Restaurant owner imprisoned A

co-owner of the Masala Restaurant chain has been jailed for hiding millions of dollars in cash sales and laundering large amounts of it. Rupinder Singh Chahil – who resided in Howick - was sentenced today at the Auckland High Court to three years and two months in prison, plus a $50,000 fine, on nine money laundering charges and 34 tax evasion charges. A former accountant, Vijay Kumar Gupta, was also sentenced on Friday to 10 months home detention and ordered to pay $5000 in reparations. Inland Revenue spokesman Tony Morris says the evasion wasn’t particularly sophisticated but was carried out on a massive scale. “Chahil provided 114 individual GST returns to Inland Revenue on behalf of the Masala Related Companies, which together concealed more than $6.5 million of mainly cash sales,” Tony Morris says. “The tax offending was linked inescapably to the money laundering but the money laundering was far more complex, involving multiple bank accounts here and overseas. “Chahil and another co-

owner, Joti Jain, collected cash from the Masala Restaurants, and delivered the money to Gupta to be laundered. “Gupta controlled the deposit of large amounts of cash into bank accounts, transferred the cash to overseas banks, purchased large amounts of foreign currency, and then brought the money back to New Zealand.” The tax offending spanned six years, from April 2008 to April 2014 through regular, two-monthly false returns to IR. The money laundering took place over 14 months through a series of transactions from 15 February 2012 to April 2013. “Tax evasion hurts everyone because taxes are what fund essential items like hospitals, schools, and national parks. On a more basic level, tax evasion allows unscrupulous people to get a leg up over their competitors,” Tony Morris says. “Hiding their cash sales, and laundering the proceeds of their offending, meant the Masala Restaurants were inevitably able to undercut other restaurants. “The tax evasion and money laundering were uncovered at a tremendous public cost. It required a substantial effort to detect, uncover and prosecute

this case. “The investigation took longer than it should have because Chahil had false responses prepared to deliberately frustrate the enquiries. IR’s investigation into the money laundering meant contacting tax authorities in Australia and India where he and Gupta tried to hide their criminal proceeds. “The offending itself caused significant financial loss to society. The money laundering was designed to hide the tax evasion and allow Chahil to enjoy the fruits of his crime at society’s expense,” Tony Morris says. Joti Jain, who was a former co-owner of the companies running the Masala chain, pleaded guilty to 21 charges of tax evasion and was sentenced to nine months home detention in 2018. Gupta pleaded guilty to nine charges of money laundering along with Chahil who also pleaded guilty to 34 charges of tax evasion in October. Chahil previously had imposed and served a sentence of Home Detention for charges relating to providing false or misleading information to Immigration New Zealand.

Friday night fight: Stabbing in Shelly Park ■■BY JIM BIRCHALL Police are investigating a stabbing incident at a reserve on Cyclades Place in Shelly Park on Friday night. Local residents who did not want to be named reported a “car speeding down the road” at around 10pm on February 28. This was followed by “yelling and screaming...and a person yelling for help.” An eyewitness also stated that a blood-stained t-shirt was “stashed in the wheel well of the car”. The t-shirt was believed to be recovered by an eyewitness on Sunday morning and subsequently turned over to Police. In a statement, Detective

Sergeant James Gemmell of Counties Manukau East police said: “At around 10 pm, two groups got into an altercation in the reserve. Local man jailed for child abuse imagery A

n east Auckland man has sentenced to four years and nine months in prison for knowingly possessing and distributing child sexual abuse imagery, and blackmail. 30-year-old Earl Gary Chatterton was sentenced at Manukau District Court on Wednesday February 25, to four years and nine months in prison. The sentence is the result of a joint investigation by NZ Police and the Department of Internal Affairs which commenced in August 2018. Mr Chatterton pled guilty to 26 charges involving the distribu-

tion and possession of child sexual abuse and exploitation imagery, and one charge of blackmail. The joint investigation revealed Mr Chatterton distributed, copied and was in possession of over 80 objectionable image files and attempted to blackmail several people for financial gain. Detective Senior Sergeant Eddie Sutherland says: “The sentencing shows that police along with our partners will not tolerate this abhorrent offending. “Police, DIA and Customs have a very close working relationship. The strength of the three agen-

cies working collaboratively means we are more effective when it comes to identifying and bringing to justice those who seek to exploit defenceless and vulnerable children and adults within our community,” says detective Sutherland. Tim Houston, Censorship manager, Internal Affairs, says “We work closely with NZ Police and Customs to ensure these criminals are caught and brought to justice. “We proactively share knowledge and insight to identify these individuals who offend against our most vulnerable members of society,” says Mr Houston.

mbattled local MP Jami-Lee Ross has vowed to stand again for the Botany electorate in September’s general election. Ross was approached by the Times for comment on whether he would withdraw from the election race in light of him being charged by the Serious fraud Office, along with three others, for their part in the National Party donations scandal. Ross said: “Re: elections, nothing has changed.” He was hamstrung

from making further comment about the SFO charges by sub judice laws. Ross is a former National Party MP for Botany, but now is an independent MP after resigning from the party in October 2018. He appeared in Auckland District Court on Tuesday, February 25 to answer charges brought by the Serious Fraud Office in relation to the National Party donations impropriety. Yikun Zhang (48), Shijia (Colin) Zheng (34) and Jami-Lee Matenga Ross (34) each face two charges of

‘Obtaining by deception’. Hengjia (Joe) Zheng (34) faces one charge of ‘Obtaining by deception’ under the Crimes Act and another of ‘Providing false or misleading information’ under the Serious Fraud Office Act. The charges relate to donations paid to the National Party. He, along with his co-defendants have pleaded not guilty to the SFO charges. He was ordered to surrender his passport and was remanded on bail till June 10, when he must re-appear. He must reside at his home address.

The government’s social housing strategy

The apparent strategy adopted by this government to buy up homes off the open market in order to compensate for its lack of follow through on KiwiBuild is only going to make things worse in the housing market, not better. The disclosure last year that Housing New Zealand, now known as Kainga Ora, had purchased five homes on Nelson Street for nearly $1 million each shined a light on what this government has turned to following the failure of their flagship housing policy. The issue with this is that buying homes off the open market to inflate our state housing portfolio is only adding to the problem, since it’s not actually increasing the country’s housing stock. It means the government is competing with first home buyers, who have worked hard and saved for years in order to get their foot in the door only to lose out to the large state-funded pockets of Kainga Ora. It’s also a poor use of taxpayer money, particularly in the case of Nelson Street. For what the government paid, it could have built twice as many homes itself and housed twice as many families in need. The government says it is trying to accomplish two main goals when it comes to housing – increasing the stock of affordable homes in New Zealand, particularly in Auckland, and ensuring there are enough so that everyone has a sheltered place to sleep at night.

But this strategy ensures their failure at both of those objectives. It does not add to the housing stock, and it is not helping those most in need. Rather than buying million-dollar state homes off the open market the government should follow through on the promises it made. While I fundamentally disagree with KiwiBuild, building new homes is what’s required right now. If elected into government later this year, National will scrap the Resource Management Act and replace it with something that actually makes sense. The biggest impediment to the construction of affordable homes at present is the exorbitant costs placed upon developers and builders through the consents process, so we will simplify things to make it easier to build what’s needed. I am hosting a public meeting on social housing with National’s Spokesperson on the subject Simon O’Connor, on Tuesday 24 March at the Howick Bowling Club, 33 Selwyn Street, Howick, at 7:00pm. uckland Transport is promising extra capacity on buses and trains for the busiest time of the year as Aucklanders head back to work and study. Last year public transport patronage totalled 103.2 million passenger boardings, that’s annual growth of eight per cent. Auckland Mayor Phil Goff says, “With the annual surge in demand for public transport as students return to university it’s critical that Auckland Transport provides extra capacity on the network. “I’m pleased to see that Auckland Transport has added an extra 5000 seats on buses at peak times and is rolling out extra train cars to accommodate demand.” Group Manager Metro Services Stacey van der Putten says AT is in a good position to cope with the rise in demand. “We have put the extra seats on the 15 busiest routes services including on the number 70 bus which runs from Botany to Britomart. The first of our new trains have arrived from Spain and we are rolling those out with more six car trains during the busy periods. We will have 1200 extra seats in the morning peak and the same in the afternoon.” Auckland Transport has a few additional buses to help out over

record number of people turned out for the Auckland Brit & Euro Classic Car at Lloyd Elsmore Park on Sunday. The weather was kind too – although there was cloud cover it was extremely warm with some respite in the afternoon when the wind picked up. Rev Dr Richard Waugh, chairman of the Brit & Euro Classic Car Show Committee, said: ‘Our fifth annual classic car show was a resounding success with the most car and motorcycle registrations we’ve had (1140) and a record public attendance of more than 10,000 people. “The free community event is only possible due to much voluntary effort and the sponsorship of Howick Local Board, Protecta Insurance and Times Media. “We are already underway with our evaluation work to ensure the 2021 event is just as memorable for east Auckland.”

The weather was fantastic – if not a bit too hot – on Sunday, the first day of autumn. Thousands came through the park to see almost 1200 classic cars and motorbikes on show.

Rotary Fun Walk and Run all set to go Dust off your running shoes and break out the – possibly green – active wear because the Howick Rotary Fun Walk and Run is back for another year! It started with only a couple of hundred people in 2005 – and with 2019 being a record year in terms of participation – this year more than 700 people are expected to take to the streets on Sunday March 15. Howick Rotary organising committee member Colin Monk says the event is a great way to get the whole family involved in keeping fit and healthy. There will be three routes on offer. The tracks cater to all levels of fitness – walkers or runners can choose from a 5.9km primary course, a 6.9km intermediate course, or an 8.1km extended course, with five water stations available on the way. Rotarian Monk says the event creates a friendly rivalry between local primary and intermediate schools that compete to be crowned the winning school – and this year, with more schools entered than ever, that competition is sure to increase. With spot prizes on offer (the best selection ever, says Mr Monk) and a delicious sausage sizzle on comple-

tion, there’ll be no shortage of motivation to finish. Each participating child will also receive a medal at the finish line. All courses start and finish at Stockade Hill, so participants can soak up some post-run (and walk) views. Sponsors this year include My Ride, Mitre 10 Mega Botany, Dilmah Tea, Howick Local Board, The Athlete’s Foot and many others. Mr Monk also acknowledged the support provided by the Howick Local Board, as part of their keep healthy initiatives. The board provide funds to assist in the running costs. All proceeds go to the Howick Coastguard, and the Rotary Club of Howick covers all the costs associated with running the event. Last year The Rotary Club of Howick donated $9000 to Coastguard. ervous on her first day at school, Tracy Leader anxiously announced, “Please don’t just stare at me but come and shake my hand.” The next thing she knew was every child in the school hall was shaking her hand and happily introducing themselves to the new principal of Anchorage Park School. Now the newly anointed principal’s goal is to get to know every child’s name. And from the looks of it she is doing pretty well. Meeting up with the little ones of Anchorage Park Kindergarten that are on their weekly visit to the primary school as part of an orientation programme, Leader knows each child by name. “The transition of the kids is seamless as they come and spend some time with us once a week. Their school life doesn’t start at five years of age but from early childhood,” she says. A former deputy principal of Pigeon Mountain School, Leader says that the transition from a big primary school to a more intimate one is something she is very proud of. “When you walk around the school you realise how special it is. This small country school in the city that is tucked away in this pocket is so safe and secure. It has amazing facilities. The play area, the school grounds and we even have a wetland – our school

is environmentally sustainable,” she says with pride. “Some of our classrooms overlook an estuary with breathtaking views. But what our kids love most is our very own swimming pool. Children get to swim every day.” Showing off the reception area of the school originally built in 1966, she says that when she first walked in the school she asked the staff if the area had been newly refurbished and was surprised to find that the entire school is in pristine condition. Now her aim is to ensure that the roll is healthy. “We have no enrolment zone so all are welcome.” Leader is also excited about growing the Enviroschool from

bronze to silver and focus on the wellbeing of every child. The commitment of the teachers is huge, she says. “There is no one sitting in the staff room unlike big schools and during lunch time we have so many clubs including the kapa haka, card club, Stem group, sports club, enviro gardening, swim club and art extension classes to name a few. Hot rodding is more of a culture, as well as a description of a vehicle type, and the definition varies from owner to owner. manufactured prior to 1949”. Steve Keys, who has been a member of Southside Streeters for over 40 years, says that the club is a hobby group of hot rodders and classic car enthusiasts. It is a community-based, family-oriented club that meets once a month at the club rooms behind the Howick Leisure Centre in Pakuranga. At these meetings, the members discuss their common interest and passion for the vehicles and the hobby, and offer support and advice to those members who are currently building or restoring their cars. The club has a steady member-

ship number of 50, with second generation family members now also enthusiastic hot rodders and full members of Southside Streeters. “Our club is supporting the Howick Business Association and will be displaying around 15 hot rods and classic cars at the Howick Village HOP event,” says Keys, who is proud of the fact that Southside Streeters assist the local community in any way it can. A recent example is a car show, put on by the club at the Howick Leisure Centre, which benefited St John with $5000 being donated to the charity.

On a sultry night at the end of summer, I went along to my first experience of a production at Howick Little Theatre. In a New Zealand premiere, Stag and Doe showcases the Canadian tradition of partners holding a fundraiser to set themselves up financially for the start their married lives. A couple named Bonnie and Brad have a Stag and Doe planned, but run into issues with a married couple named Mandy and Rob who are at a loose end for a venue after their wedding reception tent blows down. They agree to share the local hall, but both couples are at each other’s throats, the catering staff are in jail, and the reception subsequently is in disarray. Nasty ‘Bridezilla’ Mandy, (played by the impressive Courtney Louise) is on the warpath after a few too many wines, and the fact her fiancé Rob has shifted his focus to Bonnie’s

best friend, Dee, who just so happens to be his ex that he left standing at the altar some years previously. The cast is made up of solid performers whose range extends to cross the comedy/drama divide. Tony Rahme who plays an embattled caterer, is a genuine scene-stealer with his comedic zeal. Gentle comedy goes hand-inglove with some touching moments, as the traditions of small town Canada collide with issues such as solo parenting, financial worries, and dealing with past heartbreak. Stag & Doe has a light-hearted, genuine feel that doesn’t impose itself on the audience-nor take itself too seriously, making it the perfect accompaniment to a night out on the eastside. Cause of the accident was an offending sign In a car accident on Thursday February 13, at the intersection of Laings Road and Bucklands Beach Road, I was involved in a collision with a 4-wheel drive utility when I attempted to cross the road to head home following my regular swim. After checking that the road was clear I pulled out to cross Bucklands Beach Road, and was astounded to hear a screeching of brakes coming from my right, and had no chance of my BMW avoiding the oncoming vehicle. The result was my car was so badly damaged it was written off. The cause of the accident was an offending sign on the island in the middle of the intersection. For vehicles coming to the beach, the sign is at ground level and shows two arrows, for going left to the beach, or straight ahead along Bucklands Beach Road. Heading home, and waiting to cross the road from Laings Road, the view from my BMW saloon, which is a fairly low to the ground vehicle, was completely blocked, as many people have experienced since the junction was modified a few months ago. The original sign was on a pole about two metres high, and was

not a problem. The replacement sign however was a different story. Vehicles coming along the main road were obscured from view when they were behind the sign, and in addition, the colour of the back of the sign is dark grey, as are the merging roads, and they just blend together. Even a vehicle as large as a utility momentarily disappears from view completely. My insurer, the AA, had no hesitation in accepting the claim, it was paid out within 36 hours. That was the good news. The bad news was that I suffered from shock, and banged my head and shoulder that became very stiff over the next few days. I was unable to swim, and in addition, I was without a vehicle, and resented the loss of my BMW, which I cherished, because of a signpost! I had to hire a car and spend the whole weekend looking for

a new one. I was annoyed because the road signs are there to ‘help prevent’ accidents, when this ridiculous lowly placed sign obscured my view, momentarily admitted, but enough to write my car off. No sign should do that. I cannot understand how the council could place a sign that obscures the driver’s view. The one saving grace was the beamer had a high safety factor, and even the tow yard manager was surprised at the level of damage, saying it had to be a 4-wheel drive as no normal car could inflict damage like that to a beamer. I have been to the council about the sign, which is now being attended to, and also the fact I suffered injury, trauma, believing for one short moment that my time was up! (water tanks running dry in rural areas) and now realise that although the Auckland Council spouts water conservation, you should see their property Auckland Council/Auckland Transport-owned commercial property at 7 Reeves Rd, Pakuranga. For weeks now the water has run out of the ground and into the stormwater and has done so off and on for years with a few attempts by WaterCare to stop it. They have been told on more than one occasion. Added to this, since the property became council-owned, it has been a maintenance disgrace. Banks need looking into

The New Zealand banking industry should have been subject to an intensive, intrusive inquiry immediately after the Australian Government’s inquiry. NZ citizens are now paying the price for the lack of urgency. Now becoming apparent, NZ citizens are having their accounts closed (while out of NZ on holiday) without any ethical professional explanations apart from saving the banks money. Further, the procedures, reasons, justifications for closing individual and business profession accounts is not disclosed adequately. Basically it is intended to save the banks money by reducing or capping employee numbers and eliminating services. Small private or business customers are being targeted. There is also considerable and grow-

ing evidence that the banks are practicing what can only be interpreted as selective discrimination by closing the accounts of individual customers, businesses, enterprises which have a history of contact with the African scams con fraud over the past 10 or more years yet tens of thousands of Australia, New Zealand, Pacific Islands – world citizens – were exposed. Under normal circumstances there is the opportunity to refer the matter to the NZ Banking Ombudsman but how much support will the average NZ citizen get given that the office of the Banking Ombudsman will, or already is, overwhelmed and has little effect especially for private citizens. REINZ disappointed industry feedback ignored in RTA Bill T

he Real Estate Institute of New Zealand (REINZ) is disappointed that the Government has gone ahead with its proposals to end the 90 day no cause notice and to convert fixed term-tenancy agreements to periodic tenancies, despite significant feedback from different areas of the property industry that this could further exacerbate the rental shortage with rental property owners leaving the market. Bindi Norwell, chief executive at REINZ says: “Since the Minister made the initial announcement back in November last year, a number of key players in the property sector have made it clear that there are concerns the proposals could have adverse effects on the rental property market should the 90-day no cause notice cease to exist. “Our concerns centre around the fact that should the proposals go ahead; rental property owners will have limited abilities to remove tenants who are causing problems in their rental properties or causing trouble with neighbours. Rental property owners have already had to contend with a raft of legislative changes over the last few years designed to bring the balance more in favour of tenants, but it’s important to get the balance right between protecting the rights of tenants with the rights of landlords in order to look after both sides of the equation. If this change goes ahead,

Under the proposals, tenants will have up until 28 days before the end of a fixed-term lease to let an owner know they are not going to renew their fixed term agreement. “If fixed term tenancies automatically convert to periodic tenancies, this will significantly affect areas that have strong student populations such as Christchurch, Hamilton, Auckland, Wellington and Dunedin,” points out Norwell. “Under the proposal, students could let their tenancy rollover to a periodic contract throughout the

Six of those that have come via this season’s development program, and they have 11 referee’s that have represented PC touch, Counties and NZ in overseas events and World cups. Age is no barrier to getting involved as young Kurt Harrison showed. Kurt was one of our first young men to join the development program. Kurt started refereeing age just 14 and in his first year went from refereeing U12 games to controlling the A Grade final. Kurt has progressed through the programme to becoming PC Touch’s only Level 4 black badge the highest rank in NZ and the world. Kurt went on to represent PC touch at the Youth World Cup in Malaysia in the 2018 season. This season, a young 11-year-old referee has taken up refereeing, and will hope to emulate Kurt. n the media this week was the report rugby league star Kayln Ponga is looking to be the next top athlete to make the code switch to union from league, in order to wear the All Black jersey. Australian born, but eligible for New Zealand via his Maori heritage, Ponga is off-contract with the Newcastle Knights this November. The Knights are clamouring to retain his signature and are believed to have offering a fouryear contract upgrade worth a whopping $4.5 million. The contract also comes with a ‘player option’ for 2023, effectively a get-out clause freeing up Ponga to chase his All Black’s dream (just in time for the World Cup in France). This comes on the heels of remarks from Ardie Savea concerning a switch to the ‘foreign’ code. Whether he was serious about his ambitions or the comment was made to liven up the Ice project podcast he was appearing on (although he re-affirmed his stance on another show the following day), it got people talking.

Pohutukawa churns out touch referees Pohutakawa Coast Touch (PCT) based in Beachlands has a proud and enviable record of producing top class touch referees, many of who have gone on to referee at the national level. The club is considered the largest module in New Zealand, with a staggering (approximate) 1200 players registered. Its referee development squad was created 12 years ago by Eddie Van Den Dop who wanted to create a team of referees to assist in the module. Back in his day there were just a handful of volunteers that put their hand up to referee and at the time there were no support mechanisms by Counties or NZ Touch nor pathways or qualifications they just turned up and ran. Carl Llewelyn took over the role 8+ years ago and started a long-term plan to create a team of elite referees. To date, 66 referees (sourced mainly from player ranks) have been put through the development programme, and currently they boast 37 referees within the youth development and elite programmes. In addition, 24 referees are either still in the National programme or have represented Counties and NZ at nationals. ➤➤Turn to Page 15

aving deservedly overcome the previously unbeaten Stormers 33-10 in Cape Town, the Blues face an even sterner test of their Super Rugby talent against the Hurricanes in Wellington on Saturday. That latest win, following their triumph against the Bulls in Pretoria, can be attributed to the return of Otere Black to first-five and the success of converting Steven Perofeta to fullback where they have contributed to a far more cohesive backline. Black is not a fancy attacker, but he has an astute rugby brain and an accurate kick which succeeded with four penalties and converted all three of the Blues tries scored by Joe Marchant (2) and Dalton Papalii. Given more space at fullback where his sidestep and slick pass bring rich reward, Perofeta has adjusted nicely to his new position. Throw in Rieko Ioane, Mark Telea and Englishman Marchant and it’s a backline possessed of pace and penetration. However with powerful Ngani Laumape and Vince Aso combin-

ing brilliantly in the centres during the Hurricanes 62-15 thrashing of the Sunwolves, the Blues defence will need to be excellent in Wellington next Saturday. Add to them inspirational halfback TJ Perenara, slippery fullback Chase Tiatia and big wingers Kobus van Wyk and Ben Lam and they have awesome strike power. In scoring three tries against the Sunwolves, determined South African van Wyk showed off a smart sidestep and fend. Their forwards have also exceeded expectations. That is too long in a sport which demands frequent action to prevent ring rust and loss of fitness and timing of punches. However Parker got it right when an excellent four-punch combination nearly put Winters through the ropes in the fifth after a crunching right floored the American in the third. Unfortunately in his eagerness to demonstrate his punching power, Parker failed to box as well as he can against a wily opponent who was no patsie. Consequently he got caught

in too many clinches against a 39-year-old former cruiserweight who conceded considerable weight. Parker is not an in-fighter and is at his best when he uses his excellent left jab extensively. Nor is he a one-punch knockout artist like David Tua was with his lethal left hook. However he does have fast reflexes and is capable of putting opponents away with his combinations, as he did in the fifth against Winters. That performance won’t scare Anthony Joshua and Tyson Fury who need to unify the world heavyweight championship by fighting in a winner-take-all bout. Meanwhile I ended up with egg on my face last week when reporting on Tyson’s win against Wilder, I wrote Fury’s corner threw in the towel when in fact it was Wilder’s. Be assured I am having my senility checked and have asked my proof reader to see an optician.
