded during the July 15 storm.

Gary Crawford, the local councillor, said it’s disappointing the residents didn’t get any compensation.

“They went through incredible hardships,” he said.

But Crawford said he was satisfied any sort of sewer infrastructure would have been overwhelmed by the severity of the storm.

Environment Canada said parts of Southwest Scarborough received 88 millimetres of rain in two hours on July 15, pushing the storm to a level the city said should occur once in 100 years.

Toronto’s sewers are expected to handle runoff from a 25-year storm, and after talking to Toronto Water staff, Crawford said he’s satisfied

the sewer system in his hard-hit Birch Cliff area, which has some older combined sewers, had been reasonably well-maintained.

Alex Mozo, a spokesperson for the city, confirmed the number of claims in the ward and that all were denied.

Crawford said he wants to look further into residents’ contention that a still-unassumed development at Midland and St. Clair avenues has worsened flooding for homes to the south, though staff said there has been no effect.

At Toronto Council last week, Crawford said he supported water rate increases because they are needed to improve sewers in a list of priority wards to which both Southwest Scarborough wards were added to this year.

Over the coming months, he hopes to find $9.4 million for sewer projects in Ward 36 that “would greatly improve water flow” and reduce flooding risks for the Birch Cliff area, he said.

In his decision, however, Justice James Spence said “there is no air of reality” to claims the fins are unhealthy for human consumption, calling this and Toronto’s argument the current slaughter of sharks could lead to extinctions in 10 to 20 years “matters of great debate.”

The judge also said the bylaw can be expected to have “a detrimental effect upon the business activities of restaurant operators in the Chinese community” and what some in the community see as an important cultural practice.

De Baeremaeker said he’s confident the bylaw will be upheld in an appeal, one he said other municipalities that have passed shark-fin bans have an interest in joining. Toronto has the right to ban products, and experts say eating shark fin soup in Toronto results in a slaughter of sharks in the seas, he argued. “It is a Toronto issue and it is a global issue.”

The councillor also disagreed with Spence’s finding that the bylaw was “highly intrusive”.

Toronto’s budget balancing act W hat must Toronto’s civic leaders accomplish as they shape the 2013 capital and operating budgets for the city?

A number of things – and they form a balancing act between delivery of services and exhibiting fiscal responsibility. our view Budgets are complex documents and when discussions Take time to opened last week, it led to some heated disagreements on the weigh in on floor of an already-polarized city your budget council.

But balance is in order and we offer the following suggestions to help guide the process: • Councillors must continue to engage with their constituents on what are priorities in their communities. This is true whether the issue is sports arena fees, community policing, or support for a neighbourhood festival. Local representation is the very essence of the system that’s in place. Our communities and neighbourhoods are the city’s building blocks. But they are unique and those ward-level exchanges need to be taking place to truly reflect the city’s needs.

• On the council floor there must be acknowledgement and careful consideration of all revenue tools, including property tax. While a sharp eye on expenditures is expected, it’s not realistic to dedicate oneself to one side of the ledger when trying to balance a budget. As impressive a feat as reducing expenditures in last year’s budget was, it’s not a sustainable practice for Toronto council. Tax increases are never popular (the budget currently proposes a modest 1.95 per cent jump) but they are among a limited set of tools available when one searches for solutions for revenue.

• Finally, there must be a sense of direction from the budget. Once approved in January, the budget must demonstrate progress toward getting the city back on a more sustainable footing financially. The days of relying on provincial bailouts are long gone. The previous year’s budget was a positive step forward. This upcoming budget must continue on that path.

Budgets are a balancing act. It’s about identifying priorities and delivering cost-effective services.

Unfortunately, it’s also about understanding that we can’t afford everything we may want in this city – especially if we are unwilling to pay for it.

Next week, public hearings are scheduled on the budget. We encourage you to make it out to Toronto City Hall to offer your input or to contact your local councillor.

To the editor: Re: ‘Council needs to re-set priorities at halfway point,’ Editorial, Nov. 29.

Your editorial is insightful. Council should make an appointment and it should be an experienced councillor who will follow the agenda of Mayor Rob Ford.

He was elected by a good majority of the voters and they deserve to have their wishes honoured.

Spending $7 million on an election should not be considered.

If the left votes for this course, it will be further proof they only care about trying to get back into power and continue with their lack of respect for the city taxpayers.

Going to the sports doctor on not bended knee

fter reluctantly admitting that a lifetime of playing hockey yearround had finally caught up with him, my buddy Mario finally broke down and hobbled in to see a sports doctor last week for a much needed examination.

Alas, I’m afraid the news was not good. For Mario, that is. For me? It couldn’t have worked out better. I got a column out of it.

Doc: “OK, Mario, now be a good boy and hop up on the table with your feet dangling over, will ya?”

Mario: “So, whaddya think, Doc?” Doc: “You call that a hop? My grandmother is in her late 90s and she moves better than that.”

Mario: “You’re pulling my leg, right?”

Doc: “Actually, I haven’t started yet. And I’m going to be pulling it left, too. Now, let’s get this show on the road. How does your knee feel if I twist it like this?”

Doc: “I have been for some time now. I learned it while I was in the East.”

Mario: “When did you go to Japan?”

Doc: “I meant Halifax. I went to a clinic at Dalhousie University two summers ago.”

Mario: “How do I get myself into these things?”

Doc: “I played in a celebrity tennis tournament while I was there.”

Later that morning ...

Doc: “Sidney Crosby’s accountant was my doubles partner.”

Later that afternoon ...

Doc: “We were creamed in the semifinals by Anne Murray and her podiatrist.”

Later that night ...

Doc: “OK. Enough with the schtick. We’ll just rub a little of this herbal ointment on there, tape it with a tensor bandage and now the piece de resistance, we’ll put on this monster brace, roughly the size of the CN Tower. Now, how’s that feel?”

Mario: “Outside of the excruciating pain? Let’s just say I’m in agony and leave it at that.”

Doc: “Wonderful. So what do you say you give the old baby a test drive?”

Mario: “Yeah, right. I can barely move in this gigantic contraption.”

Doc: “You’ll get the hang of it. Everybody does eventually. Now give it a go.”

Mario: “Whew. One lap of the room and I think I need to lie down.”

Doc: “Beautiful. I told you could do it. You’re like an old pro already. Now with that out of the way, be a good lad and why don’t you just scamper back up on the table again – and let’s have a look at your BAD knee.” n Jamie Wayne is a lifelong columnist, who takes writing very seriously.

Boy, 16, facing firearms charges in Danzig shooting A fourth youth now faces multiple charges connected to the Danzig Street mass shooting.

Toronto Police say they arrested a 16-year-old boy Tuesday morning and charged him with threatening death and three firearm offences, including unauthorized possession of a restricted weapon.

Under the Youth Criminal Justice Act, the youth’s name can’t be released.

Two people, 14-yearold Shyanne Charles of Scarborough, and Joshua Yasay of Ajax, 23, were killed July 16 in what police say was a gun fight between members of rival gangs from the Scarborough neighbourhoods of Kingston-Galloway and Malvern during a West Hill street party.

Another 23 people survived with wounds.

Shaquan Mesquito, 18, Nahom Tsegazab, 19, and a boy of 17, who also can’t be

named, were arrested separately last month, and each was charged with murder, attempted murder and multiple counts of aggravated assault in the Danzig Street incident.

The investigation is continuing.

n Armed robbery

Three men wearing disguises and armed with handguns approached a man seated in a vehicle last week near Warden and Eglinton avenues, and one of the men pointed a gun at his head, Toronto police say.

One of the suspects took the vehicle’s keys from the ignition and then allegedly took “a quantity of jewelry, cash and cheques from the trunk of the vehicle” before the trio slashed the front tires and fled westbound in a vehicle waiting on Comstock Road.

The victim, 54, wasn’t injured in the 11:20 a.m. Nov.

28 incident, and apparently offered no description of the robbers.

Another man, 28, was at Eglinton and Midland Avenue at around 8 p.m. on the same day when a man pushed him to the ground and began searching his pockets.

Police say they struggled “and the suspect indicated that he had a weapon” though none was seen.

Three more suspects then approached and took items from the victim before running away.

Si x m e n a p p ro a c h e d another man, 19, at about 9:30 p.m. last Wednesday around the intersection of Finch Avenue and Sandhurst Circle, and police said one suspect threw the victim to the ground and punched him, though no injuries were reported.

Other suspects took items from the victim before the group then headed north towards Sandhurst, police said.

A 46-year-old man has been charged after police seized 25 kilos of cocaine, shown here on display by Toronto police, from a car in Agincourt.

Cocaine seized from car Twenty-five kilos of cocaine was allegedly seized from a vehicle in the Kennedy Road and Bonis Avenue area last Thursday.

The drugs are worth an estimated $2.5 million, police said.

Donald Lee, 46, of no fixed address, has been charged with possession of cocaine for

the purpose of trafficking.

One man was sent to hospital early Monday morning with stab wounds to the neck.

Police said the stabbing

occurred at a Military Trail townhouse complex near Morningside Avenue and Ellesmere Road around 2 a.m. on Dec. 3.

The victim, who is in his 40s, was taken to hospital for treatment of non-life threatening injuries.

No suspects have been arrested.

Lacrosse Day events on Friday at Leacock Collegiate It’s everything lacrosse when the Toronto Rock, the Toronto Stars Minor Lacrosse Association and the City of Toronto host Lacrosse Day tomorrow in Scarborough.

The three groups have partnered to offer five free introductory lacrosse clinics at the Stephen Leacock Community Recreation Centre.

Toronto Rock forward Garrett Billings will lead the players through a series of drills and discuss the

game.

Players between the ages of five and 13 are invited to participate, but registration is mandatory and is limited to 40 children per age group.

dds are that should the time come that council has a choice on what to do about a vacant mayor’s office, they’ll choose to hold a byelection.

Certainly, that’s what councillors who have been asked about it have said.

And certainly Mayor Rob Ford, facing eviction from office, has said he’d be happy to put his name forward in one.

But as the past two years have shown us, anything can happen with this council.

And with a price tag of $7 million, it’s by no means a certainty that a majority of councillors will vote to spend that money on a byelection and not to bolster some cash-starved programs in the 2013 operating budget.

As tempting as saving cash with an appointment might be, councillors should resist.

Even if Mayor Ford’s

Mandate In 2010, Ford was elected with a powerful mandate, from an electorate who in the main were interested in a more conservative approach to municipal government.

They believed Ford when as a long-serving city councillor he said the city government was bloated with what he called gravy, and

they voted for him on the assumption that he would be able to extract that gravy without meaningfully affecting services.

Particularly in Scarborough, they accepted Ford’s assurance that he would be able to build a subway using private sector money.

They understood that his slogan Respect for Taxpayers meant that when elected mayor, he would show respect for all taxpayers.

What Toronto got was something very different.

Mayor Ford appears to have been wrong about the gravy; there’s not very much at all as it turns out.

Torontonians voted, then, for an agenda that turned out to be chimeric.

one from the left that repudiates it, would amount to a rejection of the popular will of Toronto voters.

Health of city A byelection, as costly as it is, is essential for the short and long-term health of this city.

If Torontonians want to continue with some measure of the Fords’ conservative agenda at city hall as they supported, they ought to have the opportunity to say so.

Donation of $1 million a thank you to The Scarborough Hospital A retired ophthalmologist and his wife have given $1 million to The Scarborough Hospital, one of the largest gifts the institution has ever received Dr. Harold Stein performed Canada’s first cornea transplant

at the hospital, and was its chief ophthalmologist for 35 years.

Retired now, he said he wanted to thank TSH for being good to him.

“The Scarborough Hospital backed me up on all sorts of things, so I thought I should be good back.

Stein’s relationship with TSH goes back to the 1950s, before what is now the TSH General campus was built and its location at McCowan Road and Lawrence Avenue, he recalled, “really was the boonies.”

Today, his son Dr. Raymond Stein is the hospital’s chief of ophthalmology.

REGISTRATION AREA RE-NAMED The patient registration area at the General was re-named in honour of Dr. Harold and Anne Stein last month in recognition of their gift, a legacy pledge which the hospital said will be held in trust for future needs.

Hospital officials are hoping the Steins’ generosity moves others to donate.

The hospital is raising funds to move its crowded facilities for dialysis and chronic kidney disease treatment into a community hub to be built in Scarborough’s Bridlewood area.

“It’s possible, for whatever reason, the owner couldn’t give her the veterinary care she needed,” Leiher said, adding that’s a reason many dogs wind up in shelters. “It’s not necessarily wilful abuse.”

Twiggy is now on medication she will probably always need. “She was starving – it wasn’t necessarily because she wasn’t being fed,” said Leiher, who thinks the dog may partly be of an Australian breed such as a heeler.

Twiggy needed an operation to correct the injuries to her leg, which could have been brought on by her lack of muscle mass. Over

time, though, she got better.

The city said her story shows why Animal Services relies so much on donations and people who want to foster dogs. “It helps them get better quicker,” said Leiher.

Twiggy’s foster family will likely adopt her.

The fact that she is back to being a healthy, loving dog is an inspiring story, said Glenn De Baeremaeker, a Scarborough councillor.

“Obviously some very compassionate people took that dog in.”

De Baeremaeker thought the dog had been abandoned.

On Wednesday, he said an owner who let Twiggy reach this state would be guilty of cruelty. “There’s just no excuse to do this to an animal,” he said.

he Scarborough Theatre Guild audience was given a special treat on the opening night of the Guild’s latest show, No Traveller Returns, when the author of the show, Maureen Jennings, was there to

Set in 1895, in Huntsville, Ont., at the inn owned by the Ryan family, it’s days before Christmas and the guests are stuck there because of heavy snow.

(Rob Pristas), husband to Margaret (Julie Jarrett) and father to Sarah (Sophie Schade), as he’s a drunkard with a sizeable and abusive mean streak. But what’s great about this show is that it isn’t obvious who the murderer is, keeping audiences paying attention, and guessing, until the end.

Besides the Ryan family, there are four other guests at the inn. Jack Kipp (Alex Bortoluzzi), a local lumberjack, The Great Prospero (Jeremy Henson), a travelling illusionist, local seamstress Alice Woodstock (Carolyn Williamson) and John Wilson (Sandy Stephens) who it turns out is actually detective William Murdoch.

He’s in town on another case and instead discovers a body. Murdoch immediately starts questioning everyone, and piecing together what happened. What makes it more difficult is everyone has secrets and the dynamic between the suspects is not what it seems, making this case a tough one to crack.

And just when you think the entire plot and possible motives are established, the story takes a turn and yet another, as more information is added to the mix, including the truth about certain relationships and the true motives for some guests being there.

This means just when you think you know who did it, you’re left having to reconsider.

This cast plays both victims and potential murderers believably. The duality of these characters adds intrigue to the show, and

they play both sides well.

Schade as Sarah is sweet, yet angry enough to think she may have done it, same with Jarrett as Margaret, as she convincingly plays a character older than she is, and with the right amount of anger and conviction.

Both Bortoluzzi and Henson as Prospero share a hidden past and are not who they seem, and portray their roles fantastically, and even innocent-looking Alice, the character you love to hate, along with Ben played convincingly by Pristas, has her secrets and isn’t what she seems.

Stephens plays Murdoch with poise and assuredness, and is enjoyable to watch as he unravels the mystery.

What I liked about this murder mystery is it has a calm to it, though there is a tension-filled atmosphere, without the frenzy and dramatic characters that shows of this genre usually have.

The set is cozy and beautifully done, depicting the common room of the inn where the action takes place. With red velvet curtains, rustic wood furniture and a realistic looking stone fireplace, it adds well to the eerie atmosphere of knowing everyone is stuck in the middle of nowhere with a murderer. A well-played mystery that’s ideal for those who are fans of the genre.

Go fare hikes get Metrolinx approval RAHUL GUPTA rgupta@insidetoront.com As expected, a GO Transit fare hike was approved by the Metrolinx board at a meeting Wednesday morning, which will see fares rise by an average of 31 cents per ride.

The fare hike is scheduled to take effect Feb. 1.

The increase approved by the board will result in fares rising by approximately five per cent with longer trips costing more.

The increase comes in three tiers: fares under $5.80 will cost 35 cents more; there will be a 45 cent rise for rides costing between $5.81 and $7.35; trips currently costing more than $7.35 will receive an increase of 55 cents.

Metrolinx chief executive officer Bruce McCuaig said fare increases are necessary for improving service and recommended similar increases every year.

“By doing it on an annual basis you can avoid building up to a larger fare increase,” McCuaig told reporters following the two hour meeting at Metrolinx’s downtown offices.

“We think it’s the best practice to improve services and identify costs.”

He said Metrolinx will net around $18-million from the revenue raise this year if the level of subsidy the transit planning agency receives from the provincial government remains the same.

Future fare hikes would be determined by existing levels of service, fare revenue, government subsidy and monies generated independent of the fare box.

T h e p r i c e d i f f e re n c e between paper tickets and fares paid via Presto will also increase, said Metrolinx chief financial officer Robert Siddall, to encourage more migration to the re-fillable card that approximately 400,000 riders and the majority of GO customers have already adopted.

Siddall said the cost for using Presto will also rise, although cash fares will still be higher due to loyalty discounts provided by GO. Riders who “tap on” using Presto will pay nearly nine per cent less for the same trip paid in cash.

The regular board meet-

ing was Metrolinx’s last of the year, and board members also heard presentations on various projects under construction including the Union Pearson Express, which will become the city’s first rapid transit link to the airport when it’s completed in 2015.

The board watched a video where Torontonians extolled the benefits of having a fixed link that will provide 25 minute trips between Pearson International Airport and Union Station.

The project has proven unpopular for some west-end residents groups including the Clean Train Coalition for the decision to run diesel trains along the link before eventually converting the line to environmentally friendlier electric.

But, air rail link president Kathy Haley said 88 per cent of Torontonians support the idea of rapid transit connection from downtown to the airport.

She said station designs for the new service have been completed with construction at Pearson’s Terminal One stop scheduled to begin in spring of next year.

Ford made the statement minutes after Justice Gladys Pardu agreed to grant a stay on the sentence by Justice Charles Hackland, that would have seen Ford thrown out of office this coming Monday.

Hackland had found Ford guilty of violating the Municipal Conflict of Interest Act (MCIA) because he voted on a report from the integrity commissioner recommending he be made to return $3,150 in donations

to his personal football charity.

The act prevents politicians from speaking or voting on matters in which they have a financial interest.

The minimum sentence available to a judge in the matter of a guilty plea is to declare the seat vacant.

Should that happen, council would have two months to decide whether to appoint a successor or hold a byelection.

E

dwin Sheon remembers it all too well.

Fresh out of high school, not exactly sure of his career path, the Scarborough native wasn’t enjoying himself and chose to take some time off from studies at Toronto’s George Brown College.

Leaving his post-secondary education in limbo, it didn’t take Sheon long to realize there was a huge gap in his life that needed closure.

“I wasn’t happy, just not doing what I wanted,” said Sheon. “I remember my parents were concerned that I seemed to forget about being focused on a career and future. I just wanted to do something that, when I look back, I could be proud of my work.”

Now 22 years old, Sheon admitted he has found his niche.

Returning to the classroom to complete his education, Sheon is not only

studying building renovation technology, but – talented with his hands – the 5-foot-10 athlete is also one of the top college volleyball players in Ontario.

“Talking with people, I saw the big picture – I needed my education,” he said.

While Sheon said he always has an eager eye on improving skills, and would like to be just like popular Canadian contractor Mike Holmes, he is also the backbone of the Huskies men’s volleyball team that competes in the Ontario Colleges Athletic Association.

The Huskies are off to a solid start as one of the top teams and Sheon, a left-side hitter and team captain, is having an all-star season.

It might even be a personal best.

Back in October, opening game of the season, Sheon sent a message early that he was ready for the competition. In a three-set sweep of Loyalist College of Belleville, Sheon was the best player on the court and, watching

him play, his passion for the sport is evident.

But volleyball success also didn’t happen overnight.

“I’m now more aware of my surroundings, more mature and focused,” said Sheon, who played volleyball at Our Lady of Grace elementary school in Scarborough before shuffling off to Brebeuf College in North York.

In his classes, Sheon is initially constructing and also demolishing for academic grades. He’s putting together sheds, working on roofs and understanding how to drywall rooms.

On the volleyball court, he wears “No. 1” on his jersey for a reason – he’s that good on his team.

“I just strive to be the best on my team, but also looking to help my teammates, and that means more to me than statistics,” he said. “It’s also patience and knowing when to do the right thing.

It doesn’t always work the way you want it to be, so you look for opportunities. Consistency is a key in

sports and in life.”

According to OCAA official statistics, Sheon hasn’t made an error in eight games. That bodes well for him and his teammates hoping to win a league championship for the first time since 1969.

“He’s steady, consistent, very good – our best player and the team leader,” said Josh Nichol, head coach of the George Brown squad.

“Having him on the team is like having another coach.”

Nichol said Sheon had similarities to volleyball player Jeff Chung, a fourtime all-Canadian who played pro in Holland and Switzerland as well as helped coach Canada’s under-20 National Team in 2006.

Dealing with accolades can be a challenge for any athlete – even Sheon.

“It’s all nice, but I understand that to win, we have to play as a unit,” he said.

“To be successful in life, you learn from things like that – and then keep getting better.”

For the fourth time in its history, North Metro took top honours at the Sweet Adeline International Chorus Competition, which took place in Denver, Colorado, beating out the likes of Texas, California plus Sweden, Australia and a host of other competitors representing the very best competitive chorus groups in the world.

“We’re still a bit euphoric from the win,” said Towner, a member of the 140-strong female chorus. “I think we have a new confidence that we haven’t had.”

For the two-round competition, dubbed the Olympics of singing, the four-part a capella chorus comprised of bass, baritones, leads and tenors performed piano numbers, current pop hits and, in full costume, a 15-minute “package” of songs about toy soldiers.

“We went in very prepared for this one,” said Towner, who has competed in chorus competitions since 1977. “We don’t just stand and sing, we’re performing, we’re dancing.”

The Denver win marks the first time the chorus has taken the championship since 2003. Prior to that, North Metro won in 2000 and 1997 and it remains the only competitive chorus outside of North America to have ever won the Sweet Adeline competition, which

just celebrated its 66th year of existence.

But for Towner, this latest victory is the sweetest of all.

“For those of us who have been at it for a long time we were starting to wonder if we would ever win again,” she said.

To prepare for the competition the group, which ranges in age from 25 to 83, rehearsed weekly at East York’s St. Clement of Ohrid Macedonian Orthodox Church at 76 Overlea Blvd. under the watchful eyes of longtime director June Dale and choreographer Erin Howden, Dale’s daughter, whom Towner credited with coming up the right mix of song and dance for the competition.

“She has these visions. I don’t know how she sleeps at night,” said Towner.

Another of Dale’s daughters, Lynn Reisch, handles costumes for the chorus and Towner herself has three daughters who are members.

North Metro, which has performed at Roy Thomson Hall, the Mississauga Living Arts Centre and Hamilton Place among other venues, is taking a break until the New Year.

Then, it’s back to weekly rehearsals and preparation for the next Sweet Adeline Competition scheduled for November 2013 in Honolulu, Hawaii.

Towner said she and the rest of the women in the chorus will be ready to defend their title.

“People were saying after our win that North Metro’s back,” she said. “We were thinking we really weren’t very far away.”
