ESTATE PLANNING CONTRACT OR REPRESENTATIVE

As an estate planning attorney since 2002, I often get asked one of these three questions: (1) Do I even need a will? (2) Can I get just a basic will? (3) Do I need a trust? The professional response to each question: “It depends.” The sarcastic response to each question: “Do you have an opinion?” Sarcasm aside, if you have an opinion on what happens to your stuff, then you need to design a plan.

Testament, then: local statutes dictate where to transfer your property, someone will need to become your representative; the probate court oversees your “administrator”. If you die with a LWT, then you set the plan for distributing your assets, and your representative is called an “executor”. If you have less than $5M in assets, if you just want to give assets to your kids, and if you have no concerns about your LWT being a public document filed with the Court, then you may be a candidate for a Basic Will.

The true beginning point for an estate plan is to develop an understanding of how funds, assets, or property get Do I need a trust? No, I didn’t forget this transferred – by contract or by a representative. question. An estate planning Trust is nothing more When talking in estate planning parlance, the word than a contract. The Trust will continue to exist after “property” does not only / singly include real estate you die, and the Trust will indicate where to transfer or your home. Property, in the estate planning property. Sometimes, a LWT includes various types of context, means everything that you own – your what are called Springing Trusts: a tax shelter Trust; jewelry, your home, your car, your checking account, a spendthrift protection Trust; a minor’s Trust where your investment account, your life insurance policy, you determine the age for kids to inherit; a special etc… If you have an opinion on what happens needs Trust. Sometimes you may need a Living to that stuff, you can transfer that property to Trust drafted outside of a LWT: Do you want a private distribution plan? Do you have property in someone else either by contract or by a representative. different states that should be owned by the Trust? Do When you transfer property by contract, that you want to protect against a gold-‐digger “comforting” property transfer is not likely governed by a probate your widowed spouse? Do you want to reduce judge. Take a life insurance policy for example. When your assets while you are alive, but your kids are not you purchase a life insurance policy, it’s a contract. Your ready for that kind of financial windfall? Do you need part is to pay the premiums; the insurer’s part is to substantial tax avoidance? pay the benefit to your designated beneficiary. No court needed. The same is generally true for So there are your beginning points for estate planning: your various financial accounts (Bank of America, (1) Do I have an opinion about what happens to my Schwabb, etc…). You have a contract with the financial stuff? (2) Can I control where it goes by contract? (3) If I need a representative, do institution, and you decide where those funds go after I want to select that person? you die via Joint Ownership of the account – or – via the (4) Do I have needs greater Beneficiary Designation / Payable on Death selections. than a Basic Will? Often, a contract does not indicate where to transfer the property, for example: home, car, jewelry, Kurt R. CHATEAU ELAN RESIDENTS

SUNDAY, NOVEMBER 3, 2019 11AM - 3PM WOODLANDS PAVILION The Chateau Elan Social Committee hosted our very first vendor fair in January 2019 and it was a huge success and many vendors have asked us to host another one this Fall. If you own a business and would like to participate in the Vendor Fair the cost is $150.00 and all money raised goes toward the budget to sponsor different fun events in the neighborhood. Please contact Karen Tatro at karenftatro@gmail.com or 706-362-3309 to reserve your space or with any questions...Space is limited. The vendor fair is not only an opportunity to meet vendors that may be helpful for you but also a chance to meet and mingle with your neighbors and find out about the clubs or events that are available in the neighborhood.
