US 82 Westbound Traffic Shift Set in Fannin County Be aware of a change in traffic flow
PARIS – Texas Department of Transportation officials today announced that a major shift for westbound traffic on US 82 in Fannin County will

Drivers who travel frequently in this area, and those who desire to cross from the north, are advised that all driveways, county roads and FM roads will include a full stop at their intersection with US 82. After the stop, traffic can proceed to cross over to the median. The contractor, Austin Bridge & Road Services LP, will place stop signs at these locations before the traffic switch occurs, and will place message boards along some roads to alert drivers to the new stop signs. This road construction project in Fannin County will expand US 82 from two lanes to a four-lane highway with depressed median, from one-half mile west of State Highway 121 in Bonham eastward to approximately six-tenths of mile east of State Highway 56 in Honey Grove, officials said Those who frequently travel in this area are asked to pay special attention to all barricades, traffic controls and signs, and to reduce their speed as they approach and travel through work zones. By Rose Schwartz Monday, December 7, 2020, the Fannin County Republican Women, PAC, was thrilled to welcome the President of the Texas Federation of Republican Women, Glynis Chester to their annual Christmas Cookie Exchange Meeting. The meeting began at 6:00 p.m. with members encouraging visitors to help themselves to ribbon tied bags of melt in your mouth, home baked Christmas Cookies. Guests were assured the ladies who volunteered to bake the cookies, had taken the extra precautions of wearing masks & gloves during the baking and assembly process to prevent any accidental Covid-19 transmission. After the committee’s business had been addressed and a short address was given to the attendees by Judge Laurine Blake, Ms. Chester spoke. Glynis gave an encouraging and informative speech, noting that for those who were
not happy with the results of the national election, first, they should know that with all the fraud allegations & evidence pouring in across the country, the election

Senior Commissioner Gary Whitlock called the regular meeting of the Commissioner’s Court to order at 9:00 a.m. Tuesday 8, December 2020. Quorum was established as all Commissioners were present. David Woodson introduced Honey Grove Church of Christ’s new pastor, Cody Maxwell to give the invocation. Major James Manis led the pledges. There were no introductions, however Commissioner Whitlock did inform all in attendance, of the passing of County Judge Randy Moore’s father from Covid-19. Hence, the reason for his absence from the court. 5. Public Forum: There were no speakers. 6. Discussion, consideration
and action regarding the Fannin County Declaration of Disaster Proclamation for Covid-19: Commissioner Gary Whitlock said that as of 4:05 p.m. yesterday, there were 1097 total cases of Covid-19 reported, 66 active cases, (with 19 of the active cases being in prison), 1017 recovered cases and 42 fatalities. He also noted that the current hospitalization rate has risen to 15.87%. He asked for a motion to extend the Proclamation another week. Motion was made, seconded and passed. 7. Discussion, consideration and action regarding the Covid-19 Response and Continuity of Operations Plan for Fannin County: Commissioner Whitlock stated additional verbiage had been added to the plan regarding employee paid leave. He said that the wording could be found on page 3, paragraph 2 and could be viewed on their

website under “commissioners meetings.” County Purchasing Agent Michelle Case asked to speak to bring up the topic of the Employee Appreciation Banquet. With the many restrictions mounting because of the higher Covid-19 numbers, she thought the banquet should be rescheduled for another time. Commissioner Whitlock said that would be addressed at the next Commissioners Court. Commissioner Lackey posed a question to Fannin County Auditor Alicia Whipple about the verbiage that was added to the Operations Plan for Fannin County. After some discussion between Commissioner Lackey, Alicia Whipple and Lisa Loiselle, it was determined that elected officials do not always have to strictly adhere to all the requirements for approving sick leave pay for their employees. Motion was made to extend the plan for one more week, seconded, and passed. 8. Discussion and update regarding AgriLife Extension: Fannin County Extension Agent Cody Maxwell began the last update for 2020 by noting that due to Covid-19, he and his co-workers have been forced to utilize online capabilities which has resulted in successfully reaching and educating more people interested in their programs. This year they had 34 educational programs with 27 of them being online. AgriLife has reached and educated 4,144 people in 2020 through online programs, site visits and office visits. The largest program area for them is in the area of livestock and forage. The number of people helped was obtained without the benefit of two of their historically well attended programs that were cancelled due to Covid-19. Highlighting this year for Cody were four new radio programs out of Dallas that are in addition
to the two heard locally on 95.7. The six radio programs have enabled AgriLife to reach approximately a half million people in 2020. He ended his update on the note that he was very appreciative when a new landowner calls on him due to a recommendation from their respective Commissioner. He thanked the Commissioners for their ongoing support of the work they do. Cody feels the work of the AgriLife Extension is even more critical today as more new landowners move into our area without any agricultural experience at all. He said, he likes people and likes to assure them that if they are willing, he can take them from soil testing to raising livestock. 9. Discussion and update regarding Courthouse Restoration: Commissioner Lackey gave an update he received. Commissioner Lackey said: Layout of the trusses this week will result in them being put up on the roof next week, Interior rough-in work is continuing; Blocking millwork is continuing, and they are continuing to work on the 1888 gables. 10. Discussion, consideration and action to approve minutes from 10/27/2020: Motion was made, seconded and passed to approve minutes. 11. Discussion and report to Commissioners Court of monies collected by the Fannin County District Clerk’s Office for November 2020: District Clerk Nancy Young stated that the report was electronically sent to all the Commissioners. 12. Discussion, consideration and action to renew the lease at 108 E. Sam Rayburn, Bonham, Tx: Michelle Case gave a report on the lease changing to a monthly lease. She also said the rent is going up from $1,100 a month to $1,150 a month. Motion was made, seconded and passed to renew the lease. 13. Discussion, consideration and action regarding personnel or supplies for Covid-19 from the CARES Act Grant or other funding: Michelle Case said there was nothing new to report other than a stop to purchasing anything on the CARES money until more money comes through. No action needed. 14. Discussion, consideration and action to approve payment of bills: Motion was made, seconded and passed to pay the bills. 15. Comments by County Commissioners and County Judge: Commissioner Self hoped everyone has a good week. Commissioner Magness expressed thanks for the concern he has received with the passing away of his brother David. Commissioner Lackey expressed the need for caution on Hwy 82 and the need for caution with Covid-19 as he knows of six people who have had it. And though he did not know David Magness very well, he knew enough of him to know that he was a real gentleman and a good public servant. 16. Adjourn: Motion was made, seconded and passed to adjourn at 9:37 a.m.

still feel like a young person inside. I believe life is to understand and know God. It is to understand that God sent his son Jesus into this world to die for my sins that I may have eternal life. And then God instilled in us that desire to be a legacy for others to follow by our actions. That’s what my dad was...he was a legacy for all of us to follow. My dad was not perfect by any means just like all of us. He did his best in this world of darkness to bring a little light into it. ● Sometimes dad would say boys I just need y’all to help me do something for an hour or so this morning. We both would just look at one another and go... well there goes our day. ● It seems that dad was always working. One day my brother and I, when we were both very young, decided to go meet him down in riverbottom where he was fixing fence. We found him and he was there with his horse Blaze. We waited around a while but before long we decided it was time to go home so we asked dad if he would let us ride his horse back, he said yes, but be careful. We both got on Blaze in that big pecan bottom with me sitting behind my brother and that horse was very sensitive to any kind of pressure. Maybe I kicked the horse in the flanks, I’m not sure. A couple of minutes later all my brother and I knew is that we were laying on the ground unconscious. The horse had run under a lowlying limb and knocked us both off. Dad picked us up, laid us across the saddle and took us to the house. ● We really never knew what holiday was. Working on the farm or ranch there was always something to do. Needless to say though, if we had it all to do over again, we would not give up one moment of living

I write this as speaking for many of you. Our Fathers are special. Some of you have good memories and some not so good. I believe many of you will identify with some or maybe all of what I have to share. My Dad left many good memories and a legacy of challenge to live our lives with honor, respect, humility and a love for others and God. Have you ever wondered what your legacy was going to be in life? I believe a lot of that comes from how you were raised, your siblings, but most especially your parents and grandparents. My dad passed away early this morning, December 4, 2020. He was also my brother and my sister’s dad. My dad was not a hugger and did not display love toward us like maybe some Father’s do. But, we undoubtedly knew he loved us more than anything in the world. The one thing my dad and mom wanted for us kids was to know God and to get a good education. My love was for the land. I love farming, ranching and all those things that kind of came along with that. It was not until my senior year in college and my peanut crop was actually a failure, I realized that I cannot support a family on nothing and there is no security in the farming business. I chose to work for USDA and my dreams came true as far as living the life and doing the things that I really wanted to do in this world. The who I am over the years begin to come out of my person. I not only loved the land, the trees, plants and animals... but also grew to love the God who made them. I began to realize that this is really what life is all about. We have never been guaranteed a long life on this earth. Life is but a mist or a vapor (Ps. 39:46). It is here today and gone tomorrow. I can’t believe I’m already 67 years of age, as I

And our kids piled right in and helped with gathering, separating, vaccinating, castrating, branding, dehorning and ear notching our animal. Our kids were taught to respect animals and not to wantonly waste any animal.

Farming and ranching is hard work, but it taught us the value of work and that has stuck with us all through life. ● There were a few times that we were not working if it had rained or snowed too much and we would enjoy time together with mom and dad. We played lots of games, mostly it was 42, and we enjoyed those times thoroughly. ● One of the best times we always enjoyed was on Sunday morning when dad would say boys go shut the electricity off of the irrigation pump. We are not working today. And we never did...not on Sunday. That day was reserved for worship and rest. ● I did not have an alarm to get me up in the morning. I would hear Dad coming back from milking the cow... whistling. I knew all was well with the world. ● My brother and I were in our teenage years and out hunting quail. We came upon one of our ponds and noted it was full of ducks. We decided to hunt ducks. We came up over the tank dam and shot 9 as they rose into the air. We thought we had done well. We brought them back to the house to show off our mighty skills and Dad said; I hope you don’t expect me to help clean or eat

Nick Rhinehart of Bonham made the elite team, while classmate Brant Stuber appeared on the first team. Honorable mention recipients included Bonham’s Aidan Downs, Hannah Petty (trainer), Hayley McBroom (trainer) and Elijah McFarland, joined by Trenton’s Christian Verde, Eden Kuykendall and Anthony Taylor. In 2019, Bonham made school history in boys basketball: most-known single-season wins (26), first bi-district win and second area-round advance. The historic season also ended with a competitive postseason loss against Dallas Madison, a frequent state tournament participant for the last dozen years. Having reached that pinnacle for the program, it made the struggles of the 201920 campaign all the more stark for the Warriors -- 10 total wins and no playoffs -during the first season at the helm for alum Eric Hicks who assisted with said historic
team. The initial results for the current campaign suggest another memorable one may be unfolding during Hicks’ second season. Host Bonham defeated Lone Oak, 61-40, on Dec. 8 in non-district play -- matching the 8-0 start of the historic team. During the undefeated start, senior Tanner Reaves, a Grayson College baseball commit, has most often led the scoring attack for the Warriors. When not the leader, he has tied for or most often been near the top in points scored for Bonham -- aided by his prowess behind the 3-point arc. Reaves, who had 32 points in the season opener, returns this year after garnering the sixth-man award and a first-team selection, respectively, in 2019 and 2020 in District 10-3A. Junior Mason Rodriguez and sophomore Cam Bush have each additionally had team-leading 20-point scoring efforts, through Dec. 8. Junior Michael Crosby has also frequently produced double-digit scoring -- and numerous others each game have consistently contributed count -- for the Warriors, who are scheduled to start 11-3A play on Dec. 18 against Gunter, a new rival in district basketball -- and the opponent against whom Bonham earned its historic bi-district win in 2019.

The Work Session of the Fannin County Commissioners Court scheduled for December 10, 2020 at 10:00 a.m. was cancelled for lack of a Quorum. The items that had been slated for discussion were: 1. Discussion regarding floorplans for the Fannin County Courthouse 2. Discussion regarding Requests for Qualifications (RFQs) for architectural services in the building of a Fannin County Justice Center Some Fannin County residents present for the Work Session, were visibly disappointed that the meeting was called off and asked Commissioner Lackey when they could expect a rescheduling. Commissioner Lackey responded that he could not reschedule it himself but that it would be rescheduled at a later date. Those interested in attending any future meetings of the Fannin County Commissioners Court should know such meetings are posted 72 hours priors to being held in the entry foyer of Bonham City Hall. The Fannin County Leader is also notified 72 hours prior to meetings being held.

The Story of Santa Over the centuries, Santa Claus has been know by many names; Saint Nicholas or St. Nick, Papa Noel, Father Christmas, Kris Kringle, Sinterklass or simply “Santa.” The legend of Santa Claus can be traced back hundreds of years to a monk named St. Nicholas. It is believed that Nicholas was born sometime around 280 A.D. in Patara, near Myra in modern-day Turkey. Much admired for his piety and kindness, St. Nicholas became the subject of many legends. The years have seen many legends and folklores about Santa Claus, especially in many European countries like Germany, France, Belgium and the Netherlands. Many poems, songs and books have brought the modern Santa to what we see each year during the Christmas Holidays.
Come join us on a wagon ride to Bethlehem. Starting at the main camp, journey down the trail while singing Christmas carols. When you reach Bethlehem, be prepared to experience the Christmas story, the true meaning of Christmas. After that, travel back to the main camp, where you will find Christmas delights.
Whatever the legends and folklore may be, let us not forget the true meaning of Christmas, and that is to remember the birth of Jesus Christ, the love for our fellow man and to practice the giving spirit during this holiday season, and everyday.

Establishment of Drainage Utility; Service Area; Exemptions, and Dedication of Assets. (a) (b) (c) (d)

The provisions of the Texas Local Government Code, Chapter 552, Subchapter C are hereby adopted to create a Drainage Utility for the City. Accordingly, drainage of the City of Bonham is hereby declared to be a public utility. The service area for the Drainage Utility shall include all real property within the city limits of the City of Bonham as now existing and all which may be annexed hereafter from time to time. The City Council finds that: (1) Impervious cover increases runoff and associated pollutants; and (2) It is equitable to assess the drainage charge to each User based on impervious cover. Pursuant to the Texas Local Government Code, Section 552.053 and Section 580.003, the following shall be exempt from the provisions of this chapter: (1) Property with proper construction and maintenance of a wholly sufficient and privately-owned drainage system; (2) Property held and maintained in its natural state, until such time that the property is developed, and all of the public infrastructure constructed has been accepted by the municipality in which the property is located for maintenance; (3) A subdivided lot, until a structure has been built on the lot and a Certificate of Occupancy has been issued by the City; (4) State agencies; (5) Public or private institutions of higher education; (6) Property owned and operated by the U.S. Department of Veterans Affairs; and, (7) City-owned properties and facilities. The City incorporates into the Drainage Utility System all existing property, facilities, materials, and supplies constituting the City’s drainage system on the effective date of this article. All future acquisitions by the City of real or personal property used in the City’s drainage system shall be maintained as a part of the Drainage Utility.
Sec. 13.06.002. No Effect on Land Owner Obligations Under City Ordinances; No Waiver of Immunity. (a) The establishment of the Drainage Utility by the City does not relieve private land owners, developers, other individuals and entities from responsibility for providing drainage improvements in connection with land development pursuant to the other ordinances of the City or laws of the State of Texas that relate to stormwater runoff, drainage management, or drainage improvements. (b) The establishment of the Drainage Utility does not imply or warrant that a benefitted property will be free from flooding, stormwater pollution, or stream erosion. The City makes no representation that all drainage problems will be remedied. This article does not create additional duties on the part of the City or create new liability or remedies for any flooding, stream erosion, deterioration of water quality, or other damages. Nothing in this article shall be deemed to waive the City’s immunity under law or reduce the need or necessity for flood insurance. Sec. 13.06.003. Other Laws (a) To the extent this Chapter conflicts with any other Chapter in this code, the provisions shall be harmonized when possible, however, this Chapter shall control and supersede any other provision regarding the Drainage Utility System. SECTION 3. Administration of Drainage Utility Sec. 13.06.004. Definitions Terms defined herein are specific to this chapter and shall not be construed as conflicting with similar terms in other parts of this code. Terms not otherwise defined herein shall be given the definitions contained in the Texas Local Government Code, Subchapter C. (a) “The Act” shall mean the Texas Local Government Code, Chapter 552, Subchapter C. (b) “Benefitted Property” shall mean an improved lot or tract to which drainage service is made available under this Chapter. (c) “Commercial Property” shall mean all improved properties within the City other than residential property, including, but not limited to, commercial, industrial, institutional, government, multi- family, mobile-home park, and religious organization land uses. (d) “Cost of Service” shall mean the costs for drainage system service to a Benefitted Property, which shall be the total of: (1) Prorated cost of the acquisition, whether by eminent domain or otherwise, of land, rights-of-way, options to purchase land, easements, and interests in land relating to structures, equipment, and facilities used in draining the Benefitted Property; (2) Prorated cost of the acquisition, construction, repair, and maintenance of structures, equipment, and facilities used in draining the Benefitted Property; (3) Prorated cost of architectural, engineering, legal and related services, plant and specifications, studies, surveys, estimates of cost and of revenue, and all other expenses necessary or incident to planning, providing, or determining the feasibility and practicability of structures, equipment, and facilities used in draining the Benefitted Property; (4) Prorated cost of all machinery, equipment, furniture, and facilities necessary or incident to the provision and operation of draining the Benefitted Property; (5) Prorated cost of funding and financing charges and interest arising from construction projects and the start-up cost of a drainage facility used in draining the Benefitted Property; (6) Prorated cost of debt service and reserve requirements of structures, equipment, and facilities provided by revenue bonds or other drainage revenue-pledge securities or obligations issued by the City; and (7) Administrative costs of operating and maintaining a Drainage Utility System. (e) “Drainage” shall mean bridges, catch basins, channels, conduits, creeks, culverts, detention ponds, ditches, draws, flumes, pipes, pumps, sloughs, treatment works, and appurtenances to those items, whether natural or artificial, or using force or gravity, that are used to draw off surface water from land, carry the water away, collect, store, or treat the water, or divert the water into natural or artificial watercourses. (f) “Drainage Utility Charges” shall mean the levy imposed to recover the cost of the service of the municipality in furnishing drainage for any Benefitted Property, including any interest and penalties; and amounts made in contribution to funding of future drainage system construction by the City. (g) “Drainage System” shall mean the drainage system owned or controlled in whole or in part by the City and dedicated to the service of Benefitted Property, including any future additions, extensions, and improvements thereto and replacement thereof. (h) “ERU (Equivalent Residential Unit)” shall mean the unit of measure used to calculate the Drainage Utility Charge for Commercial Property. The ERU is the average horizontal Impervious Area for single-family property within the City. (i) “Facilities” shall mean the real, personal, or mixed property that is used in providing drainage and included in the system. (j) “Impervious Area” or “Impervious Surface” shall mean a surface which has become compacted or covered with a layer of material so that it is highly resistant to infiltration by water. Impervious Areas include, but are not limited to, compacted soils, graveled surfaces subject to motorized vehicular traffic, walkways, buildings, parking lots, pavement, and ingress/egress driveways. “Impervious Area” or “Impervious Surface” does not include sidewalks located in the public right-of- way and as further defined in Section 4-6-2 of this Code. For purposes of this definition a “walkway” is a pedestrian way in the interior of a lot or tract that is not located in the public right-of-way. (k) “Improved Lot or Tract” shall mean a lot or tract that has a structure, as that term is defined in Section 4-10-3 of this Code, or other improvement on it that causes an Impervious Surface or Area. (l) “Parcel” shall mean one (1) or more lots or portions of lots that are contiguous and under single ownership. (m) “Public Utility” shall mean drainage service that is regularly provided by the City through City property dedicated to that service to the users of benefited property within the service area and that is based on: (1) An established schedule of charges; (2) Use of the police power to implement the service; and (3) Nondiscriminatory, reasonable, and equitable terms consistent with the Act.

“Residential Property” shall mean any improved lot or tract with single-family home, duplex, triplex, quadplex, condominium, or mobile home. “Service Area” shall mean the municipal boundaries of the City. “User” or “Customer” shall mean the person or entity that owns or occupies a Benefitted Property. “Wholly Sufficient and Privately-Owned Drainage System” shall mean drainage from an improved lot or tract which does not discharge into any natural or manmade waterway or drainage infrastructure including public streets, storm drains, culverts, drainage easements, or storm water ponds that are part of the Drainage System.
Sec. 13.06.005. Drainage Utility Fund. A separate fund is hereby created, known as the Drainage Utility Fund, for the purpose of segregating, identifying, and controlling all revenues and expenses attributable to the Drainage Utility. All Drainage Utility Charges shall be deposited as collected and received into this fund and shall be used exclusively for drainage Cost of Service. Such utility revenues may be used for the operation, planning, engineering, inspection, construction, repair, maintenance, improvement, reconstruction, administration, debt issuance cost and debt service, and other reasonable and customary expenses associated with the operation of a utility system. It shall not be necessary that the expenditures from the Drainage Utility Fund for any authorized purpose specifically relate to or benefit any particular Benefited Property from which the revenues were collected. Sec. 13.06.006. Administration of Drainage Utility The Director of Public Works or his designee shall be responsible for the administration of the Drainage Utility, including, but not limited to, enacting any procedures necessary for the administration of the drainage charges and the consideration of appeals, development, and implementation of maintenance and facility improvement programs, state and federal regulatory compliance, and establishing drainage criteria and standards for the drainage system. The Director of Public Works shall keep an accurate record of all properties benefited by the services and facilities of the Drainage Utility. (a) (b) (c) (d) (e) (f) (g)

Sec. 13.06.007. Drainage Utility Charge A Drainage Utility Charge is hereby imposed upon each improved lot and parcel within the Service Area. The Drainage Utility Charge shall be billed after September 30, 2018. Drainage Utility Charges shall be billed on a monthly basis thereafter for the duration of the Drainage Utility. For purposes of imposing the Drainage Utility Charge, all lots and parcels within the City are classified into the following customer categories: (1) Residential Property and (2) Non-Residential Property. The ERU value for the City is determined through an inventory of all improved single-family residential parcels in the City and determination of Impervious Area for each parcel. Evaluation of these data determined that the equivalent residential unit Impervious Area value for assigning charges to commercial properties is eleven thousand eight hundred and forty-four (11,844) square feet. Commercial Rates shall be based on Impervious Area determination for each parcel: Total ERU’s = (Impervious Area/11,844 sq. ft.), minimum 1 ERU The monthly Drainage Utility Charge for properties shall be calculated by multiplying the total number of ERU’s for the parcel by the ERU monthly billing rate. The following ERU monthly billing rate is hereby established and shall be used to calculate the total monthly Drainage Utility Charge for all property located in the City, both residential and commercial, in accordance with the applicable formula established in this subsection: ERU rate = $2.33 per ERU per month. The Director of Public Works or his designee shall be responsible for determining Impervious Area of property based on reliable data, including the appraisal roll, geographic information system technology, aerial photography, or other reliable means for determining Impervious Area. The Director of Public Works may require additional information from the property owner, tenant, manager or developer to make the determination. The amount of a charge may be revised by the Director of Public Works based on any additions to the Impervious Area through the City approved building permit process. The City Council may review the schedule of charges at any time and may increase or decrease charges upon a determination that an increase or decrease is warranted. No Drainage Utility Charge credit shall be given for the installation of drainage facilities required by the code or state law.
Sec. 13.06.008. Billing, Payments, and Penalties (a) Bills or statements for the Drainage Utility Charge shall be rendered by the City for all properties subject to the charge. Bills shall be payable when rendered and shall be considered received by the customer, whether actually received or not, when deposited in the United States mail, postage prepaid, addressed to the utility customer. Bills shall be rendered monthly for the previous month’s service. (b) The Director of Public Works shall assume that each utility account in the service area serves one (1) or more Users of a Benefitted Property, and shall assess the Drainage Charges to the person responsible for payment of the utility account. The Director of Public Works shall calculate the Drainage Charges for all Users and shall assess the Drainage Charges to the person responsible for payment of the utility account. If there is more than one (1) User of a Benefited Property (which is non-Residential), then the charges shall be assessed to the owner of the Benefited Property, unless instructed by the owner of the Benefited Property, in writing, to bill Users on a prorated basis. (c) Bills are due and payable on the date specified thereon and if full payment is not made by the date specified, the bill shall become delinquent. (d) Drainage Utility Charges shall be billed with the City’s other public utility billings and shall be identified separately on the bill as a Drainage Utility Charge. Drainage Utility Charges are subject to the billing procedures, penalties, discounts, interest, and other terms of Chapter 13, Article 13.03, Division 2. (e) Any charge due hereunder which is not paid when due will subject the User to discontinuance of all utility services provided by the City and may be recovered in an action at law or in equity by the City including fixture of a lien against the property, as allowed by law. (f) The City shall have access, at all reasonable times, to any Benefited Property served by the Drainage Utility for necessary inspection, repair of infrastructure or enforcement of this article. Sec. 13.06.009. Appeals Requests for adjustment of a Drainage Utility Charge shall be submitted to the Director of Public Works or his designee. A User may apply for an adjustment if: (1) The User believes that the drainage charge schedule, as applied to the User’s Benefitted Property, does not fairly reflect the Cost of Service to the User’s Benefitted Property; (2) The User disputes the amount of Impervious Area used to calculate the drainage charge; or (3) The User’s Drainage Charge has been assessed in error. The following procedures shall apply to all requests for adjustment of the Drainage Utility Charge: (1) The User shall have the burden of proof. (2) Any User who has paid Drainage Utility Charges and who believes the calculation or determination of the Drainage Utility Charge to be incorrect may, subject to the restrictions set forth in this Chapter, submit an adjustment request to the Director of Public Works. (3) Requests for adjustment of Drainage Utility Charges paid by an Owner, User or Customer making the request shall be in writing and set forth in detail the grounds upon which relief is sought. (4) Adjustment requests will be reviewed by the Director of Public Works within twenty (20) days from the date of receipt of an adjustment request. Adjustments resulting from such a request shall be prospective but may be made retroactive for no greater time period than three (3) monthly billings prior to the receipt of the request. (5) The User requesting an adjustment may be required, at the User’s cost, to provide supplemental information to the Director of Public Works, including, but not limited to, survey data certified by a Texas Registered Professional Land Surveyor (R.P.L.S.), or other documentation of Impervious Area. Failure to provide requested information may result in the denial of the adjustment request. (6) The Director of Public Works’ determination of the adjustment request shall be provided to the User, in writing, within ten (10) days of the later of receipt of the request for adjustment or receipt of any additional information submitted in accordance with this section. If the Director of Public Works approves the request, the adjustment to the Drainage Utility Charge will be made. If the Director of Public Works denies the adjustment request, the User may, within ten (10) days from the date of notification, appeal the decision to a panel consisting of the City Manager, the Director of Finance, the Director of Community Development, and the Director of Public Works. The appeal shall be in writing, contain a succinct and clear statement of the User’s argument and suggested remedy, and be filed with the Planning Director who shall convene the panel. The panel shall have ten (10) business days from the date the appeal is received to review the appeal, make a determination, and notify the User. If the panel denies the appeal, the User shall have five (5) business days from the date of notification to appeal the decision to the City Council. The appeal shall be in writing, containing the information stated above in (b), and be filed with the City Secretary. The City Council shall grant a public hearing within sixty (60) days of receipt of the request for review. The City Council’s decision shall be final. Before imposing a lien for delinquent Drainage Utility Charges, the City shall send notice to the record owner of the Benefitted Property stating the amount of the charges owned, and of the owner’s right to appeal the placement of the lien by producing evidence the delinquent charges are not rightfully owed, by providing such within ten (10) business days from the date of notification to the Director of Utility Billing. The Director of Utility Billing shall not file the lien if the owner shows that the Drainage Utility Charge made the basis of the lien is not owed. When a person pays all of the charges, a lien filed pursuant to this Chapter, shall be released. The paying party shall be responsible for the filing costs of the release.
SECTION 4. That all provisions of the ordinances of the City of Bonham in conflict with the provisions of this Ordinance be, and the same are hereby, repealed, and all other provisions of the ordinances of the City of Bonham not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 6. That an offense committed before the effective date of this Ordinance is governed by prior law and the provisions of the Code of Ordinance, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 7. That this Ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide. Serving as pallbearers were Dennis’s sons and brothers Josh, Nathan, Matthew, Guy, Dean, and Darrell Bailey. Dennis passed away Friday December 5, 2020 at Medical City Plano Hospital. Dennis was born November 10, 1954 in Ft. Worth, TX. the son of Walter and Thelma (Wright) Bailey. He worked in credit and collections in the home interior and gifts industry, and a member of the Greywood Church of God. Dennis enjoyed fishing, camping, gardening, making people laugh, but most importantly if there was someone in need and he could help, he would. He relied on the Lord in his struggles and praised him even when life was hard. He could make anything grow in his garden, one time he put a stick in the ground and now it is a huge tree, at least that what he told the kids. He loved all his children and grandchildren and saw them as his greatest blessing and joy. He never met a stranger because if he was talking for long, they were friends instantly. Dennis is survived by his sons, Josh, Nathan, and Matthew Bailey, daughter, Melanie Cantu, his grandchildren, Conner, Alex, Jasen, Gunner, Maximus, Carmen and Hope Bailey, brothers, Guy, David, Dean and Darrel Bailey. Services are under the direction of Wise Funeral Home in Bonham, Texas. Jim was born Nov. 4, 1942 in Chicago, Illinois, the son of James Henry Buchanan and Jane High Crockett Buchanan. Magness, Commissioner Joe David – Joe David Magness, a longtime resident of Royse City, Texas, passed away on December 3, 2020. He was born March 3, 1952, in Fannin County, Texas, to Royce Glen Magness and Melba Jean (Harris) Magness and was raised in Telephone, Texas. David was a graduate of Texas A&M UniversityCommerce with a Bachelor of Science in Business and Agriculture. He farmed and ranched in Rockwall, Hunt, and Collin counties and owned a fertilizer and chemical distribution business prior to becoming the Rockwall County Commissioner representing Precinct 4 in 2003. While Commissioner, David was the Chair of both the Rockwall County Road and Open Space Consortiums. He also served as the County Court representative to the Regional Transportation Council, STAR Transit Board of Directors, and the North Texas Council of Governments. David loved serving and planning for the preservation and future of his community. David was appointed in 2003 to the Board of Directors of Farmers Electric Cooperative, a rural electricity provider for over 60,000 meters in Rockwall, Collin, Hunt, and other counties, serving as the Board President since 2010 and a member of the Farmers Electric Charitable Foundation Board since 2008. David was a Realtor for the past 14 years with Upchurch Real Estate and United Country Real Estate. He was a founding investor and Chairman of the Board of Texas Leadership Bank, now Guaranty Bank of Royse City. He also served for 12 years as a member of the Royse City ISD Board of Trustees and was a founding member and the first President of the Royse City Rotary Club. David was active within the community, serving as a member on the Rockwall County Youth Fair Board, Texas Farm Bureau, the Royse City Chamber of Commerce Board, and the Rockwall County Republican Men’s Club. He was also an active member of the First United Methodist Church of Royse City. David had a warm welcome and smile for every person he met and enjoyed sharing a laugh after telling a tall tale or a harmless prank. Known as Papa to his grandkids, David’s family was his pride and joy. His presence will be deeply missed by everyone who knew and loved him. David is survived by his loving wife of 47 years, Shirley Magness; daughter and son-in-law, Rebecca and Michael Gilmer; grandchildren, Reid, Jude, and Sloane Gilmer; sister, Marilyn Ackmann; brother, Jerry Magness and wife Shonda; and numerous aunts, uncles, nieces, and nephews. He was preceded in death by his parents. In order to maintain the safety of family and friends at this time, a public memorial service will be scheduled at a later date. Glaser Family Charitable Foundation Scholarship Recipients - Spring 2021
PERMIT NO. WQ0015278001 APPLICATION AND PRELIMINARY DECISION. North Texas Municipal Water District, P.O. Box 2408, Wylie, Texas 75098, has applied to the Texas Commission on Environmental Quality (TCEQ) for a renewal of Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0015278001 which authorizes the discharge of treated filter backwash effluent from a water treatment plant at a daily average flow not to exceed 500,000 gallons per day. TCEQ received this application on July 1, 2020. The facility is located at 2073 Farm-to-Market Road 273, Bonham in Fannin County, Texas 75418. The treated effluent is discharged to an unnamed tributary, thence to Lake Bonham, thence to Timber Creek, Bois d’Arc Creek in Segment No. 0202 of the Red River Basin. The unclassified receiving water uses are minimal aquatic life use for unnamed tributary and high aquatic life use for Lake Bonham. The designated uses for Segment No. 0202 are primary contact recreation, public water supply and high aquatic life use... All determinations are preliminary and subject to additional review and/ or revisions. The permit application, Executive Director’s preliminary decision, and draft permit are available for viewing and copying at Bonham Public Library, 305 East 5th Street, Bonham, Texas. PUBLIC COMMENT / PUBLIC MEETING. You may submit public comments or request a public meeting about this application. The purpose of a public meeting is to provide the opportunity to submit comments or to ask questions about the application. TCEQ holds a public meeting if the Executive Director determines that there is a significant degree of public interest in the application or if requested by a local legislator. A public meeting is not a contested case hearing. OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for submitting public comments, the Executive Director will consider all timely comments and prepare a response to all relevant and material, or significant public comments. Unless the application is directly referred for a contested case hearing, the response to comments will be mailed to everyone who submitted public comments and to those persons who are on the mailing list for this application. If comments are received, the mailing will also provide instructions for requesting a contested case hearing or reconsideration of the Executive Director’s decision. A contested case hearing is a legal proceeding similar to a civil trial in a state district court. TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant’s name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; a list of all disputed issues of fact that you submit during the comment period; and the statement “[I/we] request a contested case hearing.” If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group’s representative for receiving future correspondence; identify by name and physical address an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member’s location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group’s purpose. Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting. The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality concerns submitted during the comment period. TCEQ may act on an application to renew a permit for discharge of wastewater without providing an opportunity for a contested case hearing if certain criteria are met. EXECUTIVE DIRECTOR ACTION. The Executive Director may issue final approval of the application unless a timely contested case hearing request or request for reconsideration is filed. If a timely hearing request or request for reconsideration is filed, the Executive Director will not issue final approval of the permit and will forward the application and request to the TCEQ Commissioners for their consideration at a scheduled Commission meeting. If you submit public comments, a request for a contested case hearing or a reconsideration of the Executive Director’s decision, you will be added to the mailing list for this specific application to receive future public notices mailed by the Office of the Chief Clerk. Press Release - The Glaser Family Charitable 12/15/20is a family Foundation foundation that was established in 2001 and is located in Bonham, Texas. The foundation exists to strengthen educational and cultural opportunities, protect children’s health, and support Christian ministries. The Glaser Family Charitable Foundation scholarship program seeks to identify and support students who combine academic promise with character and a commitment to their community. It is interested in assisting individuals to develop their talents, broaden their horizons, and fulfill their dreams through educational success. At least 80% of the scholarships will be awarded to students from Fannin County. Programs include schol-
arships for all levels of post-secondary education available to students with a 2.0 GPA and above. Financial assistance will be available to individuals entering skills and technical training institutions as well. The Glaser Family Charitable Foundation provides its services on a competitive basis without regard for race, creed, color or sex. Awards are granted semi-annually. No funds go directly to the students, but to the colleges of their choice and placed in an account in the business office to pay tuition, books, fees, supplies, room and board. If the student is unable to use all of the money, the college must return the remainder to the foundation. Recipients must re-apply for a grant each semester they attend classes.
