BEDCO Regular Meeting – Update Presentation from HH Architecture/ Construction Approved for Hwy 121 Property

nomic Development Corporation, Alan McDonald, called to order at 5:30 p.m., the regular meeting of the BEDCO Board

of Directors. After Mr. McDonald established Quorum, Vice President of the Board, Kelly Royse, led an Invoca-

tion.

2. Consideration and possible action to approve the Minutes of the Special and

Regular Meetings held on March 2nd and 20th, 2023,

respectively: After the board reviewed the minutes, Board

Member Wayne Moore made the motion to approve the March 2nd minutes with Board Member Allen Sanderson seconding the motion which passed. A motion to approve the March 20th minutes was then made by Kelly Royse and seconded by Board Member Lee Ellis. The motion passed.

3. Consideration & possible action acknowledging the monthly financial reports for March 2023: Mr. McDonald, noting that Finance Supervisor Michelle Burnett was away at training, touched on highlights of the report. He noted that February sales tax is continuing to track consistently with the budget and that the fiscal year 2023 YTD totals are about 3.9% favorable than the previous year. He then called the board’s attention to expenses from HH Architects on the downtown plan and noted that if there were any questions, he would e-mail Ms. Burnett and get back to them with her answers. A motion was then made by Kelly Royse to accept the report with Board Member Ernie Quintana seconding the motion which passed.

4. 5. Presentation by Bruce Woody (via ZOOM) regarding Downtown Planning by HH Architects: CEO and President of HH Architects, Bruce Woody began a livestreamed meeting via Zoom with himself and two other members of his firm detailing an update of proposed plans for the downtown (and nearby) areas of Bonham. Focusing on entry points into Bonham (121 & 56 as well as 78 south of 56), Mr. Woody presented the proposed ideas that would enhance the business and historical districts of Bonham. Also included in his presentation were proposed visuals of the GK Reddy Event Center. He touched on plans for updates on the highway system, sidewalk improvements (with a walking trail to

increase pedestrian traffic) and various business development potentials. After Mr. Woody’s presentation, Mr. McDonald, noting that members of the downtown advisory group were in attendance, led a discussion of the proposed plans. Bonham City Manager Sean Pate spoke of an upcoming meeting city officials will be having with the Sulphur River Regional Mobility Authority (Bonham’s regional mobility authority) and the county regarding grant transportation dollars and future development plans dealing with the Hwy 121/56 interchange and how HH Architects would need to incorporate their plans with those parties. A citizen of Boyd Loop had questions about the precise location of the event center (by the hotel, up on the hill area) and the sufficiency of the plans for parking.

6. Consideration and possible action regarding bud-

get items inc. but not limited to Downtown Grants: Executive Director of BEDCO, Gayle Cooper, referred the board to an expense report provided to them that noted where additional monies will be needed with an explanation of each line-item increase and her recommendation for the increases. She noted that overall, the budget is looking good despite the necessity to increase monies on certain line items. After her report a motion was made to amend the line items by Allen Sanderson, seconded by Lee Ellis and the motion passed unanimously.

7. Executive Director’s Report to include updates on:

o GK Reddy Event Center: Covered in Bruce Woody’s presentation.

o 121 Project: Covered in Bruce Woody’s presentation.

8. Discuss/decide on suggested date for Joint City Council/Board workshop: June 26th: Ms. Cooper noted

that City Secretary Heather Stockton would be obtaining the authorization for the date of June 26th at the next City Council meeting if there were no objections by the board. There were no objections.

9. Adjourn to Executive Session relating to Sections 551.087 ED negotiations and 551.074 Personnel: A motion was made, seconded and passed to enter into Executive Session at 6:22 p.m. Before entering Executive Session, Ms. Cooper thanked all for their attendance and quickly shared how earlier in the day, several hours were spent with a videographer (Neon Cloud) who, working with a drone and other high-tech cameras, filmed downtown Bonham and key development areas in Bonham that will be used for a promotional video of Bonham. Once completed, the video will be made available on BEDCO’s website as well as other sites.

10. Return to regular session; possible action resulting from Executive Session: Board members returned to regular session at 6:50 p.m. A motion was then made by Allen Sanderson to approve L4 Construction and Manufacturing to start infrastructure construction on property on Hwy 121. The motion was seconded by Ernie Quintana and passed unanimously.

11. Adjourn: Meeting adjourned at 6:51 p.m.

I know that John is the best candidate for this position.

John worked for sixteen years for the Goodyear Tire and Rubber Company. This is important because with his job, he was trained by Goodyear to do economic development. In order to accomplish this goal, John needed to know the rules and regulations that were applicable to the towns that would allow him to create jobs and more sales.

In Bonham, John has served a number of years on Bonham Economic Development Corporation. This entity was created to develop and recruit both businesses and manufacturing facilities. As a result of John’s operating businesses in Bonham and Denison for thirty-five years, this has given him a vast knowledge of both procedural and practical knowledge on how to recruit and maintain businesses.

One of the things that impresses me most is John’s connections with people in Washington, D.C., and Austin, Texas. John can telephone or write to those in positions of influence when immediate action is needed. He simply has to say, “This is John Burnett in Bonham, Texas,” and no one is going to say, “Who?”

In addition to serving on several boards and civic organizations, John volunteers to help with special events in Bonham. This past week, John, along with fellow Kiwanians, was present at 4:45 A.M. at the Multi-Purpose Complex to direct parking for the Texas Mission of Mercy free dental event on two days. This event had over 300 dental patients, plus dentists and dental personnel, and a multitude of local movers and shakers who volunteered for this event. There are other events to which John volunteers during the year.

A vote for JOHN BURNETT is a vote for the people of Bonham.

Preheat the oven to 425° and line a baking sheet with parchment paper, folding up the edges to keep sauce around the salmon.

Good Match For Mixed: Pairing of Bailey, Torres by coach equals State for Ector tennis duo

ECTOR -- Regional advances and Ector tennis have become synonymous.

Yearly, the Eagles and Lady Eagles, en route, dominate the district tournament.

A chance to improve one player's probability of advancing again led to the pairing: of sophomores Julia Bailey and Anthony Torres, regional qualifiers in girls' singles and mixed doubles last year, respectively.

"There were three [players in] girls' singles in our district who I felt could advance to regionals," said longtime Ector tennis coach Terry Johnson. "I went to Julia first to see if she was interested [in switching] or wanted to take a chance in singles.

"I think it excited her a little

bit. I think she thought singles were more stressful," said Johnson who added with a laugh. "She wanted someone else to blame it on."

The pairing of the duo has led this month for Ector to another district championship in mixed doubles, a runner-up regional finish -- and the first State qualifier in that category of tennis for the school since 2019.

Class 1A State Tournament play for them will begin on April 25 in San Antonio at the Blossom Tennis Center in the quarterfinals at 9:15 a.m. The semifinal round will occur later that same day at 2 p.m., with the championship match on April 26 at the same site at 8:30 a.m.

"It's a lot different," said Bailey. "I'm not used to playing up front [on the court] -- the ball comes at you faster. The back is the same as during singles."

"[Julia] picked it up quickly," said Torres. "She communicates very easy. She talks a lot.

"My first year, I played mixed doubles with a senior; so I guess Coach Johnson wanted to try it again," said Torres. "I think he knew we would be a good match."

Trenton s'ball defends 15-2A title; Bonhi assures postseason return

At least one district champion --and, maybe, two -- will head Fannin County's softball postseason qualifiers for 2023.

Trenton has defended its 152A title and will be the district's top seed in the Class 2A playoffs, which like the other classifications are slated to begin April 27-29 with bi-district play.

It equates the Lady Tigers' 10th-consecutive postseason

Also in 15-2A, either Sam Rayburn or Honey Grove will be the district's fourthand-final qualifier, pending the teams' meeting April 21 in Ivanhoe. Dodd City, a 1A State semifinalist last year, has secured 152A's top seed to the 1A play-

Meanwhile, 3A Bonham has assured a return to the playoffs after a rare absence in 2022.

Through April 18, the Lady Warriors were tied with Pottsboro and Gunter for second place at 7-4 -- all a game behind first-place Bells. Bonham split its district homeand-home meetings with each mentioned 11-3A opponent.

Bonham senior Gorden to long jump

BONHAM -- Consider it a

coming full circle of sorts.

Jacob Gorden on April 17 agreed to extend his career in the men's long jump at East Texas Baptist University in Marshall.

After visiting the ETBU campus earlier this year, the Bonham High School senior said he felt at home -- and had no need to look further.

He got the idea of vying for ETBU from Bonham coach Kade Trompler who recently ran for ETBU and knew its head track and field coach, Zach Richardson, having run with him for the Tigers.

Coincidentally, Gorden's trek toward this day and destination also started and gained ground in East Texas, just down the road

from ETBU in Whitehouse.

"His sophomore year, he went to the regional meet as an alternate in the long jump," said Kevin Trompler, Bonham head track and field coach. "I told him to value the experience of seeing what track looked like at that level."

As junior, Gorden improved his jump -- from 19 feet, 11 inches as a sophomore to 20 feet, nine and 1/2 inches -- to win the District 11-3A boys' championship.

Gorden bettered his jump at the ensuing area-round meet as a junior, posting a leap of 21-3 to be the event's runner-up -and return to the regional meet at Whitehouse, but this time as a competitor.

He ended his junior season with a 21-even leap -- good for

sixth in the Region II-3A boys' competition.

BONHAM -- Head tennis coach Kirstin Bockman had no doubts about pairing senior Alli Kirkpatrick and junior Jagger Lindsey this season for mixed doubles for Bonham. "Their athleticism and competitiveness made them the perfect match," said

"I knew at the end of last season that I wanted to see them on the court together," she said, "and they immediately embraced the idea and have worked so well together.

"They clicked immediately. There was no question when they stepped on the court that they were there to compete with each other."

Kirkpatrick, an Angelo State volleyball signee, competed in mixed doubles with a now-graduated partner last season, played girls' doubles in 2021 and reached the Region II-3A Tournament each time. Lindsey equated a regional alternate while playing boys' doubles in 2022.

"It's been an easy adjustment," said Kirkpatrick. "He actually knows what he's doing so it makes it easier for me."

"We have been friends for a long time," added Lindsey.

Tuesday, April 18, 2023, Fannin County Judge Newt Cunningham called to order at 8:54 a Special Meeting of the Fannin County Commissioners Court and established Quorum with all County Commissioners present.

2. Hear comments regarding partial closure of County Road 3840 in Precinct 2; beginning at Hwy. 11 / CR 3840 and extending to CR 3841, a closure of approximately .31 miles in length: Judge Cunningham read the agenda item before inviting those wishing to speak. There were no speak-

ers.

On the same day at 9:00 a.m., Judge Cunningham called to order the Regular Meeting of the Fannin County Commissioners Court. After noting Quorum established, Judge Cunningham led the court in an Invocation. Major James Manis, retired, led the Pledges.

4. Introductions: Judge Cunningham welcomed Erik Simien from Pat Fallon’s office to the court. Also welcomed to the court was County Chair for the Republican Party of Texas, Melanie Grammar.

5. Public Forum: A citizen of Ector spoke to remind everyone of the importance of prayer during challenging times and urged all to come, with a special invitation to the county’s youth; to the courthouse lawn Sunday, April 23rd for the “Fannin County Call to Prayer” to pray for our communities beginning approximately at 5:00 p.m. She also reminded everyone about the “National Day of Prayer” which will be held May 4th at noon on the courthouse grounds. A citizen of Ravenna

then spoke to question the fairness of the court calling out a prior decision made by a former Commissioner to work on a certain county road without scrutinizing other road work he believed to be poor choices made by other Commissioners. He was asked by Judge Cunningham if he might want to reserve his comments for agenda item 37 where road issues would be discussed.

6. Discussion regarding EMS monthly profit/loss report for March 2023 – County Judge for Scott Ridling, Fire Chief: Bonham’s Fire Chief Scott Ridley gave a report of being fully staffed, an increase of about 15 calls more a month, and the likelihood of the long-awaited ambulances arriving within a month.

7. Discussion regarding County Health Insurance mid-year review with Jonathan Collander and Amy Bridges of Texas Association of Counties Health & Benefits Services – County Judge: Jonathan Collander and Amy Bridges gave a report summarizing health benefits of the plans available to employees of the county; data of previous health care loss ratios as compared to the recent year and preventative practices being implemented such as physicals and wellness programs focused on reducing health care losses. Noted was a new expanded healthcare network being available effective Oct 1st and how information on the rates and new plans will be made available by late May.

8. Discussion regarding 2nd Quarter Indigent Care Activity report – County Judge for Indigent Healthcare Director: Indigent Healthcare Director Mark DeMay gave a report of there being a total of 649 inbound/outbound calls, 62 in office appointments, and 23 applications with 4 approved/1pending/18 referred to other programs. He noted along with the 4 new patients; were 2 renewals and 4 coming off the program with 2 of

those going back to work and 2 going onto disability. Total indigent claims (including prescriptions) paid came to $45,800.77; total inmate claims paid $19,313.16. Regarding the budget, Mr. DeMay noted there is currently an overage of $13,763. He expounded on the excellence of Bonham Family Drug and the decrease of prescription costs since signing with them. He detailed grant successes in the area of medical equipment and transportation costs and announced the first ever Fannin County free medical equipment program and the partnership with Fannin Baptist Association that is making this possible. He concluded his report noting the additional providers that will be accepting indigent patients and the life saving resources being made available to Fannin County residents.

9. Discussion, consideration and action to approve payment of bills – County Judge for County Auditor: After reading the amount to pay, Commissioner Lane made the motion to approve payment with Commissioner Kopf seconding the motion which passed.

Citizen Paul Ivy asked to speak to voice concerns about the preliminary plat and the subdivision manual possibly containing language that could require the county to take over maintenance of the road in the future. After some discussion Commissioner Self made the motion to approve the Preliminary Plat as written with Commissioner Lane seconding the motion. Discussion regarding Subdivision Policy – County Judge: Matt Logue with Lakewood Development spoke regarding a delay of having the subdivision plats for The Peninsula and The Shores ready for the court’s review. He asked the court this be placed on the agenda for May 2nd with consideration given to the acquisition of the bond needed on the project.

Discussion regarding Courthouse repairs – County Judge: Judge Cunningham led a discussion on a punch list of items that will be discussed with Turner Construction, the Historical Commission and possibly former Commissioner Dean Lackey to determine which repair issues are the responsibility of Turner and which items Turner may have previously had their responsibility for, relinquished.

Discussion regarding Fannin County road issues – County Judge: Judge Cunningham noted some Universities not only have training on this but there are engineers who may be available for consultation. Citizen Jason Walker spoke to expound on the subject he spoke on in Public Forum calling into question the legality of county work done on a certain private road leading to a cemetery. A discussion ensued about closed county roads, work done by previous Commissioners, misappropriation of county funds, public purpose, transparency and overall fairness. Judge Cunningham stated he would look at the specific issue Mr. Walker brought up though he noted his belief that nothing illegal took place due to the existence of public purpose.

My name is Sandy Barber.

I am a Bonham ISD taxpayer and the parent of 3 Bonham High School graduates. I am also a big advocate for all kids. I will be voting FOR the BISD school bond. More than a decade ago, I served on some school facility committees. Back then, the consensus was that BHS, Evans and LH Rather buildings were all in very, very bad shape. Voters passed a bond election in 2012 to completely renovate Evans and then passed another bond election in 2016 to build a new high school. In February 2023, the bonds for Evans were paid off early. We now have an opportunity to finally address the numerous facility issues at the Junior High with the bond election on May 6.

The plan calls for demolishing the older, lower part of LHR that was built in the 70’s and has flooded a countless number of times. The newer, upper part that was built in the 90’s will be majorly renovated for our 6th graders. Then a new addition will be built on higher ground, to the north, where the practice football field is. This new part of the

facility will have classrooms for the 7th and 8th graders, a cafeteria, multipurpose space with a stage, vocational classrooms, agriculture classrooms and band hall. Bringing these 3 grades together under one roof will dramatically improve safety and security.

Approving the bond will also alleviate overcrowding at Finley Oates (FO), as the 3rd graders will be moved to Evans. FO was designed for only grades K-2. When my oldest attended there 20 years ago, the current portables were moved in and she was in the first group of third graders to be a FO. Voting for the bond will get rid of these old portables.

LHR has become a money pit. It is not good use of tax dollars to continue to pour tax money into the repairs and maintenance of that school when it cannot even be insured against water damage. One of my memories of that school is my kids telling me that on heavy rain days, they would take off their shoes and socks, roll up their pants and wade through several inches of rain water to get to and from lunch and art class. On rainy days when the wind is blowing,

everyone gets soaked going to and from lunch and certain classes. How hard would it be for our students to concentrate in math or reading class when they are dripping wet?

Environmental psychology is a field of study that looks at how the environment impacts human behavior, morale, attitudes, etc. The physical environment of a school has an impact on our students’ and teachers’ morale, concentration, learning and behaviors. My youngest attended Evans before, during and after the renovations. I saw a dramatic difference in her attitude and energy after the school was like new. My Facebook memories recently reminded me of one day when she came home bubbling with excitement over the new library and the new science rooms. I remember that before the renovations of Evans, they hardly ever had the best attendance. Since the renovations were completed, Evans often has the best attendance record in the district.

It is my hope that voters in the Bonham ISD school district will go to the polls and join me in voting FOR the bonds. Early voting is April 24- May 2 and election day is May 6. All voting will be at Bonham City Hall.

McCraw's Chapel Homecoming

The McCraw's Chapel Homecoming will be held Sunday, May 7. Please join us for a picnic lunch and stay for the Cemetery Association's annual meeting. If you are unable to attend, donations may be sent to the McCraw's Chapel Cemetery Association, 3184 CR 3455, Honey Grove, TX 75446.

Our Dad, Dave Ray, was a Chaplain in World War II. After a battle, he made it a practice to visit the First Aid Station. One time, Medics told him they could not prevent a soldier from bleeding to death. Dad laid down on the ground next to him.

He told Dad, “Yesterday, I thought I’d be killed. I asked Jesus to save me, and He stepped into my heart. I was so happy I thought I’d live forever. Don’t know why I was hit today, but tell my mother I’ll meet her in heaven.”

An Army telegram saying her son was killed in action broke his mother’s heart. It hurt more believing her son was not a Christian. After Dad wrote, she replied: “You’ll never know how much your letter meant to us!”

Its OK to VOTE YES, Bonham

AS most of you know, Bonham ISD has a Bond Proposition on the ballot for May 6th in the amount of $64.4 million. This bond package, if approved, will be used to remodel the current upper portion of LHR and add a new building to the north of the current LHR to house 6th-8th grade. Passage of this bond would not only address current and expected growth district wide, but also update the oldest campus now ineligible for flood insurance due to the multiple recent floods.

Bonham ISD Administration and Board of Trustees are committed to doing “what’s

best for kids.” Voting YES doesn’t diminish one’s position as being fiscally conservative. In fact, voting YES allows for construction of a safer - more efficient building, mitigation of future flood damage expense, and alleviates overcrowding with the construction of just one school.

Schools in Texas are by design built with Bond revenue. This benefits the taxpayers two-fold – It allows Districts to finance a school in a more stable borrowing market and shares the cost of the school with future taxpayers instead of building for growth on the backs of current taxpayers.

To be clear – There is a plan. There is a reason. Individuals

familiar with the construction and school finance industry have been consulted to ensure the Bonham ISD can build and do what we are telling the taxpayers we can build and do.

The Bonham ISD board has well over 150 years invested in Bonham ISD. The Bonham ISD Superintendent as well as 6 of the Bonham ISD board members are Bonham High School graduates. Don’t let some California move-ins keep Bonham ISD from doing “what’s best for kids.”

The James Butler Bonham Statue

The 12th in a series of articles for the 175th Anniversary of Bonham

What is the story behind the James Butler Bonham statue on the Courthouse grounds?

In 1936, in the midst of the Depression, Texas staged a big celebration to commemorate its 100th year anniversary. It was essentially a world’s fair centered in Fair Park in Dallas.

In addition to the big event in Dallas, 19 statues were commissioned to honor Texas heroes to be placed around the state. One of the statues was to be of James Butler Bonham, an Alamo hero, and of course it would be placed in the city named after him.

Noted sculptor Allie Tennant was chosen to sculpt the Bonham statue. Allie Tennant was a respected Dallas artist. (Tennant’s best-known work is the nine-foot bronze Tejas Warrior placed over the entrance doorway of the Hall of State building at Fair Park in Dallas).

On Sunday, December 18, 1938, on a bright sunny afternoon, the statue was first unveiled in an elaborate ceremony to which, according to newspaper reports, thousands

were in attendance. Several distant relatives of James Butler Bonham were there, as well as dignitaries from Austin, Dallas and Sherman. Allie Tennant was in attendance. Congressman Sam Rayburn made the dedicatory address. The Bonham High School Band played patriotic songs, and school children from the James Duncan and Bailey Inglish schools sang "Texas, Our Texas" as the covering over the statue was removed.

After almost seventy-five years of weathering, the statue was in dire need of cleaning and a new coat to prevent further deterioration. So the Fannin County Historical Commission, led by Tom Thornton, made this their project for 2013. The Commissioners’ Court approved, and efforts to obtain the approximate $20,000 began. With more than half donated by local citizens, businesses, and former Bonham citizens, and a generous grant from The Daughters of the Republic of Texas, the James Butler Bonham statue was removed and taken for refurbishing on Saturday, December 16, 2013. The statue was refurbished and reinstalled. The re-dedication was held on Friday, November 21, 2014.

Horse Owners Urged To Participate In National Survey

To understand the true size and impact of the state’s horse industry, Texas A&M AgriLife Extension Service horse specialists stress the importance of current data, and they say it’s time for Texas horse owners and enthusiasts to stand up and be counted in the American Horse Council’s survey.

The AHC National Economic Impact Study survey counts horses in Texas pastures and paddocks, and AgriLife Extension specialists aim to harvest more extensive “breakout data” that measures horse industry impacts, involvement and economic contributions. Current Texas horse industry breakout data is over 15 years old.

The survey results will provide the informational power to substantiate the value of the horse industry, said Chelsie Huseman, one of two AgriLife Extension horse specialists in the Texas A&M College of Agriculture and Life Sciences Department of Animal Science.

The survey will analyze the direct effects of the industry as well as indirect and induced effects. The surveys will include expenses related to the care and training of horses for racing, competition and recreation. It will also gather information on spending by non-owners for activities such as riding lessons, trail riding and going to the races.

“We need to have a sizable number of responses to say this data accurately reflects the horse industry in Texas,” Huseman said. “The horse industry contributes significantly to the Texas economy.”

She has stepped up this year to ensure Texas is among those states receiving state economic impact breakout data from the American Horse Council’s national survey, which started this month and continues through September.

“The AHC National Economic Impact Study is one of the most comprehensive studies for the nation’s equine industry,” Huseman said. “And now more than ever, it is essential to get state breakout data secured for Texans.”

Industry changes need to be assessed

The horse industry in Texas has definitely changed over the past 15 years, Huseman said.

“Within just the past five years, not only have there been major economic changes that have forced business closures and federal stimulus programs related to the pandemic made a major impact, but the horse industry has adapted to historic changes made to the tax code since 2017,” she said.

Huseman said no large group in Texas stepped forward to get the Texas survey data into the national survey, so she took on the project, rallying industry partners to get a complete survey funded. A collaborative effort among several top equine events and organizations got the job done.

“If we did not do that, the national survey would have only reported the number of horses in Texas and nothing else,” she said. “By getting the state breakout data from the full survey, the American

Horse Council will provide statistics beneficial to the state. It will include direct, indirect and induced economic impacts of horse ownership, recreation and equine-related services, and that’s informational power.”

Rallying to gather the untold story

An up-to-date and comprehensive data set like this doesn’t exist for Texas’ equine economic impact, Huseman said.

“The last time Texas received state breakout data from a survey this comprehensive was in 2007,” she said. “A lot has changed in the horse industry since then: the economic downturn in 2008, defunding of horse slaughter facilities,

and most recently, the pandemic. We know that had to greatly influence the industry and horse ownership, but we have no idea to what degree.”

Fork GOOD. Water Stained; 55-62 degrees; 1.21 feet below pool. The bite at Lake Fork is still slow due to fish spawning. Sight fishing is producing some catches. Best bite if not sight fishing is points and secondary points with Carolina rigs with caffeine Shad from Strike King in 2-6 feet. Spinnerbaits and chatterbaits are picking up a few on windy banks and points, but it is a grind. Flukes and frogs in the grass will produce a few bites.

Lavon GOOD. Water lightly stained; 60 degrees; 0.02 feet above pool. Every day the shad are spawning in the morning, so watch for bird action. White bass are hitting paddle tail swimbaits, 3 1/2 to 4 inch. Cast as close to the bank as we can, and dragging them back to the boat, so the school does not spook. Later in the morning they move out to 15-20 feet on main lake structures such as points and ledges hitting one ounce white slabs with a jig tied 18 inches above for a double catch.

Ray Roberts GOOD. Water is stained; 68 degrees; 0.38 feet above pool. White bass are excellent and have started showing up the flats in the morning, birds have been working and the shad spawn is in effect.

Tawakoni GOOD. Water lightly stained; 62 degrees; 0.20 feet above pool. Hybrid striper and white bass bite is steady. Fish are feeding under huge herds of threadfin shad right now, so swimbaits and slabs are working best in 18-35 feet of water.

The catfish bite is great. Fish have moved up shallow and we are seeing a consistent blue catfish bite in 2-7 feet of water.

Texoma GOOD. Water stained; 61 degrees; 1.33 feet below pool. Striped bass are good along the banks using topwaters early in the day, switching to swimbaits as the fish move off the banks.

Anglers are having success trolling with live bait, or using slabs. Striped bass are still spawning, and the shad will follow suit soon. Striped bass are great on live shad fishing ledges and channels in 30-45 feet of water on the main lake.

The shad spawn is on top so topwater baits along rocky banks where the egrets and herons are early in the morning will produce fish.

Newness Of Mind

The Apostle Paul asked the question, “Know ye not, that so many of us as were baptized into Jesus Christ were baptized into his death?” (Romans 6:3). He then makes the statement that “Therefore we are buried with him by baptism into death: that like as Christ was raised up from the dead by the glory of the Father, even so we also should walk in newness of life” (Romans 6:4). The ‘newness of life’ includes the new mind, a changed mind, a mind that has repented. Peter informs us that repentance comes before baptism, “Repent, and be baptized every one of you in the name of Jesus Christ for the remission of sins” (Acts 2:38). In having a new mind, it is to be a mind like Christ. “Forasmuch then as Christ hath suffered for us in the flesh, arm yourselves likewise with

the same mind” (1 Peter 4:1). Paul wrote, “Let this mind be in you, which was also in Christ Jesus” (Philippians 2:5). Christ is to live in our minds, thoughts, and actions, “I am crucified with Christ: nevertheless I live; yet not I, but Christ liveth in me: and the life which I now live in the flesh I live by the faith of the Son of God, who loved me, and gave himself for me” (Galatians 2:20).

In having a new mind, it is to be a mind that is temperate. This new mind is to say ‘no’ to the wrong things. When we become Christians, we are to turn from the life of sin. Peter stated, “For the time past of our life may suffice us to have wrought the will of the Gentiles, when we walked in lasciviousness, lusts, excess of wine, revellings, banquetings, and abominable idolatries” (1 Peter 4:3). Paul commented to Christians, “But God be thanked, that ye were the servants of sin, but

ye have obeyed from the heart that form of doctrine which was delivered you” (Romans 6:17).

In having a new mind, it is to be a mind that serves the will of God. A Christian is to “no longer should live the rest of his time in the flesh to the lusts of men, but to the will of God” (1 Peter 4:2). We are reminded that as children of God, we are to “present your bodies a living sacrifice, holy, acceptable unto God, which is your reasonable service. And be not conformed to this world: but be ye transformed by the renewing of your mind, that ye may prove what is that good, and acceptable, and perfect, will of God” (Romans 12:1-2). This renewing of the mind includes “Study to shew thyself approved unto God, a workman that needeth not to be ashamed, rightly dividing the word of truth” (2 Timothy 2:15). Christians are to have a NEWNESS OF MIND.

Sunday Morning Retake “God’s Word Will Stand”

Hello everyone!

The Bible tells us in Isaiah 40:8, “The grass withereth, the flower fadeth: but the word of our God shall stand for ever.” As you know, we are living in very uncertain times right now. We hear and see several different things from several different people, and sometimes we just don’t know what to believe. As Isaiah tells us, God’s Word should never be doubted. We know that what it says is the absolute truth. As I’ve said before, one of my favorite quartets in gospel music are the Inspirations. The unique thing about them is that they always sing with live music as opposed to soundtracks. This song has a very powerful message.

“What has happened to a nation that used to fear the Lord, To a people whose foundation was built upon God’s word, We’ve allowed the world’s opinion to chart a different way But it’s time the church of Jesus Christ should boldly stand and say

God’s word will stand against the raging tide Of those who criticize and work their evil plans.

God’s word will stand against the gates of hell, With power to prevail in the hearts of men, God’s word will stand.”

LOLA CHRISTINE “CHRISTY” CHESSER

Chesser, 49, of Bonham Texas, passed away in her home on April 8th, 2023 ; joining her mother Patricia, father John and sister Janie in her eternal life in Heaven.

Christy was born in Bonham on September 25th 1973. She lived a full and sometimes difficult life, but she always managed to make the best of everything. She worked her entire life until health problems gave her the opportunity to finally be a homemaker.

Christy was as hardheaded as they come, but it was a quality most admired. She was well known for her beauty, strength and unconditional love. Not to mention her incredible karaoke skills.

Christy loved all things black, pink, sparkly, glittery and girly. She was still a kid at heart. Which made her over the moon for her 2 granddaughters and 1 grandson.

She was extremely sentimental and held onto all things that had valuable memories. She loved and cared for her two dogs (KiKi and Gizmo) day in and day out.

Christy was engaged to Gregory Long; excited to live the rest of her life with her “Baby,” with whom she shared many new adventures.

Christy will be lovingly remembered by her fiancé of 7 years, Gregory Long; Daughter, Chelsey (William) Arnott; Son, Christopher Langston; Grandbabies, Lucas, Lainey and Livie; Brothers, Josh (Ashley) Chesser and John. T Chesser; Step children, Ashleigh (Robert) Speights and Daniel (Chassity) Wood; as well as numerous nieces, nephews, cousins and friends.

A Celebration of Life Memorial Service was held on April 16th 2023 where her family and friends were surrounded by memories of her and her life on earth.

A special thank you to the family and friends who attended and donated to help Christy’s family with her wishes. Now we only ask for prayers for the loved ones left behind as they navigate life without her beautiful soul.

GRACE MARGARET BAUER TUCKER

Grace Margaret Bauer Tucker, 99, of Bonham, Texas passed away Sunday, April 16, 2023, at the Seven Oaks Nursing Home in Bonham, Texas. The family received friends at the Wise Funeral Home Chapel from 10 a.m. until service time at 11 a.m. on Saturday, April 22, 2023. Pastor Lisa Reece officiated. A private family burial followed at Willow Wild Cemetery.

Grace Margaret Bauer Tucker was born in St. Louis, Missouri on November 17, 1923, to parents Gilbert E. and Elsie Sievert Bauer. Grace married Edward Randall Tucker in New Haven, Connecticut in 1943 where he was stationed with the Air Force during W.W. II. Their son, Randy, was born in New Haven in 1944. The Tucker family came to Texas in 1950. Jarrett Leon Tucker their second son was born in Houston, Texas in 1955. As husband and wife, the couple started several businesses including General Aviation and Ed Tucker Distributor, which is now known as Tucker PowerSports.

Grace was a dedicated daughter, wife, mother, and grandmother selflessly giving her time to care for others. She was a Pink Lady hospital volunteer in Irving and continued in Bonham. Her service to the Pink Ladies exceeded 12,000 hours. She loved to work in the gift shop at the hospital. She donated handmade baby blankets that took her many hours of loving work to complete. She also said that she was the gift shop’s “best customer” as she purchased many items for herself and gifts for others. She also enjoyed buying and donating books to the Bonham Public Library. She faithfully attended church and had a true servant’s heart. After the closure of the Zion Lutheran Church in Bonham, she attended the First Presbyterian Church with her children.

She was preceded in death by her husband, Ed Tucker after 59 years of marriage; her son Randy Tucker, and her sister Betty Karay.

Grace leaves to cherish her memories: Son, Jarrett Leon Tucker and wife Rachael of Bonham, Texas. Grandchildren: Melanie Tucker Connelly and husband Brad of Trenton, Texas, Mica Tucker and husband Zach Rodgers of Roanoke, Texas, and Jarrett Leon Tucker Jr. of Bonham, Texas. She is also survived by her great grandchildren Kellie Connelly Pilkinton (Billy) of Bonham, Texas, Brooke Connelly of Trenton, Texas Michael Connelly of Trenton, Texas and Aubrey Rodgers of Waxahachie, Texas. The family would like to thank Seven Oaks Nursing Home and Rehabilitation Center, Heart to Heart Hospice, and faithful friend Toni Mason for their loving care.

Mr. Jim Ed Massey, age 76, of Bonham peacefully passed into our Father’s hands on April 14, 2023, in Bonham, Texas. Jim was born in a small country house on March 25, 1947, in Murphy, Texas, to the late Randolph Lee Massey and Lillie Mae Williford Massey. Jim was the last of three children, two sons and one daughter born in the home. He attended schools in Plano and Murphy, where he was active in sports. Jim’s letter of faith is kept at Murphy Baptist Church, where he made his profession of faith. He met the love of his life, Faye Booe, at the ripe old age of 15 while working at the roller skating rink. They were later married on May 17, 1968, in Garland, Texas, and have shared 60 years of love together. He was an avid roller skater and bowler and enjoyed yearly vacationing with his family along with camping, fishing, and boating activities. Jim loved dining out and would never turn down an invitation for Mexican. He retired from H.J. Heinz as a mechanical maintenance engineer in 2008 providing years of dedicated service.

Jim was preceded in death by his parents and a brother, Dale Massey, and sister Janet McCullough. Titsworth, age 78, of Ravenna, Texas passed away peacefully Thursday, April 5, 2023 at his home with his loving family by his side.

Wayne married the love of his life Brenda Gayle Allen on March 23, 1963 in Atoka,

Oklahoma. He worked for 36 years at the General Cable in Bonham where he retired from in 2005. He loved his horses, his cows and baling hay with his sons and later his grandsons. He loved fishing, hunting, gambling, and going to rodeos to watch his grandson’s rope. He loved spending time with his family, friends and especially his grandchildren and great grandchildren whom he loved dearly.

Wayne will be missed by his loving wife Brenda of Ravenna, Texas; his daughter, Pam Dodson (Dugan) of Ivanhoe, Texas; son, Kelly Titsworth (Laurie) of Telephone, Texas.

Visitation was at 1:00 PM on Saturday, April 8, 2023 with funeral services beginning at 2:00 pm at Cooper-Sorrells Funeral Home in Bonham. Bro. Marty Hutchins and Bro Ronnie Ball officiated. Interment followed at Lamasco Cemetery.

Serving as pallbearers were Jerry Heflin, David Nichols, Ray Gibbs, Billy Pannell, Roy Pannell, and Matt Titsworth.

Joyce Marie Hallmark (Gowan), 68, passed away at home on Sunday, April 16, 2023 surrounded by her family and her beloved dogs. Joyce was born on August 10, 1954 in Havre, Montana. She was a proud member of the Little Shell Tribe of Chippewa Indians of Montana.

Joyce was raised by her parents, Jimmie and Margaret Gowan, and attended schools in Jasper, Alabama, and later in Irving, Texas. She is a graduate of Irving Nimitz High School. Joyce made a career in customer service at Government Records Services, where she met and later married Billy Hallmark; they shared 37 years together. Joyce enjoyed gardening and maintaining her home, both inside and out. She loved estate sales, shopping, and sharing her finds with family and friends. Joyce had a big heart and often took care of her neighbors and those she saw in need. Her daily phone calls made sure to keep the family in touch and on task. One of her greatest loves was to spoil her grandchildren, and she made sure to be there for their ball games, recitals, and band performances. She also adored her dogs, Sophie and Tink, who have been her faithful friends. And at the end of the day, Joyce was known to be found on the back porch with a good cold one.

Joyce will be remembered by her husband, Billy Hallmark of Leonard, Texas; children, Michael Morris of Weatherford, Texas, Amy Shaw and husband, Matt, of Whitewright, Texas, and Angie Eads and husband, Brent, of Whitewright, Texas; grandchildren, Kelby Shaw and wife, Julie, Kendall Shaw, Shelby Eads, Seth Eads and wife, Jade, Devin Eads, and Lilly Eads; great grandchildren, Keylan, Triniti, Xander, and Stevie; mother, Margaret Gowan; brother, Bill Gowan; and sister, Debbie Nass; and many extended family and friends. She was preceded in death by her son, Kris Morris; father, Jimmie Gowan; and siblings, Renee Wallace, Eddie Gowan, Nolan Favel, Lorrie Marinkovich, and Bobby Gowan.

While Joyce did not want a traditional funeral service, she did agree to allow us a casual Celebration of Life BBQ. We invite you to join the family at Branscome Hall in Blue Ridge, Texas, on Saturday, May 6 at noon to celebrate her. BBQ will be provided; feel free to bring a side or dessert to share. Memorials may be made to your choice of animal shelter or youth sports organization.

Sam Rayburn, Bonham, Texas, 75418. The public is invited to attend and comment.

Ordinance Prohibiting Solid Waste Disposal in Fannin County

Section 1. General Provisions and Findings

Whereas, the Commissioners Court of Fannin County, Texas, has both the responsibility and authority to protect the public health, safety and general welfare by prohibiting solid waste disposal in the unincorporated areas of Fannin County, except for those areas designated as solid waste disposal sites, pursuant to the authority of the Texas Health and Safety Code § 363.112 and 364.012; and,

Whereas, solid waste disposal, especially the disposal of solid waste in landfills, is an activity that has high potential to negatively impact the health, safety, and welfare of any community; and,

Whereas, the Commissioners Court has considered current state and federal laws and regulations, and makes that the regulations below, including distances from certain locations included in Section 4, below, are reasonable and necessary for complying with those regulations, and to protect the health, safety and welfare of its citizens.

Section 2. Definitions

The following words and terms, when used in this ordinance, shall have the following meanings, unless the context clearly indicates otherwise.

“Affected Area” refers to area of the county in which solid waste disposal is prohibited.

“Aquifer” refers to any subsurface geological formation, group of formations or part of a formation that is capable of yielding a significant amount of water to a well or a spring.

“Day Care Facility” refers to any real property used for the care of children or the elderly and is registered with the State of Texas as such.

“Facility” refers to any structure or property that is used for processing, storage, or disposal of solid waste or solid waste handling equipment. Including all contiguous land, structures, appurtenances, and other improvements on the land, used for processing, storing, or disposing of solid waste. The term includes a publicly or privately owned solid waste facility consisting of several processing, storage, or disposal operational units such as one or more landfills, surface impoundments, or a combination of units.

“Fault” refers to an area that has fractured along the crust of the earth and has two sides that have moved in relation to each other.

“Floodplain” refers to any area in the 100-year floodplain that is susceptible to being inundated by water from any source or that is identified by the Federal Emergency Management Agency on flood insurance rate maps, flood boundary and floodway maps under the National Flood Insurance Act of 1968 (42 U.S.C. Sections 4001 through 4129).

“Health Care Facility” refers to any real property that provides medical care or treatment under the direction of a licensed physician to four or more persons unrelated to the proprietor or operator of the facility. Includes public or private hospitals, skilled nursing facility, intermediate care facility, ambulatory surgical facility, family planning clinic that performs ambulatory surgical procedures, rural or urban health initiative clinic, kidney disease treatment facility, inpatient rehabilitation facility, and any other facility designated a health care facility by federal law.

“Individual Residence” refers to any structure intended to serve as the primary residence of, and is inhabited by, a human being. A structure is presumed to be an individual residence if it is designed for human residential habitation.

“Industrial Solid Waste” means solid waste resulting from or incidental to a process of industry, manufacturing, mining, or agricultural operations.

“Historic Site” refers to any real property that is included on the National Register of Historic Places, designated as a Texas Historic Landmark, designated as a State Archeological Landmark; is determined to qualify as eligible property under criteria for inclusion on the National Register of Historic Places, as a Recorded Texas Historical Landmark or as a State Archeological Landmark; or has been designated as such by the actions of a county commissioners court or city council.

“Municipal Solid Waste” means solid waste resulting from or incidental to municipal, community, commercial, institutional, or recreational activities, and includes garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and other solid waste other than industrial solid waste.

“Neighborhood” refers to any manufactured or mobile home development, apartment or condominium complex, subdivision, or community having a total of nine or more individual residences or residential units and an overall density of one residential unit or more per acre; an area designated as a residential zoning district by a governing ordinance or code or an area in which the principal permitted land use is for private residences; a subdivision for which a plat is recorded in the real property records of the county and a majority of the lots of which are subject to deed restrictions limiting the lots to residential use.

“Park” refers to any real property owned or operated or so designated by a unit of federal, state, or local government as such; and any land so designated in an adopted parks plan of a city or county.

“Places of Worship” refers to any enclosed structure that is owned by a religious institution or organization and that is used primarily as a place of regular group ceremony or meditation, education, and fellowship, the purpose of which is to manifest or develop reverence, homage, and commitment in behalf of religious faith.

“Public Surface Drinking Supply” refers to any surface water supply utilized for public drinking water supply.

“Scenic Road” refers to any road or highway in an area containing natural and scenic qualities of at least regional significance designated by federal, state, or local governments. “School” refers to any real private or public property, attendance at which satisfies the compulsory school attendance requirements of §§25.085 and 25.086, Education Code, as they existed on the effective date of this ordinance.

“Solid Waste” means, subject to the limitations of 42 U. S. C. § 6903 (27) and 40 C. F. R. § 261.4 (a) garbage, rubbish, refuse, sludge, from a waste treatment plant, water supply treatment plant, or air pollution control facility, and other discarded material, including solid, liquid, semisolid, or contained gaseous material resulting from industrial, municipal, commercial, mining, and agricultural operations and from commercial and institutional activities. The term:

(A) does not include:

(i) solid or dissolved material in domestic sewage, or solid or dissolved material in irrigation return flows, or industrial discharges subject to regulation by permit issued under Chapter 26, Water Code;

(ii) soil, dirt, rock, sand, and any other natural or man-made inert solid waste materials used to fill land if the object of the fill is to make the land suitable for the construction of surface improvements; or

(iii) waste materials that result from activities associated with the exploration, development, or production of oil or gas or geothermal resources and other substance or material regulated by Railroad Commission of Texas under Section 91.101, Natural Resource Code, unless the waste, substance, or material results from activities associated with gasoline plants, natural gas liquids processing plants, pressure maintenance plants, or repressurizing plants and is hazardous waste as defined by the administrator of the United States Environmental Protection Agency under the federal Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act, as amended (42 U.S.C. § 6901 et seq.); and,

(B) does not include hazardous substances.

“Solid Waste Processing and or Disposal Facility” refers to any land, structures, appurtenances, and other improvements on land, used for management or disposal of solid waste, including any incinerator, landfill, transfer station, materials recovery facility, land application, beneficial use, or composting site. This includes both publicly and privately owned facilities.

“Tourist Attraction” refers to any area designated as such by the federal government, state, city council or county commissioners court.

“Water Well” refers to any well, registered with TWDB/TCEQ used to supply or is capable of supplying potable water.

“Wetlands” refers to a transitional land between terrestrial and aquatic systems where the water table is usually at or near the surface or the land is covered by shallow water, and conforms to the Army Corps of Engineers’ definition.

Section 3. Approved Areas for Disposal in Unincorporated Areas of Fannin County

Fannin County designates the following areas for exemption under these regulations:

1. Any area with a current TCEQ Permit covering activities referenced in these regulations, as of the Effective Date, subject to Section 8., “Withdrawal or Return of Permit,” below; and

2. Any area which is the subject of an application for permit or other authorization under Texas Health and Safety Code Chapter 361 covering activities referenced in these regulations, subject to Section 8, “Withdrawal or Return of Permit,” below. This exemption applies only to geographic locations and permit parameters included in a pending application(s) as of the Effective Date, and does not exempt the application of these regulations to operations or location not included in such currently-pending application(s).

Section 4. Siting Criteria for Solid Waste Processing and Disposal Facilities

Processing and or disposal of solid waste may only occur if the following conditions are met:

(a) facility perimeter is located at least 2,640 feet from a school;

(b) facility perimeter is located a least 2,640 feet from public or private water wells;

(c) facility perimeter is located at least 10,000 feet from neighborhoods;

(d) facility perimeter is located at least 2,640 feet from individual residences;

(e) facility perimeter is located at least 2,640 feet from day cares facilities;

(f) facility perimeter is located at least 2,640 feet from places of worship;

(s) facility perimeter is not located within a seismic impact zone;

(t) facility perimeter is not located within any unstable area;

(u) facility is not in the watershed of the Bois d’ Arc Lake Reservoir;

(v) facility perimeter is located at least 5,000 feet from the shoreline of Bois d’ Arc Lake Reservoir;

(w) facility is not in the watershed of the Lake Ralph Hall Reservoir;

(x) facility perimeter is located at least 5,000 feet from the shoreline of Lake Ralph Hall Reservoir;

(y) facility is not in the watershed of the Lake Bonham Reservoir;

(z) facility perimeter is located at least 5,000 feet from the shoreline of Lake Bonham Reservoir:

(aa) facility does not create conditions which make traffic flow unsafe. This section does not apply to:

(a) areas within a municipality;

(b) any area that has applied for a permit or received authorization from TCEQ prior to the issuance of this ordinance’s Effective Date, but only to the extent those areas are exempted under Texas Health and Safety Code § 364.012(e);

(c) temporary sites established to handle demolition and debris from a natural disaster; or

(d) Any activities regulated by Texas Health and Safety Code § 361.090, “REGULATION AND PERMITTING OF CERTAIN INDUSTRIAL SOLID WASTE DISPOSAL,” but only to the extent those areas are exempted under Texas Health and Safety Code § 364.012(g). Unless restricted by state or federal law.

Section 5. Civil Remedies and Penalties

(a) Violations of this Ordinance are subject to criminal penalties to the extent allowed by state law and a civil penalty of $10,000 for each violation. Such penalty is to be forfeited to Fannin County, Texas. Each day that a violation continues constitutes a separate ground for recovery.

(b) The Fannin County Commissioners Court may bring a legal action to enjoin violations of this Ordinance and seek judgment for civil penalties.

Section 6. Severability

If any portion of this ordinance is deemed to be in violation of the statutes or the constitution of this state or the United States by a court of competent jurisdiction, said portion shall be severed, and the remaining portions of the ordinance shall remain in full force and effect.

Section 7. Withdrawal or Return of Permit

In the event that an application for permit or other authorization under Texas Health and Safety Code Chapter 361, et seq., which was pending before the Texas Commission of Environmental Quality at the time of the adoption of this Order for an area listed in Section 3 of this order is withdrawn by or returned to the applicant, or if a permit is overturned by a final appeal, then such area shall be removed from Section 3 of this Order and unincorporated areas of Fannin County.

Section 8. Effective Date

These regulations are effective as of the date of adoption, ____________________, 2023.

APPLICATION AND PRELIMINARY DECISION. City of Savoy, P.O. Box 176, Savoy, Texas 75479, has applied to the Texas Commission on Environmental Quality (TCEQ) for a renewal of Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0014273001 which authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 150,000 gallons per day. TCEQ received this application on January 19, 2023.

The facility is located at 601 North Cedar Street, in Fannin County, Texas 75479. The treated effluent is discharged to an unnamed tributary, thence to Valley Lake, thence to Brushy Creek, thence to Red River Below Lake Texoma in Segment No. 0202 of the Red River Basin. The unclassified receiving water uses are minimal aquatic life use for the unnamed tributary and high aquatic life use for Valley Lake. The designated uses for Segment No. 0202 are primary contact recreation, public water supply, and high aquatic life use. All determinations are preliminary and subject to additional review and/or revisions. The TCEQ Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if approved, would establish the conditions under which the facility must operate. The Executive Director has made a preliminary decision that this permit, if issued, meets all statutory and regulatory requirements. The permit application, Executive Director’s preliminary decision, and draft permit are available for viewing and copying at Savoy City Hall, 405 East Hayes Street, Savoy, Texas.

PUBLIC COMMENT / PUBLIC MEETING. You may submit public comments or request a public meeting about this application. The purpose of a public meeting is to provide the opportunity to submit comments or to ask questions about the application. TCEQ holds a public meeting if the Executive Director determines that there is a significant degree of public interest in the application or if requested by a local legislator. A public meeting is not a contested case hearing.

OPPORTUNITY FOR A CONTESTED CASE HEARING. After the deadline for submitting public comments, the Executive Director will consider all timely comments and prepare a response to all relevant and material, or significant public comments. Unless the application is directly referred for a contested case hearing, the response to comments will be mailed to everyone who submitted public comments and to those persons who are on the mailing list for this application. If comments are received, the mailing will also provide instructions for requesting a contested case hearing or reconsideration of the Executive Director’s decision. A contested case hearing is a legal proceeding similar to a civil trial in a state district court.

TO REQUEST A CONTESTED CASE HEARING, YOU MUST INCLUDE THE FOLLOWING ITEMS IN YOUR REQUEST: your name, address, phone number; applicant’s name and proposed permit number; the location and distance of your property/activities relative to the proposed facility; a specific description of how you would be adversely affected by the facility in a way not common to the general public; a list of all disputed issues of fact that you submit during the comment period; and the statement “[I/we] request a contested case hearing.” If the request for contested case hearing is filed on behalf of a group or association, the request must designate the group’s representative for receiving future correspondence; identify by name and physical address an individual member of the group who would be adversely affected by the proposed facility or activity; provide the information discussed above regarding the affected member’s location and distance from the facility or activity; explain how and why the member would be affected; and explain how the interests the group seeks to protect are relevant to the group’s purpose.

Following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for reconsideration or for a contested case hearing to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.

The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material water quality concerns submitted during the comment period. TCEQ may act on an application to renew a permit for discharge of wastewater without providing an opportunity for a contested case hearing if certain criteria are met.

EXECUTIVE DIRECTOR ACTION. The Executive Director may issue final approval of the application unless a timely contested case hearing request or request for reconsideration is filed. If a timely hearing request or request for reconsideration is filed, the Executive Director will not issue final approval of the permit and will forward the application and request to the TCEQ Commissioners for their consideration at a scheduled Commission meeting.

Press Release - Doc Holliday Saints and Sinners Festival will be held on Saturday, April 29, 2023 from 9-5 in Downtown Denison. With Bandits, Bluegrass, and Barbecue on Friday evening that kicks off the weekend, Saturday will feature fun for the entire family with many free events.

A petting zoo and pony rides will be $5 each and this year, it will be in the Katy Park in front of the Katy Depot. Visit the Red River Railroad Museum at 124 W. Main (donations accepted). As you move up the street, visit the awesome businesses Downtown

Denison has to offer. You’ll see some familiar faces and some new ones too.

At Heritage Park, the Heroes of the Old West are the most popular attraction with gunfights at 10:30, 1:30, and 4:30. They’ll be there the rest of the day for photos and just talking to the visitors. Burton Gilliam of Blazing Saddles will be joining them throughout the day!

A selection of live music will be on the main stage with Ann House, Tim Rogers, Rust and Lace, Salt Creek Bluegrass Band, Frontier Brigade Band, The Lindsey Family, Sweet Song String Band, and the

Red River Valley Dulcimer Club. The Tribal Evolution Belly Dancers will perform their vaudeville steampunk show. A best dressed contest will be held at 1:00 before the beard and mustache contest.

In the 500 Block of Main, you will experience vendors and food. The Red River Valley Dulcimer Club will be playing throughout the day.

The Denison Arts Council will have their 517 Gallery open with an art show and from 1-3:00 p.m. they will feature ghost stories, poetry, and music by Blue GrassFire. Across the street in the Senior Center, there will be artists,

makers, and crafters with demonstrations and sales. Some of the demonstrations will include quilting, painting, woodcarving, ink making, fiber arts, ceramics, and a luthier. There will also be children’s activities and genealogy research by the Preston Trail Chapter of the NSDAR.

Just up the street at the 700 Block of Main, there will be an old west encampment with special guests Dale and his horse Penny and music by Rickey Pittman and Jeff Coleman. Kids activities will feature panning for gold, kid roping, and horse shoe throwing.

will have a camp meeting for all the saints and sinners at 3:30. The Downtown Denison Farmers Market will be there all day for their season opener. A parade will be held at 2:00 p.m. and many of the characters throughout the day will appear in horse drawn carriages. The carriages and wagons will be shuttling people up and down Main Street for free the rest of the day (except for during the gunfights!).

Other activities will feature a car show in the morning on Fannin next to the event. The Studebaker museum will be

open all day. And St. Lukes Episcopal Church will be celebrating 150 years with an open house from 9-1 p.m. Tour the church with the original interior from Doc’s days. On Friday night, Bandits, Bluegrass, and BBQ festival will be held in Heritage Park from 6-9PM. You can enjoy live bluegrass bands, BBQ sales, and photo ops with old west reenactors. The event is a fundraiser for the Boys and Girls Club of Denison, come show your support! This event is free to the public. The live bluegrass music features: The Western Flyers and Hot Pickin 57's.
