Fannin County Commissioners Court – Burn Ban Extended One Week

regarding her salary.

Tuesday, September 3, 2024, Fannin County Judge Newt Cunningham called to order at 8:30 a.m., a Special Meeting of the Fannin County Commissioners Court. Quorum was established with all County Commissioners and County Judge present.

2. Appeal regarding septic permit Application# 2024-142, Zachary and Steve Bergenholtz: Judge Cunningham began by noting this appeal had to do with a decision made based on an ordinance on the books since February 2009. After Judge Cunningham’s statement, Certified Community Planner Andrew Mack began his comments regarding his client’s request for an appeal of the decision to deny a septic permit for 3 residences they wish to build on their 1.6 acres. He referred the court to documentation given to them the Tuesday prior; and began his list of reasons for the court’s consideration.

3. Discussion, consideration and action regarding appeal of septic permit Application# 2024-142, Zachary and Steve Bergenholtz: After Mr. Mack cited passages of state law dealing with this matter and communication received from FC’s Director of Development Services Di Hopkins and communication from TCEQ regarding their approval for their request to be granted, Judge Cunningham noted the court has been enforcing the law involving the rule of one residence on one acre consistently since 2009 as they are not allowed to be inconsistent with how the law is enforced. A lengthy discussion ensued regarding the interpretation of the law and concluded with Mr. Mack being told the court was following legal counsel given them and him being asked to direct all future communication with the Judge. A motion was made by Commissioner Magness to stand with decisions already made that was seconded by Commissioner Kopf with Commissioner McQueen adding an amendment to the motion that any future contact on this matter be only with Judge Cunningham. The vote was taken with Judge Cunningham abstain-

ing and the motion passed. Judge Cunningham clarified with the passing of the motion; the appeal was denied.

4. Public Forum: There were no speakers.

5. Adjourn: The meeting adjourned at 8:52 a.m. On the same day at 9:00 a.m., after Judge Cunningham noted Quorum had been established, he called to order the Regular Meeting of the Fannin County Commissioners Court. Pastor Kevin McClain of the First Methodist Church of Leonard led the Invocation. Major James Manis, Retired, led the Pledges.

4. Introductions: Judge Cunningham recognized FC Commissioner Elect Troy Waggoner and FC Democratic Chair Bill Roberts.

5. Public Forum: FC resident Molly Hayes reminded all of the upcoming election, next week’s presidential debate and those needing to register to vote, to do so 30 days prior to the election. FC resident Jason Wallker commented on the decision made last week to progress with the sale of the acreage near the MultiPurpose Facility and how if the court is to be selective with who purchases the land, the option they chose with the real-estate agreement does not provide that ability as the option they chose will cause the land to go to the highest bidder. The consultant representing the Bergenholtz’s, Andrew Mack, spoke to have additional comments on the

Texas Civil Law pertaining to his client’s appeal request, added to the county’s records.

ROUTINE ITEMS:

6. Approve payment of bills – County Auditor: FC Auditor Alicia Whipple noted bills were $272,386.27 and payroll was $313,832.85. A motion was made by Commissioner Magness to approve payment with Commissioner Kopf seconding the motion which passed.

10. Cancel or extend current Fannin County Burn Ban – Emergency Management Coordinator: FC Emergency Management Coordinator Troy Hudson gave reasons why the ban should be extended one more week. The motion was seconded by Commissioner Kopf and passed.

11. Authorize County Auditor to move $1,000.00 from Forfeiture Funds (560-103-560) to Miscellaneous (560-560-4900) for the payment of a Texas Commission on Law Enforcement Fee – Sheriff Johnson: This was passed on to await documentation from the Sheriff’s office.

A discussion ensued about how this would assist in keeping Fannin County a more rural county before a motion was made by Commissioner Magness to approve adding the proposed language with Commissioner Kopf seconding the motion which passed.

14. Discussion and possible action regarding Section 1B-8, Political Activity, of the Fannin County Employee Handbook - County Judge: FC Democratic Chair Bill Roberts began by noting there were two personnel manuals online with one from 2014 and one from 2023. It was suggested the older version be removed. He then requested a change to 1B-8 to be more equitable to county employees as well as requesting the last paragraph in that section to be removed. He requested the current county policy regarding employees working under an incumbent supervisor having to resign their job to run for that supervisor’s position be

reconsidered to avoid the loss of experienced county personnel. A discussion ensued with Judge Cunningham explaining how this policy has been in place for some time and his understanding behind the reasoning for it before Commissioner Kopf voiced his desire the rule remain in place due to problems having occurred in the past. FC resident Jason Walker also voiced his opinions and his suggestion that the rule be changed to be applied only when the incumbent supervisor is one who is in their position via being voted in by the county and not appointed by a committee and the court. At the conclusion of the discussion, no action was taken.

15. Approve estimate from Noble Resources for termite treatment in the Courthouse basement; $1,400.00, to be paid from Contingency – County Auditor: Alicia Whipple explained the need for this and detailed the services that would be provided. A motion was made by Commissioner Magness to approve with Commissioner Kopf seconding the motion which passed. In response to Judge Cunningham’s inquiry, Ms. Whipple noted as of today there was $89,937.31 in the Contingency budget to serve until Oct 1st of this year.

9/10/24

Jed Davis, age 80, of Bonham, TX found his wings on Wednesday, August 28, 2024. Jed was born December 22, 1943 in Ft. Worth, TX to the late J.O. and Carmen Otis Davis. Jed was a beloved husband, father, and grandfather, but to his grandson, he was also a hero. Jed was fiercely independent, opinionated, purposeful, and planned. He loved to laugh, whistle little tunes, and sing in the car to old country music with the windows down and the sun on his face. He had an easy smile, and his quick humor was warmly sarcastic, slightly mischievous, and always, always funny. He could fix almost anything and enjoyed working in his shop to rig solutions for whatever problem presented itself. He loved to fish, and he was happiest tossing a line into the water at sunset from the cedar benches on the dock he built himself; the only thing better was company to enjoy it with. He made friends easily and believed that blessings granted were blessings to be shared. He treasured his late wife Linda, and he wanted nothing more than to see those he loved safe, healthy, and happy. If he loved you, you felt it without any doubt.

Those left to cherish Jed’s memory include: one daughter, Jamie Henning; two grandchildren Gage Henning and Kaja Henning; one sister Virginia Allen of Brownwood, TX; his cousins Meg Johnston of Largo, FL and Jess Larson of Grand Rapids, MI; his caretaker and friend Lisa Kelly of Bonham, TX; and many others touched by his kindness and friendship through the years.

God’s Patience Is Limited

for the Ivanhoe Church of Christ

Many, think of God as a God of love only. God is also a God of judgement and has “appointed a day, in the which he will judge the world” (Acts 17:31). God is longsuffering with humanity, but His patience is limited. Peter reminds us that God brought “in the flood upon the world of the ungodly” (2 Peter 2:5) in the days of Noah. God allowed Noah to preach to the people, “when once the longsuffering of God waited” (1 Peter 3:20). God will judge the world. Paul penned that we “judge nothing before the time, until the Lord come, who both will bring to light the hidden things of darkness, and will make manifest the counsels of the hearts” (1 Corinthians 4:5). Jesus said that “of that day and that hour knoweth no

man, no, not the angels which are in heaven, neither the Son, but the Father” (Mark 13:32). We find that “the Lord is not slack concerning his promise, as some men count slackness; but is longsuffering to us-ward, not willing that any should perish, but that all should come to repentance” (2 Peter 3:9). God desires that all men would “fear God, and keep His commandments,” “for God shall bring every work into judgment, with every secret thing, whether it be good, or whether it be evil (Ecclesiastes 12:13-14).

Again, Peter reminds us that “the Lord knoweth how to deliver the godly out of temptations, and to reserve the unjust unto the day of judgment to be punished” (2 Peter 2:9).

There is comfort when we obey God. Paul comforts Christians by writing “And to you who are troubled rest

Sunday Morning Re-Wind “A Bridge You Cannot Burn”

Hello everyone!

The Bible tells us in James 5:19-20, “Brethren, if any of you do err from the truth, and one convert him; let him know, that he which converteth the sinner from the error of his way shall save a soul from death, and shall hide a multitude of sins.”

James concludes his letter with a challenge to us, as believers, to try to bring back those among us who have wandered away from the truth, and out of the will of God. He refers to those who were once part of the community of believers who have lost their way, who may have become spiritually weak, those who were possibly never true believers in Christ in the first place, and were merely just going through the motions as part of the Christian community. James doesn’t address how we might accomplish this rescue, but that we should put forth the effort. Just reaching out to someone who has gone astray from God, with grace and compassion, can sometimes be enough to bring them back into His fold. This attempt should always be made with

genuine love and concern for their souls. Remember that James is not speaking of condemnation, arrogance, or judgment, but rather of a sincere interest, and a loving effort, to help others by letting them know that no matter how far they have wandered away from God, there is always a bridge back to Him. He sent His only begotten Son, Jesus Christ, to give His life on the cross, so that we can be saved by His grace, through our faith in Him, and that we can always have that bridge back to Him whenever we stumble and stray from His will for our lives. This is certainly a bridge that you cannot burn. When I was reading this passage in preparation for this, I couldn’t help but remember

Letter to the Editor

Where Are They?

One thing I’ve noticed from watching my parents campaign for candidates during the past four election cycles is the absence of candidates who lost their primary elections. Most, if not all, of these candidates who were not incumbents, and lost to their opponents, have disappeared from the public scene altogether. The candidates I’m writing about attended local fund raisers, candidate forums, civic groups, parades, Commissioner’s Court, meetings of the Fannin County Republican Women and other venues where they could meet and greet potential voters. These candidates typically drove vehicles wrapped with eye-catching slogans announcing their

air-conditioned atmosphere. Mark your calendar for October 19, from 12 PM to 9 PM, to support this vital cause. The event is free for all, and there's plenty of live entertainment, games, activities, and much more! This year's theme is “Rock Out Cancer.”

We also invite all cancer survivors to a complimentary meal from 4:00 PM to 5:00 PM in the BHS cafeteria during the main event.

The funds raised will aid the American Cancer Society in financing research and providing essential early detection programs and services for cancer patients and their families in our community. Cancer impacts our Texas community in significant ways:

values and the public office they were seeking. During the months preceding the primary election, these candidates declared that they want to SERVE THE CITIZENS OF FANNIN COUNTY. If these candidates really wanted to serve the citizens of Fannin County, why are they not continuing to show-up and serve the county as ordinary citizens? Why were they not serving the county in some fashion before they ran for elected office? My “two cents” is that they never really cared about serving the citizens of Fannin County in the first place; they merely wanted to get a relatively well-paying job close to home. The candidates I’m describing are not public servants…they appear to be politician “wannabes,” whose aim was to push a

- Nearly 145 women per 100,000 are diagnosed with breast cancer, the most prevalent form of cancer, followed by prostate and lung/ esophageal cancers.

- In 2023, approximately 139,100 new cancer diagnoses were recorded in Texas.

- Around 44,140 Texans lost their lives to cancer in 2023.

- Texas received over $2 billion ($2,087,975,055) in state funding in 2022 from the National Cancer Institute and the National Institutes of Health.

- Funding related to cancer research supports 36,721 jobs in Texas. Our mission is to eliminate cancer for everyone, everywhere, and we need the support of our entire community to make this a re-

personal agenda or an agenda of someone else.

There is one notable example of a candidate who won his race for commissioner and who did not serve Fannin County in any capacity before the primary and doesn’t even attend Commissioner’s Court, now that he’s been elected. Does this candidate represent a public servant? He doesn’t meet my definition of a public servant…does he meet yours? True public servants will be serving the county BEFORE, DURING AND AFTER their run for office. Check to see what your favorite candidate has been doing for the county prior to election season; it will be a good indication of what they will do afterwards.

a song that I first heard over 20 years ago. I absolutely love the message in this song, and around the middle of last year, I started singing it in church.

with us, when the Lord Jesus shall be revealed from heaven with his mighty angels, in flaming fire taking vengeance on them that know not God, and that obey not the gospel of our Lord Jesus Christ: who shall be punished with everlasting destruction from the presence of the Lord, and from the glory of his power” (2 Thessalonians 1:7-9). There should be fear when we disobey God. Jesus said, “And these shall go away into everlasting punishment” (Matthew 25:46). The Hebrew writer penned, “It is a fearful thing to fall into the hands of the living God” (Hebrews 10:31). We must understand that God is a loving God and that he desires us to be successful in eternity, but we all make that choice. God will judge that world. “He has appointed a day” (Acts 17:31). Parvovirus

Parvovirus is a highly contagious disease of the gastrointestinal (GI) tract of dogs – while puppies are most susceptible, it can affect adult dogs and wild dogs. It is spread in the stool and can stay in the environment for years. In Fannin County, that means the coyote population is probably partly to blame for the high numbers of puppies infected each year. The small intestines are lined with finger-like projections that help to absorb nutrients

from food. When parvo attacks, it kills those cells at the base, wiping out the lining of the GI tract; leading to diarrhea (+/- blood), vomiting, poor appetite, and severe weakness. In severe cases the bacteria from the gut can get into the bloodstream and cause infection of the nervous system. The 3 main causes of death in a parvo puppy are: dehydration, low blood sugar and bacterial infection. Since this is a virus, all we can do is offer supportive care while

the dog’s body fights the infection. The best supportive care option is to hospitalize the dog to get IV fluids with sugar in it, IV medications, and a feeding tube until they can eat on their own and have normal stool – approximately 90% of hospitalized patients will survive. Recovery can take 5 – 7 days which can get quite costly when spent in the hospital, so home-care protocols have been developed that are approximately 80% effective. The good news is that there is now a biologic treatment that allows us to give a dog antibodies to the virus directly by an IV injection. This allows the body to mount an effective immune response to prevent the fatal events associated with the virus. In clinical trials and in the cases we have seen at Leonard Animal Clinic, all the puppies have made a complete recovery. The best news is parvovirus is avoidable with proper vaccination, including boosters. There are multiple strains of parvovirus. There are some variations in the strains that are put in overthe-counter vaccines and those that are given by a veterinarian. Vaccinations must also be stored and given properly to be fully effective.

Fannin County Purchasing Agent Appointed

Press Release - The Fannin County Purchasing Board, after a diligent search, review of more than 50 resumes and conducting interviews, has selected and appointed Julie Criswell as Purchasing Agent for Fannin County. Ms. Criswell received her Oath of Office

Monday, August 26, 2024 from Judge Laurine Blake, Chairman of the Purchasing Board. Also in attendance was Board Member, County Judge Newt Cunningham. The Purchasing Board is comprised of any and all District Judges with jurisdiction in Fannin County

Pecan Gap NEWS

The First Baptist Church of Pecan Gap fed the Falcon Football Team, Cheerleaders, Falcon Force and Falconettes before the football game Thursday afternoon. Jan Moore prepared delicious chicken spaghetti and rigatoni, buttered corn, salad and rolls, with Brownies for dessert. All of the food was delicious! Servers were: Peggy Jean Durham, Mary Ann Moss, Karen Pickard (school board member) and Cindy Donnell. The coaches and all of the students enjoyed it so much and want to thank the First Baptist Church of Pecan for their thoughtfulness and support of the Fannin-

del football team and spirit groups. The Fighting Falcons beat the Campbell Indians Thursday night in what was a back and forth gridiron opener. Both teams led in the game many different times with the Falcons coming out in the win column by a score of 44-38. It was a very interesting home opener to say the least. With about 8 minutes remaining in the second quarter, one of the four Thursday night lights went out. Then a minute or so later, a second, then a third, and with about 4 or 5 minutes left until halftime, the fourth and final light tower went out. So we were all in the dark. Actually, ALMOST dark. You could still see just a

and the Fannin County Judge. The purchase order system was implemented April 9, 2007 by District Judges Jim Lovett and Laurine Blake. The function of the purchasing department is to ensure a transparent system of purchases by County employees and Elected Officials in compliance with the law. This process requires that every purchase made begins with a requisition or competitive bid. The Purchasing Agent is the only person who can purchase items, including service contracts, on behalf of Fannin County. The bid process involves the Commissioners Court and Purchasing Agent working together to facilitate any purchases of goods

very small amount. Well of course the drill team girls said, “Coach Beeler, can we perform in the dark? Please?!” I replied, “Well the majorettes used to so why not?!” Of course they had fire on the end of their batons when doing it but I let them. They were so eager to perform one of their dance routines that they learned at Camp and practiced all summer. Actually while they were performing one of the light towers started slowly coming back on so people could see them somewhat, especially the sparkling gold sequins!

Two more light towers came back on and the game was finished with three out of the four towers and we could see plenty good with those. Hope-

or services above $50,000. The process is designed to assure that the County obtains goods and services at the lowest and best bid. “It has been the goal of the Purchasing Board to set forth clear policies and procedures for county employees and elected officials so they are in compliance with the law when making any purchases. Purchasing Agent Criswell will provide the leadership and support for these individuals so they can perform the duties of their respective offices. This extra layer of protection when expending tax payer dollars can require more time, but by planning ahead, minimal delay is involved”, state Judge Blake.

fully the problem will be resolved before our next home game. The Campbell Indians played a great game and fought valiantly until the very end. They certainly have nothing whatsoever to hang their heads about and I wish them the best of luck on the remainder of their season. After the game was over, good sportsmanship was exhibited by both teams shaking hands and forming a big circle where the coaches of both teams gave compliments to the other school and its team. Fannindel travels to Savoy tonight with the Junior High game beginning at 5:00, followed by the Varsity at 7:30. Until next week, “Keep looking up, ‘cause that’s where it all is.” -Kidd Kraddick

History, noun :

a record of significant events (such as those affecting a nation or institution) often including an explanation of their causes. There are 132 Historical Markers in Fannin County according to the Texas Historical Commission (THC) website. Each week I will search the County and post a pic along with the Marker location and the Marker text. If you have a specific Marker you want to see in the Leader, email the pic to fcltimmeek@gmial.com “A generation which ignores history has no past and no future.”

Gober Garage

Marker Text: Vernon C. Shive and John N. Glover operated a garage in Gober as early as 1933. After Shive died in 1944, John and Ruth Glover acquired a full share in the Gober Garage. In 1956, E. F. Anderson built a new facility with clay tile walls and steel trusses and windows. This vital community business offered maintenance and repair services for automobiles and farm equipment. It also became a community meeting place for farmers taking a break from their fields. Glover’s family continued to operate the Gober Garage after his death in 1994, but the business closed a few years later. Its story reflects the dependence of many rural Texas towns on transportation in the 20th century. Context: Settlers began to arrive in a small community located 10 miles SE of Bonham. The year was 1840. The town’s first name was Grittersville because it was the home of one of the town’s first businesses, a steam powered gristmill. In 1845 it had a general store, a grist mill, a cotton gin and a post office. The first postmaster appointed to Gober was James Christian. The community experienced an increase in surrounding farms and in 1879 postal service was begun. In 1885 Jim Eads, Charlie Stafford and Lijah Peters helped lay off the present township and the name was changed from Grittersville to Gober in honor of J.F. & William Gober, the builders of the gristmill.

Seeking Success Sans Seniors: Underclassmen mostly populate Lady Hornets' v'ball roster in '24

The 2023 Dodd City graduate competed for ECU in the season-opening Rogers State Invitational in Tulsa, Okla., on Aug. 31, 2023, before a stress fracture sidelined her for the remainder of the season.

The two-sport collegiate athlete recovered in time to compete in her first college softball season, earlier this year.

DODD CITY -- Graduation took away three all-district seniors -- the most valuable player, the offensive player of the year and a first-team selection in 19-1A in 2023 -- who helped Dodd City last fall reach its second-straight Region III-1A volleyball quarterfinal.

No seniors populate its roster this season.

Instead, the Lady Hornets will look to another trio of all-district on-court recipients from 2023 and others to add to the program's longtime successful history in the sport -- already assured of another postseason.

Junior Addison Weeks heads that awarded group of veterans. Weeks earned the all-district setter of the year superlative in 2023.

Sophomore Emma Garner, a second-team recipient, and junior Kenzi Freeman, an honorable mention, complete the trio.

Dodd City also has a familiar face at the helm, as Landon Dyer, assistant the previous three years, now heads the school's volleyball and girls' basketball programs. Rodney Durham, a newcomer to the school, assists Dyer.

Realignment in February changed the Lady Hornets' district from 19-1A to 21-1A, but Ector and Savoy remain as their competition, as Dodd City determines how it will enter -- its 30th postseason in the last 35 years.

District play will begin on Oct. 15, when Savoy visits.

Dodd City improved on Sept. 2 in the Class 1A volleyball poll, as the Texas Girls Coaches Association rankings for the sport expanded to include the Top 20 per classification. The Lady Hornets (11-6)

rose two spots to No. 6 in the 1A rankings, where defending 1A State champion Blum remained on top. Paris North Lamar at No. 13 and Texarkana Pleasant Grove at No. 17 joined the 4A poll where Wimberley replaced San Antonio Davenport in the top spot. Both newcomers to the rankings equate members of District 14-4A with Bonham. Bells ranked at No. 12 in 3A where Goliad now leads. Crawford stayed atop the 2A poll which also included No. 3 Detroit and No. 9 North Hopkins.
