AUSTIN – Governor Greg Abbott has appointed Tammy Biggar, Christopher “Chris” Taylor, and Holly Williamson to the Texas County and District Re-
tirement System Board of Trustees for terms set to expire on December 31, 2025. The board oversees a retirement system for employees and retirees of more than 780 counties and districts, including hospital districts, water districts, emergency services districts and others. Tammy Biggar of Bonham is the County Clerk and Voter Registrar of Fannin County, where she leads voter registration and elections, and supports the county’s courts at law. She is a member of the North Texas Public Information
Officers Association and the Board of the Fannin County Family Crises Center, and she is a former Secretary of the Board for the Northeast Texas Election Administrators. She volunteers with the Fannin County Family Crisis Center, as a Disaster Action Team member with the Red Cross and with her church. Christopher “Chris” Taylor of Fort Worth is an Assistant District Attorney in the Civil Division in the Tarrant County District Attorney’s Office. He serves as a member of the advisory

board of the Texas Commission on Law Enforcement, and is a member of the Texas District & County Attorneys Association. He volunteers as a board member of the Women’s Center of Tarrant County and the Alliance for Children. The discussion of saying, “Merry Christmas” vs “Happy Holidays” has been ongoing for the past several years. The proponents of saying “Merry Christmas” say that to greet in any other manner during this sacred time of the year leaves CHRIST out of CHRISTMAS. Perhaps that is true in the hearts of some, but the word “HOLIDAYS” comes from the Old English word “halig” meaning HOLY and “daig” meaning DAY. The word Holiday has taken on many meanings in our contemporary society, and in some cultures, it refers to one’s vacation days, even a respite from certain activities. In the original language, HOLY DAYS meant a time of reflection, dedication, and consecration to God. Beginning with Thanksgiving in November and proceeding through the end of December in America and around the world, days are packed with activities for Jews and Christians during their Holy Days. In around 160 BC, the Syrians had captured Jerusalem under the leadership of the cruel Antiochus Epiphanes. He had killed and tortured the Jewish residents and had profaned the temple of YAHWH by setting up images of the government’s pagan gods in this most Holy place. When he offered a sacrificial pig to Jupiter on God’s Altar, a small band of God’s Priests, known as the Maccabees, revolted against the tyrant. Incensed by this cruel and ungodly activity in God’s temple, the outnumbered band of priests attacked the tyrannical leader and his soldiers. Surprisingly they routed their enemy, took back the Temple and Jerusalem. They rededicated the Temple of God and cleansed the false gods from its place. The eternal flame of the temple fueled by special oil had gone out under the profane leadership of the Syrians. After cleansing the temple, they had only one container of the dedicated oil that would last for one day, and it took eight days to prepare more oil. Undeterred, the priests lit the flame with the oil they had. The miracle of Hanukkah (Festival of Dedication) is that the flame lasted eight days rather than one until the special oil was again available. The story of the Maccabees is not recorded in our Bible, so it may be surprising to know that Jesus, when He walked this earth, went to the Festival of Hanukkah [Dedication] as recorded in John. It was now winter, and Jesus was in Jerusalem at the time of Hanukkah, the Festival of Dedication. He was in the Temple, walking through the section known as Solomon’s Colonnade [Porch]. John 10:22-23 NLT. At the same time every year, Jewish people and Christians around the world celebrate Hanukkah starting on the 24th day of the ninth month which is Kislev on the Jewish Calendar. Compared to our calendar, this eight-day festival falls within the last days of November through the Month of December. It is symbolized by the Menorah, a candle holder of nine candles, one for each day of the festival and in the center, a “shamash” or servant candle that lights all the other candles. Symbolizing eternal light, all light comes from One candle, the servant candle. John the Baptist testifies of Jesus, “The one who is the True light, who gives light to everyone, was coming into the world.” John 1:9 NLT In around 325 AD, over three centuries after Jesus left to return to the Father, the Roman Empire had adopted Christianity as the official religion of the empire in cooperation with the Holy Roman Church. Christmas (Christ Mass) was established as a Holy Day by the Catholic Church, but it was not until 1870, that America recognized it as a national holiday. The birth of our Savior, Jesus Christ, as recorded in the New Testament Gospels in Matthew 2:1-12 and Luke 2:1-20, is a great time of JOY and celebration for the long-awaited Messiah and Savior of all mankind and is celebrated worldwide. When I was a girl, Christmas was a time for family, celebration, Christmas carols, baking, and gifts. But my Dad never let us forget that this time was all about Jesus. Before we could open our presents that we had fawned over for weeks, we read the Christmas Story from Luke and then my Dad prayed (seemingly the longest prayers in history). His last AMEN brought squeals of joy, as we collapsed under the Christmas tree tearing into wrapping paper and ribbon. He might not have known, but his patience and insistence that we remember that Jesus is the reason for the celebration is the greatest gift he could have ever given us. As we celebrate this season of Holy Days, may we all be blessed with the knowledge of the greatest gift that one could ever receive – this ONE, CHRIST JESUS. May we be able to comprehend the GRACE God gave us when He sent His Precious Son into the World, to overcome God’s enemy, death, and to give us an eternal home with HIM. May we always remember that Jesus Christ, God in the flesh, tasted death for everyone of us that will receive Him, and in HIM alone do we have peace and hope forever – not just in these short days we call life, but for eternity. One cannot deny the stillness, also known as PEACE, during these HOLY DAYS. I pray we all listen to the stillness, take a deep breath of His Sprit, and know that no matter what is going on around us – HE IS LORD. “That Christ may dwell in our hearts by faith; that We, being rooted and grounded in love, may we be able to comprehend with all believers the breadth, the length, and the height of the Love of God, and to know the love of Christ, which passes knowledge, that we might be filled with all the fulness of God. Now unto HIM that is able to do exceedingly abundantly above all that we ask or think, according to the power that worketh in us, unto Him be glory in the church [His Body] by Christ Jesus throughout all ages, world without end.” Amen. This recipe sounds delicious, and I can’t wait to try it. She says that her family always loved it, and sometimes she adds leftover chopped celery as well. I hope everyone is ready for Christmas! This year will be different than most, but we can still celebrate the birth of our Savior, Jesus Christ. I hope everyone has a blessed and peaceful Christmas. I received this recipe in the
¼ cup butter ¼ cup flour ½ tsp. salt ¼ tsp. pepper 1 cup chicken broth 1 cup whipping cream 2 Tbsp. cooking sherry or wine (optional) 7 oz. spaghetti, cooked and drained 2 cups cubed and cooked turkey or chicken 1 - 3 oz. can mushrooms, drained ½ cup shredded Parmesan cheese

cream. Return to stove and heat to boiling, stirring constantly. Continue to boil 1 minute. Stir in wine, drained spaghetti, meat and drained mushrooms. Pour into ungreased 2 qt. oven safe casserole dish. Sprinkle with cheese. Bake uncovered for 30 minutes or until bubbly and

Discussion ensued with Councilman Moore asking for specifics of the plan the church had for what they were asking. Pastor Moreno explained that though they were speaking with an architect for plans for a larger church, they were waiting for approval from the city before making plans to include a closed section of Maple St. Police Chief Mike Bankston and Fire Chief Scott Ridling

Compton, asked Pastor Moreno if the ideas of a gate or traffic cones with signage would be an acceptable solution to the safety issue posed by traffic during church services. Pastor Moreno said he was in agreement to that solution and praised Chief Bankston for having helped with traffic cones during previous events at his church. Councilman LaVergne II was concerned that allowing traffic cones to block traffic during service hours for Saint Elizabeth’s might set a precedent for other churches to expect the same. Also, he was concerned about the cost to the city, additional signage blocking traffic during certain hours, might impose. City Manager Sean Pate answering his concerns, said that if there became a problem with many other churches asking for traffic blocking privileges, they would reassess at

Commissioners Court: County Employees2-19-19 Banquet Postponed/ 02-07-17 for Restored Courthouse Discussed Floorplans By Rose Schwartz County Judge Randy Moore called the regular meeting of the Commissioners Court to order at 9:00 a.m. Tuesday 15, December 2020. Quorum was established and David Woodson introduced Pastor Craig Clark of the United Methodist Church of Honey Grove to lead the invocation. Major James Manis led the pledges. Judge Moore recognized Beth, a representative from Senator Bob Hall’s office and proceeded to thank all in attendance for wearing their masks. 5. Public Forum: There was no one to speak in Public Forum 6. Discussion, consideration and action regarding the Fannin County Declaration of Disaster Proclamation for Covid-19: County Judge Moore gave the updated numbers as of this morning as: 1,208 confirmed cases, 187 probable, 129 active cases with 38 of those being in prison, 1,252 recovered and 45 fatalities. The hospitalization rate is above 17%. Judge Moore advised all to follow and observe recommendations put out by CDC and DSHS which can be found on their websites. After some discussion it was decided for additional wording to be added stating that: “admin leave per the elected official” so that an employee can receive their full pay when forced to take off due to Covid-19. It was also noted that Judge Laurine Blake of the 336th District Court, has postponed all jury trials until February 1st, is having all of her court hearings by zoom and is still handling and having grand jury at the theatre. Motion was made to accept the plan with the added wording regarding “admin leave” and extend for another week. Motion was seconded and passed. 8. Discussion ensued about that court going back to the courthouse with input from Tammy Biggar who spoke of the support that exists for that happening. Austin College Hosts Virtual Christmas Eve Service
SHERMAN, TEXAS— Austin College has hosted a Christmas Eve Worship Service in Wynne Chapel for decades for Presbyterian congregations in the ShermanDenison area. In 2020, a pre-recorded Christmas Eve Service will be streamed on Austin College’s Facebook and YouTube pages (Facebook.com/Austin College) and (YouTube.com/ Austin College) on Thursday, December 24, at 6 p.m. The service will include leadership and music from members of Covenant Presbyterian Church and Grand Avenue Presbyterian Church in Sherman, First Presbyterian Church in Denison, and the Austin College A Cappella Choir. KTEN-TV also will broadcast the service at 10:35 p.m. on local Channel 10. Rev. Dr. Lander Bethel, pastor of Grand Avenue Presbyterian Church in Sherman and First Presbyterian Church of Denison; Rev. Lisa Juica Perkins, pastor of Covenant Presbyterian Church in Sherman; and Rev. Dr. John Williams, Austin College Chaplain, have planned and will lead the service. Dr. Bethel will present the sermon. Around twenty talented musicians that make up The Bonham Big Band Express, met Saturday December 12th at the armory to record their 2020 “Virtual” Christmas Special. The concert was set to air on Facebook later that night. Rich Karm, a trombonist and the Director of the band, began the concert with the popular sounds of “Jingle Bells”. The other selections that followed, like the childhood favorite “A Charlie Brown Christmas” and the jazzy “Zat You Santa Claus”, served to transport one to a time before extreme divisiveness brought about by political differences and high anxiety due to Covid-19, existed. The vocalists, Anna Waller, Choral Director for Bonham ISD and local talent Eric Vest, gave delightful performances that enhanced the sometimes
playful, jazzy, reverent and always enjoyable, instrumentals of the band. Rich Karm said that next year’s schedule had not yet been determined but that he would let the Leader know when Bonham can expect their next performance. Anyone wishing to know more about the band, can also find them by their name on Facebook. It has been said that “music hath charms to soothe the savage beast”. Enchanted by the charming melodies filling the air thanks to the musical artistry of the Bonham Big Band Express, I tend to agree. The concert concluded with “Have Yourself a Merry Little Christmas” and as Anna and Eric sang about “being together as the fates allow” I almost teared up. Hopefully, it won’t be too long before “faithful friends who are dear to us gather near to us once more”.

Lake Ralph Hall Prepares to Start Construction New Website and Facebook Page Launched to Provide Updates
LEWISVILLE,TX – December 11, 2020: The Upper Trinity Regional Water District (UTRWD) launched a dedicated website for its Lake Ralph Hall water project scheduled to begin construction in early 2021. The new website (www.lakeralphhall. com) and a dedicated Facebook page (@LakeRalphHall) will share regular updates on the construction activities, contracting opportunities as well as providing resources, newsletter sign up and contact information. Lake Ralph Hall will be Texas’ newest lake and one of the state’s biggest reservoir projects in nearly 30 years. Located on the North Sulphur River in Fannin County just north of the City of Ladonia, Lake Ralph Hall adds a new water source for the UTRWD. Once complete, Lake Ralph Hall will provide an additional 35 million gallons daily (MGD) of water and 19 MGD of reuse water for the residents of Denton, Collin and Fannin coun-
ties. UTRWD currently serves more than 29 cities, towns and utilities supplying drinking water to close to 300,000 customers. Construction of the new lake is scheduled to start in the second quarter of 2021 with water delivery expected by 2025. Construction will begin next year on the dam, roads and a pedestrianfriendly State Highway 34 bridge that will span the lake, and certain environmental improvements. To prepare for construction of the new Hwy 34 bridge, the Ladonia Fossil Park will be temporarily relocated to FM 2990. A permanent, new park is planned downstream of the dam. Construction will benefit the local economy by creating close to 400 new jobs and the net effect on sales of goods and services expended from Lake Ralph Hall amounts to about $36 million in Fannin County. Lake Ralph Hall was named after Texas’ longtime U.S. Congressman Ralph M. Hall, and its
dam named after Ladonia’s visionary mayor Leon Hurse. The lake will provide essential water for UTRWD’s service area whose population is projected to increase nearly fivefold in the next 50 years. About Upper Trinity Upper Trinity is a regional water district created by the Texas Legislature in 1989 for the benefit of cities and utilities in the Denton County area. Its mandate is to develop regional plans for water services, and to provide both water and wastewater services on a wholesale basis to cities and utilities within its service area, including all of Denton County and portions of Dallas and Collin Counties. Upper Trinity is a leader in public education regarding water conservation and water quality protection, and regularly conducts programs concerning drought tolerant landscape techniques, landscape practices and more efficient water use. The Upper Trinity Regional Water District Board of Directors took further action to help protect the watersheds above water supply reservoirs by creating the Upper Trinity Conservation Trust to work with communities, landowners and developers in preservation of watershed and riparian assets. Senior Andrew Campbell earned two first-team selections to lead Honey Grove on the All-District 6-2A-I football team for 2020. Campbell garnered one of four spots at receiver and one of two as an outside linebacker on the first team for the Warriors (4-6), who this fall narrowly missed making a fourth-straight postseason appearance. Junior Jaden Wilson also made the first team as one of the three-selected offensive guards, after Honey Grove finished 2-4 in district play -- one game out of the final playoffs berth in the district and a record which included a win over Como-Pick-
ton, one of the 6-2A-I postseason representatives. Second-team selections for the Warriors included junior Jordan Woods as an offensive guard and sophomore Peter Krahn as an inside linebacker. Krahn at fullback also joined senior Ben Patrick at outside linebacker, sophomore Mason Woodard at defensive tackle, junior Jonas Butler at cornerback, sophomore Anthanie Whitman as a running back and senior Ki Bass as a safety as honorable mentions for the Warriors. Honey Grove will remain in 6-2A-I for football in 2021 with district-champion Cooper, Rivercrest, Wolfe City, Como-Pickton, Celeste and Alba-Golden.

By Rich Hilliard Junior Contreal Judkins won the most valuable player award to lead Fannindel in the District 10-1A-II six-man football honors for 2020. Junior Jaquadrian Scott received the offensive MVP honor and senior Dayton Dunbar garnered the defensive MVP for Fannindel, an 11-1 State quarterfinalist and undefeated district champion this fall. Head coach Gabe Lane along with assistants Erik Pevey and Xavier Brown earned the district’s coaching superlative after guiding the Falcons to the school’s deepest postseason football run since 1988’s State semifinals trip. Fannindel players also mostly populated the first-team offense and defense. First-team offensive recipients included: senior Jawaylon Shaw and sophomore Tahj McGee as tight ends; senior Branden Dillehay at center; sophomore Jabari Dowdy at quarterback; freshman Kemonte Cuba at fullback; senior Dayton Dunbar as a utility back; and senior Stephan Olsen as a special teams player. First-team defensive selections were freshman Kazion Dugan as a cornerback; senior Christopher Jordan at nose guard; Shaw and Dowdy as linemen; Cuba as a safety; and Scott as a utility player. Second-team selections included: senior Toby Childress at tight end; freshman Edgar Lopez as a wide receiver; sophomore Richard Juarez at nose guard; and junior Ivan Lopez as a lineman.

Miller Foundation Gives to Kids
Trustees from the MW and Fair Miller Foundation recently presented a check for $22,000 to the Fannin County Children’s Center. Pictured from left are Dr. Dana Sisk, Sandy Barber, Tyler Todd and Dr. Jerry Hopson. Press Release - Trustees with the M.W. and Fair Miller Foundation have been delivering lots of holiday cheer this month by presenting generous grants to many local schools and nonprofit organizations in Fannin County. One generous gift was for $22,000 to the Fannin County Children’s Center. “Once again, we are excited and honored to receive such a generous gift,” said Sandy Barber, Executive Director of the Children’s Center. “This gift will provide many critical support services for kids from hard places. This donation will make
sure advocacy, counseling, forensic interviews and many other support services are available
to help children heal from the trauma of abuse and neglect.” The M.W. and Fair Miller Foundation was incorporated in 1988 and organized for the betterment and care of the children in Fannin County. Currently serving on the Board of Trustees are Dr. Jerry Hopson, Tyler Todd and Dr. Dana Sisk. The Fannin County Children’s Center is a nonprofit agency that has been serving abused and neglected children since 1993. Programs include CASA, Children’s Advocacy Center and child abuse prevention. ORDINANCE NO. ________ AN ORDINANCE OF THE CITY OF BONHAM, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 13, TO ADD ARTICLE 13.06 TITLED MUNICIPAL DRAINAGE UTILITY SYSTEM, TO ESTABLISH A MUNICIPAL DRAINAGE UTILITY SYSTEM; PROVIDING FOR DRAINAGE SERVICE, BILLING, EXEMPTIONS, DRAINAGE CHARGES, AND APPEALS; PROVIDING FOR REPEALING, SAVINGS, AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Bonham, Texas (“City Council”) has investigated and determined that it would be advantageous and beneficial to the citizens of the City of Bonham, Texas (“City”) in promoting the public health, safety, and welfare of the citizens by adopting a Municipal Drainage Utility System; and WHEREAS, the City Council desires to establish a Municipal Drainage Utility System, pursuant to 552.041, Subsection C, Municipal Drainage Utility Systems of the Texas Local Government Code; the City Council has investigated and determined that a uniform schedule of drainage fees shall be applied against all real property in the proposed service area(s) which includes the entire City subject to charges under this Ordinance; and WHEREAS, the City Council further finds that it would be in the best interest of its citizens to provide for exemptions or credits to the drainage fees, pursuant to 552.041, Subsection C, Municipal Drainage Utility Systems of the Texas Local Government Code; as set forth herein below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BONHAM, TEXAS: SECTION 1. That the facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct. SECTION 2. That Chapter 13 of the Code of Ordinances of the City of Bonham, Texas, is amended by adding Article 13.06, Municipal Drainage Utility System, to read as follows: “ARTICLE 13.06 MUNICIPAL DRAINAGE UTILITY SYSTEM” Sec. 13.06.001. Establishment of Drainage Utility; Service Area; Exemptions, and Dedication of Assets. (a) (b) (c) (d)

The provisions of the Texas Local Government Code, Chapter 552, Subchapter C are hereby adopted to create a Drainage Utility for the City. Accordingly, drainage of the City of Bonham is hereby declared to be a public utility. The service area for the Drainage Utility shall include all real property within the city limits of the City of Bonham as now existing and all which may be annexed hereafter from time to time. The City Council finds that: (1) Impervious cover increases runoff and associated pollutants; and (2) It is equitable to assess the drainage charge to each User based on impervious cover. Pursuant to the Texas Local Government Code, Section 552.053 and Section 580.003, the following shall be exempt from the provisions of this chapter: (1) Property with proper construction and maintenance of a wholly sufficient and privately-owned drainage system; (2) Property held and maintained in its natural state, until such time that the property is developed, and all of the public infrastructure constructed has been accepted by the municipality in which the property is located for maintenance; (3) A subdivided lot, until a structure has been built on the lot and a Certificate of Occupancy has been issued by the City; (4) State agencies; (5) Public or private institutions of higher education; (6) Property owned and operated by the U.S. Department of Veterans Affairs; and, (7) City-owned properties and facilities. The City incorporates into the Drainage Utility System all existing property, facilities, materials, and supplies constituting the City’s drainage system on the effective date of this article. All future acquisitions by the City of real or personal property used in the City’s drainage system shall be maintained as a part of the Drainage Utility.
Sec. 13.06.002. No Effect on Land Owner Obligations Under City Ordinances; No Waiver of Immunity. (a) The establishment of the Drainage Utility by the City does not relieve private land owners, developers, other individuals and entities from responsibility for providing drainage improvements in connection with land development pursuant to the other ordinances of the City or laws of the State of Texas that relate to stormwater runoff, drainage management, or drainage improvements. (b) The establishment of the Drainage Utility does not imply or warrant that a benefitted property will be free from flooding, stormwater pollution, or stream erosion. The City makes no representation that all drainage problems will be remedied. This article does not create additional duties on the part of the City or create new liability or remedies for any flooding, stream erosion, deterioration of water quality, or other damages. Nothing in this article shall be deemed to waive the City’s immunity under law or reduce the need or necessity for flood insurance. Sec. 13.06.003. Other Laws (a) To the extent this Chapter conflicts with any other Chapter in this code, the provisions shall be harmonized when possible, however, this Chapter shall control and supersede any other provision regarding the Drainage Utility System. SECTION 3. Administration of Drainage Utility Sec. 13.06.004. Definitions Terms defined herein are specific to this chapter and shall not be construed as conflicting with similar terms in other parts of this code. Terms not otherwise defined herein shall be given the definitions contained in the Texas Local Government Code, Subchapter C. (a) “The Act” shall mean the Texas Local Government Code, Chapter 552, Subchapter C. (b) “Benefitted Property” shall mean an improved lot or tract to which drainage service is made available under this Chapter. (c) “Commercial Property” shall mean all improved properties within the City other than residential property, including, but not limited to, commercial, industrial, institutional, government, multi- family, mobile-home park, and religious organization land uses. (d) “Cost of Service” shall mean the costs for drainage system service to a Benefitted Property, which shall be the total of: (1) Prorated cost of the acquisition, whether by eminent domain or otherwise, of land, rights-of-way, options to purchase land, easements, and interests in land relating to structures, equipment, and facilities used in draining the Benefitted Property; (2) Prorated cost of the acquisition, construction, repair, and maintenance of structures, equipment, and facilities used in draining the Benefitted Property; (3) Prorated cost of architectural, engineering, legal and related services, plant and specifications, studies, surveys, estimates of cost and of revenue, and all other expenses necessary or incident to planning, providing, or determining the feasibility and practicability of structures, equipment, and facilities used in draining the Benefitted Property; (4) Prorated cost of all machinery, equipment, furniture, and facilities necessary or incident to the provision and operation of draining the Benefitted Property; (5) Prorated cost of funding and financing charges and interest arising from construction projects and the start-up cost of a drainage facility used in draining the Benefitted Property; (6) Prorated cost of debt service and reserve requirements of structures, equipment, and facilities provided by revenue bonds or other drainage revenue-pledge securities or obligations issued by the City; and (7) Administrative costs of operating and maintaining a Drainage Utility System. (e) “Drainage” shall mean bridges, catch basins, channels, conduits, creeks, culverts, detention ponds, ditches, draws, flumes, pipes, pumps, sloughs, treatment works, and appurtenances to those items, whether natural or artificial, or using force or gravity, that are used to draw off surface water from land, carry the water away, collect, store, or treat the water, or divert the water into natural or artificial watercourses. (f) “Drainage Utility Charges” shall mean the levy imposed to recover the cost of the service of the municipality in furnishing drainage for any Benefitted Property, including any interest and penalties; and amounts made in contribution to funding of future drainage system construction by the City. (g) “Drainage System” shall mean the drainage system owned or controlled in whole or in part by the City and dedicated to the service of Benefitted Property, including any future additions, extensions, and improvements thereto and replacement thereof. (h) “ERU (Equivalent Residential Unit)” shall mean the unit of measure used to calculate the Drainage Utility Charge for Commercial Property. The ERU is the average horizontal Impervious Area for single-family property within the City. (i) “Facilities” shall mean the real, personal, or mixed property that is used in providing drainage and included in the system. (j) “Impervious Area” or “Impervious Surface” shall mean a surface which has become compacted or covered with a layer of material so that it is highly resistant to infiltration by water. Impervious Areas include, but are not limited to, compacted soils, graveled surfaces subject to motorized vehicular traffic, walkways, buildings, parking lots, pavement, and ingress/egress driveways. “Impervious Area” or “Impervious Surface” does not include sidewalks located in the public right-of- way and as further defined in Section 4-6-2 of this Code. For purposes of this definition a “walkway” is a pedestrian way in the interior of a lot or tract that is not located in the public right-of-way. (k) “Improved Lot or Tract” shall mean a lot or tract that has a structure, as that term is defined in Section 4-10-3 of this Code, or other improvement on it that causes an Impervious Surface or Area. (l) “Parcel” shall mean one (1) or more lots or portions of lots that are contiguous and under single ownership. (m) “Public Utility” shall mean drainage service that is regularly provided by the City through City property dedicated to that service to the users of benefited property within the service area and that is based on: (1) An established schedule of charges; (2) Use of the police power to implement the service; and (3) Nondiscriminatory, reasonable, and equitable terms consistent with the Act.

“Residential Property” shall mean any improved lot or tract with single-family home, duplex, triplex, quadplex, condominium, or mobile home. “Service Area” shall mean the municipal boundaries of the City. “User” or “Customer” shall mean the person or entity that owns or occupies a Benefitted Property. “Wholly Sufficient and Privately-Owned Drainage System” shall mean drainage from an improved lot or tract which does not discharge into any natural or manmade waterway or drainage infrastructure including public streets, storm drains, culverts, drainage easements, or storm water ponds that are part of the Drainage System.
Sec. 13.06.005. Drainage Utility Fund. A separate fund is hereby created, known as the Drainage Utility Fund, for the purpose of segregating, identifying, and controlling all revenues and expenses attributable to the Drainage Utility. All Drainage Utility Charges shall be deposited as collected and received into this fund and shall be used exclusively for drainage Cost of Service. Such utility revenues may be used for the operation, planning, engineering, inspection, construction, repair, maintenance, improvement, reconstruction, administration, debt issuance cost and debt service, and other reasonable and customary expenses associated with the operation of a utility system. It shall not be necessary that the expenditures from the Drainage Utility Fund for any authorized purpose specifically relate to or benefit any particular Benefited Property from which the revenues were collected. Sec. 13.06.006. Administration of Drainage Utility The Director of Public Works or his designee shall be responsible for the administration of the Drainage Utility, including, but not limited to, enacting any procedures necessary for the administration of the drainage charges and the consideration of appeals, development, and implementation of maintenance and facility improvement programs, state and federal regulatory compliance, and establishing drainage criteria and standards for the drainage system. The Director of Public Works shall keep an accurate record of all properties benefited by the services and facilities of the Drainage Utility. (a) (b) (c) (d) (e) (f) (g)

Sec. 13.06.007. Drainage Utility Charge A Drainage Utility Charge is hereby imposed upon each improved lot and parcel within the Service Area. The Drainage Utility Charge shall be billed after September 30, 2018. Drainage Utility Charges shall be billed on a monthly basis thereafter for the duration of the Drainage Utility. For purposes of imposing the Drainage Utility Charge, all lots and parcels within the City are classified into the following customer categories: (1) Residential Property and (2) Non-Residential Property. The ERU value for the City is determined through an inventory of all improved single-family residential parcels in the City and determination of Impervious Area for each parcel. Evaluation of these data determined that the equivalent residential unit Impervious Area value for assigning charges to commercial properties is eleven thousand eight hundred and forty-four (11,844) square feet. Commercial Rates shall be based on Impervious Area determination for each parcel: Total ERU’s = (Impervious Area/11,844 sq. ft.), minimum 1 ERU The monthly Drainage Utility Charge for properties shall be calculated by multiplying the total number of ERU’s for the parcel by the ERU monthly billing rate. The following ERU monthly billing rate is hereby established and shall be used to calculate the total monthly Drainage Utility Charge for all property located in the City, both residential and commercial, in accordance with the applicable formula established in this subsection: ERU rate = $2.33 per ERU per month. The Director of Public Works or his designee shall be responsible for determining Impervious Area of property based on reliable data, including the appraisal roll, geographic information system technology, aerial photography, or other reliable means for determining Impervious Area. The Director of Public Works may require additional information from the property owner, tenant, manager or developer to make the determination. The amount of a charge may be revised by the Director of Public Works based on any additions to the Impervious Area through the City approved building permit process. The City Council may review the schedule of charges at any time and may increase or decrease charges upon a determination that an increase or decrease is warranted. No Drainage Utility Charge credit shall be given for the installation of drainage facilities required by the code or state law.
Sec. 13.06.008. Billing, Payments, and Penalties (a) Bills or statements for the Drainage Utility Charge shall be rendered by the City for all properties subject to the charge. Bills shall be payable when rendered and shall be considered received by the customer, whether actually received or not, when deposited in the United States mail, postage prepaid, addressed to the utility customer. Bills shall be rendered monthly for the previous month’s service. (b) The Director of Public Works shall assume that each utility account in the service area serves one (1) or more Users of a Benefitted Property, and shall assess the Drainage Charges to the person responsible for payment of the utility account. The Director of Public Works shall calculate the Drainage Charges for all Users and shall assess the Drainage Charges to the person responsible for payment of the utility account. If there is more than one (1) User of a Benefited Property (which is non-Residential), then the charges shall be assessed to the owner of the Benefited Property, unless instructed by the owner of the Benefited Property, in writing, to bill Users on a prorated basis. (c) Bills are due and payable on the date specified thereon and if full payment is not made by the date specified, the bill shall become delinquent. (d) Drainage Utility Charges shall be billed with the City’s other public utility billings and shall be identified separately on the bill as a Drainage Utility Charge. Drainage Utility Charges are subject to the billing procedures, penalties, discounts, interest, and other terms of Chapter 13, Article 13.03, Division 2. (e) Any charge due hereunder which is not paid when due will subject the User to discontinuance of all utility services provided by the City and may be recovered in an action at law or in equity by the City including fixture of a lien against the property, as allowed by law. (f) The City shall have access, at all reasonable times, to any Benefited Property served by the Drainage Utility for necessary inspection, repair of infrastructure or enforcement of this article. Sec. 13.06.009. Appeals Requests for adjustment of a Drainage Utility Charge shall be submitted to the Director of Public Works or his designee. A User may apply for an adjustment if: (1) The User believes that the drainage charge schedule, as applied to the User’s Benefitted Property, does not fairly reflect the Cost of Service to the User’s Benefitted Property; (2) The User disputes the amount of Impervious Area used to calculate the drainage charge; or (3) The User’s Drainage Charge has been assessed in error. The following procedures shall apply to all requests for adjustment of the Drainage Utility Charge: (1) The User shall have the burden of proof. (2) Any User who has paid Drainage Utility Charges and who believes the calculation or determination of the Drainage Utility Charge to be incorrect may, subject to the restrictions set forth in this Chapter, submit an adjustment request to the Director of Public Works. (3) Requests for adjustment of Drainage Utility Charges paid by an Owner, User or Customer making the request shall be in writing and set forth in detail the grounds upon which relief is sought. (4) Adjustment requests will be reviewed by the Director of Public Works within twenty (20) days from the date of receipt of an adjustment request. Adjustments resulting from such a request shall be prospective but may be made retroactive for no greater time period than three (3) monthly billings prior to the receipt of the request. (5) The User requesting an adjustment may be required, at the User’s cost, to provide supplemental information to the Director of Public Works, including, but not limited to, survey data certified by a Texas Registered Professional Land Surveyor (R.P.L.S.), or other documentation of Impervious Area. Failure to provide requested information may result in the denial of the adjustment request. (6) The Director of Public Works’ determination of the adjustment request shall be provided to the User, in writing, within ten (10) days of the later of receipt of the request for adjustment or receipt of any additional information submitted in accordance with this section. If the Director of Public Works approves the request, the adjustment to the Drainage Utility Charge will be made. If the Director of Public Works denies the adjustment request, the User may, within ten (10) days from the date of notification, appeal the decision to a panel consisting of the City Manager, the Director of Finance, the Director of Community Development, and the Director of Public Works. The appeal shall be in writing, contain a succinct and clear statement of the User’s argument and suggested remedy, and be filed with the Planning Director who shall convene the panel. The panel shall have ten (10) business days from the date the appeal is received to review the appeal, make a determination, and notify the User. If the panel denies the appeal, the User shall have five (5) business days from the date of notification to appeal the decision to the City Council. The appeal shall be in writing, containing the information stated above in (b), and be filed with the City Secretary. The City Council shall grant a public hearing within sixty (60) days of receipt of the request for review. The City Council’s decision shall be final. Before imposing a lien for delinquent Drainage Utility Charges, the City shall send notice to the record owner of the Benefitted Property stating the amount of the charges owned, and of the owner’s right to appeal the placement of the lien by producing evidence the delinquent charges are not rightfully owed, by providing such within ten (10) business days from the date of notification to the Director of Utility Billing. The Director of Utility Billing shall not file the lien if the owner shows that the Drainage Utility Charge made the basis of the lien is not owed. When a person pays all of the charges, a lien filed pursuant to this Chapter, shall be released. The paying party shall be responsible for the filing costs of the release.
SECTION 4. That all provisions of the ordinances of the City of Bonham in conflict with the provisions of this Ordinance be, and the same are hereby, repealed, and all other provisions of the ordinances of the City of Bonham not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 6. That an offense committed before the effective date of this Ordinance is governed by prior law and the provisions of the Code of Ordinance, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 7. That this Ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide. Bonham- Graveside services for James Ondal Hamilton age 81 of Bonham were held at 2:00 PM Friday December 18, 2020 at the Gober Cemetery in Gober, TX. with Bro. Mark Posey officiating. Mr. Hamilton passed away Wednesday Dec. 16 at TMC Hospital in Bonham. James was born in Randolph, TX. on December 22, 1938 to James Marcell Hamilton and Alma May (Hicks) Hamilton. He went to grade school at North Fannin Elementary in Ivanhoe, TX. and high school in Bonham. As a boy he worked in the concession stand at Lake Fannin for several summers, he hauled ice with his dad and brother, and also worked in a lumber yard where they bought their materials and supplies for several homes they built in the area. James learned to repair vehicles by watching, learning, and working, and taught himself to be a master mechanic over the years. Around the age of 16, he and his uncle Drummer headed west toward the wheat harvest. They found themselves traveling from west Texas to New Mexico, and on to Washington state where they drove large trucks, combines, and dozers up the mountains, cutting and harvesting the wheat fields. In 1960 he married the love of his life Joyce, only to receive a “GREETINGS” notice from the U.S. Army just a few months after their wedding. He was sent to Fort Chaffee, Arkansas for his basic training and on to Fort Ord, California where Joyce joined him. While there they had two beautiful sons, Jeffrey Kenton and James Brent. Returning from California, James worked for his dad a few months before attaining a job at Carter Chevrolet as service manager, also later sold vehicles, and became manager at C. & C. agency for some 20 years. James is survived by his wife Joyce of the home, his two sons, Kent Hamilton of Denton, TX., and Brent Hamilton and wife Lisa of Telephone. Also, his best friend Jimmy Page that he loved like his own. Three grandchildren, Brentney Hamilton and husband McClain Watson, Ashton Cabler and husband Charlie, and Tyler Hamilton, three great grandsons, Coy and Callan Cabler and Waylon Watson, his sister, Faye J. White and husband Tommy, along with several nieces and nephews. He was preceded in death by his father James Marcell (Red) Hamilton and mother Alma May Hamilton, and brother Harold Bland Hamilton. Bettye married Ted Ray Wilson on February 19, 1954 in Bonham, TX. She worked for the Bonham VA as a contracting officer. Bettye was a loving wife, mother, grandmother, great grandmother, and friend. She was a member of Bois D’Arc Creek Cowboy Church. Bettye is survived by husband Ted Wilson of Bonham; daughterin-law, Terri Wilson of McKinney, TX, wife of Bettye’s late son, Jerry Glen Wilson; grandchildren, Kristen Wilson and Amy Wilson; and 7 great grandchildren.
