Regarding Introductions, County Judge Randy Moore recognized former County Judge Spanky Carter. 5. Public Forums: Former County Judge Spanky Carter thanked the court for allowing him to speak. He stated he was at this morning’s meeting to speak about Commissioner Whitlock. Permission was given for him to sidestep the rule of not singling out anyone. He expressed his appreciation for the good work, service and leadership of Commissioner Whitlock. Out of Commissioner Whitlock’s twelve years of service to Fannin County, he was grateful and honored for the eight years he was able to serve with him. Former Judge Carter read an encouraging note of congratulations, well wishes and thanks for Whitlock’s service, from President Donald Trump and First Lady Melania. He then presented Commissioner Whitlock with a signed framed document from the President of the United States. Next to speak in Public Forum was District Judge Laurine Blake who wanted to make it known to the court and the public, that on January 1, 2021 there will be a swearing in ceremony for all the newly elected and re-elected officials at 9:00 a.m. at the Multi-Purpose Complex. She stated this is a historic occasion with local media being there.

Fannin County Network Administrator Dustin Morrow read a comment from the online chat that was submitted by John Finn. 6. Discussion, consideration and action regarding the Fannin County Declaration of Disaster Proclamation for Covid-19: County Judge Randy Moore

began his update by echoing Pastor Prince’s words of hope that God would soon put an end to Covid. He continued, that as of 8:15 a.m. today there were 1,362 confirmed cases, 217 probable cases bringing the total to 1,579 Covid-19 cases in the county. Of the total cases, there are 149 active cases with 37 of those being in the prison, 1,394 recovered cases and 49 fatalities in the county. Judge Moore spoke about the good news of the vaccines that will be coming into our area and who would be eligible to be the first recipients of the vaccine. He went over which pharmacies would be receiving and administering the vaccines and how the phases of the operation of

administering the vaccines would work. 10/9/12 He asked for citizens to have patience in obtaining a vaccination and emphasized his belief in the quality of the two vaccines he has researched which are the Pfizer and Moderna vaccines. Judge Moore also dispelled the rumor that anyone would be forced to receive the vaccine as he said, no-one would be forced to take the vaccine. Stating his approval of the Proclamation, he asked it extended two weeks to Jan 5th and the next Commissioners Court meeting. Motion was made by Commissioner Magness, seconded by Commissioner Self and passed to extend the Proclamation to Jan 5, 2021. 7. Discussion, consider-

ation and action regarding the Covid-19 Response and Continuity of Operations Plan for Fannin County: County Judge Randy Moore touched briefly on the changes made last week to the plan and said no other changes have been made. He said that if he is contacted about Covid-19 testing for himself and county employees, he would get the information out immediately. Judge Moore said he was sure that would not happen before Christmas. The Judge believes there will be a huge push for people to get the vaccine sometime during January. He commented that even with one dose of the vaccine a person gets some protection but with the second dose there is a 94 to 95% effectiveness. Motion was made by Commissioner Whitlock to extend the plan two weeks to January 5, 2021, and seconded by Commissioner Magness. Motion passed. 8. Discussion and update regarding Courthouse Restoration: Commissioner Lackey gave an update of the trusses most likely being done by tomorrow (Wednesday, December 23rd) in the afternoon, stone work around the windows progressing well and he saw interior mechanical work going on. He said the chimneys should be done by the end of next week as well as decking on the trusses. Judge Moore added that

he believes the courthouse will be closed-in sometime in January and that they are working on the second floor first. Commissioner Lackey responded that they are working on the windows according to size and corrected the date for the close-in to be sometime in February. 9. Discussion regarding EMS report for November 2020: Commissioner Lackey said that Fire Chief Scott Ridling was not in attendance to report due to illness. 10. Discussion, consideration and action to approve minutes from 09/01/2020: Motion was made by Commissioner Magness, seconded by Commissioner Self and passed to approve minutes. 11. Discussion, consideration and action to change the name from Habitat for Humanity to Housing Helpers on Fannin County Jury Forms regarding donations to organization of choice for jury pay: Chantal Carey, who is on the board of Housing Helpers explained why it has become necessary to change their name to continue the work they have been doing under “Habitat for Humanity” to “Housing Helpers.” County Judge Randy Moore said he would need to look at a copy of their by-laws and see how they are operating. He explained that he would then send that information to all the Commissioners as they would all need to agree,

Discussion, consideration and action to approve Newly Elected Official’s bond for the following office and term: Edwina Lane – Commissioner Precinct 1 – 4 year - term: Motion was made, seconded and passed to approve the bond. 14. Discussion, consideration and action to approve Re-Elected Official’s bonds for the following offices and terms: Jerry Magness – Commissioner Precinct 3 – 4 year term; Laurine J. Blake – 336th District Judge – 4 year term; Richard Glaser – District Attorney – 4 year term; Mark Johnson – Sheriff – 4 year term; Kevin Mayberry – Constable Precinct 3 – 4 year term; Jimmy D. Discussion, consideration and action to appoint Elizabeth Ellis, Romiro Ortiz, Debbie Whitfield and Janice Elmore to the Fannin County Child Welfare Board: District Clerk Nancy Young who is also on the Fannin County Child Welfare Board asked for the approval of the aforementioned. Motion was made, seconded and passed. 16. Discussion, consideration and action to allow vested employees to retain county insurance at the employee’s cost after leaving Fannin County: Tax Assessor/Collector Gail Young gave her reasons of support for this item. Commissioner Lackey also threw his support behind this and explained how it does not cost the county anything and is a benefit to the employee. Discussion ensued with Judge Moore adding his thoughts.

Discussion, consideration and action regarding which County offices will be in the Courthouse after restoration is complete: Fannin County Purchasing Agent Michelle Case led an in depth discussion regarding plans for the first floor of the restored Courthouse. Judge Moore spoke about Judge Butlers’ opinions of his court being located in the Courthouse. Commissioner Lackey gave his differing opinions citing security issues while discussing the need for relocating some offices to the Justice Center at a later date. Input came from Fannin Co Clerk Tammy Biggar and Chief Clerk Kim Richards for JP Pct 1 as well as Commissioners Self and Magness. District Attorney Richard Glaser read a note from District Judge Blake, who could not be present, expressing her opinions on which offices should be in the restored Courthouse with an emphasis on why she believes it is important for the District Court to be returned

to the second floor of the restored Courthouse. With so many different opinions, and a deadline approaching for signage, furniture and other issues needed to move ahead, County Judge Randy Moore suggested for there to be a meeting scheduled next Wednesday the 30th with all parties involved to work out the best decision for the first and second floorplans of the Courthouse. There was no argument to approving the floorplan of the third floor of the Courthouse. Motion was made by Commissioner Lackey to approve the third floorplan. Commissioner Magness seconded it and motion to approve plans for the third floor passed. 20. Discussion, consideration and action regarding personnel or supplies for Covid-19 from the CARES Act Grant or other funding: Michelle Case gave an update 21. Final discussion, Randy Pendergrass said we would look for sponsors for this event, and it was discussed that sponsor would help our event grow. All was in favor of looking for sponsors to help buy jerseys for this event. Press Release - Trustees with the M.W. and Fair Miller Foundation have been delivering lots of holiday cheer this month by presenting generous grants to many local schools and non-profit organizations in Fannin County. One generous gift was for $22,000 to the Fannin County Children’s Center. “Once again, we are excited and honored to receive such a generous gift,” said Sandy Barber, Executive Director of the Children’s Center. “This gift will provide many critical

support services for kids from hard places. This donation will make sure advocacy, counseling, forensic interviews and many other support services are available to help children heal from the trauma of abuse and neglect.” The M.W. and Fair Miller Foundation was incorporated in 1988 and organized for the betterment and care of the children in Fannin County. Currently serving on the Board of Trustees are Dr. Jerry Hopson, Tyler Todd and Dr. Dana Sisk.

Press Release - Bonham Rotary is in its 100th year of service to the community! In celebration of those 100 years of service, our club has decided to sponsor a monthly service project. The November service project was to col-

lect and donate hoodies, blankets, underwear and socks to Bonham ISD to distribute to Jr. High and High School students in need. Rotarian Newt Cunningham served as Chair of this service project. Through

his efforts, Bonham Rotary was able to work with our local Walmart and their Manager, Faron Long to obtain hoodies at a reduced cost and other clothing for BISD students. Another partnership between Bonham Rotary and Mrs. McGovern and the Church of Jesus Christ of Latter Day Saints garnered 21 blankets for the project. Members of the

First United Methodist Church donated socks and underwear through an “Undie Sunday” event. Pastor Dana Coker of the FUMC is also a Rotarian and she coordinated the distribution of the items to BISD school counselors. Many people contributed to the success of this service project lead by Rotarians. Working together, we can accomplish much!

Much of the region saw below-normal temperatures, and the largest precipitation amounts fell across southeastern Texas, extending eastward to Louisiana and northeastward to the Tennessee Valley. Locations east of Austin, Texas, and along the western Gulf Coast, saw above-normal precipitation (1 to 1.5 inch totals, with some localities receiving more than 2 inches), leading to some D1 and D2 improvement near Austin and a reduction in D0 coverage in southern Louisiana. Western and central Texas saw some degradation in D1-D3 areas, with lack of precipitation (less than 10 percent of normal precipitation in the last 90 days) and low relative humidity. Some slight trimming of the abnormally dry (D0) area in north-central Oklahoma, with 0.25 to 0.5 inches of precipitation falling last week, near-normal average temperatures, and 30-60 day precipitation totals ranging between 150 and 175 percent of normal. Some D0 reduction was also warranted in northern Louisiana and central Mississippi, as SPIs across several time periods show mixed weak above and below-normal signals, indicating near-normal conditions.

AUSTIN— Start the new year in nature with a First Day Hike at a Texas State Park. This New Year’s Day, walk, bike or paddle your way into 2021 on a First Day Hike at 89 Texas State Parks. First Day Hikes at Texas’ state parks and natural areas aim to help visitors commit to their New Year’s resolutions to get healthy. Last year, 5,242 visitors ushered in 2020 by hiking, biking and riding a total of 9,564 miles statewide. Find a list of this year’s First Day Hikes on the TPWD calendar page. To help with social distancing, many hikes will be self-guided while guided hikes may limit the number of participants. “If nothing else, 2020 has shown us the value of getting outdoors,” said Rodney Frank-

lin, Director of Texas State Parks. “Personally, I am looking forward to saying goodbye to 2020, having some blackeyed peas and starting out the new year with a First Day Hike. Spending time outdoors is a great way to connect with friends and family in a healthy way. While we must still recreate responsibly, I hope that everyone will join us in ushering in 2021 with a First Day Hike at your favorite state park.” Trails at Texas State Parks range in length and difficulty levels across the state. Some short, easy trails are perfect for family-friendly scenic strolls, while others are more strenuous for experienced hikers. Trail maps for all Texas State Parks can be found on the Texas Parks and Wildlife Department’s (TPWD) website and

individual park webpages. Anyone planning a trip to a Texas State Park should keep in mind that parks are operating at a limited capacity. Reserving a day pass in advance is highly recommended since some parks are expected to reach their capacity limit. Game Warden Field Notes

Crossbow Drive-by Two Trinity County game wardens received a call from the local sheriff’s office about a hunter who had just shot a buck in a yard from a vehicle. The landowner thought a rifle was used and was able to write down the license plate number and get a good description of the vehicle. The wardens and sheriff’s office called a local constable who lives in the same neighborhood for some back up. The constable was able to find the vehicle quickly while the wardens traveled to the scene. After a brief interview upon their arrival, the hunter admitted to shooting the buck out of his vehicle with a crossbow from the public roadway. Wardens filed multiple charges for hunting from the public roadway and hunting during closed season. Cases pending. Drunk and on the Hunt A Cass County game warden was on patrol when they saw a vehicle stop twice near a large pasture and stick what they thought was a rifle out of the window. While following the vehicle to confirm what they had seen, the subject was driving erratically on the county road. When the vehicle stopped again, the warden conducted a traffic stop. The warden then approached the vehicle and saw an AR-15 rifle in the passenger’s seat. The weapon was secured, and the driver was checked for warrants. The warden noticed the thermal scope was still on, so they asked the driver about hunting and told him that they had seen him stick the rifle out of the window. The driver then admitted to hunting the field for hog and admitted to being intoxicated. The driver was arrested and charged with hunting without landowner consent and hunting non-game from a motor vehicle.

Herb‘Ivore Hunter — Freestone County Game Wardens checked a suspect recently who was leaving a deer camp. The person did not have his hunting license with him so they returned to the camp. After being confronted about his extreme nervousness, the person handed over a bag or marijuana. A search of the camp revealed more marijuana and a bag of cocaine. The suspect was already on probation for distribution of marijuana. His probation officer’s business card was found in the same container as the cocaine. Cases are pending. I Confess — Van Zandt County Game Wardens were visiting the Justice of the Peace in Ben Wheeler when the wardens noted a large metal bowl covered in blood in the front yard at a house next door. The wardens visited with the occupant of the home who stated he had helped a friend clean a deer. When asked if he had killed a deer, the man replied, “I can’t hunt anymore

because I’m a felon!” When asked the name of his friend, the man became confused and stated, “I knew this was going to happen.” The man went on to confess to killing three deer on opening day. A 4-point and two 8-point antlers were seized along with one rifle. Cases are pending. Here Comes the Judge — A Dewitt County Game Warden responded to a call concerning shots fired from a public road in a subdivision. He tracked down two suspects who confessed to shooting a hog. Three cases were filed against the suspects. It turns out the two men shot the hog in front of the house of the judge who will handle their cases.

Mrs. Vickie was born June 12th, 1951 in Bonham, TX to Newman Wylie and Betty Marie Fox of Gober, TX. She enjoyed being with family and driving to Gober every Saturday to spend time with her mom, dad, and sister Sherry Brooks. As well as spending time with her 2 sons, Justin and Blake; granddaughter, Faith, family, friends, and co-workers past and present. She loved God and a member of the Gober Baptist Church in Gober, TX. When she married the love of her life, Walter West, they were members of Oakridge Baptist Church in Denison, TX. Her untimely passing left a void in everyone lives that she touched and loves here on Earth, but she will live on forever in our hearts and in our memory as she has the best view and watching over everyone that she cares for and loves. Press Release - M.W. and Fair Miller Foundation presented the Honey Grove ISD with a generous gift of $10,000. This donation is to help the school with the snacks and other food items that are sent home with the needy children of the district each Friday. ORDINANCE NO. ________ AN ORDINANCE OF THE CITY OF BONHAM, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 13, TO ADD ARTICLE 13.06 TITLED MUNICIPAL DRAINAGE UTILITY SYSTEM, TO ESTABLISH A MUNICIPAL DRAINAGE UTILITY SYSTEM; PROVIDING FOR DRAINAGE SERVICE, BILLING, EXEMPTIONS, DRAINAGE CHARGES, AND APPEALS; PROVIDING FOR REPEALING, SAVINGS, AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Bonham, Texas (“City Council”) has investigated and determined that it would be advantageous and beneficial to the citizens of the City of Bonham, Texas (“City”) in promoting the public health, safety, and welfare of the citizens by adopting a Municipal Drainage Utility System; and WHEREAS, the City Council desires to establish a Municipal Drainage Utility System, pursuant to 552.041, Subsection C, Municipal Drainage Utility Systems of the Texas Local Government Code; the City Council has investigated and determined that a uniform schedule of drainage fees shall be applied against all real property in the proposed service area(s) which includes the entire City subject to charges under this Ordinance; and WHEREAS, the City Council further finds that it would be in the best interest of its citizens to provide for exemptions or credits to the drainage fees, pursuant to 552.041, Subsection C, Municipal Drainage Utility Systems of the Texas Local Government Code; as set forth herein below. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BONHAM, TEXAS: SECTION 1. That the facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct. SECTION 2. That Chapter 13 of the Code of Ordinances of the City of Bonham, Texas, is amended by adding Article 13.06, Municipal Drainage Utility System, to read as follows: “ARTICLE 13.06 MUNICIPAL DRAINAGE UTILITY SYSTEM” Sec. 13.06.001. Establishment of Drainage Utility; Service Area; Exemptions, and Dedication of Assets. (a) (b) (c) (d)

The provisions of the Texas Local Government Code, Chapter 552, Subchapter C are hereby adopted to create a Drainage Utility for the City. Accordingly, drainage of the City of Bonham is hereby declared to be a public utility. The service area for the Drainage Utility shall include all real property within the city limits of the City of Bonham as now existing and all which may be annexed hereafter from time to time. The City Council finds that: (1) Impervious cover increases runoff and associated pollutants; and (2) It is equitable to assess the drainage charge to each User based on impervious cover. Pursuant to the Texas Local Government Code, Section 552.053 and Section 580.003, the following shall be exempt from the provisions of this chapter: (1) Property with proper construction and maintenance of a wholly sufficient and privately-owned drainage system; (2) Property held and maintained in its natural state, until such time that the property is developed, and all of the public infrastructure constructed has been accepted by the municipality in which the property is located for maintenance; (3) A subdivided lot, until a structure has been built on the lot and a Certificate of Occupancy has been issued by the City; (4) State agencies; (5) Public or private institutions of higher education; (6) Property owned and operated by the U.S. Department of Veterans Affairs; and, (7) City-owned properties and facilities. The City incorporates into the Drainage Utility System all existing property, facilities, materials, and supplies constituting the City’s drainage system on the effective date of this article. All future acquisitions by the City of real or personal property used in the City’s drainage system shall be maintained as a part of the Drainage Utility.

Sec. 13.06.002. No Effect on Land Owner Obligations Under City Ordinances; No Waiver of Immunity. (a) The establishment of the Drainage Utility by the City does not relieve private land owners, developers, other individuals and entities from responsibility for providing drainage improvements in connection with land development pursuant to the other ordinances of the City or laws of the State of Texas that relate to stormwater runoff, drainage management, or drainage improvements. (b) The establishment of the Drainage Utility does not imply or warrant that a benefitted property will be free from flooding, stormwater pollution, or stream erosion. The City makes no representation that all drainage problems will be remedied. This article does not create additional duties on the part of the City or create new liability or remedies for any flooding, stream erosion, deterioration of water quality, or other damages. Nothing in this article shall be deemed to waive the City’s immunity under law or reduce the need or necessity for flood insurance. Sec. 13.06.003. Other Laws (a) To the extent this Chapter conflicts with any other Chapter in this code, the provisions shall be harmonized when possible, however, this Chapter shall control and supersede any other provision regarding the Drainage Utility System. SECTION 3. Administration of Drainage Utility Sec. 13.06.004. Definitions Terms defined herein are specific to this chapter and shall not be construed as conflicting with similar terms in other parts of this code. Terms not otherwise defined herein shall be given the definitions contained in the Texas Local Government Code, Subchapter C. (a) “The Act” shall mean the Texas Local Government Code, Chapter 552, Subchapter C. (b) “Benefitted Property” shall mean an improved lot or tract to which drainage service is made available under this Chapter. (c) “Commercial Property” shall mean all improved properties within the City other than residential property, including, but not limited to, commercial, industrial, institutional, government, multi- family, mobile-home park, and religious organization land uses. (d) “Cost of Service” shall mean the costs for drainage system service to a Benefitted Property, which shall be the total of: (1) Prorated cost of the acquisition, whether by eminent domain or otherwise, of land, rights-of-way, options to purchase land, easements, and interests in land relating to structures, equipment, and facilities used in draining the Benefitted Property; (2) Prorated cost of the acquisition, construction, repair, and maintenance of structures, equipment, and facilities used in draining the Benefitted Property; (3) Prorated cost of architectural, engineering, legal and related services, plant and specifications, studies, surveys, estimates of cost and of revenue, and all other expenses necessary or incident to planning, providing, or determining the feasibility and practicability of structures, equipment, and facilities used in draining the Benefitted Property; (4) Prorated cost of all machinery, equipment, furniture, and facilities necessary or incident to the provision and operation of draining the Benefitted Property; (5) Prorated cost of funding and financing charges and interest arising from construction projects and the start-up cost of a drainage facility used in draining the Benefitted Property; (6) Prorated cost of debt service and reserve requirements of structures, equipment, and facilities provided by revenue bonds or other drainage revenue-pledge securities or obligations issued by the City; and (7) Administrative costs of operating and maintaining a Drainage Utility System. (e) “Drainage” shall mean bridges, catch basins, channels, conduits, creeks, culverts, detention ponds, ditches, draws, flumes, pipes, pumps, sloughs, treatment works, and appurtenances to those items, whether natural or artificial, or using force or gravity, that are used to draw off surface water from land, carry the water away, collect, store, or treat the water, or divert the water into natural or artificial watercourses. (f) “Drainage Utility Charges” shall mean the levy imposed to recover the cost of the service of the municipality in furnishing drainage for any Benefitted Property, including any interest and penalties; and amounts made in contribution to funding of future drainage system construction by the City. (g) “Drainage System” shall mean the drainage system owned or controlled in whole or in part by the City and dedicated to the service of Benefitted Property, including any future additions, extensions, and improvements thereto and replacement thereof. (h) “ERU (Equivalent Residential Unit)” shall mean the unit of measure used to calculate the Drainage Utility Charge for Commercial Property. The ERU is the average horizontal Impervious Area for single-family property within the City. (i) “Facilities” shall mean the real, personal, or mixed property that is used in providing drainage and included in the system. (j) “Impervious Area” or “Impervious Surface” shall mean a surface which has become compacted or covered with a layer of material so that it is highly resistant to infiltration by water. Impervious Areas include, but are not limited to, compacted soils, graveled surfaces subject to motorized vehicular traffic, walkways, buildings, parking lots, pavement, and ingress/egress driveways. “Impervious Area” or “Impervious Surface” does not include sidewalks located in the public right-of- way and as further defined in Section 4-6-2 of this Code. For purposes of this definition a “walkway” is a pedestrian way in the interior of a lot or tract that is not located in the public right-of-way. (k) “Improved Lot or Tract” shall mean a lot or tract that has a structure, as that term is defined in Section 4-10-3 of this Code, or other improvement on it that causes an Impervious Surface or Area. (l) “Parcel” shall mean one (1) or more lots or portions of lots that are contiguous and under single ownership. (m) “Public Utility” shall mean drainage service that is regularly provided by the City through City property dedicated to that service to the users of benefited property within the service area and that is based on: (1) An established schedule of charges; (2) Use of the police power to implement the service; and (3) Nondiscriminatory, reasonable, and equitable terms consistent with the Act.

“Residential Property” shall mean any improved lot or tract with single-family home, duplex, triplex, quadplex, condominium, or mobile home. “Service Area” shall mean the municipal boundaries of the City. “User” or “Customer” shall mean the person or entity that owns or occupies a Benefitted Property. “Wholly Sufficient and Privately-Owned Drainage System” shall mean drainage from an improved lot or tract which does not discharge into any natural or manmade waterway or drainage infrastructure including public streets, storm drains, culverts, drainage easements, or storm water ponds that are part of the Drainage System.

Sec. 13.06.005. Drainage Utility Fund. A separate fund is hereby created, known as the Drainage Utility Fund, for the purpose of segregating, identifying, and controlling all revenues and expenses attributable to the Drainage Utility. All Drainage Utility Charges shall be deposited as collected and received into this fund and shall be used exclusively for drainage Cost of Service. Such utility revenues may be used for the operation, planning, engineering, inspection, construction, repair, maintenance, improvement, reconstruction, administration, debt issuance cost and debt service, and other reasonable and customary expenses associated with the operation of a utility system. It shall not be necessary that the expenditures from the Drainage Utility Fund for any authorized purpose specifically relate to or benefit any particular Benefited Property from which the revenues were collected. Sec. 13.06.006. Administration of Drainage Utility The Director of Public Works or his designee shall be responsible for the administration of the Drainage Utility, including, but not limited to, enacting any procedures necessary for the administration of the drainage charges and the consideration of appeals, development, and implementation of maintenance and facility improvement programs, state and federal regulatory compliance, and establishing drainage criteria and standards for the drainage system. The Director of Public Works shall keep an accurate record of all properties benefited by the services and facilities of the Drainage Utility. (a) (b) (c) (d) (e) (f) (g)

Sec. 13.06.007. Drainage Utility Charge A Drainage Utility Charge is hereby imposed upon each improved lot and parcel within the Service Area. The Drainage Utility Charge shall be billed after September 30, 2018. Drainage Utility Charges shall be billed on a monthly basis thereafter for the duration of the Drainage Utility. For purposes of imposing the Drainage Utility Charge, all lots and parcels within the City are classified into the following customer categories: (1) Residential Property and (2) Non-Residential Property. The ERU value for the City is determined through an inventory of all improved single-family residential parcels in the City and determination of Impervious Area for each parcel. Evaluation of these data determined that the equivalent residential unit Impervious Area value for assigning charges to commercial properties is eleven thousand eight hundred and forty-four (11,844) square feet. Commercial Rates shall be based on Impervious Area determination for each parcel: Total ERU’s = (Impervious Area/11,844 sq. ft.), minimum 1 ERU The monthly Drainage Utility Charge for properties shall be calculated by multiplying the total number of ERU’s for the parcel by the ERU monthly billing rate. The following ERU monthly billing rate is hereby established and shall be used to calculate the total monthly Drainage Utility Charge for all property located in the City, both residential and commercial, in accordance with the applicable formula established in this subsection: ERU rate = $2.33 per ERU per month. The Director of Public Works or his designee shall be responsible for determining Impervious Area of property based on reliable data, including the appraisal roll, geographic information system technology, aerial photography, or other reliable means for determining Impervious Area. The Director of Public Works may require additional information from the property owner, tenant, manager or developer to make the determination. The amount of a charge may be revised by the Director of Public Works based on any additions to the Impervious Area through the City approved building permit process. The City Council may review the schedule of charges at any time and may increase or decrease charges upon a determination that an increase or decrease is warranted. No Drainage Utility Charge credit shall be given for the installation of drainage facilities required by the code or state law.

Sec. 13.06.008. Billing, Payments, and Penalties (a) Bills or statements for the Drainage Utility Charge shall be rendered by the City for all properties subject to the charge. Bills shall be payable when rendered and shall be considered received by the customer, whether actually received or not, when deposited in the United States mail, postage prepaid, addressed to the utility customer. Bills shall be rendered monthly for the previous month’s service. (b) The Director of Public Works shall assume that each utility account in the service area serves one (1) or more Users of a Benefitted Property, and shall assess the Drainage Charges to the person responsible for payment of the utility account. The Director of Public Works shall calculate the Drainage Charges for all Users and shall assess the Drainage Charges to the person responsible for payment of the utility account. If there is more than one (1) User of a Benefited Property (which is non-Residential), then the charges shall be assessed to the owner of the Benefited Property, unless instructed by the owner of the Benefited Property, in writing, to bill Users on a prorated basis. (c) Bills are due and payable on the date specified thereon and if full payment is not made by the date specified, the bill shall become delinquent. (d) Drainage Utility Charges shall be billed with the City’s other public utility billings and shall be identified separately on the bill as a Drainage Utility Charge. Drainage Utility Charges are subject to the billing procedures, penalties, discounts, interest, and other terms of Chapter 13, Article 13.03, Division 2. (e) Any charge due hereunder which is not paid when due will subject the User to discontinuance of all utility services provided by the City and may be recovered in an action at law or in equity by the City including fixture of a lien against the property, as allowed by law. (f) The City shall have access, at all reasonable times, to any Benefited Property served by the Drainage Utility for necessary inspection, repair of infrastructure or enforcement of this article. Sec. 13.06.009. Appeals Requests for adjustment of a Drainage Utility Charge shall be submitted to the Director of Public Works or his designee. A User may apply for an adjustment if: (1) The User believes that the drainage charge schedule, as applied to the User’s Benefitted Property, does not fairly reflect the Cost of Service to the User’s Benefitted Property; (2) The User disputes the amount of Impervious Area used to calculate the drainage charge; or (3) The User’s Drainage Charge has been assessed in error. The following procedures shall apply to all requests for adjustment of the Drainage Utility Charge: (1) The User shall have the burden of proof. (2) Any User who has paid Drainage Utility Charges and who believes the calculation or determination of the Drainage Utility Charge to be incorrect may, subject to the restrictions set forth in this Chapter, submit an adjustment request to the Director of Public Works. (3) Requests for adjustment of Drainage Utility Charges paid by an Owner, User or Customer making the request shall be in writing and set forth in detail the grounds upon which relief is sought. (4) Adjustment requests will be reviewed by the Director of Public Works within twenty (20) days from the date of receipt of an adjustment request. Adjustments resulting from such a request shall be prospective but may be made retroactive for no greater time period than three (3) monthly billings prior to the receipt of the request. (5) The User requesting an adjustment may be required, at the User’s cost, to provide supplemental information to the Director of Public Works, including, but not limited to, survey data certified by a Texas Registered Professional Land Surveyor (R.P.L.S.), or other documentation of Impervious Area. Failure to provide requested information may result in the denial of the adjustment request. (6) The Director of Public Works’ determination of the adjustment request shall be provided to the User, in writing, within ten (10) days of the later of receipt of the request for adjustment or receipt of any additional information submitted in accordance with this section. If the Director of Public Works approves the request, the adjustment to the Drainage Utility Charge will be made. If the Director of Public Works denies the adjustment request, the User may, within ten (10) days from the date of notification, appeal the decision to a panel consisting of the City Manager, the Director of Finance, the Director of Community Development, and the Director of Public Works. The appeal shall be in writing, contain a succinct and clear statement of the User’s argument and suggested remedy, and be filed with the Planning Director who shall convene the panel. The panel shall have ten (10) business days from the date the appeal is received to review the appeal, make a determination, and notify the User. If the panel denies the appeal, the User shall have five (5) business days from the date of notification to appeal the decision to the City Council. The appeal shall be in writing, containing the information stated above in (b), and be filed with the City Secretary. The City Council shall grant a public hearing within sixty (60) days of receipt of the request for review. The City Council’s decision shall be final. Before imposing a lien for delinquent Drainage Utility Charges, the City shall send notice to the record owner of the Benefitted Property stating the amount of the charges owned, and of the owner’s right to appeal the placement of the lien by producing evidence the delinquent charges are not rightfully owed, by providing such within ten (10) business days from the date of notification to the Director of Utility Billing. The Director of Utility Billing shall not file the lien if the owner shows that the Drainage Utility Charge made the basis of the lien is not owed. When a person pays all of the charges, a lien filed pursuant to this Chapter, shall be released. The paying party shall be responsible for the filing costs of the release.

SECTION 4. That all provisions of the ordinances of the City of Bonham in conflict with the provisions of this Ordinance be, and the same are hereby, repealed, and all other provisions of the ordinances of the City of Bonham not in conflict with the provisions of this Ordinance shall remain in full force and effect. SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section of this Ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 6. That an offense committed before the effective date of this Ordinance is governed by prior law and the provisions of the Code of Ordinance, as amended, in effect when the offense was committed, and the former law is continued in effect for this purpose. SECTION 7. That this Ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide. Dodd City seniors Dani Baccus and Journie Hilliard each garnered a spot on the Texas Girls Coaches Association Class 1A all-state volleyball team for the 2020 season. Baccus, a Hardin-Simmons women’s basketball commit, stepped into the role of being the primary setter for the Lady Hornets who last month made their first regional final appearance in volleyball since 2001. She finished the season with 390 assists and 85 digs. Meanwhile, Hilliard reprised her role as a hitter and blocker at the net for Dodd City, which made its 26th postseason appearance in the last 31 years. Hilliard had 346 kills and 78 blocks.

Press Release - In all, 224 children served by the Fannin County Children’s Center will have gifts of coats, shoes, books, games, toys and other items to open on Christmas morning, thanks to several generous donors and many hard-working volunteers and staff. This year’s effort to provide Christmas presents for the children and youth served by CASA and the Children’s Advocacy Center looked different than in year’s past. Some of the changes were due to the pandemic, but others were because the agency’s caseload has grown so much in recent years. This year the staff and volunteers of the Children’s Center created a pop-up store at the Bonham Armory for the week of December 14. Parents, caregivers or advocates came to the store at a designated times to “shop” for the children in their care. Each child got a book and either a coat, hoodie or pair of shoes. Each family got one family board game and plenty of wrapping paper. Caregivers were also able to select toys and other gifts using a point system.

“For the last few years, our traditional way of doing Christmas had grown to be more than our staff could reasonably manage. I started asking other CASA and CAC programs how they did Christmas, and we learned of this pop-up store idea,” said Sandy Barber of the Children’s Center. “This way of getting gifts to kids turned out to be much more empowering for our families and allowed for more volunteer involvement.” “Our community was amazing in their generosity once again! So many people gave what they could and it all added up to make sure all of the children served by CASA and the Children’s Advocacy Center have something special for Christmas,” said Barber. Rebel Roots Boutique, WalMart, Bonham Chrysler, CapTex, Legend Bank, First United Bank, Fannin Federal Credit Union, Fix and Feed, Tax Assessor Collector Office, Blessings and Butterflies, Stay Grounded Coffee Company, Warrior Tire, Red River Gypsies and 9-11 Nutrition put up teddy bear trees to help the center collect presents.

“Many of these businesses have been doing this for as long as anyone can remember. Some places were new this year too,” said Barber. “We are very grateful for their faithful and generous support of our Christmas Drive.” Gifting The Cycle is a nonprofit that gives bicycles to children in the North Texas area. They gave 50 bicycles to the Children’s Center for Christmas presents. Presents were given to the children and youth who are being served by the Children’s Center’s two primary programs: CASA and the Children’s Advocacy Center. Some of the children are living in foster homes, away from family and friends. Other children have gone to live with grandparents or other relatives as a result of abuse or neglect. Many of these families struggle financially when one or more children suddenly come to live with them.
