Thank You Fannin County Community From Open Arms Shelter

Last year a young family with four children came to Open Arms Shelter seeking help. A tragedy left them homeless with nowhere to go. Over the next six months you responded, and recently the family moved out of our shelter transition house into their own home.

This effort would not have been possible without the help and support from the gracious shelter donors, employees, and volunteers. Staff from

Bonham ISD, several local churches who supported the family spiritually, individuals who provided essentials for the family, Christmas gifts for the children, meals for the first several days, and of course many prayers from all over our county.

Monday, April 10, 2023, Pastor Mark Posey of the First Congregational Church of Bonham led an Invocation before Mayor H.L. Compton called to order, at 5:30 p.m., the regular meet-

ing of the Bonham City Council. Quorum was established with all City Council Members present except for Councilman Bill Chapman. Before addressing the agenda items, Mayor Compton recognized former Fannin County Commissioner Dean Lackey,

thanking him for his part in the success of the recent “Steaks on Main Street Cook-Off that occurred April 1st in downtown Bonham.

1. Consider and take action to approve minutes of the March 13th regular meeting: A motion

was made by Councilman Wayne Moore to approve the minutes that was seconded by Councilman John Burnett and passed unanimously.

2. Consider and take action to accept financial report for month ending March 31, 2023: Bonham’s Finance Supervisor Michelle Burnett gave a report of the General Fund continuing with a positive variance in revenues collected through March. She noted building permits were slightly lower than anticipated with the year-to-date collection being $48,000 less than the previous year at this time. See

March news from Oakwood Cemetery

Press Release - March was the beginning of the mowing season at Oakwood. There was a lot of rain and water standing for several days, but the cemetery looked as nice as always. The yearly board meeting was in March, and there was a lot of discussion about what went

on in 2022 and the projects for 2023. Many thanks go out to Deidra Jackson, who retired from the board after being the secretary for twenty-three years. Laura Beavers Baker joined the board. Memorials were received for Josh Odom and Sonny Stanley.

Press Release - Motor Vehicle Crashes continue to be the leading cause of death for children 3 and up. Child safety seats, including boosters, are proven to be effective in preventing injuries and deaths, but 43% of children killed in crashes are found to be unrestrained. Studies show that booster seats can reduce the risk of injury by nearly 60% in children ages 4-7!

The law in Texas requires that children under 8 years old, unless taller than 4 feet 9 inches ride in a child restraint system. Most children do not reach 4’9” until about 11 years old.

There are so many pasta salad recipes out there, but this recipe is one that everyone will want again and again! The mixture of ranch dressing and taco seasoning makes this recipe extra comforting and fun. It's perfect for potlucks, parties or pool parties!

CREAMY RANCH TACO PASTA SALAD

12 ounce box Rotini pasta, fully cooked

1 c. ranch dressing

1 ounce package taco seasoning

1 c. cherry tomatoes, halved

1 green bell pepper, diced

1 red bell pepper, diced

½ red onion, diced

15 ounce can black beans, rinsed and drained

15 ounce can corn, drained chopped cilantro to garnish

Tortilla strips or Doritos

In a small mixing bowl, mix together the ranch dressing and taco seasoning. Mix until well blended. Set aside. In a large mixing bowl, combine the pasta and dressing. Toss until the pasta is evenly coated. Add the remaining ingredients to the bowl (except for

the cilantro or tortilla strips) and toss until well combined and all ingredients are distributed evenly. Cover and place pasta salad inside the refrigerator to chill for at least 30 minutes. When chill time is complete, top with chopped cilantro and tortilla strips before serving.

Cesli Crum, a Junior at Bonham High School in the BHS Vocal Ensemble class is excited to have been selected to attend the High School Honors Performance Series in Sydney, Australia this July. This selection gives her the opportunity to travel to Sydney and perform at the world renowned Sydney Opera House. Participation in the Honors Ensembles is limited to the highest-rated young performers from across the world. They had over 10,000 performers audition from around the world and only 500 were selected, including vocalists and orchestra. Cesli is the daughter of Julie Baccus and Wesley Crum. She auditioned last summer and was informed of her selection by the Honors Selection Board this past fall. Acceptance to this elite group is a direct result of talent, dedication, and achievements demonstrated in in her application and audition pieces.

Basketball game, as well competed and received the highest scores at her high school regional and state competitions, amongst other local charity events. In Sydney, she will join performers from across the globe for a week long, intensive orchestra and vocal ensemble camp that will end with a special performance at the Sydney Opera House, a venue that marks the pinnacle of musical achievement. Those selected will come together and have the opportunity to learn from and perform alongside worldrenowned conductors, many of which work with colleges and professional performers and groups outside of their partici-

pation with the Honors Performance Series.

Cesli is beyond proud and excited to get this opportunity to work with other talented performers her age from places in the world. While this experience is a wonderful opportunity to learn,

meet new people, and improve her talent, it does come with a cost. Also noted was an upcoming budget amendment (expected to be presented in May) to cover additional Street Department capital items, work set to begin in June for the 2022 audit and the notation that the city has begun work on preliminary budget worksheets for the fiscal year 2024 budget.

Councilman Michael Evans made the motion to accept the report with Councilman Kevin Hayes seconding the motion which passed unanimously.

3. Citizens Opportunity to Speak: [The City Council invites persons with comments or observations to briefly address the Council for the limited purpose of determining whether the matter should be referred to staff for study and response and/or be placed on a future meeting agenda. State law prohibits the City Council from considering deliberations on any item not listed on the posted City Council Agenda.]:

A citizen of Boyd Loop in Bonham spoke to urge the city to hold developers responsible in adhering to the rules of the current sidewalk ordinance to prevent the city from becoming liable for the expense of providing sidewalks in the future.

4. Proclamation – Children month American Legion: Mayor Compton commended American Legion Post 283 Commander Wolf (Jason) Laughing for the successful Powder Creek Easter Egg Hunt held April 8th at the park that provided a day of fun for children (and the young at heart) of all ages. After Mayor Compton read the Proclamation designating the month of April, American Legion Children and Youth Month, a photo was taken.

5. Present Proclamation for National 911 Public Safety Telecommunicators

Week: Councilman Kevin Hayes read the Proclamation recognizing the week of April 9th through April 15th as the National Public Safety Telecommunications Week. A photo was then taken with members of the Bonham Police Dispatch Department.

6. Consider and take action to rename Field #2 of the Larry Shockley Athletic Complex as the Ronnie Partridge Field #2: Maintenance Director of the Bonham ISD Ronnie Hill, spoke to expound on the many

hours Ronnie Partridge and his family spent working on the athletic fields for the benefit of the community’s youth and how Ronnie Partridge is very deserving of having the field named after him. A motion was then made by Councilman Timothy LaVergne II to approve the renaming of the field that was seconded by Wayne Moore and passed unanimously.

7. Consider and take action to approve contract for Election Services between the Fannin County Clerk and the City of Bonham for the May 6, 2023, election: City Manager Sean Pate explained how this action was just a formality and a motion was made by Wayne Moore to approve the contract with Michael Evans seconding the motion which passed unanimously.

8. Consider and take action to amend Section II paragraph 4 of the Inter-Local Contract for Emergency Medical Services between the City of Bonham, Texas and Fannin County, Texas in regard to non-emergency medical transportation: Bonham Fire Chief Scott Ridling explained how this makes official the absorption of services to the City of Savoy into the department’s current contract. He noted calls originating from Texoma Medical Center in Bonham will hence forward be handled by a private contractor. He advised the changes will not only be better for all parties but will be cost effective for the City of Bonham. After some discussion a motion was made by Wayne Moore to approve with Kevin Hayes seconding the motion which passed unanimously.

9. Consider and take action on the City’s participation in the Opioid Settlement as set forth in the Subdivision Participation and Release Forms with Walgreens Settlement, Walmart Settlement, Allergan Settlement, and CVS Settlement: Sean Pate detailed how the city opted in to this back in December 2021 and how this was a second wave receipt in the approximate amount of $95,000 to be used for items that are associated with drug prevention and safety measures as related to drug related programs. After some discussion a motion was made by Michael Evans to approve with Kevin Hayes seconding the motion which

passed unanimously.

10. Consider and take action to approve a Specific Use Permit/Zoning Change located at 1107 Pine St (ID# 92175) from Single Family Residential to Duplex: Bonham’s Director of Community Development Mark Kinnaird explained how this request was brought before the zoning commission in March and was voted unanimously to recommend for approval. He noted there was a resident outside of the 200 ft circumference who voiced disapproval of this being granted. After some discussion a motion was made by Wayne Moore to approve, seconded by John Burnett and passed unanimously.

11. Hold public hearing and consider and take action on an ordinance amending Ordinance 1393 providing for a fee schedule for solid waste collection services inside the city and at Lake Bonham: Mayor Compton called the hearing into order at 5:53 p.m. Municipal Marketing Manager with Sanitation Solutions Woodie Brantley spoke to give reasons justifying an approximate 11% increase for services. After citing out of control fuel increases and other cost increases (insurance, equipment costs, etc.) Mr. Brantley asked for the council’s approval for the fee increase request. After discussion ensued which included comments regarding the difficulty in obtaining and retaining adequate staffing, it was noted the starting pay for any seeking employment with Sanitations Solutions was $20.00 an hour. Also noted was Mr. Brantley’s assurance to correct the issue of workers leaving emptied trash receptacles in the street instead of on the curb. The hearing came to an end at 6:05 p.m. after which Sean Pate read the ordinance amending Ordinance 1393. A motion was made by Michael Evans to approve with Wayne Moore seconding the motion which passed unanimously.

12. Hold public hearing and consider and take action on an ordinance providing rules of conduct for Council meetings and providing rules for citizen communication during City Council meetings: Mayor Compton called the hearing to order at 6:06 p.m. Sean Pate began a discussion on rules of conduct regarding communication in cities. He

noted that since the city does not currently have a written rules system that is consistent with the law in place, the city staff had been researching the rules and procedures of many North Texas cities in order to put together the proposed formal ordinance for citizen communication during city council meetings. During the discussion an objection was made by John Burnett to the rule that a “request to speak form” be filled out ten minutes prior to the commencement of the meeting. Citing his belief that a citizen attending a meeting without the intention of speaking, should not be stifled from voicing his/her concerns or ideas during the meeting if they believe their opinion on a specific agenda matter should be heard. After more discussion with others seeing a need to refine the ordinance to provide order for the meetings while not discouraging public views, a motion was made by Wayne Moore to table the item to give the staff more time on the wording of the ordinance. The motion to table was seconded by Michael Evans and passed unanimously.

13. Adjourn: The meeting adjourned at 6:24 p.m. with Mayor Compton and City Manager Sean Pate thanking everyone for their attendance.

We started this conversation referencing doggie obesity affecting about 45% of the dogs in the U.S., and we talked about reducing Max's calories, while increasing his exercise. I recommend cutting out superfluous treats all together, because while it might make you feel

good, it's not great for Max. And treats like Milk Bones are the (begin ital>worst<end ital). I personally only use treats for training purposes, and extremely sparingly. We talked about replacing unhealthy treats with carrots, broccoli, apples, and green beans. Again, he might not like all of those, but one of them, he will probably love. Note: My weird dog really likes broccoli. Every other dog I've had, loved apples… not her. Last time I mentioned increas-

ing your dogs exercise by increasing the time and distance of his walks. You should increase the length of his walk every few days. - Don't allow him to dally and sniff too much. We're not out here for the sniffing and marking (contrary to fairly popular belief). We're out here for exercise. - All dogs walk fast, even the little ones, so keep it as brisk as is comfortable for you. If your dog has somewhat of a prey drive, adding the fetch game to his daily routine is a great idea. Twenty minutes of fetching a day, will make for

some some big changes. I've also mentioned swimming. If you have a pool, introduce him to it. When I introduced my dog to the pool, she started with a doggie life jacket. That way she didn't have to worry about paddling to stay afloat. A life jacket takes the initial pressure off your dog until they get used to the idea, and swimming is an excellent exercise. Even if it's only for 10 minutes total. - Finally, if you help Max lose some weight, you'll both feel better, and he most certainly will live longer.

Jan Kueckelhan Gibbs, 84, of Ivanhoe, Texas, passed away on April 10, 2023 at the Stone Brook Assisted Living in Denison, Texas. The family received friends at the Wise Funeral Home Chapel from 10:00 AM until service time and the funeral was held at 11:00 AM Friday, April 14, 2023, in the Wise Funeral Home Chapel. Bro. James Rogers officiated. Burial followed in the Duplex Cemetery.

Mary Jan Kueckelhan Gibbs was born May 4, 1938, in Bonham, Texas, the daughter of Lester Howard Kueckelhan and Eupha Nell Haynes Kueckelhan. Jan attended schools in the Ridings Community of Fannin County, Texas (now the Corinth Community) and graduated from Bonham High School in 1956. She married the love of her life, Duane “Doodle” Gibbs on June 22, 1956, in Corinth, Texas and he preceded her in death March 17, 2020. Hand in hand, Jan and Doodle raised their two children, Mary Kae and Jacky and worked their cattle business on the ranch near Ivanhoe, Texas. She also worked with him as he auctioneered in numerous sale barns around the country. Spending time with her family was a great joy. Jan loved to draw and was a member of Duplex Baptist Church.

Jan was preceded in death by her parents, her daughter, Mary Kae Gibbs Chaffin (Oct 10, 2012), her brother, Haynes Kueckelhan, and brother-in-law, Tommy Keeton.

From The Faith

Paul informed Timothy that “some shall depart from the faith” (1 Timothy 4:1). How does one depart from the faith? “THE FAITH” is the system of faith that is only found in God’s Word, the Bible. Christians are told to “stand fast in the faith” (1 Corinthians 16:13). Children of God are also told to “Examine yourselves, whether ye be in the faith” (2 Corinthians 13:5). Paul stated that “I am crucified with Christ: nevertheless I live; yet not I, but Christ liveth in me: and the life which I now live in the flesh I live by the faith of the Son of God, who loved me, and gave himself for me” (Galatians 2:20). The church at Rome was told that “faith cometh by hearing, and hearing by the word of God” (Romans 10:17).

One can depart from the faith

by “giving heed” or following false teachers or “doctrines of devils” (1 Timothy 4:1). We are warned “Be not carried about with divers and strange doctrines” (Hebrews 13:9). Jesus stated, “in vain do they worship me, teaching for doctrines the commandments of men” (Mark 7:7).

One can depart from the faith by allowing others to lead one away from the faith. Luke records that “Elymas the sorcerer” withstood Barnabas and Saul, “seeking to turn away the deputy from the faith” (Acts 13:8). Some “profess that they know God; but in works they deny him, being abominable, and disobedient” (Titus 1:16).

One can depart from the faith by not following the principles of the Holy Scriptures. God’s word says that “if any provide not for his own, and especially for those of his own house, he hath denied the faith, and is worse than an infidel” (1 Timothy 5:8). Paul shows God’s

principal “that if any would not work, neither should he eat” (2 Thessalonians 3:10). Some depart from the faith by loving objects of this world. Paul teaches us that “the love of money is the root of all evil: which while some coveted after, they have erred from the faith, and pierced themselves through with many sorrows” (1 Timothy 6:10). John wrote “Love not the world, neither the things that are in the world. If any man love the world, the love of the Father is not in him” (1 John 2:15).

How do we stay in ‘the faith?’

We are told to “continue in the faith grounded and settled, and be not moved away from the hope of the gospel” (Colossians 1:23), to “stand fast in the faith” (1 Corinthians 16:13), to “earnestly contend for the faith” (Jude 3), and to “keep the commandments of God, and the faith of Jesus” (Revelation 14:12).

The Book Of Job... And How We Can Apply It To Our Lives

In and throughout the book of Job, we see faithfulness, loyalty, and humility displayed in the whole book. Job was a very burdened person in his lifetime, and sometimes left devastated during his trials. Job faced many trials because the devil saw Job’s faith and wanted to destroy it. The devil attacked Job’s family, finances, his character, and

any other way he could get at Job. The devil’s entire goal was to get Job to turn on God. Even though Job had sin in his life like everyone, Job never turned on God. What we can take away from this story is that you may have troubles in life, but you should never lose sight of God’s greater plan that He is working. All you have to do

is just have the determination that Job had. In the end, Job was blessed double what he had in the beginning, and was even given a long life. Job accomplished these things by being humble and faithful to the Lord. So when you are feeling down just remember Job’s faithfulness to God, and the blessings he received in return.

Come, see the place where the Lord lay.” The resurrection of Jesus Christ is the true reason that we celebrate the Easter season. Oftentimes, though, this sadly gets overshadowed by the other aspects of Easter. We ought to be thankful for His resurrection, and rejoice in the fact that one day, He

will return to this earth to call His children home!

In 1933, Alfred Henry Ackley wrote one of the most well-known hymns about the resurrection of all time. It is one of my favorites, and I hope it is one of yours as well.

“I serve a risen Saviour, He’s in the world today I know that He is living, whatever men may say I see His hand of mercy, I hear His voice of cheer And just the time I need Him He’s always near.

He lives! He lives! Christ Jesus lives today!

Bonham’s First Air Show

first aerial exhibition ever given in Bonham.” The exhibition was at the “old fair ground race course.” The “crowd that witnessed [the exhibition] was pleased and delighted, enthusiastically cheering the daring birdman on brilliant feats.”

“Mr. Walsh made three beautiful flights . . . remaining in the skies several minutes each time and demonstrating his perfect control over the strange, birdlike machine that was carrying him in spiral dives and glides.

and demonstrating his versatility with loops, dips, and glides that lasted for ten minutes climaxing in a series of downward spiral glides landing within 50 feet of the racetrack grandstand.

The second flight took place some twenty minutes after the first landing and was obviously designed to give the crowd an even more spectacular view of the aviator's flying skills. His takeoff was considerable shorter than the first and a sudden nose-up maneuver thrilled the crowd into a long period of loud cheering according to press reports. During this flight he attained an altitude of 3000 feet and remained in the air for a ten minute display of dazzling aerobatics.

The third and final exhibition of the afternoon came when Walsh raced a 50 horsepower Kissel automobile. Both the plane and the auto made an even start down the racetrack but before they arrived at the first turn of the one mile track,

the plane had outdistanced the Kissel and was speeding far ahead. Three laps of the track were made with Walsh completing the course in under four minutes. Percy Gauldin of Honey Grove drove the Kissel.

After the race Walsh remained in the air for several

more minutes giving a continuing exhibition of the graceful maneuvers the bi-plane was capable of under his experienced hands. After the demonstrations were completed, members of the crowd were allowed to view the marvelous machine at close proximity.

The 11th in a series of articles for the 175th Anniversary of Bonham

On January 24, 1912, the air age arrived in Bonham when famed aviator Charles F. Walsh landed his Curtiss bi-plane as part of a flying exhibition. This was only nine years after the Wright brothers’ flight at Kitty hawk in 1903.

The event was heavily pro

moted in the Bonham Daily Favorite and the Honey Grove Signal. An article in the Favorite said that “Bonham is Perhaps The Smallest Town in Texas That Has so Far Attempted Such an Exhibition. It is a Chance of a Lifetime.”

The Favorite reported in its January 25 edition that an “immense crowd witnesse[d]

Walsh took off down more than 150 feet of the dirt track for the first of his three flights of the day which brought "a roar of applause from the eager and anxious spectators;" as reported in The Bonham Daily Favorite. Two $500.00 scholarships will be awarded by the Fannin County Republican Party recognizing Fannin County students who best exemplify patriotism, civic dedication, volunteering and good works toward their fellow citizens. There must be at least three letters of recommendation along with a minimum 300-hundred-word essay on "How to Encourage Political Activism in Young People?"

“Our goal is to make those angling experiences as easy and enjoyable as possible,” said Craig Bonds, TPWD’s Inland Fisheries director.

“Our staff has been intentional about coordinating with city, county and state park authorities to provide quality fishing opportunities in Community Fishing Lakes, most of which reside within safe and convenient locations for families to enjoy time spent outdoors.”

The changes enacted for the 2023–24 license year take effect Sept. 1. The Texas Parks and Wildlife Department (TPWD) will incorporate the details of these new regulations into the 2023–24 edition of the Outdoor Annual.

Clarified that CFLs include all public impoundments 75 acres or smaller, located totally within incorporated city limits or a municipal, city, county or state park. The new definition will exclude impoundments greater than 75 acres that are totally within the boundaries of state parks.

TAKE A KID FISHING

Cooper FAIR. Water lightly stained; 65 degrees. Crappie are great along the banks and creeks using jigs and minnows. Blue catfish catches are good drifting with cut bait.

Fork GOOD. Water Stained; 55-62 degrees; 1.10 feet below pool. The bass bite has slowed down, with the best catches coming sight fishing. Bass are slow on in 3-7 feet on points using Carolina rigs with lizards in green pumpkin. Texas rigs picked up a few on the edge of grass in 2-3 feet with beavers and craw worms in crawfish colors. A few catches with topwater frogs in the grass.

Lavon GOOD. Water lightly stained; 60 degrees; 0.23 feet above pool. Crappie are in spawning grounds in 1-5 feet in flooded grass or submerged buttonwillow bushes vertically fishing a 1/16 to 1/8 ounce jig. Solitary fish are in 5-12 feet of water, or fishes in packs near structures using LiveScope. Use 1/16 ounce black and chartreuse or white and chartreuse jigs under a slip bobber at whatever depth they are hanging. White bass are showing up in the creeks and rivers.

Ray Roberts GOOD. Water is stained; 62 degrees; 0.38 feet above pool. White bass are good on points and humps in the main lake, with a few surfacing in shallow water in the early morning and late afternoon. Watch for diving birds. Crappie are good from the banks to brush piles in 8-15 feet of water. Bass are good in shallow water while the spawn is on using soft plastics.

Tawakoni GOOD. Water lightly stained; 62 degrees; 0.20 feet above pool. Hybrid striper and white bass bite is steady. Fish are feeding under huge herds of threadfin shad right now, so swimbaits and slabs are working best in 1835 feet of water. The catfish bite is great. Fish have moved up shallow and we are seeing a consistent blue catfish bite in 2-7 feet of water.

Texoma GOOD. Water stained; 61 degrees; 1.04 feet below pool. Striped bass are good along the banks using topwaters early in the day, switching to swimbaits as the fish move off the banks.

Anglers are having success trolling with live bait, or using slabs. Striped bass are still spawning, and the shad will follow suit soon.

Tidwell shared advice for preventing the swallows many Texans consider unwanted and pesky guests. Use netting or wire mesh hung diagonally to cover areas where swallows could build nests — typically anyplace like an eave or where a roof and wall meet.

Surfaces can also be covered with materials hung vertically to prevent birds from getting to their preferred building sites.

Bird spike sticks and bird barriers can be purchased and installed to prevent birds from building nests.

For places where there is an open entry way, vinyl plastic hung in overlapping strips may be used. This is essentially a doorway curtain similar to what you may see in a grocery store for workers in refrigerated areas.

Knock down old nests that are empty. Birds will reuse nests from previous years if available.

When you see a new nest

Barn swallows are not easily frightened so trying to scare them away using any method is usually ineffective.

How to remove a barn swallow nest

Old, empty nests and the mud for nests birds are beginning to construct can be removed several ways.

A pressure washer or hose.

A pole.

A scraper or chisel can be used, however if you are getting close enough to a nest to use those tools, protective gear should be used. Gloves and a mask should be worn — if you have a respirator or leftover N95s now is the time to put them to use.

Use caution. Blood sucking parasites and mites can survive in nests long after the birds have left, even as long as three years. You do not want to come in direct contact with a nest potentially filled with parasites, mites and feces.

PLEASE BE ADVISED that Fannin County intends to consider and possibly take action on an ordinance prohibiting solid waste disposal in the unincorporated areas of Fannin County, except for certain designated areas, pursuant to the County’s authority in Texas Health and Safety Code §§ 363.112 and 364.012

PUBLIC HEARING: The above referenced and proposed solid waste ordinance will be considered and possibly acted upon completion of a public hearing conducted on Tuesday, May 2, 2023 beginning at 8:50 a.m. in the Fannin County Courthouse, 101 E. Sam Rayburn, Bonham, Texas, 75418. The public is invited to attend and comment.

Ordinance Prohibiting Solid Waste Disposal in Fannin County

Section 1. General Provisions and Findings

Whereas, the Commissioners Court of Fannin County, Texas, has both the responsibility and authority to protect the public health, safety and general welfare by prohibiting solid waste disposal in the unincorporated areas of Fannin County, except for those areas designated as solid waste disposal sites, pursuant to the authority of the Texas Health and Safety Code § 363.112 and 364.012; and,

Whereas, solid waste disposal, especially the disposal of solid waste in landfills, is an activity that has high potential to negatively impact the health, safety, and welfare of any community; and,

Whereas, the Commissioners Court has considered current state and federal laws and regulations, and makes that the regulations below, including distances from certain locations included in Section 4, below, are reasonable and necessary for complying with those regulations, and to protect the health, safety and welfare of its citizens.

Section 2. Definitions

The following words and terms, when used in this ordinance, shall have the following meanings, unless the context clearly indicates otherwise.

“Affected Area” refers to area of the county in which solid waste disposal is prohibited.

“Aquifer” refers to any subsurface geological formation, group of formations or part of a formation that is capable of yielding a significant amount of water to a well or a spring.

“Day Care Facility” refers to any real property used for the care of children or the elderly and is registered with the State of Texas as such.

“Facility” refers to any structure or property that is used for processing, storage, or disposal of solid waste or solid waste handling equipment. Including all contiguous land, structures, appurtenances, and other improvements on the land, used for processing, storing, or disposing of solid waste. The term includes a publicly or privately owned solid waste facility consisting of several processing, storage, or disposal operational units such as one or more landfills, surface impoundments, or a combination of units.

“Fault” refers to an area that has fractured along the crust of the earth and has two sides that have moved in relation to each other.

“Floodplain” refers to any area in the 100-year floodplain that is susceptible to being inundated by water from any source or that is identified by the Federal Emergency Management Agency on flood insurance rate maps, flood boundary and floodway maps under the National Flood Insurance Act of 1968 (42 U.S.C. Sections 4001 through 4129).

“Health Care Facility” refers to any real property that provides medical care or treatment under the direction of a licensed physician to four or more persons unrelated to the proprietor or operator of the facility. Includes public or private hospitals, skilled nursing facility, intermediate care facility, ambulatory surgical facility, family planning clinic that performs ambulatory surgical procedures, rural or urban health initiative clinic, kidney disease treatment facility, inpatient rehabilitation facility, and any other facility designated a health care facility by federal law.

“Individual Residence” refers to any structure intended to serve as the primary residence of, and is inhabited by, a human being. A structure is presumed to be an individual residence if it is designed for human residential habitation.

“Industrial Solid Waste” means solid waste resulting from or incidental to a process of industry, manufacturing, mining, or agricultural operations.

“Historic Site” refers to any real property that is included on the National Register of Historic Places, designated as a Texas Historic Landmark, designated as a State Archeological Landmark; is determined to qualify as eligible property under criteria for inclusion on the National Register of Historic Places, as a Recorded Texas Historical Landmark or as a State Archeological Landmark; or has been designated as such by the actions of a county commissioners court or city council.

“Municipal Solid Waste” means solid waste resulting from or incidental to municipal, community, commercial, institutional, or recreational activities, and includes garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and other solid waste other than industrial solid waste.

“Neighborhood” refers to any manufactured or mobile home development, apartment or condominium complex, subdivision, or community having a total of nine or more individual residences or residential units and an overall density of one residential unit or more per acre; an area designated as a residential zoning district by a governing ordinance or code or an area in which the principal permitted land use is for private residences; a subdivision for which a plat is recorded in the real property records of the county and a majority of the lots of which are subject to deed restrictions limiting the lots to residential use.

“Park” refers to any real property owned or operated or so designated by a unit of federal, state, or local government as such; and any land so designated in an adopted parks plan of a city or county.

“Places of Worship” refers to any enclosed structure that is owned by a religious institution or organization and that is used primarily as a place of regular group ceremony or meditation, education, and fellowship, the purpose of which is to manifest or develop reverence, homage, and commitment in behalf of religious faith.

“Public Surface Drinking Supply” refers to any surface water supply utilized for public drinking water supply.

“Scenic Road” refers to any road or highway in an area containing natural and scenic qualities of at least regional significance designated by federal, state, or local governments. “School” refers to any real private or public property, attendance at which satisfies the compulsory school attendance requirements of §§25.085 and 25.086, Education Code, as they existed on the effective date of this ordinance.

“Solid Waste” means, subject to the limitations of 42 U. S. C. § 6903 (27) and 40 C. F. R. § 261.4 (a) garbage, rubbish, refuse, sludge, from a waste treatment plant, water supply treatment plant, or air pollution control facility, and other discarded material, including solid, liquid, semisolid, or contained gaseous material resulting from industrial, municipal, commercial, mining, and agricultural operations and from commercial and institutional activities. The term:

(A) does not include:

(i) solid or dissolved material in domestic sewage, or solid or dissolved material in irrigation return flows, or industrial discharges subject to regulation by permit issued under Chapter 26, Water Code;

(ii) soil, dirt, rock, sand, and any other natural or man-made inert solid waste materials used to fill land if the object of the fill is to make the land suitable for the construction of surface improvements; or

(iii) waste materials that result from activities associated with the exploration, development, or production of oil or gas or geothermal resources and other substance or material regulated by Railroad Commission of Texas under Section 91.101, Natural Resource Code, unless the waste, substance, or material results from activities associated with gasoline plants, natural gas liquids processing plants, pressure maintenance plants, or repressurizing plants and is hazardous waste as defined by the administrator of the United States Environmental Protection Agency under the federal Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act, as amended (42 U.S.C. § 6901 et seq.); and,

(B) does not include hazardous substances.

“Solid Waste Processing and or Disposal Facility” refers to any land, structures, appurtenances, and other improvements on land, used for management or disposal of solid waste, including any incinerator, landfill, transfer station, materials recovery facility, land application, beneficial use, or composting site. This includes both publicly and privately owned facilities.

“Tourist Attraction” refers to any area designated as such by the federal government, state, city council or county commissioners court.

“Water Well” refers to any well, registered with TWDB/TCEQ used to supply or is capable of supplying potable water.

“Wetlands” refers to a transitional land between terrestrial and aquatic systems where the water table is usually at or near the surface or the land is covered by shallow water, and conforms to the Army Corps of Engineers’ definition.

Section 3. Approved Areas for Disposal in Unincorporated Areas of Fannin County

Fannin County designates the following areas for exemption under these regulations:

1. Any area with a current TCEQ Permit covering activities referenced in these regulations, as of the Effective Date, subject to Section 8., “Withdrawal or Return of Permit,” below; and

2. Any area which is the subject of an application for permit or other authorization under Texas Health and Safety Code Chapter 361 covering activities referenced in these regulations, subject to Section 8, “Withdrawal or Return of Permit,” below. This exemption applies only to geographic locations and permit parameters included in a pending application(s) as of the Effective Date, and does not exempt the application of these regulations to operations or location not included in such currently-pending application(s).

Section 4. Siting Criteria for Solid Waste Processing and Disposal Facilities

Processing and or disposal of solid waste may only occur if the following conditions are met:

(a) facility perimeter is located at least 2,640 feet from a school;

(b) facility perimeter is located a least 2,640 feet from public or private water wells;

(c) facility perimeter is located at least 10,000 feet from neighborhoods;

(d) facility perimeter is located at least 2,640 feet from individual residences;

(e) facility perimeter is located at least 2,640 feet from day cares facilities;

(f) facility perimeter is located at least 2,640 feet from places of worship;

(v) facility perimeter is located at least 5,000 feet from the shoreline of Bois d’ Arc Lake Reservoir;

(w) facility is not in the watershed of the Lake Ralph Hall Reservoir;

(x) facility perimeter is located at least 5,000 feet from the shoreline of Lake Ralph Hall Reservoir;

(y) facility is not in the watershed of the Lake Bonham Reservoir;

(z) facility perimeter is located at least 5,000 feet from the shoreline of Lake Bonham Reservoir:

(aa) facility does not create conditions which make traffic flow unsafe. This section does not apply to:

(a) areas within a municipality;

(b) any area that has applied for a permit or received authorization from TCEQ prior to the issuance of this ordinance’s Effective Date, but only to the extent those areas are exempted under Texas Health and Safety Code § 364.012(e);

(c) temporary sites established to handle demolition and debris from a natural disaster; or

(d) Any activities regulated by Texas Health and Safety Code § 361.090, “REGULATION AND PERMITTING OF CERTAIN INDUSTRIAL SOLID WASTE DISPOSAL,” but only to the extent those areas are exempted under Texas Health and Safety Code § 364.012(g). Unless restricted by state or federal law.

Section 5. Civil Remedies and Penalties

(a) Violations of this Ordinance are subject to criminal penalties to the extent allowed by state law and a civil penalty of $10,000 for each violation. Such penalty is to be forfeited to Fannin County, Texas. Each day that a violation continues constitutes a separate ground for recovery.

(b) The Fannin County Commissioners Court may bring a legal action to enjoin violations of this Ordinance and seek judgment for civil penalties.

Section 6. Severability

If any portion of this ordinance is deemed to be in violation of the statutes or the constitution of this state or the United States by a court of competent jurisdiction, said portion shall be severed, and the remaining portions of the ordinance shall remain in full force and effect.

Section 7. Withdrawal or Return of Permit

In the event that an application for permit or other authorization under Texas Health and Safety Code Chapter 361, et seq., which was pending before the Texas Commission of Environmental Quality at the time of the adoption of this Order for an area listed in Section 3 of this order is withdrawn by or returned to the applicant, or if a permit is overturned by a final appeal, then such area shall be removed from Section 3 of this Order and unincorporated areas of Fannin County.

Section 8. Effective Date

These regulations are effective as of the date of adoption, ____________________, 2023.

“With drivers holding onto their vehicles for 10 years or more, it could take many years before the fleet fully turns over,” says Rini Sherony, senior principal engineer, Toyota Collaborative Safety Research Center.

But what if every vehicle on the road was fully equipped with crash-prevention features? And how do engineers identify which new vehicle safety features to prioritize next? To find out, Toyota Collaborative Safety Research Center and Virginia Tech teamed up to research the potential benefits that different safety systems have in various crash scenarios. The team took real-world

crashes and reconstructed the data, performing multiple crash simulations. They started modeling with more traditional “passive” safety features, like the latest vehicle structures, and extended their work to include such technologies as automatic emergency braking, lanekeeping assistance, blindspot warning, etc. Assuming full deployment and optimal activation of safety features, such as those that were modeled, their research showed that over half of all U.S. crashes could be avoided and nearly 60% of moderate to serious injuries could be mitigated. At the same time, the research also identified what types of crashes are likely to still occur even if these safety features were deployed.

The research center has made the study’s data, found at toyota.com/CSRC, publicly available so that automakers, policymakers, technology research universities and

tech companies can work together to continue to make safety gains and fill the crash prevention gap.

“While drivers can’t avoid every danger on the road, our research shows that safety systems have the potential to be very effective in reducing the risk and severity of crashes,” says Sherony. “It’s important to know that most automakers offer features like lane departure warning, automatic emergency braking, audio warnings and steering assist (often with additional functionality). When you search for your next car, consider these features, even possibly opting for those that do not come standard-equipped. Texas Senate Approves $15 Million Bill To Expand Local Mental Health Treatment Options For Children And Families

The Texas Senate passed a bill Thursday that would create a $15 million “Innovation Grant” program designed to expand access to mental health services for children and families statewide.

Senate Bill 26, filed by state Sen. Lois Kolkhorst, R-Brenham, will offer grants to health care providers and nonprofit groups who offer mental health treatment, especially those that work with children and their family members. The program would be overseen by Texas Health and Human Services.

“The state doesn’t always have to do this. There are great nonprofits doing wonderful work out there. We have local mental health providers doing wonderful work,” Kolkhorst said. Kolkhorst’s bill was unanimously approved with a

30-0 vote and will now head to the House. State Sen. Roland Gutierrez, D-San Antonio, pushed forward an amendment that would have required grantees to post gun safety and suicide prevention materials on their website and in their facilities but it failed to pass.

As written, the bill would have Texas Health and Human Services give grant priority to entities that work with children and family members of kids who are considered high risk for mental health issues. The bill also directs the state to consider new funding options for nursing homes that could provide long-term inpatient care to people with behavioral treatment needs but who no longer need to be in the state’s psychiatric hospital system.

The bill also would require the state to audit local mental health authorities once every 10 years and publish online data related to mental health

care. It will also create a discharge and transition program to help people in state hospitals gradually make their way into the community.

“Senate Bill 26 delivers clear direction for several programs funded in the budget to make sure these funds are spent on patients’ treatment and beds, not just bureaucracy,” Kolkhorst said. “The bill creates transparency and accountability for our many community health systems to ensure that services are truly getting to those that need it.”

In 2022, Texas ranked dead last when it comes to access to children’s mental health services and 33rd for adult care, according to Mental Health America, a nonprofit advocacy group.

Greg Hansch, executive director of the nonprofit National Alliance on Mental Illness of Texas, said his organization supports SB 26 because it improves communication between state psychiatric hospitals and local mental health authorities.

“We have long maintained that the state should be collecting data about the extent to which individuals are in a lower level of care than what they are clinically recommended for,” he said. “Getting the right services at the right time matters. SB 26 will shed light on this key issue, as well as several others.”

SR, HG, DC baseball leading 12-2A standings this year

District 12-2A baseball has been led all season by its Fannin County members.

Class 2A Sam Rayburn remained undefeated through April 11 and has clinched a 2A postseason berth.

Dodd City has secured the district's top 1A postseason berth. Through April 11, 2A Honey Grove stood on the verge of a second-straight postseason.

Perpetual Postseason Preparation:

Assured 1A s'ball playoffs trips have DC, Savoy always readying in 15-2A

As the only Class 1A softball programs this season in 15-2A, Dodd City and Savoy started district play in March assured of postseason trips.

Only two 1A teams per University Interscholastic League 2A softball district advance to the 1A playoffs.

In the meantime, the pair have prepared for the upcoming playoffs with district games -- save their home-and-home

meetings -- being against 2A teams with successive successful seasons in the sport.

Through April 11, only the Lady Hornets had notched 152A wins against any of the 2A members: Sam Rayburn, 4-0, on March 21, Honey Grove,

2-1, on April 4 and Tom Bean, 10-2, on AprIl 11. During the last five completed softball seasons -- not counting the COVID-19 truncated 2020 campaign -- Dodd City has used the experience it has gained during district play

against 2A teams to prepare for long postseason runs -- four times reaching the 1A State Tournament, including winning the 2021 championship.

boys win; Ball three-peats in 23-1A

WOLFE CITY -- Hope Ball won her third-straight district championship and Nathan Harris finished as a runner-up, respectively, to lead Ector on April 5 to the 23-1A girls' and boys' championships at the Webb Hill Country Club.

Julia Bailey, Chloe Hardemon, Ally Harris and Reese Gibbs additionally composed the advancing Lady Eagles team, which also won the district title last year, but via different golfers save Ball.

Other advancing Eagles are Carter Whitburn, Brent Bailey, Samuel Hughes and Devin Ramirez. Harris, Whitburn and Bailey additionally advanced last season, when Ector was the district runnerup. Harris and Bailey also qualified for regional play in 2021.

The championship teams will join Dodd City's John Gilbreath and Natally Medina and Savoy's Taelor Cornwell at the Region III-1A Tournaments at the Mount Pleasant Country Club April 17-18.

Gilbreath has also qualified for regional golf for threeconsecutive seasons, while Medina's advance equates her second-straight.

Trenton, Bonhi in softball rankings

Class 2A Trenton and 3A Bonham appeared in the softball rankings on April 10 by the Texas Girls Coaches Association.

The Lady Tigers -- postseason-bound for the 10thstraight season -- held the No. 14 spot, as 15-2A competition nears its conclusion.

Class 2A Crawford led the 1A/2A rankings, followed by No. 2 Como-Pickton.

Meanwhile, Bonham, which was, after play on April 11, nearing a postseason return following a rare absence, ranked No. 22 in 3A where Grandview led and No. 6 Whitesboro and No. 21 Prairiland ensued.

Lannius Church of God Debt Free

On March 26th, 2023 the leadership and congregation of Lannius Church of God celebrated the amazing accomplishment of the church being debt free. The Lannius Church of God has been in Fannin County since 1918. They officially merged with the Church of God movement out of Cleveland, TN on January 1st, 1920. Since then, they have been through various remodels and new building programs. The latest beginning in

2017 with the addition of an educational wing full of new classrooms, fellowship hall, and full gymnasium. This project also included new offices, foyer and a complete remodel of the existing sanctuary. In less than 5 years, the loan is officially paid in full and we celebrate this wonderful and amazing accomplishment.

I want to publicly thank the Church & Pastor’s Council members who are Mike Burpo, Roy Burpo, Chad Knight,

Ronnie Knight, and Robert Wilson. Our church clerk Lesia Bridges and the entire congregation of Lannius Church of God for everything each of you did during this process. It is an honor to be the Lead Pastor of this amazing church and this is only the beginning.
